A key factor that affects whether and at what age children can demonstrate an understanding of false belief and complement‐clause constructions is the type of task used (whether it is implicit/indirect or explicit/direct). In the current study, we investigate, in an implicit/indirect way, whether children understand that a story character's belief can be true or false, and whether this understanding affects children's choice of linguistic structure to describe the character's belief or to explain the character's belief‐based action. We also measured (...) children's understanding of false belief in explicit false‐belief tasks. English‐ and German‐speaking young 4‐ and 5‐year‐olds as well as English‐ and German‐speaking adult controls heard complement‐clause constructions in a story context where the belief mentioned in the complement clause (e.g., “He thinks thatshe's not feeling well”) turned out to be false, true, or was left open. After hearing the test question (“Why does he not play with her?”), all age groups were most likely to repeat the whole complement‐clause construction when the belief turned out to be false. That is, they tended to explicitly refer to the character's perspective and say “He thinks…” When the belief turned out to be true, participants often reverted to a simple clause (“She's not feeling well”). Furthermore, children with better short‐term memory were more likely to repeat the whole complement‐clause construction. However, children's performance in explicit false‐belief tasks showed no relation to their performance in our novel, more implicit/indirect, task. Whether or not the complement clause was introduced by athatcomplementizer only had a small effect on the German adults’ responses, where leaving out the complementizer also changes the word order of the complement clause. Overall, our results suggest that task characteristics and individual differences in short‐term memory affect children's ability to demonstrate false‐belief understanding and to express this understanding linguistically. Research that is integrated into ongoing clinical activities holds the potential to accelerate the generation of knowledge to improve the health of individuals and populations. Yet integrating research into clinical care presents difficult ethical and regulatory challenges, including how or whether to obtain informed consent. Multiple empirical studies have explored patients' and the public's attitudes toward approaches to consent for pragmatic research. Questions remain, however, about how to use the resulting empirical data in resolving normative and policy debates and what (...) kind of data warrants the most consideration. We recommend prioritizing data about what people consider acceptable with respect to consent for pragmatic research and data about people's informed, rather than initial, preferences on this subject. In addition, we advise caution regarding the weight given to majority viewpoints and identify circumstances when empirical data can be overridden. We argue that empirical data bolster normative arguments that alterations of consent should be the default in pragmatic research; waivers are appropriate only when the pragmatic research would otherwise be impracticable and has sufficiently high social value. In this chapter, Stephanie Collins examines the idea that individuals can acquire ‘membership duties’ as a result of being members of a group that itself bears duties. In particular, powerful and wealthy states are duty-bearing groups, and their citizens have derivative membership duties (for example, to contribute to putting right wrongs that have been done in the past by the group in question, and to increase the extent to which the group fulfils its duties). In addition, she argues, individuals (...) have duties to signal their willingness to coordinate with others so as to do more good than the sum of what each could do on their own. Putting these two things together, Collins suggests, individuals’ duties in (for instance) matters of global poverty might be largely driven by such group-based considerations, leaving little room for the duties that would follow from more individualistic reasoning. What sets someone on a life trajectory? This question is at the heart of studies of 21st-century neurosciences that build on scientific models developed over the last 150 years that attempt to link psychopathology risk and human development. Historically, this research has documented persistent effects of singular, negative life experiences on people’s subsequent development. More recently, studies have documented neuromolecular effects of early life adversity on life trajectories, resulting in models that frame lives as disproportionately affected by early negative experiences. (...) This view is dominant, despite little evidence of the stability of the presumably early-developed molecular traits and their potential effects on phenotypes. We argue that in the context of gaps in knowledge and the need for scientists to reason across molecular and phenotypic scales, as well as time spans that can extend beyond an individual’s life, specific interpretative frameworks shape the ways in which individual scientific findings are assessed. In the process, scientific reasoning oscillates between understandings of cellular homeostasis and organisms’ homeorhesis, or life trajectory. Biologist and historian François Jacob described this framework as the “attitude” that researchers bring to bear on their “objects” of study. Through