Turri describes a case in which a group of experts apparently correctly advise you not to withhold on a proposition P, but where your evidence neither supports believing nor disbelieving P. He claims that this presents a puzzle about withholding: on the one hand, it seems that you should not withhold on P, since the experts say so. On the other hand, we have the intuition that you should neither believe nor disbelieve P, since your evidence doesn't support it. Thus, (...) there is apparently no doxastic attitude you are permitted to adopt to P. Turri considers various solutions to the puzzle, but in the end rejects all of them and concludes that it seems to be unsolvable. I suggest resolving the puzzle by distinguishing between what I call the subjective and the collective ‘should’. In light of your, the subject's, evidence, i.e., in the subjective sense of ‘should’, you should neither believe nor disbelieve P. However, in light of your and the experts' combined evidence, i.e., in the collective sense of ‘should’, you should not withhold on P. It is true that you are not permitted to adopt a doxastic attitude if you should not, in the subjective sense of ‘should’, adopt it; but this is not so if you should not adopt it in the collective sense. Thus, you are actually permitted to withhold on P. The puzzle is nonetheless philosophically interesting since it points something out that deserves more discussion in epistemology: epistemic advice and the collective sense of the doxastic ‘should’, which we use when giving epistemic advice. Video surveillance is an omnipresent phenomenon in today’s metropolitan life. Mainly intended to solve crimes, to prevent them by realtime-monitoring or simply as a deterrent, video surveillance has also become interesting in economical contexts; e.g. to create customer profiles and analyse patterns of their shopping behaviour. The extensive use of video surveillance is challenged by legal claims and societal norms like not putting everybody under generalised suspicion or not recording people without their consent. In this work we propose a technological (...) solution to balance the positive and negative effects of video surveillance. With automatic image recognition algorithms on the rise, we suggest to use that technology to not just automatically identify people but blacken their images. This blackening is done with a cryptographic procedure allowing to revoke it with an appropriate key. Many of the legal and ethical objections to video surveillance could thereby be accommodated. In commercial scenarios, the operator of a customer profiling program could offer enticements for voluntarily renouncing one’s anonymity. Customers could e.g. wear a small infrared LED to signal their agreement to being tracked. After explaining the implementation details, this work outlines a multidisciplinary discussion incorporating an economic, ethical and legal viewpoint. (shrink)

