Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

For, in Eudora Welty's words, "as is true of all friendships, it might not have happened—and it did."Although we were saddened to say goodbye to our dear friend and former director Lauren Rhoades, to our delight she has returned time and again, as a volunteer, a guest, and even a guest speaker. Most impactful, Rhoades now supports sites like ours in an official capacity as the new director of grants at the Mississippi Arts Commission, where she connects arts-based organizations with potential funding opportunities. In this role, Rhoades informed the Eudora Welty Foundation about the Building Fund for the Arts Grant, to which they successfully applied. Because of this very grant, we can make perhaps our biggest announcement of 2022, which is that the Eudora Welty Foundation will break ground on the much-needed community arts building behind our Visitor Center. The report in this volume by the Foundation, which is supervising construction, contains more details on this exciting development.After Rhoades's departure, I had the great honor of transitioning to director. By December, we welcomed Lauren Claret to fill my former role as Garden Projects Specialist, ending a lengthy staff shortage. We even grew our team, adding Mary Atchley as a part-time Visitor Center Associate to handle our gift shop and ticket sales. All the while, my seasoned colleagues, Special Projects Coordinator Rachel Lott, and Education Specialist Jennifer [End Page 189] Rose, continued to shine in their respective roles: Lott coordinates volunteers and plans exhibits, events, and social media. Rose leads educational programs for students of all ages, in groups large and small, onsite and away.With such a small team, our museum depends heavily on volunteers to lead house tours and maintain the Welty garden, and recruiting new volunteers is our greatest need as we look ahead to 2023. We saw a precipitous drop in volunteers at the onset of the pandemic. Although visitation has started a noticeable rise, volunteer numbers have not yet picked up. To each of our house docents and Cereus Weeders, we say a heartfelt "thank you."Fortunately, we had the support of two interns last fall. Life on the road was anything but glamorous for Farm Security Administration photographers traveling through southern Illinois in the mid-1930s. Often their most promising subjects lived at the end of the worst roads, many of which lacked bridges, drainage ditches, or gravel. Outfitted with three government-issue cameras, flashbulbs, tripods, and film-processing chemicals, their job was to help explain America to Americans by seeking out and photographing the one-third of the nation FDR described as ill-housed, ill-clad, and ill-nourished. Featured in this (...) book are more than one hundred photographs from the collection of a quarter of a million taken by FSA photographers between 1935 and 1943. These pictures capture life during the Great Depression as viewed in the coal-mining towns of Herrin, West Frankfort, and Zeigler; the river communities of Shawneetown, Cairo, and Grayville; the farming regions near McLeansboro, Newton, and Harrisburg--more than two dozen southern Illinois county seats, hamlets, and landings. Together they comprise a photographic portrait of the determination, hard work, and capacity to find ways to celebrate life exemplified by the people of southern Illinois during one of the most difficult periods of American history. FSA photographers helped to invent and popularize the documentary style, a type of photography in which pictures and their arrangement carry much of the information in a story. Intended to document the success of a government project, these pictures survived to preserve for later generations the story of the people of southern Illinois and how they endured the difficult times of the Great Depression. Following the financial crisis of 2008, the Treasury Committee of the UK House of Commons undertook an inquiry into the lessons that might be learned from the banking crisis. Paul Moore, head of group regulatory risk at Halifax Bank of Scotland during 2002–2005, provided evidence of his experience of questioning HBOS policies which resulted in his dismissal from HBOS. The problems that surfaced at HBOS during the financial crisis were so serious that it was forced to merge with Lloyds (...) TSB, another UK bank, to form the Lloyds Banking Group in which the government took a significant stake. Moore’s evidence to the Treasury Committee revealed that long before the financial crisis, he had raised major concerns with the management of HBOS and with the Financial Services Authority, the UK financial services regulator. Moore’s evidence led to the submission of further disclosures, replies and rejoinders as evidence to the Treasury Committee. Moore’s case is therefore of considerable interest to researchers of whistleblowing because it is a rare instance of high-level whistleblowing, the details of which subsequently entered the public domain. The information revealed in evidence to the Treasury Committee sheds light on the process of whistleblowing in the context of the governance and regulation of a major UK bank that subsequently had to be rescued by government intervention during the financial crisis. The paper makes a contribution to the wider literature on whistleblowing, and to a greater understanding of aspects of the financial crisis. (shrink)