an analysis of, first, historical and contemporary scientific literature and then ethnographic research with neuroscientists, we consider how early life trauma came to be associated with specific psychological and neurobiological effects grounded in understandings of life trajectories. We conclude with a consideration of the conceptual, ontological, and ethical implications of interpreting life trajectories as the result of the persistence of long-embodied biological traits, persistent life environments, or both. Engaging patients in research has come to be viewed as a vital component of high‐quality research, and funders now regard engaging patients and other stakeholders as a core criterion for funding decisions. In response, numerous empirical and conceptual papers have emerged to guide the process of engagement. However, as Emily Largent and colleagues rightly note, the inquiry of whom to engage has received less attention. While several teams have suggested that the selection of patients for engagement is an important consideration, (...) researchers generally have little guidance on how to undertake this process. To that end, Largent and colleagues offer an important contribution to the literature. I agree with their argument regarding the centrality of critically examining which patients to engage in research and with their recommendations to maximize the positive goals of patient engagement. Just over 20 years ago, molecular biologists Leonie Ringrose and Renato Paro published an article with a provocative title, “Remembering Silence”, in BioEssays. The article focused on how epigenetic elements could return to their silent state, operationally defined as their epigenetic status before their modulation by experimental or environmental factors. Though Ringrose and Paro's article was on fruit flies and factors affecting embryological growth, the article asked a question of considerable importance to rapidly expanding research in neuroepigenetics on the correlation (...) between trauma and neuropsychiatric risk: If you experience a traumatic event and, as a result, acquire an epigenetic trait that is considered pathological, can you free yourself of that trait? Ultimately, we are interested in how a return to silence is envisioned in neuroepigenetics research, how interventions purported to bring about that silence might function, and what this might mean for people who live in the aftermath of trauma. People who suffer brain damage to their ventromedial prefrontal cortex have a puzzling psychological profile: they seem to retain high intellect and practical reasoning skills after their brain injuries, but continually make poor decisions in many aspects of their lives. Adina Roskies argues that their behavior is explained by the fact that, although VM patients make correct judgments about what they ought to do, they are entirely unmotivated by those judgments. Roskies thus takes VM patients to be real-world counterexamples to (...) motivational internalism: the thesis that, necessarily, if S judges that she ought to φ in circumstances C, then S is somewhat motivated to φ in C. In this paper, however, I argue that the neuropsychological evidence that Roskies appeals to does not actually show that VM patients are entirely unmotivated by their normative judgments. Rather, I argue, the evidence suggests that VM patients form weaker normative judgments than normals during practical deliberation. And this affords the internalist with a plausible explanation for VM patients’ behavior: because VM patients form weaker normative judgments than normals, they are less motivated by their normative judgments than normals, which allows their decision-making to be overruled by their standing desires for greater and more immediate rewards. When making decisions on behalf of someone, is asking what they would have wanted a good way to respect their autonomy? Against prevalent assumptions, I argue that in decisions about the care and treatment of those with advanced dementia, the notion of ‘what one would have wanted’ is conceptually, epistemically, and practically problematic. The problem stems from the disparity between the first-person subjectivity of the past person and that of the present person. The transformative nature of dementia renders the very (...) meaning of ‘what the patient would have wanted’ problematic. When applied to those with advanced dementia, the subjunctive notion is either (i) incoherent, (ii) fundamentally indeterminate, or (iii) normatively irrelevant. (shrink)

This essay examines how disability interacts with gender in public discourse about sexual violence by investigating the ableist implications of two popular labels commonly applied to people who have experienced rape or sexual assault: survivors and liars. Using a rhetorical approach in conjunction with disability theory, I analyze how discourses of compulsory survivorship ask people who experience sexual assault to overcome disability and appear nondisabled, whereas rape‐hoax narratives frame others as mentally ill, mad, or irrational. Taken together, I argue, these (...) frameworks form a discursive paradox for people who experience sexual assault, specifically marking their mental fitness and placing them in a rhetorically impossible situation when attempting to disclose sexual assault. Demonstrating how these frameworks silence articulations of pain and the realities of mental illness that can result from sexual trauma brings debates about mental disability and pain more