Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Osmanlılar, İbnü’l-Arabî’nin (ö. 638/1240) düşüncelerine ve kitaplarına büyük ilgi göstermiştir. Osmanlı padişahları da, devletlerinin kuruluşunu İbnü’l-Arabî'ye nispet eden rivayetlere değer vermiş ve onun fikirlerini desteklemiştir. Osmanlı’da kurulan medreselerin başında olan kişilerin, ilk dönem şeyhülislam ve kadıların İbnü’l-Arabî'nin fikirlerini yayma çabaları dikkat çekmektedir. Bu durum, İbnü’l-Arabî'nin Osmanlı toplumunda nazarî tasavvuf ekolünün sembolü haline gelmesine neden olmuştur. Şam toplumu ise genelde Osmanlı ile karşılaşmadan önce İbnü’l-Arabî’ye ve eserlerine az ilgi göstermekteydi. Şam’ın Osmanlı yönetimine girmesinden sonra ise bölgede İbnü’l-Arabî’ye ilgi artmıştır. Osmanlı valileri (...) ve kadıların İbnü’l-Arabî'nin kabrini ziyaret etmeyi gelenek haline getirmeleriyle daha da belirgin hale gelmiştir. Halk arasında da İbnü’l-Arabî’nin velayetine inanılarak büyük bir hürmet görmüştür. Bu gelişmeler Şam’da İbnü’l-Arabî’nin fikirlerinin yayılmaması açısından önem arz etmekdedir. Osmanlı döneminde, özellikle on altıncı yüzyılda İbn Kemal Paşa'nın desteğiyle İbnü’l-Arabî'ye olan ilgi artmıştır. On yedinci yüzyılda da bu ilgi devam etmiştir. Abdulganî en-Nablusî, on sekizinci yüzyılda İbnü’l-Arabî ekolünün önde gelen ismi olmuştur. On dokuzuncu yüzyılda, Emir Abdülkâdir el-Cezâirî'nin çabalarıyla İbnü’l-Arabî ekolüne mensup sufi ve âlimler çoğalmıştır. Bu dönemde İbnü’l-Arabî'nin evrâdı ve şerhleri de önem kazanmıştır. Şam ulemasından birçok kişi, özellikle Bahâüddin b. Abdülganî el-Baytar ve Muhammed Emin b. Muhammed Süveyd gibi şahsiyetler, İbnü’l-Arabî'nin eserlerini düzenli bir şekilde okumuş ve öğrencilere okutmuştur. Şam'da İbnü’l-Arabî'ye olan ilgi ve saygı, genel tasavvufî çizgi içinde amelî tasavvufa ağırlık verilmesine rağmen, nazarî tasavvufa yönelik bir eğilim göstermiştir. Şam toplumunda tarih boyunca İbnü’l-Arabî'nin şahsiyeti özel bir konum kazanmıştır. Onun için Şeyhu’l-Ekber gibi lakapların yaygınlaşması bunun göstergesi olmuştur. Âlimler ve mutasavvıflar İbnü’l-Arabî'nin öğretilerine büyük değer vermiş, özellikle baş eseri Fusûs’a önemli şerhler yazılmıştır. İbnü’l-Arabî'ye yönelik eleştiriler ve tartışmalar da yaşanmıştır. Özellikle Fusûsu'l-Hikem kitabındaki görüşleri bazı âlimler tarafından eleştirilmiş ve hatta tekfir edilmiştir. Ancak Osmanlı Devleti'nin resmi tutumu, İbnü’l-Arabî'ye destek vermek ve eleştirilere karşı çıkmak şeklinde olmuştur. Zamanla, İbnü’l-Arabî'nin eserleri savunulmuş ve eleştirilere cevaplar verilmiştir. Osmanlı valileri, Şam'da İbnü’l-Arabî'nin görüşlerine saldıran kişileri soruşturmuş ve cezalandırmıştır. Ancak bu tutum, Osmanlı fakihleri arasında da eleştiri ve karşıt görüşlerin ortaya çıkmasına neden olmuştur. İbnü’l-Arabî'nin kabri Osmanlı döneminde sürekli olarak ziyaret edilmiş, bu ziyaretler cuma geceleri özel olarak artmıştır. Osmanlı devlet adamları şeyhler ve âlimler, Şam'a girişlerinde önce İbnü’l-Arabî'nin kabrini ziyaret etmişlerdir. Kabir ziyaretine olan bu ilgi, zaman içinde önemli şahsiyetlerin defnedilme arzusuna dönüşmüş, Osmanlı büyüğü olan birçok kişi İbnü’l-Arabî'nin kabri yakınında gömülmeyi tercih etmiştir. Osmanlı devlet adamları ve şeyhlerinin İbnü’l-Arabî'nin etrafında defnedilme çabaları, bu bölgenin Osmanlılar dönemindeki etkisini göstermektedir. Osmanlı döneminde Şam'da İbnü’l-Arabî'nin öğretileri önemli ölçüde ilgi görmüş, devlet adamları, âlimler ve sûfîler tarafından benimsenmiştir. Osmanlılar, İbnü’l-Arabî'nin mirasını koruma ve destekleme amacıyla çeşitli önlemler almıştır. Ancak bu ilgi genellikle belirli gruplar arasında kalmış ve geniş kitlelere ulaşmamıştır. Makale, yirminci yüzyılın 30’lu yıllarında Özbekistan’da ateizmin gelişme yollarının, mekanizmalarının ve yöntemlerinin geriye dönük bir analizini sunmaktadır. Özellikle o dönemin komünist dünya görüşünün insanların bilincini nasıl etkilediği ve SSCB'nin eski devletlerinin halklarının ateist eğitiminin ne kadar önemli bir rol oynadığı makalenin ana içeriğini oluşturmaktadır. Dinle mücadele, sosyalist bir toplum inşa etmek için gerekli bir durumdur. O dönemde dini fanatizm ve hurafeler kitlelerin siyasi bilincinin yükselmesine ve sosyalist inşaya aktif katılımlarına engel oluyormuş gibi gösteriliyordu. Modern Sovyet ateist literatüründe, bilimsel ateizm konusunun (...) daha derinlemesine anlaşılması ve sosyal ve doğa bilimleri sistemindeki, özellikle felsefi bilgi sistemindeki yerinin kesin bir tanımına yönelik çalışmalar yer almaktaydı. Bilimsel ateizm teorisinin