Modern physics asks: how do the objects exist? This kind of question inevitably touches upon philosophy; to be precise, it involves metaphysics that traditionally deals with these problems. There are grounds to assume that a quantum object in a certain sense does not exist until it is registered. Thus, one of the conclusions says, “Photon is a photon if it is a registered photon”. This is a paraphrase of well-known Wheeler’s words about the essence of quantum phenomenon. These effects cannot (...) be understood if we come from the assumption that all existing (‘real’) and quantum objects in particular, is only being of the actual. To explain quantum mechanics phenomena we need to realize that there exists another modus of being. Quantum mechanics refers to some sort oftranscendence. Such conclusion is based not only on the analysis of the testing of Aspeckt’s experiments. The whole structure of quantum mechanics confirms it. The revision of the New European paradigm leads to the return of such conception of existence that brings us to the traditional metaphysical understanding of the being and implies its study on several levels of existence. The conclusion of this kind leads to a serious correction of the philosophical model of the world built by modern natural science. (shrink)

The article is devoted to the problem of time in modern science, where in recent years there have been major changes related to the latest discoveries in the field of the foundations of quantum theory. The author refers to works of K.-F. von Weizsacker (which works are not well-known in Russian-speaking field). Weizsacker deploys a large-scale program of building modern physics, while starting (not only as a physicist, but also a professional philosopher) with questions of philosophical interpretation of postulates of (...) modern physics, especially quantum mechanics. His key thesis is that time in physics is fundamentally distinct, which represents the whole physics as an integral scientific discipline. Weizsacker comes from physical and philosophical reflections, that give a special value to his work. Analyzing the conclusions of theoretical physics, namely the issues of substantiation of statistical mechanics, thermodynamics, and, above all, quantum mechanics, Weizsacker comes to the key idea of the structure of time in the substantiation of physical theory. The author in this conclusion disagrees with the opinion of most modern physicists that time has a subjective character, and the modus of the past, present and future reflects its essential character. The allocation of the time structure requires special logic. Such a logic is temporal and quantum. Starting from temporal logic, introducing the concept of possibility and probability, he comes to the substantiation of quantum mechanics. Being modal logic, it is based on the concept of possibility and probability. Key concept for Weizsacker is a binary alternative (Uralternative), closely related to the principle of superposition in quantum mechanics. By introducing the concept of certain alternatives, essentially actualized alternatives, Weizsacker shows how one can get the theory of relativity with its space-time structure. Further, he shows that based on its structure, you can get the theory of relativity. The space-time structure in this case is secondary, relational, as understood by Leibniz, Mach, and Einstein. The work is devoted to the analysis of the scientific and organizational activities of the German physicist Erich Schumann, who was one of the key curators of the German nuclear project on the part of the military. In historical publications, his activities in this post were assessed as extremely inefficient and unprofessional, which was attributed to one of the reasons for the failure of the German nuclear program. Recent publications made on the basis of new archival data allow us to (...) completely reconsider his role and the results of his activities within the framework of the German Nuclear Project. Assuming the crucial interest of Arabic material for the recovery of the textual tradition of some Greek texts of mechanics, the following article aims at presenting a partial survey of the Graeco-Arabic transmission in the field of mechanics. Based on new manuscript material dating from the ninth to the twelfth century, it investigates the textual and theoretical traditions of two writings ascribed to Aristotle and Euclid respectively and transmitted to Arabo-Islamic culture in fragmentary form. The reception and the impact of (...) the Peripatetic Mechanics are analyzed on the basis of texts edited by al-Khāzinī as well as by the comparative study of the proof of the law of the lever in three authors: Pseudo-Aristotle, Thābit ibn Qurra, and al-Isfizārī. The codicological analysis of the extant manuscripts of Maqāla fī ‘l-mīzān – a rather systematic treatise on the balance ascribed to Euclid – leads to the assumption that it is a Greek fragment edited in Arabic. This reconstruction of the Arabic tradition of Euclidean mechanics is further elaborated by an annotated synopsis of al-Isfizārī's systematic recension of the text. (shrink)

