To what extent should parents be able to choose the kind of child they have? The unfortunate phrase 'designer baby' has become familiar in debates surrounding reproduction. As a reference to current possibilities the term is misleading, but the phrase may indicate a societal concern of some kind about control and choice in the course of reproduction. Typically, people can choose whether to have a child. They may also have an interest in choosing, to some extent, the conditions under which (...) they do so, such as whether they have a child with a serious disability or disease. The purpose of this book is to explore the difficult and controversial question of the appropriate ethical and legal extent of reproductive autonomy in this context. The book examines ethical, legal and public policy issues in prenatal screening, prenatal diagnosis (PND), selective abortion and preimplantation genetic diagnosis (PGD). It explores the ethics of these selection practices and the ability of current ethical guidelines and legal mechanisms, including the law on selective abortion and wrongful birth, to deal with advances in genetic and other knowledge in these areas. Unlike in the United States, in England the relevant law is not inherently rights-based, but the impact of the Human Rights Act 1998 inevitably raises questions about the proper scope of reproductive autonomy in this context. The implications of the analysis are considered for the development of relevant law, public policy and ethical guidelines and will be of interest to academics in medical law and ethics, health professionals, lawyers, those working on public policy and students with an interest in these issues. The rapid development of machine-learning algorithms, which underpin contemporary artificial intelligence systems, has created new opportunities for the automation of work processes and management functions. While algorithmic management has been observed primarily within the platform-mediated gig economy, its transformative reach and consequences are also spreading to more standard work settings. Exploring algorithmic management as a sociotechnical concept, which reflects both technological infrastructures and organizational choices, we discuss how algorithmic management may influence existing power and social structures within organizations. We identify (...) three key issues. First, we explore how algorithmic management shapes pre-existing power dynamics between workers and managers. Second, we discuss how algorithmic management demands new roles and competencies while also fostering oppositional attitudes toward algorithms. Third, we explain how algorithmic management impacts knowledge and information exchange within an organization, unpacking the concept of opacity on both a technical and organizational level. The notion that eukaryotes are ancestrally sexual has been gaining attention. This idea comes in part from the discovery of sets of “meiosis‐specific genes” in the genomes of protists. The existence of these genes has persuaded many that these organisms may be engaging in sex, even though this has gone undetected. The involvement of sex in protists is supported by the view that asexual reproduction results in the accumulation of mutations that would inevitably result in the decline and extinction of (...) such lineages. It is argued that this phenomenon can be obviated by polyploidy and that the “meiosis‐specific genes” are used in other processes, including polyploidy control and homologous recombination, independent of meiosis. These phenomena account for the finding that these genes are expressed in cultures devoid of apparent cell fusion events. Hence, it is also proposed that asexual, and not sexual, reproduction is the ancestral condition. (shrink)

The issue of prenatal testing and selective abortion has never received open public appraisal. This is somewhat regrettable. The interest in this area, however, is rapidly growing. In part this is a result of concerns about the rate of development in genetic knowledge and questions as to its application. For instance, there will be a huge increase in the scope of conditions or features for which we will be able to screen, some of which could hardly be described as significant. (...) Further, for some time now, people with disabilities have had concerns about the practice of prenatal testing and selective abortion. This article looks at the relationship between reproductive autonomy, prenatal testing and associated practices, and the interests of people with disabilities. It asks whether such practices negatively affect the interests of such individuals, and if so, how. This is an important question for the formulation of public policy in this area. Although some groups have studied this issue in detail, policy bodies do not necessarily fully engage with their analyses. This may be a reflection of public confusion about this issue. To some degree, fear of causing offense may also inhibit both expression of public opinion and, in turn, policy analysis. This is unfortunate and needs to be acknowledged. a. (shrink)

