Frente a la teoría de la pena, con sus sutiles matices y fines comunicativos, encontramos una realidad que diverge sustancialmente de aquella. Donde, con frecuencia, la denominada prevención general no acontece, porque la resolución no llega a esta, a la generalidad a la que se apela como fundamento del castigo. Pero, en particular, cuando tal comunicación acontece, tiene lugar en un inquietante marco discursivo que va dando nombre a nuestro tiempo: la era de la posverdad. Se revela aquí un contexto (...) comunicativo hostil al discurso experto y a los hechos, que se ven desplazados por su valoración, donde los interlocutores se alejan del modelo del ciudadano racional sobre el que se teoriza en Derecho, y donde actores políticos desarrollan estrategias comunicativas propagandistas, de modo que, en ocasiones, se termina comunicando un mensaje contrario a lo que enuncia literalmente la resolución judicial. The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)

Peut-on continuer à considérer les canons d’Elvire comme appartenant à un seul concile ? L’historiographie française la plus répandue jusqu'a ce jour a répondu affirmativement à cette question. Depuis la fin du siècle dernier, on assiste a un débat très anime sur l’authenticité et l’unité des Actes dits d’Elvire. Les différentes thèses se partagent entre deux approches totalement opposées : l’une soutient l’unité des Actes, sans refuser qu’ils aient pu être remanies au cours de leur transmission historique ; l’autre, a (...) la suite de l’article pionnier de M. Meigne (1975), défend le caractère composite des Actes, qui constitueraient une collection de dispositions juridiques hétérogènes. The expansion of research on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises important neuroethics and policy questions related to data sharing. However, there has been little empirical research on the perspectives of experts developing these technologies. We conducted semi-structured, open-ended interviews with aDBS researchers regarding their data sharing practices and their perspectives on ethical and policy issues related to sharing. Researchers expressed support for and a commitment to sharing, with most saying that they were either sharing their data (...) or would share in the future and that doing so was important for advancing the field. However, those who are sharing reported a variety of sharing partners, suggesting heterogeneity in sharing practices and lack of the broad sharing that would reflect principles of open science. Researchers described several concerns and barriers related to sharing, including privacy and confidentiality, the usability of shared data by others, ownership and control of data (including potential commercialization), and limited resources for sharing. They also suggested potential solutions to these challenges, including additional safeguards to address privacy issues, standardization and transparency in analysis to address issues of data usability, professional norms and heightened cooperation to address issues of ownership and control, and streamlining of data transmission to address resource limitations. Researchers also offered a range of views on the sensitivity of neural activity data (NAD) and data related to mental health in the context of sharing. These findings are an important input to deliberations by researchers, policymakers, neuroethicists, and other stakeholders as they navigate ethics and policy questions related to aDBS research. This article analyzes a panel of 550 international firms, for the period 2004 to 2010, to compare the role of female directors in family and non-family firms in promoting responsible practices. Many studies have associated the presence of women on the board with a higher degree of socially responsible commitment. However, we found that this is much less so in family firms than in non-family firms. In family firms, corporate social responsibility commitment does not vary significantly with the presence of (...) female directors, as the latter tend to behave in accordance with the family orientation toward CSR. This orientation depends on the stakeholders being addressed, with greater social responsibility shown toward external stakeholders than internal ones. (shrink)

The capacity of next-generation closed-loop or adaptive deep brain stimulation devices to read and write shows great potential to effectively manage movement, seizure, and psychiatric disorders, and also raises the possibility of using aDBS to electively modulate mood, cognition, and prosociality. What separates aDBS from most neurotechnologies currently used for enhancement is that aDBS remains an invasive, surgically-implanted technology with a risk-benefit ratio significantly different when applied to diseased versus non-diseased individuals. Despite a large discourse about the ethics of enhancement, (...) no empirical studies yet examine perspectives on enhancement from within the aDBS research community. We interviewed 23 aDBS researchers about their attitudes toward expanding aDBS use for enhancement. A thematic content analysis revealed that researchers share ethical concerns related to safety and security; enhancement as unnecessary, unnatural or aberrant; and fairness, equality, and distributive justice. Most researchers felt that enhancement applications for DBS will eventually be technically feasible and that attempts to develop such applications for DBS are already happening. However, researchers unanimously felt that DBS ideally should not be considered for enhancement until researchers better understand brain target localization and functioning. While many researchers acknowledged controversies highlighted by scholars and ethicists, such as potential impacts on personhood, authenticity, autonomy and privacy, their ethical concerns reflect considerations of both gravity and perceived near-term likelihood. However, other writings like Carmen de Cometa anni M.D.LXXVII (1578), offer us different ideas about how Sánchez considers possible the scientific knowledge like, for example, his idea about the casual relations between natural objects.