centrally into disability studies through a feminist lens. This paper applies a very traditional position within Natural Law Theory to Cyberspace. I shall first justify a Natural Law approach to Cyberspace by exploring the difficulties raised by the Internet to traditional principles of jurisprudence and the difficulties this presents for a Positive Law Theory account of legislation of Cyberspace. This will focus on issues relating to geography. I shall then explicate the paradigm of Natural Law accounts, the Treatise on Law, by Thomas Aquinas. From this account will emerge (...) the structure of law and the metaphysics of justice. I shall explore those aspects of Cyberspace which cause geography to be problematic for Positive Law Theory and show how these are essential, unavoidable and beneficial. I will then apply Aquinas’s structure of law and metaphysics of justice to these characteristics. From this will emerge an alternative approach to cyberlaw which has no problem with the nature of Cyberspace as it is but treats it as a positive foundation for new legal developments. (shrink)

Beyond a mere rejection of its form, the author uses the specific context of Mali to shed light on the flexibility and capacity for adaptation of community initiatives undertaken in the field of non-formal education, such as the (...) REFLECT approach, which is directly inspired by the learners' immediate environment. This approach serves as an illustration of certain methods of encountering otherness, the other in their individuality, and acts as a starting point for (re) thinking the education for excluded and highly vulnerable populations. In order to explain the idea that sacrifice involves voluntary diminution of the agent’s well-being, “well-being” must be explained. The thesis that an agent’s well-being just consists in the occurrence of events wanted is rejected. Overvold replaces it by the view that the motivating desires involve the existence of the agent, alive, at the time of their satisfaction. This view seems counterintuitive. The whole desire-satisfaction theory is to be rejected partly because we dont’t think an event worthwile if it is (...) not liked when it occurs, and partly because the theory cannot give a sensible account of what is good for an individual when his desires change. A more satisfactory view is that the goodness of an event for a person is fixed by his total gratifications as a result of its occurrence, provided they would occur if the person were fully informed about facts knowledge of which would change them if it existed. But self-sacrifice seems to involve not only voluntary diminution of well-being in this sense, but belief that the action is taken for the benefit of someone else. Overvold’s view leaves open the possibility that acting morally is never contrary to self-interest, if one of the agent’s major interests is that he act morally. This is an ingenious suggestion, but seems a bit counterintuitive. (shrink)

We apply Carol Gilligan's distinction between a "male" mode of moral reasoning, focussed on justice, and a "female" mode, focussed on caring, to the reading of literature. Martha Nussbaum suggests that certain novels are works of moral philosophy. We argue that what Nussbaum sees as the special ethical contribution of such novels is in fact training in the stereotypically female mode of moral concern. We show this kind of training is appropriate to all readers of these novels, not just to (...) women. Finally, we explore what else is involved in distinctively feminist readings of traditional novels. (shrink)

The reason for the lexical transformation of classical Latin auctor and auctoritas into Neo-Latin author and authoritas has remained obscure outside of specialist literature. This note offers a consolidated account of the matter in English. Based on a minor misreading of Priscian’s Institutiones grammaticae by glossators active at the turn of the thirteenth century, a back-formation of Latin author by analogy with Greek αὐθέντης and αὐθεντία was proposed by humanist scholars in the sixteenth century. Once introduced, the Neo-Latin fricative th (...) dropped out or was never fully adopted into any of the European vernaculars except English, where it nonetheless survives in ‘author’ and its derivatives today. Background Standard interpretations of the ethical principle of respect for persons have not incorporated the views and values of patients, especially patients from groups underrepresented in research. This limits the ability of research ethics scholarship, guidance, and oversight to support inclusive, patient-centered research. This study aimed to identify the practical approaches that patients in community-based settings value most for conveying respect in genomics research. Methods We conducted a 3-round, web-based survey using the modified Delphi technique to identify areas of agreement (...) among English-speaking patients at primary care clinics in Washington State and Idaho who had a personal or family history of cancer. In Round 1, respondents rated the importance of 17 items, identified in prior qualitative work, for feeling respected. In Round 2, respondents re-rated each item after reviewing overall group ratings. In Round 3, respondents ranked a subset of the 8 most highly rated items. We calculated each item’s mean and median rankings in Round 3 to identify which approaches were most important for feeling respected in research. Results Forty-one patients consented to the survey, 21 (51%) completed