The primary objective of this anthology is to make intergenerational justice an issue for intercultural philosophy, and, conversely, to allow the latter to enrich the former. In times of large-scale environmental destabilization, fair- ness between generations is an urgent issue of justice across time, but it is also a global issue of justice across geographical and nation-state borders. This means that the future generations envisioned by the currently living also cross these borders. Thus, different philosophical cultures and traditions of thought (...) should converse to re ect on what is fair to future people. In the remainder of this introduction, we will detail these claims and give an overview of the volume’s chapters. (shrink)

Arthur O. Lovejoy famously referred to thirteen pragmatisms. If he were called on to enumerate postmodernisms, no doubt he would increase this number tenfold.1 Fortunately I need not follow his lead for the task at hand, namely, to discuss whether the pragmatic tradition can narrow the divide between modernism and postmodernism on the topic of cosmopolitanism. To do so I will focus on specific sets of ideas that have been associated with these terms. So, for example, modernists have been viewed (...) as defenders of some form of universality, ethical or conceptual, and of a responsible, self-actuating, authentic subject. ABSTRACT‘Reading Weber’s Sociology of Law’ is a review essay of Hubert Treiber’s Reading Max Weber’s Sociology of Law. It is an exploration and evaluation of Treiber’s splendid analysis of Weber’s legal philosophy. Treiber addresses the question of the dating of Weber’s manuscripts on the sociology of law and he clarifies Weber’s four stages in the development of the law and legal practices. This review essay concludes with a comparison between Treiber’s book and those by Werner Gephart and by Michel Coutu. (...) Adolf Reinach’s theory of social acts and Czesław Znamierowski theory of the environment can show a new perspective of analysis in the fields of computer science and digital communication. This paper will begin analysing the performance of social acts in two categories of digital environments: (i) fictional digital environment and (ii) real digital environment. The analysis will be supported by examples from the history of computer science. In both kinds of digital environments, organigrams play a significant role and depend on (...) the users’ digital power to perform a real or fictional social act. In literary studies, the conversation about how affect theory might help us to interpret literature is still emerging. The goal of the present discussion is to provide a critical overview of work by scholars who draw on the insights of recent theory to read literary texts written in English. If one thing that the failed coup by a small but some of the top hierarchy of Turkish armed forces on that fateful July 15, 2016 day made clear, it was: the ordinary civilians, unarmed as they were poured into the streets to defend the government whatever way they can. This massive public sympathy and support for Turkish resident Erdogan and his government would be hard, if not impossible to understand, without knowing the historical intellectual, academic, and moral combat between (...) the modernists and Islamist groups working within the country. Mustafa Kamal had turned Turkey, mostly by force, from Ottoman Empire into the secular mode using military power. Various Islamic revolutionary outfits struggled for the revival of Ottoman Empire. Among them Bedi-uz-Zaman Said Nursi managed to cast a strong influence. A little slow but steadfast effort influenced by Nursi movement. Islam-shy Western powers managed alternate power structure against sitting President Tayyep Erdogan. They, however, failed due to result oriented social work delivered by his regime as Mayor and Prime Minister. It is a lesson for other revolutionaries and Governments especially for Islamic revolutionaries that if politicians deliver no power can oust them like a bee from butter. (shrink)

Given that personal source of information is preferred by the customers over company-generated marketing communications, promoting advocacy behavior among customers is of much importance for every organization. Literature suggests that an organization's corporate social responsibility (CSR) activities significantly influence individual behavior. However, the advocacy behavior of customers (ADB), from a CSR perspective, did not receive due attention. To address this literature gap, the current study attempts to explore the relationship among CSR and ADB with the intervening role of brand admiration (...) (BA). To collect the data, customers of a large fast-food service organization in Pakistan were approached. The proposed relationships were tested through the structural equation modeling (SEM) technique. The statistical evidence verifies a positive link between CSR and ADB, while BA mediated this relationship. These findings will be supportive to the fast-food business to realize the critical role of CSR for a meaningful customer-company relationship in the face of competition. (shrink)

