Referring to basic Weberian notions of rationalization and secularization, I try to find a more accurate sense of the term “secularization”, intending to describe adequately the position of religion in modernity. The result of this query is—or at least should be—a new, original conceptualization of religion as one of finite provinces of meaning within one paramount reality of the life-world, as defined by Alfred Schutz. I proceed by exposing a well known, major oversimplification of the Weberian concept of secularization, (...) very well outlined in Peter Berger’s The sacred canopy, in order to point to the genuine, much more differentiated position of Max Weber in this matter (especially from the period of Foundations of social economic and Economy and society), and, consequently, to return to the roots of Berger’s thought: phenomenological sociology of Alfred Schutz, an attempt to assure the philosophical foundations of Weber’s sociological theory. At a closer glimpse, transformation of religion in the modern process of rationalization does not consist—according to Weber—in eliminating religion and thus depriving society of the religious source of meaning, but in parallel emancipation of many different domains of rationality, including religion itself. Using Schutz’s analysis of the social world as a complex structure of many different final provinces of meaning, I describe religion as such a province and show what does the process of rationalization of this province consist and what it should consist in: a complex, ongoing exchange of cognitive relevances and contents, combined with growing autonomy of many different sub-worlds. Schutz’s theory of symbol, rooted in Edmund Husserl’s description of constitution of complex objects in mono- and polythetic acts of consciousness, moves the analysis to the epistemological level, pointing to a chance of intensifying our cognitive relation to reality through increasing interpenetration of various sub-universes of meaning. In the former socialist countries the relation of philosophy to social reality, as shaped by the political interests of the State, must be considered for each particular case with a view to the historical dynamics of its own development. The Polish case is not typical in this regard — it was determined by the failure of forced sovietization at the institutional, cultural level and the maintenance of Poland''s traditional contacts with Western European culture. In this regard Polish universities played an (...) important role since they preserved normal structures of academic activity.Philosophy in Poland has been marked by three currents which managed to rebuff the advances of Marxism. Best known among them is the Lwów-Warsaw school of logic and analytic philosophy. Its contribution is especially important in the methodology of philosophical inquiry and the style of responsible philosophical discourse. Though not a bed of political opposition the school''s members mounted a spiritual opposition to Marxism, especially during the Solidarity period. Catholic philosophy, as represented by the Catholic University of Lublin (KUL), has been and remains a completely independent force in Eastern and Central Europe. Doctrinally, Catholic philosophy in Poland has been divided between a more traditional, dated Thomism and the more progressive circles in Cracow where Western European philosophy, especially phenomenology, existentialism, and hermeneutics, has been influential (the significance of Józef Tischner and Karol Wojtyla, now Pope Jean Paul II). The third major current, centered in Cracow, is the phenomenology of Roman Ingarden, whose influence is manifest in a style of philosophizing that has attracted professional philosophers as well as committed intellectuals from different disciplines. Works by Henryk Sienkiewicz, a Polish writer and the winner of the 1905 Nobel Prize for Literature, were subjected to verification by the DDR’s censorship apparatus several times. Censors considered his novellas which discussed 19th-century social issues as desirable and worth promoting among East German readers. His novel Krzyżacy, which was set in the Middle Ages, was accepted eagerly both by publishing houses and the censorship office as it enabled national socialism in Germany to be viewed in critical terms, as (...) the DDR distanced itself from the system. Reviewers did, however, find a major ideological threat for young readers in East Germany in a young adult novel entitled W pustyni i w puszczy, and for that reason it was withdrawn from the publishing procedure. During the 15th century the Cracow University had become a major intellectual centre in central Europe. It was especially important in educating lawyers and administrators for the Polish-Lithuanian state as well as the higher clergy: as a result, special stress was put on legal and theological studies. The faculty of Liberal Arts (Philosophy), though less prized, also took part in the intellectual life of the Latin Europe, becoming home to representatives of most philosophical schools of the late Middle Ages. (...) Scotism was one of the last medieval schools to arrive in Cracow. It was introduces there by Michael Twaróg of Biestrzyków, who studied the doctrines of scotism in logic and metaphysics. His main source was not Duns Scotus, however, but his pupils and followers, notably Antonius Andreae, whose "Quaestiones super XII libros Metaphysicae" was a book widely read in Cracow since 1489. Antonius' solutions on the division of sciences, the subject-matter of metaphysics, the concept of being, etc. were accepted also by Nicholas of Michałowice, Martin Kulap of Tarnowiec, John of Głogów, and John of Stobnica. Some of them tried to combine some scotist ideas with philosophical views of other schools. In logic, the solutions associated with scotism started appearing in Cracow s little earlier – in 1470s – but their influence was weaker than in metaphysics. Again, they were mostly coming from the works of Scotus's followers of the 14th and early 15th century. The group of Cracow logicians influences by scotist opinions included John of Głogów, Michael of Wrocław, Nicholas of Giełczewo and Michael od Biestrzyków, who tried to combine the views of Scotus with those of Peter of Spain in his commentary on "Parva naturalia". Philosophy of nature was the discipline in which the influence of scotism was felt last and least. It is found mostly in the works of John of Stobnica – especially in his commentary on "Parvulus philosophiae naturalis" (1498) – and Simon of Leśniewo, John's pupil, who wrote glossa to the commentary. In four major parts, this study investigates the phenomenon of scrolling. Its first task is to argue in favor of a specific quality of the experience of scrolling, distinguishing it from other forms of distraction, notably from the flow experience. Scrolling takes the shape of aimless drifting. Secondly, it investigates the phenomenon of scrolling against its relevant historical, economic, social, and cultural backdrop, with the intention of understanding scrolling as a typical phenomenon of today, rather than subscribing to a (...) biased and superficial critique of its wastefulness or outright pathological character. The third part presents a comprehensive analysis of the temporal makeup of scrolling. Its temporality is expressed in the specific impatience of scrolling. Furthermore, scrolling amounts to a temporal reduction in the sense of favoring the present moment (and suppressing the temporal dimensions of the past and the future). The reductiveness of scrolling pertains to the semantic content as well. I argue that scrolling does not allow for certain experiences (such as, e.g., profound sadness). The temporality of scrolling is one of experiencing lived time as the permanence of passing. In the last section, I connect scrolling to boredom, and argue that scrolling accomplishes the task of allowing for an existential distractedness. In conclusion, I propose a nuanced evaluation of scrolling: in a Pascalian sense, scrolling responds to a profoundly human need of distraction. Yet I find scrolling dangerous in how easily available such distraction becomes, and in how it accustoms the users to a reductive existential experience. Scrolling, unlike art (but also, in principle, photography, movies, books), shields the user from challenging and enriching experiences. (shrink)

