In her article the author shows the relevance of the concept of compromise for protestant ethics after 1945. Coming from the current discussion about the significance of compromise in the german society today she asks for the role of compromises for community building and as a guarantee for plurality in the civil society nowadays. The author illustrates the relation between compromise, plurality and democracy in protestant ethics after World War II by presenting an article of the German pastor Eberhard Müller, (...) who was the founder of the Protestant Academy of Bad Boll in Wuerttemberg/west-germany in 1945. In his article compromise, published in the Evangelisches Soziallexikon (Protestant Encyclopedia of social ethics, Kreuz-Verlag Stuttgart) 1954 Müller emphasizes his conviction, that after the ideology of Nazi-Germany only a culture of communication and exchance, a culture, that is based on compromises could anchor an understanding of democracy in the young German society. What impact should sufficientarianism have on the measurement of inequality? Like other theories of justice, sufficientarianism influences how economic inequality is conceived. For the purpose of measurement, its standards of justice can be approximated by income-based thresholds of sufficiency. At which income level could a threshold of having enough be pegged in OECD countries? What would it imply for standard indicators of inequality, such as decile comparisons of cumulated income, income spreads, or the Gini coefficient? This paper suggests some answers (...) to these questions, showing that sufficientarian ideas could make a difference with respect to the measurement of inequality in a society. (shrink)

This is only the most recent incarnation of the fear of fat (...) Black women, which Sabrina Strings shows took root more than two hundred years ago. Strings weaves together an eye-opening historical narrative ranging from the Renaissance to the current moment, analyzing important works of art, newspaper and magazine articles, and scientific literature and medical journals—where fat bodies were once praised—showing that fat phobia, as it relates to Black women, did not originate with medical findings, but with the Enlightenment era belief that fatness was evidence of “savagery” and racial inferiority. The author argues that the contemporary ideal of slenderness is, at its very core, racialized and racist. Indeed, it was not until the early twentieth century, when racialized attitudes against fatness were already entrenched in the culture, that the medical establishment began its crusade against obesity. An important and original work, Fearing the Black Body argues convincingly that fat phobia isn’t about health at all, but rather a means of using the body to validate race, class, and gender prejudice. We discuss the implementation of Responsible Research and Innovation (RRI) within a project for the development of an AI-supported exergame for assisted movement training, outline outcomes and reflect on methodological opportunities and limitations. We adopted the responsibility-by-design (RbD) standard (CEN CWA 17796:2021) supplemented by methods for collaborative, ethical reflection to foster and support a shift towards a culture of trustworthiness inherent to the entire development process. An embedded ethicist organised the procedure to instantiate a collaborative learning effort and implement RRI (...) in a translational context. Within the interdisciplinary setting of the collaboration and with the support of a technoethicist, we successfully identified relevant, project-specific challenges and developed a roadmap with derived actions, thus meaningfully integrating RRI into the development process. We discuss the methodological procedure in terms of its effectiveness and efficiency, the allocation of responsibilities and roles, particularly regarding potential frictions in the interdisciplinary context with embedded ethics, and the challenges of the translational context. We conclude that the responsibility-by-design standard effectively established a productive workflow for collaborative investigation and work on ethical challenges. We reflect on methodological difficulties and propose possible avenues to our approach. (shrink)