The Coalition of Immokalee Workers (CIW) has successfully combated modern-day slavery by transforming the ways that over a dozen major brands, including Taco Bell, Subway, and Wal-Mart, manage their supply chains. The CIW’s efforts over more than 20 years have effectively stopped enslavement practices, including abuses such as wage theft and peonage indebtedness. We conducted a field ethnography, interviews, and archival analyses to understand this success. We find that the CIW employs a decentered, egalitarian, and ensemble approach to their multiplicities (...) of alliances by collectively “animating” themselves and their partners through ensemble leadership. This combination of alliances, along with worker-driven monitoring, brings life to the CIW motto “We are all leaders.” Translating this motto into daily practice is how the CIW virtually eradicates enslavement practices in corporate supply chains. Two populations are subdivided into two categories of individuals (hawks and doves). Individuals fight to have access to a resource which is necessary for their survival. Conflicts occur between individuals belonging to the same population and to different populations. We investigate the long term effects of the conflicts on the stability of the community. The modelis a set of ODE's with four variables corresponding to hawk and dove individuals of the two populations. Two time scales are considered. A fast time (...) scale is used to describe frequent encounters and fightings between individuals trying to monopolize the resource. A slow time scale is used for the demography and the long term effects of encounters. We use aggregation methods in order to reduce this model into a system of two ODE's only for the total densities of the two populations which is found to be a classical Lotka-Volterra competition model. We study different cases of proportions of hawks and doves in both populations on the global coexistence and the mutal exclusion of the two populations. Pure dove tactics in both populations are unstable. In cases of mixed hawk and dove in both populations, there is coexistence. Pure dove or mixed hawk-dove tactics in one population can coexist with pure hawks in the other one when the costs of fightings between hawks are large enough. (shrink)

The tumor suppressor protein p53 is intimately involved in the cellular response to DNA damage, controlling cell cycle arrest, apoptosis and the transcriptional induction of DNA damage inducible genes. A transcriptional target of p53, Gadd45, was recently found to bind to PCNA, a component of DNA replication/repair complexes, thereby implicating Gadd45 in DNA metabolism(1). Using biochemical assays, a role for Gadd45 in excision repair in vitro has been demonstrated(1). Antisense experiments have also indicated an in vivo role for the GADD45 (...) gene in UV‐irradiation survival. These discoveries establish a link between p53 and DNA repair through Gadd45. (shrink)

The relationship between social and financial performance (CSP – FP) has been a main objective in the literature on business management, as it would provide an economic justification for the social investment insofar as it contributes to the creation of value. This relationship has been empirically tested by several authors though without using a theoretical model that sustains this relationship. The aim of this article is to propose a theoretical model of the process of the creation of value from the (...) reputation generated by companies, integrating the factors that have been shown to be more relevant in this process from previous research, in such a way that hypotheses are put forward regarding the existence of this relationship and the factors that determine it. BackgroundMonitoring recovery–stress balance in sport is becoming more relevant to prevent training maladaptation and reach the optimal performance for each athlete. The use of questionnaires that identify the athlete’s recovery–stress state have much acceptance in sports due to reliability and useful, furthermore for its low cost. Identifying possible differences between sport modalities and sex is important to determine specific needs and possible intervention ways to keep a recovery–stress balance. The aim was to analyze the differences in the recovery–stress state and (...) mood states