A major objection to the view that the relation of persons to human animals is coincidence rather than identity is that on this view the human animal will share the coincident person's physical properties, and so should (contrary to the view) share its mental properties. But while the same physical predicates are true of the person and the human animal, the difference in the persistence conditions of these entities implies that there will be a difference in the properties ascribed by (...) these predicates, with the result that the physical properties that determine the person's mental states will belong to the person and not to the human animal. David Shoemaker presents a new pluralistic theory of responsibility, based on the idea of quality of will. His approach is motivated by our ambivalence to real-life cases of marginal agency, such as those caused by clinical depression, dementia, scrupulosity, psychopathy, autism, intellectual disability, and poor formative circumstances. Our ambivalent responses suggest that such agents are responsible in some ways but not others. Shoemaker develops a theory to account for our ambivalence, via close examination of several categories of pancultural (...) emotional responsibility responses and their appropriateness conditions. The result is three distinct types of responsibility, each with its own set of required capacities: attributability, answerability, and accountability. Attributability is about the having and expressing of various traits of character, and it is the target of a range of aretaic sentiments and emotional practices organized around disdain and admiration. Answerability is about one’s capacity to govern one’s actions and attitudes by one’s evaluative judgments about the worth of various practical reasons, and it is the target of a range of sentiments and emotional practices organized around regret and pride. Accountability is about one’s ability to regard others, both evaluatively and emotionally, and it is the target of a range of sentiments and emotional practices organized around anger and gratitude. In Part One of the book, this tripartite theory is developed and defended. In Part Two of the book, the tripartite theory’s predictions about specific marginal cases are tested, once certain empirical details about the nature of those agents have been filled in and discussed. In Physical Realization, Sydney Shoemaker considers the question of how physicalism can be true: how can all facts about the world, including mental ones, be constituted by facts about the distribution in the world of physical properties? Physicalism requires that the mental properties of a person are 'realized in' the physical properties of that person, and that all instantiations of properties in macroscopic objects are realized in microphysical states of affairs. Shoemaker offers an account of both these sorts (...) of realization, one which allows the realized properties to be causally efficacious. He also explores the implications of this account for a wide range of metaphysical issues, including the nature of persistence through time, the problem of material constitution, the possibility of emergent properties, and the nature of phenomenal consciousness. It is notable that all of the leading theories of blame have to employ ungainly fixes to deflect one or more apparent counterexamples. What these theories share is a content‐based theory of blame's nature. Such approaches overlook or ignore blame's core unifying feature, namely, its function, which is to signal the blamer's commitment to a set of norms. In this paper, we present the problems with the extant theories and then explain what signaling is, how it functions in blame, why (...) appealing to it resolves the problems in other theories, what the signaling function implies for a wider range of gray‐area cases, and what the larger significance is of blame's core function for interpersonal interactions in a variety of (non‐moral) normative domains. Sydney Shoemaker is one of the most influential philosophers currently writing on philosophy of mind and metaphysics. The essays in this collection deal with the way in which we know our own minds, and with the nature of those mental states of which we have our most direct conscious awareness. Professor Shoemaker opposes the 'inner sense' conception of introspective self-knowledge. He defends the view that perceptual and sensory states have non-representational features - 'qualia' - that determine what it (...) is like to have them. Amongst the other topics covered are the unity of consciousness, and the idea that the 'first-person perspective' gives a privileged route to philosophical understanding of the nature of mind. Since the appearance of a widely influential book, Self-Knowledge and Self-ldentity, Sydney Shoemaker has continued to work on a series of interrelated issues in the philosophy of mind and metaphysics. This volume contains a collection of the most important essays he has published since then. The topics that he deals with here include, among others, the nature of personal and other forms of identity, the relation of time to change, the nature of properties and causality and the relation between (...) the two, dualism and immortality, and the nature of mental states. All the essays show the same care and precision in argument as the earlier book, but they also reveal a substantial shift in Professor Shoemaker's position to a form of materialism. In fact, a number of papers together constitute what is probably the most subtle and rigourous defence yet of a sophisticated functionalism in the account of the mind. (shrink)

Explores five fault lines in the fledgling field of responsibility theory, serious methodological disputes traceable to P.F. Strawson's "Freedom and Resentment.".