Kant's Mathematical World aims to transform our understanding of Kant's philosophy of mathematics and his account of the mathematical character of the world. Daniel Sutherland reconstructs Kant's project of explaining both mathematical cognition and our cognition of the world in terms of our most basic cognitive capacities. He situates Kant in a long mathematical tradition with roots in Euclid's Elements, and thereby recovers the very different way of thinking about mathematics which existed prior to its 'arithmetization' in the nineteenth (...) century. He shows that Kant thought of mathematics as a science of magnitudes and their measurement, and all objects of experience as extensive magnitudes whose real properties have intensive magnitudes, thus tying mathematics directly to the world. Although a pregnant woman can now refuse any medical treatment needed by the fetus, the Court of Appeal has acknowledged that ethical dilemmas remain, adverting to the inappropriateness of legal compulsion of presumed moral duties in this context. This leaves the impression of an uncomfortable split between the ethics and the law. The notion of a pregnant woman refusing medical treatment needed by the fetus is troubling and it helps little simply to assert that she has a legal right to (...) do so. At the same time, the idea that a pregnant woman fails in her moral duty unless she accepts any recommended treatment or surgery—however great the burdens—is also not without difficulty. This article seeks to find a way between these two somewhat polarized positions by arguing that, instead of being a question primarily about whether legally to enforce moral obligations, the «maternal—fetal conflict» begins with previously unrecognized difficulties in determining when a woman's prima facie moral rights invoked in the treatment context should «give way» to the interests of the fetus. This difficulty is mirrored within the law. Thus, how can we tell when a pregnant woman has the moral or legal duty to submit to a caesarean section? Seen in this way, the conflict is a problem which lies at the interface between moral and legal rights and duties, showing that there are important conceptual links between the ethics and the law. Against this background, this article explores the limits of a pregnant woman's right to bodily integrity by focusing upon the idea of her moral duty to aid the fetus through her body. Here we find difficulties in determining the existence and extent of this somewhat extraordinary duty. Such a duty is contrasted with both negative and positive duties toward others in the course of «general conduct». Attention to the social context of pregnancy and the refusal of treatment within this is also instructive. Overall, the purpose is to foster understanding and acceptance of the current legal position. (shrink)

