“Every step and every movement of the multitude, even in what are termed enlightened ages, are made with equal blindness to the future; and nations stumble upon establishments, which are indeed the result of human action, but not the execution of any human design.”—_Adam Ferguson_ During the Scottish Enlightenment, David Hume, Adam Smith, Adam Ferguson, and other lesser thinkers described a theory of spontaneously generated social order. Ronald Hamowy discusses their contributions to this significant area of social theory, noting (...) that the revolutionary aspect of these philosophers’ thoughts was “the proposition that social phenomena of a high degree of intricacy are not the product of intentional design.” Hamowy shows that Hume is best known for his application of the theory to justice, developing it most thoroughly in the _Treatise of Human Nature. _Adam Smith’s first treatment of it is in the _Theory of Moral Sentiment, _published before the significant _Wealth of Nations. _There Smith uses it to explain the development of general rules that compose the moral fabric of societies. All of these thinkers used their notion of spontaneously generated social order to explain systems of moral rules and social systems. Instead of an editorial, in this issue of Environmental Values the publishers have been invited to comment on a local environmental issue that currently looms large in our Scottish island backyard. Divided from mainland Scotland by fifty miles of sea, the Outer Hebrides are a peripheral part of the already peripheral Scottish Highlands - a region of low production, and high demands on thinly spread national services. Fifteen years ago our economic salvation was to be the creation of (...) the largest stone quarry in Europe, to supply aggregate for the construction industry in South-east England and mainland Europe. After two Public Inquiries and much legal wrangling this proposal was eventually laid to rest. Its eventual defeat was at least partly due to the united front against the proposed development that was maintained by a coalition of virtually all the environmental NGOs that function north of the English border.1In environmental terms, aggregates, the landscape damage caused by quarrying, and the connection with road-building and increasing motor traffic are readily characterised as a 'bad thing', but the latest threat to the Scottish and island landscape is a less clear-cut environmental bad. The prospect of large-scale windfarms, and the associated transmission lines that would be required to deliver electric power from them to markets in the South, is one that has already divided environmental groups; with Friends of the Earth generally in favour, Greenpeace equivocal, and landscape- and wildlife-oriented NGOs against. For wind energy has long been promoted as a 'green' alternative to damaging fossil fuels and dangerous nuclear power, and its proponents argue that we should not be deflected on merely aesthetic grounds from grasping a technology that could save the world from climate catastrophe. This division of the environmental camp inevitably makes it more likely the developers will prevail. As with the superquarry, scale is part of the problem: the proposed developments are massive - mouth-wateringly so to local councils and landowners attracted by the prospect of multi-million pound revenues, devastatingly so to the majority of local residents and to the many walkers and climbers who visit the Highlands and Islands for their majestic and unspoilt scenery.The following extracts from recent press releases by the John Muir Trust and the local campaigning group Moorlands Without Turbines, and the developers' mock-up of thevisual impact of one of the local proposals above, will convey to readers the scale of proposals for Scottish windfarms, the strength of local feeling and the real dilemmas faced by NGOs in developing a coherent response.... targets set in the [renewable energy] strategy for Highland Council area are greater than those of the Scottish Executive for the whole of Scotland ... The Scottish Executive has a renewable energy target for 2020 which requires another 3,400 MW in Scotland. The Highland Council Renewable Strategy sets a target of over 4,000 MW from new renewable energy.The Highland Council targets do not seem to have been strategically set in relation to factors outside the Highlands but look as if they are based on the maximum possible installation based on the most liberal planning regime.2Scottish Executive Minister Allan Wilson has given the first official statistics on the number of objections for the proposed North Lewis Peatlands Windfarm - the world's largest onshore windfarm.In a response to written questions by Green MSP Shiona Baird, Mr. Wilson states: 'Prior to Comhairle nan Eilean Siar [Western Isles Council] submitting its consultation response the Executive recorded six responses in support and 2,713 objections to the Lewis Windpower proposal from Western Isles residents. Since Western Isles Council submitted their consultation response, the Executive has recorded 11 responses of support and 1,860 objections to the Lewis Windpower proposal, from Western Isles residents'In total a massive 6,131 objections have been received of which 4,573 come from local people. The figures show that for every person who wrote to support the scheme from the islands 269 people wrote and objected.Lewis based Moorland without Turbines chairperson Catriona Campbell, who is campaigning against the joint AMEC and British Energy project said:'At last we have official confirmation of the unprecedented level of protest against this industrialisation of our land. Till now our local MSP and Council have refused to acknowledge the sentiment of the island. The Council voted in favour of it against the wishes of those who will be affected. Every community council and councillor in North Lewis, the area directly affected, has voted resoundingly against it.'...The proposed 234 turbines, each higher than the Forth Rail bridge, and 167km of new road would cover moorland that is protected by European Law for its wildlife interest, including international populations of species such as Golden Eagles, Red-throated Divers and Golden Plovers.3The Lingerabay Superquarry saga was a rich source for academic case-studies; we confidently predict that we shall hear more about the 'green energy' debate in the pages of this journal. This article sets out to examine the role of teacher research and enquiry in the professional development of teachers. The context derives from the initiative of the Scottish Executive to enhance the status and working conditions of teachers. We consider the extent to which continuing professional development activities arising out of the Chartered Teacher Programme encourage teachers to value research, equip them to become research-minded and support them to engage in research and enquiry in their own professional contexts.