sorunlarını inceleyen Sovyet filozofları sonuç olarak zor bir zorlukla karşı karşıyadır: Bilimsel ateizmin içeriğinin, yayılma biçimlerinin ve yöntemlerinin, gelişmiş bir dünyada meydana gelen insanların yaşamlarının tüm alanlarındaki derin dönüşümleri nasıl yansıttığını bulmak sosyalist toplum için önemliydi. Ülkemizin muazzam sosyo-ekonomik ve kültürel dönüşümleri önceden belirleyen sosyalist yolda gelişmesinin sonuçlarından biri de kitlesel ateizmin oluşması ve istikrarlı bir şekilde büyümesidir. Sovyetler Birliği'nde karşıt sınıfların ortadan kalkması, sınıf mücadelesinin sınırlarının dışa dönük olmasına yol açmıştır. Bilimsel ateizmin yayılmasında Komünist Partinin ideolojik faaliyeti çok büyük bir rol oynuyor. Son olarak, kitlesel ateizmin gelişiminin doğası, propagandasının içeriği, biçimleri ve yöntemleri, dini örgütlerin siyasi konumu tarafından uygulanmış ve uygulanmakta ve uygulanmaya devam etmektedir. Marksist-Leninist dünya görüşünün oluşumuna ilişkin sorunlar, önemli bir kısmı ateist eğitim olan Partinin ideolojik ve eğitimsel çalışmasının sürekli merkezinde yer almaktadır. Ateizmin gelişmesi sırasında ‘Tanrısızlar’ gazetesinin dostları topluluğunun hücrelerinden doğan Militan Ateistler Birliği’nin faaliyetleriyle ilişkilendirildi. Militan Ateistler Birliği, din karşıtı propagandanın teori ve pratiğinin geliştirilmesine büyük katkı sağladı. Özbekistan'daki kitlesel ateizmin sosyal epistemolojik ve psikolojik kökenlerinin araştırılması. Çalışmanın amacı, Ateizm kavramının kendisini belirlemek, bugüne kadar yeterince çalışılmamış olan laik ve dini kültür, bilim, felsefe, dini hoşgörü, özgür düşünce, hümanizm, şüphecilik, materyalizm kavramlarıyla ilişkisini ve karşılıklı etkisini kurmak. Klasik fizik anlayışını değiştiren kuantum kuramı, bilimsel sahada ilk defa ortaya çıkan indeterminizm olması bakımından felsefe ve teoloji alanlarında da büyük etkiler meydana getirmiştir. Evrene yönelik yeni bir bakış açısı sunan bu kuram, tarihte çığır açarak yepyeni bir dönemi başlatmıştır. Devrim niteliğindeki kuantum kuramı, yirminci yüzyılın en önemli entelektüel başarılarındandır. Atom ve atom altı sistemleri inceleyen kuantum kuramı Max Planck’in kuantum hipoteziyle başlamış, kuramın temel prensipleri yine onun tarafından ortaya konulmuştur. Kuantum kuramı; hiçbir kesinliğin olmadığı, nesnelerin ölçüm yapılıncaya kadar hiçbir (...) özelliğinin bulunmadığı sıradışı bir dünyayı betimlemektedir. Kuantum dünyası; parçacıkların uzayda sürekli şekilde bir var olup bir yok olduğu, bir nesnenin aynı anda evrenin her yerinde bulunabildiği ve bir duvarın içinden rahatlıkla geçebildiği, iki cismin galaksiler arası uzaklıkta bile ışık hızından çok daha hızlı ve anlık bir iletişim hâlinde olabildiği tuhaflıklarla doludur. Bütün bunlar tamamen bilimsel olup gerçek sonuçları ve uygulamaları hem mikrodünyada hem de makro dünyada mevcuttur. Kuantum yasaları hiçbir yasanın edilmediği kadar test edilmiş ve bunlardan istisnasız geçmiştir. İslam düşüncesinde önemli bir yeri olan Gazzâlî, mûcizeyi nedensellik bağlamında tartışmıştır. Mûcizeyi âdetullah teorisi üzerine temellendirerek zorunlu nedenselliği reddetmiştir. Ona göre varlıklar özsel niteliklere sahip değildir, onları da aralarındaki ilişkileri de yaratan hakîkî fail olan Allah’tır. Dolayısıyla onların aralarında gerçekleşen neden-sonuç ilişkisi zorunlu değildir. Bu ilişkideki kuralları koyan da değiştirebilecek olan da Allah’tır. Neden-sonuç ilişkisindeki genel kurallar âdetullah, kurallardaki istisnâî değişiklikler ise mûcizelerdir. Gündelik yaşamdaki genel geçer kurallar (âdetullah) işlemekte olup bilim vs. bu kurallara göre yapılır. Mûcizenin gerçekleşmesi ise düşük bir ihtimal olarak her zaman vardır. Gazzâlî’nin, zorunlu nedenselliğin geçersizliğini ispat bağlamında getirdiği ateşin pamuğu yakması örneğinde ateş ile yanma arasında zorunlu bir ilişki yoktur. Başka bir deyişle ateşin özsel bir yakma özelliği bulunmamaktadır. Ona göre bunların kaynağı tamamen Allah’tır ve esasen âdetullah dışında -zıtların bir arada bulunması gibi muhaller hariç- her türlü ihtimal mevcuttur. Gazzâlî’nin bu görüşleri, günümüz kuantum kuramının neden-sonuç ilişkisine dair verileriyle uyum içindedir. Kuantum kuramına göre de maddenin en küçük yapı birimi olan temel parçacıkların farklı özsel nitelikleri bulunmamaktadır. Onların dünyasında dolayısıyla tüm evrende belirsizlik hakimdir. Her parçacık her an evrenin her yerindedir. Bu belirsizlikler ancak gözlemci etkisiyle/ölçümle belirlenir, böylece varlıklar ve olaylar oluşur. Bu oluşta her türlü ihtimal mevcutken gözlemci etkisi/ölçüm, bunu tek ihtimale düşürür. Kuantum kuramına göre gündelik yaşantıdaki yani makro âlemdeki alışılagelen klasik fizik kurallarının işleme sebebi, olasılıklarının çok yüksek olmasıdır. Fakat çok düşük ihtimalle de olsa sıra dışı ya da tabiat dışı olayların meydana gelmesi mümkündür. Bu ise mûcizelerin imkanını göstermektedir. (shrink)