Akt, a protein kinase hyperactivated in many tumors, plays a major role in both cell survival and resistance to tumor therapy. A recent study,1 along with other evidences, shows interestingly, that Akt is not a single‐function kinase, but may facilitate rather than inhibit cell death under certain conditions. This hitherto undetected function of Akt is accomplished by its ability to increase reactive oxygen species and to suppress antioxidant enzymes. The ability of Akt to down‐regulate antioxidant defenses uncovers a novel (...) Achilles' heel, which could be exploited by oxidant therapies in order to selectively eradicate tumor cells that express high levels of Akt activity. (shrink)

Im Beitrag wird versucht, Fichtes und Hegels Konzepte der Intersubjektivität miteinander zu vergleichen, auch um die verbreitete Meinung über die Unvereinbarkeit beider zu prüfen. Die nähere Rekonstruktion beider Auffassungen will zeigen, daß Fichtes dialogisches Modell der auf gegenseitige »Aufforderung zur Freiheit« gründenden Interpersonalität dem Hegelschen Konzept des ursprünglichen »Kampfes um die Anerkennung« keinesfalls widerspricht. Es handelt sich hier vielmehr um zwei wohl verschiedene, aber komplementäre Darstellungs- und Begründungsweisen einer und derselben kommunikativen Reziprozität, die als unhintergehbare Voraussetzung für die menschliche Freiheit (...) in der modernen Welt doch von den beiden Philosophen angenommen wird. What are the ethical concerns among the growing populations of business people in Central & Eastern Europe, and how might they be dealt with practically in the course of business life? David Murray has been a management consultant since 1979 working primarily with the Hay Group in the area of strategic organisational change. Since founding Maine Consulting Services in 1991 he spends most of his time in the field of business and professional ethics, also holding a Visiting Fellowship at the (...) University of Central Lancashire. He is chairman of the Professional & Technical Board at the (British) Institute of Quality Assurance and a coordinating editor of the quarterly Organisations & People. Marek Kucia is a social researcher operating his own research agency (which organised the Polish part of this exercise) and an academic teaching sociology, and conducting and co‐ordinating Central European Studies at the Jagiellonian University, Krakow. He studied political science, sociology and philosophy at Krakow and studied for his PhD at Oxford. He has also worked for Gallup, London, in opinion and market research. In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban (...) development in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

