Semantic theories based on a hierarchy of types have prominently been used to defend the possibility of unrestricted quantification. However, they also pose a prima facie problem for it: each quantifier ranges over at most one level of the hierarchy and is therefore not unrestricted. It is difficult to evaluate this problem without a principled account of what it is for a quantifier to be unrestricted. Drawing on an insight of Russell’s about the relationship between quantification and the structure of (...) predication, we offer such an account. We use this account to examine the problem in three different type-theoretic settings, which are increasingly permissive with respect to predication. We conclude that unrestricted quantification is available in all but the most permissive kind of type theory. (shrink)

Disputes over causes play a central role in legal argumentation and liability attribution. Legal approaches to causation often struggle to capture cause-in-fact in complex situations, e.g. overdetermination, preemption, omission. In this paper, we first assess three current theories of causation to illustrate their strengths and weaknesses in capturing cause-in-fact. Secondly, we introduce a semi-formal framework for modelling causal arguments through strict and defeasible rules. Thirdly, the framework is applied to the Althen vaccine injury case. And lastly, we discuss the need (...) for new criteria based on a common causal argumentation framework and propose ideas on how to integrate the current theories of causation to assess the strength of causal arguments, while also acknowledging the tension between evidence-based and policy-based causal analysis in law. Plural logic is widely assumed to have two important virtues: ontological innocence and determinacy. It is claimed to be innocent in the sense that it incurs no ontological commitments beyond those already incurred by the first-order quantifiers. It is claimed to be determinate in the sense that it is immune to the threat of non-standard interpretations that confronts higher-order logics on their more traditional, set-based semantics. We challenge both claims. Our challenge is based on a Henkin-style semantics for plural logic (...) that does not resort to sets or set-like objects to interpret plural variables, but adopts the view that a plural variable has many objects as its values. Using this semantics, we also articulate a generalized notion of ontological commitment which enables us to develop some ideas of earlier critics of the alleged ontological innocence of plural logic. Plural expressions found in natural languages allow us to talk about many objects simultaneously. Plural logic — a logical system that takes plurals at face value — has seen a surge of interest in recent years. This book explores its broader significance for philosophy, logic, and linguistics. What can plural logic do for us? Are the bold claims made on its behalf correct? After introducing plural logic and its main applications, the book provides a systematic analysis of the relation between (...) this logic and other theoretical frameworks such as set theory, mereology, higher-order logic, and modal logic. The applications of plural logic rely on two assumptions, namely that this logic is ontologically innocent and has great expressive power. These assumptions are shown to be problematic. The result is a more nuanced picture of plural logic's applications than has been given thus far. Questions about the correct logic of plurals play a central role in the final chapters, where traditional plural logic is rejected in favor of a "critical" alternative. The most striking feature of this alternative is that there is no universal plurality. This leads to a novel approach to the relation between the many and the one. In particular, critical plural logic paves the way for an account of sets capable of solving the set-theoretic paradoxes. (shrink)

This article examines the concept of “perspective” as an embodied metaphor with ontological and epistemological implications for the modeling of historical understanding of contested pasts. The metaphors employed in modeling past reality shape how we make sense of the controversial past. In particular, I explore how perspectival metaphorical models conjure the notions of presence/proximity/engagement and absence/distance/detachment. To open this up, the paper juxtaposes two distinct models of seeing and knowing as sources of embodied metaphor: 1) static and distancing optical metaphors (...) of cognition, and 2) a “post-cognitive” process of interaction. I argue that the shift towards the affective, experiential and immersive forms of engagement in historical representation is indicative of the growing importance of dynamic, embodied and interactive features in mediated models of the past. The paper concludes by discussing the implications of virtual reality as an emergent medium that offers a new way of modeling the past. Despite its novelty, however, virtual reality raises age-old questions about the dynamics of engagement and detachment in historical understanding. (shrink)