The morning-after pill has been promoted as a solution to the growing teenage sexual health problem being witnessed in Scotland. The continuing increase in sexually transmitted infections (STIs), recorded in recent reports of the Scottish Centre for Infections and Environmental Health2, has come as a shock to members of the health profession across Scotland. Documenting a marked increase in teenage sexual activity, the report raises urgent questions about the impact of the “safe sex” message in our classrooms and the (...) Scottish Executive’s overall approach to teenage sexual health. One specific feature of this approach that has prompted concern from General Practitioners (GPs), parents and educators (and others) has been the official policy on the promotion of the morning-after pill as a method of contraception. When appropriately initiated within 72 hours of unprotected coitus, emergency contraception will prevent approximately 80% of pregnancies in teens and young women who are mid-cycle and, thus, at risk of pregnancy.3 But this policy has not been based on a clear and rigorous understanding of the properties, the function and the efficacy of the morning-after pill. Neither has there been adequate and in-depth research on the short and long-term safety implications of the morning-after pill. In light of proposals to increase the availability of the morning-after pill, the overall aim of this Briefing Paper is: 1. to provide specific answers to the questions raised above, based on research evidence; and 2. to provide an independent source of information on the most recent research on the morning-after pill and STIs, for parents, teachers, politicians, members of the health and legal professions and other interested parties. Muito é escrito sobre o que a participação na filosofia poderia fazer para a criança academicamente e emocionalmente. O que propomos aqui é que permitindo às crianças participar de diálogos filosóficos elas aprenderão uma abordagem que poderia dar suporte a sua participação na sociedade e que poderia envolvê-las na consideração e no arejamento de suas vistas, tomando decisões em suas interações e (...) relacionamentos com os outros. É inevitável que, vivendo com os outros, se encontrem os valores dos outros. É essencial, portanto, que as crianças aprendam como lidar com os valores dos outros mas também que elas aprendam como desenvolver os seus próprios pelo questionamento e a reflexão. Melhor que ensinar às crianças sobre os valores ou ensinar-lhes os valores que elas deveriam ter, este artigo sugere que às crianças deveriam ser proporcionadas oportunidades de explorar uma variedade de perspectivas e que elas precisam aprender a fazer isto. Além disso, no entanto, a fim de viver harmoniosamente com os outros, existem considerações sobre ética a serem encontradas. As crianças precisam aprender como lidar com política, arte, ciência, literatura e a maior variedade de problemas que a vida em sociedade inclui. É colocado, neste artigo, que participando dos diálogos filosóficos uma pessoa é suscetível de favorecer uma apreciação dos outros e de suas perspectivas, de compreender que os valores e opiniões de alguém evoluem, que essa visão filosófica pode, de fato, funcionar para a melhora da sociedade. SUMMARYThe Machiavellian Moment was largely responsible for establishing what remains the dominant understanding of American Revolutionary ideology. Patriots, on this account, were radical whigs; their great preoccupation was a terror of crown power and executive corruption. This essay proposes to test the whig reading of patriot political thought in a manner suggested by Professor Pocock's pioneering first book, The Ancient Constitution and the Feudal Law. The whig tradition, as he taught us, located in the remote Saxon past an ‘ancient (...) constitution’ of liberty, in which elected monarchs merely executed laws approved by their free subjects in a primeval parliament. This republican idyll, whigs believed, was then tragically interrupted by the Norman Conquest of 1066, which introduced feudal tenures and monarchical tyranny. Did patriot theorists accept this narrative? The answer, I shall argue, is strikingly mixed. By the early 1770s, appeals to the ‘ancient constitution’ had become less common in patriot writing. And by the end of the 1770s, many patriots had absorbed a completely different understanding of the feudal past—one pioneered by Royalist historians of the seventeenth century and then adapted by Scottish historians of the eighteenth. This shift reflects a broader transformation in patriot political and constitutional theory. (shrink)