Financial misconduct has come into the spotlight in recent years, causing market regulators to increase the reach and severity of interventions. We show that at times the economic benefits of illicit financial activity outweigh the costs of litigation. We illustrate our argument with data from the US Securities and Exchanges Commission and a case of investment misconduct. From the neoclassical economic paradigm, which follows utilitarian thinking, it is rational to engage in misconduct. Still, the majority of professionals refrain from misconduct, (...) foregoing economic rewards. We suggest financial activity could be reimagined taking into account intrinsic and prosocial motivations. A virtue ethics framework could also be applied, linking financial behavior to the quest for moral excellence and shared flourishing. By going beyond utilitarian thinking and considering alternative models, we offer a fuller account of financial behavior and a better perspective from which to design deterrence methods. (shrink)

Assuming the importance of Alfred Schutz’s “protosociology” in social theory as a given, the paper tries to explore its philosophical core, treating Schutz’s sociophenomenology as an answer to the most fundamental questions of phenomenology, such as evidence and phenomenological reduction. It analyses Schutz’s point of departure – the problematization of Max Weber’s concept of the meaning of social action and its deepening by means of Henri Bergson’s and Edmund Husserl’s notion of time – and tries to unravel the double structure (...) of consciousness, revealing increasingly its complex temporal character. Brentano’s and Husserl’s double intentionality, seeming to offer a kind of “decent realism” in modern philosophical context, in Schutz turns out to be marked by the profound pastness of reflexive consciousness, reaching the primary stream experience only by means of primary and secondary acts of remembrance, re-effectuated intersubjectively in acts of phantasying about future, thus constituting the very core of meaning, with its reference to external objects. It appears that only analysing this mode of phantasying in reference to its motives that we can solve the conundrum of realism in its modern shape. (shrink)

Truth seems to be an indispensable element of authority which presents itself as being based on more than just power and efficiency. In the domain of law,there is not only and primarily the problem of establishing the truth about the facts which are to be judged; there is also the problem of norms—does their authority rest solely on the act of establishing them, or is there “something behind”, a truth which contributes to the strength of law, and which provides legitimacy (...) to both legislator and to the legal norms themselves. In theoretical reflection, the very possibility of talking about true norms or true evaluations is under challenge, and this view dominates in the academic education of lawyers and other professionals. At the basis of this project lies the conviction that the problem of true norms, and the more general problem of the place of truth in law, is worth re-examining. In the course of such a re-examination, it is also worth returning to certain points in the tradition of thinking about the foudations of law. In the tradition recalled by the papers presented here—by both Italian and Polish authors—a prominent place is occupied by Polish thinkers such as Leon Petrażycki, Czesław Znamierowski, and Zygmunt Ziembiński. The book consists of three major parts. The titles—Tradition, Theory, Practice mark important points of reference in the reflection on truth in the context of law. The contributions relate to these points in different degrees, and each, though placed in one of these parts, also refer to the others. (shrink)

The European Union’s funding of electricity made of biogas that is obtained from purpose-grown plants accelerated the global boom of renewable energy two decades ago. Tens of thousands of biogas plants were built in EU farms soon after. As this specific trend toward renewable energy globally spreads, it has the potential to alter the features of agriculture in the future. Such conceptual changes are related to a variety of socio-economic and environmental implications that manifest itself over a large time scale. (...) Regarding renewables made of purpose-grown plants, a majority of reservations are related to its production economy, particularly since these biofuels are expected to compete with food or feed. So far, little attention has been paid to the fact that the fields of farms that run biogas stations are subject to shortly repeated erosive crops followed by the intensive application of the fermentation residues obtained. The various types of soil on different European farms, which have been operating biogas stations for at least two decades, were analyzed. It was revealed for the first time that such practices cause soil degradation and pose a threat to food production, which has been overlooked until now. The relations between ethical and economical points of view are discussed. (shrink)