Niche construction denotes the alteration, destruction, or creation of environmental features through the activities of an organism, modifying the relation between organism and environment. The concept of niche construction found application in various fields of research: evolutionary biology, enculturation, ontogenetic development, and local organism-environment coordination. This is because it provides a useful tool emphasizing different aspects of the dynamic interplay between organisms and their actively constructed environment. Traditionally, niche construction is considered a positive mechanism in the complementarity of organism and (...) environment. In contrast, this paper sheds light on the dark side of niche construction, that is, the different manners in which organisms may modify environmental features that are in some way or another harmful to them. First, the paper introduces a paradigmatic distinction of four kinds of niche construction as commonly addressed in recent literature, using more or less extended spatio-temporal scales as the distinguishing feature. Second, the paper elaborates on the concept of negative niche construction, providing normative criteria of (mal)adaptation that are suitable for the evaluation of environmental alterations, given the chosen spatio-temporal scale. Of particular interest are inter-scale conflicts: those cases of environmental constructions which appear adaptive concerning one spatio-temporal scale but maladaptive concerning another. Third, the paper distinguishes the concept of niche construction as a valuable instrument to better understand central aspects of modern medicine and the entangled contribution of evolutionary, socio-cultural, personal, and situational aspects to different health issues, using chronic pain as an illustrative case study. Juxtaposing Cherríe Moraga's Loving in the War Years and Luce Irigaray's Speculum of the Other Woman, I explore the ways that sex and race intersect to complicate an Irigarayan account of the relations between mother and daughter. Irigaray's work is an effective tool for understanding the disruptive and potentially healing desire between mothers and daughters, but her insistence on sex as primary difference must be challenged in order to acknowledge the intersectionality of sex and race. Working from recent work on (...) the psychoanalysis of race, I argue that whiteness functions as a master signifier in its own right, and as a means of differentiation between the light-skinned Moraga and her brown-skinned mother. Irigaray's concept of blood deepens Moraga's account of her healing and subversive return to her mother. The juxtaposition of Moraga, Irigaray, and contemporary psychoanalysis of race can allow for a necessary revision of Irigaray's psychoanalysis that acknowledges the ways in which sexual difference is indexed by race and sheds new light on her account of the mother–daughter relation. In the face of massively increased technological complexity, it is striking that so many of today’s computational and networked things follow design ideals honed decades ago in a much different context. These strong ideals prescribe a presentation of things as useful tools through design and a withdrawal of aspects of their functionality and complexity. Beginning in the mid-twentieth century, we trace this ‘withdrawal program’ as it has persisted in the face of increasing computational complexity. Currently, design is in a dilemma (...) where computational products can be seen as brilliantly designed and engaging to use yet can also be considered very problematic in how they support hidden agendas and often seem less than trustworthy. In this article, we analyse factors shaping this emergent ethical dilemma and reveal the concept of _a widening rift_ between what computational _things actually are and do_ and _the ways in which they are presented as things for use_. Against this backdrop, we argue that there is a need for a new orientation in design programs to adequately address this deepening rupture between the aesthetics and ethics in the design of computational things. This article examines how the so-called disembodied criminal subject is given structure and form through the law of homicide and assault. By analysing how the body is materialised through the criminal law’s enactment of death and injury, this article suggests that the biological positioning of these harms of violence as uncontroversial, natural, and universal conditions of being ‘human’ cannot fully appreciate what makes violence wrongful for us, as embodied entities. Absent a theory of the body, and a consideration of corporeality, (...) the criminal law risks marginalising, or altogether eliding, experiences of violence that do not align with its paradigmatic vision of what bodies can and must do when suffering its effects. Here I consider how the bionic body disrupts the criminal law’s understanding of human violence by being a body that is both organic and inorganic, and capable of experiencing and performing violence in unexpected ways. I propose that a criminal law that is more receptive to the changing, technologically mediated conditions of human existence would be one that takes the corporeal dimensions of violence more seriously and, as an extension of this, adopts an embodied, embedded, and relational understanding of human vulnerability to violence. In a familiar interpretation, the Non-Identity Problem claims that persons whose existence depends on a seemingly harmful action cannot in fact be harmed through such an action. It is often objected that the persons in question can nevertheless be wronged through a violation of their rights. However, this objection seems to fail because these persons would readily waive any violated right in order to come into existence. The present article will analyze this Waiver Counter Argument in detail and show why (...) it does not succeed. First, it is necessary to distinguish between a prospective and a retrospective waiver scenario. In the prospective scenario an imagined person must consider whether she wants to waive a right in order to come into existence. In the retrospective scenario a person is asked whether she would prefer a wronged existence to never having been born. In both scenarios the conditions of a legitimate waiver of rights are not met, but for different reasons. On this basis, an argument against NIP can be developed. (shrink)

Food poverty and food waste are two major contemporary food system problems, which have gained prominence amongst both scholars and policy-makers, due to recent economic and environmental concerns. In this context, the culturally dominant perspective portrays charitable food redistribution as a “win–win solution” to confront food poverty and food waste in affluent societies, although this view is contested by many scholars. This paper applies the notions of framings and flat/sharp keyings to unpack the different narratives entailed by public discourses on (...) food waste and food poverty in Italy. The aim is to problematize the representation of the recent anti-waste/pro-donations law as the optimal policy measure to effectively rectify both food poverty and food waste. The paper argues that the widespread public support for the law reflects the interpretation of charitable food redistribution as a consensus frame, standing for the convergence between flat positions and is reinforced by confusion on terms and responsibilities. Indeed, the strength of the law lies in the capacity to reconcile different positions and bring actors together around a short-term objective, whose foundations have deep roots in the common ethics. However, if the debate is to be moved forward, trade-offs between different framings of problems at stake should be explicitly navigated when designing policy instruments. (shrink)