Straipsnyje nagrinėjama vyresnio amžiaus asmenų diskriminacijos raiška Lietuvos darbo rinkoje. Aptariami diskriminacijos dėl amžiaus teoriniai aspektai, vyresnio amžiaus asmenų užimtumas kaip socialinės politikos problema ir pristatomi 2014 m. Lietuvoje atlikto diskriminacijos dėl amžiaus darbo rinkoje sociologinio tyrimo rezultatai. Mokslinės literatūros ir kiekybinio tyrimo duomenų analizės pagrindu galime teigti, kad vyresnio amžiaus asmenys dėl jų amžiaus, lyties, įsitikinimų ir kt. darbe susiduria su įvairaus pobūdžio diskriminacijos apraiškomis. Atliktas tyrimas atskleidė, kad diskriminacija darbinėje aplinkoje išauga su respondentų amžiumi, t. y. vyresnėse grupėse (...) diskriminacijos raiška intensyviausia. 40–50 m. amžiaus grupėje patiriama diskriminacija darbe yra žemesnė nei imties vidurkis. Su amžiumi susijusi diskriminacija išryškėja 56–60 m. amžiaus grupėje, o labiausiai reiškiasi tarp vyresnių nei 60 metų asmenų. (shrink)

Diskurso analitinis požiūris propagandos tyrime gali padėti ne tik ištirti propagandos turinį, žodyną, bet ir jo kūrimo kontekstą, kurio analizė tampa vis svarbesnė, plėtojantis sunkiau atpažįstamoms propagandos formoms. Šiame straipsnyje, taikant pusiau sisteminę literatūros apžvalgą ir dedukcinę teminę analizę, nagrinėjama, kaip jungiant propagandos ir diskurso terminus suvokiama propaganda bei kokiose tyrimų tematikose, interpretaciniuose kontekstuose ir kokius metodus pasitelkiant naudojama tokia jungtis. Į apžvalgą įtraukti anglų kalba 2012–2021 m. publikuoti mokslo darbai, kurių pavadinimuose minimi propagandos, diskurso ar propagandinio diskurso terminai. Tyrimo (...) rezultatai rodo, kad propagandos analizei pasitelkdami diskurso analitinį požiūrį, tyrėjai propagandą daugeliu atveju suvokia kaip neigiamą reiškinį, todėl jos analizei dažniausiai pasitelkia kritinę diskurso analizę. Propagandos ir diskurso terminų jungtis moksliniuose tyrimuose naudojama vis dažniau ir yra ypač būdinga visuomenę poliarizuojančių propagandinių pranešimų analizei. Tačiau moksliniuose darbuose propagandos ir diskurso terminų jungtis ne visada išplėtojama tinkamai. (shrink)

The article provides an analysis on how much the standard court proceedings can be regarded as the research, which is performed by investigating by what manner and measures the justice in a procedural sense is implemented. It is generally acknowledged that the court, as a subject, solving a legal dispute, implements justice only in the case, when it ensures the impartiality towards all persons. The appropriate legal proceedings form a constituent part of the constitutional right to apply in the court. (...) The article aims at introducing certain aspects of the implementation of the principle of justice in the court proceedings of Lithuania. It is indicated that the lack of legal methodology results in different arguments of the rendered decisions and their unpredictability, therefore, it does not encourage to opt for the legal peace. The article is topical in a sense that it has not provided an analysis, on which the aspects of impartiality reveal themselves in the nowadays case law in particular cases and how it produces an effect on the approach to justice. In Lithuania, doctrinal presumptions were created for the freedom of the courts, upon which the courts started to formulate new procedural regulations. The freedom of the actions of judges is based on the aim to ensure a stronger safety in regard to the rights pertaining to one of the public groups, i.e. to disallow the domination of certain subjects over the others by eliminating inequality between the parties. The freedom of the actions of judges is also justified by the aim to render the right decision. However, the formulation of the new regulations according to the actual situation by too freely interpreting the norm of the proceedings, without having the doctrinal basis for that, causes the legal confusion, thus inconsistency in the case law appears, the inner contradictions arise and, in addition to that, there is a failure to follow the standard of impartiality. The individualisation of each legal dispute pursuant to the newly established procedural regulations creates the presumptions for legal instability. Upon the absence of doctrinal substantiation for the newly formulated procedural regulations, the risk arises for the courts to unduly avail of the competence granted to them, thus there will be no implementation of the justice attained. The approach, based on the demand for an individual safety, encourages to refuse the regulations, which are universally applied. Such conception of justice is characteristic for legal individualism, which is grounded in consumerism, by means of which the standard court proceedings are refused, while the extended sympathy theory becomes the starting point. The comprehension and observance of the legal methodology is one of the conditions for the development of the consistent case law. The presence of a clear method in the case law will allow to prevent from pursuing different legal conceptions, i.e. different reasoning of a court decision upon the similar circumstances, as well as it will prevent from speculating on the accepted legal position by refusing the legal argument. According to the singular conception of reality, there are objects and there are singular properties, i.e. properties that are instantiated by objects separately. It has been argued that semantic considerations about plurals give us reasons to embrace a plural conception of reality. This is the view that, in addition to singular properties, there are plural properties, i.e. properties that are instantiated jointly by many objects. In this article, I propose and defend a novel semantic account of plurals which dispenses with (...) plural properties and thus undermines the semantic argument in favor of the plural conception of reality. This chapter provides an overview of the philosophical and linguistic debate about the logic of plurals. We present the most prominent singularizing analyses of plurals as well as the main criticisms that such analyses have received. We then introduce an alternative approach to plurals known as plural logic, focusing on the question whether plural logic can count as pure logic.

