Fairness is one of the most prominent values in the Ethics and Artificial Intelligence (AI) debate and, specifically, in the discussion on algorithmic decision-making (ADM). However, while the need for fairness in ADM is widely acknowledged, the very concept of fairness has not been sufficiently explored so far. Our paper aims to fill this gap and claims that an ethically informed re-definition of fairness is needed to adequately investigate fairness in ADM. To achieve our goal, after an introductory section aimed (...) at clarifying the aim and structure of the paper, in section “Fairness in algorithmic decision-making” we provide an overview of the state of the art of the discussion on fairness in ADM and show its shortcomings; in section “Fairness as an ethical value”, we pursue an ethical inquiry into the concept of fairness, drawing insights from accounts of fairness developed in moral philosophy, and define fairness as an ethical value. In particular, we argue that fairness is articulated in a distributive and socio-relational dimension; it comprises three main components: fair equality of opportunity, equal right to justification, and fair equality of relationship; these components are grounded in the need to respect persons both as persons and as particular individuals. In section “Fairness in algorithmic decision-making revised”, we analyze the implications of our redefinition of fairness as an ethical value on the discussion of fairness in ADM and show that each component of fairness has profound effects on the criteria that ADM ought to meet. This is the first of two papers in which we propose an evolutionary route for the transition from sensory processing to unlimited experiencing, or basic consciousness. We argue that although an evolutionary analysis does not provide a formal definition and set of sufficient conditions for consciousness, it can identify crucial factors and suggest what evolutionary changes enabled the transition. We believe that the raw material from which feelings were molded by natural selection was a global sensory state that we call (...) overall sensation, which is a by-product of the incessant activity of the highly interconnected nervous systems that characterize all neural animals. We argue that global sensory states generated limited experiencing once they became coupled to the simplest kinds of nervous-system-mediated learning, a coupling that occurred in the most ancient taxa of neural animals, which were similar to present-day cnidarians and ctenophores. In such animals, limited experiencing involves a small number of persistent global sensory states. These sensory states, however, do not have a function and do not act as motivational states. As we argue in the next paper, with the evolution of associative learning they evolved into systems that gave animals basic consciousness. (shrink)

Religious ethics was founded on a commitment to inclusion, welcoming projects from and about different religious and philosophical traditions. This paper argues that the increasing welcome of feminist ethics in the JRE also reveals a tension in the field between inclusion and critique: where feminist ethics is included as another tradition of ethical inquiry, its critical claims can be escaped by appeal to difference from the traditions it seeks to engage. The response to feminist critique should not be to applaud (...) its inclusion without responding to its claims. Where this occurs, religious ethicists must renegotiate the terms of inclusion and the borders of difference. Feminist critique thus requires a return to founding questions of this journal, and the field, about the terms on which different traditions can be discussed and engaged in a common, critical conversation of religious ethics. The Birth of the Philologist from the Spirit of Schopenhauer’s Philosophy. Nietzsche’s Inaugural Lecture On the Personality of Homer. This essay highlights Schopenhauer’s decisive and unexplored role in Nietzsche’s Über die Persönlichkeit Homers. Following Schopenhauer’s negative assessment of the study of history, Nietzsche criticizes F. A. Wolf’s organic systematization of the sciences of antiquity and foregrounds the aesthetic dimension of philology. Contrary to Wolf, Nietzsche believes that historical investigation is subordinate to the essential pedagogical function of philology; and only through (...) its aesthetic component can philology establish which literary works of antiquity are to be considered truly “classical.” The debate on the Homeric question after the publication of Wolf’s Prolegomena ad Homerum illustrates that philologists have paradoxically become opponents and “destroyers” of the ideal of antiquity. Nietzsche shows how a methodological approach inspired by Schopenhauer’s philosophy can revive the relationship between philology and art. Nietzsche’s arguments to counter Wolf’s thesis about the problem of Homer’s personality implicitly rest on Schopenhauer’s aesthetics. In particular, through Schopenhauer’s conception of genius, Nietzsche rehabilitates the individuality of the poetic author of the Iliad and Odyssey, even though this poet does not correspond to the one referred