Temporal epistemic logics are known, from results of Halpern and Vardi, to have a wide range of complexities of the satisfiability problem: from PSPACE, through non-elementary, to highly undecidable. These complexities depend on the choice of some key parameters specifying, inter alia, possible interactions between time and knowledge, such as synchrony and agents' abilities for learning and recall. In this work we develop practically implementable tableau-based decision procedures for deciding satisfiability in single-agent synchronous temporal-epistemic logics with interactions between time and (...) knowledge. We discuss some complications that occur, even in the single-agent case, when interactions between time and knowledge are assumed and show how the method of incremental tableaux can be adapted to work in EXPSPACE, respectively 2EXPTIME, for these logics, thereby also matching the upper bounds obtained for them by Halpern and Vardi. Asian American women demonstrate higher rates of disordered eating than other women of color and comparable rates to European American women. Research suggests that leading sociocultural predictors, namely pressures for thinness and thin-ideal internalization, are predictive of disordered eating in Asian American women; however, no known studies have tested the intersection of sociocultural and culture-specific variables (e.g., ethnic identity, biculturalism, acculturative stress) to further elucidate disordered eating risk in this vulnerable, understudied group. Accordingly, this project used path analysis to simultaneously (...) examine the role of sociocultural and culture-specific effects on disordered eating in Asian American college women (N = 430). Self-report measures assessing disordered eating, sociocultural (pressures for thinness; thin-ideal internalization) and culture-specific (ethnic identity, biculturalism, acculturative stress) variables revealed that a number of sociocultural and culture-specific factors are predictive of disordered eating. Consistent with prior research, heightened perceived pressures for thinness and thin-ideal internalization were predictive of disordered eating, and thin-ideal internalization partially mediated the relationship between pressures for thinness and disordered eating. Acculturative stress predicted disordered eating and fully accounted for the inverse relationship between biculturalism and disordered eating. Overall, findings highlighted the salience of sociocultural predictors for disordered eating in Asian American women and identified biculturalism and acculturative stress as culture-specific contributors that may uniquely impact vulnerability to disordered eating in Asian American women. Thus, the combined consideration of sociocultural and culture-specific factors may be important in disordered eating research and in the development of individualized treatment plans for Asian American women. Resumen Este trabajo se centra en la relación que se establece en el discurso entre argumentación y cortesía. Mi propósito es demostrar que la estructura argumentativa puede funcionar como un recurso que sirve de regulador de la imagen del hablante así como, en otro plano, un recurso que refuerza la actividad cortés. La mayoría de los estudios llevados a cabo hasta el momento han reparado en la función persuasiva de la cortesía, con lo que, en cierta manera, el acto cortés (...) se ha contemplado como un recurso “al servicio” de la argumentación. En este estudio intento demostrar que la relación entre ambos aspectos no es monodireccional, y que en ocasiones y, más precisamente, en determinados tipos discursivos, es la estructura argumentativa la que sirve al objetivo de la cortesía, sin menoscabar en absoluto la importancia de la finalidad persuasiva presente, a mi juicio, de forma más o menos marcada, en cualquier realización discursiva. De esta forma, se puede hablar de una relación de bifuncionalidad entre argumentación y cortesía. Para probarlo se utilizan textos de carácter persuasivo publicitarios y políticos. (shrink)