In 1944, American Polonia consisted of two separate social groups. The first one was the so-called “old Polonia”. This group was significantly assimilated into America’s culture and way of life, and had strong self-help organizations. The second group, “new Polonia”, was formed of wartime émigrés, mainly with intellectual backgrounds. They experienced at first hand the anti-human policies of the Nazi and Soviet systems.In the Polish American Congress, founded in 1944 by representatives of both groups, there was great concern about the (...) policies of President Franklin D. Roosevelt. The fear was that these policies would allow Stalin, by a method of fait accompli, to introduce the Soviet system in all countries “liberated” by the Red Army. Old Polonia was under the influence of the US Administration and, despite reservations, supported the approach of Polish Prime Minister Stanisław Mikołajczyk who was committed to finding a Polish-Soviet compromise. Such a compromise turned out to be impossible because of Stalin’s demands. Firstly, nearly 50% of the pre-war territory of Poland was to be ceded to the Soviet Union. Secondly, fundamental changes were to be made in the government leadership of the Polish satellite state.New Polonia, which in 1942 formed the National Committee of Americans of Polish Descent, had a strong intellectual group. They warned the Polish American Congress and the US Administration against conceding to Stalin’s demands. From the perspective of the Sixtieth Anniversary of the Warsaw Uprising, their evaluation of Stalin’s policy has turned out to be correct.There was also a small group of Polish American activists centered around Professor Oskar Lange and the eminent poet Julian Tuwim, who belonged to the so-called Kościuszko League. During the Warsaw Uprising they were willing to accept Stalin’s demands and in connection with this supported the policies of the Polish Committee for National Liberation (a pro-communist coalition).The overwhelming majority of American Polonia was involved in unmasking false information about the Warsaw Uprising in the American press. They signed petitions to the President and Secretary of State. They collected money. They organized religious and patriotic meetings at which true information about the Warsaw Uprising was presented. The Uppsala School in philosophy and the Vienna Circle are prima facie similar currents in contemporary philosophy. Both reject metaphysics, claim that reality is a spatio­‑temporal realm and adhere to noncognitivism in terms of values. However, justifications of these assumptions are quite different. In the following article we reconstruct main theses of both mentioned currents and then we indicate their impact on one of the major jurisprudential movements, namely Scandinavian Legal Realism. We focus on Alf Ross’ legal philosophy, as (...) it was an attempt to accommodate both: the philosophy of the Uppsala School and of the Vienna Circle. We trace those two sources of inspiration in Ross’ theory of legal validity and of legal concepts. (shrink)

The paper deals with the state of the social sciences after the boom of internet services in the Czech Republic in the 1990s. The results of our survey, based on 512 responses from the economics and history departments of major Czech public universities, show that internet services are considered a quality factor for academic output; however, the issues of plagiarism, a lack of resource criticism, inadequacy of impact factor-based evaluations, poor academic training for the new generation of social scientists, (...) the failure of state academic policy, and the generation gap make further development in the Czech social sciences rather problematic. As a result we recommend creating a better communication link between policy makers and scholars, reforming the current state policy which encourages lower quality academic output, and improving academic training, which requires a more individual approach, and also placing higher demands on social scientists. This article revisits the existing accounts of the early Czech Kierkegaard reception. It argues that Kierkegaard has had a greater reception than previously assumed and that one must take into account the cultural and historical contexts. Two major points are made: first, the earliest Kierkegaard reception was closely related to the Czech national political struggles and Kierkegaard was used as a political argument supporting the need for a Czech national reformed Church. Second, we provide evidence for a surprising politicized (...) Catholic reception of Kierkegaard: Kierkegaard’s critique of the Danish Lutheran Church was appropriated to attack Protestantism and support the Roman Catholic Church. (shrink)

In Vermont, approximately 1000–1200 migrant workers from Latin America are helping to sustain the state’s dairy industry. These dairy workers, the majority of whom are from Mexico and Guatemala, experience significant mental health impacts stemming from a combination of stressors due to leaving their home of origin and challenges related to working in rural Vermont. This article employs a framework of structural violence and structural vulnerability to situate the lived experiences and health concerns of migrant farmworkers in Vermont’s dairy industry. (...) It presents two case studies of applied projects that have been utilized to address these health concerns, a gardening project called Huertas that addresses issues of food insecurity and barriers in access to fresh and culturally familiar produce, and a participatory comics project called El Viaje Más Caro that aims to address mental health concerns through engaged storytelling and comics production. The authors of this article have designed and carried out these projects with the goal of interrupting the forms of structural violence and structural vulnerability that negatively impact the wellbeing of farmworkers in the state’s dairy industry. This article describes the successes and limitations of these projects with the hope they can be adapted and replicated for other farmworker communities facing similar health barriers. (shrink)