The purpose of this paper is to highlight an aspect of Elisabeth’s intellectual life that has received little scholarly attention so far, namely Elisabeth’s involvement with the sciences of her day. Firstly, this paper provides a survey of Elisabeth’s interest in and engagement with various scientific disciplines, such as mathematics, medicine, natural philosophy, and microscopy, drawing on her letter exchange with Descartes and several other intellectuals as well as additional documents, such as dedications of scientific works to Elisabeth. Secondly, this (...) paper investigates Elisabeth’s involvement with one particular scientific discipline, namely astronomy. Analyzing Elisabeth’s letter exchange with Andreas Colvius and Constantijn Huygens and additional letters and testimonies, I show that Elisabeth played an active part in at least three current debates in astronomy, namely concerning the discoveries of the satellites of Jupiter, the emerging maps of the moon, and the invention of the new telescopes. Based on the evidence provided in this paper, it is argued that Elisabeth’s intellectual biography should be broadened. It is not sufficient to perceive her only as a critic of Descartes’ philosophy, as this characterization does not accommodate her scientific commitments, but rather as a multitalented intellectual. Since Russell and Burch (1959) suggested the principles of replacement, reduction, and refinement (3Rs) as a foundation for animal research, their influence has only grown in the research community. In this paper, we discuss whether the 3Rs can be constructively used as a prism to analyse decisions regarding the welfare of animals housed in zoos and aquariums (henceforth “zoo animals”). We analyse opportunities and challenges for each of the three Rs when applied to zoo animals. We discuss the following reasons (...) to consider the use of the 3Rs in relation to zoo animals: (1) there are similarities between motivations for housing animals in zoos and using them in research that are ethically relevant to consider; (2) the professional zoo community has committed to progress towards evidence-based best practice models to ensure and enhance the welfare of animals housed in zoos; and (3) there is a growing public concern regarding the welfare of zoo animals which can, to some extent, be met by viewing current practices through the prism of the 3Rs. In this study, we extended a model of the relations among ADHD symptoms, anxiety, and academic performance. Undergraduates (N = 515) completed self-report measures of anxiety (i.e. trait, test, math, and literacy) and ADHD symptoms. During the study, they completed math and literacy measures and reported their current (i.e. state) anxiety three times. There were significant correlations among ADHD symptoms and all measures of anxiety. However, neither ADHD symptoms nor trait anxiety were correlated with math or literacy performance. Test-anxious students (...) reported increasing state anxiety as the study progressed. In contrast, math-anxious students reported increased state anxiety following the math tasks but not the literacy tasks and literacy-anxious students reported increased state anxiety following the literacy tasks but not the math tasks. With respect to performance, math-anxious students had worse math performance and literacy-anxious students had worse literacy performance whereas test anxiety was not directly related to performance on either math or literacy tasks. Patterns of relations did not differ for men and women, but, except for literacy anxiety, women reported higher levels of all types of anxiety. These results could help educators understand how affective responses are related to university students’ academic performance. (shrink)