to as “Homer” in antiquity. A new theory about the origins of consciousness that finds learning to be the driving force in the evolutionary transition to basic consciousness. What marked the evolutionary transition from organisms that lacked consciousness to those with consciousness—to minimal subjective experiencing, or, as Aristotle described it, “the sensitive soul”? In this book, Simona Ginsburg and Eva Jablonka propose a new theory about the origin of consciousness that finds learning to be the driving force in the transition to basic consciousness. Using (...) a methodology similar to that used by scientists when they identified the transition from non-life to life, Ginsburg and Jablonka suggest a set of criteria, identify a marker for the transition to minimal consciousness, and explore the far-reaching biological, psychological, and philosophical implications. After presenting the historical, neurobiological, and philosophical foundations of their analysis, Ginsburg and Jablonka propose that the evolutionary marker of basic or minimal consciousness is a complex form of associative learning, which they term unlimited associative learning (UAL). UAL enables an organism to ascribe motivational value to a novel, compound, non-reflex-inducing stimulus or action, and use it as the basis for future learning. Associative learning, Ginsburg and Jablonka argue, drove the Cambrian explosion and its massive diversification of organisms. Finally, Ginsburg and Jablonka propose symbolic language as a similar type of marker for the evolutionary transition to human rationality—to Aristotle's “rational soul.”. (shrink)

The main idea of this paper is that memories are the key elements of our identity and in order to access these elements it is sometimes necessary to use different techniques. Music is one of them and the education of the mind represents a safe direction to define and our cultural identity regardless the various social pressures.

Julia Kristeva’s work on the concept of revolt is marked by a temporal analysis that takes revolt to be a movement of return into the past that makes possible change, rebirth, and an open future. Such temporal revolt is, according to Kristeva, intimate, in that it touches on unconscious psychic structures and operates on the level of thought and creativity. But Kristeva simultaneously inherits Freud’s notion that the unconscious is timeless. How, I ask, can revolt be defined as a temporal (...) movement of return while at the same time being rooted in timelessness? I examine both Freud’s and Kristeva’s discussions of the timelessness of the unconscious and suggest that it needs to be understood not as non-temporal or outside of time, but rather as a temporal structure that challenges traditional philosophical conceptions of time. As such, the timelessness of the unconscious is far from being yet another instantiation of metaphysical presence. Rather, I see it as offering a challenge to both metaphysical presence and linear time, and indeed as making possible the retrospective movement of return that revolt for Kristeva must be. (shrink)

We discuss the evolutionary transition from animals with limited experiencing to animals with unlimited experiencing and basic consciousness. This transition was, we suggest, intimately linked with the evolution of associative learning and with flexible reward systems based on, and modifiable by, learning. During associative learning, new pathways relating stimuli and effects are formed within a highly integrated and continuously active nervous system. We argue that the memory traces left by such new stimulus-effect relations form dynamic, flexible, and varied global sensory (...) states, which we call categorizing sensory states . These CSSs acquired a function: they came to act as internal “evaluators” and led to positive and negative reinforcement of new behavior. They are therefore the simplest, distinct, first-person motivational states that an animal can have. They constitute what we call basic consciousness, and are the hallmark of animals that can experience. Since associative learning has been found in many invertebrate taxa that first appeared during the Cambrian era, we propose that the processes underlying basic consciousness are phylogenetically ancient, and that their emergence may have fueled the Cambrian explosion. In the last decade, we have witnessed the return of one of the most controversial terms in the political lexicon: totalitarianism. What are we talking about when we define a totalitarian political and social situation? When did we start using the word as both adjective and noun? And, what totalitarian ghosts haunt the present? Philosopher Simona Forti seeks to answer these questions by reconstructing not only the genealogy of the concept, but also by clarifying its motives, misunderstandings, and the (...) controversies that have animated its current resurgence. Taking into account political theories and historical discussions, Totalitarianism especially focuses on philosophical reflections, from the question of totalitarian biopolitics to the alleged totalitarian drifts of neoliberalism. The work invites the relentless