Truth and Authority in Vico's Universal Law.Mirella Vaglio & Donald Phillip Verene - 1999 - Peter Lang Incorporated, International Academic Publishers.
This is the first full-length study of Vico's Diritto Universale to be written in English. This study places the work within the wider traditions of Roman legal scholarship and natural law, which Vico was confronting. Truth and Authority in Vico's Universal Law breaks new ground in the treatment of Aristotelian influences on Vico. It examines Vico's idea that a theory founded on the subjective right of the single individual cannot be the foundation of social relationships. This entails the investigation of (...)

  4. Plato's Simile of Light. Part I. The Similes of The Sun and The Line.A. S. Ferguson - 1921 - Classical Quarterly 15 (3-4):131-.
No part ot Plato's writings has been more debated than the three similes in Books VI.-VII. of the Republic, and still there is a diversity of opinion about their meaning. I believe that most of these difficulties arise from certain assumptions about their purpose which need revision. The current view applies the Cave to the Line, as Plato seems to direct, and this application, which is itself attended by considerable difficulties, leads to an assimilation of the two figures till they (...)

    What’s yours is ours: waiving intellectual property protections for COVID-19 vaccines.Nancy S. Jecker & Caesar A. Atuire - 2021 - Journal of Medical Ethics 47 (9):595-598.
This paper gives an ethical argument for temporarily waiving intellectual property protections for COVID-19 vaccines. It examines two proposals under discussion at the World Trade Organization : the India/South Africa proposal and the WTO Director General proposal. Section I explains the background leading up to the WTO debate. Section II rebuts ethical arguments for retaining current IP protections, which appeal to benefiting society by spurring innovation and protecting rightful ownership. It sets forth positive ethical arguments for a temporary waiver that (...)

  16. The deliberative democrat’s Idea of Justice.John S. Dryzek - 2013 - European Journal of Political Theory 12 (4):329-346.
In Amartya Sen’s The Idea of Justice, democracy is necessary for the reconciliation of plural justice claims. Sen’s treatment of democracy is however incomplete and inadequate: democracy is under-specified, there are unrecognized difficulties in any context featuring deep moral disagreement or deep division and a conceptualization of public reason in the singular erodes his pluralism. These faults undermine Sen’s account of justice. Developments in the theory of deliberative democracy can be deployed to remedy these deficiencies. This deployment points to a (...)

Peter S. Fosl offers a radical interpretation of Hume as a thoroughgoing sceptic on epistemological, metaphysical and doxastic grounds. He first contextualises Hume's thought in the sceptical tradition and goes on to interpret the conceptual apparatus of his work - including the Treatise, Enquiries, Essays, History, Dialogues and letters.

In "mind-Body identity, Privacy and categories" richard rorty set forth a new form of the identity theory of the mind, (called the 'disappearance' version) in which he suggested that instead of identifying sensations with neural events, Sensations might be eliminated. Using an illustration of rorty's I show that 'pain' cannot come to refer to a brain process for neural events are neither pleasant nor unpleasant. For 'pain' to refer to something unpleasant, We would have to give 'brain process' the connotation (...)

Max Weber’s ideal versus material interest distinction revisited.Dustin S. Stoltz & Omar Lizardo - 2018 - European Journal of Social Theory 21 (1):3-21.
While Weber’s distinction between ‘ideal’ and ‘material’ interests is one of the most enduring aspects of his theoretical legacy, it has been subjected to little critical commentary. In this article, we revisit the theoretical legacy of interest-based explanation in social theory, with an eye to clarifying Weber’s place in this tradition. We then reconsider extant critical commentary on the ideal/material interest distinction, noting the primarily Parsonian rendering of Weber and the unproductive allegiance to ‘generic need’ readings of Weber’s action theory. (...)

    Deleuze’s Difference.Matthew S. Linck - 2008 - International Journal of Philosophical Studies 16 (4):509 – 532.
This article delineates the core concerns and motivations of the ontological work of Gilles Deleuze, and is intended as a programmatic statement for a general philosophical audience. The article consists of two main parts. In the first, two early writings by Deleuze are analysed in order to clarify his understanding of ontology broadly, and to specify the precise aim of his understanding of being in terms of difference. The second part of the article looks at the work of Heidegger and (...)

    Heidegger’s resonance with engineering: The primacy of practice.W. P. S. Dias - 2006 - Science and Engineering Ethics 12 (3):523-532.
This paper describes how some aspects of Martin Heidegger’s philosophy resonate strongly with an engineering outlook. He argued that practice was more “primordial” than theory, though preserving an important role for theoretical understanding as well, thus speaking to the gap between engineering education (highly theoretical) and engineering practice (mostly empirical). He also underlined the reality of “average” practices into which we are socialized, though affirming the potential for original work and action too, thus providing the grounds for self-actualization whether within (...)

    Judicial review: a practising judge's perspective.S. Breyer - 1999 - Oxford Journal of Legal Studies 19 (2):153-166.
In this lecture Justice Breyer examines three classical criticisms of constitutional judicial review. Those criticisms say that a grant to unelected judges of the power to set aside legislation as contrary to a written constitution leads to judicial decision-making that is (a) undemocratic, (b) subjective, and impractical. Justice Breyer describes features of the constitutional decision-making that do not dictate results in individual cases, but none the less hold the judges' 'subjective' will in check. He also describes necessary judicial efforts to (...)

Nietzsche's Metaphilosophy : The Nature, Method, and Aims of Philosophy.Paul S. Loeb & Matthew Meyer (eds.) - 2019 - New York: Cambridge University Press.
Recent Anglophone scholarship has successfully shown that Nietzsche's thought makes important contributions to a wide range of contemporary philosophical debates. In so doing, however, scholarship has lost sight of another important feature of Nietzsche's project, namely his desire to challenge the very conception of philosophy that has been used to assess his merits as a philosopher. In other words, contemporary scholarship has overlooked Nietzsche's contributions to metaphilosophy, i.e. debates around the nature, methods, and aims of philosophy. This important new collection (...)

    Hobbes's religion and political philosophy: A reply to Greg Forster.Aloysius Martinich, S. Vaughan & D. L. Williams - 2008 - History of Political Thought 29 (1):49-64.
A.P. Martinich's interpretation that in Leviathan Thomas Hobbes believed that the laws of nature are the commands of God and that he did not rely on the Bible to prove this has been criticized by Greg Forster in this journal (2003). Forster uses these criticisms to develop his own view that Hobbes was insincere when he professed religious beliefs. We argue that Forster misrepresents Martinich's view, is mistaken about what evidence is relevant to interpreting whether Hobbes was sincere or not, (...)

What is the dry garment which Sceparnio offers to the sea-soaked Charmides? First of all, there is doubt about the spelling of the word. The Palatine tradition is tigillum, though T has tixillum; the Ambrosian palimpsest is provokingly defective at this point and Studemund was unable to determine whether the vowel is e or i. Since the beginning of the sixteenth century editors have chosen to print tegillum, being influenced by notes preserved in the collections of two grammarians—Nonius and Paulus. (...)
