This article uses the idea of resilience as a point of departure for analysing some contemporary challenges to the climate justice movement posed by social-ecological sciences. Climate justice activists are increasingly rallying for a system-change, demanding fundamental changes to political bureaucracy and the economy, which would put ecology, biodiversity and climate change first for all future political decisions. Since the concept of resilience has taken up a central role in recent developments in ecological sciences, it has also become part of (...) the activist debate. The article’s main argument is that the scientific framework behind resilience is not politically neutral and that this framework tends to weaken the activist’s demands for a just transition and place more emphasis on technical and bureaucratic processes. I propose to show that any direct moral bioenhancement procedures that could be realized within a relatively short period of time are not realistic options. This does not have to worry us; however; because alternative options for promoting morality are available. Consequently; moral bioenhancement is not an option for dealing successfully with the increased potential destructiveness of contemporary technologies within a short-term framework; i.e. within this century. In what follows; I will explain why this is the case; and why; contrary (...) to Ingmar Persson and Julian Savulescu; I think this need not worry us too much. In section 1.; I will critically analyze moral bioenhancement by means of citalopram; aimed at reducing the tendency to harm others directly. I give this prominence because it could be a practical option for altering human emotions and dispositions – to my mind; it seems the most promising practical option in this field. In later sections; I will consider other means of realizing moral bioenhancement; since the first option does not do the job it is supposed to; and because Persson and Savulescu are concerned with alternative approaches. This article investigates corporate governance reform in South Africa in the context of the country’s international links with Anglo-American corporate governance and domestic pursuit of socioeconomic development. Two key questions are evaluated. (a) How has divergence within the Anglo-American model influenced corporate governance reform in South Africa? (b) Can South Africa’s historical closeness to the Anglo-American model be combined with increasing attention to stakeholder issues to produce a hybrid “African model” of corporate governance? Evaluating these questions, the following issues are (...) explored in turn: the contrast between shareholder and stakeholder models, divergence between U.S. and U.K. approaches to corporate governance as exemplified by Sarbanes-Oxley, locating a South African approach in context of the Anglo-American model, the King reports and an emerging “African” model of corporate governance, and the role of international and domestic factors in shaping South Africa’s ongoing reform process. This paper explores links between different ethical motivations and kinds of corporate social responsibility activities to distinguish between different types of business cases with regard to sustainability. The design of CSR and corporate sustainability can be based on different ethical foundations and motivations. This paper draws on the framework of Roberts which distinguishes four different ethical management versions of CSR. The first two ethical motivations are driven either by a reactionary concern for the short-term financial interests of the business, or (...) reputational, driven by a narcissistic concern to protect the firm’s image. The third responsible motivation works from the inside-out and seeks to embed social and environmental concerns within the firm’s performance management systems, and the fourth, a collaborative motivation, works to bring the outside in and seeks to go beyond the boundaries of the firm to create a dialogue with those who are vulnerable to the unintended consequences of corporate conduct. Management activities based on these different ethical motivations to CSR and sustainability result in different operational activities for corporations working towards sustainability and thus have very different effects on how the company’s economic performance is influenced. Assuming that corporate managers are concerned about creating business cases for their companies to survive and prosper in the long term, this paper raises the question of how different ethical motivations for designing CSR and corporate sustainability relate to the creation of different business cases. The paper concludes by distinguishing four different kinds of business cases with regard to sustainability: reactionary and reputational business cases of sustainability, and responsible and collaborative business cases for sustainability. The ways in which the sciences have been delineated and categorized throughout history provide insights into the formation, stabilization, and establishment of scientific systems of knowledge. The Dresdener school’s approach for explaining and categorizing the genesis of the engineering disciplines is still valid, but needs to be complemented by further-reaching methodological and theoretical reflections. Pierre Bourdieu’s