Un phénomène intéressant apparaît dans de multiples cultures juridiques : afin de concilier la lettre de la loi et son esprit, certaines lois sont contournées – légalement. Ce contournement, qui consiste à vider la loi de son esprit tout en faisant mine de respecter sa formulation (un loophole en anglais), pose d’un point de vue éthique la question de savoir s’il n’y a pas là hypocrisie. La loi juive est ici étudiée car les contournements qu’elle autorise sont critiqués par ses (...) détracteurs, mais également de l’intérieur : tous les contournements ne sont pas approuvés, loin s’en faut. The Approximate Number System (ANS) is a system that allows us to distinguish between collections based on the number of items, though only if the ratio between numbers is high enough. One of the questions that has been raised is what the representations involved in this system represent. I point to two important constraints for any account: (a) it doesn’t involve numbers, and (b) it can account for the approximate nature of the ANS. Furthermore, I argue that representations of pure (...) magnitude with vehicles that have an imprecision in the value of the unit of measurement (further clarified through a formal model from measurement theory) fit both these requirements. Die Arbeit des Bundesverfassungsgerichts hat Ausstrahlungswirkung auf alle drei Staatsgewalten. Während sich das Interesse der Öffentlichkeit wie der Medien im Wesentlichen auf spektakuläre Einzelurteile fokussiert, bemüht sich die Rechtswissenschaft, die Rechtsprechung des BVerfG in ihrer gesamten Breite zu erfassen, zu analysieren und zu strukturieren. Die wissenschaftlichen MitarbeiterInnen nehmen als Erste Tendenzen und Rechtsprechungslinien wahr und begleiten sie mit ihrer Arbeit. Aus dieser Nahsicht herauswird in dem vorliegenden Bandder Versuch unternommen, zentrale, charakteristische und bedeutsame Themen und Fragestellungen aufzugreifen und auf wissenschaftlichem (...) Niveau zu erörtern. Die Beiträge gehen dabei über bloße Entscheidungsbesprechungen ebenso hinaus wie über Rechtsprechungsübersichten. Im Aufzeigen sowohl von Hintergründen als auch von Tendenzen der Verfassungsrechtsprechung und ihrer aktuellen und praktischen Bezüge zur Tätigkeit der anderen Staatsgewalten gerade durch Mitarbeiter des Gerichts liegt der besondere Wert dieses Sammelbandes. An English double-embedded relative clause from which the middle verb is omitted can often be processed more easily than its grammatical counterpart, a phenomenon known as the grammaticality illusion. This effect has been found to be reversed in German, suggesting that the illusion is language specific rather than a consequence of universal working memory constraints. We present results from three self-paced reading experiments which show that Dutch native speakers also do not show the grammaticality illusion in Dutch, whereas both German (...) and Dutch native speakers do show the illusion when reading English sentences. These findings provide evidence against working memory constraints as an explanation for the observed effect in English. We propose an alternative account based on the statistical patterns of the languages involved. In support of this alternative, a single recurrent neural network model that is trained on both Dutch and English sentences is shown to predict the cross-linguistic difference in the grammaticality effect. Das vorliegende Themenheft „Ethik der Integrität“ der Zeitschrift für Praktische Philosophie vereint Beiträge aus der Rechts-, Moral- und Umweltphilosophie, die sich mit den deskriptiven und normativen Möglichkeiten und Grenzen von „Integrität“ beschäftigen. Die Untersuchung von Integrität nimmt dabei die Anwendung des Konzepts auf menschliche Personen und nichtmenschliche Naturwesen wie Tiere, Pflanzen und Ökosysteme in den Blick. Integrität impliziert im weitesten Sinne die Annahme, Wesen könnten und sollten als „ganze“ betrachtet, auch gegen innere und äußere Widerstände in der Lage sein, gemäß (...) ihrer eigenen „Zwecke“ zu verfahren. Zwar taucht integritas bereits bei Cicero in De officiis und bei Thomas v. Aquin in Summa theologiae vereinzelt auf, doch nimmt die Begriffsverwendung vor allem in der zweiten Hälfte des 20. Jahrhunderts zu. Es scheint offenkundig ein Bedürfnis danach zu bestehen, z.T. recht unterschiedliche Phänomene als „Ganzheiten“ zu beschreiben und deren „Intaktheit“ positiv zu bewerten. Personen sollten hiernach in elementaren, ihre Identität dennoch im umfassenden Sinne betreffenden Aspekten in „Übereinstimmung“ mit sich selbst leben können. Die Integrität der Natur wird in wichtigen klimapolitischen Verträgen wie dem Abkommen von Paris sowie bei der Kodifizierung der Rechte der Natur z. B. in der Verfassung von Ecuador als Wert normativ vorausgesetzt. Das naturwissenschaftliche Paradigma des Anthropozäns verwendet ebenfalls eine umfassende Perspektive auf Mensch und Natur, die auch als Plädoyer für die Schutzwürdigkeit der Erde als „ganzer“ ausgedeutet wird. Noch wissen wir nicht, ob dem Konzept der Integrität im 21. Jahrhundert eine ähnliche „Karriere“ bevorsteht, wie sie der Begriff der Würde im 20. Jahrhundert erlebt hat. Dieses Heft ist ein Versuch, die verschiedenen Verwendungskontexte zu überblicken und einige stichprobenartig zu überprüfen. (shrink)