formulation of a radical question about democratic age: the possibilities it has opened up, the voids it leaves behind, the mechanisms it activates, and the "voluntary servitude" it produces. Forti argues that totalitarianism cannot be considered an external threat to democracy, but rather, one of the possible answers to those questions posed by modernity which democracies have not been able to solve. Her investigation of the uses and abuses of totalitarianism as one of the fundamental categories of 20th and 21st centuries promises to provoke much-needed discussion and debate among those in philosophy, politics, ethics, and beyond. A new trend in the production technology of solid biof uels has appeared. There is a wide consensus that most solid biofuels will be produced according to the new production methods within a few years. Numerous samples were manufactured from agro-residues according to conventional methods as well as new methods. Robust analyses that reviewed the hygienic, environmental, financial and ethical aspects were performed. The hygienic and environmental aspect was assessed by robust chemical and technical analyses. The financial aspect was assessed (...) by energy cost breakdown. The ethical point of view was built on the above stated findings, the survey questionnaire and critical discussion with the literature. It is concluded that the new production methods are significantly favourable from both the hygienic and environmental points of view. Financial indicators do not allow the expressing of any preference. Regarding the ethical aspect, it is concluded that the new methods are beneficial in terms of environmental responsibility. However, it showed that most of the customers that took part in the survey are price oriented and therefore they tend to prefer the cheaper—conventional alternative. In the long term it can be assumed that expansion of the new technology and competition among manufacturers will reduce the costs. (shrink)

Simona Giordano investigates the moral concerns raised by current clinical options available for transgender and gender diverse children and adolescents. From the time young children express gender incongruent preferences and attitudes, up to the time in which older adolescents might apply for medical or surgical treatment, moral questions are likely to be asked: should children be enabled to express themselves freely inside and outside the domestic environment? What are the implications of the choices that parents might make early on? (...) How should clinicians respond to distress around sexual anatomy? Is it ethical to suspend pubertal development? What level of evidence should we seek for medications to be used in paediatric care? What are the risks and benefits of various forms of hormonal treatment? Is it ethical to defer surgical interventions till adulthood? Giordano provides a detailed ethical analysis of these and many other questions that are likely to arise at various stages of a person's life and proposes a moral formula to answer these questions, as well as others, that are likely to arise in a fast-changing landscape. This article considers the claim that gender diverse minors and their families should not be able to consent to hormonal treatment for gender dysphoria. The claim refers particularly to hormonal treatment with so-called ‘blockers’, analogues that suspend temporarily pubertal development. We discuss particularly four reasons why consent may be deemed invalid in these cases: the decision is too complex; the decision-makers are too emotionally involved; the decision-makers are on a ‘conveyor belt’; the possibility of detransitioning. We examine each of these (...) reasons and we show that none of these stand up to scrutiny, and that some are based on a misunderstanding of the nature and purposes of this stage of treatment and of the circumstances in which it is usually prescribed. Moreover, accepting these claims at face value could have serious negative implications, not just for gender diverse youth, but for many other minors and families and in a much broader range of healthcare settings. Magazines, leaflets, weblogs, and a variety of other media incessantly spread messages advising us on how to achieve or maintain our health or well-being. In such messages, the iconic representation of the face is predominant, and reveals an interesting phenomenon: the “face of health” seems to be unattainable as such, and is generally represented in a differential way, that is to say, by making reference to its opposite – the “face of illness”, or at least of malaise. In fact, the (...) face is crucial in the medical domain: since ancient times, face observation has played an essential role in diagnostic practices, both in Western medicine (which resorts to the concept of facies, intended as the distinctive facial expression or appearance associated with a specific medical condition, for the description of pathological states) and Eastern preventive and healing techniques (within which the so-called Mian Xiang, or ‘face reading’, is fundamental, and connects the medical sphere with other aspects such as personality, talents, and dispositions). Drawing on the semiotic analysis of relevant case studies extending from classical iconography to present-day digital mediascapes, this paper investigates the representation of the face of health (and illness) across time and space, specifically focusing on the analogies and differences between the Western and the Eastern semiosphere. To this purpose, it relies on both literature concerning the representation and understanding of the face and studies on medical sign systems and discourses. (shrink)