Makale feminizmin genel olarak insan dışı hayvanların, özel olarak da tarımda kullanılan insan dışı hayvanların özgür ve özerk yaşama haklarını savunması gerektiğini savlamaktadır. Tarımda kullanılan insan dışı hayvanlardan elde edilen ürünlerin üretim süreçleri sadece onların bedenlerinin insanların arzuları uyarınca üretilip tüketilmelerini değil, ömürleri boyunca doğalarına aykırı şartlarda yaşayarak, sürekli eziyete maruz bırakılmalarını kapsamaktadır. Üstelik mevcut pratikler dişi insan dışı hayvanları, özellikle süt ve yumurta endüstrilerinde, biyolojik üreme yetilerinden faydalanmak adına ek eziyetlere maruz bırakmaktadır. Bu temel savı desteklemek için bell hooks (...) ve Carol J. Adams gibi yazarların eserlerinden faydalanılarak dört argüman öne sürülmüştür. Cinsiyeti biyolojik parametrelerle tanımlamanın sorunlu olacağına dair bir eleştiri de değerlendirilip, bu eleştiriye Wittgensteincı düşünceden yola çıkan bir yanıt önerilmiştir: Her ne kadar tarımda kullanılan insan dışı hayvanların cinsiyetini biyolojik parametrelerle tanımlıyor olsak da bu, biyolojinin genel olarak kadınlığı ve dişiliği tanımlamanın yeterli veya tek kriteri olduğu anlamına gelmemektedir. A number of philosophers think that grounding is, in some sense, well-founded. This thesis, however, is not always articulated precisely, nor is there a consensus in the literature as to how it should be characterized. In what follows, I consider several principles that one might have in mind when asserting that grounding is well-founded, and I argue that one of these principles, which I call ‘full foundations’, best captures the relevant claim. Kit Fine (2000) breaks with tradition, arguing that, pace Russell (e.g., 1903: 228), relations have neither directions nor converses. He considers two ways to conceive of these new "neutral" relations, positionalism and anti-positionalism, and argues that the latter should be preferred to the former. Cody Gilmore (2013) argues for a generalization of positionalism, slot theory, the view that a property or relation is n-adic if and only if there are exactly n slots in it, and (very roughly) that each slot (...) may be occupied by at most one entity. Slot theory (and with it, positionalism) bears the full brunt of Fine's (2000) symmetric completions and conflicting adicities problems. I fully develop an alternative, plural slot theory (or pocket theory), which avoids these problems, key elements of which are first considered by Yi (1999: 168 ff.). Like the slot theorist, the pocket theorist posits entities (pockets) in properties and relations that can be occupied. But unlike the slot theorist, the pocket theorist denies that at most one entity can occupy any one of them. As a result, she must also deny that the adicity of a property or relation is equal to the number of occupiable entities in it. By abandoning these theses, however, the pocket theorist is able to avoid Fine's problems, resulting in a stronger theory about the internal structure of properties and relations. Partial grounding is often thought to be formally analogous to proper parthood in certain ways. Both relations are typically understood to be asymmetric and transitive, and as such, are thought to be strict partial orders. But how far does this analogy extend? Proper parthood is often said to obey the weak supplementation principle. There is reason to wonder whether partial grounding, or, more precisely, proper partial grounding, obeys a ground-theoretic version of this principle. In what follows, I argue that it (...) does not. Context: There is a growing recognition in consciousness science of the need for rigorous methods for obtaining accurate and detailed phenomenological reports of lived experience, i.e., descriptions of experience provided by the subject living them in the “first-person.” Problem: At the moment although introspection and debriefing interviews are sometimes used to guide the design of scientific studies of the mind, explicit description and evaluation of these methods and their results rarely appear in formal scientific discourse. Method: The recent publication of (...) an edited book of papers