by sex and sport type during the competitive phase in young Mexican athletes. As a secondary objective, the psychometric properties of the Mexican version of the Recovery–Stress Questionnaire for Athletes were analyzed.MethodsA cross-sectional study was carried on with 461 athletes, 17.95 years old, from six sports disciplines. The RESTQ-Sport and Profile of Mood States were applied in a single moment. Differences by sex and sports modality were analyzed. RESTQ-Sport’s confirmatory factor analysis was performed after the stress and recovery theoretical structure of two stress and two recovery dimensions, and last, the concurrent validation with the POMS was carried on.ResultsSignificant differences by sex were found in the General Recovery and Sport Stress dimensions of the RESTQ-Sport as well as Vigor factor of the POMS, being higher for men; furthermore, both the Sport Recovery dimension of RESTQ-Sport and Cholera and the Fatigue and Depression factors from POMS also had differences by sport type, showing a less recovery and high stress for individual sport athletes. Goodness-of-fit indexes of the model for the RESTQ-Sport were acceptable. Pearson’s correlation between questionnaires was moderate.ConclusionThe recovery–stress state shows differences in the function of sex and sport modality. More special attention is suggested for women and individual sport athletes. The higher punctuation for men compared with women in sport stress dimension did not negatively affect the recovery–stress balance for male athletes. Finally, the Mexican context adaptation of the RESTQ-Sport provides a psychometric instrument suitable to assess the recovery–stress balance in Mexican athletes. (shrink)

The lysine demethylase KDM5A collaborates with PARP1 and the histone variant macroH2A1.2 to modulate chromatin to promote DNA repair. Indeed, KDM5A engages poly(ADP‐ribose) (PAR) chains at damage sites through a previously uncharacterized coiled‐coil domain, a novel binding mode for PAR interactions. While KDM5A is a well‐known transcriptional regulator, its function in DNA repair is only now emerging. Here we review the molecular mechanisms that regulate this PARP1‐macroH2A1.2‐KDM5A axis in DNA damage and consider the potential involvement of this pathway in transcription (...) regulation and cancer. Using KDM5A as an example, we discuss how multifunctional chromatin proteins transition between several DNA‐based processes, which must be coordinated to protect the integrity of the genome and epigenome. The dysregulation of chromatin and loss of genome integrity that is prevalent in human diseases including cancer may be related and could provide opportunities to target multitasking proteins with these pathways as therapeutic strategies. Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. In seiner Auseinandersetzung mit Eberhard behauptet Kant, Kritizismus sei die eigentliche Apologie von Leibniz. Diese Äußerung darf nicht einfach als sarkastisch abgetan werden. Kant kann dies insofern ernsthaft denken und behaupten, da für ihn die Transzendentalphilosophie die wesentliche philosophische Bedeutung des leibnizschen Gedankens aufhebt, liegt doch schon in Leibniz ein kritizistischer Kern, welcher wiedergewonnen werden kann. Man sieht hier nur einen Aspekt dieser historischen Transformation von Leibniz im kantischen Gedanken, und zwar: die explizite Behauptung Kants, das Konzept der prästabilierten Harmonie (...) werde in der Theorie der reflektierenden Urteilskraft und im Begriff der Zweckmäßigkeit kritisch aufgehoben. Dazu muss man jedoch vorher den Grundzug des kritischen Unterschieds zwischen Kant und der leibniz-wolffschen Philosophie durch eine Diskussion über die Bedeutung des Begriffs des Transzendentalen erläutern. Health‐related data uses and data sharing have been in the spotlight for a while. Since the beginning of the big data era, massive data mining and its inherent possibilities have only increased the debate about what the limits are. Data governance is a relevant aspect addressed in ethics guidelines. In this context, the European project BRIDGE Health (BRidging Information and Data Generation for Evidence‐based Health policy and research) strove to achieve a comprehensive, integrated and sustainable EU health‐information system. One of (...) the aims of the project was