Gammie (bio)A peculiar and under-explored event in Robert Grosseteste's (d. 1253) life is that of his supposed dream-vision in 1249, reported posthumously and in only one source, the Lanercost chronicle.1 The vision foreshadows the loss of Damietta in Egypt the following year, during the Seventh Crusade (1249–54) under the leadership of Louis IX. The parallels to St. Francis's (...) vision at Damietta in 1219 during the Fifth Crusade (1215–21) are immediately noticeable yet the vision has remained largely dismissed as an afterthought in the scholarship of Grosseteste. Considering that Grosseteste wrote, in 1236, what has been described by Michael Lower as "surely the best defence of the cross petition a crusader ever had," in addition to his association with the Franciscans and his relationship with Richard, earl of Cornwall, brother of Henry III and nephew of celebrated crusader Richard I and a (if not the) principal leader of the Baron's Crusade, it is surprising that there is no fuller account of his support for the movement; rather there are piecemeal references to certain acts of interference such as that noted by Lower.2 This paper seeks to establish Grosseteste's position on the crusades, in light of a thoroughly Franciscan influence, beginning with Damietta. [End Page 141]Robert Grosseteste and the FranciscansMuch has been written about the relationship between Robert Grosseteste and the early Franciscan movement in England.3 As Giles Gasper writes in a recent study of Grosseteste and the Franciscan school at Oxford, "Robert Grosseteste is well-known for his support for the Franciscan order, and his warm relations with many brothers of the English province."4 James McEvoy concludes in his examination of Grosseteste's affinity with the nascent movement that "there can be no doubt that Grosseteste was well acquainted with the personality and ideals of St. Francis, the circumstance of the Franciscans' foundation, and the nature of their vocation."5 Grosseteste's Letters are full of admiration for the Franciscans and involvement in their affairs, so much so that a clear and uncompromisingly affectionate relationship can be traced during the bishop's lifetime. Indeed, Grosseteste, in Letter 41, ca. 13 March, 1236, declares to Elias of Cortona, third minister of the Franciscan Order, that "there are no assistants I know of … so effective as your friars."6 The Friars themselves reciprocated their love for Grosseteste; the same letter states, "your sons, the Friars Minor in England, out of kindness in a special way embrace me tightly with arms of love." A letter from 1238 (Letter 58) to Pope Gregory IX asks for help in preserving the reputation of the Brothers, who "illuminate our whole land with the brilliant light of their preaching and teaching" with the warning that "the glory of such an important religious order will vanish and the masses will be scandalized in them."7 [End Page 142]The Dominican Brother Hubert perhaps best expresses the affection between the religious orders and Grosseteste, writing the celebratory Life of Grosseteste shortly after the bishop's death in 1253.8 According to Brother Hubert, Grosseteste was the "father and guardian" of both orders, whose presence "pleased him, as did their / Arrival, their multitude, and frequent conversation," and that just "as a mother to her new-born, he fostered, loved / Protected, fed, and valued them."9 Gasper continues, "English Franciscan historiography leaves no doubt as to the high esteem in which the order held Grosseteste from the mid-13th century onwards, honored in particular for his teaching and learning."10 Chosen personally by Agnellus of Pisa to teach the first Franciscans at Oxford, his influence cannot be underestimated. Indeed, there were Franciscan (and Dominican) contributions to the ultimately unsuccessful attempt to canonize the bishop; a ten-lined letter from Nicholas, guardian of the Greyfriars at Lincoln, penned on 26 June, 1289, extolls the exemplary actions of the bishop.11The relationship between Grosseteste and this first generation of Franciscans was one of mutual respect and love. In the late twentieth century the United States experienced a wave of cases concerning compelled obstetric interventions, cases which attracted much legal and philosophical interest. Behind and alongside them, however, lies a little known strand of authorities which concerns a parent wishing to refuse life-sustaining treatment and a hospital seeking to prevent this on the basis of the State's interest in protecting innocent third parties, usually the patient's dependent minor children. This issue appears to be unique to the United States. (...) Although the leading case in point was influential in cases concerning compelled obstetric intervention, it has received little examination in its own right. This article critically appraises the current legal scope of the principal applications of preimplantation genetic diagnosis (PGD). This relatively new technique, which is available to some parents undergoing in vitro fertilization (IVF) treatment, aims to ensure that a child is not born with a seemingly undesirable genetic condition. The question addressed here is whether there should be serious reasons to test for genetic conditions in embryos in order to be able to select between them. The Human Fertilisation and Embryology Authority (...) and the Human Genetics Commission have decided that there should be such reasons by broadly aligning the criteria for PGD with those for selective abortion. This stance is critically explored, as are its implications for the possible use of PGD to select either against or for marginal features or for significant traits. The government is currently reviewing the legal scope and regulation of PGD. (shrink)

A simple mathematical extension of quantum theory is presented. As well as opening the possibility of alternative methods of calculation, the additional formalism implies a new physical interpretation of the standard theory by providing a picture of an external reality. The new formalism, developed first for the single-particle case, has the advantage of generalizing immediately to quantum field theory and to the description of relativistic phenomena such as particle creation and annihilation.

Despite the importance of Kant's claims about mathematical cognition for his philosophy as a whole and for subsequent philosophy of mathematics, there is still no consensus on his philosophy of arithmetic, and in particular the role he assigns intuition in it. This inquiry sets aside the role of intuition for the nonce to investigate Kant's conception of natural number. Although Kant himself doesn't distinguish between a cardinal and an ordinal conception of number, some of the properties Kant attributes to number (...) can be characterized as cardinal or ordinal. This essay argues that Kant's conception of number includes both cardinal and ordinal elements; it suggests that the cardinal elements provide the basis of a conception of number in general, while the ordinal elements contribute to specifying the exact size of particular collections. In considering these elements, roles for intuition begin to emerge, setting the stage for a reevaluation of the role of intuition in Kant's arithmetic. (shrink)

