Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

The article describes a framework that identifies event, organizational, and individual factors that threaten ethical decision making in organizations facing discrete crises or in an ongoing crisis environment. Nine propositions are stated that predict threats to ethical decision making during crisis. A comparison between predictions from our model and from Jones's (1991) model is made. Suggestions for research to test and refine the framework are proposed.

The logics BN4 and E4 can be considered as the 4-valued logics of the relevant conditional and (relevant) entailment, respectively. The logic BN4 was developed by Brady in 1982 and the logic E4 by Robles and Méndez in 2016. The aim of this paper is to investigate the implicative variants (of both systems) which contain Routley and Meyer’s logic B and endow them with a Belnap-Dunn type bivalent semantics.

The low representation of women in the Brazilian National Congress has been recurrently criticized by the feminist movements, international agencies and the parliament representatives themselves. From the 513 parliament representatives elected for the 55th legislation, 51 are women representatives, and only 10 of these are evangelical Christians. The acting of evangelical women in politics has not been a subject of interest by the academy in the field of religious and feminist studies. The present article addresses the acting of evangelical women (...) representatives in the current Brazilian politics, taking in consideration the timid participation of women in political parties, the process of evangelical insertion into Brazilian politics and the invisible place of evangelical women on political acting in their parties, including on Legislative drafting related to the right of women. Such an approach has its theoretical basis in discussion of the public/private dichotomy, on the assumption that there is an interdependence between them, and that the social nuisance with the presence of women in the public sphere has to do with the genderization and subsequent hierarchization of such spheres. As a methodological resource, there was made a recollection of the drafts proposals of the 10 evangelical women representatives on their 6 first months of mandate during the current legislation, and also of the draft proposals during the former legislation of the reelected ones. A distinctive form of anticolonial analysis has been emerging from Latin America in recent decades. This decolonial theory argues that important new insights about modernity, its politics, and epistemology become visible if one starts off thinking about them from the experiences of those colonized by the Spanish and Portuguese in the Americas. For the decolonial theorists, European colonialism in the Americas, on the one hand, and modernity and capitalism in Europe, on the other hand, coproduced and coconstituted each other. The (...) effects of that history persist today. Starting thought from these LA histories and current realities enables envisioning new resources for social transformations. These decolonial insights seem to receive only a passing recognition in the Latin American social studies of science and technology projects that have begun cosponsoring events and publications with northern equivalents. My focus will be primarily on the decolonial theory and on just two of its themes. One is the critical resources it offers for creating more accurate and progressive northern philosophies and histories of science as well as social studies of science. The second is insights from Latin American feminists that carry different impacts in the context of the decolonial accounts. (shrink)

It is common to assimilate Marx’s and Spinoza’s conceptions of democracy. In this chapter, I assess the relation between Marx’s early idea of “true democracy” and Spinozist democracy, both the historical influence and the theoretical affinity. Drawing on Marx’s student notebooks on Spinoza’s Theological-Political Treatise, I show there was a historical influence. However, at the theoretical level, I argue that a sharp distinction must be drawn. Philosophically, Spinoza’s commitment to understanding politics through real concrete powers does not support with Marx’s (...) anti-institutional conception of true democracy. And as a matter of social theory, the gap between civil society and the state which so troubles Marx is a development of modernity that has not entered Spinoza's premodern field of view. Marx’s true democracy was also influenced by his study of Rousseau, and theoretically, it is just as close if not closer to Rousseau as to Spinoza. (shrink)

Institutions create their own internal cultures, including the culture of ethics that pervades scientific research, academic policy, and administrative philosophy. This paper addresses some of the issues involved in institutional enhancement of its culture of research ethics, focused on individual empowerment and strategies that individuals can use to initiate institutional change.