The paper reports results of the very first survey-based study on the prevalence, frequency and nature of ethical or other non-medical difficulties faced by Polish physicians in their everyday clinical practice. The study involved 521 physicians of various medical specialties, practicing mainly in inpatient healthcare. The study showed that the majority of Polish physicians encounter ethical and other non-medical difficulties in making clinical decisions. However, they confront such difficulties less frequently than their foreign peers. Moreover, Polish doctors indicate different circumstances (...) as a source of the experienced problems. The difficulties most often reported relate to (i) patients (or their proxies) requests for medically non-indicated interventions; (ii) problems with communication with patients (or their proxies) due to the patients’ negative attitude, unwillingness to cooperate, or aggression; and (iii) various difficulties with obtaining informed consent. Polish physicians report difficulties associated with disagreements among care givers or scarcity of resources less frequently than doctors from other countries. The study’s findings provide support for the thesis that a significant portion of Polish physicians still follow a traditional, paternalistic, and hierarchical model of healthcare practice. Instead of promoting patient’s empowerment, engagement, and rights, they often consider these ideas as a threat to physicians’ professional authority and autonomy. The study leads to the conclusion that due to insufficient training in medical ethics, communication skills, and medical law, many Polish physicians lack the knowledge and competence necessary to adequately respond to challenges posed by modern healthcare practice. We investigate under what conditions contrary-to-duty (CTD) structures lacking temporal and action elements can be given a coherent reading. We argue, contrary to some recent proposals, that CTD is not an instance of defeasible reasoning, and that methods of nonmonotonic logics are inadequate since they are unable to distinguish between defeasibility and violation of primary obligations. We propose a semantic framework based on the idea that primary and CTD obligations are obligations of different kinds: a CTD obligation pertains to, or (...) pre-supposes, a certain context in which a primary obligation is already violated. This framework is presented initially as an extension of Standard Deontic Logic (SDL), a normal modal logic of type KD, and is illustrated by application to a series of examples. The concluding section is concerned with some resemblances between CTD and defeasible reasoning. We show first that the SDL-based framework contains a flaw and must be adjusted. A discussion of possible adjustments, including an alternative treatment in terms of a preference-based semantics, reveals difficulties that are reminiscent of problems in defeasible reasoning and intensional accounts of defeasible conditionals. The paper is a contribution to the debate on the epistemological status of thought experiments. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...) theory, focusing on the critique of eliminativism by Tamar Szabó Gendler based on the reconstruction of famous Galileo's Pisa experiment. I show that her reconstruction is simplistic and that more elaborate reconstruction is needed for an appropriate assessment of the epistemic power of general argument. I propose such a reconstruction and demonstrate that general version of Pisa experiment is epistemically equal to the particular one. Thus, from an epistemological perspective, Galileo's thought experiment is reducible to a straightforward argument without particular premises. (shrink)

Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

In this paper I analyze the most controversial thesis of Aristotelian substantialism, namely, that substances cannot be composed of other substances. I call this position the Mereological Limitation Thesis (MLT). I find MLT valid and defend it. My argument for MLT is a version of the argument from the unicity of substantial form. Every substance can have only one substantial form, thus, if some substances compose the objectO, then what binds them is only a set of their accidental forms (relations) (...) and in the result thereofOis not a substance (Ois not informed by a substantial form). I argue against the relativization of the substantiality of forms to the level of composition by showing that substantial forms must be absolutely identity-independent. In the last section I specify the ontological status of parts of substances and argue that they are spatially distributed bundles of accidents of a compound substance itself. (shrink)

Experiences are interpreted as conscious mental occurrences that are of phenomenal character. There is already a kind of (weak) intentionality involved with this phenomenal interpretation. A stricter conception of experiences distinguishes between purely phenomenal experiences and intentional experiences in a narrow sense. Wittgenstein’s account of psychological (experiential) verbs is taken over: Usually, expressing mental states verbally is not describing them. According to this, I believe can be seen as an expression of one’s own belief, but not as an expression of (...) a belief about one’s belief. Hence, the utterance I believe it is raining shows that I believe that it is raining, although it is not said by these words that I believe that it is raining. Thinking thoughts such as I believe it is raining, but it is not raining (a variant of Moore’s paradox) is an absurdity between what is already said by silently uttering It is not raining and what is shown by silently uttering I believe it is raining. The paper agrees with a main result of Wittgenstein’s considerations of Moore’s paradox, namely the view that logical structure, deducibility, and consistency cannot be reduced solely to propositions—besides a logic of propositions, there is, for example, a logic of assertions and of imperatives, respectively. For the given logical calculus we investigate the proportion of the number of true formulas of a certain length n to the number of all formulas of such length. We are especially interested in asymptotic behavior of this fraction when n tends to infinity. If the limit exists it is represented by a real number between 0 and 1 which we may call the density of truth for the investigated logic. In this paper we apply this approach to the intuitionistic (...) logic of one variable with implication and negation. The result is obtained by reducing the problem to the same one of Dummett's intermediate linear logic of one variable (see [2]). Actually, this paper shows the exact density of intuitionistic logic and demonstrates that it covers a substantial part (more than 93%) of classical prepositional calculus. Despite using strictly mathematical means to solve all discussed problems, this paper in fact, may have a philosophical impact on understanding how much the phenomenon of truth is sporadic or frequent in random mathematics sentences. In the paper [8], the first author developped a topos- theoretic approach to reference and modality. (See also [5]). This approach leads naturally to modal operators on locales (or spaces without points). The aim of this paper is to develop the theory of such modal operators in the context of the theory of locales, to axiomatize the propositional modal logics arising in this context and to study completeness and decidability of the resulting systems.