to evaluate the requirements to construct a data‐linkage infrastructure for the secure management of health information. In a blueprint provided for this infrastructure, the topics ethics and the intimately related governance occupied a whole section, where the recent ethics guidelines by the Council for International Organizations of Medical Sciences (CIOMS) and the World Medical Association (WMA) were referenced. We explore what has changed in the latest versions of the ethics documents adopted by CIOMS and WMA regarding the management of health data and human tissues, the appropriateness of their application in new forms of research and infrastructures as the proposed in the BRIDGE Health project, and whether society should be so concerned about this topic, in the digital era of social exchange. Academic entrepreneurship and the formation of spin-offs from educational institutions have been consolidated as essential elements to promote innovation and stimulate economic growth worldwide. However, the evolution of these initiatives shows marked differences between developed countries and emerging economies, such as Colombia. This study focuses on analyzing how research in this area has progressed, identifying the key factors that determine the success of spin-offs and suggesting a framework for action for Colombia in comparison with international dynamics. The findings reveal a (...) shift in research attention from prioritizing the creation of spin-offs to a greater focus on their long-term performance and sustainability. At the international level, the relevance of technology transfer, strategic alliances between universities and industry and the efficient management of technological resources are highlighted. On the other hand, in the Colombian context, research tends to focus on institutional aspects, cultural factors and support regulations, underestimating the analysis of the performance of spin-offs after their creation. This paper aims to contribute to the formulation of policies and strategies that promote not only the emergence but also the sustainability of academic spin-offs in Colombia, seeking to align their practices with international standards in order to maximize their impact on the economic and social development of the country. Diversas evidencias parecen indicar que, durante la comprensión oral, el procesamiento del habla se realiza a partir de la información verbal auditiva y de la información viso-gestual proveniente del interlocutor. En este marco, se evaluó el tiempo y la precisión de respuestas de sujetos oyentes en una tarea de lectura labial con el patrón acústico suprimido. En ella, 25 participantes adultos, sin diagnóstico de patologías lingüísticas o cognitivas ni discapacidad auditiva o visual, debían distinguir si estaban frente a una palabra (...) del español a partir de la visualización de su articulación. Para la tarea se construyeron 240 estímulos, divididos en tres grupos de 80 ‘Palabras’ del español, 80 ‘Pseudopalabras’ del español y 80 ‘No-Palabras’, presentados en forma aleatoria. Los resultados respecto del tiempo de respuesta indicaron que las ‘Palabras’ (m=717,6ms) se reconocen con una velocidad menor que las ‘Pseudopalabras’ (m=809,5ms) y las ‘No-Palabras’ (7633,7ms); mientras que las ‘Pseudopalabras’ demoraron más en ser respondidas que las ‘No-Palabras’. Por su parte, en los resultados de precisión los estímulos presentaron el siguiente patrón de reconocimiento: ‘Palabras’<‘Pseudopalabras’<‘No-Palabras’ (correspondientes a un 59,89%, 62,5% y 86,3%, respectivamente). Del mismo modo, se encontró evidencia robusta de la relación entre el tipo de estímulo presentado y el acierto/desacierto de las respuestas, aunque el modelo indica que la condición ‘No-Palabra’ es reconocida con mayor facilidad y que la diferencia entre ‘Palabras’ y las ‘Pseudopalabras’ no es relevante. Asimismo, se observó una relación entre la menor velocidad y el desacierto en las respuestas. Estos datos corroboran la hipótesis de la integración de información proveniente de la percepción visual y el procesamiento del lenguaje, al mismo tiempo que permiten proyectar trabajos futuros con evidencias electrofisiológicas. La crisis sanitaria ocasionada por la expansión del Covid-19 pone en evidencia las consecuencias que tiene sobre la vida común la