In some recent papers, the authors and Peter Gärdenfors have defined and studied two different kinds of formal operation, conceived as possible representations of the intuitive process of contracting a theory to eliminate a proposition. These are partial meet contraction (including as limiting cases full meet contraction and maxichoice contraction) and safe contraction. It is known, via the representation theorem for the former, that every safe contraction operation over a theory is a partial meet contraction over that theory. The purpose (...) of the present paper is to study the relationship more finely, by seeking an explicit map between the component orderings involved in each of the two kinds of contraction. It is shown that at least in the finite case a suitable map exists, with the consequence that the relational, transitively relational, and antisymmetrically relational partial meet contraction functions form identifiable subclasses of the safe contraction functions, over any theory finite modulo logical equivalence. In the process of constructing the map, as the composition of four simple transformations, mediating notions of bottom and top contraction are introduced. The study of the infinite case remains open. The main purpose of this paper is to explore the role played by logic in the legal domain. In the traditional conception which underlies the movement of codification, judges are able to find in the legal system (the Master System) a unique answer for every legal problem. This entails its completeness, consistency and the possibility of deriving from it the contents of all judicial decisions. Although the ideal model of this conception is supported by important theoretical and political ideals, it (...) has significant shortcomings. The elements of normative systems (Master Systems) are “norms” and not mere “norm-formulations.” A “norm” is the meaning attributed to normative linguistic expressions. The set of all normative expressions, such as statutes, codes, etc. forms what is called the Master Book. One of the main problems for the ideal model is the identification of a normative system behind the Master Book. Interpretative arguments are the tools designed to solve these problems. Although the requirements of the model are not totally fulfilled in actual practice, it remains as an effective ideal rational goal behind legal activities linked to adjudication and most theoretical approaches to law. Transitaremos así de la interpretación de la filosofía leibniziana del sujeto como un «manierismo» que ofrece Deleuze a la caracterización graciana del héroe y el mundo, con miras a mostrar que en (...) ambos planteamientos hay una ontología de la potencia que desmiente el esencialismo a propósito del sujeto característico de la Modernidad de cuño cartesiano, en provecho de una evaluación interna o inmanente del sujeto conformada en tiempos de crisis y con una marcada inspiración estoica. In this response to the comments on my book, Rape and Resistance: Understanding the Complexities of Sexual Violation, I offer a futher elaboration of the crucial concept of sexual subjectivity put forward as a way to approach the normative evaluation of sexual practices. This concept makes possible a healthy pluralism without retreating to a facile libertarian view that would render consent sufficient to determine morally unproblematic sex. The concept of sexual subjectivity sanctions experimentation in our sexual lives and the question (...) arises as to whether this opens the door to anything. Yet the concept of experimentation also presupposes that some experiments fail and that all require assessment. I argue that assessment is best done in intra-group discussions where people share broad experiences and aims, but it is also possible to communicate concerns and ideas across groups. I then discuss my use of Foucault to elaborate the specific challenges that are encountered when one tries to speak about rape and sexual violations, and also the ways we can use his work to develop more effectively resistant speaking practices. We give several applications that include the analysis of countable Richter–Peleg multi-utility representations.

Ranking finite subsets of a given set X of elements is the formal object of analysis in this article. This problem has found a wide range of economic interpretations in the literature. The focus of the article is on the family of rankings that are additively representable. Existing characterizations are too complex and hard to grasp in decisional contexts. Furthermore, Fishburn (1996), Journal of Mathematical Psychology 40, 64–77 showed that the number of sufficient and necessary conditions that are needed to (...) characterize such a family has no upper bound as the cardinality of X increases. In turn, this article proposes a way to overcome these difficulties and allows for the characterization of a meaningful (sub)family of additively representable rankings of sets by means of a few simple axioms. Pattanaik and Xu’s (1990), Recherches Economiques de Louvain 56, 383–390) characterization of the cardinality-based rule will be derived from our main result, and other new rules that stem from our general proposal are discussed and characterized in even simpler terms. In particular, we analyze restricted-cardinality based rules, where the set of “focal” elements is not given ex-ante; but brought out by the axioms. (shrink)

According to the orthodox view, photographic artworks are abstract objects. This view, however, has recently been challenged by Christy Mag Uidhir. In his article ‘Photographic Art: An Ontology Fit to Print’, he argues in favour of a nominalist construal of photographic artworks. My goal is to show that Mag Uidhir’s argument is unpersuasive.

Abstract The last two decades have witnessed a vast expansion in research and writing on the sociology of the body and on issues of embodiment. Indeed, both sociology in general and the sociology of sport specifically have well heeded the long-standing and vociferous calls ‘to bring the body back in’ to social theory. It seems particularly curious therefore that the sociology of sport has to-date addressed this primarily at a certain abstract, theoretical level, with relatively few accounts to be found (...) that are truly grounded in the corporeal realities of the lived sporting body; a ‘carnal sociology’ of sport, to borrow Crossley’s (1995) expression. To portray and understand more fully this kind of embodied perspective, it is argued, demands engaging with the phenomenology of the body, and this article seeks to contribute to a small but growing literature providing this particular form of ‘embodied’ analysis of the body in sport. Here we identify some useful intellectual resources for developing a phenomenology of sporting experience, specifically its sensory elements, and also subsequently examine the potential for its evocative portrayal and effective analysis via different kinds of textual forms. In this article, I discuss the structural domination of whiteness as it intersects with the potential of individual critique and reflexivity. I reflect on my positioning as a white nurse researcher while researching international nurse migration. I draw on two large qualitative studies and one small focus group study to discuss my reactions as a white researcher to evidence of institutional racism in the British health services and my growing awareness of how racism is reproduced in the British nursing profession.