BackgroundOperation room (OR) planning is a complex process, especially in large hospitals with high rates of unplanned emergency procedures. Postponing elective surgery in order to provide capacity for emergency operations is inevitable at times. Elderly patients, residents of nursing homes, women, patients with low socioeconomic status and ethnic minorities are at risk for undertreatment in other contexts, as suggested by reports in the medical literature. We hypothesized that specific patient groups could be at higher risk for having their elective surgery (...) rescheduled for non-medical reasons.MethodsIn this single center, prospective observational trial, we analysed 2519 patients undergoing elective surgery from October 2018 to May 2019. A 14-item questionnaire was handed out to illicit patient details. Additional characteristics were collected using electronic patient records. Information on the timely performance of the scheduled surgery was obtained using the OR’s patient data management system. 6.45% of all planned procedures analysed were postponed. Association of specific variables with postponement rates were analysed using the Mann–Whitney U test and Fisher's exact test/χ2-test.ResultsSignificantly higher rates of postponing elective surgery were found in elderly patients. No significant differences in postponing rates were found for the variables gender, nationality (Germany, EU, non-EU), native language, professional medical background and level of education. Significantly lower rescheduling rates were found in patients with ties to hospital staff and in patients with a private health insurer.ConclusionsElderly patients, retirees and nursing home residents seem to be at higher risk for having their elective surgery rescheduled. However, owing to the study design, causality could not be proven. Our findings raise concern about possible undertreatment of these patient groups and provide data on short-term postponement of elective surgery.Trial registration DRKS00015836. Videoüberwachung ist heute allgegenwärtig. Sie dient dazu, Delikte im Nachhinein aufzuklären, zur Echtzeit-Überwachung oder zur Abschreckung. Darüber hinaus gibt es aber auch wirtschaftliche Interessen für eine Videoüberwachung und automatische Erfassung von Personen – z.B. zur Erstellung von Kundenprofilen und somit zur Analyse von Kaufverhalten. Dem gegenüber stehen Rechtsanspruche sowie ethische und gesellschaftliche Grundnormen, etwa dass Menschen nicht unter Generalverdacht gestellt oder ohne Zustimmung aufgezeichnet werden dürfen. In dieser Arbeit wird ein technischer Lösungsansatz behandelt, der eine flexible Handhabung der Videoüberwachung erlaubt. (...) Es werden in diesem Zusammenhang neben der technischen Umsetzung auch ökonomische, ethische und juristische Fragen betrachtet. Der Lösungsansatz besteht darin, Personen auf Videoaufnahmen durch ein kryptographisches Verfahren unkenntlich zu machen, noch bevor die Aufnahmen die Kamera-Elektronik verlassen. Nur mittels eines geheimen kryptographischen Schlüssels können einzelne Zeit- und Bildbereiche einer Aufnahme wieder deanonymisiert werden, wodurch rechtlichen wie ethischen Bedenken Rechnung getragen werden kann. In kommerziellen Szenarien erlaubt es diese digitale Tarnkappe, dass Kunden z.B. im Rahmen eines Prämien-Programms freiwillig auf Anonymisierung verzichten. Während in der Literatur der Informatik bereits seit längerem Technologien für solche System beschrieben werden, werden in dieser Arbeit Wege gezeigt, wie dessen Einbettung in die Gesellschaft wirklich realisiert werden könnte. Resumen Este artículo aborda dos reescrituras de William Shakespeare en la dramaturgia chilena actual, Shakespeare falsificado: reconstrucción falsificada de un manuscrito censurado de Luis Barrales y La Tempestad de Juan Radrigán. Para ello propone la reescritura como ejercicio metadramático, un gesto consciente, dramático y político, que busca dialogar y discutir con el original, inscribiendo la nueva perspectiva autorial en el continuum de la tradición cultural. Dentro de este enfoque, el trabajo expone, en primer lugar, las características de la dramaturgia renacentista (...) inglesa como una praxis híbrida, colaborativa, refundidora y política. Luego, caracteriza ambas reescrituras como prácticas que muestran la vigencia y continuación de un canon cultural, literario y dramático, por medio de las distintas modulaciones que se imprimen desde estas nuevas voces. Asimismo, las perspectivas de Barrales y Radrigán se exhiben como gestos políticos expresados hacia sus contextos.The following article approaches two rewritings of William Shakespeare’s work within current Chilean playwriting:Shakespeare falsificado: reconstrucción falsificada de un manuscrito censurado, by Luis Barrales andLa Tempestad, by Juan Radrigán. It proposes rewriting as a metadramatic exercise, a conscious gesture -both political and dramatic- that seeks to establish dialogue and discussion with its original, inscribing a new authorial perspective within the cultural tradition continuum. With this approach, this work exposes, first, characteristics from English renaissance dramaturgy as a hybrid praxis, collaborative, refounding and political. Then, it characterises both rewritings as practice that showcase the currency and continuation of a cultural, literary and dramatic canon through different articulations that print themselves in our voices. Likewise, Barrales and Radrigan’s perspectives display themselves as political gestures expressed towards their contexts. (shrink)

This paper defends and develops the structuring account of conscious attention: attention is the conscious mental process of structuring one’s stream of consciousness so that some parts of it are more central than others. In the first part of the paper, I motivate the structuring account. Drawing on a variety of resources I argue that the phenomenology of attention cannot be fully captured in terms of how the world appears to the subject, as well as against an atomistic conception of (...) attention. In the second part of the paper, I show how the structuring account can be made precise: attention causes and causally sustains phenomenal relations to hold between the parts of the stream of consciousness; most importantly the relation of one part being peripheral to another. I end by pointing out consequences for both the scientific study of attention as well as for several areas of central philosophical interest. (shrink)