In these nearly 40 years as a Labour peer, Russell proved to be a fitful attender and infrequent participant in the upper house—speaking only six times. This paper examines each of these interventions—studying not just the speeches themselves but also their genesis and impact within Parliament and without. Of all the controversial and important foreign and domestic issues faced (...) by Parliament over these four decades, it was matters of peace and war which prompted Russell to take advantage of his hereditary position and, more importantly, of the national forum which the Lords' chamber provided him. INTRODUCTION BERTRAND RUSSELL'S POLITICAL thought underwent several metamorphoses in his nearly seventy years of political activism and writing. Indeed, many commentators on Russell take this as the overarching attribute ofhis politics. Alan Ryan writes that "Russell's career defies summary analysis; his life was much too long and his activities too various. His philosophical allegiances were no more stable (...) than his emotional allegiances, and his political allegiances no more stable than either."1 Likewise, Benjamin Barber suggests that "Russell had to contend with staying alive; and by the time he was ninety, consistency must have seemed to him less like the hobgoblin of little minds than the hallmark Of a short life."2 Ryan, Barber and others come to different conclusions about Russell's engagements with pacifism, anarcho-syndicalism, socialism and liberalism, but their efforts, taken collectively, signal a growing appreciation for the fluidity of Russell's politics. The core premise of the argument is that to understand the political Russell, it is necessary to suspend the urge to unify. What is crucial is an openness to the extraordinary variety and range of his political interests and reflections. Once this step is taken, it becomes possible to uncover the degree to which Russell's eclectic activism is reflected in his approach to political theory. It becomes possible to see that his statements on a particular political issue are embedded with concepts selected from various sources within the western tradition ofpolitical discourse. In addition, this approach highlights the conceptual background of some of Russell's more contentious political statements which seem so characteristically out of character. The issue selected for this essay arises from one of the most controversial and least understood acts in Russell's life. It concerns his public statements following World War II that the United States might do well to use its monopoly of atomic bombs to force the Soviet Union into abandoning the development of its own atomic weapons. In addition to notable events in Russell's honour at London's Festival (...) Hall and Café Royal, as well as in the House of Commons, English coin designer and painter Christopher Ironside (1913–1992) was commissioned to produce this bronze medallion. Only twelve copies were cast, including this one, originally in Russell's possession at Plas Penrhyn and now held by the Bertrand Russell Peace Foundation. (Another copy is in the Russell Archives.) Inscribed on the obverse of the medallion (diameter: 128 mm.) are the titles of fourteen Russell books. The notion of logical construction was used by Bertrand Russell in the early 20th century, which originally comes from A. N. Whitehead. Russell said that matter as a mind-independent thing can only be known by description. He also argued that matter is a logical construction of sense-data. However, this leads to an incoherent view of the direct or indirect connection between a mind and the external world. The problem examining is whether a collapsing house is a logical (...) construction of the sense-data of rumbling sounds and collapsing shapes. Using Russell's writings between 1911 and 1918, I will analyze how Russell characterized logical constructions. Finally, I will show Russell’s view about the relation of logical constructions to matter and sense-data. A careful interpretation of Russell's thoughts shows that the contents of the statements of the physical world are not constructions being equivalent to the contents of the sense-datum statements. For more than seven decades there has been a broad gap between how philosophy is conceived and practiced. Two ill-defined but well-recognized traditions have developed—the "analytic" and "Continental" schools of philosophy. The former traces its roots to philosophers like Frege, Russell, Moore, Wittgenstein, and the logical positivists. The latter has been heavily influenced by Nietzsche, Heidegger, Merleau-Ponty, Foucault, and Derrida, among others. The aim of this collection is to reconsider the often facile characterization of major thinkers as belonging to (...) either one or the other philosophical tradition. The contributors—philosophers from both sides of the divide working in different countries and contexts—all question the problematic conception that the two traditions are incommensurable. Each of their articles compares individual philosophers who have had a major influence on the analytic and Continental traditions with a view to clarifying their similarities and dissimilarities of approach. What this collection of thoughtful articles clearly demonstrates is that regardless of approach and precedents, analytic and Continental philosophers are all doing philosophy, and there are many important points of contact between them. ROCKLER Interdisciplinary Studies in Education / National-Louis Universiry Evanston, 1L 60201, USA I n The Prospects of IndustriaL CiviLization, written in collaboration with his wife Dora, Bertrand Russell wrote: The governors of the world believe, and have always believed, that virtue can only be taught by teaching falsehood, and that any man who knew the truth would be wicked. (...) I disbelieve this, absolutely and entirely. I believe that love of truth is the basis of all real virtue, and that virtues based upon lies can only do harm.