This paper explores the constructed nature of legal complaints through the adoption of a socio-linguistic model with an emphasis upon pragmatics and elements of conversation analysis. When making a legal complaint, we posit that there is a conflict between effective communication and the uptake of politeness strategies. Furthermore, how complaints are ‘worked up’ in situ is a product of the arena in which such complaints are made. Through a textual analysis of the methods of complaining adopted by those who make (...) representations to the licensing authority, for the purposes of objecting to a licence application, we show the tension between making oneself clear and being polite, and how complaints in different settings take different forms. We conclude by exploring the implications of our findings for legal processes—is it reasonable, for instance, to talk of ‘consistency’ in testimony if each complaint is worked up in situ—and for pragmatic theory more generally, i.e the applicability of Brown and Levinson’s politeness model for legal processes. Still, the volume benefits tremendously from an apparent and unusual amount of editorial attention that sequences the essays and interrelates them with useful references to one another in such a way that Democracy, Culture, Catholicism escapes entirely the fate of so many volumes of collected essays. Here, the reader has the sensation of reading one coherent narrative, not twenty-three disparately connected, individual essays. This alone is impressive.The volume possesses other strengths. Reflections emerge throughout that engage the deeper questions of democracy. Who are these people making decisions together? How can we understand the composition of a political community? Too much democratic theory overlooks the complex interweaving of history, memory, and identity that operates like a substrate of our consciousness beneath our reason while we are presuming ourselves to be rational decision makers using democratic procedures. The book's engagement not just with democracy and Catholicism but also with culture is important. These essays treat culture not only in different local expressions but also (and in a way that is deep, serious, and sustained) as a phenomenon of consciousness.The American perspective always lurks in the narrative, threatening to dominate. This is inevitable not only because the project was managed in the United States but also because the polarizing obsessions of the church in the United States about how to acknowledge the norms of modern political arrangements have tended to dominate conversation in the church worldwide. The editors have shrewdly chosen to save the United States for the last part of this volume, allowing other voices to come forward first to claim their own space. This editorial decision, like so many others, improves the volume and keeps the narrative in good balance. Still, some questions linger in this reviewer's mind as the volume concludes.What do we mean by democracy? Throughout, the authors treat this as a question that is largely settled. Democracy is identified with democratic values that the church accepts, and in Schuck's words, what is under way is "a critical conversation with the culture of democracy" (330). Yet procedural democracy cannot be severed from these values. Are democratic norms and values vindicated when majorities choose undemocratic values? A more careful drawing of distinctions between democracy, liberalism, and republicanism would expose the inner conflicts in which Catholicism meets modern political norms.Perhaps most urgently for the subject matter of this book, are the claims of Catholic social teaching and Christian ethics a foundation for the democratic, participatory values of this secular age, as writers like Charles Taylor and David [End Page 209] Walsh have suggested? Very close analysis of Baruch Spinoza's wording in describing individuals rather than things. Individuals, but not collections such as a political state or club, each have their own specific conatus, or essence. Collectivities, like nations or institutions, fail to meet this necessary condition of individuation.

The view that quantum particles cannot be regarded as individuals was articulated in the early days of the 'quantum revolution' and became so well-entrenched that French and Krause called it 'the Received View'. However it was subsequently shown that quantum statistics is in fact compatible with a metaphysics of particle individuality, subject to certain caveats. As a consequent it has been claim that there exists a kind of underdetermination of the metaphysics by the physics which in turn has been used (...) to motivate a form of 'notice' structural realism. In this essay I will review this purported underdetermination and the motivation for structural realism that it purportedly provides in the context of recent developments in both the philosophy of physics and metaphysics. I aim to conclude that such developments reinforce the underdetermination and allow one to respond to certain critical concerns regarding its motivational power. (shrink)