dedicated to the exploration of first-and second-person methods, Ten Years of Viewing from Within: The Legacy of Francisco Varela, serves as a starting point for a discussion of how these methods could be integrated into the growing discipline of consciousness science. We complement a brief review of the book with a critical analysis of the major pilot studies in Varela’s neurophenomenology, a research program that was explicitly devised to integrate disciplined experiential methods with the latest advances in neuroscience. Results: The book is a valuable resource for those who are interested in impressive recent advances in first- and second-person methods, as applied to the phenomenology of lived experience. However, our review of the neurophenomenology literature concludes that there is as yet no convincing example of these specialized techniques being used in combination with standard behavioral and neuroscientific approaches in consciousness science to produce results that could not have also been achieved by simpler methods of introspective reporting. Implications: The end of behaviorism and the acceptance of verbal reports of conscious experience have already enabled the beginning of a science of consciousness. It can only be of benefit if new first- and second-person methods become well-known across disciplines. Constructivist content: Constructivism has long been interested in the role of the observer in the constitution of our sense of reality, so these developments in the science of consciousness may open new avenues of constructivist research. More specifically, one of the ways in which the insights from first- and second-person methods are being validated is by recursively applying the methods to themselves; a practical application of an epistemological move that will be familiar to constructivists from the second-order cybernetics tradition. Much philosophical progress has been made in elucidating the idea of evolutionary contingency in a recent re-burgeoning of the debate. However, additional progress has been impaired on three fronts. The first relates to its characterisation: the under-specification of various contingency claims has made it difficult to conceptually pinpoint the scope to which ‘contingency’ allegedly extends, as well as which biological forms are in contention. That is—there appears to be no systematic means with which to fully specify contingency claims which has (...) led to a tendency for authors to talk past each other. Secondly, on the matter of evidence, recent research has focused on the evidential import of convergent evolution which is taken to disconfirm the evolutionary contingency thesis. However, there has been a neglect of convergent evolution’s converse: ‘evolutionary idiosyncrasies’ or the singular evolution of certain forms, which I argue is evidentially supportive of evolutionary contingency. Thirdly, evolutionary contingency has often been claimed to vary in degrees and that the debate, itself, is a matter of ‘relative significance’. However, there has been no formal method of evaluating the strength of contingency and its relative significance in a particular domain. In this paper, I address all three issues by proposing a systematic means of fully specifying contingency theses with the concept of the modal range. Secondly, I propose an account of evolutionary idiosyncrasies, investigate the explanations for their occurrences, and, subsequently, spell out their significance with respect to the evolutionary contingency thesis. Finally, having been equipped with the evidential counterpart to convergent evolution, I shall sketch a likelihood framework for evaluating, precisely on the basis of a sequence of opposing data, the strength and relative significance of evolutionary contingency in a particular domain. With this in hand, the relative observations of idiosyncrasies and convergences can be informative of the strength and relative significance of contingency in any particular domain. (shrink)

