There are many different ways in which modern Corpus Linguistics can be used to enrich and broaden our understanding of legal discourse. Based on the central principle of co-occurrence and co-selection in language construction, this paper reviews current applications of Corpus Linguistics in the area of legal discourse focusing on issues ranging from phraseology, variation in legal discourse, legal translation, register and genre perspectives on legal discourse, legal discourse in forensic contexts to evaluative language in judicial settings. It revisits the (...) notion of ‘corpus’ and it highlights the relevance of various types of legal corpora and computer tools in legal linguistic research. (shrink)

Historically, Ehrenfest’s theorem is the first one which shows that classical physics can emerge from quantum physics as a kind of approximation. We recall the theorem in its original form, and we highlight its generalizations to the relativistic Dirac particle and to a particle with spin and izospin. We argue that apparent classicality of the macroscopic world can probably be explained within the framework of standard quantum mechanics.

The article reviews the book Korespondencja Adama Adamandego Kochańskiego SJ, edited by Bogdan Lisiak.

Assuming, according to Jaspers, that the measure of truth of a philosophical system is the lifestyle of its creator as well as his ability at drawing conclusions resulting from philosophical speculation to the requirements of practical action, the question must be asked, to what extent, if at all Wojciech Słomski's book tries to recognise and name the philosophically characteristic merging of theory and practise. Despite this, it shouldn't be the superior aim of any biography, let alone the biography of a (...) philosopher. However in the case of Professor Antoni Kępiński, the connection between theoretical views and real life holds meaning not only for judging the truth of these views but most of all for a correct understanding of them. After a brief look at Drafts on Polish philosophy of the twentieth century you could get the impression that this is a work dedicated to the most recent works of Polish philosophy. However after a moment of consideration, it seems hard to believe that a contemporary philosopher would write a history of twentieth century philosophy which could be considered neither as his history nor his philosophy. The distinction between history and philosophy in this case is not accidental since Wojciech Słomski (...) does not try to present a completely closed view of philosophical thought in the last century but aims at expressing that which he himself considers most valuable in contemporary Polish philosophy. It turns out that despite first impressions, we are not dealing with a systematic lecture, maintaining a cold and impartial approach to the subject but with a text written by an independent philosopher who cannot write differently about philosophy than Wojciech Słomski has done. For this reason too, the philosophy in Drafts is a living philosophy, made up of the most current propositions considered by W. Słomski as more important than the task of executing clear distinctions and pigeonholing of presented views into categories created by philosophers. (shrink)

The article reviews the book Adam Adamandy Kochański. Studium z dziejów filozofii i nauki w Polsce w XVII wieku, by Bogdan Lisiak.

When engaging in a philosophical analysis of body and corporeality in a political context, it is essential to ask to what extent, under what circumstances, and in accordance with what moral norms the state performs actions that have the bodies and lives of citizens as their object. This issue was already discussed in ancient philosophy, examples of which can be found in the writings of Plato and Aristotle, but also in ancient jurisprudence, especially in the law and the legal doctrine (...) of ancient Rome. Aware of such a previous history of studies on this topic, this analysis will discuss the three main ways in which state power over the life and health of citizens is manifested. Namely: (i) capital punishment (ii) policing and (iii) warfare. In addition, it will be indicated, based on Thomistic philosophy, what moral norms govern these state actions. The fundamental differences between the three main state powers — judicial, police, and military — will also be shown in the context of lethal actions undertaken on their basis. (shrink)

A progress report on studies around the Warsaw Uprising, an issue which mainly for political reasons was a taboo for the past four decades.The few studies that did come out in that time were either incomplete owing to the lack of reliable source material, or presented a false, distorted picture of the events upon insistence by the state authorities, who had no interest in revealing the truth about the insurgency.Even now, democracy permitting access to many once secret files and documents, (...) research into the events of 1944 is far from satisfying. In this knowledge, the author appeals for an indepth investigation of all reliable sources in a quest for the truth about the Warsaw Uprising. (shrink)