In an era of fiscal austerity and dualization of social protection, has organized labor become increasingly split along skill and industry lines? Against recent political science accounts of trade union involvement in social policymaking, this paper argues that, in the specific area of pensions, unions representing high-skilled workers and the core industrial sectors of the economy have paradoxically been led to increase their cooperation with unions representing the less privileged segments of labor, in order to improve coverage of private pensions (...) across the board. These unions’ motivations for doing so and the strategies they have employed have nonetheless differed according to the preexisting institutional design of domestic pension systems. The argument is supported with case studies of British, French, German, and Belgian unions’ involvement in contemporary pension reform. (shrink)

O artigo trata da questão dos direitos humanos quanto ao potencial de consenso entre culturas através do diálogo intercultural. Trata-se de uma contribuição para superar os confrontos entre civilizações e a imposição coercitiva de direitos humanos sobre outras culturas. O paper mostra que a promoção intercultural de direitos humanos entre culturas individuais que se reconhecem mutuamente é uma das formas efetivas de resistência contra a falta de reconhecimento. Todavia, é mister uma formulação dos direitos humanos embasada nos valores de culturas (...) individuais e no diálogo entre elas. A interpretação aqui adotada é uma contribuição para criar ‘unidade na pluralidade’, i.e. uma universalidade de direitos humanos dentro da pluralidade de culturas. (shrink)

The present paper consists of two parts. In the first, some issues related to the character of biological experiments conducted under in vitro cultures are portrayed. The relevant aspects of these procedures are explicated from the viewpoint of the experimental botanist. It is a case study for the considerations in the second part, which presents selected philosophical and legal issues involved in biological experiments from the general perspective of philosophical investigations concerning the problem of plants’ axiology. Obviously, the nature of (...) the considerations is limited; not all important questions from the perspective of biology and philosophy have been raised. Nevertheless, the authors hope that the analyzed issues may be interesting for both biologists and philosophers. (shrink)

In recent years the age-old question “what is the human?” has acquired a new acuteness and novel dimensions. In introducing the special issue on “Historical Thinking and the Human”, this article argues that there are two main trends behind the contemporary “crisis of human”: ecological transformations, and technological ones. After discussing the respective anthropocenic and technoscientific redefinitions of the human, the paper theorizes three elements in an emerging new historicity of the human: first, the move from a fixed category to (...) a dynamic and indeterminate concept, considering the human as a lifeform in movement; second, the extent to which the human is conceived of in its relational dependence on various non-human agents, organic and non-organic; and third, the reconceptualization of the human not as one but as many, to comprehend that we cannot speak of human individuality in the classical biological sense. In the final part, the article addresses the consequences of the redefinition of the human for historical thinking. It makes the case for the need to elaborate a new notion of history – captured by the phrase “more-than-human history”, and attuned to an emerging planetary regime of historicity in which historical thinking becomes able to affirm multiple temporalities: digital, technoscientific, sociocultural, human, biological and anthropocenic. The article concludes by recognizing the necessity to venture into a new transdisciplinary knowledge economy, appropriate for making sense of the contemporary constellation of the entangled human, technological and natural worlds. This book discusses outcomes of a study by the National Institute of Mental Health, Czech Republic, examining moral integrity in the post-communist Czech-speaking environment. Chapters map the history of the Euro-Atlantic ethical disciplines from moral philosophy and psychology to evolutionary neuroscience and socio-biology. The authors emphasize the biological and social conditionality of ethics and call for greater differentiation of both research and applied psychological standards in today’s globalised world. Using a non-European ethical system – Theravada Buddhism – as a case (...) study, the authors explore the differences in English and Czech interpretations of the religion. They analyse cognitive styles and language as central variables in formatting and interpreting moral values, with important consequences for cultural transferability of psychological instruments. This book will appeal to academics and other specialists in psychology, psychiatry, sociology and related fields, as well as to readers interested in the psychology of ethics. (shrink)

