In Germany, transfers of assets between generations are subject to inheritance and gift tax.1 However, there are different views on whether or not the present level of taxation is high enough. Our study looks at the potential for applying increases. We show that the constitutional framework does indeed allow for higher taxation in the case of intergenerational property transfers. We identify the essential points in current German inheritance and gift tax law, which make it possible to transfer large assets with (...) no or low inheritance tax burden. For these points as well as the determination of tax rates, we propose reform approaches and present options for the use of possible additional income. (shrink)

The article discusses the relation between the concepts of unfair trade, exploitation, and below-subsistence wages with regard to individual economic transactions. Starting from the common notion that exploitation involves some kind of unfair advantage taking, it asks how “unfair” is to be understood, and what it is that is taken advantage of in exploitative exchanges. On this basis it then explores a line of argument for grounding the claim that below-subsistence wages are exploitative, focusing on the condition of morally transformative (...) voluntary consent to transactions. By analyzing the structure of coercion with regard to threats, offers, and circumstances it comes to the conclusion that consent to an offer is morally non-transformative with regard to legitimizing the outcome of a transaction if the person giving the “consent” has only unacceptable options in absolute terms to choose from, since this reduces “consent” to a mere act of rationality devoid of any normative content. Accordingly, it argues that insofar as below-subsistence wages are unacceptable options in absolute terms, they are to be considered exploitative and an instance of unfair trade. (shrink)

Over evolutionary time, humans have developed a selective sensitivity to features in the human face that convey information on sex, age, emotions, and intentions. This ability might not only be applied to our conspecifics nowadays, but also to other living objects (i.e., animals) and even to artificial structures, such as cars. To investigate this possibility, we asked people to report the characteristics, emotions, personality traits, and attitudes they attribute to car fronts, and we used geometric morphometrics (GM) and multivariate statistical (...) methods to determine and visualize the corresponding shape information. Automotive features and proportions are found to covary with trait perception in a manner similar to that found with human faces. Emerging analogies are discussed. This study should have implications for both our understanding of our prehistoric psyche and its interrelation with the modern world. (shrink)

The aim of this paper is to show that, unlike proponents of Humean accounts of intentional action, Ockham can also answer the fundamental question of why we desire anything at all. For Ockham, desire cannot be the starting point of the explanation, since desire presupposes yet another kind of appetitive act that is objectual, or non-propositional, in its nature. Ockham calls this love (amor). It should become clear that Ockham's approach, even in his day, is not common. It is, however, (...) worthy of detailed examination because it furthers a deeper and more complete understanding of intentional action by shedding light on this more fundamental question. In his terminology, love is the most basic kind of unconditional willing, not least because it is purely objectual: we appreciate persons as ends, not as means. The explanation of intentional action has to start somewhere. And, for Ockham, it starts with love for persons. (shrink)

Despite a paucity of psychological research exploring the interface between lesbian and gay issues and human rights, a human rights framework has been widely adopted in debates to gain equality for lesbians and gay men. Given this prominence within political discourse of human rights as a framework for the promotion of positive social change for lesbians and gay men, the aim of this study was to explore the extent to which rights‐based arguments are employed when talking about lesbian and gay (...) issues in a social context. An analysis of six focus group discussions with students showed that when lesbian and gay issues are discussed, rights‐based reasoning is employed intermittently, and in relation to certain issues more so than others. The implications of these findings for moral education aimed at promoting positive social change for lesbians and gay men are discussed. (shrink)

