Many formerly incarcerated people have civil legal needs that can imperil their successful re-entry to society and, consequently, their health. We categorize these needs and assess their association with cardiovascular disease risk factors in a sample of recently released people. We find that having legal needs related to debt, public benefits, housing, or healthcare access is associated with psychosocial stress, but not uncontrolled high blood pressure or high cholesterol, in the first three months after release.

From the Federal Theater Projects of the Great Depression to the disruptive performances of the 1960s and 1970s, theater has played an important role in American radicalism. As we write, U.S. cities and states with extensive community transmission of Covid‐19 are in harm's way—not only because of the disease itself but also because of prior and current failures to act. During the 2009 influenza pandemic, public health agencies and hospitals developed but never adequately implemented preparedness plans. Focused on efficiency in a competitive market, health systems had few incentives to maintain stockpiles of essential medical equipment. Just‐in‐time economic models resulted in storage of only those supplies needed then. (...) At the same time, global purchasing in search of lower prices reduced the number of U.S. suppliers, with hospitals dependent on foreign companies. There is still a possibility that the pandemic will be manageably bad rather than unmanageably catastrophic in this country. Immediate, powerful, and sustained federal action could make the difference. (shrink)

Scholars and policymakers continue to struggle over the meaning of the word “vulnerable” in the context of research ethics. One major reason for the stymied discussions regarding vulnerable populations is that there is no clear distinction between accounts of research vulnerabilities that exist for certain populations and discussions of research vulnerabilities that require special regulations in the context of research ethics policies. I suggest an analytic process by which to ascertain whether particular vulnerable populations should be contenders for additional regulatory (...) protections. I apply this process to two vulnerable populations: the cognitively vulnerable and the economically vulnerable. I conclude that a subset of the cognitively vulnerable require extra protections while the economically vulnerable should be protected by implementing existing regulations more appropriately and rigorously. Unless or until the informed consent process is more adequately implemented and the distributive justice requirement of the Belmont Report is emphasized and operationalized, the economically disadvantaged will remain particularly vulnerable to the harm of exploitation in research. In this article, Professors Wolff and Koppelman offer a critical analysis of the free speech claims that were asserted by the law schools and law faculty that sought to challenge the Solomon Amendment. Solomon is a federal statute that requires law schools to grant full and equal access to military recruiters during the student interview season. The military discriminates against gay men and lesbians under its t Ask, Don policy, and the law professors claimed a right to exclude (...) the military under the First Amendment doctrine of arguing that the presence of discriminatory recruiters would interfere with the ability of faculty to express their own message of inclusion toward their gay students. Those claims were ultimately rejected by the Supreme Court in Rumsfeld v. FAIR. Wolff and Koppelman argue that the law professors' litigation efforts, though well intentioned, were deeply misguided, seeking to extend a recent and aberrational decision in the law of expressive association to unsustainable lengths and, in the process, offering a characterization of the manner in which faculty engage in their own expression that is inconsistent with the ideals that should govern institutions of higher learning. This article discusses women and peace-building in Solomon Islands and the effect of law, theory and practical circumstances on their role. It looks at the place of Solomon Islands women in society historically, with particular reference to war and peace. It then analyses their current status from a legal perspective, looking at the existing Constitution, the proposed Federal Constitution, and relevant aspects of international law. It questions whether gender equity provisions are sufficient to promote participation at a practical (...) level. The article also disputes the effectiveness of various international, regional, and local initiatives, designed to enhance the status of women. The article discusses the application of some of the theories relating to women and peace-building to the circumstances of Solomon Islands. It concludes by looking to the future and discussing means of consolidating women’s position, and increasing their involvement in leadership and decision-making. (shrink)

