There is a deep tension between liberalism and retributivism. On the face of it, one cannot coherently believe liberalism about the fundamental purpose of the state and retributivism about the basic end of legal punishment, given widely held and well-motivated or what I call ‘standard’ conceptions of these views. My aims in this article are to differentiate the types of conflict between liberalism and retributivism, to identify the strongest and most problematic type of conflict between them, to demonstrate that existing (...) strategies in the literature that might be invoked to resolve this conflict fail, and to present a new, conclusive way to resolve it. The solution lies in changing the standard conception of liberalism, which change, I argue, is warranted on independent grounds. Liberalism, up to now, has been conceived in a way that fails to best capture liberal intuitions. Upon improving our understanding of what liberal purposes essentially are, it becomes clear that retributive punishment is not merely logically consistent with them, but also partially constitutive of them. This chapter critically explores contemporary philosophical understandings of whether meaning in life might depend on the presence or absence of an afterlife. After distinguishing various kinds of afterlife, it focuses most on the potential relevance of an eternal one, and considers at length the extreme but common views amongst philosophers that an eternal afterlife would be either necessary for a meaningful life or, conversely, sufficient for a meaningless one. It concludes by considering the plausibility of a more moderate view, that (...) an eternal afterlife could substantially enhance the meaning of our lives, even if they would not be meaningless without it. The aim of the chapter is not to defend some overall thesis about these positions, but rather to acquaint the reader with recent English-speaking philosophical discussions of them. (shrink)

This narrative provides insight into medical education for Black physicians in South Carolina in the 1960s, during the civil rights movement. It also discusses the many rewards and challenges of being a physician of color, describes what has been done to develop programs that benefit minority communities, and argues that more such programs are needed.

Karl Marx did write, “The philosophers have only interpreted the world in various ways, the point is to change it,” which in this essay I interpret in the context of his normative thought about overcoming alienation. Reading “thesis eleven” in the light of that critical perspective, I maintain that two under-appreciated claims emerge: a central reason to pursue revolutionary change is so that more people have the freedom to engage in interpretation such as philosophy, and it is reasonable for many (...) of us to do some mere interpretation now even if doing so will not foster the kind of change that is admittedly vital. -/- . In her essay ‘The Curious Coincidence of Feminine and African Moralities’ (1987), Sandra Harding was perhaps the first to note parallels between a typical Western feminist ethic and a characteristically African, i.e., indigenous sub-Saharan, approach to morality. Beyond Harding’s analysis, one now frequently encounters the suggestion, in a variety of discourses in both the Anglo-American and sub-Saharan traditions, that an ethic of care and an African ethic are more or less the same or share many commonalities. While the two ethical (...) perspectives are indeed sisters, in this article I argue, first, that they are not identical twins, and, more strongly, that the family resemblance between the two is significantly less than has been recognized. I highlight key differences between representative forms of an ethic of care and a sub-Saharan communitarian morality, after which I argue, second, that the latter better captures some central feminist concerns and moral considerations generally. That is, I maintain that an African ideal of community, when understood in a philosophically refined way, provides an important, relational corrective to the ethic of care. (shrink)

Concomitant with the rise of rationalizing accountability in higher education has been an increase in theoretical reflection about the forms accountability has taken and the ones it should take. The literature is now peppered by a wide array of distinctions (e.g. internal/external, inward/ outward, vertical/horizontal, upward/downward, professional/public, political/economic, soft/ hard, positive/negative), to the point that when people speak of ‘accountability’ they risk speaking past one another, having some of these distinctions in mind and not others. Furthermore, often these distinctions are (...) vague and cross-cut each other in ways that are as yet unclear. The field could benefit from having a comprehensive framework in which to place these distinctions and to view their relations. My aim in this article is to provide an analytical tool by which to classify important debate about what accountability in higher education has been and ought to be. Beyond organizing such debate, this schema will serve the purposes of revealing ambiguities in terms, conflations of ideas, assumptions that warrant questioning, and gaps in present research agendas. This article introduces a special issue of Philosophical Papers devoted to the topic of meaning in life. In the paper, I engage with articles by Robert Audi, David Velleman, John Martin Fischer, Laurence Thomas, Berit Brogaard, Barry Smith and Larry James, laying out their central views, criticizing them, and suggesting ways they could be developed.