It seemed like only minutes after a team of Scottish scientists announced, in late February 1997, that they had successfully cloned a sheep, that governmental officials and private citizens throughout the world called for a ban on cloning human beings. The rush to legislate or issue executive orders was so swift, it is reasonable to wonder why the news that a mammal had been cloned ignited such a stampede to prohibit, even criminalize, attempts to clone humans. These events (...) raise a series of separate, yet related questions. Why does the prospect of cloning human beings incite such strong reactions? What reasons have been proposed for enacting national laws or international conventions to prohibit cloning? Can these prohibitions be justified by sound ethical arguments? Before attempting to answer these questions, let us look first at the responses that called for public policy measures to ban human cloning. (shrink)

Abstract The values of the healthcare sector are fairly ubiquitous across the globe, focusing on caring and respect, patient health, excellence in care delivery, and multi-stakeholder collaboration. Many individual pharmacists embrace these core values. But their ability to honor these values is significantly determined by the nature of the system they work in. -/- The paper starts with a model of the prevailing pharmacist workforce model in Scotland, in which core roles are predominantly separated into hierarchically disaggregated jobs focused on (...) one professional ‘pillar’: Clinician /Practice Provider; Educator; Leader/Manager; and Researcher. This is the ‘Atomistic’ Model. This skills-segregation yields a workforce of individuals working in isolation rather than collaborating together, and lacking a shared information flow, purpose and identity. Key strategic flaws include suboptimal responsiveness to population and subpopulation needs, inconsistency and inequity of care, an erosion of professional agency, and lower job satisfaction. It is conjectured that this results from a lack of congruence between values, professional ethos, and organizational structure. ‘Atomism’ culminates in a syndrome of widespread professional-level cognitive dissonance. -/- The paper contrasts this with a new emerging workforce vision, The Collaborative Care Model. This new model defines a systems-first-approach, built on the principle that all jobs must include all four professional ‘pillars’. Vertical skills integration, involving education and task sharing, will support sustainability and succession planning. Horizontal skills integration (across practice, leadership and research) is included to improve responsiveness to population need and individual professional agency. The working conditions, supportive ethos, and career structure needed to make the model work are described. Moral theory and workforce theory are used to justify why the model may be more effective for population health, delivering greater job satisfaction for individuals and ultimately helping systematically realize and honor healthcare values. Finally, the paper sketches the first steps needed to implement the model at the national level, starting with the operationalization of new multi-pillar professional curricula across the career spectrum. Patients with schizophrenia have an impairment in the inhibition of reflexive saccades, as a consequence of a functional impairment of the prefrontal cortex, which has not yet been encapsulated in terms of a formal model. A number of novel and testable hypotheses can be generated from the framework proposed by Findlay & Walker that will stimulate further research. Their framework therefore marks an important step in the development of a comprehensive functional model of saccadic eye movements. Further advances will be (...) assisted by (1) a recognition of important distinctions in the executive control of volitional saccades and (2) addressing the capacity for cross-model integration of spatial information in the generation of the spatial properties of saccadic eye movements. To deal with potential conflicts between the triple-bottom-line expectations of investors and the performance of executives, firms can use incentives by integrating corporate social performance targets into executive compensation. No evidence yet exists that CSP targets in executive compensation actually lead to an improvement of CSP results. Using a panel data set of 400 firms for the years 2008–2012 leading to 1846 firm-year observations, the relationships between CSP targets and CSP results and CSP improvements are analyzed. The results (...) show that the level of CSP has no effect on the use of CSP targets, the use of CSP targets in general does not automatically lead to better CSP results, and the use of quantitative, hard CSP targets is an effective way to improve CSP results, especially to lower CSP weaknesses. This study investigated relationships between inter-class variations in paranormal experience and executive functions. A sample of 516 adults completed self-report measures assessing personal encounter-based paranormal occurrences, executive functions together with Emotion Regulation and Belief in the Paranormal. Paranormal belief served as a measure of convergent validity for experience-based phenomena. Latent profile analysis combined experience-based indices into four classes based on sample subpopulation scores. Multivariate analysis of variance then examined interclass differences. Results revealed that breadth of paranormal experience was (...) associated with higher levels of executive functioning difficulties for General Executive Function, Working Memory, Decision Making, and Belief in the Paranormal. On the Everyday Memory Questionnaire, scores differed on Attention Tracking and Factor 3, but not Retrieval. In the case of the Emotion Regulation Scale, class scores varied on Expressive Suppression, however, no difference was evident on Cognitive Reappraisal. Overall, inter-class comparisons identified subtle differences in executive functions related to experience. Since the present study was exploratory, sampled only a limited subset of executive functions, and used subjective, self-report measures, further research is necessary to confirm these outcomes. Social information processing theory suggests that the chief executive officer’s entrepreneurial orientation is an organisational signal that influences the members’ innovativeness. Middle management teams are expected to be more innovative as they connect senior managers with frontline managers in the dynamic competitive environment of the digital economy. How CEOs guide MMT innovations through EO becomes critical in the process of capturing opportunities and creating value. However, previous research has failed to adequately identify distinct CEO EO manifestations with organisational contexts (...) configurations that influence MMTs innovation. Thus, based on differences in organisational contexts and MMTs’ cognition, this study thoroughly investigates how the vertical manifestation of CEO EO impacts the innovativeness of MMTs. We used fuzzy-set qualitative comparative analysis on a sample of 117 organisations to determine which configurations of CEO EO vertical penetration within an organisation can stimulate MMT innovativeness. The study discovered four first-level configurations that support stimulating MMT innovativeness respectively when the CEO EO is fully or partially manifested, and without the CEO EO. Moreover, we found the internal reasons for MMTs’ information interpretation heterogeneity, which is critical for realising the coordination and unity of entrepreneurial cognition and behaviours. Finally, these findings’ theoretical and practical implications are discussed. (shrink)

