This article draws together two works created in late fifteenth-century Mantua. Although radically different in kind, they were borne from the same acts of violence: Andrea Mantegna’s Madonna of Victory and a responsum about Jewish religious law by Rabbi Joseph Colon. Mantegna’s altarpiece, painted to commemorate the bloody battle of Fornova as a Gonzaga victory, was paid for by Daniele Norsa; Norsa, a Jewish banker, was accused of destroying a prior Christian icon and ordered to finance the new altarpiece as (...) reparations for this crime, under threat of death. Colon’s responsum addressed the permissibility of creating a Christian image under duress—idolatry being one of the sins for which a Jew must sacrifice their life rather than transgressing. We explore the remarkable artistry and distinct craft practiced by the painter and the rabbi—image making in the one case, legal reasoning in the other—as modes of describing, interpreting, and creating reality. Both works address problems of religion and idolatry, faith and coercion, victory and violence, and triumph and lament. Together they reveal the dynamics of a fascinating iconoclash, a conflict of culture waged over the struggle between making and breaking images. (shrink)

Despite their centrality and importance to both science and philosophy, relatively little has been written about thought experiments. This volume brings together a series of extremely interesting studies of the history, mechanics, and applications of this important intellectual resource. A distinguished list of philosophers and scientists consider the role of thought experiments in their various disciplines, and argue that an examination of thought experimentation goes to the heart of both science and philosophy.

Attitudes toward sow husbandry differ between citizens and conventional pig farmers. Research showed that moral values could only predict the judgment of people in case of culling healthy animals in the course of a disease epidemic to a certain extent. Therefore, we hypothesized that attitudes of citizens and pig farmers cannot be predicted one-on-one by moral values. Furthermore, we were interested in getting insight in whether moral values can be useful in bridging the gap between attitudes toward sow husbandry of (...) citizens and pig farmers. Based on a questionnaire, it was found that pig farmers and citizens, when considered as one group, shared the valuation of most moral values. However, when studying the four clusters of citizens with different attitudes toward sow husbandry, determined in a previous study, a variation in valuation of the moral values between the clusters of citizens and farmers came to the fore. This means that moral values are interpreted differently by groups of people when forming attitudes toward sow husbandry. The results of our study give an indication of which moral values are weighed differently between clusters of citizens and pig farmers. This information can be useful in future research on attitudes toward animal husbandry in order to understand why attitudes differ between groups of people. Besides, our results can be useful for the pig sector and citizens to learn to understand each other’s attitudes. With this understanding it is possible to invest in a husbandry system that can build on societal support. (shrink)

One hundred and ninety‐six Israeli middle‐school students participated in a study that explored the effects of moral orientation (moral versus conventional)and of three situational variables on attitudes toward two types of cheating in school exams—copying from others (‘active’)and letting others copy (‘passive’). Several vignettes that were comprised of different combinations of the three situational variables—exam importance, supervision level and peers' norms—were used as the main instrument. It was found that a‐morally oriented students approved significantly more of cheating than morally oriented (...) students. Importance of exam had marginally significant effects on active copying. Level of supervision during exam and classmates' norms had significant effects on both active and passive cheating attitudes. (shrink)