There is some limited contemporary scholarship on the theory of metaphor Kant appears to provide in his Critique of Judgment. The dominant interpretations that have emerged of Kant’s somewhat nascent account of metaphors are what I refer to as the symbolist view, which states that Kantian symbols should be viewed as Kantian metaphors, and the aesthetic idea view, which holds that Kant defi ned metaphors as aesthetic ideas . In this essay, I claim that the symbolist view of Kantian metaphors (...) is not plausible and that we should accept the aesthetic idea view in its stead. The jumping off points for my discussion are two fairly recent essays on the subject: A. T. Nuyen’s “The Kantian Theory of Metaphor” and Kirk Pillow’s “Jupiter’s Eagle and the Despot’s Hand Mill: Two Views of Metaphor in Kant.” Nuyen defends the symbolist view of Kantian metaphor and Pillow defends a split view, i.e., Pillow thinks Kant has a dual-aspect view of metaphor that can bear both the symbolist and the aesthetic idea interpretations. Although I make use of some of Pillow’s objections against the symbolist view, I conclude that both he and Nuyen are wrong in thinking that Kantian symbols have any relationship to Kantian metaphors at all. Lastly, I will provide my own positive account of Kant’s theory of metaphors as well as show how this debate affects Kant’s overallaesthetic theory. (shrink)

In this paper I present an argument for a procedural principle of distribution, which is often called the presumption of equality.

We investigate the development of terms during cut-elimination in first-order logic and Peano arithmetic for proofs of existential formulas. The form of witness terms in cut-free proofs is characterized in terms of structured combinations of basic substitutions. Based on this result, a regular tree grammar computing witness terms is given and a class of proofs is shown to have only elementary cut-elimination.

Rival paradigms of genetics suggest different perceptions of human life and, correspondingly, of the task of medicine. In dialogue with two paradigmatic heuristics of genetics, I will show that bioethics needs to articulate a narrative that encourages a renewed understanding of the complexity of the phenomena of human life to which molecular medicine must be open. These considerations will be put to the test by discussing the ethical implications of the recent developments in stem cell research and in personal genetics.