· This passage reflects Russell's views on scepticism and education; he sought an educational system that would avoid indoctrination and would produce sceptical students. Scepticism, a central aspect of much of Russell's philosophic work, was a primary organizing principle of his writings on education. Russell, a major contributor to educational theory, produced two volumes on education that continue to have considerable relevance for teaching and learning in contemporary society. The first, Education and the Good Life (1926),2 inspired by the births of John and Katharine, focused on the education of young children. In Education and the Good Life, Russell identified the aims of education. These included the development ofvitality, the promotion of courage (which entails the absence of fear), sensitiveness and intelligence. The CurricuLar Role ofRusselL's Scepticism 51 Russell, who once stood for Parliament as suffragist candidate, believed in equality of education for both men and women. This position was well advanced for its time; it still encounters resistance today. As the Russells' children approached school age, he and Dora confronted the problem of their education. Russell did not want John and Katharine to experience the loneliness of education by tutors that he had faced as a child. He and Dora also wished to avoid conventional public schools because they wanted their children to be educated in a manner consistent with their sense of scepticism about society and about religion. Russell felt that exposure to any kind of traditional learning would cause his children to be indoctrinated with patriotic and religious points of view. On the other hand, he felt that the progressive schools that were available-including A. S. Neill's Summerhill-lacked intellectual rigour. As a result of these feelings and because of Dora Russell's interest in education, the Russells leased the estate of Bertrand's brother at Telegraph House in Sussex and founded what came to be known as Beacon Hill School in September 1927. With his experience at Beacon Hill in mind, Russell published a second book on education in I932-Education and the Modern WorLd.3 It argued against the notion of progressive educators that schooling should simply allow for natural growth. Russell rejected Rousseau's approach to teaching and learning, and he distanced himself from some of Dewey's early work as well. In Education and the Good Life, and in other early essays on learning theory, Russell had seemed impressed by the growing role of behaviourism in education. However, his experience at Beacon Hill and his reading ofpsychoanalytic literature weakened his acceptance of behaviourism. In Education and the Modern World Russell called for more awareness of the role of emotion in learning as well as an examination of the way in which repressed feelings affect action. Russell argued that conditioning cannot effectively develop character. Education and the Modern World ends on a discouraging note. Despite the rapid proliferation (...) of critical texts addressing themselves to black writing, it remains the case that many critics come to black writing with methodologies and agendas already in hand, while few critics have taken upon themselves the task of rereading the critical history of African-American work in theory. This has often resulted in a sort of critical shortsightedness, with the field of black literary theory presented as a foreshortened, if now more level, playing field. While some have engaged in arguments about the question of whether or not African-American writing should be engaged by poststructuralist theorists (a question that seems to begin with the assumption that poststructuralism is a particularly white mode of mythology), the fact is that a form of deconstruction had been theorized by an African-American poet long before deconstruction had entered the American academy. That this fact is largely unknown among contemporary critics is the result of a continuing practice of not reading the theoretical work of black poets who have published outside the established circuit of the academic press. With the prominent exceptions of poets like Amiri Baraka, June Jordan, Larry Neal, and Haki Madhabuti, the critical writings of recent African-American poets have seldom been collected and circulated in any very effective way. Characteristically, Neal’s essays were gathered into a book posthumously, and Madhabuti’s have been published and distributed primarily through his own publishing house. Even Baraka’s collections have been allowed to pass out of print in most instances, only the books on music remaining readily available throughout his career. This may change for black poets who write in more mainstream modes in the near future. Now that Rita Dove has served a term as Poet Laureate of the United States and Derek Walcott has won the Nobel Prize, we might expect a modest increase in interest by publishers and readers in critical works by poets whose forms are less troubling than their content. And black poets who attain academic credentials and write scholarly/critical essays, such as Nathaniel Mackey and Harryette Mullen, may succeed in getting their works published by the university presses. However, surveys of shelves in bookstores and [End Page 86] libraries will confirm that there has been little concern among even university and small presses to collect and preserve