In a previous article in _Philosophia, I claim that one can be a metaphysical relativist without being a truth relativist. One premise my argument for this claim relies on is (R2) truth relativism is inconsistent with the deflationary theory of truth. Peter Davson-Galle criticizes my argument for (R2), and also argues directly for the falsity of (R2). I try to show that Davson-Galle's effort to undermine (R2) founders due to his blurring the distinction between a taxonomy or classification system on (...) the one hand, and on the other, a conceptual framework in the sense use by truth relativists. What was once a value that united Americans has become so politicized by both the left and the right that it threatens to rip apart the social fabric. On the right, patriotism has become synonymous with nationalism and an “us versus them” worldview, while on the left it is seen as an impediment to acknowledging important ethnic, religious, or racial identities and a threat to cosmopolitan globalism. Steven B. Smith reclaims patriotism from these extremist positions and advocates for a patriotism that is broad enough to balance loyalty to country with other loyalties. Describing how it is a matter of both the head and the heart, Smith shows how patriotism can bring the country together around the highest ideals of equality and is a central and ennobling disposition that democratic societies cannot afford to do without. Despite its long history, there is no agreed-upon conception of emergence. One might claim that a common idea of emergence seems to be that something termed a "system" gives rise to, or possesses, characteristics termed "properties," which latter are absent or unmanifested in whatever individual components the system consists and are thus "emergent" from the system itself. However, types of systems discussed run a gamut from purely mental entities to simple tools . "Properties" is similarly unconstrained . The so-called special (...) sciences, such as biology, psychology, sociology, and even chemistry have all claimed some properties as emergent. However, the enormous literature dealing with various types of systems characterized as emergent can be divided, roughly speaking, into two classes of descriptions of emergence. One might be termed "structural" and the other "functional." The first characterizes emergent systems in terms of their components and their interrelationships , while the second characterizes them in terms of their effects on other systems or elements . There is generally no mention of possible internal structures of the system in the latter, and if there is, it is in vague and/or abstract terms, while the former emphasizes internal structures over clear characterizations of the effects of emergence. Thus, a conception of emergence like Kim's is functional, while explicit descriptions of small-world networks, chaotic systems, or other types of complex internal organizations in mathematics, physics, and computer science are structural. The structuralfunctional distinction will play a part in the analysis of emergence later in this paper. (shrink)

At first glance, it is surprising that contemporary racist organizations like the Ku Klux Klan advertise a pro‐environmental stance. This fact, however, might be expected by Luc Ferry, who argues for a connection between the racism and nature protection laws of the Third Reich. Ferry argues that a non‐anthropocentric approach to nature makes it easier to dehumanize humans so that a non‐anthropocentric environmental ethic can transform into racist environmentalism. Does this contemporary case vindicate Ferry? We argue that it does not. (...) When the underlying theoretical foundations and historical conditions that gave rise to the racist environmentalist movements and the contemporary non‐anthropocentric environmental left are analyzed, quite different pictures emerge: one type of non‐anthropocentric environmentalism is racist, one type of anthropocentric environmentalism is racist, and one type of non‐anthropocentric environmentalism is not racist, meaning that any relation between a non‐anthropocentric approach to nature and dehumanizing the Other is more complex and historically contextual than Ferry allows. These brief reflections extend the discussion of Louis H. Swartz review essay “Reflections on Shils, Sacred and Civil Ties, and Universities.” I note the influence Shils and Polanyi had upon one another and comment on issues related to Shils’s thought which Swartz raises in connection with material in three recent, posthumously published volumes of Shils’s writings.

Most evidence for the role of regular inflection as a default operation comes from languages that confound the morphological properties of regular and irregular forms with their phonological characteristics. For instance, regular plurals tend to faithfully preserve the base’s phonology, whereas irregular nouns tend to alter it. The distinction between regular and irregular inflection may thus be an epiphenomenon of phonological faithfulness. In Hebrew noun inflection, however, morphological regularity and phonological faithfulness can be distinguished: Nouns whose stems change in the (...) plural may take either a regular or an irregular suffix, and nouns whose stems are preserved in the plural may take either a regular or an irregular suffix. We use this dissociation to examine two hallmarks of default inflection: its lack of dependence on analogies from similar regular nouns, and its application to nonroots such as names. We show that these hallmarks of regularity may be found whether or not the plural form preserves the stem faithfully: People apply the regular suffix to novel nouns that don’t resemble existing nouns, and to names that sound like irregular nouns, regardless of whether the stem is ordinarily preserved in the plural of that family of nouns. Moreover, when they pluralize names, they do not apply the stem changes that are found in their homophonous nouns, replicating an effect found in English and German. These findings show that the distinction between regular and irregular phenomena cannot be reduced to differences in the kinds of phonological changes associated with those phenomena in English. Instead, regularity and irregularity must be distinguished in terms of the kinds of mental computations that effect them: symbolic operations versus memorized idiosyncrasies. A corollary is that complex words are not generally dichotomizable as “regular” or “irregular”; different aspects of a word may be regular or irregular depending on whether they violate the rule for that aspect and hence must be stored in memory.. Language comes so naturally to us that we are apt to forget what a strange and miraculous gift it is. Over the next hour you will sit in your chairs listening to a man make noise as he exhales. Why would you do such a thing? Not because the sounds are particularly melodious, but because the sounds convey information in the exact sequence of hisses and hums and squeaks and pops. As you recover the information, you think the thoughts that (...) I want you to think. Right now I am conveying ideas about language itself, but with a slightly different sequence of hisses and pops I could be talking about anything from theories of the origin of the universe to the latest plot twists in your favorite daytime drama. The fundamental scientific problem raised by language is to explain this vast expressive power. What is the trick behind our ability to fill each other’s heads with so many kinds of thoughts? The present paper complements the publications of Gerard L'E. Turner on Mercator's astrolabes by presenting an account of an astrological disc which Mercator published at Louvain in May 1551. This instrument, of which only one copy is known, is described, and a transcription of its instruction sheet, with commentary and English translation, is provided. My preliminary study of the astrological content and context of the instrument indicates that it is connected with John Dee's astrological studies at Louvain from 1548 to (...) 1550. The didactic functions of the instrument are discussed, as well as the relationship between astrological theory and practice in Mercator's work. (shrink)