Semantic interpretations of both natural and formal languages are usually taken to involve the specification of a domain of entities with respect to which the sentences of the language are to be evaluated. A question that has received much attention of late is whether there is unrestricted quantification, quantification over a domain comprising absolutely everything there is. Is there a discourse or inquiry that has absolute generality? After framing the debate, this article provides an overview of the main arguments for (...) and against the possibility of unrestricted quantification, highlighting some of the broader implications of the debate. In a series of works published over the last thirty years, Rudolf Makkreel accomplished what can be called a hermeneutical rehabilitation of Kant’s Critique of Judgment. Such a rehabilitation has been formulated in explicit opposition to the negative hermeneutical image of Kant’s aesthetics which originated in the work of Hans-Georg Gadamer, and according to which the subjectivization of aesthetics perpetrated by Kant reduced aesthetic judgments to a mere communication of feelings, sanctioning thereby their hermeneutical irrelevance. In this essay I do (...) not intend to evaluate the legitimacy of Makkreel’s considerations about the hermeneutical importance of Kant’s Third Critique. Rather, I aim to question the pertinence of those considerations for Gadamer’s criticism of Kant, specifically in relation to the notion of sensus communis, which plays a central role both in Gadamer’s and Makkreel’s analyses. Straipsnyje siekiama atskleisti, kiek įtakos švietimo funkcijoms turi visuomenės socialinė kaita. Analizuojamos tos funkcijos, kurios tapo svarbios po Lietuvos nepriklausomybės paskelbimo, nes Lietuvai perėjus prie laisvosios rinkos, vienos aktualiausių yra švietimo funkcijos, turinčios užtikrinti švietimo prieinamumą ir socialinį teisingumą. Pagrindinis švietimo funkcijų tikslas – sušvelninti socialinę nelygybę, sumažinti skurdąir socialinę atskirtį. Straipsnio autorių nuomone, pagrindinės švietimo funkcijos, galinčios užtikrinti didesnę visuomenės homogenizaciją, yra: socializacija ir kultūrinė reprodukcija, socialinė kontrolė ir socialinė integracija.