Pediatric cancer can be considered an event potentially leading to posttraumatic stress symptoms as well as posttraumatic growth. While clinically significant levels of PTSS are rare in childhood cancer survivors, PTG is common in this population. However, the relationship of PTG to overall adaptation and quality of life in pediatric cancer patients is not clear. Therefore, our study aims to analyse the relationships of PTSS and PTG with QOL in childhood cancer survivors. In this study, 172 childhood cancer survivors completed (...) measures of quality of life, posttraumatic stress and posttraumatic growth. Correlation analyses were carried out separately for the child and adolescent groups and each QOL dimension. In the adolescent group, the relationship of PTSS and PTG with QOL was further verified by regression analyses while controlling for age, gender, and time off treatment. In children, negative relationships between PTSS and QOL were found, but the relationships between QOL and PTG were not significant. In adolescents, significant relationships were found for all dimensions of QOL and PTSS and also for several dimensions of QOL and PTG. The relationships between PTSS and QOL dimensions were negative in both groups, and the relationships between PTG and QOL in the adolescent group were weakly positive. In adolescents, regression analyses controlling for age, gender and time off treatment were performed and confirmed a negative relationship of PTSS with all QOL dimensions except for social functioning. For PTG, regression analyses revealed a significant positive relationship with QOL dimensions of social functioning, outlook on life and intimate relations. While the relationship between PTSS and QOL is negative for almost all QOL dimensions in children and adolescents, the nature of the relationship between PTG and QOL appears to be more complex and changing over time. PTG in children may reflect different processes with different outcomes than PTG in adolescents. (shrink)

"Dignity as a Quality of Person: Types of Dignity – a Proposed Systematisation" This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of the expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the concept of dignity encompasses dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve (...) different concepts of dignity, and thus twelve types of dignity. Half of them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law, and this essay is devoted to this group of meanings. This group of meanings includes three concepts of dignity which encompass dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. Only the first of these three concepts of dignity is adequate to the interpretation of the preamble and art. 30 of the Polish Constitution. The second group of meanings, treating dignity as something with which the human being is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. The other half of the meanings take dignity as something that belongs to something. These meanings will be considered in the forthcoming essay Godność jako cecha podmiotów zbiorowych i godność jako cecha ugruntowana instytucjonalnie. Typy godności – propozycja systematyzacji [Dignity as an Attribute of Collective Entities and Dignity as an Institutionally Grounded Attribute: Types of Dignity – a Proposed Systematisation]. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “dignity” when designating something belonging to something can also designate (4) the dignity of social status based on belonging to a social group, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. STRESZCZENIE Opracowanie zmierza do identyfikacji różnych znaczeń wyrażenia (nazwy) „godność”, ze szczególnym uwzględnieniem znaczeń tego wyrażenia występującego w tekście Konstytucji RP. Znaczeniem nazwy „godność” jest pojęcie godności; z kolei pojęcie godności ujmuje samą godność danego typu. Wskazanych zostaje dwanaście różnych znaczeń wyrażenia „godność” – dwanaście różnych pojęć godności, zatem i dwanaście jej typów. Połowa z nich to znaczenia (pojęcia), które ujmują godność jako coś przynależnego człowiekowi jako podmiotowi i tym znaczeniom (i odpowiadającym im typom godności) poświęcone jest niniejsze opracowanie. W tej grupie znaczeń odróżnione zostają trzy pojęcia godności, które ujmują godność jako coś konstytutywnego dla bycia osobą – (1) przyrodzoną i niezbywalną godność osobową, (2) godność opartą na obserwowalnych i zmiennych cechach specyficznych dla istoty rozumnej i (3) godność opartą na historycznie ukształtowanym statusie społecznym przypisanym wszystkim ludziom. Jedynie pierwsze z tych pojęć jest adekwatne do interpretacji preambuły i art. 30 Konstytucji RP. W drugiej grupie znaczeń ujmujących godność jako coś przysługującego człowiekowi są pojęcia ujmujące godność jako cechę osoby – (4) godność osobistą (cześć i dobre imię), (5) godność osobowościową (poziom moralny) oraz (6) godność jako dyspozycja do stosownego sposobu bycia. Druga połowa znaczeń ujmuje godność jako coś przynależnego czemuś lub jako coś o charakterze konwencjonalnym, instytucjonalnym. Te znaczenia będą omawiane w kolejnym opracowaniu Godność jako cecha podmiotów zbiorowych lub cecha ugruntowana instytucjonalnie. Typy godności – Propozycja systematyzacji – Część 2. Konstytucja RP mówi o (1) godności Narodu, (2) godności urzędu lub funkcji, oraz o (3) godności publicznej (godnościach publicznych. Wyrażenie „godność” jako desygnujące coś przynależnego czemuś może także desygnować (4) godność statusu społecznego opartego na przynależności do jakiejś grupy społecznej, (5) godność zawodu oraz – co specyficzne dla języka polskiego – (6) godność jako nazwisko. Autor argumentuje, że niedopuszczalne jest przypisywanie wyrażeniu „dignity” występującym w danym przepisie prawnym, różnych pojęć godności. (shrink)