Presupposition is the semantic-pragmatic phenomenon whereby a statement contains an implicit precondition that must be taken for granted for that statement to be felicitous. This article discusses the role of presupposition in legislative texts, using examples from Swiss constitutional and administrative law. It illustrates how presuppositions are triggered in these texts and what functions they come to serve, placing special emphasis on their constitutive power. It also demonstrates how legislative drafters can distinguish between “good” presuppositions and “bad” presuppositions by weighing (...) their main advantage, conciseness, against their main flaw, reduced transparency. The present study argues that, if employed carefully, presuppositions can be a useful stylistic means to keep legislative texts free from unnecessary clutter that merely elaborates on the obvious; however, it also suggests that, if applied wrongly, presuppositions can camouflage the duties and obligations placed on the subjects of a law and thus impede its accessibility and its efficient and effective implementation. In the last decade a great amount of literature that elaborates on Leibniz’ cultural and philosophical openness has emerged. It is therefore odd that there has not been made any direct comments on Chung-Ying Cheng interesting analyses of Leibniz’s writings on Chinese philosophy (Cheng 2000, 2002). By giving a critical review of Cheng’s work on this topic, it is the aim of this paper to integrate some problems of Sino-western philosophical encounters into the Leibniz scholarship of today. In the course (...) of analyzing Cheng’s arguments the paper points to some problems in his approach to Leibnizian philosophy and its “encounter” with Chinese classics. After challenging Cheng’s reading of Leibniz and suggesting alternative interpretations, the paper discusses whether thisunderstanding of Leibniz could designate a positive approach to Sino‐western philosophical exchange. Central to this, the question is raised whether or not it can be shown that Leibniz remained open to rethink his own philosophy in the light of his meeting with Chinese philosophy. While the paper agrees with Cheng in the judgement that Leibniz did not arrive at a complete understanding of the Chinese classic Yijing, it claims that Cheng’s analysis contradicts some of Leibniz’s other writings on China as well as Leibniz’s general ambition of supporting global philosophical exchange. This manuscript describes the institutional and clinical considerations that apply to the question of whether to mandate opioid dose reduction in patients who have received opioids long-term. It describes how a calamitous rise in addiction and overdose involving opioids has both led to a clinical recalibration by healthcare providers, and to strong incentives favoring forcible opioid reduction by policy making agencies. Neither the 2016 Guideline issued by the Centers for Disease Control and Prevention nor clinical evidence can justify or promote (...) such policies as safe or effective. (shrink)

The Measure of a Man ist der Originaltitel der 9. Episode der 2. Staffel von Star Trek – The Next Generation, die im Mittelpunkt meiner Überlegungen steht. Hierin beabsichtigt der Kybernetikforscher und Sternenflottenoffizier Bruce Maddox, Forschung am Androiden Data durchzuführen, in der Hoffnung, schließlich Data-ähnliche Androiden erschaffen zu können. Die Forschungsprozesse implizieren jedoch Eingriffe, mit denen das Risiko einhergeht, dass Data zerstört wird, weshalb Data nicht bereit ist, an sich forschen zu lassen. Die entscheidende philosophische Frage diesbezüglich ist: Handelt es (...) sich bei Data um eine Sache oder um eine Person? Ein Weder-Noch stellt hier die plausibelste Antwort dar, wie in diesem Artikel gezeigt wird. (shrink)

The target article is well in accordance with recent theoretical advances considering the complex large-scale brain network organization underlying emotions. Given current limitations of the methods in brain science, however, research is faced with the difficult question as to how it will be possible to elucidate the complex nonlinear interactions, the neurotransmitters involved, and the excitatory or inhibitory nature of neural processes underlying human emotion in such networks. Moreover, while investigating the network properties of neural processes underlying emotions, it is (...) also important to keep in mind that specific brain structures, or specific brain networks, generate specific emotions. Thus, while aiming at elucidating complex large-scale brain networks of emotion, it is important to identify emotional specificity of, or within, these networks. (shrink)

This contribution first searches for historical and empirical evidence for whether and how curricula act or acted as a measure of public education. The problem is explicated on account of a short history of curriculum work and distinguished in a analytical, a political, programmatical and practical discourse of curriculum work. Curriculum work always underlies premises of planning, learning and effects. Three models are finally developed and brought in touch with the different discourses. Curriculum work proves to be an attempt to (...) make publicly acceptable the empirically impossible accountability of schools. (shrink)

Ziel dieses Aufsatzes ist es, Robert Brandoms Begriff des Explizit-Machens explizit zu machen. Zu diesem Zweck werden zunächst verschiedene Formen des Explizit-Machens unterschieden. Dabei erweist sich allein der Begriff des logischen Explizit-Machens als haltbar. Anschließend wird gezeigt, dass diesem Begriff eine Schlüsselstellung im Rahmen von Brandoms Philosophie zukommt. Sowohl seine philosophische Methodologie als auch sein zentrales philosophisches Projekt einer Zurückführung von Semantik auf Pragmatik lassen sich höchstens soweit verständlich machen wie der Begriff des logischen Explizit-Machens. Dieser weist allerdings ein erhebliches (...) Defizit auf: Im Rahmen einer Inferentialistischen Semantik lässt sich die expressive Funktion wichtiger Teile des logischen Vokabulars nicht verständlich machen. Das Ergebnis ist, dass sich zwei der Grundpfeiler von Brandoms Sprachphilosophie, die Inferentialistische Semantik einerseits und deren Zurückführung auf eine normative Pragmatik andererseits, nicht gleichzeitig konsequent durchhalten lassen.