the critical legacy of black experimentalists in the way that the essays of Charles Olson, Ed Dorn, or Robert Creeley have been maintained before a public.Russell Atkins has been one of the most prolific and demanding of black poets writing criticism and theory in the last four decades, but like Percy Johnston, central figure of the Dasein group of poets centered at Howard University in the 1950s, he has had to publish most of this work through his own magazine and workshop press, and there has never been a published collection of his critical work. Pp. xxi, 177· US$19.95; paper $9·95· B rian Hendley's book is more than a well-written account of three eminent philosophers who wrote about and participated in educational (...) theory and reform. The author has in fact selected Dewey, Russell and Whitehead as three stallions to draw a chariot. The precise nature of this "chariot" is indicated in the chapter entitled "The Philosopher as Educator Today" appearing at the end of the book: My intention throughout has been to suggest a way out of the current impasse in the philosophy ofeducation by reopening a conversation regarding a more productive role for philosophers to play, rather than merely analyzing concepts and policing arguments. My claim has been that philosophers of education can learn from their past, that we can see in Dewey, Russell and Whitehead instances of a productive approach to educational problems through thought and action. (P. 105) Having said this, the structure and contents of Hendley's book fall squarely into place. Chapter One, entitled "The Reconstruction of the Philosophy of Education", argues that there is a crisis in the current state of educational philosophy. The ensuing three chapters are devoted individually to Dewey, Russell and Whitehead. The concluding chapter, resting upon the strength of the examples given of three constructive contributors to the field, suggests new directions for the philosophy of education. It is clear that Hendley's book is more than an interesting account of the practical and theoretical educational activities of three of the most influential philosophers of the twentieth century. Dewey, Russell and Whitehead are not gathered together between the. same covers in order to explore or present a detailed analysis of their theoretical similarities or who may have influenced Reviews 219 whom. Instead, one gathers that the author has selected them on the basis of his own admiration and preference rather than for any shared theories which connect them. The point is made, however, that the strongest common element, and the most significant one, is that each man had ideas about education, each was a philosopher, and each attempted to exert some practical influence upon the educational institutions and practices of the day. In short, Dewey, Russell and Whitehead were theorists who were prepared to get their hands dirty. Hendley argues that after the death of John Dewey in 1952 educational philosophy was neglected and· philosophers tended to pay less attention to education. The author goes on to suggest some renewed interest in the field on the grounds of contributions made to the fifty-fourth Yearbook of the National Society for the Study of Education in 1955 under the theme "Modern Philosophies and Education", a special issue of the Harvard Education Review published in 1956; the publication of Israel Scheffler's edited collection of readings entitled Philosophy and Education in 1958; and R. S. Peters' Inaugural Address given at London in 1963, and his publication of Ethics and Education in 1966. According to this argument, we witness a general lapse after the death of Dewey, a rekindling in the mid-1950S and a broader resurgence in the 1960s. On the basis of the author's own account, I think that it is very difficult to argue that Dewey's death initiated any period of calm or disinterestedness. Furthermore, it is very problematic to point to various yearbooks or publications as indicators. The point is that with the death of Dewey there were numerous contenders to fill his position as the pre-eminent American philosopher of education. The extent to which anyone has been able to do so is a different matter. What I believe Hendley is really trying to say here is implicit in his argument, namely, that after the death of Dewey, no philosopher of equal stature took his place. Ezach family is happy and unhappy in its own ways. This is hardly surprising zgiven that the family lies at the crossroad of so much human (...) experience. It is the scene for playing out genetics and for working through the rearing and civilizing of children, both nature and nurture. In economic life it constitutes the primary unit, the household. Despite Tolstoy’s ideal, none can ever be com­ pletely happy for every member all the time. And, there is no reason to think that basically happy families are any more the same than unhappy ones. But then none can ever be completely unhappy; or rather, when a family is com­ pletely unhappy it is unlikely that it will remain one. One other factor, however, intrudes on this picture: we tend to be more interested in bad or scandalous news than good. Vicarious experience brings catharsis, possibly helpful in a way. Yet, as the German language recognizes with the word “Schadenfreudez”, we can experience joy at someone else’s sorrow, despite the questions it raises about our empathy. Alexander Waugh is himself the member of a famous family. Given the family documentation at his disposal and the span of generations, that book covers enough territory, in enough detail, to give us some