Despite the efforts of Bosanquet, Muirhead, Basch, and many others, it is still frequently stated or implied, in both popular and scholarly literature, that Hegel constructed his philosophy of the State with an eye to pleasing the reactionary and conservative rulers of Prussia in his day, and condoned, supported, and, through his teaching, became partly responsible for some of the most criticized features in “Prussianism” and even of present-day National-Socialism.5 Ijn this article I propose to give reasons for denying that (...) Hegel the man is justly accused of servility to the Prussian Government, and that there is any warrant in the text of his Philosophie des Rechts for the charge that Hegel the philosopher was an exponent of “Prussianism” and “ frightfulness.”. Speaks defends the view that propositions are properties: for example, the proposition that grass is green is the property being such that grass is green. We argue that there is no reason to prefer Speaks's theory to analogous but competing theories that identify propositions with, say, 2-adic relations. This style of argument has recently been deployed by many, including Moore and King, against the view that propositions are n-tuples, and by Caplan and Tillman against King's view that propositions are facts (...) of a special sort. There are at least three vaguely atomistic principles that have come up in the literature, two explicitly and one implicitly. First, standard atomism is the claim that everything is composed of atoms, and is very often how atomism is characterized in the literature. Second, superatomism is the claim that parthood is well-founded, which implies that every proper parthood chain terminates, and has been discussed as a stronger alternative to standard atomism. Third, there is a principle that lies between these two (...) theses in terms of its relative strength: strong atomism, the claim that every maximal proper parthood chain terminates. Although strong atomism is equivalent to superatomism in classical extensional mereology, it is strictly weaker than it in strictly weaker systems in which parthood is a partial order. And it is strictly stronger than standard atomism in classical extensional mereology and, given the axiom of choice, in such strictly weaker systems as well. Though strong atomism has not, to my knowledge, been explicitly identified, Shiver appears to have it in mind, though it is unclear whether he recognizes that it is not equivalent to standard atomism in each of the mereologies he considers. I prove these logical relationships which hold amongst these three atomistic principles, and argue that, whether one adopts classical extensional mereology or a system strictly weaker than it in which parthood is a partial order, standard atomism is a more defensible addition to one’s mereology than either of the other two principles, and it should be regarded as the best formulation of the atomistic thesis. Once one accepts that certain things metaphysically depend upon, or are metaphysically explained by, other things, it is natural to begin to wonder whether these chains of dependence or explanation must come to an end. This essay surveys the work that has been done on this issue—the issue of grounding and infinite descent. I frame the discussion around two questions: (1) What is infinite descent of ground? and (2) Is infinite descent of ground possible? In addressing the second question, I (...) will consider a number of arguments that have been made for and against the possibility of infinite descent of ground. When relevant, I connect the discussion to two important views about the way reality can be structured by grounding: metaphysical foundationalism and metaphysical infinitism. (shrink)

The Gouldian argument for evolutionary contingency found in Wonderful Life can be dissected into three premises: palaeontological, macro-evolutionary, and developmental. Discussions of evolutionary contingency have revolved primarily around the developmental. However, a shift in methodological practice and new palaeontological evidence subsequent to the book’s publication appears to threaten the palaeontological premise that asserts high Cambrian disparity, or, roughly, that morphological differences between the Cambrian species were high. This presents a prima facie problem: Did the Cambrian consist of enough anatomical variety (...) to fuel a different outcome upon a replay of the tape of life? I investigate the role that disparity plays in the Gouldian argument for evolutionary contingency and conclude that the reduced disparity view does not undermine the argument, per se. As for the macro-evolutionary premise, Gould never offers any explicit justification for the idea that species sorting was indiscriminate or ‘lottery-like’ (though he certainly gestures at it). Putting aside the exegetical, I consider certain empirical avenues for underwriting the macro-evolutionary premise and argue that the most plausible route is to appeal to the special status of mass extinctions, a move that is not entirely unfamiliar to macro-evolutionists. That is, mass extinctions can be good sources of contingency due to their being ‘chancy’ in at least three respects. In sum, I update the palaeontological and macro-evolutionary premises as to reconstrue the Gouldian argument for evolutionary contingency in its strongest form. (shrink)