STRESZCZENIE Opracowanie zmierza do udzielenia odpowiedzi na pytanie, czym – z punktu widzenia struktury procesu wykładni i struktury wchodzących w grę wartości konstytucyjnych – różni się ograniczanie wolności i praw w ramach stosowania „zwykłych środków konstytucyjnych”, od ograniczania wolności i praw dopuszczalnego w stanach nadzwyczajnych. Podjęta zostaje problematyka dotyczącą kwestii materialnych, a poza zakresem rozważanych zagadnień pozostają kwestie dotyczące formalnych warunków dopuszczalności ograniczeń, jak publiczne ogłoszenie zagrożenia czy możliwość wprowadzania ograniczeń w aktach podustawowych. Stawiane tezy są polemiczne wobec poglądów, że (...) zawieszenie wolności lub praw jest skrajnym typem ograniczania i następuje wtedy, gdy wolności czy prawa „już nie ma”, lub że zawieszenie zakłada ograniczenie istoty wolności lub prawa. Okazuje się, że można sensownie mówić o zawieszaniu wolności lub praw także wówczas, gdy są one ograniczane w niewielkim tylko stopniu. Ponadto, możliwe jest zawieszanie, które nie prowadzi do ograniczenia istoty wolności lub prawa. Argumentuje się, że istotą zawieszania wolności lub praw w stanach nadzwyczajnych jest zakwestionowanie podstawowego ich przymiotu, jakim jest – uznawana w prawie międzynarodowym – nienaruszalność „całych” poszczególnych praw człowieka, która jest czymś innym od nienaruszalności ich istoty. Przy okazji prowadzona jest refleksja teoretycznoprawna nad zagadnieniem zawieszania wolności lub praw. Zawieszenie okazuje się czymś istotnie różnym od czasowej utraty mocy obowiązującej przepisów dotyczących wolności czy praw. Ich ciągłe obowiązywanie znajduje wyraz, na przykład, w zasadzie proporcjonalności mającej zastosowanie do zawieszanych wolności lub praw. -/- Extraordinary Measures and Restrictions of Constitutional Freedoms and Rights ABSTRACT The study aims to answer the question on the difference between limitation of freedoms and rights in ordinary situations and their suspension (derogation) when extraordinary measures are introduced. This question is considered from the point of view of the structure of the interpretation process and the structure of the constitutional values. Consideration is given to issues relating to material aspects. However, issues relating to formal conditions for the admissibility of restrictions, such as public announcement of a threat or the possibility of introducing restrictions in sub-statutory acts, are not examined. The theses put forward are critical of the view that suspension of freedoms or rights is an extreme type of limitation and a freedom or a right "is no longer there", and of the view that suspension presupposes violation of the essence of freedom or right. It can be argued that it makes sense to talk about the suspension of freedoms or rights also when they are only slightly restricted. Moreover, it is possible to suspend a freedom or a right without violating their essence. It is argued that suspension of freedoms or rights leads to questioning of their basic characteristic that is their inviolability as recognized in international law. However, this inviolability of freedoms or rights is something different from the inviolability of their essence. In terms of the theory of law, the suspension of freedoms or rights turns out to be something significantly different from the temporary loss of the binding force of the respective provisions. Their continued validity is reflected, for example, in the application of the principle of proportionality to the suspended freedoms or rights. (shrink)