sense of Waugh family character. You learn what it was like to grow up in the family, down to the odour of Uncle Auberon Herbert’s cologne, “smelling like Cleopatra in her barge on her way to meet Antony for the Wrst time” according to Bron (p. 370, paperback ed.), and the family suspicion that this uncle may have been the illegitimate son of Hilaire Belloc (p. 276). The fathers and sons, from Arthur down to Alexander, all wrote for a living, witty, stylish prose, and sometimes poetry. They especially liked writing about each other in letters, essays, and novels, often to each other in public letters and dedications; and as a consequence Alexander’s book is rich, amusing, intimate, and a bit indiscrete. Arthur’s turn-of-the-century avoidance of emotion in sentimentality grew outmoded, but it was replaced in the family business with newer models, with more Xash and cynicism. When it came to Alexander’s fa­ ther Bron, he was known for his talent at vituperation, and got into verbal and legal scrapes with C. P. Snow and Bertrand Russell among others (p. 407), which led to his getting sacked but only made his journalism more widely read and more valuable to publishers. In Alexander’s disclosure of his family history, there is a sureness of touch that comes from working within his ken. Waugh studied music, and worked as a music critic. In his easy, self-depreci­ ating way, he told an interviewer for The Wall Street Journalz that he got the idea to write this book because of “the most appalling boil on my right index Wnger”. This curtailed his routine enjoyment at the piano, “But then as I sat down and pressed a chord with my left hand I thought of Paul Wittgenstein. I knew about the concerto that Ravel composed for him and I knew that he was Ludwig’s brother. He was bound to have an interesting story.”2 With access to some Witt­ genstein family papers through one of Paul Wittgenstein’s daughters, he began. Since Russell and Burch (1959) suggested the principles of replacement, reduction, and refinement (3Rs) as a foundation for animal research, their influence has only grown in the research community. In this paper, we discuss whether the 3Rs can be constructively used as a prism to analyse decisions regarding the welfare of animals housed in zoos and aquariums (henceforth “zoo animals”). We analyse opportunities and challenges for each of the three Rs when applied to zoo animals. We discuss the following (...) reasons to consider the use of the 3Rs in relation to zoo animals: (1) there are similarities between motivations for housing animals in zoos and using them in research that are ethically relevant to consider; (2) the professional zoo community has committed to progress towards evidence-based best practice models to ensure and enhance the welfare of animals housed in zoos; and (3) there is a growing public concern regarding the welfare of zoo animals which can, to some extent, be met by viewing current practices through the prism of the 3Rs. The relations between Russell and three Polish philosophers are considered. Each of them exchanged letters with Russell but their professional interests in philosophy, their meta-philosophical views and their worldviews profoundly varied. Nevertheless, Russell’s wide intellectual horizon enabled him to have fruitful discussions with each of them. Chwistek’s philosophical aim was to improve Russell’s theory of types but he failed to publish his own book in English with Russell’s preface and he never met Russell in (...) person. The English philosopher, however, helped Chwistek in obtaining the post at Lvov University. Lutosławski was unable to develop the professional philosophical discussion with Russell, whom he met at a philosophical congress, but he expressed positive opinion on the chapters on Plato in Russell’s History of Western Philosophy. This opinion was helpful for Russell in his further cooperation with the publishing house. The last of the Poles under discussion was Themerson, rather a writer, artist and a thinker than a philosopher. He met Russell after the WW II in London, while they both lived there. Themerson edited some minor works of Russell, who wrote a preface to Themerson’s novel. We add texture to the conclusion of Duchon and Drake (Journal of Business Ethics, 85, 2009, 301) that extreme narcissism is associated with unethical conduct. We argue that the special features possessed by financial accounting facilitate extreme narcissism in susceptible CEOs. In particular, we propose that extremely narcissistic CEOs are key players in a recurring discourse cycle facilitated by financial accounting language and measures. Such CEOs project themselves as the corporation they lead, construct a narrative about the corporation and themselves (...) using financial accounting measures, and then reflect on how their accounting-constructed performance is perceived by stakeholders. We do not present empirical evidence about whether the use of accounting language and measures leads to unethical behaviour by extreme narcissistic CEOs — although the conclusions of Duchon and Drake (2009) suggest empirical support is probable. Rather, we focus on developing alertness to the potential for accounting, when engaged by an extremely narcissistic CEO, to be a precursor or implement of unethical behaviour. (shrink)