World-systems analysis is a well-established but poorly-defined critical research tradition in the social sciences. Its undisputed progenitor, Immanuel Wallerstein, steadfastly maintains that world-systems analysis is not a theory, yet it is widely referred to as such by commentators, critics, and practitioners alike. The resolution to this conundrum is to identify the defining elements of world-systems analysis as a perspective for understanding human society, then to evaluate propositions based on these defining elements as theories that have been conceptualized from a world-systems (...) perspective. In this paper five defining elements of world-systems analysis are identified that together support a central theorem that the core-periphery hierarchy of the modern world-system can best be understood in terms of state strength and cultural integration. A further conjecture is made that the successor world-system to the current capitalist world-economy is more likely to be an American world-empire than the socialist world-government craved by many world-systems analysts. The information contained in DNA is not definitive, but modifiable. Indeed, the environment has the power to modify the genetic material expression without altering the DNA genes sequence. The principal environmental factors that work in this way, whether in a positive or in a negative way, are diet and stress with their ruling hormones, insulin and cortisol; these hormones are normally antagonists but, when they reach their respective resistances, they become the ubiquitary etiopathogenetic factors in bidirectional convergent relationship, each other (...) causing the disinhibition and development of low grade systemic inflammation that opens the door to a myriad of interconnected sets of problems. Among these problems the greater one is cancer, which represents the extreme junction between hyperinsulinemia and hypercortisolemia, just because cancer cells never become insulin resistant and/or cortisol resistant. This article considers historical facts and investigates the particular relationship between a factual and a valuative dimension within them. The operation is an autopsy of a particular historical fact, which works as an example. On this basis, the article will elucidate the similarities and the differences between historical facts and natural facts, with an emphasis on the observation that the former are more subject to the influence of interpretation than the latter. The article analyses enforcement of freedom of assembly, draws attention to faults of legal regulation of dispute settlement, and revises a possibility of restriction of freedom of assembly. The authors provide evidence that restriction of freedom of assembly by refusing to grant permission to hold a peaceful assembly, is not an effective measure, therefore, it is suggested to educate the public on legal issues in order to enlighten the society about detrimental effect of publicly expressed ideas that provoke national or (...) racial discord, to disclose actual intentions of people who instigate aggression, force and violence so that they do not attract and rally a sufficiently large part of the public. People usually believe that the society enjoys freedom of knowledge and the right to obtain all information, as well as all news that originate and spread across the market, as it creates a pre-requisite for strengthening the best and most useful culture projects resulting in the development of culture and, alongside, the law. Cet essai entend lire Benedetto Croce et Robert Brandom en parallèle, à travers la centralité de la notion d’expression dans l’esthétique de Croce et dans la sémantique de Brandom. Après une première section répondant à certaines objections préliminaires à cette opération herméneutique, l’analyse est développée en deux sections successives. Tout d’abord, les divergences et les convergences entre les deux auteurs concernant la pertinence épistémologique du concept d’expression sont identifiées. Dans les deux cas, l’accent est mis d’une part sur l’articulation comme (...) caractéristique indispensable de l’expression et d’autre part sur la normativité qui distingue clairement l’acte expressif de la simple extrinsécation (« estrinsecazione »). Ensuite, l’accent est mis sur une caractéristique sociale et politique, explicitement non élitiste, des deux auteurs, en quoi réside aussi leur actualité. L’acte expressif, dans ses manifestations esthétiques (Croce) et conceptuelles (Brandom), met effectivement en lumière des structures affectives et cognitives qui, par cet acte seulement, deviennent l’héritage commun d’un sentiment et d’une pensée partagée. Tongan people in Aotearoa New Zealand experience higher rates of mental health challenges than Tongans born in Tonga. Engagement with services is lower for Pacific Island groups than it is for the dominant population in Aotearoa New Zealand. Meanwhile, the Pacific population is growing in Aotearoa New Zealand year after year. This paper explores how services could use evidence to support more appropriate responses for Pacific Islanders, in particular, Tongan communities. In linguistics, the dominant approach to the semantics of plurals appeals to mereology. However, this approach has received strong criticisms from philosophical logicians who subscribe to an alternative framework based on plural logic. In the first part of the article, we offer a precise characterization of the mereological approach and the semantic background in which the debate can be meaningfully reconstructed. In the second part, we deal with the criticisms and assess their logical, linguistic, and philosophical significance. We identify four (...) main objections and show how each can be addressed. Finally, we compare the strengths and shortcomings of the mereological approach and plural logic. Our conclusion is that the former remains a viable and well-motivated framework for the analysis of plurals. (shrink)

This book is the first comprehensive and systematic introduction to the linguistics of humor, exploring not only theoretical linguistic analyses, but also topics from applied linguistics. It will be a valuable resource for students from advanced undergraduate level upwards, particularly those coming to linguistics from related disciplines.