The capacity to treat pain has never been greater; but, as you will read in the articles that follow, the problem of undertreated and neglected pain in the United States persists. Deep-seated perceptions and practices undergird this strong and well-documented pattern of neglect. Among the reasons frequently noted for the inadequacy of treatment for pain, however, is that the legal system actually penalizes effective interventions to relieve pain while it leaves neglect of pain unthreatened. It is the mission of the (...) American Society of Law, Medicine & Ethics to explore areas, such as this one, where developments in medicine directly encounter the law and, in turn, create ethical issues for clinicians, regulators, patients, and lawyers.This special issue of the Journal of Law, Medicine & Ethics is part of a multi-year project in which ASLME, with the wonderful support of the Mayday Fund, has worked to address legal and regulatory barriers to effective pain relief. Environmental crises, which are consequences of resource-intensive lifestyles and are characterized to a large extent by both a changing climate and a loss of biodiversity, stress the urgent need for a global social-ecological transformation of the agro-food system. In this regard, the bioeconomy and bioeconomic innovations have frequently been seen as instrumental in addressing these grand challenges and contributing to more sustainable land use. To date, the question of how much bioeconomic innovations contribute to sustainability objectives remains unanswered. Against this (...) background, we study four bioeconomic innovations using the case study of animal production and manure utilization in relation to their potential contributions to a social-ecological transformation. The analysis is based on the application of analytical categories derived from the literature that assess the normativity of these innovations and their implicit cultural changes. The results show that the innovations examined manifest existing thought styles and the incumbent socio-technical regime rather than contribute to a more fundamental transition. In this respect, we stress the importance of evolving alterative ideas in innovation design, applying more integrative approaches, such as embedding innovation processes into transdisciplinary processes, and developing adaptive and reflective governance approaches. In return, bioeconomic innovations should adjust towards the design mission of a social-ecological transformation and include a multitude of actors to discuss and harmonize contesting imaginaries and ethical concerns. This article aims to offer some notes related to the question of the insecurity and fear in urban life. Constitutive condition of many, if not all, contemporary societies, fear and insecurity in urban space, or, in public space, are here analized from two thinkers. The sociologist Zygmunt Bauman is present insofar as he considers the fear a constitutive aspect on two life dimensions : on the fragility and the human contingence towards nature, and on the society itself, constituted by rules (...) and norms. The philosopher Giorgio Agamben is here emphasized on two oportunities. The first, when showing the impossibility of experiences made by human on the current societies context. The second when noting contemporary societies as following the concentration camp paradigm. Starting with these two authors, is found the necessity of rescue the public experience, resignify the economy and revalue the political economy. (shrink)

The results of numerous research studies have revealed that the style in which people deliver their speech impacts on the way they are perceived by others. This is particularly so in the adversarial courtroom, where witnesses' credibility is crucial for winning a case. When witnesses do not speak the language of the courtroom, interpreters are employed to interpret the proceedings accurately. The meaning of `accuracy', however, may not be fully understood by all involved. This article presents the results of a (...) data-based study of Spanish—English court proceedings where it was found that interpreters tend to accurately interpret only the content of witnesses' answers, but constantly alter the style of testimony, either favourably or detrimentally, thus potentially changing the outcome of the case. In this paper, I articulate two Hobbesian models of interpersonal power relations that can be used to understand gender relations in society: what I will call the dominion model and the deference model. The dominion model discerns vertical subjection to another's will, whereas by contrast the deference model places individuals in a complex and shifting webs of favor and disfavor. Hobbes himself analyses gender relations through the dominion model. Indeed, more broadly this is the most prominent model of interpersonal power (...) relations throughout his texts. It is this model which is also reflected in the very rich existing feminist literature on Hobbes. However, the deference model, emerging only late in Hobbes's oeuvre, offers a superior general rubric for understanding interpersonal power relations. In particular, in light of its ability to grasp informal and diffuse relations of power, I argue that it offers useful insights for thinking about gender relations in our post-coverture era. We believe that members of the scientific community have a primary obligation to promote integrity in research and that this obligation includes a duty to report observations that suggest misconduct to agencies that are empowered to examine and evaluate such evidence. Consonant with this responsibility, we became whistleblowers in the case of Herbert Needleman. His 1979 study (Needleman et al., 1979), on the effects of low-level lead exposure on children, is widely cited and highly influential in the formulation of public (...) policy on lead. The opportunity we had to examine subject selection and data analyses from this study was prematurely halted by efforts to prevent disclosure of our observations. Nevertheless, what we saw left us with serious concerns. We hope that the events here summarized will contribute to revisions of process by which allegations of scientific misconduct are handled and that such revisions will result in less damage to scientists who speak out. Pero ¿cómo puede actuar la multitud sin alienar el poder de nadie? Para contestar esta dificultad, Negri explícitamente apela (...) a Spinoza. Sin embargo, en este trabajo, sostengo que la filosofía de Spinoza no respalda el proyecto de Negri. Por el contrario, argumento que la multitud spinozista evita la jerarquía interna por medio de la mediación de las instituciones políticas y no a pesar de ellas; de la misma manera, estas instituciones tampoco simplemente emanan de la multitud tal cual es, sino que estructuran, contienen y canalizan sus pasiones. En particular, las instituciones requeridas no son las de la democracia simple y directa. Political protesters often don’t play by the rules. Think of the Occupy Movement, which brought lower Manhattan to a standstill in 2011 under the slogan, “We are the 99%”. Closer to home, think of the refugee activists who assisted a breakout from South Australia’s Woomera detention centre in 2002. Both are examples of contentious politics, or forms of political engagement outside the institutional channels of political decision-making. The democratic credentials of contentious politics are highly ambivalent. On the one hand, contentious (...) politics appears to have insufficient respect for democratic decision. Protesters are often forceful, uncivil and rowdy, aiming to disproportionately influence policy. But shouldn’t proposals be put forward with civility through the proper channels? And shouldn’t their proponents accept with good grace if they are democratically rebuffed? A closer look at the history of political thought can provide us with the framework to assess the case for and against the democratic reasonableness of contentious politics. (shrink)