In this article I will discuss the dancer’s physical potential and the sensitive knowledge (‘la connaissance sensible’) that emerges from dance practice. For this, I take Lévi-Strauss’ (2010) theory of the ‘savage mind’ as a reference. This theory is important to understand how the discipline of dance does not need to be justified through modern science (Lévi-Strauss 2010). It is understood that dance operates from sensitive knowledge, while modern science is expressed through the intelligible. I will point out how the (...) dancer operates the sensitive, or dancing, thought, stressing that this type of knowledge is created through interest in how to use it and not through interest in how it serves, or what it means. I will then explain how, through sensitive knowledge, dancers propose new challenges during their aesthetic training in order to develop new body technologies, thereby increasing their expressive potential. For this, dancers need to develop body acuity. In other words, I will discuss the processes that dancers use to transform the perception of the self and of the world through danced gestures. In this process, the dancer is always looking for new challenges; he/she constantly deals with new risks in order to discover new knowledge. I will also discuss the problem that dance faces in traditional academia, which disregards sensitive knowledge and values scientific knowledge. (shrink)

O presente artigo empreende uma reflexão sobre a ressonância política e ética da teoria crítica da tecnologia de Andrew Feenberg, especialmente na prática tecnocientífica biomédica. Referida ressonância ganha destaque no papel exercido pela ativa cidadania técnica no âmbito biomédico. Partindo de uma crítica ao projeto tecnocrático de intervenção paternalista, demonstra-se que abordagem democrática pensada pelo construtivismo crítico da tecnologia de Feenberg orienta criticamente a tradução e a implementação tecnológica de projetos biomédicos socialmente engajados ou enviesados. Para cumprir o exposto serão (...) desenvolvidos dois momentos: No primeiro apresenta a abordagem democrática do construtivismo crítico, dando destaque a teoria da cidadania tecnológica organizada em forma de redes pelas agências e interesses participantes capazes de redefinir, em torno de seus interesses e necessidade sociais, morais e culturais o design técnico. No segundo momento, expõe o exercício da política técnica, fundamentada pelo interesse participante, no âmbito da prática e da tecnologia biomédica, com ênfase na atenção à saúde. Assinala, como destaque nesse ponto da discussão, o conceito de Medicina ciborgue pela qual a noção de sujeito é ressignificada ou desconstruída a partir da relação simbiótica e fluida entre tecnologia, corpo e sociocultural. Desse modo, afastando a concepção de cidadania moderna, situa-se contemporaneamente a indispensável inclusão do exercício da cidadania pelos pacientes na fundamentação dos empreendimentos biomédicos. Conclui-se que a teoria da cidadania tecnológica pensada por Feenberg possibilita uma reflexão ampla e prolífica sobre a implementação de uma política médica que pressupõe a participação ativa da comunidade e um engajamento sócio-ético-político dos profissionais da saúde. Three recent studies carried out in the Spanish regions of Madrid, Valencia, and Murcia have shown that medical residents at public hospitals are systematically required to work for more than 48 hours a week. This practice is institutionalised, and there are indicators suggesting that it also occurs in other public hospitals throughout Spain. The obligation to work excessive hours has been shown to have harmful consequences for workers’ physical and psychological health while jeopardizing residents’ and patients’ safety. I argue that (...) behaviours contrary to people’s health and safety imply bioethical and, in this case, institutional, malpractice. (shrink)