What is the relation between some things and the set of these things? Mathematical practice does not provide a univocal answer. On the one hand, it relies on ordinary plural talk, which is implicitly committed to a traditional form of plural logic. On the other hand, mathematical practice favors a liberal view of definitions which entails that traditional plural logic must be restricted. We explore this predicament and develop a “critical” alternative to traditional plural logic.

This paper examines the contribution of Gabrio Piola to continuum mechanics.Though he was undoubtably a skilled mathematician and a good mechanician, little is commonly known about his papers within the international scientific community, principally because a large part of the Italian school of mechanics was isolated in the first half of the XIXth century.We examine and comment on Piola’s most important papers, and compare them with those of his contemporaries Cauchy, Poisson and Kirchhoff.

In constructional ontology, entities emerge by construction, that is, from the application of constructors to objects. We explore this approach to ontology, focusing on three modules: the constructors, the inputs to the constructors, and the constructional process. Our aim is to identify and assess some key theoretical choices arising in an ontology of this kind.

Questo saggio, risultato del lavoro seminariale svolto presso la Fondazione Centro Studi Campostrini, avanza una proposta teoricasulla base di un’ipotesi. L’ipotesi è che quando usiamo il vocabolariodella credenza diciamo qualcosa di specifico e irriducibile adaltre nozioni. Alla ricerca del nucleo di irriducibilità e specificitàdella credenza Giuseppe Di Salvatore scarta tutte quelle forme dicredenza che dipendono in maniera più o meno diretta da unaconsiderazione in termini di conoscenza o da un’implicazione dellaverità. Se alcuni tipi di giustificazione della credenza possono essereutili (...) a individuarne l’irriducibilità, solo le credenze primitive, unacomplessa nozione di “credenza soggettiva” e un originale modellofiduciario della credenza fungono da buoni candidati per difenderela specificità della credenza. Dopo la discussione di alcune tesi diLudwig Wittgenstein e il ricorso a fonti eterogenee, da William Jamesa Henry Habberley Price fino a Niklas Luhmann, l’autore proponela nozione originale di “credenza progressiva” come il migliorcandidato che confermi l’ipotesi di partenza. In essa una precisaidea di rischio e la fiducia, al cui dibattito è dedicata un’ampiaattenzione, contribuiscono a delineare la credenza progressivainsieme ad alcuni suoi aspetti soggettivi, così profilandola comeuna postura sperimentale. Il saggio si completa con una riflessionesulla peculiarità della questione filosofica della credenza religiosa,la quale viene approcciata nella sua preliminare generalità, quindiconfrontata con la credenza progressiva. This paper reports the framework, method and main findings of an analysis of cultural milieus in 4 European countries. The analysis is based on a questionnaire applied to a sample built through a two-step procedure of post-hoc random selection from a broader dataset based on an online survey. Responses to the questionnaire were subjected to multidimensional analysis-a combination of Multiple Correspondence Analysis and Cluster Analysis. We identified 5 symbolic universes, that correspond to basic, embodied, affect-laden, generalized worldviews. People in this (...) study see the world as either a) an ordered universe;b) a matter of interpersonal bond;c) a caring society;d) consisting of a niche of belongingness;e) a hostile place. These symbolic universes were also interpreted as semiotic capital: they reflect the capacity of a place to foster social and civic development. Moreover, the distribution of the symbolic universes, and therefore social and civic engagement, is demonstrated to be variable across the 4 countries in the analysis. Finally, we develop a retrospective reconstruction of the distribution of symbolic universes as well as the interplay between their current state and past, present and future socio-institutional scenarios. We construct an explicit covariant Majorana formulation of Maxwell electromagnetism which does not make use of vector 4-potential. This allows us to write a “Dirac” equation for the photon containing all the known properties of it. In particular, the spin and (intrinsic) boost matrices are derived and the helicity properties of the photon are studied.