Maureen Donnelly’s (2016) relative positionalism correctly handles any fixed arity relation with any symmetry such a relation can have, yielding the intuitively correct way(s) in which that relation can apply. And it supplies an explanation of what is going on in the world that makes this the case. But it has at least one potential shortcoming — one that its opponents are likely to seize upon: it can only handle relations with fixed arities. It is unable to handle relations with (...) variable arities. I argue that, all else being equal, relative positionalism ought nonetheless to be preferred to its closest competitors — at least to the extent that the explanation it supplies of relational application is plausible — even though those competitors can handle variable arity relations in addition to fixed arity relations. Contingency-theorists have gestured to a series of phenomena such as random mutations or rare Armageddon-like events as that which accounts for evolutionary contingency. These phenomena constitute a class, which may be aptly called the ‘sources of contingency’. In this paper, I offer a probabilistic conception of what it is to be a source of contingency and then examine two major candidates: chance variation and genetic drift, both of which have historically been taken to be ‘chancy’ in a number of different (...) senses. However,contrathe gesturing of contingency-theorists, chance variation and genetic drift are not always strong sources of contingency, as they can be non-chancy in at least one sense that opposes evolutionary contingency. The probabilistic conception offered herein allows for sources of contingency to appropriately vary in strength. To this end, I import Shannon’sinformation entropyas a statistical measure for systematically assessing the strength of a source of contingency, which is part and parcel of identifying sources of contingency. In brief, the higher the entropy, the greater the strength. This is also empirically significant because molecular, mutational, and replicative studies often contain sufficient frequency or probability data to allow for entropies to be calculated. In this way, contingency-theorists can evaluate the strength of a source of contingency in real-world cases. Moreover, the probabilistic conception also makes conceptual room for the converse of sources of contingency: ‘sources of directionality’, which ought to be recognised, as they can interact with genuine sources of contingency in undermining evolutionary contingency. Giving money to others feels good. It is now standard to use the label ‘warm glow feelings’ to refer to the pleasure people take from giving. But what exactly are warm glow feelings? And why do people experience them? To answer these questions, we ran two studies: a recall task in which participants were asked to remember a donation they made, and a donation task in which participants were given the opportunity to make a donation before reporting their affective states. (...) Correlational and experimental results converge towards the conclusion that, if the nature of the warm glow is straightforward, its source is multifaceted. Regarding the nature of the ‘warm glow’, the pleasure people took in giving was mainly predicted by one particular type of positive emotion and was indeed described by participants as ‘warm’. Regarding the underlying psychological mechanisms, warm glow feelings were elicited by positive appraisals regarding the donor’s moral character, positive appraisals regarding the actual impact of the donor’s donation on the welfare of others and a feeling of communion with others. ABSTRACT Some think we should look at aspects of what is commonly thought of as non‐sentient nature as having a value in themselves apart from the use or recreation they provide for humans or even animals. But to what extent does nature, in the character it presents to us, exist apart from presence to consciousness such as ours? Surely at least many of its aspects cannot. However, that does not stop them having a genuinely intrinsic value, just as works of (...) art do, whose existence also is impossible apart from their display to a consciousness such as ours. But can nature, as it exists quite apart from human or animal consciousness, have any intrinsic value? It is suggested that only a panpsychic, and perhaps pantheist, view of nature (a view for which there are excellent metaphysical grounds) can give a positive answer, and even that must be a very vague one [1]. This is a slightly opinionated review of three main factions in metaontology: Quineans, Carnapians, and Meinongians. Emphasis is given to the last camp, as the metaontological aspect of Meinongianism has been underappreciated. The final section then offers some general remarks about the legitimacy of ontology, touching on ideas I have developed in other publications.