Depois de estabelecer as características do corpo político ou soberano e destacar a função excepcional do legislador no Livro segundo do Contrato social, e no livro seguinte analisada a incumbência do governo na ordem política, Rousseau, no livro quarto da obra referida, se mobiliza para demonstrar a importância fundamental de algumas instituições para a manutenção dos valores republicanos. Entre as diversas instituições apresentadas pelo filósofo genebrino que visam cumprir esses objetivos, o presente artigo se concentra no exame de três delas: (...) o tribunato, a ditadura e a censura - instituições claramente inspiradas nas instituições romanas no período da Roma republicana. Em vista disso, indagamos: em que consiste o tribunato, a ditadura e a censura no arcabouço teórico de Rousseau? Quais são suas características? Como elas podem contribuir para a conservação da República? Partindo dessas indagações, pretende-se investigar as definições das três instituições elencadas bem como suas particularidades e a maneira como elas operam e podem contribuir para a preservação da República em longo prazo. In the law of rape, consent has been and remains a gendered concept. Consent presumes female acquiescence to male sexual initiation. It presumes a man desires to penetrate a woman sexually. It presumes the woman willingly yields to the man's desires. It does not presume, and of course does not require, female sexual desire. Consent is what the law calls it when he advances and she does not put up a fight. I have argued elsewhere that the kind of thin (...) consent that the law focuses on is not enough ethically and it should not be enough legally to justify sexual penetration. I advocate sexual negotiation, where individuals discuss sexual desires and boundaries and agree to engage in penetration before it occurs, except under circumstances in which the partners have a reasonable basis to assess one another's nonverbal behavior. I argue that not only is verbal consultation about desire ordinarily ethically necessary before most acts of sexual penetration, it should be legally required. Consultation to ascertain sexual desires and boundaries assures that both parties desire penetration. (shrink)

Open‐ended tasks can be decomposed into the three levels of Newell's Cognitive Band: the Unit‐Task level, the Operation level, and the Deliberate‐Act level. We analyzed the video game Co‐op Space Fortress at these levels, reporting both the match of a cognitive model to subject behavior and the use of electroencephalogram (EEG) to track subject cognition. The Unit Task level in this game involves coordinating with a partner to kill a fortress. At this highest level of the Cognitive Band, there is (...) a good match between subject behavior and the model. The EEG signals were also strong enough to track when Unit Tasks succeeded or failed. The intermediate Operation level in this task involves legs of flight to achieve a kill. The EEG signals associated with these operations are much weaker than the signals associated with the Unit Tasks. Still, it was possible to reconstruct subject play with much better than chance success. There were significant differences in the leg behavior of subjects and models. Model behavior did not provide a good basis for interpreting a subject's behavior at this level. At the lowest Deliberate‐Act level, we observed overlapping key actions, which the model did not display. Such overlapping key actions also frustrated efforts to identify EEG signals of motor actions. We conclude that the Unit‐task level is the appropriate level both for understanding open‐ended tasks and for using EEG to track the performance of open‐ended tasks. (shrink)

El presente trabajo aborda la cuestión de la utopía en el pensamiento de Gilles Deleuze. Frente a diversos comentadores que lo consideran un autor utopista (Buchanan, Patton, Scherer, Zourabichvili), argumentamos que su filosofía es inconciliable con la utopía a causa de su opción por el devenir, la fabulación y la creación de lo posible. No obstante, sostenemos que la utopía pone de manifiesto una ambigüedad en la idea deleuzeana de inmanencia. Si bien ésta tiene por efecto rechazar los ideales y (...) las posiciones trascendentes, Deleuze conjuga la inmanencia y la utopía mediante una evaluación inmanente de las acciones guiadas por los ideales utópicos. In the history of Lithuania during the period between the two world wars, the criminal law sources were received from Russia (Criminal Statute of 1903) and adapted for the requirements of those States, where the conditions of life were notably different from those in Lithuania. The Criminal Statute of 1903 was the main criminal law source in Lithuania until 1940. Prior to the second occupation—the return of the Soviets—tens of thousands of Lithuanian citizens fled to the West, including a very (...) large segment of the intelligentsia, university lecturers, professors and many lawyers. The lawyers in emigration were very socially active and founded a paper of law research—“Teisininkų žinios.” The article deals with the works and research of the emigration lawyers B. Nemickas, V. Vaitkevičius, P. Raulinaitis,V. Rastenis, D. Krivickas and others, in which they deal with the problem of Soviet criminal law. The lawyers analyse the sources of Soviet criminal law, which was the criminal law source in occupied Lithuania. (shrink)