This Paper identifies seven positive elements of an _ethics system_, or framework, for public officials - namely, (1) the culture and values prevailing in a country; (2) codes and laws and their enforcement; (3) new institutions to uphold ethics in public life; (4) audit, public accountability and openness; (5) guiding principles and motivation to encourage good conduct; (6) external and internal education and training for public life; and (7) the views of the public in regard to their call for greater (...) trust, honesty, and integrity in public life. The Paper next discusses in detail each of these seven elements of an _ethics system_ in the context of British Central Government. However, these seven elements are deemed appropriate for the Public Service of any country seeking to strengthen its standards of conduct and uphold its ethical responsibilities. Finally, this Paper concludes with a reference to business companies and the relevance to them of an _ethics system_. For example, there is a defence in the new UK Bribery Act of 2010 (to be implemented on 1st July 2011 and applicable also to foreign corporations doing business in the UK) that, if a business company has procedures in place to prevent corruption (that is, an _ethics system_), it will be treated more leniently. The fact that the “probability density” expression provided by the Klein–Gordon equation can take on negative values is usually seen as an obstacle to formulating a particle interpretation of quantum mechanics. Nevertheless, reconciling this expression with a particle ontology is quite possible once a careful distinction is drawn between the outcomes of measurements and the positions of particles between measurements. Following this path, however, points to the involvement of retrocausality, as proposed by various authors in other contexts.

In theCritique of Pure Reason,Kant argues for two principles that concern magnitudes. The first is the principle that ‘All intuitions are extensive magnitudes,’ which appears in the Axioms of Intuition (B202); the second is the principle that ‘In all appearances the real, which is an object of sensation, has an intensive magnitude, that is, a degree,’ which appears in the Anticipations of Perception (B207). A circle drawn in geometry and the space occupied by an object such as a book are (...) paradigm examples of extensive magnitudes, while the intensity of a light is a paradigm example of an intensive magnitude. These principles justify and explain the possibility of applying mathematics to objects of experience. The Axioms principle also explains the possibility of any mathematical cognition at all. Much evidence suggests that, from a young age, humans are able to generalize information learned about a subset of a category to the category itself. Here, we propose that—beyond simply being able to perform such generalizations—people are biased to generalize to categories, such that they routinely make spontaneous, implicit category generalizations from information that licenses such generalizations. To demonstrate the existence of this bias, we asked participants to perform a task in which category generalizations would distract from the main goal (...) of the task, leading to a characteristic pattern of errors. Specifically, participants were asked to memorize two types of novel facts: quantified facts about sets of kind members and generic facts about entire kinds. Moreover, half of the facts concerned properties that are typically generalizable to an animal kind, and half concerned properties that are typically more idiosyncratic. We predicted that—because of the hypothesized bias—participants would spontaneously generalize the quantified facts to the corresponding kinds, and would do so more frequently for the facts about generalizable properties. In turn, these generalizations would lead to a higher rate of quantified-to-generic memory errors for the generalizable properties. The results of four experiments supported this prediction. Moreover, the same generalizable-versus-idiosyncratic difference in memory errors occurred even under cognitive load, which suggests that the hypothesized bias operates unnoticed in the background, requiring few cognitive resources. In sum, this evidence suggests the presence of a powerful bias to draw generalizations about kinds. (shrink)