For years as an award-winning war reporter, Sebastian Junger traveled to many front lines and frequently put his life at risk. And yet the closest he ever came to death was the summer of 2020 while spending a quiet afternoon at the New England home he shared with his wife and two young children. Crippled by abdominal pain, Junger was rushed to the hospital by ambulance. Once there, he began slipping away. As blackness encroached, he was visited by his (...) dead father, inviting Junger to join him. "It's okay," his father said. "There's nothing to be scared of. I'll take care of you." That was the last thing Junger remembered until he came to the next day when he was told he had suffered a ruptured aneurysm that he should not have survived. This experience spurred Junger--a confirmed atheist raised by his physicist father to respect the empirical--to undertake a scientific, philosophical, and deeply personal examination of mortality and what happens after we die. How do we begin to process the brutal fact that any of us might perish unexpectedly on what begins as an ordinary day? How do we grapple with phenomena that science may be unable to explain? And what happens to a person, emotionally and spiritually, when forced to reckon with such existential questions? (shrink)

This dissertation investigates the nature, the phenomenal character and the philosophical significance of attention. According to its central thesis, attention is the ongoing mental activity of structuring the stream of consciousness or phenomenal field. The dissertation connects the scientific study of attention in psychology and the neurosciences with central discussions in the philosophy of mind. Once we get clear on the nature and the phenomenal character of attention, we can make progress toward understanding foundational issues concerning the nature and the (...) structure of conscious mentality itself. We understand better how consciousness is connected to self-awareness and to agency, and we get a better grip on the nature of perceptual experience, the unity of consciousness, and its subjective character. The dissertation also aims at showing that the current empirical investigation of attention should be complemented with work at the level of generality that a philosophical analysis can provide; it shows how such an analysis is relevant for the scientific study of attention by providing a new conceptual framework and suggesting several new areas of research. In the traditional understanding, human dignity is often portrayed as a «final», «inherent», and «absolute» value. If human dignity as the core of the status of a human being did indeed have thos characteristics, this would yield a severe limitation for obligations that stem from the moral status of non-human animals, plants, eco systems and other entities discussed in environmental ethics; for obligations that arise from human dignity standardly take priority over the duties toward entities with non-human moral status. Yet, (...) many theorists of human dignity nowadays have given up the traditional picture in favour of a more «contingent» understanding of human dignity that abandons one or more of its traditional characteristics.In this paper, I argue that to the contrary, we have good reasons to think that the three characteristics of human dignity just mentioned can indeed be attributed to a value that deserves the name «human dignity». In a first part, I argue for a specific understanding of the three value characteristics under consideration. After these preliminaries, I show in a second part that given such an understanding, we have ample evidence that we can indeed say that human dignity is an inherent, absolute and final value; and also that these three characteristics are properties of a single value. Food standards, which are used to signal adherence to sustainability goals or a specific origin, have deep political implications. Standards crafted by retailers, processors, or third-party actors such as non-governmental organizations (NGOs) often disempower farmers. Moreover, due to the liberalization and globalization of many food value chains, producer organizations (POs) lost some of their legal privileges and market protections. This paper analyzes how POs in the Global North sought to regain their control over food markets by establishing their own standards. (...) These strategies and their consequences are considered across three dimensions: the internal life of the PO, the relevant market institutions, and the relationship between the PO and the state. Our case studies (N = 5) performed in France and in Québec, a French-speaking province of Canada, span across a variety of food sectors. Drawing on qualitative material, we designed our explanatory framework through an abductive, iterative method. Although standards crafted by POs have, in some cases, reshaped market institutions to their advantage and have repositioned them in the governance of food markets, they come at a cost. They may create tensions within POs and clash with the agrarian values of solidarity, democracy, and autonomy. Overall, this article challenges the assumption that food standards are mainly governed by private actors and sheds light on the new alliances and new identities of POs. (shrink)