Citizenship status is meant to be secure, that is, inviolable. Recently, however, several democratic states have adopted or are considering adopting laws that allow them the power to revoke citizenship. This claimed right forces us to consider whether citizenship can be treated as a “conditional” status, in particular whether it can be treated as conditional on the right sort of behavior. Those who defend such a view argue that citizenship is a privilege rather than a right, and thus in principle (...) is revocable. Participating in a foreign state's military, treason, spying, or committing acts that otherwise threaten the national security of one's state may all warrant revocation. This article assesses the justifications given for the claimed power to revoke citizenship in democratic states and concludes that, ultimately, such a power is incompatible with democracy.I begin with a brief account of the claims given by contemporary democratic states for the “right to revoke.” Democratic citizenship is today commonly understood to beegalitarian, that is, it protects an equal basic package of rights for all citizens; and to be “the highest and most secure legal status,” that is, it is meant to be secure from unilateral withdrawal by the state. Formally, many democratic states have revocation laws on the books, but most of these have long been in disuse. Although I argue in this article that all revocation laws are inconsistent with democratic citizenship, I focus on the recent surge in proposed and implemented revocation laws, which are justified as essential to protecting national security.In the second section I outline three reasons to object to revocation laws. First, revocation laws discriminate between citizens based on their citizenship status. Second, since they single out those who are eligible for revocation, they apply unequal penalties for the same crime. Third, they are inadequately justified, in general, but also particularly to those who may be subject to them, because they are not adequately connected to the policy goal they are said to fulfill. I conclude with some brief observations concerning the ways in which revocation permits states to abrogate their shared responsibility for protecting the global community from dangerous individuals. : In his autobiographical account, the Munqidh min al-Dalāl, al-Ghazālī reflects on his conversion from skepticism to faith. Previous scholarship has interpreted this text as an anticipation of Cartesian positions regarding epistemic certainty. Although the existing similarities between al-Ghazālī and Descartes are striking, the focus of the present essay lies on the different philosophical aims pursued by the two thinkers. It is thus argued that al-Ghazālī operates with a broader notion of the Self than Descartes, because it is inclusive of (...) the body. And it is shown that the two philosophers use completely diverging paradigms. While Descartes models his notion of evidence after mathematical certainty, al-Ghazālī draws his famous 'ilm al-yaqīnī (certain knowledge) from a religious context. (shrink)

KANT is the foremost philosopher to have argued at length for there being moral duties to oneself, and he puts forward the most extensive list of such duties to be found in philosophical writings. Kant's most detailed statement of his views concerning duties to oneself is to be found in his late work, the Tugendlehre or Doctrine of Virtue, which forms the second part of his Metaphysic of Morals, that work for which the much more famous Grundlegung was the foundational (...) study. I shall confine my consideration of Kant entirely to the Tugendlehre, for his views there, at least concerning duties to oneself, represent only an amplification of ideas that he had expressed in earlier writings. The book discusses citizenship in the contemporary world; as a concept, as an ideal, as a policy and as a goal to be achieved from the perspective of different academic disciplines.

To what extent can philosophical thought experiments reveal norms? Some ethicists have argued that certain thought experiments reveal that people draw a morally significant distinction between "doing" and "allowing". I examine one such thought experiment in detail and argue that the intuitions it elicits can be explained by "prospect theory", a psychological theory about the way people reason. The extent to which such alternative explanations of the results of thought experiments in philosophy are generally available is an empirical question.

This article focuses on the follow question: Are human enhancement technologies likely to be justice impairing or justice promoting? We argue that human enhancement technologies may not be inherently just or unjust, but when situated within obtaining social contexts they are likely to exacerbate rather than alleviate social injustices.

Building on Wittgenstein’s ideas, I defend a brand of pluralism that associates words with conceptual families and appeals to this notion in the course of philosophical problem solving. I argue that certain problems that the received view of conceptual engineering (‘improvement by replacement’) faces can be more easily overcome if we adopt a pluralist perspective. I show that the proposed approach can circumvent the problem of topic discontinuity, whilst also avoiding the threat of trivialisation, since it can easily accommodate both (...) coarse-grained and fine-grained topics. Finally, I argue that my variant of pluralism is compatible with de novo conceptual engineering insofar as it allows that the paradigm associated with a word may shift overtime thus creating an opportunity for new candidate members to join a conceptual family. In this article, we present ideas related to three key aspects of mindfulness training: the regulation of attention via noradrenaline, the importance of working memory and its various components (particularly the central executive and episodic buffer), and the relationship of both of these to mind-wandering. These same aspects of mindfulness training are also involved in the preparation and execution of movement and implicated in the pathophysiology of psychosis. We argue that by moving in a mindful way, there may be an (...) additive effect of training as the two elements of the practice (mindfulness and movement) independently, and perhaps synergistically, engage common underlying systems (the default mode network). We discuss how working with mindful movement may be one route to mindfulness training for individuals who would struggle to sit still to complete the more commonly taught mindfulness practices. Drawing on our clinical experience working with individuals with severe and enduring mental health conditions, we show the real world application of these ideas and how they can be used to help those who are suffering and for whom current treatments are still far from adequate. This paper develops a domination-based practice-dependent approach to justice, according to which it is practices of systemic domination which can be said to ground demands from justice. The domination-based approach developed overcomes the two most important objections levelled to alternative practice-dependent approaches. First, it eschews conservative implications and hence is immune to the status quo objection. Second, it is immune to the redundancy objection, which doubts whether empirical facts and practices can really play an irreducible role in grounding justice. In (...) theorising dominating practices in terms of practices of social power, a domination-based approach makes justice dependent on factual information in three ways: First, the principle of non-domination is indeterminate and can only be spelled out by taking into view particular contexts of domination. Second, the principle of non-domination is conditional on the existence of practices of social power. Third, social power possesses a structural ontology – to know whether A has social power over B we need to turn to social rules distributing agents' higher order status of normative authority towards each other. This explains in what way practices of social power – and of domination – are both factual and normative practices and hence how such practices are non-redundant in grounding justice. (shrink)

