Recent highly publicized privacy breaches in health care and genomics research have led many to question whether current standards of data protection are adequate. Improvements in de-identification techniques, combined with pervasive data sharing, have increased the likelihood that external parties can track individuals across multiple databases. This paper focuses on the communication of identifiability risks in the process of obtaining consent for donation and research. Most ethical discussions of identifiability risks have focused on the severity of the risk and how (...) it might be mitigated, and what precisely is at stake in pervasive data sharing. However, there has been little discussion of whether and how to communicate the risk to potential donors. We review the ethical arguments behind favoring different types of risk communication in the consent process, and outline how identifiability concerns can be incorporated into either a detailed or simplified method of communicating risks during the consent process. We characterize, in syntactic terms, the ranges of epimorphisms in an arbitrary class of similar first-order structures. This allows us to strengthen a result of Bacsich, as follows: in any prevariety having at most \ non-logical symbols and an axiomatization requiring at most \ variables, if the epimorphisms into structures with at most \ elements are surjective, then so are all of the epimorphisms. Using these facts, we formulate and prove manageable ‘bridge theorems’, matching the surjectivity of all epimorphisms in (...) the algebraic counterpart of a logic \ with suitable infinitary definability properties of \, while not making the standard but awkward assumption that \ comes furnished with a proper class of variables. Governments can try to counter obesity through preventive regulations such as sugar taxes, which appear to raise costs or reduce options for consumers. Would the regulations improve the welfare of adult consumers? The regulations might improve choice sets through a mechanism such as reformulation, but the scope for such improvement is limited. Otherwise, a paternalistic argument must be made that preventive regulations would improve welfare despite reducing choice. This paper connects arguments about obesity, health, and choice to a philosophically plausible (...) view of welfare. On the negative side, two errors to avoid are failing to see the limited value of health and thinking that findings of irrationality would alone settle arguments about welfare. On the positive side, preventive regulations could make people better-off if welfare is the satisfaction of preferences and if preventive regulations could better satisfy preferences by overcoming certain forms of irrationality. The leading evidence is from widespread attempts to lose weight. However, at least for the United States, most adults are not trying to lose weight, and that casts doubt on whether they would benefit from preventive regulations. If they would not, that seems a strong albeit not decisive reason against these regulations. (shrink)

This paper argues that the Food and Drug Administration’s (FDA) policy for health and wellness apps is ethically problematic. Currently, the FDA does not regulate health and wellness apps that are not intended for medical use. As a result of this hands‐off policy, preventing harm to consumers is left primarily to developers and app marketplaces. We argue that the FDA’s duties to prevent harm and maintain accountability to the American public require that they play a much stronger role. We also (...) discuss concerns about efficiency and fostering innovation, and argue that while they should help shape FDA regulation of health and wellness apps, they do not justify complete absence of FDA involvement. -/- . Since its inception, bioethics’ principled stance has been to argue against paternalism and elitism, and for an inclusive ethical perspective. But at least in North America, the growth of bioethics as a special area of applied ethics has created conflicts within the field itself. Those who, a generation earlier, argued against paternalism and for both professional and public accountability in medical decision making are now part of the decision making process. Too often, it is argued in this paper, their allegiance (...) is to the employer, or to a view of medicine that is institutionally based. As a result, it is suggested by this review, medical ethicists have adopted the perspective that, in the early 1970s, they most criticised. The answer, it is argued here, is to revisit a lexicographical ordering of responsibility in bioethics, one that recognises professionals as individuals with responsibilities, as citizens with a public posture, and finally, as professionals involved in the process of medical decision making. This paper is an attempt to elucidate the senses in which this place-name is used in Homer; to assign meanings to the Homeric terms Achaean, Iason and Pelasgic Arge, to ‘Argive’ as a synonym for Greek, and to establish the nature of the Argos over which Agamemnon ruled. I take the Homeric poems as the unity which they profess to be, and which they must be for historical enquiry. Whatever liberties Homer took with his materials it is plain he was (...) careful to respect events. The effort to distinguish between old and new in the Iliad and Odyssey has caused needless and fruitless encumbrance to the official historians, such as Busolt; the Unitarian position has given us the remarkable results of Professor Myres' . The consistency of Mr. Myres' account, and I venture to hope of mine, allows a fresh inference back to the homogeneity of the poems which are their source. (shrink)

Enough and too much has been written about the Epic Cycle. Upon scanty quotations and a jejune epitome a tedious literature has been built. The older writers, such as Welcker, tried to ‘reconstruct’—as profitable and satisfying a task as inferring a burnt manor-house from its cellars; later scholars have gone out in tracing the tradition of the poems through the learned age of Greece—a scaffolding without ties, by which this or that conclusion is reached according to temperamental disposition to this (...) or that fallacy. I do not intend to enter more than is needful into a controversy where so far as I can see everyone has gone beyond the evidence. If I add to the bulk of the literature, it is in the hope of putting things in their proper places and of presenting the data as they appear to a future editor. (shrink)

This chapter analyses various theories of natural law. The discussions cover meta-ethical objections to natural law theory; the views of Mills and Hobbes; a holistic and teleological conception of nature; nature and the precepts of natural law; nature and human good; natural sociality and morality; a defence of naturalism; a voluntarist conception of natural law; an objection to and defence of voluntarism; and natural morality without natural law.

This paper presents preliminary solutions to three conceptual problems posed by the use of triage to sort candidates for scarce medical resources: (1) By what criteria are the candidates grouped? (2) To what extent can triage be justified? (3) Under what conditions are different versions of triage equivalent? Four explicit methods of applying triage are described and compared, with the aid of examples. The extent to which they either maximize expected utility or show cost-benefit dominance is discussed. And cases in (...) which one triage method reduces to another are contrasted with others where no such reduction occurs. (shrink)

An aspect of Pisistratus, which has not hitherto been utilized in this question , appears to justify another presentment of the evidence which connects him with the Homeric tradition. I shall endeavour to be brief and not to repeat what is common property or irrelevant. The literature and the bearing of the controversy are given with his usual clearness by P. Cauer, Grundfragen der Homerkritik,2 pp. 125 sqq. Cauer's private doctrine, that Homer was for the first time written down by (...) Pisistratus, I consider sufficiently refuted by C. Rothe, Die Was als Dichtung, pp. 5–13. Fantastic views lately promulgated in England are1 dealt with conclusively to my mind by Mr. A. Lang, The World of Homer, pp. 281 sqq., to whose account nothing for controversial purposes need be added. On looking back over the literature I find myself most in agreement with Hans Flach, whose treatise, Die litterarische Thdtigkeit des Peisistratos, 1885, has been unduly depreciated. I shall have to repeat my own views expressed in the Classical Review, 1901, p. 7; 1907, p. 18; and in the Classical Quarterly, 1909, p. 84. (shrink)

The Homeridae bear the name of Homer, and should point a path by which we may climb to his personality. In antiquity they were known to be a γένος, a constituted family-corporation, though the accounts of the functions they fulfilled are scanty. Modern criticism, with its usual fluctuation, began by taking them at their apparent value; then adopted from a Roman grammarian a rationalistic explanation of them; invented other similar rationalistic explanations; and finally my lamented colleague Mr. Binning Monro robbed (...) them of all significance by treating the word as an adjective, an equivalent of Ὁμηρικοí Men who are called Sons of Homer should not be lightly dismissed, and it may be worth while to go over the familiar evidence once more in the hope that this obvious avenue to Homer may not turn out a blind alley.