According to a popular line of thought, being excluded from interpersonal life is to be exempted from accountability, and vice versa. In ordinary life, this is most often illustrated by the treatment of people with serious psychological disorders. When people are excluded from valuable domains on the basis of their arbitrary characteristics (such as race and sex), they are discriminated against, prevented from receiving the benefits of participation in those domains for morally irrelevant reasons. Exemption from accountability—via exclusion from the (...) interpersonal domain—seems to prevent exempted parties from receiving crucial human goods for morally irrelevant reasons. This chapter discusses two widely deployed ways of trying to ameliorate morally costly disabilities. Both fail to apply viably to various psychopathologies. The solution involves disentangling accountability and interpersonality in a way that also provides insights into our shared human nature. (shrink)

In introducing the reactive attitudes “of people directly involved in transactions with each other,” P. F. Strawson lists “gratitude, resentment, forgiveness, love, and hurt feelings.” To show how our interpersonal emotional practices of responsibility could not be undermined by determinism’s truth, Strawson focused exclusively on resentment, specifically on its nature and actual excusing and exempting conditions. So have many other philosophers theorizing about responsibility in Strawson’s wake. This method and focus has generated a host of quality of will theories of (...) responsibility. What I show in this paper is that if Strawson—and his followers—had focused on hurt feelings instead of resentment, not only would quality of will theories of responsibility be disfavored, but none of our other theories of responsibility could adequately account for them. I conclude by exploring what a conundrum this poses for our methods and starting points in theorizing about responsibility. (shrink)

This essay attempts to provide and defend what may be the first actual argument in support of P. F. Strawson's merely stated vision of a response-dependent theory of moral responsibility. It does so by way of an extended analogy with the funny. In part 1, it makes the easier and less controversial case for response-dependence about the funny. In part 2, it shows the tight analogy between anger and amusement in developing the harder and more controversial case for response-dependence about (...) a kind of blameworthiness. Our aim in this entry is to articulate the state of the art in the moral psychology of personal identity. We begin by discussing the major philosophical theories of personal identity, including their shortcomings. We then turn to recent psychological work on personal identity and the self, investigations that often illuminate our person-related normative concerns. We conclude by discussing the implications of this psychological work for some contemporary philosophical theories and suggesting fruitful areas for future work on personal identity.

What is introspective know ledge of one’s own intentional states like? This paper aims to make plausible the view that certain cases of self-knowledge, namely the cogito-type ones, are enough like perception to count as cases of quasi-observation. To this end it considers the highly influential arguments developed by Sydney Shoemaker in his recent Royce Lectures. These present the most formidable challenge to the view that certain cases of self-knowledge are quasi-observational and so deserve detailed examination. Shoemaker’s arguments (...) are directed against two models of ordinary perception, the “object perception model” and the “broad perceptual model”. I argue that the core theses that Shoemaker associated with them are either dubious in their own right or applicable to certain cases of self-knowledge. Overall the aim is to show that there is such a variety of patterns in each case that simple analogies or disanalogies are unhelpful. (shrink)

One of P. F. Strawson's suggestions in “Freedom and Resentment” was that there might be an elegant theory of moral responsibility that accounted for all of our responsibility responses in a way that also explained why we get off the hook from those responses. Such a theory would appeal exclusively toquality of will: when we react with any of a variety of responsibility responses to someone, we are responding to the quality of her will with respect to us, and when (...) we let her off the hook, we are doing so in virtue of her lacking the capacity for the relevant quality of will. Strawson's own attempt to put forward such a view fails, for reasons Gary Watson has given, but several other theorists have advanced their own, more developed,Pure Quality of Willtheories in recent years. Specifically, there have been three distinct interpretations of “will” defended in the literature, yielding three different possible targets of our responsibility responses: quality ofcharacter, quality ofjudgment, or quality ofregard.My first task in this essay will be to show that none of these theories individually can captureallof our responsibility responses, given our deeply ambivalent responses to several marginal cases. One reaction to this fact might be to abandon the quality of will approach altogether. Another, more plausible, reaction is to develop a pluralistic account of responsibility, one that admits three noncompeting conceptions of responsibility, each of which emphasizes one of the three different qualities of will as the target of a distinct subset of our responsibility responses. On this pluralistic approach, marginal agents might be responsible on some conceptions, but not responsible on others. In the bulk of the paper, I discuss each of the relevant subsets of responsibility responses, the different qualities of will they target, what the capacities for the three qualities of will are, and how the pluralistic qualities of will approach could account for our ambivalence in the marginal cases. In this paper, I argue that on an equality-based theory of democracy's value, randomly selecting legislators is more democratic than electing them. In sections 1 and 2, I describe how a legislature composed of randomly selected legislators might operate and what an equality-based theory of democracy's value consists in. In section 3, I evaluate arguments made in support of election-based democracy by democratic theorists and demonstrate why these arguments fail on their own terms. In section 4, I argue that when (...) compared to electing legislators, randomly selecting legislators better answers to four democratic ideals embedded in equality-based theories of democracy's value. The recent swell of public interest in AI image generating software, such as Midjourney, DALL-E 2, and Stable Diffusion, has led to a great deal of consternation among conventional visual artists. Understanding that the process through which these machines generate images depends ultimately on a machine learning process that involves the use of copyrighted artworks, has led many artists to allege that AI art is theft. There has already been a substantive debate in the literature concerning whether this use of (...) copyrighted material by AI image generating software constitutes copyright infringement in the United States. However, the artists’ complaint appears to be a moral claim, rather than a legal one. In this paper, I will argue that these artists are essentially mistaken. Their copyrights should not protect them from this use of their art by AI image generating software. While I am sympathetic to the claims that this technology will harm visual artists, and that there should be some kind of protection afforded to artists against that harm, that harm is not caused by anything analogous to theft. A common conception of what it is for one property to “realize” another suggests that it is the realizer property that does the causal work, and that the realized property is epiphenomenal. The same conception underlies George Bealer’s argument that functionalism leads to the absurd conclusion that what we take to be self-ascriptions of a mental state are really self-ascriptions of “first-order” properties that realize that state. This paper argues for a different concept of realization. A property realizes another if (...) its “forward looking” causal features are a subset of those of the property realized. The instantiation of the realizer property will include the instantiation of the property realized; and when the effects produced are due to the causal features of the latter, it is the instantiation of it that is appropriately regarded as their cause. Epiphenomenalism is avoided, and so is Bealer’s absurd conclusion. (shrink)