In this article I articulate and defend an African moral theory, i.e., a basic and general principle grounding all particular duties that is informed by sub-Saharan values commonly associated with talk of "ubuntu" and cognate terms that signify personhood or humanness. The favoured interpretation of ubuntu (as of 2007) is the principle that an action is right insofar as it respects harmonious relationships, ones in which people identify with, and exhibit solidarity toward, one another. I maintain that this is the (...) most defensible moral theory with an African pedigree at the time, and that it should be developed further with an eye to rivalling dominant Western theories such as utilitarianism and Kantianism. Arguing that every scientific concept and theory—including his own—is culturally conditioned, Fleck was appreciably ahead of his time. In the literature on African moral philosophy, it is common to find normative conclusions about the way we ought to act directly drawn from purported metaphysical facts about the nature of ourselves and the world. For example, Kwame Gyekye, the most influential sub-Saharan political philosopher, attempts to defend moderate communitarianism, roughly the view that agents have strong duties to support others in ways that do not violate human rights, by contending that it follows from the dual nature of the self (...) as both social and individual. In this article, I critically analyze this sort of rationale, and contend that it is unsound. I propose several reconstructions, but conclude that they cannot plausibly bridge the ‘is-ought gap’, and that similar arguments found in the field of African ethics, such as the frequent claim we must treat nature with respect since everything in the universe is interdependent, also fail to do so. This essay is a lengthy response to six contributors to a special issue edited by Adeshina Afolayan and devoted to critical discussions of _A Relational Moral Theory: African Ethics in and Beyond the Continent_. Key topics include: the proper role of metaphysics when doing moral philosophy; the appropriate aims of moral philosophy in the light of relational values and properties; the ir/relevance of imperceptible agents for an African ethic; the un/attractiveness of the principle that one morally should promote the common (...) good; the nature of virtue (vice) and its relation to rightness (wrongness); and how to capture self-regarding virtues and duties to oneself theoretically. In this article I draw on resources from the African philosophical tradition to construct a theory of human rights grounded on dignity that presents a challenge to the globally dominant, autonomy-based approach. Whereas the latter conceives of human rights violations as degradations of our rational nature, the former does so in terms of degradations of our relational nature, specifically, our capacity to be party to harmonious or friendly relationships. Although I have in the past presented the basics of the Afro-relational (...) approach, in this article I defend it from objections and also go on the offensive by arguing that understanding the human rights violations of torture and rape to be (roughly) behavior that treats innocent parties in an extremely discordant or unfriendly way is, if not more plausible than standard Kantian understandings, then at least a promising alternative to them. I consider whether a vitalist axiology, widely accepted in the African philosophical tradition, especially among religionists, can make adequate sense of evil, understood as what is bad in itself. I provide an important reason for thinking that it cannot, which African philosophers of religion and ethicists have yet to address. The reason is that a vitalist approach must construe evil as the reduction or other lack of vitality, while some evil conditions, such as cancer or torture, cannot be adequately understood (...) in those terms. Some bad states consist of the presence of an undesirable condition and not merely the absence of a desirable condition such as vitality. After replying to some responses on behalf of vitalism, I conclude that it cannot fully account for why evil might be a problem for God’s existence or for how to understand the quality of human life, and I also sketch some other avenues African philosophers might take that are more promising. Here I introduce the symposium issue of the South African Journal of Philosophy that is devoted to critically analysing my article “Toward an AfricanMoral Theory.” In that article, I use the techniques of analytic moral philosophy to articulate and defend a moral theory that both is grounded on the values of peoples living in sub-Saharan Africa and differs from what is influential in contemporary Western ethics. Here, I not only present a précis of the article, but also provide a sketch (...) of why I have undertaken the sort of project begun there, what I hope it will help to achieve, and how the contributors to the symposium principally question it. I draw on ideas salient in contemporary literate African philosophy to construct two new theoretical ways of capturing the essence of duties to oneself. According to one theory, a person has a foundational duty to “relate” to herself in ways similar to how the African field has often thought that a person should relate with others, viz., harmoniously. According to the second, one has a foundational duty to produce liveliness in oneself. In addition to articulating these novel attempts to capture (...) what all duties to oneself might have in common and showing that each one captures several intuitions about them, I offer some reasons to think that the harmony theory is more attractive than the vitality one. I conclude that there are values prominent in the African tradition that, upon some reformulation, ground comprehensive accounts of what one owes oneself that merit consideration by a global audience as rivals to, say, Kantian-rationalist approaches common in the West. It discusses contributions from Paul Edwards, R. W. Hepburn, Robert Nozick, Garrett Thomson, Arjan Markus and Thaddeus Metz.