Facing a near-death experience naturally pushes people to re-examine their basic moral values. During the recent global economic melt-down, calls to solve the concomitant ‘moral’ crisis come in from all fronts. The presumption is that we need business ethics courses to teach our business students to learn to take the moral high-road; we need ethics pledges and codes of ethics to teach business students to do the right thing. But in reality, what impact can a business ethics class have on (...) business people in the real world of tough choices and intense competition? It is my contention that if we look at the teaching of business ethics from the traditional Foundational Platonic perspective, we over-promise and under-deliver. By contrast, a Post- Foundational perspective gives us a pragmatic and viable picture of business ethics pedagogy that can make a real difference. (shrink)

Confirmation functions are generally thought of as probability functions. The well known difficulties associated with the probabilistic confirmation functions proposed to date indicate that functions other than probability functions should be investigated for the purpose of developing an adequate basis for confirmation theory. This paper deals with one such function, the likelihood function. First, it is argued here that likelihood is not a probability function. Second, a proof is given that, in the limit, likelihood can be used to determine which (...) of two observationally distinct hypotheses is true. Finally, a demonstration is given that, in the presence of a finite amount of experimental information, likelihood can serve as a good estimator of truth. (shrink)

Suite à ces publications, certains experts en théorie des jeux ont contesté l’idée voulant que le dilemme du prisonnier soit un cadre approprié (...) pour réfléchir sur la théorie morale. La première partie de cet article examine les rôles du dilemme du prisonnier dans l’œuvre de Gauthier. La deuxième partie présente un projet, incluant des composantes descriptives et normatives, qui développe les idées de «Morality and Advantage» tout en le préservant de la critique des théoriciens des jeux. Two distinct problems of objectivity in moral theory are that of reference and truth and that of justification. These questions are often run together. However, it is possible to discuss the two questions separately. A defense is offered of moral ascriptions and moral properties, in opposition to the proposals of Mackie and Harman. But the thin or minimal defense of moral ascriptions leaves the second problem of objectivity unaddressed. Further argumentation leads to a proposal that claims limited moral objectivity.

Many philosophers argue that is morally objectionable in principle to punish people in order to deter others from committing crimes. Such punishment is said to treat the offender simply as a means to benefit others. This Kantian argument rests on a certain reading of the Formula of Humanity. However, the central concept in that formula is not ‘treating a person simply as a means’, but rather ‘treating a person as an end’. This conclusion speaks against the moral principle that Victor (...) Tadros uses to support his non-consequentialist theory of punishment. Furthermore, a plausible way of interpreting the injunction to treat people as ends—Rawls’ original position—does not rule out seeking deterrence. Therefore, Kantianism and consequentialism do not differ in a fundamental way on the permissibility of deterrence. But Rawls’ Kantianism sets an implausible ceiling on the severity of punishments, and consequentialism does not. (shrink)

Central to Descartes’ philosophy is a view about immutable essences and eternal truths. After mentioning a Platonist account of recollection in Meditation V, Descartes declares that the ideas we have of mathematical notions “are not my invention but have their own true and immutable natures” (AT VII, 64/CSM II, 44).Descartes claims that other important philosophical notions, such as God, mind, body, and human free will (AT VII, 68; AT VIII-2, 348; AT III, 383; AT VII, 433, respectively), also have immutable (...) natures or essences. Although Descartes says a good many things about this view, nowhere does he offer definitive doctrine on the matter, and in fact frequently confuses his reader with apparently inconsistent pronouncements about immutable natures and eternal truths. In this essay, I focus on the immutable natures and propose a solution to two of the main problems associated with Descartes’ position, the metaphysical status of immutable natures and the purported indivisibility of their existence as ideas in the mind.