Social epistemology existed in the scholastic tradition in the shape of doctrines on the legitimate use of probable opinions. Medieval scholasticism had developed sophisticated approaches in this respect, but the apogee of scholastic theoretical reflection on social epistemology occurred in the Baroque era and its Catholic moral theology. The huge debate on probable opinions at that time produced the most far-reaching and deepest investigations into the moral and epistemological foundations and limitations of opinion-based, reasonable discourse prior to the late twentieth (...) century. It is time to recover the arguments and claims of Baroque scholastic social epistemology, not only to fill a lacuna in intellectual history but also to see whether some of its challenges are still with us today. How should a crisis sparked by migration of the poor be dealt with? How should tax evasion be addressed? What is the appropriate response to manipulation of elections? Daniel Schwartz's book illustrates that moralists, lawyers, political decision makers, and society at large already contended with these issues some four hundred years ago. The immediate source of Grotius’s etiamsi-claim (natural law would be valid even if there were no God or human affairs were no concern for him) has never been convincingly identified. This paper argues that Grotius’s formulation of the claim derives from a very similar sentence of Bartolomé de Medina (1527–1580), a Spanish scholastic and eminent member of the School of Salamanca, whose work Grotius quotes in De iure belli ac pacis. Medina ascribes the sentence to Seneca, but there is apparently (...) no such proposition in Seneca’s extant works. Nevertheless, related propositions were attributed to Seneca in the medieval period, not least in sermons and pastoral writings, even in vernacular languages. This shows that, even outside academic debates, counterfactual reasoning involving God’s non-existence or indifference to human affairs was not considered illicit or dangerous in the Middle Ages. Deontologists often assume that ethical constraints hold ‘come what may’ but that violations of the constraints can be excused or pardoned. Vinit Haksar has argued for pardon as deontologically appropriate mitigation for the violation of deontological constraints. However, the reasons he adduces against excuse are inconclusive. In this paper, I show how complex the question of excuse versus pardon for deontological transgressions is. Liability for the development of character traits and the assumption of agent-centered responsibility have to be taken into (...) account before the possibility of pardon can be identified as appropriate deontological softener for strict constraints. Although pain is one of the most fundamental and unique experiences we undergo in everyday life, it also constitutes one of the most enigmatic and frustrating subjects for many scientists. This book provides a detailed analysis of why this issue is grounded in the nature of pain itself. It also offers a philosophically driven solution of how we may still approach pain in a theoretically compelling and practically useful manner. Two main theses are defended: (i) Pain seems inscrutable because there (...) exists no property that is commonly shared by all types of pain and that is at the same time particular to pain, setting it apart from other bodily sensations. This applies irrespective of whether we consider the psychological dimensions, neural networks, causal relations or biological functions of pain. Consequently, it is impossible to refer to ideal far-reaching and ideal distinct generalizations on the matter of pain. (ii) Despite this challenge, by focusing on the resemblance relations that hold across pains, we can generate scientific progress in explaining, predicting and treating pain. In doing so, the book aims to provide a clear conceptual basis for interdisciplinary communication and a useful heuristic for future research. (shrink)

The most common approach to understanding the semantics of the concept of pain is third-person thought experiments. By contrast, the most frequent and most relevant uses of the folk concept of pain are from a first-person perspective in conversational settings. In this paper, we use a set of linguistic tools to systematically explore the semantics of what people communicate when reporting pain from a first-person perspective. Our results suggest that only a pluralistic view can do justice to the way we (...) talk about pain from a first-person perspective: The semantic content of the folk concept of pain consists of information about both an unpleasant feeling and a disruptive bodily state. Pain linguistics thus provides new insights into ordinary pain language and poses an interesting challenge to the dominant unitary views of pain. (shrink)

In this paper, we argue that the concept of environmental scaffolding can contribute to a better understanding of our affective life and the complex manners in which it is shaped by environmental entities. In particular, the concept of environmental scaffolding offers a more comprehensive and less controversial framework than the notions of embeddedness and extendedness. We contribute to the literature on situated affectivity by embracing and systematizing the diversity of affective scaffolding. In doing so, we introduce several distinctions that provide (...) classifications of different types of environmentally scaffolded affectivity. Furthermore, we differentiate eight dimensions that allow us to evaluate the quality and effectivity of scaffolds in particular applications. On that basis, we develop a taxonomy using paradigmatic examples of affective scaffolding. This taxonomy enriches the current debate by emphasizing distinctions that are often conflated and by identifying fields of application that are commonly overlooked. (shrink)