Non-medical sex selection is premised on the notion that the sexes are not interchangeable. Studies of individuals who undergo sex selection for non-medical reasons, or who have a preference for a son or daughter, show that they assume their child will conform to the stereotypical roles and norms associated with their sex. However, the evidence currently available has not succeeded in showing that the gender traits and inclinations sought are caused by a “male brain” or a “female brain”. Therefore, as (...) far as we know, there is no biological reason why parents cannot have the kind of parenting experience they seek with a child of any sex. Yet gender essentialism, a set of unfounded assumptions about the sexes which pervade society and underpin sexism, prevents parents from realising this freedom. In other words, unfounded assumptions about gender constrain not only a child’s autonomy, but also the parent’s. To date, reproductive autonomy in relation to sex selection has predominantly been regarded merely as the freedom to choose the sex of one’s child. This paper points to at least two interpretations of reproductive autonomy and argues that sex selection, by being premised on gender essentialism and/or the social pressure on parents to ensure their children conform to gender norms, undermines reproductive autonomy on both accounts. In this paper I propose a partition semantics for sentences containing objective predicates that takes into account the phenomenon of occasion-sensitivity associated with so-called Travis cases. The key idea is that the set of worlds in which a sentence is true has a more complex structure as a result of different ways in which it is made true. Different ways may have different capacities to support the attainment of a contextually salient domain goal. I suggest that goal-conduciveness decides whether some (...) utterance of a sentence is accepted as true on a particular occasion at a given world. The utterance will not be accepted as true at a world which belongs to a truth-maker which is less conducive to a contextually salient goal than other truth-makers. Finally, the proposed occasion-sensitive semantics is applied to some cases of disagreement and cancellability. (shrink)

In this article we discuss the molecular signaling mechanisms that coordinate interactions between Schwann cells and the neurons of the peripheral nervous system. Such interactions take place perpetually during development and in adulthood, and are critical for the homeostasis of the peripheral nervous system (PNS). Neurons provide essential signals to control Schwann cell functions, whereas Schwann cells promote neuronal survival and allow efficient transduction of action potentials. Deregulation of neuron–Schwann cell interactions often results in developmental abnormalities and diseases. Recent investigations (...) have shown that during development, neuronally provided signals, such as Neuregulin, Jagged, and Wnt interact to fine‐tune the Schwann cell lineage progression. In adult, the signal exchange between neurons and Schwann cells ensures proper nerve function and regeneration. Identification of the mechanisms of neuron–Schwann cell interactions is therefore essential for our understanding of the development, function and pathology of the peripheral nervous system as a whole. -/- . Students’ cheating is a serious problem: It undermines the chance to adequately promote, support, and evaluate them. To explain cheating behavior, research seldom focuses on perceived teachers’ characteristics. Thus, we investigate the relationship between students’ cheating behavior and an important teacher characteristic, individual reference norm orientation. We examined cheating on written exams, on homework, and in oral exams among N = 601 students in N = 31 language classes. Results from doubly manifest multi-level analyses showed that, on the classroom level, (...) cheating on written exams and on homework occurred less frequently the more the classroom of students perceived their teachers as having an IRNO. We found no further evidence for other cheating factors or student characteristics. This supports the idea that teacher characteristics are associated with some forms of students’ cheating behavior. The aim of this paper is twofold: first, it seeks to provide a better understanding of lawyers’ ethics in practice in the field of publicly funded asylum law. It does so by examining Dutch asylum legal aid lawyers’ moral reasoning in respect of the ethically challenging issue of ‘the hopeless case’, employing a version of Christine Parker’s four approaches to moral reasoning in legal practice: adversarial advocacy, responsible lawyering, moral activism and relational lawyering. Second, it aims to demonstrate the applicability (...) of Parker’s taxonomy, developed in a common law country (Australia), to a civil law country (The Netherlands). This paper shows, in line with what Parker argued, that lawyers may apply a combination of approaches – different ethical considerations carry different in weight in different circumstances. It provides illustrations of situations in which approaches coexist and compete and the circumstances in which one prevails over the other in the area under review. (shrink)

