Durch das Erscheinen seines Werkes "Der Einzige und sein Eigenthum", in dem er seine Zeit, die nachhegelianische Epoche, schonungslos kritisierte, war er bei den einen berühmt, bei anderen berüchtigt geworden. In neuerer Zeit lenkte er die allgemeine Aufmerksamkeit vor allem durch Nietzsche und durch die posthum erschienene Kritik Marxens an seinem Werk wieder auf sich, die letzterer 1845/46 gemeinsam mit Engels verfaßte, der Zeitumstände wegen aber "der nagenden (...) It is frequently noted that a “crisis in language” accompanied the profound changes in human consciousness everywhere evident near the turn of the century. As the nature of reality itself became problematic—or at least suspect, distrusted for its imposition of limits upon individual imagination—so, necessarily, did the relationship of language to reality. Thus in the later nineteenth century, the adequacy of an essentially standardized form of “classical” writing was increasingly questioned as an effective vehicle for artistic expression: even though often (...) in “elevated” form, such writing bore too close a connection to ordinary discourse. Indeed, it was precisely the mutually shared, conventional aspects of language that came to be most deeply distrusted for their failure to mirror the more subjective, obscure, and improbable manifestations of a transcendent reality or, rather, realities—the plural reflecting an insistence upon the optional and provisional nature of human experience. Language in its normal manifestations—with its conventionalized vocabulary and standardized rules for syntactical combination—proved inadequate for an artistic sensibility demanding, in Friedrich Nietzsche’s words, “a world of abnormally drawn perspectives.”This dissatisfaction with “normal” language received its classic statement through Hugo von Hofmannsthal’s Lord Chandos. Writing in 1902, Hofmannsthal conveys through the figure of the aristocratic Chandos the loss of an encompassing framework within which the various objects of external reality are connected with one another and integrated with the internal reality of human feelings. Chandos’ world has become one of disparate, disconnected fragments, resistant to the abstractions of ordinary language. It is a world characterized by “a sort of feverish thought, but thought in a material that is more immediate, more fluid, and more intense than that of language.” Chandos longs for a new language in which not a single word is known to me, a language in which mute objects speak to me and in which perhaps one day, in the grave, I will give account of myself before an unknown judge.”2 The content and forms of art thus shifted away from exterior reality, which no longer provided a stable, “given” material, toward language itself—to “pure” language in a sense closely related to the symbolists’ “pure” poetry. “No artist tolerates reality,” Nietzsche proclaimed.3 And Gustave Flaubert’s farsighted advice to himself was that he should write “a book about nothing, a book dependent on nothing external, which would be held together by the internal strength of its style.”4 2. Flaubert argues that from the standpoint of l’Art pur, “one might almost establish the axiom that there is no such thing as subject—style in itself being an absolute manner of seeing things” . Further:The finest works are those that contain the least matter; the closer expression comes to thought, the closer language comes to coinciding and merging with it, the finer the result. I believe the future of Art lies in this direction. I see it, as it has developed from its beginnings, growing progressively more ethereal …. Form, in becoming more skillful, becomes attenuated, it leaves behind all liturgy, rule, measure; the epic is discarded in favor of the novel, verse in favor of prose; there is no longer any orthodoxy, and form is as free as the will of its creator. This progressive shedding of the burden of tradition can be observed everywhere: governments have gone through similar evolution, from oriental despotisms to the socialisms of the future. This chapter treats in roughly chronological order ten Lutheran theologians other than Rudolf Bultmann and Paul Tillich, who were examined in the previous chapter. All of these figures can be discussed in relation to their reception of Søren Kierkegaard's writings, even though the level of appropriation of Kierkegaard varies significantly. They include German national Lutheran theologians Karl Holl, Friedrich Gogarten, Paul Althaus, and Emanuel Hirsch, Scandinavian Lutheran theologians Anders Nygren, Knud Løgstrup, Regin Prenter, and Gustaf Wingren, and contemporary (...) German Lutheran theologians Wolfhart Pannenberg and Eberhard Jüngel. The chapter attempts to identify distinctive characteristics of each thinker and their connections to Kierkegaard. (shrink)