The sheer multitude of criteria of empirical significance has been taken as evidence that the pre-analytic notion being explicated is too vague to be useful. I show instead that a significant number of these criteria—by Ayer, Popper, Przełęcki, Suppes, and David Lewis, among others—not only form a coherent whole, but also connect directly to the theory of definition, the notion of empirical content as explicated by Ramsey sentences, and the theory of measurement; two criteria by Carnap and Sober are trivial, (...) but can be saved and connected to the other criteria by slight modifications. A corollary is that the ordinary language defense of Lewis, the conceptual arguments by Ayer and Popper, the theoretical considerations by Przełęcki, and the practical considerations by Suppes all apply to the same criterion or closely related criteria. Furthermore, the equivalence of some criteria allows for their individual justifications to be taken cumulatively and, together with the entailment relations between nonequivalent criteria, suggest criteria for general auxiliary assumptions, comparative criteria, and more liberal conceptions of observation. Logical anti‐exceptionalism is the view that logic is not special, it is continuous with science. This continuity is typically understood in terms of the use of the abductive method in logical theory choice, with logical knowledge resulting from our choice of the theory best accounting for the data. In this paper, we argue for two related claims: (i) that this understanding of the continuity between logic and science faces considerable challenges; and (ii) that such challenges may be avoided by elaborating (...) the continuity of logic with science in terms of the “logic‐as‐models” approach. More specifically, we defend that logical theories should be seen in the lights of the “models‐as‐epistemic‐tools” approach, an approach to the nature of models in empirical science more closely connected with current scientific practice. The result is a version of logical anti‐exceptionalism opening new perspectives for the philosophical understanding of logic. (shrink)

The thematic focus of this yearbook is concerned with the various relations of „art“ and „technology“. It seeks to interrogate and reflect their conceptual filiations, their complementarities and mutual stimulations, and contrasts and tensions. There has been a lot of interest over the last fifteen years or so in no-collapse interpretations of quantum mechanics. The Bohm interpretation of quantum mechanics has received several thorough accounts, perhaps most notably by Bohm himself.

Essences play a central role in Spinoza’s philosophy, not only in his metaphysics, but also in his philosophy of mind, his theory of affects, and his political philosophy. Despite their importance, however, it is surprisingly difficult to determine what exactly essences are for Spinoza. On a widespread reading, the essence of X is nothing but the concept of X. This paper argues against this identification of essences and concepts. Spinozistic concepts are maximally inclusive: the concept of X contains everything that (...) is needed to make X conceivable. The essence of X, in contrast, is more limited in scope and does not include everything that is needed to make X conceivable. Thus, Spinoza avoids the ‘overloading’ of essences and the problems that would ensue. The account developed in this paper has a surprising implication, namely that the essences of non-divine, singular things do not suffice to render these things fully conceivable on Spinoza’s view. Thus, Spinoza breaks with a tradition according to which the essence of a thing states ‘what the thing is.’ As a result, his conception of essence is much further removed from traditional Aristotelian accounts, and from other seventeenth-century accounts, than usually acknowledged. This book argues for adopting a new account of the circumstances of justice ("the habilitation framework") for philosophical theories of basic justice. It proposes a concept of basic health as a metric for such theories, and healthy agency as a target for them. It does not, however, propose a specific distributive rule or set of distributive principles. Nor does it propose a specific type of theory to pursue (e.g., utilitarian, contractarian, etc.). Our understanding of human visual perception generally rests on the assumption that conscious visual states represent the interaction of spatial structures in the environment and our nervous system. This assumption is questioned by circumstances where conscious visual states can be triggered by external stimulation which is not primarily spatially defined. Here, subjective colors and forms are evoked by flickering light while the precise nature of those experiences varies over flicker frequency and phase. What’s more, the occurrence of one subjective experience (...) appears to be associated with the occurrence of others. While these data indicate that conscious visual experience may be evoked directly by particular variations in the flow of spatially unstructured light over time, it must be assumed that the systems responsible are essentially temporal in character and capable of representing a variety of visual forms and colors, coded in different frequencies or at different phases of the same processing rhythm.