Pain continues to be one of the most controversial subjects in neurophilosophy. One focus of current debates is the apparent absence of an ideal brain‐based biomarker that could function as a coherent and distinct indicator for pain. One prominent reaction to this in the philosophical literature is scientific pain eliminativism. In this article, I argue for a non‐eliminative alternative that builds on family resemblances and provides a useful heuristic in the tradeoff between the idiosyncrasy of the neural processes corresponding to (...) different pain cases and the demand for generalizability in pain research. The virtue development literature often draws on the language of goal-directed automaticity and flow states in discussions of virtue. This article examines the attentional features of various virtues and argues that only some virtuous actions can be adequately described in these terms. It proposes a distinction between three kinds of virtuous actions—flow state actions, deliberative actions, and presence actions—which have varying attentional features, bodily reliance, and conscious reasoning in virtue performance. Then the article motivates these distinctions as important, describing how (...) one might take on-board these classifications in character education, providing a more tailored development of virtues. Cette obligation de consentement est fondée sur la primauté de la personne et la dignité humaine, qui ont été intégrées dans le droit des personnes à la fin de la Seconde Guerre mondiale. Ce principe fondamental a également été inséré au coeur de l’encadrement de la recherche scientifique. La philosophie personnaliste en serait à l’origine. Cet article, après avoir établi la provenance philosophique et historique du principe de dignité humaine, tente de rétablir un certain équilibre entre les intérêts individuels et collectifs impliqués dans la recherche populationnelle. | : According to this paper, personalist philosophy could be at the origin of the importance given to consent in an actual research normative framework. The obligation of consent is well established in Canadian law, but when the time comes to apply it to research on populations, which involves large number samples, it causes some impracticabilities. Access to personal data for populational research should be viewed as a common good contributing to improve life conditions. Si C est spécifié par un constituant non interrogatif ou bien si (...) le spécificateur de C n’est pas réalisé morphologiquement, alors C est préfixé par P. It has become common to draw parallels between scholastic philosophy and modern analytic philosophy. As this paper will show, there exist historical reasons within the scholastic tradition itself to support such comparisons. These reasons bolster a Similarity Thesis regarding the style of reasoning in modern analytic and premodern scholastic thought. In the case of early modern scholastics, it is even possible to substantiate an Identification Thesis, indicating that they primarily identified as scholastics with reference to a reasoning style closely resembling (...) that of post-1970 analytic philosophy. While historians of scholastic thought are correct in asserting that there is no single essential characteristic of scholasticism, but rather a plurality of characteristics, the specific role of a particular reasoning style in defining scholastic theology demonstrates that only this style or method was essential for the self-identification of early modern scholastics as scholastics. This discussion primarily centers on definitions of scholastic theology, as explicit definitions of scholastic philosophy appear to be relatively rare in the scholastic tradition. However, it should be noted that the “analytic” reasoning style associated with scholastic theology was evidently a characteristic of scholastic philosophy as well. (shrink)

In recent years, the societal and personal impacts of pain, and the fact that we still lack an effective method of treatment, has motivated researchers from diverse disciplines to try to think in new ways about pain and its management. In this paper, we aim to develop an enactive approach to pain and the transition to chronicity. Two aspects are central to this project. First, the paper conceptualizes differences between acute and chronic pain, as well as the dynamic process of (...) pain chronification, in terms of changes in the field of affordances. This is, in terms of the possibilities for action perceived by subjects in pain. As such, we aim to do justice to the lived experience of patients as well as the dynamic role of behavioral learning, neural reorganization, and socio-cultural practices in the generation and maintenance of pain. Second, we aim to show in which manners such an enactive approach may contribute to a comprehensive understanding of pain that avoids conceptual and methodological issues of reductionist and fragmented approaches. It proves particularly beneficial as a heuristic in pain therapy addressing the heterogenous yet dynamically intertwined aspects that may contribute to pain and its chronification. (shrink)

Drawing upon two independent national samples of 201 and 241 psychology graduate students, this article describes the development and psychometric evaluation of 4 Web-based student self-report scales tapping student socialization in the responsible conduct of research (RCR) with human participants. The Mentoring the Responsible Conduct of Research Scale (MRCR) is composed of 2 subscales assessing RCR instruction and modeling by research mentors. The 2 subscales of the RCR Department Climate Scale (RCR-DC) assess RCR department policies and faculty and student RCR (...) practices. The RCR Preparedness scale (RCR-P) and the RCR Field Integrity scale (RCR-FI) measure respectively students' confidence in their ability to conduct research responsibly and their belief in the RCR integrity of psychology as a discipline. Factor analysis, coefficient alphas, correlations, and multiple regression analyses demonstrated each of the scales had good internal consistency and concurrent and construct validity. (shrink)