This essay offers a critical analysis of Hannah Arendt's notion of natality through the lens of Adriana Cavarero's feminist philosophy of birth. First, I argue that the strength of Arendtian natality is its rootedness in an ontology of uniqueness, and a commitment to human plurality and relationality. Next, I trace with Cavarero three critical concerns regarding Arendtian natality, namely that it is curiously abstract; problematically disembodied and sexually neutral; and dependent on a model of vulnerability that assumes equality rather than (...) asymmetry. This last issue is further developed in the final section of the essay, where I examine the idea that birth, for Cavarero, becomes the very concept by which we can distinguish and normatively differentiate acts of care and love from acts of wounding and violence. Upholding the normative distinction here depends on a conceptual distinction between vulnerability and helplessness. To maintain the ethical potential of the scene of birth, I argue that we have to insist on the very characteristics Cavarero attributes to it—ones, as this essay aims to show, that are ultimately missing in the Arendtian account thereof. The Exclusion Problem for mental causation suggests that there is a tension between the claim that the mental causes physical effects, and the claim that the mental does not overdetermine its physical effects. In response, Karen Bennett puts forward an extra necessary condition for overdetermination : if one candidate cause were to occur but the other were not to occur, the effect would still occur. She thus denies one of the assumptions of EP, the assumption that if an effect has (...) two sufficient causes, it is overdetermined. If sound, her argument does two things: it solves EP, and it shows how to use counterfactuals in order to make the notion of overdetermination precise. However, the argument is not sound. (shrink)

Birth—and, by extension, pregnant embodiment, motherhood, reproductive technologies, a woman’s right to choose, and other related topics—stood out to me as an issue that has concerned, and that continues to concern, feminist thinkers from across (...) the world. Since Simone de Beauvoir’s early analysis and critique of patriarchy as a system that reduces women to mothers and confines them to the realm of reproduction, feminists have been wrestling with the question of whether birth and motherhood pose a threat to or promote women’s liberation. Many of the topics so pertinent to feminist debates—from emancipatory issues such as abortion rights, the right to work, and women’s health, to more conceptual concerns such as embodiment, desire, sexual difference, and female subjectivity—force us to return to the question of birth, and to what it means that women can, and do, give birth.It was only after I had settled on a topic and invited the six authors included here to contribute that I found out that I was pregnant with my first child. More than any scholarly project I have embarked on before, this one has, as a consequence, been deeply personal. For each step of the editorial process, for each new batch of drafts, peer reviews, discussions with authors, and copyedits, I have witnessed my body change, the baby growing and moving inside me, her little feet exploring my inside, her face looking back at me from ultrasound screens, her presence causing numbness in my hands, swelling in my feet, uncomfortable nights, and, of course, unprecedented joy and anticipation. I have negotiated my maternity leave, taken birthing classes, read books about breastfeeding and parenting, fought with obstetricians and resisted their [End Page 1] tendency to medicalize my experience, gone through phases of intense nesting, and faced fears and strengths I did not know I harbored. I have, in short, experienced some version of what generations of pregnant and birthing women have experienced before me, and yet for me it has all been new and unknown, frightening and exhilarating all at once.Never before have I been so acutely aware of the important role experience holds in feminist scholarship. If (male) philosophers for millennia have been concerned with death, and if death is the one event those writing about it have yet to experience, birth is perhaps the only experience we all—constitutively—share, insofar as we have all been born. And without resorting to biological determinism or heterosexism, it is worth noting that women have a special relationship to birth. Insofar as we live in a society that expects us to do so, we either give birth, choose not to give birth, or struggle to be able to give birth. As several of the essays included here will testify, each of these