The aim of this essay is to specify the chief concern for post-Marxist political strategy as the discovery or invention of a new political logic. Beginning with Laclau and Mouffe’s influential Hegemony and Socialist Strategy: Towards a Radical Democratic Politics, this essay extends Lyotard’s well-known diagnosis of the status of metanarratives to a consideration of the conditions for political resistance and dissent. Using concepts drawn from the work of Althusser, Nealon, and others, it reworks Laclau and Mouffe’s appropriation of Gramsci’s (...) concept of hegemony in order to separate it from any foundational, normative political identity. In conclusion, the essay uses Bergson’s discussion of intuition and fabulation in order to begin to articulate the concepts of a democratic politics. (shrink)

The question which is never entirely resolved is: what is life? Biology, claims to stand for the study of life and living things, yet we would say that it cannot make a thoroughly clear distinction between living and non living, except in some very obvious cases. There are textbook definitions, of course, based on certain notable properties such as the ability to metabolize or reproduce, but these are arbitrary. If we are familiar with the characteristics of a particular animal or (...) plant, we know enough to be able to pronounce that it is dead when certain internal and external behaviours are no longer evident. Even this has difficulties - such as revealed in the arguments about whether to switch off a human life support system or not. When you find a squishy object on the seashore, can you be sure if it is alive or dead - or never living? The same dilemma confronts medical scientists and microbiologists trying to decide, for example, whether viruses are living, or quasi living, or intermittently living, or what. (shrink)

In between those two points there are a number of layers of computer program which communicate with each other: the keyboard controller sends a message to the operating system which is interpreted by a word processor, which then returns a message to the operating system, which communicates with the video controller and the video board sends a message that it needs an “a” (...) and this is mapped as a group of pixels which light up on the screen. Except that none of this actually happens. At the level of physical reality, all that happens is the shifting of magnetic fields and the passing of electrons. Cohen On 24 July 1998, Russell Eugene Weston, Jr., stormed the United States Capitol, forced his way through a security checkpoint, bypassed a metal detector, and entered the office complex of Representative (...) Tom DeLay (R-TX), the House Majority Whip (Weil 1998). During this period of terror, he shot and killed two officers of the Capitol Police and seriously wounded another as they attempted to end his foray. 1 Weston was severely wounded by several Capital police officers and taken into custody. After being treated for his injuries, he was incarcerated in the District of Columbia. 2On 5 May 1999, Weston was transferred to the Federal Correctional Institute in Butner, North Carolina (United States v. Weston, 69 F. Supp. 2d 99 (D.D.C. 1999), 103), where he remains to this day. He has neither been brought to trial nor received appropriate psychiatric therapy, but continues to be warehoused "in solitary confinement under constant observation... in a psychotic state (United States v. I will briefly detail the legal events responsible for this mad situation and suggest alternative actions that should have been taken at the very onset of the case. Early Chronology Although overtly the crime appeared to be senseless and without any conceivable motivation, Weston believed that his acts were justified and necessary. The story he told to the court-appointed forensic psychiatrist, Sally C. Johnson, M.D., 3 was that while working for NASA in the early 1980s, he had developed a "Ruby Satellite System," a powerful machine that could reverse time. With access to this system, nothing was permanent--the user could simply reverse time and exit from the current scene. However, the "System" was now controlled by cannibals who were developing and spreading "Black Heva," the deadliest disease known to [End Page 391] humankind, similar to HIV or the plague. It resulted from human corpses rotting and turning black. Time was running out, and Weston believed he had to return to override the "Ruby Satellite System" in the Capitol so that he could stem the spread of "Black Heva" and prevent world calamity. He believed that if he were tried, convicted, and even executed, he could simply time reverse himself, place himself in a safe within the Capitol, and subsequently resume his life at whatever point he chose (United States v. Cir. 2000), 19-20).On 22 April 1999, the district court accepted Dr. Johnson's diagnosis that Weston suffered from paranoid schizophrenia, the symptoms of which were so severe that he would be incapable of understanding the proceedings against him and of assisting in his own defense. On this basis, the court had no difficulty in finding him incompetent to stand trial (U.S. v. Weston 1999, 102).At Weston's initial hearing, Dr. Johnson had testified that medication would be efficacious in treating Weston's delusions: [T]he standard of care in someone suffering from this type of symptom picture would be to treat them with medication.... [T]here is a good likelihood that he'll have a positive response, positive in the sense that his symptoms will diminish in response to treatment.... The potential benefits to treating the defendant far outweigh the risks.... (U.S. v. Weston 1999, 108) The defense presented no expert testimony refuting Dr. Johnson's presentation. The district court then ordered that Weston begin receiving medication in order to render him nondangerous and competent for trial (U.S. v. Weston 1999, 108-9).