Recent decades have seen a rapid increase in the rate of conversion from conventional to organic farming, as organic farming shifted from an alternative production approach practiced by a small number of idealists, to the de facto alternative to mainstream conventional production. Although there has been considerable academic debate as to the role of agri-business penetration into the production and marketing chains of organic farming (‘conventionalization’), less is known about how the economic drivers of conventionalization are negotiated into practices at (...) the farm level. Drawing on Bourdieu’s conceptualization of economic and cultural capitals, the direct connection between symbols of ‘good farming’ and the economic requirements of maintaining a viable farming business (i.e., the ‘taste of necessity’) is demonstrated. Findings indicate that conventional and organic farmers in the study sites identified a similar range of cultural symbols, but organic farmers emphasized different symbols within this range. This diversity and selectivity demonstrates the fragmentation and contestation of ideals resulting from economic challenges at the time of the study. Economic capital is important to the decision to consider conversion to organic farming, but formal conversion reflects re-weighting of forms of cultural capital. The author argues that recognition of the impact of economic pressures on conventional farming, which in the study sites often led to reduced input use rather than intensification, is missing from the conventionalization debate. The mainstreaming of organic farming production has presented conventional farmers with a set of alternative or re-weighted symbols and a crucible for reflexive consideration of their own standards and practices of farming. All concern the history of the philosophical treatment of (...) mathematics, necessity, or both, although there is no single thread running through all three essays.Burnyeat focuses on Plato's understanding of mathematics in the Republic, making use of the Timeaus in particular to defend his interpretation. Plato claimed that in the ideal society mathematics should be studied for a full ten years, which many have thought excessive. To explain it, Burnyeat argues that the role of mathematics is pervasive: ethics and politics are mathematical, because in Plato's view mathematics is a constitutive part of ethical understanding. On Burnyeat's interpretation, goodness is part of the objective world, and mathematics is a science of values. The link between mathematics and goodness in the objective world is forged by the concord, harmony, and unity of proportions, which express the goodness of the Divine Craftsman's beneficent design. Proportions are both intrinsically good and the proper study of mathematics.Burnyeat explains why Plato thinks abstract kinematics (the pure non-sensible counterpart to astronomy) and abstract harmonics lead to knowledge of the good. Abstract kinematics concerns the "harmony of the spheres" described in the Republic. Drawing heavily on the Timeaus, Burnyeat argues that the circular motions of the spheres are motions in the intelligence of the world soul and that there are similar motions in human souls. The world soul and human souls are spatial and have circular motions (invisibility and intangibility make them incorporeal). Souls are the most important subject matter of abstract harmonics—the study of good proportions. A soul that understands the various mathematical disciplines and their relations takes on the harmony and hence goodness of the world soul. Such a soul serves as a model for organizing the social world, a model which properly trained rulers can use to shape a community. Burnyeat's well-argued essay is compelling and exciting. [End Page 427]Ian Hacking's views provide a great contrast to Burnyeat's Plato. Hacking conducts a phenomenological inquiry into why some philosophers have become obsessed by mathematics as a source of philosophical inspiration. He holds that mathematics concerns a relatively minor part of human culture and that the influence of mathematics on philosophy is pernicious; he even describes it as an infection.Hacking examines the views of six philosophers: Plato, Leibniz, Mill, Descartes, Lakatos, and Wittgenstein. Hacking's assessment of the six philosophers is at times disputable, but it is also interesting and stimulating, and serves his phenomenological inquiry.Hacking traces philosophy's infection by mathematics to two factors. A mathematical proof can be perspicuous; that is, a proof can be "grasped," which requires seeing directly why something must be true and being able to recapitulate it. A mathematical proof can also anticipate facts about the world. He thinks that these two factors affect us in two ways: they give us the idea of a priori knowledge, and they dazzle us into unreasoned conviction in proofs. One might respond that, setting aside the feeling proofs give us, we are still justified in being impressed by them. Hacking argues that much of what impresses is based on a misunderstanding of their nature, which he attempts to correct.According to Hacking, a mathematical demonstration involves shifts of meaning that analytically bind the proof and the theorem it establishes. They thereby mutually support each other and provide what he calls self-authentication. The correctness of the proof is supported by the "analytified" truth of the theorem and the theorem is considered true because proven.This bootstrapping feature of mathematical proofs supports Hacking's deflationary account of necessity. 1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

This article considers Friedrich Kittler’s deterministic media theory as both an appropriation and mutation of Michel Foucault’s archaeological method. Focusing on these two thinkers’ similar but divergent conceptions of the “death of man,” it will be argued that Kittler’s approach attempts to expunge archaeology of its last traces of Kantian transcendentalism by locating the causal agents of epistemic change within the domain of empirical experience, but in doing so, actually amplifies the anthropological vestiges that Foucault hoped to eradicate. The result (...) is an alluring but dogmatically positivist theory of mediatic causality that, in spite of its best efforts, can only reify, rather than dispel, the image of “so-called man.”. I argue that Kant's account of how we can construct the composition of motion rests on the construction of extended intervals of space and time, and the representation of the identity of the part–whole relations the construction of these intervals allow.