For many indigenous peoples and the philosophies that have grown out of their worldviews, neither autonomy, utility, nor contract should be deemed foundational to ethics and politics. Instead, it is typical for philosophies from the Global South to hold that the aims of morality and government should be to harmonize with citizens, foster harmonious relationships between them, and promote such relationships between citizens and certain aspects of nature. This entry discusses the way harmony has figured into moral-political philosophies from three (...) major traditions, namely, African ubuntu (humanness in Nguni languages), East Asian Confucianism, and South American buen vivir (good living in Spanish). Although harmony is at the core of all three philosophies, it is conceived in different ways, entailing different prescriptions about, e.g., which sorts of beings have rights and who should have political power. The determination of death by neurological criteria—“brain death”—has long been legally established as death in all U.S. jurisdictions. Moreover, the consequences of determining brain death have been clear. Except for organ donation and in a few rare and narrow cases, clinicians withdraw physiological support shortly after determining brain death. Until recently, there has been almost zero action in U.S. legislatures, courts, or agencies either to eliminate or to change the legal status of brain death. Despite ongoing academic debates, the law (...) concerning brain death has remained stable for decades. However, since the Jahi McMath case in 2013, this legal certainty has been increasingly challenged. Over the past five years, more families have been emboldened to translate their concerns into legal claims challenging traditional brain death rules. While novel, these claims are not frivolous. Therefore, it is important to understand them so that we can address them most effectively. (shrink)

In this issue of JCE, Douglas Diekema argues that the best interest standard (BIS) has been misemployed to serve two materially different functions. On the one hand, clinicians and parents use the BIS to recommend and to make treatment decisions on behalf of children. On the other hand, clinicians and state authorities use the BIS to determine when the government should interfere with parental decision-making authority. Diekema concedes that the BIS is appropriately used to “guide” parents in making medical treatment (...) decisions for their children. But he argues that the BIS is inappropriately used as a “limiting” standard to determine when to override those decisions. Specifically, Diekema contends that the BIS “does not represent the best means for determining when one must turn to the state to limit parental action.” He argues that this limiting function should be served by the harm principle instead of by the BIS.I contend that we should not reassign the BIS’s limiting function to the harm principle. In this article I make two arguments to support my position. First, the BIS has effectively served, and can serve, both guiding and limiting functions. Second, the harm principle would be an inadequate substitute. It cannot serve the limiting function as well as the more robust BIS. (shrink)