Many people believe that for someone to now be responsible for some past action, the agent of that action and the responsible agent now must be one and the same person. In other words, many people that moral responsibility presupposes numerical personal identity. In this paper, I show why this platitude is false. I then suggest an account of what actual metaphysical relationship moral responsibility presupposes instead.

Recently T. M. Scanlon and others have advanced an ostensibly comprehensive theory of moral responsibility—a theory of both being responsible and being held responsible—that best accounts for our moral practices. I argue that both aspects of the Scanlonian theory fail this test. A truly comprehensive theory must incorporate and explain three distinct conceptions of responsibility—attributability, answerability, and accountability—and the Scanlonian view conflates the first two and ignores the importance of the third. Any property has two sorts of causal features: “forward-looking” ones, having to do with what its instantiation can contribute to causing, and ldquo;backward-looking” ones, having to do with how its instantiation can be caused. Such features of a property are essential to it, and properties sharing all of their causal features are identical. Causal necessity is thus a special case of metaphysical necessity. Appeals to imaginability have no more force against this view than they do against the Kripkean view that (...) statements like “Gold is an element” are metaphysically necessary. (shrink)

Quality of Will (qw) theories of responsibility claim the target of someone’s blameworthiness for an action is their poor quality of will. There have been many “threats” to such a theory over the years, coming out of a literature interested in the metaphysical conditions of free will, threats having to do with moral luck, manipulation, and negligence. In this paper, I am more interested in surveying and thwarting two “new school” threats to qw theories, including taking responsibility for inadvertence, and (...) holding reasonable but ostensibly wrongful beliefs. Both of these aim to ground blameworthiness independently of quality of will. I show that none of these new school threats to qw theories succeed. (shrink)

This paper discusses two features of the "morally responsible self." The first has to do with the preconditions of personal identity assumed to inhere in a morally responsible self. The paper argues that it is not a requirement of moral responsibility that the self held responsible for some action is one and the same individual as the self that performed it. the second feature involves what's known as the "deep self" theory of responsibility. Philosophical theories of property rights struggle to adequately explain the moral significance of ownership. We propose that the moral significance of property rights is due to the intersection of what we call "the extended self” and conventionally protected rights claims. The latter, drawing on conventionalist accounts of property rights, explains the social nature and flexibility of property. The former, drawing on naturalist theories, explains their personal nature. The upshot is that we find at this intersection the full moral significance of (...) property. (shrink)

It has long been thought that control is necessary for moral responsibility. Call this the control condition. Given its pride of place in the free will debate, “control” has almost always been taken to be shorthand for voluntary control, an exercise of choice or will. Over the last few decades, however, many have been arguing for including a range of attitudes for which we seem to be responsible that, if controlled at all, must be controlled via a very different mechanism, (...) namely, evaluative judgment. Call this second type of control evaluative control. In this paper I will present and discuss in detail an additional agential stance—reasonish regard—for which we treat one another as responsible, but that is ungoverned by either of the first two types of control. If we want to require a control condition for responsibility, then, we will need to introduce and include a third type of control, what I call empathic control. (shrink)

This paper attempts to show how a reductionist approach to the metaphysics of personal identity might well be most compatible with a form of contractualism, not utilitarianism.

The paper defends the view that there is a constitutive relation between believing something and believing that one believes it. This view is supported by the incoherence of affirming something while denying that one believes it, and by the role awareness of the contents one’s belief system plays in the rational regulation of that system. Not all standing beliefs are accompanied by higher-order beliefs that self-ascribe them; those that are so accompanied are ones that are “available” in the sense that (...) their subjects are poised to assent to their contents, to use them as premises in reasoning, and to be guided by them in their behavior. The account is compatible with the possibility of negative self-deception—mistakenly believing that one does not believe something—but the closest thing to positive self-deception it allows is believing falsely that a belief with a certain content is one’s dominant belief on a certain matter through failure to realize that one has a stronger belief that contradicts it. The view has implications about Moore’s paradox that contradict widely held views. On this view self-ascriptions of beliefs can be warranted and grounded on reasons—but the reasons are not phenomenally conscious mental states (as held by Christopher Peacocke) but rather available beliefs.