J.L. Austin’s insight that language should be treated as a domain of human action, rather than merely as a tool for the transmission of information, has been enormously influential. His analysis of speech acts continues to be widely utilised in a vast number of fields, from the philosophy of language to social and political philosophy, the philosophy of law, gender and literary studies, as well as a variety of social sciences. Yet scholars have so far focused on performative utterances and (...) illocutionary acts, while the perlocutionary dimension of speech has generally been dismissed as unessential. This special issue, drawing inspiration from Stanley Cavell’s seminal work on passionate utterance, aims to shed new light on the philosophical, moral and political relevance of the perlocutionary. Is there something about the deep logic of democracy that destines it to succeed in the world? Democracy, the form of politics that includes everyone as equals – does it perhaps suit human nature better than the alternatives? After all, surely any person who is excluded from the decision-making in a society will be more liable to rise up against it. From ancient thinkers like Seneca to contemporary thinkers like Francis Fukuyama, we can see some version of this line of (...) thought. Seneca thought that tyrannies could never last long; Fukuyama famously argued that liberal democracy is the end of history. I want to focus instead on the person credited with giving the most direct and uncompromising statement of this thought: Benedict de Spinoza. However, in this article, I argue to the contrary that Spinoza’s view of aristocracy should give pause to radical democrats. He does not see a historical movement towards democracy, nor does he see the superiority of democracy as written into human nature. (shrink)

It may be time to question analytic philosophy’s structural ignorance of the methods of ordinary language philosophy. Cavell’s Must We Mean What We Say? upsets the analytic tradition to this end, pursuing a “linguistic phenomenology” that focuses on ordinary language use as a resource for describing the world. Cavell thereby entrusts the tradition with a more ambitious and concrete philosophical task.

The problem of harmful, unnecessary and neglected pain has been studied extensively in many health care settings over the past decade. Research has documented the incidence of untreated pain, and scholars and advocates have given the problem several names: “public health crisis,” “oligoanalgesia, and “moral failing,” among them. Articles have identified a litany of now familiar “obstacles” or “barriers” to effective pain relief. Each of these individual obstacles or barriers has been the subject of targeted remedial action in at least (...) some context.The checklist approach to improving care for patients in pain, however, is likely to have only limited effect. What really appears to be operating is a complex ecosystem that supports ambivalence, denial, and even suspicion of the circumstance of patients in pain and efforts to treat them. Pain relief in emergency medicine, a relatively new setting for the study of challenges to treating pain, provides a revealing context for viewing discrete obstacles to effective pain management in medicine as part of an integrated environment into which patients with pain enter for treatment. This paper discusses divergent thinking as a fundamental characteristic of creativity. Unlike convergent thinking where everything is focused on one solution, divergent thinking seeks the most varied solutions to the considered problem situation while thoughts are scattered on a variety of possible solutions. By its nature, divergent thinking is subversive and destructive and, as such, it deviates from the existing thinking rules and patterns, while bringing disorder into the existing harmony and order of thoughts. In the process of modern education, (...) special attention must be dedicated to all students, but especially to those who can and want more, to those who, in relation to their peers, do a lot of things earlier, to a greater extent, faster, more successfully, better and differently and who consistently have better and higher achievements, which is possible to achieve by encouraging divergent thinking. Therefore, in the modern education, apart from the scientific-convergent shaping of thoughts, space for divergent thinking must also be enabled. (shrink)

The COVID-19 pandemic was a global tragedy, but it also presented a strange pedagogical moment. Women have long been the very name of what has been neglected and despised by public policies, and the consequences of this are also the lack of attention (the lack of care) paid by governments over the last decade to all the sectors in charge of the care and protection of citizens (health, education, poverty, old age, disability). The recent crisis related to the COVID-19 highlighted (...) the vulnerability of human societies and their dependence on care and has shown that our usual conceptual tools are insufficient in the face of the loss of the form of life woven by daily care.