The primary aim of this study was to investigate the relation between self-perceived executive functions and the school achievement of young adolescents, while controlling for parental education and sex. We specifically focused on executive aspects of daily life behavior and the higher-order EFs, as measured with self-report, rather than on the more basic EFs which have been the primary focus of prior investigations. In two independent samples of sixth graders, students evaluated their EFs on a self-report questionnaire, the (...) Amsterdam Executive Functioning Inventory. School achievement in the domains of mathematics and reading comprehension were evaluated with nationally used, norm-based achievement tests. Results revealed that the self-perceived EFs of young adolescents were significantly correlated with their school achievement in both study samples. School achievement was also correlated with the level of parental education, but the factor sex did not have such influence. In study 1, self-perceived EFs explained additional variance in school achievement, while controlling for parental education and sex. In study 2, this was only the case for the most robust measure of school achievement, i.e., the end-of-primary-school final achievement test. Furthermore, besides the relation with achievement tests, we also found a relation between self-perceived EFs and teacher ratings behavioral problems in the classroom. Together, our findings imply that young students can properly reflect on the effectiveness and appropriateness of their EFs in a way that is relevant to their academic achievement and classroom behavior. The findings underscore the importance of considering the development of EFs and parental education in the evaluation of academic achievements in early adolescence. (shrink)

We empirically examine the impact of corporate social responsibility (CSR) on CEO compensation using a large sample of the US firms from 1996 to 2010. We develop and test two hypotheses, the overinvestment hypothesis based on agency theory and the conflict–resolution hypothesis based on stakeholder theory. We find that the lag of CSR adversely affects both total compensation and cash compensation, after controlling for various firm and board characteristics. Our estimates show that an interquartile increase in CSR is followed by (...) a 4.35% (2.78%) decrease in total (cash) compensation. We also find an inverse association between lagged employee relations and CEO compensation. Our results are robust to the correction for endogeneity using instrumental variable approach. Taken together, our results support the conflict–resolution hypothesis, but not the CSR overinvestment argument. (shrink)

The current paper proposes the Dysexecutive Luck hypothesis; that beliefs in being unlucky are associated with deficits in executive functioning. Four studies suggest initial support for the Dysexecutive Luck hypothesis via four aspects of executive functioning. Study 1 established that self-reports of dysexecutive symptoms predicted unique variance in beliefs in being unlucky after controlling for a number of other variables previously reported to be related to beliefs around luck. Studies 2 to 4 demonstrated support for the Dysexecutive Luck (...) hypothesis via assessment of executive functioning via: two fundamental executive functions , emotional processes related to executive functioning as described by the Somatic Marker hypothesis, and higher executive functions as accessed via divergent thinking. The findings suggest that individuals’ beliefs in being unlucky are accompanied by a range of deficits in executive functioning. (shrink)

