Lady Lovelace’s notes on Babbage’s Analytical Engine never refer to the concept of surprise. Having some pretension to ‘originate’ something—unlike the Analytical Engine—is neither necessary nor sufficient to being able to surprise someone. Turing nevertheless translates Lovelace’s ‘this machine is incapable of originating something’ in terms of a hypothetical ‘computers cannot take us by surprise’ objection to the idea that machines may be deemed capable of thinking. To understand the contemporary significance of what is missed in Turing’s ‘surprise’ translation of (...) Lovelace’s insight, one needs to distinguish between trivial surprises and those events, propositions or encounters that lead us to question our understanding of ourselves or what surrounds us. Only some of these non-trivial surprises are the product of originality endeavours. Not only is it uncommon for surprises to track such endeavours, the type of autonomy that would be required on the part of ‘digital computers’ for originality and surprise to intersect in that way goes far beyond the operational autonomy that can be achieved by ‘learning machines’. This paper argues that a salient translation of Lovelace’s originality insight—for contemporary and future ‘learning machines’—is an upside-down version of Turing’s surprise question: can computers be surprised by us in a non-trivial, ‘co-produced’ way? This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. It delves into the Kantian duty to enter a rightful condition beyond the state and shows that a proper understanding of this duty not only leads us to acknowledge a duty of right to assist states that are unable to fulfil the core functions of a state, (...) but also provides valuable hints at what just transnational trade relations and a just regulation of immigration should look like. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

The article revisits the idea that writing may be gendered and asks whether we can define what a “woman writing” practice might be. We do this through a comparative study of the work of Julia Kristeva and Judith Butler. Both have expressed reservations about, even objected to, the essentializing of gender and therefore of writing as a woman. They have, however, provided us with useful tools to define what a non-essentialist understanding of “woman” might entail. The article proposes to do (...) three things: first, to look at the way each author presents “woman” and what I term “woman writing” in their work; second, to find, beyond epistemic differences, the common grounds shared by the two authors; and third, to clarify the places where the two disagree. In a concluding part, we will highlight how that disagreement is reconciled in revisiting Kristeva’s and Butler’s use of loss in their apprehension of “woman,” allowing us to formulate a non-essentialist definition of “woman writing.”. Some studies report that the sport context increases the risk of exposure to sexual violence for athletes. In contrast, others indicate a protective effect of sport participation against sexual violence, particularly among varsity athletes. Studies of sexual violence towards varsity athletes are limited by their failure to include control groups and various known risk factors such as age, graduate level, gender and sexual identity, disability status, international and Indigenous student status, and childhood sexual abuse. The purpose of the present study (...) is to fill in these gaps to determine whether varsity athletes are at greater risk than non-athletes of sexual violence towards them or whether, on the contrary, involvement in a varsity sport is coherent with the Sport Protection Hypothesis. Data for this article come from the ESSIMU study, a broad survey of students, professors, and other employees at six francophone universities regarding sexual violence on university campuses. A total of 6,485 students with complete data on sexual violence, athlete status, and gender were included in the study. From this total, 267 participants identified themselves as varsity athletes. Data were analyzed using a series of logistic regressions on each form of violence using athlete status as a predictor and characteristics associated with sexual violence victimization or distinguishing between varsity athletes and non-athletes as confounding variables. When considering all confounding variables in the regression analyses on four yearly incidence rates of sexual violence, the results revealed that being a varsity athlete did not significantly increase the risk of exposure to sexual violence at university. All considered other variables were more significant predictors of the past year’s risk of sexual violence victimization than athlete status was. (shrink)

On the basis of a comparative analysis of Hugo Grotius and Immanuel Kant, it shows how different the meaning of this idea can be within a theory of property or territory. The first part is devoted to Grotius’s account of why and how the institution of property was progressively introduced. It highlights the (...) importance this account attaches to the intention of the first distributors for a good understanding of property laws, and in particular, for an understanding of their non-application in situations of extreme necessity. The second part takes the opposite path and shows that although Kant rejects the very existence of a right of necessity, the idea that one might be liberated from a law is not completely absent from, and even plays a crucial role in, his account of property. Clarification of this role ultimately leads us back to the idea of original possession in common of the Earth. (shrink)