theory of social practice is applied to the question of how individual agents succeed in influencing decisively a discipline’s changing object orientation, institutionalisation and self-reproduction. (...) Through the accumulation of social, cultural and economic capital, they succeed in realising their own organisational ideas and scientific programs. Key concepts for the analysis include the struggle for power and resources, monopolies of interpretation, and the degree of autonomy. A case study from the Aachener Technische Hochschule shows that the consolidation of ferrous metallurgy can be conceived as a symbolical struggle between Fritz Wüst, professor for ferrous metallurgy, and the German Iron and Steel Institute, leading to a construction of a system of differences in which scientists accepted being scientists rather than entrepreneurs, and entrepreneurs accepted becoming entrepreneurs and renounced science. This paper critically compares a deliberative system based on parliamentary elections (an electoral system) and a deliberative system based on sortition (a lottocratic system). Both systems are analyzed in three dimensions. The epistemic dimension concerns the rational quality of the democratic process. The power dimension concerns the distribution of power and the extent to which citizens genuinely control all decisions. The motivational dimension, finally, concerns citizens’ identification with the decision-making process and their willingness to abide by its outcomes. We argue (...) that an electoral system is, in all three dimensions, normatively superior to a sortition-based system. Most prominently, we claim that electoral mechanisms provide visibility to the decision-making process. This enables a form of interactive representation in which citizens and their representatives engage in a joint process of opinion and will formation. Sortition, in contrast, is characterized by a democratically much poorer form of descriptive representation. The selected citizens are a representative sample of the wider citizenry, but they deliberate in a forum that remains mostly disconnected from that wider citizenry and therefore cannot shoulder the process of collective self-government. The inference from determinism to predictability, though intuitively plausible, needs to be qualified in an important respect. We need to distinguish between two different kinds of predictability. On the one hand, determinism implies external predictability , that is, the possibility for an external observer, not part of the universe, to predict, in principle, all future states of the universe. Yet, on the other hand, embedded predictability as the possibility for an embedded subsystem in the universe to make such predictions, does (...) not obtain in a deterministic universe. By revitalizing an older result—the paradox of predictability —we demonstrate that, even in a deterministic universe, there are fundamental, non-epistemic limitations on the ability of one subsystem embedded in the universe to predict the future behaviour of other subsystems embedded in the same universe. As an explanation, we put forward the hypothesis that these limitations arise because the predictions themselves are physical events which are part of the law-like causal chain of events in the deterministic universe. While the limitations on embedded predictability cannot in any direct way show evidence of free human agency, we conjecture that, even in a deterministic universe, human agents have a take-it-or-leave-it control over revealed predictions of their future behaviour. This paper revisits a well-known rebuttal of Peter van Inwagen’s consequence argument. This CS-rebuttal, as I shall call it, focuses on the counterfactual structure of alternative possibilities. It shows that the ability to do otherwise is such that if the agent had exercised it, the distant past and/or the laws of nature would have been different. On the counterfactual scenario, there is, therefore, no need for the agent to exercise an ability to change the past or the laws of nature. (...) I first present van Inwagen’s original version of the consequence argument. After exposing some difficulties with Lewis’ famous version of the CS-rebuttal, I proceed by explaining and defending an older and, in my view, superior version. I subsequently discuss a traditional incompatibilist rejoinder, which insists that the past and the laws of nature are fixed. Although this rejoinder delivers a valid argument against the existence of alternative possibilities, it relies on premises the compatibilist explicitly rejects. The outcome of the debate is therefore properly characterized as a genuine dialectical stalemate between compatibilists and incompatibilists. In the final sections of the paper, I demonstrate that attempts by Fischer, Holliday and Fischer and Pendergraft to move beyond the stalemate in favor of the incompatibilist position all fail. I thereby show that the debate is marred by a misunderstanding of the semantics underlying the backtracking conditionals sometimes associated with the compatibilist position. In view of my arguments, the dialectical stalemate between compatibilists and incompatibilists regarding the counterfactual structure of the ability to do otherwise remains fully intact. (shrink)