Contract law doctrines can be ranged along various spectra. One of these spectra runs from the static to the dynamic. A contract law doctrine lies at the static pole of this spectrum if its application turns entirely on what occurred at the moment in time when a contract was formed. A contract law doctrine lies at the dynamic pole if its application turns in significant part on a moving stream of events that precede, follow, or constitute the formation of a (...) contract. Another spectrum runs from the binary to the multifaceted. Contract law doctrines are binary if they organize the experience within their scope into only two categories. Contract law doctrines are multifaceted if they organize the experience within their scope into several categories, including one or more intermediate categories. Classical contract law was a rigid, rather than a supple, instrument. Its rules were often responsive to neither the actual objectives of the parties, the actual facts and circumstances of the partiesâ transaction, nor the dynamic character of contracts. Instead, the rules of classical contract law were centered on a single moment in time, the moment of contract formation. accordingly, classical contract law doctrines were almost wholly static and also tended to be binary. The twentieth century witnessed the development of a modern contract law that has largely overthrown classical contract law. This overthrow has occurred in two ways. To begin with, in many cases modern contract law has reversed or fundamentally modified the rules of classical contract law. More important than the overthrow of specific rules of classical contract law, however, has been the overthrow of the deep structure of classical contract law. Where classical contract law had an overriding preference for rules that were objective and standardized, modern contract law has been highly flexible in adopting rules that are individualized and even subjective. Where classical contract law rules were typically binary, modern contract law rules are often multifaceted. Finally, where classical contract law was largely static, modern contact law is, in large part, dynamic. So, for example, static rules of interpretation have been replaced by dynamic rules that take into account events before and after the moment of contract formation; the static legal-duty rule has withered almost completely away, to be largely replaced by a dynamic modification regime that takes into account the value of ongoing reciprocity; a static judicial review of liquidated damages provisions is giving way to a dynamic review that takes account of the actual loss; and static offer-and-acceptance rules have been replaced by dynamic rules, such as the duty to negotiate in good faith. Following WWII the French state deployed television as an instrument of nation-building. The televising of philosophy, visible in 3500 programs aired between 1951 and 1999, contributed to this project. This article examines forty philosophy shows produced for national broadcast in France during the 1960s. It argues that philosophy's dialogic structure rendered it suited to capitalize on television technology. These shows (featuring Hyppolite, Canguilhem, Ricoeur, Foucault and Badiou) also demonstrate how the state used philosophy to reify an image of national superiority (...) at a time when, under the impress of decolonization and modernization, France's role in the global arena was in question. Primate research suggests that affiliation is a highly complex construct. Studies of primate affiliation demonstrate the need to distinguish between various affiliative behaviors, consider relationships as emergent properties of these behaviors, define affiliation in the context of general environmental responsiveness, and address developmental changes in affiliation across the lifespan.

Leading experts and rising stars in the field explore whether cosmopolitanism becomes impossible in the theoretical framework that assumed the absence of a final ground. The questions that the volume addresses refer exactly to the foundational predicament that characterizes cosmopolitanism: How is it possible to think cosmopolitanism after the critique of foundations? Can cosmopolitanism be conceived without an ‘ultimate’ ground? Can we construct theories of cosmopolitanism without some certainties about the entire world or about the cosmos? Should we continue to (...) look for foundations of cosmopolitan rights, norms and values? Alternatively, should we aim towards cosmopolitanism without foundations or towards cosmopolitanism with ‘contingent foundations’? Could cosmopolitanism be the very attempt to come to terms with the failure of ultimate grounds? Written accessibly and contributing to key debates on political philosophy, and social and political thought, this volume advances the concept of post-foundational cosmopolitanism by bridging the polarised approaches to the concept.