This paper is an attempt to elucidate the senses in which this place-name is used in Homer; to assign meanings to the Homeric terms Achaean, Iason and Pelasgic Arge, to ‘Argive’ as a synonym for Greek, and to establish the nature of the Argos over which Agamemnon ruled. I take the Homeric poems as the unity which they profess to be, and which they must be for historical enquiry. Whatever liberties Homer took with his materials it is plain he was (...) careful to respect events. The effort to distinguish between old and new in the Iliad and Odyssey has caused needless and fruitless encumbrance to the official historians, such as Busolt; the Unitarian position has given us the remarkable results of Professor Myres' . The consistency of Mr. Myres' account, and I venture to hope of mine, allows a fresh inference back to the homogeneity of the poems which are their source. (shrink)

Codes of medical ethics issued by professional organizations typically contain statements affirming the importance of confidentiality between patients and health-care practitioners. Seldom, however, is the confidentiality obligation depicted as absolute. Instead, exceptions are noted, the most common of which is that health-care professionals are justified in breaching the confidence of a patient if required by law to do so. Reasons that might be given to support this exception are critically discussed in this paper. The conclusion argued for is that this (...) is not a legitimate exception to the confidentiality rule. In spite of the existence of many examples of incomplete logics, it is an important problem to find intermediate predicate logics complete with respect to Kripke frame (or Kripke sheaf) semantics because they are closed under substitution. But, most of known completeness proofs of finitely axiomatizable logics are difficult to apply to other logics since they are highly dependent on the specific properties of given logics. So, it is preferable to find a general methods of completeness proof. We give some (...) results on this problem using canonical formulas of "propositional" logics 8,2ESS. (shrink)

The pages of the history of science record thousands of instances of similar discoveries having been made by scientists working independently of one another. Sometimes the discoveries are simultaneous or almost so; sometimes a scientist will make anew a discovery which, unknown to him, somebody else had made years before.

This article explores the relation between Aquinas’ metaphysical, epistemological and theological ideas and his theory of education as presented in the De Magistro and other writings. Aquinas’ theory of education is based on a theological metaphysics of human nature and an account of human rationality that is grounded in human nature. In the first section after the introduction we provide a synopsis of Aquinas’ metaphysical narrative, but in a contemporary key that draws upon the resources of Analytical Thomism. However, this (...) theologically inspired metaphysics leads to a somewhat neglected epistemology that is crucial to his understanding of teaching and learning in the De Magistro – the notion of connatural knowledge that we explore in the second section. Our exposition of the Thomistic ontology of the human person together with the notion of connatural knowledge, provide the context for understanding the De Magistro in the third section. (shrink)

It is shown that Plato’s Lysis is full of positive content between the lines. At the close of the dialogue Socrates says that he considers Lysis, Menexenus, and himself to be friends of one another. Following up on the questions which the dialogue leads us to ask yields an explanation ofwhy each of these instances of friendship is, in fact, an instance of friendship. In addition, the dialogue shows that there are five types of motivation for desiring something.