This article provides a first inventory of the extant correspondence of Elisabeth of Bohemia, Princess Palatine and later Abbess of Herford. Elisabeth, one of the most famous women philosophers of the seventeenth century, is best known today for her comprehensive exchange of letters with the French philosopher René Descartes. Our commentary aims to show that the COVID-19 pandemic has amplified existing barriers to healthcare in England for ethnic minority and migrant women. We expose how the pandemic has affected the allocation of healthcare resources leading to the prioritisation of COVID-19 patients and suspending the equal access to healthcare services approach. We argue that we must look beyond this disruption in provision by examining existing barriers to access that have been amplified by the pandemic in order to understand the poorer (...) health outcomes for women in ethnic minority and migrant communities. Pain is often used as the paradigmatic example of a phenomenal kind with a phenomenal quality common and unique to its instantiations. Philosophers have intensely discussed the relation between the subjective feeling, which unites pains and distinguishes them from other experiences, and the phenomenal properties of sensory, affective, and evaluative character along which pains typically vary. At the center of this discussion is the question whether the phenomenal properties prove necessary and/or sufficient for pain. In the empirical literature, sensory, affective, (...) and evaluative properties have played a decisive role in the investigation of psychophysical correspondence and clinical diagnostics. This paper addresses the outlined philosophical and empirical issues from a new perspective by constructing a multidimensional phenomenal space for pain. First, the paper will construe the phenomenal properties of pains in terms of a property space whose structure reflects phenomenal similarities and dissimilarities by means of spatial distance. Second, philosophical debates on necessary and sufficient properties are reconsidered in terms of whether there is a phenomenal space formed of dimensions along which all and only pains vary. It is concluded that there is no space of this kind and, thus, that pain constitutes a primitive phenomenal kind that cannot be analyzed entirely in terms of its varying phenomenal properties. Third, the paper addresses the utility of continued reference to pain and its phenomenal properties in philosophical and scientific discourses. Hybrid and pluralist accounts of concepts agree that the class of concepts includes a multiplicity of heterogeneous representational structures, such as prototypes, sets of exemplars and theories. In this paper I argue that these accounts agree on two additional central claims related to the ways in which they articulate those structures: each type of representational structure can be used independently in psychological processes, and co-referential concepts are associated in a distinctive way as representations of the same category. Although they disagree (...) on concept individuation, they seem to agree that on a processing dimension there are multiple independent representations for a given category and on a long-term storage dimension concepts that represent the same category conform an epistemic unity. This article describes the results of qualitative research into the moral issues faced by social work professionals working in projects targeted at teenage mothers. The research is part of the tradition of empirical and practice-driven ethics. The main questions were: How does morality become visible in the social services for teenage mothers and how do social workers deal with the moral dimension of their work? (How) can education, training and peer review offer space for moral reflection? Interviews and group meetings (...) ('focus groups') were held to answer these questions. Nineteen professionals (front-line professionals as well as professionals in executive roles) participated in the research. The findings describe the moral issues and the moral actions of professionals and the organizational context respectively. The results reveal that the everyday practice of social work professionals can raise complex issues inherent to their work and that there is often no explicit reflection on the moral dimension of these issues. The authors argue that there needs to be greater focus on the complexity of moral issues and elaborate on three dimensions of this complexity. (shrink)

This paper summarizes key shifts in judicial decisions relating to public health powers during the pandemic and the implications of those decisions for public health practice. Then, it gives a preview and call for partnership in developing a legal framework for authority that guides public health to better activities, processes, and accountability in service of the public’s health.

This chapter shows how Derrida's deconstruction in Voiceand Phenomenon exposes a double necessity that undergirds Husserl's phenomenological inquiry in the “First Logical Investigation,” especially with respect to expression and indication. It turns to Derrida's reflections on the aporia of blindness in Memoirs of the Blind in order to further develop the logic of double necessity and to examine Derrida's divergence from Merleau‐Ponty's thought. The chapter examines Derrida's critique of the auto‐affective movement of temporalization in Voice and Phenomenon that reveals the (...) impossibility of pure auto‐affection. It explores the limits of Merleau‐Ponty's phenomenology where he has moved beyond Derrida's deconstruction of Husserlian phenomenology. For Derrida, Merleau‐Ponty's emphasis on speech and perception reveals his entrenchment in the phenomenological prioritization of presence; “soaring up to the sun of presence, it is the path of Icarus”.