Résumé La tradition occidentale a toujours été foncièrement anthropocentrique. A travers l’esprit scientifique, l’homme moderne parvient à une sorte de colonisation du reste de la nature, dans laquelle seul son propre bénéfice fait sens. Cette conception est entrée dans une période de crise depuis la seconde moitié du xx e siècle, particulièrement dans le dernier tiers, et l’on assiste au bouleversement de quelques-uns des principes ontologiques constitutifs de l’homme occidental. La philosophie grecque, la tradition judéo-chrétienne, la Renaissance, voilà les trois (...) grands moments de cet anthropocentrisme ; le quatrième étant l’homme comme dominateur de la nature et du cosmos. Depuis la seconde moitié du xx e siècle, cette situation produit une contre-conscience, la conscience d’ hybris de l’anthropocentrisme occidental, la conscience d’avoir transgressé toute limite et toute frontière avec l’autodestruction par le biais de la bombe atomique. La double posture d’orgueil et de chute dans l’ hybris constitue le grand fond philosophique des débats éthiques, politiques, idéologiques qui accompagnent actuellement le domaine de la biologie et de la génétique dans ses évolutions. Cela étant, est-il possible à l’homme, en termes philosophiques, intellectuels et artistiques, de dépasser l’anthropocentrisme? Oui, par l’auto-contention, l’antique sofrosyne, qui réclamait la mesure face à l’ hybris. Mais l’homme occidental craint le dépassement de l’anthropocentrisme, l’idée que l’homme n’est rien lui faisant peur (le froid pancosmique). Une voie intermédiaire est souhaitable : il faudrait récupérer la conscience d’un certain animisme, récupérer l’âme du monde. (shrink)

Modernity and What Has Been Lost comes out of a conference held at the Jagiellonian University in Krakw̤, Poland, on June 4-5, 2009 that sought to identify Leo Strauss's intellectual background in re: the repudiation of a modern idea of homogenous, universal state (considered as an illegitimate synthesis of Jerusalem and Athens, i.e., the claims of Reason and Revelation). The world we live in, molded by science and historical relativism, may be described as hostile to human dignity or perfection, or (...) abhorrent to those who love the search for wisdom. Straussian teaching consisted in the steady effort to reopen "the quarrel between the Ancients and the Moderns," and refers to the esoteric way of writing practiced by the most profound thinkers of the past which has been apparently forgotten in the last three centuries. Strauss binds the concept of natural right with the question of maintenance of conditions for philosophizing, and it probably seems to him that such defense of philosophy is the highest task in our times. However, one must be well aware that philosophizing always means a perilous way of life. Indeed, it may be destructive of the city (polis) itself as far as the city exists due to some crucial beliefs the philosopher might put in doubt. Reflecting on those issues, Strauss engaged in several highly important debates with his contemporaries, in an open way with, e.g., Carl Schmitt, Karl Lw̲ith and Alexandre Kojv̈e, and more tacitly with Martin Heidegger"--Provided by publisher. The core aims of the Global Health Impact Project include incentivizing pharmaceutical companies for socially conscious production and promoting socially conscious consumption among consumers. Its backbone is a metric that computes the amount of illness burden alleviated by a pharmaceutical drug. This essay aims to assess the connection between values and numbers in the Global Health Impact Project. Specifically, I concentrate on two issues, the anonymity of illness burden and the distribution of health benefits. The former issue asks whether we (...) should treat the illness burden of every person the same. The latter issue asks among whom health benefits should be fairly distributed. Examination of these issues begs for clarification of some of the key concepts of the Global Health Impact Project, such as the definition of essential medicines and the significance of national borders. Although this essay focuses on the two particular metric issues in the Global Health Impact Project, its core argument is applicable to other metrics for ethically motivated initiatives—to construct a metric for an ethically motivated initiative, it is not only important to articulate underlying concepts and values, but it is also important to operationalize them, so they are consistently reflected in the metric. William Tyndale, the Bible translator and Reformation martyr, enjoyed a sudden revival of interest in the mid-nineteenth century. This article examines one important aspect of his Victorian rehabilitation – his memorialization in stone and bronze. It analyses the campaigns to,erect two monuments in his honour – a tower on Nibley Knoll in Gloucestershire, inaugurated in 1866; and a statue in central London, on the Thames Embankment, unveiled in 1884. Both enjoyed wide support across the political and ecclesiastical spectrum of Protestantism, (...) and anti-Catholicism was especially prominent in the first initiative. Both monuments emphasized the blessings of the Bible in English, the importance of religious liberty, and the prosperity of England and the Empire as a result of its Reformation heritage. The article argues that controversy concerning Tractarianism and biblical criticism was brushed under the carpet, and Tyndales distinctive evangelical theology was deliberately downplayed, in order to present the martyr as a unifying figure attractive to a broad Protestant coalition. This essay is an exposition of a profound sustainable linkage for the survival of the earth—the linkage between sustainability from within and sustainability from without. The author, writing from direct experience of both, makes an eloquent plea to seize and work upon the complementarity between the Swedish 'The Natural Step' (TNS) movement regarding the 'outer', and the Indian 'Management by Human Values' (MHV) movement about the 'inner'. Building on the best and most well-tested spiritual and scientific traditions and principles—MHV from (...) the East and TNS from the West—the author feels convinced, could and ought to work in close cooperation for the future well-being of organizations and society. Traditional literature considers complex biometric sources such as words, letters and signatures for writer verification/identification. In this work the use of small segments of the handwritten stroke for writer verification is proposed. A grapheme is defined as the concatenation of smaller segments or fragments. Two models of grapheme are developed based on the idea that the segments are parts of a circle with or without direction. The average of Gray Level of the Perpendicular Line to the Skeleton and Local Binary (...) Pattern are adopted as descriptors. A database of 3,000 images of 50 writers, with 6 types of segments and with 10 samples per segment has been developed. A binary output support vector machine was applied as classifier. Thus, 50 classifiers were trained using 100 balanced data sets generated using subsampling of the majority class. Experiments are carried out with the proposed models, with an identity verification hit rate of 97 % on average. The positive results of experiments show that it is possible to achieve high precision in writer verification using segment of graphemes. (shrink)