There are legitimate worries about gaps between scientific evidence of brain states and function (for example, as evidenced by fMRI data) and legal criteria for determining criminal culpability. In this paper I argue that behavioral evidence of capacity, motive and intent appears easier for judges and juries to use for purposes of determining criminal liability because such evidence triggers the application of commonsense psychological (CSP) concepts that guide and structure criminal responsibility. In contrast, scientific evidence of neurological processes and function (...) – such as evidence that the defendant has a large brain tumor – will not generally lead a judge or jury to directly infer anything that is relevant to the legal determination of criminal culpability . (Vincent 2008) In these cases, an expert witness will be required to indicate to the fact-finder what this evidence means with regard to mental capacity; and then another inference will have to be made from this possible lack of capacity to the legal criteria for guilt, cast in CSP terms.<br><br>To reliably link evidence of brain function and structure and assessment of criminal responsibility, we need to re-conceptualize the mental capacities necessary for responsibility, particularly those that are recognized as missing or compromised by the doctrines of “legal capacity” (Hart 1968) and “diminished capacity.” I argue that formulating these capacities as executive functions within the brain can provide this link. I further claim that it would be extremely useful to consider evidence of executive function as related to the diminished capacity doctrine at sentencing. This is because it is primarily at this stage in criminal proceedings where the use of the diminished capacity doctrine is most prevalent, as evidenced by the recent Supreme Court cases of Atkins v. Virginia (536 U.S. 304 (2002)) and Roper v. Simmons (543 U.S. 551 (2005)).<br>. (shrink)

In Responsible Brains, Hirstein, Sifferd and Fagan apply the language of cognitive neuroscience to dominant understandings of criminal responsibility in criminal law theory. The Authors make a compelling case that, under such dominant understandings, criminal responsibility eventually ‘translates’ into a minimal working set of executive functions that are primarily mediated by the frontal lobes of the brain. In so arguing, the Authors seem to unquestioningly accept the law’s view of the “responsible person” as a mixture of cognitive capacities and (...) mechanisms—thereby leaving aside other fundamental aspects of individuals’ human agency. This commentary article offers a critique of the Authors’ rationalist and individualist approach. The critique can be summarized through the following claim: We humans, as responsible beings, are more than our executive functions. This claim articulates through four main points of discussion: role of emotions in moral judgments and behavior; executive functions and normative criteria for legal insanity; impact of adverse situational factors on executive functions; Authors’ account of punishment and, especially, rehabilitation. In China, investors generally make decisions depending on the intonation of executive announcements. A total of 20,328 observations are sampled from the Chinese equity market between 2005 and 2019. We perform principal component analysis to produce monthly sentiment indices and calculate the weighted average of the value over the fiscal year to measure the degree of investor sentiment. The results of the empirical analysis reveal that: there is a significant positive correlation between market-level investor sentiment and executive tone, (...) stock price and trading-volume pressures on executives, and firm-level investor expectation and gambling tendency positively moderate the relationship between investor sentiment and executive tone, executive optimism does not mediate the association between investor sentiment and executive tone, and manipulated and real intonations are non-homogeneous tactics adopted by rational managers to cater to changes in investor sentiment. These findings indicate that executives' intonations are both an extension of firms' current and past performances and managers' decision-making based on sentiments and behaviors of irrational investors, which are consistent with the Catering Theory. In addition, rational executives tend to adopt various intonation tactics to respond to investor sentiment to avoid declines in stock prices and trading volumes. (shrink)

President Trump verbally attacked human rights in his campaign rhetoric in 2016, leading many to believe that he would undermine the role of human rights in US foreign policy as President. I examine whether or not President Trump’s anti-human rights rhetoric manifested in US foreign policy by analyzing potential changes in how human rights were considered in foreign aid allocations under the Trump Administration. While President Trump had a number of executive tools at his disposal to exert control over (...) foreign aid allocation, he would still have had to overcome considerable bureaucratic and legislative inertia in order to implement his anti-human rights agenda in US foreign aid. I demonstrate that he was unsuccessful in overcoming this inertia, at least in the first 2 years of his Administration (the years for which data is currently available). If anything, human rights received more consideration under President Trump than under President Obama. (shrink)

There are few industries in which decisions are so intently scrutinized by millions of Canadians as the healthcare industry. Each and every day important decisions concerning the funding and delivery of healthcare are made away from the clinic and in the offices of administrators and policy makers.