The Evans-Salmon position on vague identity has deservedly elicited a large response in the literature. I think it is in fact among the most provocative metaphysical ideas to appear in recent years. I will try to show in this paper, however, that the position is vulnerable to a fundamental criticism that seems to have been virtually ignored in the many discussions of it. I take the Evans-Salmon position to consist of the following two theses: Thesis I. There cannot be objects (...) x and y such that it is indeterminate whether x is (identical with) y. Thesis II. The only way for an identity sentence to be indeterminate in truth-value is if one of the expressions flanking the identity symbol is referentially ambiguous.] The argument for Thesis I is essentially as follows. We are assuming that the sense of identity under discussion satisfies the standard formal logic of identity including Leibniz's Law. Suppose, now, that it is indeterminate whether x is y. Since it is determinate that x is x, x differs from y with respect to the property of being determinately x, from which it follows by Leibniz's Law that x is not y. Since the supposition that it is indeterminate whether x is y leads to the conclusion that x is not y, this supposition is incoherent. (shrink)

A number of jurisdictions, including England and Wales after their adoption of the 1991 Criminal Justice Act, require that sentences be `proportionate' to the severity of the crime. This book, written by the leading architect of `just deserts' sentencing theory, discusses how sentences may be scaled proportionately to the gravity of the crime. Topics dealt with include how the idea of a penal censure justifies proportionate sentences; how a penalty scale should be `anchored' to reduce overall punishment levels; how non-custodial (...) penalties should be graded and used; and how political pressures impinge on sentencing policies. My focus here will be Rudolf Carnap’s views on ontology, as these are presented in the seminal “Empiricism, Semantics and Ontology” (1950). I will first describe how I think Carnap’s distinction between external and internal questions is best understood. Then I will turn to broader issues regarding Carnap’s views on ontology. With certain reservations, I will ascribe to Carnap an ontological pluralist position roughly similar to the positions of Eli Hirsch and the later Hilary Putnam. Then I turn (...) to some interrelated arguments against the pluralist view. The arguments are not demonstrative. Some possible escape routes for the pluralist are outlined. But I think the arguments constitute a formidable challenge. There should be serious doubt as to whether the pluralist view, as it emerges after discussion of these arguments, will be worth defending. Moreover, there is an alternative ontological view which equally well subserves the motivations underlying ontological pluralism. (shrink)

Metaontology – the study of the nature of ontological issues – has flourished in recent years. The focus of this summary will be on some views and arguments that are central to today’s debate. One theme will be that of how seriously to take ontology: whether there is reason to take a skeptical or deflationary attitude toward ontological claims, as theorists like Rudolf Carnap, Hilary Putnam, and Eli Hirsch in different ways have urged. The other theme will be (...) that of the viability of the Fregean and Quinean approaches to ontology that have been and still are central to analytic philosophy. (shrink)

From the Introduction: The papers collected in this book are based on the assumption that art, as any other activity of the mind, is subject to psychology, accessible to understanding, and needed for any comprehensive survey of mental functioning. The author believes, furthermore, that the science of psychology is not limited to measurements under controlled laboratory conditions, but must comprise all attempts to obtain generalizations by means of facts as thoroughly established and concepts as well defined as the investigated situation (...) permits. Therefore the psychological findings offered or referred to in these papers range all the way from experiments in the perception of shape or observations on the art work of children to broad deliberations on the nature of images or of inspiration and contemplation. It is also assumed that every area of general psychology calls for applications to art. The study of perception applies to the effects of shape, color, movement, and expression in the visual arts. Motivation raises the question of what needs are fulfilled by the production and reception of art. The psychology of the normal and the disturbed personality searches the work of art for manifestations of individual attitudes. And social psychology relates the artist and his contribution to his fellow men. A systematic book on the psychology of art would have to survey relevant work in all of these areas. My papers undertake nothing of the kind. They are due to one man's outlook and interest, and they report on whatever happened to occur to him. They are presented together because they turn out to be concerned with a limited number of common themes. Often, but unintentionally, a hint in one paper is expanded to full exposition in another, and different applications of one and the same concept are found in different papers. I can only hope that the many overlappings will act as unifying reinforcements rather than as repetitions. These papers represent much of the output of the quarter of a century during which I have been privileged to live, study, and teach in the United States. To me, they are not so much the steps of a development as the gradual spelling-out of a position. For this reason, I have grouped them systematically, not chronologically. For the same reason, I did not hesitate to change the words I wrote years ago wherever I thought I could clarify their meaning. Removed from my original intimacy with the content, I approached the text as an unprepared reader, and when I stumbled, I tried to repair the road. In some instances, I recast whole sections, not in order to bring them up to date, but in the hope of saying better what I meant at the time. Some of the earlier papers led to my book, _Art and Visual Perception_, which was written in 1951 and first published in 1954- Sections of the articles on perceptual abstraction, on the Gestalt theory of expression, and on Henry Moore are incorporated in that book. Others continued where the book left off, for instance, the attempts to describe more explicitly the symbolism conveyed by visual form. The short piece on inspiration provided the substance for the introductory chapter on creativity in my more recent book, Picasso's Guernica. Finally, in rereading the material, I was surprised to find how many passages point to what is shaping up as my next task, namely, a presentation of visual thinking as the common and necessary way of productive problem solving in any human activity. Ten of the papers in this book were first published in the _Journal of Aesthetics and Art Criticism_. To mention this is to express my indebtedness to the only scholarly periodical in the United States devoted to the theory of art. In particular, Thomas Munro, its first editor, showed a great trust in the contribution of psychology. He made me feel at home among the philosophers, art historians, and literary critics whose lively propositions inhabit the hostel he founded and sustained. To him, as well as to my friends of the University of California Press, who are now publishing my fourth book, I wish to say that much of what I thought about in these years might not have been cast into final writing, had it not been for their sympathy, which encouraged the novice and keeps a critical eye on the more self-assured pro. There are a few scientific papers here, originally written for psychological journals but free, I hope, of the terminological incrustation that would hide their meaning from sight. There are essays for the educated friend of the arts. And there are speeches, intended to suggest practical consequences for art education, for the concerns of the artist, and for the function of art in our time. These public lectures are hardly the products of a missionary temperament. In fact, I marveled why anybody would go to a theorist for counsel, illumination, and reassurance in practical matters. However, when I responded to such requests I noticed, bewildered and delighted, that some of my findings pointed to tangible applications, which were taken to be useful. (shrink)