Bloch himself left for West Germany following the construction of the Berlin Wall. After the end of World War II, he had returned from his New York exile by invitation in 1948 to accept the chair of philosophy at the University of Leipzig. This is a collection of sixteen essays by a diverse group of international scholars that offers a wide-ranging and contemporary perspective on the major aspects of Christian Wolff’s ethics. The volume focuses on Wolff’s German Ethics, arguably his most important and influential text on moral philosophy, but many of the chapters also consider the development of the basic tenets of Wolff’s moral theory in his later Latin writings. The contributions cover a range of topics, including the systematic structure of the (...) text itself and the relation between Wolff’s ethics and the preceding natural law tradition. Many chapters pay special attention to the core concepts of Wolff’s moral philosophy, such as obligation, perfection, the highest good, and happiness. Other notable topics include Wolff’s conception of moral judgment and moral education, as well as the role of psychology and anthropology in his ethical thought. Following up on earlier investigations, the present research aims at validating the construct impostor phenomenon by taking other personality correlates into account and to examine whether the impostor phenomenon is a construct in its own right. In addition, gender effects as well as associations with dispositional working styles and strain are examined. In an online study we surveyed a sample of N = 242 individuals occupying leadership positions in different sectors. Confirmatory factor analyses provide empirical evidence for the discriminant validity (...) of the impostor phenomenon. In accord with earlier studies we show that the impostor phenomenon is accompanied by higher levels of anxiety, dysphoric moods, emotional instability, a generally negative self-evaluation, and perfectionism. The study does not reveal any gender differences concerning the impostor phenomenon. With respect to working styles, persons with an impostor self-concept tend to show perfectionist as well as procrastinating behaviors. Moreover, they report being more stressed and strained by their work. In sum, the findings show that the impostor phenomenon constitutes a dysfunctional personality style. Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance. This volume aimed to highlight narrative identities of European cities or city neighbourhoods that have been overlooked, such as mid-sized cities. These cities are neither small towns nor metropolises, cities that are now unveiling their appeal or specificity. The present special issue thus covers a range of representations of cities. The articles investigate more systematically how different texts deal with various cities from different experiential and fictional perspectives. The issue covers the geographical scope across Europe, from east to west or (...) vice versa, as well as a range of different works of national literature(s), but with a clear emphasis on mid-sized European cities that have until now been deemed as lesser-known, secondary, peripheral, ‘other’ cities that are in the focus of the research of the COST project Writing Urban Places. What is astro-culture? In The Babylonian Planet it is unfolded as an aesthetic, an idea, a field of study, a position, and a practice. It helps to engineer the shift from a world view that is segregated to one that is integrated - from global to planetary; from distance to intimacy and where closeness and cosmic distance live side-by-side. In this tour de force, Sonja Neef takes her cue from Edouard Glissant's vision of multilingualism and reignites the myth of (...) the Tower of Babel to anticipate new forms of cultural encounter. For her, Babel is an organic construction site at which she fuses theoretical analysis and case studies of artists, writers and thinkers like William Kentridge, Orhan Pamuk and Immanuel Kant. Her skilful interrogations then allow her to paint a portrait of art and culture that abolishes the horizon as a barrier to vision and reclaims it as a place of contact and relation. By combining the Babylonian concept of the encounter and the planetary concept of the whole-earth, Neef creates a space - an astro-culture - in which she can examine topics as varied as language, translation, media, modernity, migration and the moon. In doing so, she instigates a renewed cultural understanding receptive to the kinder forms of cultural encounter and globalisation she hopes will come. (shrink)

We propose a new topological semantics for evidence, evidence-based justifications, belief, and knowledge. Resting on the assumption that an agent’s rational belief is based on the available evidence, we try to unveil the concrete relationship between an agent’s evidence, belief, and knowledge via a rich formal framework afforded by topologically interpreted modal logics. We prove soundness, completeness, decidability, and the finite model property for the associated logics, and apply this setting to analyze key epistemological issues such as “no false lemma” (...) Gettier examples, misleading defeaters, undefeated justification versus undefeated belief, as well as the defeasibility theories of knowledge. (shrink)

This article attempts to conceptualise the notion of the foreigner in relation to immigrant early childhood teachers. Sparked by Kristeva’s challenge, to live with and as others without ostracism or levelling, it highlights tensions that arise in a juxtaposition of the Aotearoa/new Zealand early childhood curriculum document, Te Whāriki and other guidelines for cross-cultural practices, with perspectives on the foreigner and foreignness. Situated in the neoliberal sociopolitical and cultural landscape of Aotearoa/new Zealand, the analysis foregrounds and re-frames orientations towards immigrant (...) teachers as they may play out in the early childhood realm. Kristeva’s insights into foreigners’ raw and intimate experiences provide a freeing lens to emphasise influences on and consequences of a foreigner’s otherness. While Kristeva’s challenge may be a never-ending story of a utopian future in education, its use in this analysis is intended to provoke an awareness of complex conceptualisations of foreignness and of tensions that could subvert the aim of working towards this, possibly elusive, ideal. _The Dutch Legacy_ investigates the political philosophy and philosophy of religion of Franciscus van den Enden, Lodewijk Meyer, the brothers De la Court, and Adriaan Koerbagh in order to assess their contributions to the development of radical movements in the Enlightenment.

The thesis addresses the question of human consciousness in its oscillation between conditioning and transcendence: the impact of cultural worldviews on the individual's lifeworld and their gradual transcendence as a form of spiritual practice. At the centre of attention is a group of individuals and their unfolding life-stories as they move through a journey of transformation, seeking to explore and understand the complexity of their own consciousness. The emphasis is on the embodiment of belief systems and the individuals' inherent existential (...) power to transcend cultural precepts. Methodologically, the study is based in phenomenological anthropology. It thus employs the first-person perspective and includes subjective personal experience as primary data. (shrink)

I present a historical solution to the so-called Arbitrariness Objection (AO). The AO has been leveled against contemporary libertarian conceptions of free will and says that freedom of the will, conceived as freedom of indifference, implies that choices can be made for no reason. If successful, the AO would undermine the rationality of libertarian views, which is why a rebuttal of it is of systematic interest. I discuss the attempt of Christian August Crusius (1715–75) in order to explain that Crusius (...) rejects the AO by showing that there is no choice without a reason. (shrink)