Companies disclosing negative aspects in sustainability reports often employ legitimation strategies to present mishaps in a favorable light. In incentivized experiments, we find that nonprofessional investors divest from companies with a negative sustainability-related incident, and that symbolic legitimation (which only evasively explains a negative incident) is not a strong enough signal to counter this divestment behavior. Even substantial legitimation (which reports on measures and behavioral change) mitigates the divestment decisions only if the company reports on concrete remediation actions in morally (...) charged situations, such as social or environmental incidents. We elaborate these results in light of signaling and screening theory, and suggest the conceptual extension of “costly signals” to what we call “valuable signals.” We argue that valuable signals need be not only costly for the sender from an economic perspective but also perceived as appropriate by the receiver from a noneconomic perspective. According to the most important theories of justice, personal dignity is closely related to independence, and the care that people with disabilities receive is seen as a way for them to achieve the greatest possible autonomy. However, human beings are naturally subject to periods of dependency, and people without disabilities are only “temporarily abled.” Instead of seeing assistance as a limitation, we consider it to be a resource at the basis of a vision of society that is able to account (...) for inevitable dependency relationships between “unequals” ensuring a fulfilling life both for the carer and the cared for.**. In early March 2020, the March‐April Hastings Center Report was very nearly assembled and contained nothing about Covid‐19, which was still just beginning to make itself publicly known in the United States. Two weeks later, the editorial line‐up was undergoing a remix, and essays that lay out sweeping agendas for the response to the worldwide crisis were in preparation. The central theme in the agenda that Lawrence O. Gostin and colleagues develop is that the pandemic requires a sharp break from (...) usual ethical norms yet simultaneously demands a return to core ethical commitments. A similar theme is sounded by Mildred Z. Solomon and colleagues in a commentary calling for federal actions to keep the health care system functioning. Other essays in the issue take up an assortment of topical issues—including international patient dumping—that were simmering along prior to the pandemic, and the two articles take up foundational questions about the nature of moral reasoning. This Introduction to the collection of essays surveys the philosophical literature to date with respect to five central questions: justice, care, agency, metaphilosophical issues regarding the language and representation of cognitive disability, and personhood. These themes are discussed in relation to three specific conditions: intellectual and developmental disabilities, Alzheimer's disease, and autism, though the issues raised are relevant to a broad range of cognitive disabilities. The Introduction offers a brief historical overview of the treatment cognitive disability has received from philosophers, (...) and explains the specific challenges that cognitive disability poses to philosophy. In briefly summarizing the essays in the collection, it highlights the distinctive contributions the collection makes to ethics, political philosophy, bioethics, and the philosophy of disability. Taking into account pragmatic considerations and recent linguistic and psychological studies, the author forges a new understanding of the relation between metaphoric and literal meaning. The argument is illustrated with analysis of metaphors from literature, philosophy, science, and everyday language.

In daily life, perceivers often need to predict and interpret the behavior of group agents, such as corporations and governments. Although research has investigated how perceivers reason about individual members of particular groups, less is known about how perceivers reason about group agents themselves. The present studies investigate how perceivers understand group agents by investigating the extent to which understanding the ‘mind’ of the group as a whole shares important properties and processes with understanding the minds of individuals. Experiment 1 (...) demonstrates that perceivers are sometimes willing to attribute a mental state to a group as a whole even when they are not willing to attribute that mental state to any of the individual members of the group, suggesting that perceivers can reason about the beliefs and desires of group agents over and above those of their individual members. Experiment 2 demonstrates that the degree of activation in brain regions associated with attributing mental states to individuals—i.e., brain regions associated with mentalizing or theory-of-mind, including the medial prefrontal cortex (MPFC), temporo-parietal junction (TPJ), and precuneus—does not distinguish individual from group targets, either when reading statements about those targets' mental states (directed) or when attributing mental states implicitly in order to predict their behavior (spontaneous). Together, these results help to illuminate the processes that support understanding group agents themselves. (shrink)

Contemporary industrialized societies have been confronted with the fact and consequences of women's increased participation in paid employment. Whether this increase has resulted from women's desire for equality or from changing economic circumstances, women and men have been faced with a crisis in the organization of work that concerns dependents, that is, those unable to care for themselves. This is labor that has been largely unpaid, often unrecognized, and yet is indispensable to human society.

Intersex—the fact of bodies neither typically male nor female, together with the grim history of its medical management—was a topic for feminist theory before there was such a thing as intersex activism. Indeed, critical academic scholarship about intersex supported the consciousness raising that made an intersex activist movement possible. Activist engagement, in turn, has expanded the understanding of the theorists whose work is responsive to that activism. Central to the thinking about intersex are the questions of identity and its limits (...) that are an important focus of the work of Gloria Anzaldúa, whose narrative suggests she had a condition associated with intersex. While her work largely predates intersex activism, it powerfully encapsulates the tensions displayed in contests over identity that have become central over the last 15 years, and furthermore offers insight into the challenges that lie ahead. This article challenges the common tendency in modern research to treat impurity as a religious phenomenon divorced from mundane concerns. Employing the cross-cultural psychological notion of “contagion,” this investigation examines the usage of terms for pollution and purity in Hittite and Akkadian as they relate to distinct domains of human experience, specifically uncleanness, infection, and transgression. Special attention is given to the use of these terms in reference to infectious disease. This analysis demonstrates the real-world experiential basis for notions of (...) impurity and also provides a new perspective to shed light on the peculiarities of each culture. In this essay, I recount and examine my response to a genetic diagnosis of my disabled daughter. My daughter was forty‐nine before the diagnosis came. All her disabilities were traceable to a de novo single gene variant on the PURA gene that was discovered only in 2014. I speak of the jolt and the recalibration that this discovery engendered, concluding that, while it seemed that everything had changed, nothing had changed. But my family did discover a community in which Sesha (...) joins other PURA‐perfect sons and daughters and where we as a family acquire a “horizontal identity” marked by a genetic variant. (shrink)