paths has become increasingly marked by technological advancements. In the first instance, every woman who gives birth has to respond to a series of wanted or unwanted technological interventions—or the lack thereof. From ultrasounds and genetic screenings to the possibility of inducing labor, giving surgical birth, and accessing various pain medicines during labor—or, as in the case of many nations in the developing world, the sometimes dire consequences that are the result of limited access to such technological-medical tools—pregnant women across the globe are in different ways shaped by the technology that accompanies their journey of gestation. In the second instance, the access to contraception and the victories won in the fight for abortion rights constitute a revolution in the lives of women—perhaps the most important of all gains that make up our emancipation. And finally, in the third instance, reproductive technologies have revolutionized our capacity not only to reproduce, but to do so later in life, outside of a heterosexual framework, and across national borders. Often celebrated as a model of development in Africa, Botswana nonetheless endured a severe HIV epidemic. This article describes the singularity of the Botswana experience in facing AIDS and creating the widest possible access to antiretroviral medications for its citizens. Through exploration of different sets of actors and the construction of their ethics of treatment, it is possible to examine how free and universal access was created within the national antiretroviral program. This article underscores the importance of the site and (...) the local dynamics in the advent of an ethics of access to treatment for Botswana citizens. At the intersection of national citizenship, pharmaceutical philanthropy, and biomedical collaborations, Botswana is an exemplary case (one of the first and unique in its kind) of global health programs for access to drugs in which patients' rights are tied to science and pharmaceutical development. The adoption of corporate social responsibility (CSR) has implications for a company's relationships with its stakeholders. Specifically, by engaging in social dialogue, companies can promote direct relationships with employees, or indirect relationships with them, through elected staff representatives. This study investigates the relationships between companies' involvement in CSR and their engagement in social dialogue, both with employees and elected staff representatives. The results of two surveys, carried out among company representatives and elected staff representatives, indicate that employers do not implement (...) CSR to bypass elected staff representatives. Instead, CSR relates positively to direct relationships with employees and these relationships are not substitutes for dialogue with elected staff representatives, but instead, a factor that can weaken it. This book applies a justice framework to analysis of the actual and potential role of international law with respect to people on the move in the context of anthropogenic climate change. That people are affected by the impacts of climate change is no longer doubted, including with implications for people movement (migration, displacement, relocation, etc.). Climate Change and People on the Move tackles unique questions concerning international responsibility for people movement arising from the inequities inherent to climate change. Corrective and (...) distributive justice provide the analytical backbone, and are explored in a substantial theoretical chapter and then applied to subsequent contextual analysis. Corrective justice supports analysis as to whether people movement in the climate change context could be conceived or framed as harm, loss, or damage which is compensable under international law, either through fault-centred regimes or no-fault regimes (i.e. insurance). Distributive justice supports analysis as to whether such movement could be conceived or framed as a disproportionate burden, either for those faced with movement or those faced with sheltering people on the move, from which duties of re-distribution may stem. This book contributes to the growing scholarship and analysis concerning international law or governance and people movement in response to the impacts of climate change by investigating the bounds of the law where the phenomenon is viewed as one of (in)justice. In the context of the historical codes, a stance towards a body is seen as a projection of the social, cultural and power impulses. In the first case studied, the artist was (...) a male commissioned by the Serbian court to paint a series of paintings for the indigenous population and foreigners. In the second case, the artist was also male, a Serb working in Vienna, who painted for the audience of the `real Europe' from the position of an identity alteration. The third case focuses on a female artist, Babett Bachmayer Vukanovic, who was born in Germany but after marrying a Serb moved to her husband's homeland. Visual constructions of female bodies are used as the starting point for the deconstruction of ignored gender-related questions in analysing époque. (shrink)