mercantilización de lo público y el mercado como eje regulador de la vida y de las relaciones humanas. El contexto actual demostró la cadena de inequidades que enfrentan las mujeres en la región, pudiendo identificarse al menos tres dimensiones en las que se expresa esta desigualdad: los cuidados, el trabajo y la violencia. Es menester de este artículo realizar un (...) estudio del impacto de la pandemia en estas tres dimensiones, buscando aportar a la reflexión para la acción que permita repensar un mundo pospandemia, donde la perspectiva de género no se constituya como una agenda coyuntural de los gobiernos, sino como un elemento fundamental en la transformación de nuestras sociedades. Este artículo es fundamentalmente descriptivo, utilizando para su análisis la información de datos secundarios, principalmente cuantitativos, de diferentes fuentes de información; por tanto se trata de datos recolectados, procesados, analizados y publicados con propósito diferente a los objetivos de este artículo. Las principales fuentes de información han sido ONU, OIT, CEPAL, ONU MUJERES, UNESCO y ACNUR. (shrink)

This study examines personal and emotional metaphors of prospective economics teachers about the roles they themselves as teachers and their pupils would play by analysing their drawings and responses to open questions. This is a longitudinal study that analyses the evolution of future instructors using two periods: before and after their teaching practicum. Metaphors are categorised into four classes: behaviourist/transmissive, cognitivist/constructivist, situative/socio-historical, and self-referential. The categories for emotions are primary or social and positive, negative, or neutral. The results show that (...) the highest percentage of metaphors for the teacher’s role in both questionnaires were cognitivist/constructivist. Comparison of the findings before and after the teaching practicum revealed no changes in most of the participants’ metaphors and associated models. The analysis also reveals that among those who change, the tendency is to evolve towards more pupil-centred metaphors and associated models. The most common pupil metaphors are behaviourist and cognitivist, increasing after the practicum. Finally, most of the emotions expressed are positive and social, also increasing after the practicum. Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. Este estudio da cuenta de las tensiones, reveladas por autoridades de servicios públicos que atienden personas vulnerables, en su relación de colaboración con OSFL (Organizaciones Sin Fines de Lucro), para alcanzar tal horizonte. La vigilancia tecnológica, que comienza como un mecanismo empresarial de captación y fidelización clientelar, ha conocido un desarrollo tecnológico tal que, junto a la obtención masiva de datos producidos de forma inconsciente y su tratamiento por la inteligencia artificial, ha permitido la anticipación de las tendencias y la supervisión constante de los deseos e intereses de los usuarios. La integración de vigilancia y consumo ha supuesto que esta lógica del mercado pueda ser entregada a la gubernamentalidad, transformando la racionalidad disciplinaria (...) estática en múltiples dinámicas de observación de una población móvil pero controlable en términos biopolíticos, de modo que el deseo y la libertad se convierten así en dimensiones activas de una economía política actual. Se ofrecen algunos ejemplos de este auténtico panoptismo digital, como puede comprobarse con el uso de navegadores, las aplicaciones financieras, la hipersegmentación de nichos de consumo o el internet de las cosas. Por último, se analiza el tránsito de esta vigilancia hacia una lógica de gobierno basada en la predeterminación de los intereses: es el paso del panoptismo a la gubernamentalidad. (shrink)

Este texto se centra en la génesis de las ciencias sociales a través de una reflexión analítico- descriptiva sobre la sistematización de la ciencia. La ciencia es una creación del ser humano y constituye la mejor herramienta para adquirir conocimientos acerca de su entorno, de sí mismo, del universo... Debe ser interdisciplinaria y para dar soporte a este empeño, hemos tenido que elegir, y hemos optado por comparar la sociología con la filosofía buscando aportaciones (implícitas o explícitas) de prestigiosos pensadores.