Western democracies experience profound conflicts that induce concerns about polarization and social cohesion. Yet although conflicts are a core feature of democracies, the forms, functions, and dynamics of democratic conflicts have rarely been subject of political theory. This paper aims at furthering our understanding of democratic conflicts. It analyzes the theory of conflict in Mouffe's agonistic pluralism, confronts it with sociological conflict theory, and presents concrete points of departure for a more comprehensive theory of democratic conflicts. The paper, thus, contributes (...) to two lines of research: (1) Regarding agonistic theories, the paper shows that agonistic pluralism fails to provide a convincing theory of conflict since it underestimates the mechanisms and effects of conflict dynamics (e.g. intergroup cohesion, intragroup conflict, domination, and escalation) and fails to account for the variety of conflict interactions. Proponents of agonistic pluralism should therefore invest more into clarifying their core concept. (2) For a general account of democratic conflicts, the paper proposes to pursue interdisciplinary research on the cognitive concepts shaping conflict interactions, the linked practices of conflict regulation, and the processual dynamics of conflicts. The tendencies of the development of the Lithuanian criminal procedure within the recent twenty years, after Lithuania has regained its independence, are analyzed in the present article. The main factors which influence lawmaking in the sphere of criminal procedure as well as in the application of the criminal procedure norms are discussed. The constitutional imperatives and the human rights, fixed in international and the European Union agreements as the main factors determining the evolution of the law of criminal procedure are (...) reviewed. It is stated that earlier, while amending or supplementing the Code of Criminal Procedure, the utmost attention used to the drawn to the legal tradition of the state, whereas the legal norms of the modern criminal procedure must be subordinated to the principles fixed in the Constitution. After having briefly reviewed the main tendencies of the development of criminal procedure, i.e. the constitutionalization and internationalizationeuropeization, the following conclusion is drawn: the mentioned tendencies have been producing a significant impact on the evolution of the Lithuanian criminal procedure after the restoration of independence and accession to the international treaties. However, the systemic and critical viewpoint towards the impact of the European Union law on the national law of criminal procedure is still missing. (shrink)