Heideggers Verstrickung in den Nationalsozialismus war schon immer Gegenstand großer Kontroversen, doch gab es seit den Forschungen von Hugo Ott von vor 20 Jahren keine neuen Materialien mehr, auf deren Basis Heideggers Wirken beurteilt werden konnte. Holger Zaborowski hat nun erstmals umfassend bisher unbekannte Dokumente gesichtet und kann ein ganz neues und nüchternes Bild des großen Philosophen im Nationalsozialismus zeichnen.

The German philosopher Robert Spaemann provides an important contribution to a number of contemporary debates in philosophy and theology, opening up possibilities for conversation between these disciplines. He engages in a dialogue with classical and contemporary positions and often formulates important and original insights which lie beyond common alternatives. In this study Holger Zaborowski provides an analysis of the most important features of Spaemann's philosophy and shows the unity of his thought. The question 'Who is a person?' is of (...) increasing significance: Are all human beings persons? Are there animals that can be considered persons? What does it mean to speak of personal identity and of the dignity of the person? Spaemann provides an answer to these questions: Every human being, he argues, is a person and, therefore, 'has' his nature in freedom. In order to understand the person, Spaemann explains, we have to think about the relation between nature and freedom and avoid the reductive accounts of this relation prevalent in important strands of modern thought. Spaemann develops a challenging critique of modernity, incorporating analysis of modern anti-modernisms and showing that these are also subject to a dialectical development, perpetuating the problematic shortcomings of many features of modern reasoning. If we do not want to abolish ourselves as persons, Spaemann reasons, we need to find a way of understanding ourselves that evades the dialectic of modernity. Thus, he reminds his readers of 'self-evident' knowledge: insights that we have once already known, but tend to forget. (shrink)

My aim is to propose affectivity as a criterion for personal identity. My proposal is to be taken in its weak version: affectivity as _only one_ of the criteria for personal identity. I start by arguing for affectivity being a better candidate as a criterion for personal identity than thinking. Next, I focus on synchronic vs. diachronic and on ontic vs. epistemic distinctions (my proposal will concern diachronic ontic personal identity) and consider the realm of affectivity in its temporal dimension. (...) In my argument, I rely on the genuineness of affectivity and I exploit chiefly long- or everlasting feelings (or emotions) and those which involve the feeling subject more rather than less. I conclude by stating that genuine long-lasting feelings (or emotions) are constitutive of diachronic ontic personal identity. (shrink)

In this paper I adopt Aquinas’ explanation of passivity and activity by means of acts remaining in the agent and acts passing over into external matter. I use it to propose a divide between immanent-type and transcendent-type acts. I then touch upon a grammatical distinction between three kinds of verbs. To argue for the activity and passivity of affectivity I refer to the group that includes acts of transcendent-type and whose verbs in both voices possess affective meaning. In the end (...) I focus on cases in which an act of affective f-ing is mirrored in its object as being affectively f-ed. (shrink)

Current research in affectivity is often dominated by perspectives on the feeling/thinking dichotomy. In the paper first I reconstruct Collingwood’s position on this point as it is presented in his Religion and Philosophy, The Principles of Art, and New Leviathan, and then compare it shortly with Bergson’s view. In total five of Collingwood’s different readings of the feeling/thought relation are brought to light. Finally, I opt for a view that takes feeling and thought to be complementary and inseparable, and I (...) try to explain why and how they are better treated in this way. (shrink)

In this article I first analyze the meaning of mixed feelings and what this expression refers to. I argue that what the term mixed feelings is commonly taken to mean are not mixed feelings because there is no mixture, and also because the same object and the same time condition of what is supposed to be mixed is not satisfied. I then pass on to a case of genuine mixed feelings. Genuinely mixed feelings are feelings composed of simple or basic (...) feelings as well as occurrences of compounds and sets of feelings. I then discuss three categories adjacent to mixed feelings: layered feelings, metaemotions, and moods. Layered feelings are not mixed but superposed one over another, metaemotions have a mixed phenomenology, and moods are an affective mixture par excellence. In conclusion, I suggest that wrong labelling coincides with a category mistake which hampers further progress in the philosophy of affectivity. (shrink)