Durch den digitalen Medienwandel ist der Begriff der Öffentlichkeit problematisch geworden. Die Debatte fokussiert sich zumeist auf die Frage, ob die sogenannte bürgerliche Öffentlichkeit durch das Internet im Niedergang begriffen ist oder eine Intensivierung und Pluralisierung erfährt. Rudolf Maresch zeichnet die berühmte Untersuchung der Kategorie durch Jürgen Habermas nach und zieht den von ihm konstatierten Strukturwandel der Öffentlichkeit in Zweifel. Dagegen verweist er auf die gouvernementalen und medialen Prozesse, die jede Form von Kommunikation immer schon gesteuert haben. Öffentlichkeit sei (...) daher ein Epiphänomen nicht allein des Zeitungswesens, sondern der bereits vorgängig ergangenen postalischen Herstellung einer allgemeinen Adressierbarkeit von Subjekten. Heute sei Öffentlichkeit innerhalb der auf Novitäts- und Erregungskriterien abstellenden Massenmedien ein mit anderen Angeboten konkurrierendes Konzept. Mercedes Bunz konstatiert ebenfalls eine Ausweitung und Pluralisierung von Öffentlichkeit durch den digitalen Medienwandel, sieht aber die entscheidenden Fragen in der Konzeption und Verteilung von Evaluationswissen und Evaluationsmacht. Nicht mehr die sogenannten Menschen, sondern Algorithmen entscheiden über die Verbreitung und Bewertung von Nachrichten. Diese sind in der Öffentlichkeit – die sie allererst erzeugen – weitgehend verborgen. Einig sind sich die Autoren darin, dass es zu einer Pluralisierung von Öffentlichkeiten gekommen ist, während der Öffentlichkeitsbegriff von Habermas auf eine singuläre Öffentlichkeit abstellt. Due to the transformation of digital media, the notion of “publicity” has become problematic. In most cases, the debate is focused on the question whether the internet causes a decline of so-called civic publicity or rather intensifies and pluralizes it. Rudolf Maresch outlines Jürgen Habermas's famous study of this category and challenges his claim concerning its “structural transformation,” referring to the governmental and medial processes which have always already controlled every form of communication. Publicity, he claims, is an epiphenomenon not only of print media, but of a general addressability of subjects, that has been produced previously by postal services. Today, he concludes, publicity is a concept that competes with other offers of mass media, which are all based on criteria of novelty and excitement. Mercedes Bunz also notes the expansion and pluralization of the public sphere due to the change of digital media, but sees the crucial issues in the design and distribution of knowledge and power by evaluation. So-called human beings no longer decide on the dissemination and evaluation of information, but algorithms, which are for the most part concealed from the public sphere that they produce in the first place. Both authors agree that a pluralization of public sphere(s) has taken place, while Habermas's notion of publicity refers to a single public sphere. (shrink)