This article offers a critical reading of what Julia Kristeva calls ‘woman’s primary homosexuality’ and discusses homophobia in Kristeva’s work. If we are to draw conclusions on the merits and limitations of Kristeva’s theories of sexuality, homophobia needs to be assessed within the aesthetic and ethical contexts that typify Kristeva’s overall oeuvre. The article shows that we can apply Kristeva’s semiotic/symbolic model of signification to sexuality and argues for the construction of ‘primary homosexuality’ as the manifestation of resistance to authorized (...) sexual identity. The article also shows why the political demands to recognize lesbianism as a valid form of sexuality and especially as an intelligible lifestyle go against Kristeva’s understanding of what resistance entails. Escamotée par le discours convenu développé dans la tradition romanesque des Guerres de l’Indépendance nationale entre 1850 et 1950, émerge la version très progressiste du projet anticolonial et républicain adossé à l’organisation des pratiques civiques, comme forme précoce d’éducation populaire et révolutionnaire par un peuple insurgé qui lutte pour s’extraire d’un système colonialiste et pour en modifier les rapports sociaux. Ce propos et (...) ce projet seront balayés par le régime établi en 1902, mais il n’est pas infondé de voir se dessiner dans cet imaginaire et cette mémoire la continuité avec les mouvements révolutionnaires cubains du xx e siècle. While philosophical debates about the ethical dimension of cinema have flourished over the last few decades, discussions of cinema and virtues are still limited. And, even if virtues are explored with regard to film, humility is not often the most obvious virtue that comes to mind. As this article argues, this might in part be due to humility’s lack of expressive action and its tendency to remain in the background. In addition, the wide range of philosophical views on what actually (...) counts as virtuous humility, if it is to be considered a virtue at all, further problematises the discussion. One aspect of these disagreements is the question of humility’s compatibility with great achievement. This article aims to demonstrate both how humility can be shown on screen and reveal greatness and humility can go together in practice. For this, the author draws on contemporary philosophical accounts of the virtue of humility to examine Damien Chazelle’s 2018 film First Man, a Neil Armstrong biopic based on James R. Hansen’s biography of the same name. The article outlines how both the distinct portrayal of its main protagonist and the film’s aesthetic features, such as mise-en-scène, sound and editing, are used to convey an idea of humility that reconciles achievement, ambition and greatness with a recognition of sacrifice, serendipity and sometimes the futility of human endeavours. Consequently, First Man is not only a film about a humble main character, but also indicates how cinematic techniques can be used effectively to enable us to experience humility, thus demonstrating how films can make a distinct contribution to philosophical debates about virtues beyond mere illustration. The 2008 crisis has revived debates on the relevance of laissez-faire, and thus on the role of the State in a modern economy. This book offers a 'genealogical' explanation of law's normativity. The term 'genealogical' conveys a commitment to a non-metaphysical type of enquiry. While it explains how law, as a normative phenomenon, comes about, it does not seek to ground law's normativity in anything but the context of social interaction giving rise to it. Legal normativity is brought about on a daily basis. Whether in revolutionary circumstances or in the quotidian need for judges, lawmakers or citizens to balance law's demands with those (...) of morality or prudence, our ability to bind ourselves through law ultimately depends on our capacity to articulate a better way of living together, and to commit ourselves to it. These efforts of assessment and articulation depend, in turn, on our conception of normative agency. Assert the need to trace the truth of ethical judgments to some independent moral 'facts' conditioning their objectivity, and you will get a different understanding of what it is we are doing when we dispute law's authority in the name of moral values. Tracing the truth of moral judgements back to our own social practices not only affects the nature of disagreement; it also dramatically increases our responsibility when, as lawmakers, judges, or citizens we 'take the law into our own hands' and confront it with our moral expectations. This article approaches world poverty from the perspective of rectificatory justice and investigates whether the global rich can be said to have special obligations toward the global poor on the grounds that they have been harming them. The focus rests on the present situation, and more specifically on Thomas Pogge's thesis of a causal link between world poverty and the conduct of present citizens (and governments) in wealthy countries. I argue that, if Pogge does not want his position to boil (...) down to an institutional version of the ‘negative causation'-thesis – according to which one can cause harm simply by failing to alleviate it – and if he wants it to be accepted by those he seeks to convince – namely right-libertarians – he must specify that it is enough for institutions to be just that they do not actively deprive their members of the means of subsistence, even if many of them still do not have the capacity to enjoy the means of subsistence. n spite of their divergences, global justice thinkers tend to agree that fairness in international trade requires the removal of trade barriers and hence of protectionist measures, especially on the part of rich countries. Behind this agreement, we find different kinds of considerations, some of which related to the idea that trade liberalisation is not genuinely, or at least not wrongfully, harming members of rich countries. My main purpose in this paper is to examine this idea in more detail and (...) to show that it faces several difficulties which invite us to reconsider the moral acceptability of at least some protectionist policies. The general aim of this paper is to elucidate Kant's juridical understanding of the duty not to lie and to situate it within his account of ‘The right of a state’ and of ‘The right of nations’. The first section will introduce the distinction Kant draws between two senses in which a liar can be said to wrong another, namely, ‘materially’ and ‘formally’. The second section will be devoted to clarifying what Kant means by a ‘formal wrong’ (or a ‘wrong (...) in general’), by focusing on his use of this concept in the context of international relations. The third section will examine why a liar can be said to always do wrong ‘formally’. And the fourth section will show that what holds for individuals also holds for states in their mutual relationships: they are never to deceive one another, not even when innocent lives are at stake, because doing so would ‘subvert the right of human beings as such.'.