A vernacular fifteenth-century sermon tells us, in order to warn of the threats to spiritual welfare posed by dance, that cyclic motion and centering of sensory impressions – amongst them intimate conversation – are essential elements of dance. When blending out the parenesis, implicit poetics of medieval dance can be distilled from that sermon. The way how these essential elements of dance are used for generating disruptions within literary plots will be demonstrated in three literary texts dating from the thirteenth (...) to the fifteenth century: Disruptions in connection with dance occur when contrary concepts of motion clash with each other, for example the linearity of the chivalrous way through the Other World with the cyclicity of round dances. ‚Der Württemberger‘, however, collides two contrary concepts of time which can be paraphrased as spatial metaphors, namely the linearity of earthly life which collides with the cyclicity of eternal damnation, a collision symbolized by the expulsion of life out of the dance of the death. Finally in ‚Ritter Sociabilis‘, dance generates a virtual space which subverts the courtly society. The protagonists of all these texts differently manage to resolve disruptions, namely by redemption, by repentance, or by continuing disruptions which they have caused themselves. (shrink)

We are at a time when international law and the law of war are particularly important. The testing of nuclear weapons that is being used in the rhetoric surrounding threats of war is creating new fears and heightening current tensions. Richard Falk has for decades been an outspoken authority calling for nuclear disarmament and the enforcement of non-proliferation treaties. In this collection of essays, Falk examines the global threats to all humanity posed by nuclear weapons. He is not satisfied with (...) accepting arms control measures as a managerial stopgap to these threats and seeks no less than to move the world back from the nuclear precipice and towards denuclearization. Falk's essays reflect the wisdom and innovative thinking he has brought to his long career as a scholar and activist, as he reminds nuclear weapons states of their obligation under international law and moral imperative to seek nuclear disarmament. Two questions are the starting point for the discussion contained in this article: (a) Does the future exist? (b) What is the future? A preliminary analysis of these questions leads to the conclusion that their solution needs to introduce three different principal modes of existence characterized for objects belonging to the time sphere of being. They are: real (actual) existence (i.e. existence of „now”), postreal existence (the past) and potential (prereal) existence. In accordance with this differentiation the answer to point (...) (a) is generally determined by the following theses: (1) The future exists in potentiality, (2) The future exists neither in reality nor in postreality. The notion of potential existence includes two categories of objects. The first one - objects which in fact will become real objects (present). They may be described as potential objects sensu stricto. The second category constists of the quasi-potential objects, that is the objects whose potentiality of becoming real (actual) ones will never come into existence. The differentiation of categories mentioned above makes possible to formulate three definitions of the future: (D1) The future is the domain of potential, or quasi-potential objects, (D2) The future is the domain of the potential objects, (D3) The future is the domain of quasi-potential objects. The definition (D3) is obviously inadequate, hence the solution of the problem, what is the future, may be reduced to the choice between definitions (D1) and (D2). The arguments of the paper convince us that the adequate definition of the future is the definition (D2). First - contrary to (D1) - it describes the future as ontologically homogeneous domain containing only objects which will become objects of the present and subsequently past objects. Second, when the future is defined by the competitive definition (D1) it is doubtful whether the language systems, referring to the time sphere of being, can fulfill the basic principles of the classical logig: the principle of contradiction and the principle of excluded middle. The main thesis of the paper is that change and time depend existentially on a specific property of being, described by the author as the Heraclitean unstability (i.e. a kind ofsusceptibility to non-existence). Change and time are, in substance, quite different aspects of being; but they are mutually connected: time cannot exist without occurence of changes; and vice versa. All these intuitions are logically reconstructed by the author.

Recently several educational theorists have argued for the incorporation of a scepticism of a postmodern kind into educational theory and into educational research more specifically. Their understanding of postmodernism in terms of scepticism harbours much potential, but to avoid confusion and misunderstanding it is of importance that the ‘scepticism’ associated with postmodernism is distinguished from traditional philosophical scepticism, be it as part of the very process of theoretical scrutiny or as a challenge towards its results. In this paper it will (...) be argued that the interest of postmodernist ‘scepticism’ lies not in a quest for ever more certainty but rather in the way it moves beyond both foundationalism and philosophical scepticism. This will be elaborated from the point of view of a Wittgensteinian understanding of theoretical scrutiny (as found in On Certainty). This opens up the possibility of shedding light on postmodernist ‘scepticism’ in educational theory in terms of an aesthetic distance towards what is reflected upon. (shrink)

The article uses embodiment and the experiential basis of conceptual metaphor to argue for the metaphorical essence of abstract legal thought.concepts like ‘law’ and ‘justice’ need to borrow from a spatial, bodily, or physical prototype in order to be conceptualised, seen, for example, in the fact that justice preferably is found ‘under’ law. Three conceptual categories of how law is conceptualised is examined: law as an object, law as a vertical relation, and law as an area. The Google Ngram Viewer, (...) based on the massive library of books that Google has scanned, has been used to study legally relevant conceptions over time within each of these three categories, from 1800 to 2000. In addition, the article suggests a type of analytical method of ‘metaphor triangulation,’ that is, the replacement of prevailing metaphors with unusual ones in order to increase the level of awareness of what conceptual content the prevailing metaphors involve. It is well known that Ernest Gellner made substantial use of his knowledge of the social sciences in philosophy. Here I discuss how he used it on the basis of a few examples taken from Gellner’s philosophical output. It is argued that he made a number of highly original “translations”, or re-interpretations, of philosophical theories and problems using his knowledge of the social sciences. While this method is endorsed, it is also argued that some of Gellner’s translations crossed the line (...) between the original and the idiosyncratic. (shrink)

The COVID-19 pandemic has already had an enormous impact on numerous aspects of human society such as health, education, economy, business, or work and created favorable conditions for the expansion of teleworking. The aim of the paper is to identify and analyze five teleworking impact factors that affect thewellbeing and productivity of employees. The data were gathered by a quantitative research method through a questionnaire applied to 327 Romanian employees who hold a Bachelor or Master degree. Firstly, they were analyzed (...) and interpreted through a factorial analysis focusing on the five teleworking impact factors. Secondly, the authors carried on cluster analysis, followed by multiple linear regression, using R statistical software. This study shows that there is a plethora of factors that influence the wellbeing and productivity of employees: individual and societal factors, organizational and work-related factors, technological factors, social factors at home, and social factors at work. Also, the cluster analysis brings to light significant differences between various Romanian employees such as: their gender, income, age, education, and city size. (shrink)