The purpose of this paper is twofold: firstly, it aims to analyze the philosophical debate between Gadamer and Blumenberg concerning the notion of secularization, which, in the author's view, has received less attention than it deserves; secondly, it intends thereby to shed light on an ontological ambiguity in Gadamer's hermeneutics, unintentionally detected by Blumenberg in his reply to Gadamer's review of The Legitimacy of the Modern Age. The importance of the paper is both historical-philosophical and theoretical: it spells out different (...) aspects of a philosophical discussion whose relevance concern not only the secularization debate, but more generally the philosophy of history and the role of metaphors in understanding. The most relevant original contribution consists in the usage of Blumenberg's notion of background metaphorics as a tool for interpreting the role of the notion of history of effects in Gadamer's hermeneutics. Se è spontaneo associare i concetti di immagine e immaginario, in quanto sembrano due nozioni strettamente legate, non è affatto semplice determinare il modo in cui si configura il loro rapporto. Per tracciare i distingua di tale relazione e i metodi che possono aiutarci a chiarirla, partiremo dalla descrizione della coscienza d’immagine — si tratta di un termine husserliano — per arrivare al mito. La nostra riflessione si dividerà in diversi fasi. Analizzeremo infatti la struttura fenomenica dell’immagine mentale, del segno (...) e del simbolo e seguiremo, brevemente, anche il cammino inverso che va dal simbolo all’immagine. I punti salienti della nostra dimostrazione saranno i seguenti: il rapporto immagine-immaginario non può essere definito in modo univoco, in quanto cambia in base al tipo di immagine; a livello della coscienza d’immagine, un approccio psicologico può rivelarsi utile, poiché il supporto percettivo costituisce un momento essenziale dell’immagine reale; nel caso della phantasia o immagine mentale, il metodo psicoanalitico sembra quello più appropriato, poiché l’assenza del supporto percettivo rende le immagini mentali libere da ogni costrizione. Pertanto la comprensione delle dinamiche affettive-desiranti può fornire una spiegazione al corso apparentemente sregolato di associazioni che qui si manifestano. Per quanto riguarda il segno, il simbolo e il mito, le dimensioni affettiva, percettiva, transizionale e fantastica sono strettamente correlate. Questo tipo di immagini sembrano insistere su “schermi” diversi e pertanto si richiede un approccio metodologico variegato. (shrink)

The expression oikoi stratiōtikoi, used in Constantine VII Porphyrogenitus as opposed to oikoi politikoi, designates all those families who were bound to military service. They, in the tenth century, were listed in various enlistment registers that were periodically updated, among which one was kept in Constantinople. There is solid evidence to argue that such an administrative practice originated in the eighth century, coinciding with a significant transformation in the enrolment of soldiers and their maintenance. A conscription procedure was devised in (...) the age of the Isaurians, which, although it is not known whether it was on a voluntary or compulsory basis, entailed the entry in the military records (in Constantinople and the provinces) of every person in charge (oikodespotēs) of the family that had assumed the military burden. This implied in later periods a strong uncertainty in the relationship between service and its performance because registration rested on an ambiguous vocabulary. The ambiguity, in fact, was rooted in the polysemy of the concept of oikos, family unit, home and patrimony at the same time. While such a notion allowed the recruitment in thematic armies to function flexibly through the wide network of the family’s cognate and agnatic structure, precisely because the oikos was also a set of economic interests, it exposed the landed patrimony of military families to splitting and erosion. This ambiguity ended with Constantine VII’s famous law of 949, which regulated the property regime of the stratiōtikoi oikoi, a regime that, as the same provision explicitly states in several points, already existed previously throughout the empire. The law provided a precise economic quantification of the assets needed for each ‘military family’ to perform the service. Historiography has generally interpreted Constantine VII’s measure as an act breaking with the previous tradition, since military service appears in it much more markedly connoted as a patrimonial burden, rather than as a personal one. However, this ‘oppositional’ interpretation does not seem adequate for understanding the concept of oikos stratiōtikos, which from the outset must have implied a profound interrelationship between the personality of the service and its patrimonial basis, since the one did not exist without the other.