In the face of a perceived lack of widespread understanding of the theoretical issues underlying the development, dissemination and implementation of clinical guidelines, the Royal College of General Practitioners Guidelines Group developed a 2-day course aimed at teaching the theory in these areas. The course was targeted at potential opinion formers and ran on six occasions. Postal questionnaire assessment of the course revealed high levels of satisfaction with all aspects of the course and high levels of reported use of the (...) knowledge gained. Apology is arguably the central act of the reparative work required after wrongdoing. The analysis by Claudia Card of complicity in collectively perpetrated evils moves one to ask whether apology ought to be requested of persons culpably complicit in institutional evils. To better appreciate the benefits of and barriers to apologies offered by culpably complicit wrongdoers, this article examines doctors’ complicity in a practice that meets Card's definition of an evil, namely, the non-medically necessary, nonconsensual “normalizing” interventions performed on babies (...) born with intersex anatomies. It argues that in this instance the complicity of doctors is culpable on Card's terms, and that their culpable complicity grounds rightful demands for them to apologize. (shrink)

I review Elizabeth Barnes, The Minority Body very favorably. I argue as well that the substance of the work applies not only to minority bodies but also to “minority minds”. I also argue that the “dis” in disability should be understood as the precarious of maintaining a good life, not to the ability to have a good life. This may be due to both social and medical concerns.

As the mother of a daughter who has and will always require care to meet her most basic needs, I have seen firsthand how critical it is to have adequate means by which to meet those needs—for her sake, mine, and my family’s. Her flourishing life has contributed to enhancing not only our own, but those of all who care for her and who enter our lives. I have wanted to see us do better by all the families who struggle (...) and have to scratch and claw their way to access services and resources their children need. I have tried in my past writings to articulate the need and the reason why we as a society, as a community, are neither just nor caring as long as we leave their needs unmet. The cognitive gain in the use of metaphor and simile is nicely elucidated by Tversky's theory of similarity. The features of the theory which are of special importance are the directionality and context-dependency of similarity judgments. These indicate the extent to which such judgments are classificatory and that similarity is not only the cause of an object's classification but is also a derivative of groupings. Metaphor and simile exploit certain cognitive features involved in the relation between classification, context and similarity (...) judgments so as to make possible the creation of similarity, which, from a conceptual standpoint, is the prime motivation for metaphor. Children and adults from a remote Zafimaniry village in eastern Madagascar were probed for their intuitive understanding of the biological inheritance of bodily features. They were told a story about a baby adopted at birth, and were asked whether, when grown, he would be more likely to resemble his birth parents or his adoptive parents in bodily traits, beliefs, preferences, temperaments, and skills. In spite of the fact that the Zafimaniry, like other Southeast Asian and Malagasy peoples, profess explicit beliefs (...) concerning the fixation of individuals' properties that are at variance with Western folkbiology, Zafimaniry adults responded as do American adults on the task. Zafimaniry children, however, did not repond as did the adults, nor did they respond as did the majority of American children. Rather, they responded in the manner most consistent with what would be predicted, for children as well as for adults, from the ethnographic literature. That is, they tended to judge that an adopted boy would resemble his adoptive rather than his birth parents on virtually all traits, including bodily traits. A number of philosophers, linguists and psychologists have made the dual claim that metaphor is cognitively significant and that metaphorical utterances have a meaning not reducible to literal paraphrase. Such a position requires support from an account of metaphorical meaning that can render metaphors cognitively meaningful without the reduction to literal statement. It therefore requires a theory of meaning that can integrate metaphor within its sematics, yet specify why it is not reducible to literal paraphrase. I introduce the idea of (...) a "second-order meaning", of which metaphor is but one instance, that is a function on literal-conventional, i.e., first-order meaning, and outline a linguistic framework designed to provide a representation of linguistic meaning for both. This framework is designed to represent linguistic units ranging from a single word to an entire text since I argue that the by-now familiar position that the sentence is the appropriate unit for metaphor has mislead us into asking the wrong questions about metaphorical meaning. With this apparatus, we can specify the conditions under which an utterance may transcend the constraints on first-order meaning (transgressions not always apparent on the sentential level), without thereby being "meaningless". Conversely, we can specify the conditions that may render apparently odd utterances first-order meaningful rather than metaphorical. In this way we see how metaphorical language differs both from deviant language and from specialized language such as technical language, fanciful and fantastical language (in fairy tales, science fiction, etc.).