In this article, the focus will first be on the distinction Spinoza makes in his Tractatus theologico-politicus on the different strivings of human beings and the two different conceptions of law—natural and ad arte—in relation to freedom. Proceeding from these distinctions and Spinoza’s objective with his philosophical enquiries, I will then consider whether a change occurs between the earlier TTP and the later unfinished Tractatus politicus. Both texts are marked by a naturalist turn, the indifference of religion, moral neutrality, the (...) identification of right and power and the denial of natural hierarchy, but nonetheless one can also observe a change in the TP, where the naturalistic premise is more explicit, the human condition more on the forefront and the use of the concepts more precise; the ‘people’, for example, are replaced by the ‘multitude’. In search of sources and aspects for the naturalist turn and the specific conceptual evolution between the TTP and TP, we will consider the example of Machiavelli (and thereafter of Lucretius), De la Court’s notion of a free republic building on Machiavelli and the revolutionary ideas of Van den Enden aimed at improving on his predecessor. The different aspects linked to the use of the concept of multitude in the TP will then be analyzed in relation to the sources and aspects mentioned so as to return to the initial questions concerning law and freedom. Just as burnout is manifested through changes in behavioural and communication patterns, it is important to examine whether certain aspects of communication can affect student burnout development. Therefore, this study aims to investigate the relationship between communication and academic burnout. To achieve this, the study proposes an integrated model examining the effects of three communication dimensions – support from academic staff, support from colleagues, and participation in decision-making – on four different dimensions of academic burnout, as well as students’ overall (...) burnout. The model is tested using structural equation modelling (SEM) analysis. High coefficients of determination regarding particular burnout dimensions validate the strength of the proposed model. The results show that support from academic staff and support from fellow students significantly and negatively influence academic burnout, and might be instrumental in its reduction. Unexpectedly, participation in decision-making is shown to be positively related to academic burnout. (shrink)

This article investigates the contribution of Spinoza and authors of his circle (Antistius Constans, Van den Enden and Koerbagh) on the modern conception of tolerance. In his Tractatus theologico-politicus (1670), Spinoza launches the libertas philosophandi-question integrating two kinds of freedom between which there is a tension: freedom of thought and speech and freedom of religious conscience. As freedom means living and acting in society in light of one’s own interests, tolerance becomes a political issue that depends from political perspectives and (...) priorities. This insight leads Spinoza to bringing together the control of political authority on religious affairs and a political regime of religious plurality and toleration. These ideas seem to be reminiscent of texts published in his immediate circle: the anonymus De jure ecclesiasticorum (1665); the political pamphlets Kort verhael (1662) and Vrye Politijke Stellingen (1665) of his teacher Van den Enden; the subversive dictionary Een Bloemhof (1668) and the systematic philosophical Een Ligt (1668) of Koerbagh. In these texts the question of religion and religious authority shifts to the question of the nature and origin of political authority. The authors all criticize the abuse of power in light of the idea that there is no freedom without equality and no equality without freedom. Together with Spinoza’s Tractatus politicus (1677), they thereby form an anomaly within the anomaly of the Calvinist Low Countries that regards specifically this radical democratic view. They are not so much talking about tolerance but about everyone’s active participation in political life which is necessary for the rescue of the republic. (shrink)

This paper analyzes the biosocial origins of ritual by pointing to its significant social and evolutionary functions. Furthermore, it offers a detailed analysis of ethological studies on rituals in non-human species that are considered groundwork for an integrated analysis of rituals in people. Due to the fact that sociological and anthropological studies of rituals were aimed at studying social functions of rituals and rituals as a form of social interaction and neglected the existence of biogenetic models as the basis of (...) ritual behavior, the aim of this paper was to indicate that ritual is not only a product of cultural development but that it has played an adaptive role in the processes of biological and cultural evolution. In the history of philosophy, voluntarists—that is, philosophers committed to some version of the freedom of indifference—have worried about its metaphysical credentials, but only a few, at least to my knowledge, have attempted to argue for more than its mere existence. Freedom of indifference is the option to choose between opposites in a given situation. In this paper, I present the ambitious attempt of the German pre-Kantian philosopher Christian August Crusius (1715–1775) to argue for the claim that we have freedom (...) of indifference as a matter of hypothetical necessity. The point is that, in his view, there can be no actual world without freedom of indifference. This is not a logical but a metaphysical truth. I argue that a possible (motivational) reason for Crusius’s choice to tread this slippery path is that he attempts to bestow some metaphysical dignity on the freedom of indifference. As a consequence, this metaphysical value of freedom of indifference shapes the relation between the divine and free, rational agents in a way that is completely different from a rationalist’s conception such as Leibniz’s. In this paper, I give a plausible interpretation of a metaphysical argument that has been neglected in the relevant literature. (shrink)

International treaties, conventions and declarations have been developed in an attempt to establish a world in which people s basic rights and needs are provided for. An increasing number of states have ratified and incorporated them into their national legislations. But are such norms and values truly universal? And with states no longer being the only actors that shape global developments, what can be said about the role of social contracts between state and society for shaping the agenda of international (...) cooperation? And how do these social contracts develop in heterogeneous societies? If people themselves are the main drivers behind development, what does this imply for foreign aid?These and other questions are addressed in "Global Values in a Changing World," the 2010-2011 lecture series organized by the Netherlands Chapter of the Society for International Development.