The article examines some aspects of Scheler’s view on affectivity, especially his hierarchical approach which is useful in solving difficulties in analysis of affectivity and helps to avoid downwards as well as upwards reductionism in considering intricacy of emotions. After presenting how Scheler delineates the four levels of feelings, critical observations are made as to points which should be developed or refined so that Scheler’s model could more broadly contribute to current debate over emotions and advancement of the theory of (...) affectivity. This article looks at some main stages of contemporary thought about freedom and responsibility and outlines an account of important stages of 20th century philosophy as well. Whereas the early Sartre particularly coined the notion of infinite freedom, his later writings, Levinas and Derrida discovered the conception of infinite responsibility. The article draws attention to the questions which arise out of these understandings of both responsibility and freedom and asks whether these issues can be answered from a purely secular point (...) of view. The last part is devoted to the role of God in current philosophical considerations about responsibility and freedom. (shrink)

In approaching the future, i.e. in planning projects and decision-making, the role of both affective and non-affective factors is considerable. But given that affectivity is not a homogeneous realm and that it is difficult, if not impossible, to isolate the affective and non-affective elements of a description, anticipation can be hardly described as purely affective, and, on the other, it is necessary to consider what kind or level of the hierarchical realm of affectivity is involved in the anticipation move. It seems obvious that various feelings are memorized, forgotten, and recollected to various degrees. Some of them are forgotten. Some of those forgotten can be recollected, while others are lost forever. For example, short and long-lasting feelings and shallow and deep feelings are memorized and remembered in different ways. In this paper I analyse from a conceptual point of view several categories of memory-of-feelings and offer a comprehensive map of them. In the end, the richness of categories in the realm (...) of memory is interpreted as a proof of the intricacy of affectivity. (shrink)

The aim of this paper is to improve our understanding of the category of moral “luck”. In current debate most often only specific cases of moral “luck” are taken into account. Such restrictions, however, involving a fragmentary picture of moral "luck", are introduced without any rationale for them. In this paper I look for a formal comprehensiveness of the category of moral “luck”. I consider three factors each of which is developed in two scenarios. These are (i) whether the agent’s (...) action is nasty or nice, (ii) whether the agent’s intention is confirmed or contradicted by her action, and (iii) whether the agent’s action is preceded by her intention or the lack thereof. I explore eight scenarios which are a mark of the intricacy of the category of moral “luck” otherwise ignored in the literature. After an assessment of their structure I arrive at new distinctions. The upshot is a rather complex set of correlations between several cases of moral “luck” with a variety of kinds and shades. (shrink)

ᅟThe comment discusses M. Slote's view on empathy as presented in his paper “The Many Faces of Empathy”. It is asked whether three forms of empathy he portrays are three separable concepts or three variants of the same concept of empathy.

En el siguiente artículo se aborda la interpretación de Heidegger del tratado de la libertad de Schelling en las dos lecciones dedicadas a esta obra sostenidas en los años 1936 y 1941. En un primer momento me referiré al carácter autorreferencial de la aproximación heideggeriana a la obra de Schelling en 1936. En este curso Heidegger sitúa a Schelling más allá del idealismo alemán y encuentra en él los impulsos necesarios para un nuevo comienzo del pensar, en correspondencia con la (...) tarea programática del propio Heidegger en los años 30. A continuación me enfocaré en el giro radical de la interpretación heideggeriana con relación a Schelling en el curso de 1941, cuando al igual que a Hegel lo considera un exponente más de la metafísica absoluta del idealismo alemán.