Round 1, and 18 (86% of Round 1) completed each of Rounds 2 and 3. Two sets of rankings were excluded from analysis as speed of response suggested they had not completed the Round 3 ranking task. Respondents prioritized provision of study information to support decision-making (mean ranking 2.6 out of 8; median ranking 1.5) and interactions with research staff characterized by kindness, patience, and a lack of judgment (mean ranking 2.8; median ranking 2) as the most important approaches for conveying respect. Conclusions Informed consent and interpersonal interactions are key ways that research participants experience respect. These can be supported by other approaches to respecting participants, especially when consent and/or direct interactions are infeasible. Future work should continue to engage with patients in community-based settings to identify best practices for research without consent and examine unique perspectives across clinical and demographic groups in different types of research. The Saṁhitā Upaniṣad [SU] is a little-known Vedic text that presents ‘typical’ Upaniṣadic teachings on the truth of identity alongside seemingly out-of-place descriptions of rites used to protect oneself against enemies and even against death. The difference between these contents is striking, but what it has to tell us about the SU’s main concerns is vulnerable to historical and text critical methods that rely on structure, style, and linguistic archaism to divide texts into discrete strata. What if the modern text (...) critical practice of individually identifying and classifying textual contents obscures the use and meaning of the word saṁhitā in the SU? Is it possible that the SU’s diverse contents are intrinsically related? This article explores these questions through a close examination of a sequence of passages illustrating the contrast that has led previous scholars to see the SU as miscellaneous in character and lacking internal coherence. Through this examination, I identify a wider context for saṁhitā in the specific relationship the SU depicts between the person and speech. I argue that the SU’s treatment of saṁhitā draws upon an understanding of recitation in the perspective of one’s vulnerability and the dynamics involved in developments of personhood. These findings allow the SU to emerge as an intriguing and coherent text that merits closer examination and establishes a promising approach for the study of the R̥gvedic Āraṇyakas. (shrink)

Brandt (bio) and Lara Freidenfelds (bio)Human subjects research in the United States has only recently emerged as an important area of historical investigation. Over the last quarter century, scholars have begun the process of grounding within an historical context both the complex relationship between researchers and subjects and the processes by which biomedical knowledge is produced. (...) Their studies examine topics ranging from the impact of the anti-vivisectionist movement on human experimentation in the early twentieth century (Lederer 1995) to the development of the discipline of bioethics in the 1960s and 1970s (Rothman 1991) and the emergence of the legal concept of informed consent for human research (Katz, Glass, and Capron 1972). Many of the discussions focus on isolated incidents of scandal, such as the Tuskegee Syphilis Study (Jones 1993; Brandt 1978) and the Willowbrook School hepatitis study (Rothman and Rothman 1984). In doing so, they attempt to explain how such clearly unethical research could have been initiated and what consequences have resulted from public knowledge of such research.Nonetheless, the broader historical contexts and implications of human subjects research have yet to be fully delineated. This project will be of crucial importance, not only for historians, but also for those concerned with research policy and medical ethics. The historical examination of human subjects research will provide further insight into the details of research methods, the construction of protocols, and the historically specific interest in certain diseases. In addition, scholars will better understand the relationships of power and authority between researcher and subject, as well as the social and scientific mechanisms for the production of new biomedical knowledge. The process of enlisting research subjects illuminates the significance of class, gender, ethnicity, and race in science, in biomedicine, and in society. The fact that, historically, much research has employed research subjects from vulnerable populations, who participated in coercive contexts, has exposed powerful social assumptions embedded in the research enterprise. One of the most important achievements of the Advisory Committee on Human Radiation Experiments was the uncovering of thousands of documents, a remarkable mine of archival data, that had been previously inaccessible to researchers. Jonathan Moreno and Susan Lederer’s article on the history of Cold War research ethics in this issue of the Kennedy Institute ofEthics Journal represents the first attempt since the publication of the Committee’s Final Report to analyze the Committee’s findings in a serious historical context.Historical accounts of the emergence of bioethics traditionally have left a great void in their discussions of human experimentation, generally ignoring the period between the writing of the Nuremberg Code in 1947 and the publication of Henry Beecher’s 1966 New England Journal ofMedicine article condemning systematic, unethical practices in