This paper applies a very traditional position within Natural Law Theory to Cyberspace. I shall first justify a Natural Law approach to Cyberspace by exploring the difficulties raised by the Internet to traditional principles of jurisprudence and the difficulties this presents for a Positive Law Theory account of legislation of Cyberspace. This will focus on issues relating to geography. I shall then explicate the paradigm of Natural Law accounts, the Treatise on Law, by Thomas Aquinas. From this account will emerge (...) the structure of law and the metaphysics of justice. I shall explore those aspects of Cyberspace which cause geography to be problematic for Positive Law Theory and show how these are essential, unavoidable and beneficial. I will then apply Aquinas’s structure of law and metaphysics of justice to these characteristics. From this will emerge an alternative approach to cyberlaw which has no problem with the nature of Cyberspace as it is but treats it as a positive foundation for new legal developments. (shrink)

Richard Brandt is one of the most influential moral philosophers of the second half of the twentieth century. He is especially important in the field of ethics for his lucid and systematic exposition of utilitarianism. This new book represents in some ways a summation of his views and includes many useful applications of his theory. The focus of the book is how value judgments and moral belief can be justified. Richard Brandt is one of the most eminent and influential of contemporary moral philosophers. His work has been concerned with how to justify what is good or right not by reliance on intuitions or theories about what moral words mean but by the explanation of moral psychology and the description of what it is to value something, or to think it immoral. His approach thus stands in marked contrast to the influential theories of John Rawls. The essays reprinted in (...) this collection span a period of almost 30 years and include many classic pieces in metaethical and normative ethical theory. The collection is aimed at both those moral philosophers familiar with Brandt's work and at those philosophers who may be largely unfamiliar with his work. Many social scientists and philosophers have counted themselves moral relativists in some sense or other. We cannot deal with all the various views which are properly called forms of “moral relativism”; so I propose to explain a form of moral relativism which seems to me an interesting, and somewhat plausible theory. This theory comprises the following three affirmations: The basic moral principles of different individuals or groups sometimes are, or can be, in some important sense conflicting. When there is such (...) fundamental conflict of basic principles or standards, there is either always, or at least sometimes, no way to show that one view is better justified even in the presence of ideally complete factual information; in that sense the principles are equally justified or “valid.” But there is a sense in which a particular moral belief may be mistaken or unjustified, if it is a misapplication of the basic principles of the individual or group, e.g., if the basic principles plus statements of known or knowable facts entail a moral proposition incompatible with it. As stated, moral relativism could be true even though in fact, accidentally, all individuals agree in their basic moral principles. (shrink)

I argue for an account of know‐how as a capacity for practical judgment—a view I derive from Gilbert Ryle. I begin by offering an interpretation of Ryle and by correcting a number of widespread misconceptions about his views in the current debate. I then identify some problems with Ryle's account and finally present my own view which, I argue, retains Ryle's insights while avoiding his mistakes.

Kant's ethics do not include a discussion of justice as a specific virtue, and the "Metaphysical First Principles of the Doctrine of Right" appear to deal only with private and public law, but not with justice. In fact, Kant's ethics in the three Critiques and later relevant writings is dependent on God's iustitia distributiva as the highest good and the institution of the state is labelled as "public justice". This article attempts to explain this connection and to provide a contribution (...) to the topic of Kantian justice. The Epilogue to this article discusses a letter dated November 6, 1790, which Kant wrote in one of his official capacities at the University of Königsberg and which as of yet has remained unpublished. Innerhalb der Kantischen Ethik wird die Gerechtigkeit nicht als besondere Tugend erörtert, und die "Metaphysischen Anfangsgründe der Rechtslehre" scheinen nur vom privaten und öffentlichen Recht, nicht jedoch von der Gerechtigkeit zu handeln. Tatsächlich ist die Ethik in den drei Kritiken und den späteren einschlägigen Schriften auf eine iustitia distributiva Gottes als höchstem Gut angewiesen, und die rechtliche Institution des Staates wird als "öffentliche Gerechtigkeit" bezeichnet. Søren Kierkegaard is well-known as an original philosophical thinker, but less known is his reliance upon and development of the Christian tradition of the Seven Deadly Sins, in particular the vice of acedia, or sloth. As acedia has enjoyed renewed interest in the past century or so, commentators have attempted to pin down one or another Kierkegaardian concept (e.g., despair, heavy-mindedness, boredom, etc.) as the embodiment of the vice, but these attempts have yet to achieve any consensus. In our estimation, (...) the complicated reality is that, in using slightly different but related concepts, Kierkegaard is providing a unique look at acedia as it manifests differently at different stages on life’s way. Thus, on this “perspectival account”, acedia will manifest differently according to whether an individual inhabits the aesthetic, ethical, or religious sphere. We propose two axes for this perspectival account. Such descriptions of how acedia manifests make up the first, phenomenal axis, while the second, evaluative axis, accounts for the various bits of advice and wisdom we read in the diagnoses of acedia from one Kierkegaardian pseudonym to another. Our aim is to show that Kierkegaard was not only familiar with the concept of acedia, but his contributions helped to develop and extend the tradition. (shrink)

In this paper, the concept of Human-Centred Technology will be described with regard to the different dimensions of workplace, groupwork and networks and in terms of the frameworks of both society and the natural environment. These different aspects of Human-Centred Systems will be illustrated by a series of case studies representing several European countries. The report covers a wide range of research fields. The emphasis is on technology: the roles of control and information technology in enterprises today — including issues (...) of applying AI — and the strategies of designing and implementing technology taking into account the specific aspects which characterize human-centred systems.