human experimentation (Rothman 1991). The period from 1946 to 1966, however, was a time of vigorous research characterized by a fragmented community of medical researchers who applied inconsistent ethical standards and employed highly variable research practices. Both military and civilian medical researchers were intensely interested in radiation and thus conducted human subjects research along those lines, including examinations of the effects of plutonium injections and of total body irradiation, the use of trace radioisotopes to study various body processes, and observations of the effects of radiation intentionally released into the environment. The U.S. Government sponsored several thousand such studies (ACHRE 1995 [GPO, pp. 227–31; Oxford, pp. 135–38]), some of which were conducted on hospital patients, institutionalized children, military personnel, and prisoners. It has been claimed that a broad attentional breadth buffers the impact of negative stimuli on human perception and cognition. Here we identify issues with the research on which this claim is based, and then rigorously test the claim. To induce narrow versus broad attentional breadth participants attended to the local versus global elements of Navon stimuli, and to investigate the impact of emotionally salient stimuli on performance we measured the effect of task-irrelevant stimuli of varying emotional salience (negative, neutral, (...) or positive) on task performance. Across a series of experiments, we found that the Navon stimuli were effective in inducing different attentional breadths, and that both negative and positive task-irrelevant stimuli slowed responses relative to neutral stimuli, but that the magnitude of this emotion-induced slowing was invariant to whether attentional breadth was broad or narrow. This indicates that a broad attentional breadth did not buffer against the effect of either negative or positive emotionally salient stimuli. These results challenge the claim the broadening attentional breadth protects against the impact of emotionally salient stimuli. (shrink)

Sometimes referred to as "the last taboo," money has remained something of a secret within psychoanalysis. Ironically, while it is an ingredient in almost every encounter between analyst and patient, the analyst's personal feelings about money are rarely discussed openly or in any great depth. So what is it about money that relegates it to the background, both on the couch and off? In _Money Talks_, Brenda Berger, Stephanie Newman, and their excellent cast of contributors address this and other (...) questions surrounding the tender topic of money, how we talk about it, and how it talks to us. Its multiple meanings are explored in the contexts of patients and analysts and the ways in which they relate, in the training and practice of the analysts themselves, as well as the psychological and cultural consequences of having too much or too little in both flush and tight economic times. Throughout, a clinical sensibility is brought to bear on money's softly spoken place in therapy and life. _Money Talks_ paves the way for an open discourse into the psychology of money and its pervasive influence on the psyche of both patient and analyst. This paper examines a model of decision-making within the context of current and emerging regimes of accountability being proposed and implemented for school systems in a number of jurisdictions. These approaches to accountability typically involve the use of various measurable student learning outcomes as well as other measures of performance to do with teachers and schools in general, often having high-stakes consequences. Given this context of performativity, the paper proposes a model that uses an objective knowledge growth framework, where teachers (...) can engage in their own professional learning through defined structures for solving the problems of their professional practice. The model is both empowering for teachers while being sensitive to the constraints of cultures of performativity. (shrink)

The conflicts of interest that may arise in relationships between academic researchers and industry continue to prompt controversy. The bulk of attention has focused on financial aspects of these relationships, but conflicts may also arise in the legal obligations that faculty acquire through consulting contracts. However, oversight of faculty members' consulting agreements is far less vigorous than for financial conflicts, creating the potential for faculty to knowingly or unwittingly contract away important rights and freedoms. Increased regulation could prevent this, but (...) it is unclear what forms of oversight universities view as feasible and effective. In this article, we report on a Delphi study to evaluate several approaches for oversight of consulting agreements by medical schools. The panel was comprised of 11 senior administrators with responsibility for oversight of faculty consulting relationships. We found broad agreement among panelists regarding the importance of institutional oversight to protect universities' interests. There was strong support for two specific approaches: providing educational resources to faculty and submitting consulting agreements for institutional review. Notwithstanding the complexities of asserting authority to regulate private consulting agreements between faculty members and companies, medical school administrators reached consensus that several approaches to improving institutional oversight are feasible and useful.