Influential moral theories in the contemporary West face problems making sense of the conflict between the interests of animals and people’s interests in culture. They have trouble explaining either the existence of strong direct duties to animals or the importance of people’s right to culture (and frequently both). In this chapter I aim to advance a relational ethic, grounded on the African philosophical tradition, that offers a promising alternative. I contend that duties toward animals and rights to culture are potentially (...) conflicting normative branches springing from the common root of a demand to prize communal relationship. In addition to showing that communion makes good sense of the strength of some direct duties to animals and the moral significance of culture, I argue that it accounts well for how to understand the way in which they can clash and how to address it practically. Taking the good (generosity), the true (enquiry), and the beautiful (creativity) as exemplars of what can make a life noticeably meaningful, elsewhere I have advanced a principle that entails and plausibly explains all three. Specifically, I have proffered the view that great meaning in life, at least insofar as it comes from this triad, is a matter of positively orienting one’s rational nature towards fundamental conditions of human existence, conditions of human life responsible for much else about it. Iddo Landau (...) has raised important objections to this principle, arguing in particular that contouring one’s rationality towards fundamentality is neither necessary nor sufficient for great meaning in life. In this article, I reply to Landau’s objections to the fundamentality account of what makes life very meaningful. I thereby aim to enrich reflection about what it is about the lives of Neslon Mandela, Mother Teresa, Albert Einstein, and Pablo Picasso that made them so significant as well as to indicate how fundamentality implicitly plays a key role in theistic conceptions of meaning in life. The most prominent strand of moral thought in the African philosophical tradition is relational and cohesive, roughly demanding that we enter into community with each other. Familiar is the view that being a real person means sharing a way of life with others, perhaps even in their fate. What does such a communal ethic prescribe for the coronavirus pandemic? Might it forbid one from social distancing, at least away from intimates? Or would it entail that social distancing is wrong to (...) some degree, although morally permissible on balance? Or could it mean that social distancing is not wrong to any degree and could, under certain circumstances, be the right way to commune? In this article, I defend the latter view. I argue that, given an independently attractive understanding of how to value communal relationship, distancing oneself from others when necessary to protect them from serious incapacitation or harm can come at no cost to right action. However, I also discuss cases in which social distancing would evince a lack of good character, despite being the right thing to do. (shrink)

In my view, postmodernism, as a cluster of bold epistemological claims, foundered on the rocks of contemporary science. Many postmodern positions about knowledge have conflicted with views of science that are extraordinarily difficult to doubt, which in this short article (composed to honour Educational Philosophy and Theory's 50th anniversary), I point out and argue holds a lesson about how to undertake the philosophy of education.

In this article I respond to six contributors to a special issue of _Social Theory and Practice_ that is devoted to critical discussions of my book _A Relational Moral Theory: African Ethics in and Beyond the Continent_. In this book I articulate a general principle of rightness that is substantially informed by values salient in the African philosophical tradition (and some others in the Global South) and defend it as preferable to some major rivals, including utilitarianism and Kantianism. Key topics (...) that I address in this article include methodological issues, such as whether it is appropriate to provide an interpretation of the African tradition with some characteristically Western concepts and how metaphysical claims should inform the construction of normative ethical theories, as well as substantive issues pertaining to how to understand the nature of moral status and right action. Elsewhere I have contended that if a God-centred account of meaning in life were true, it would not be because meaning comes from fulfilling God’s purpose for us. Specifically, I have argued that this ‘purpose theory’ of life’s meaning cannot be the correct God-based view since God would have to be atemporal, immutable, and simple for meaning to logically depend on His existence, and since such a being lacking extension could not be purposive. Jacob Affolter has developed a fresh account (...) of the kind of purpose that is necessary for meaning in life, has argued that a God without extension could ground it, and has also provided some tentative reason to believe that only such a God could do so. I respond in three ways: by questioning whether the sort of purpose Affolter thinks is necessary for meaning in fact is; by arguing that an extensionless God could not ground it; and by indicating the way that a purely physical world could. What makes a person's life meaningful? Thaddeus Metz offers a new answer to an ancient question which has recently returned to the philosophical agenda. He proceeds by examining what, if anything, all the conditions that make a life meaningful have in common. The outcome of this process is a philosophical theory of meaning in life. He starts by evaluating existing theories in terms of the classic triad of the good, the true, and the beautiful. He considers whether meaning in (...) life might be about such principles as fulfilling God's purpose, obtaining reward in an afterlife for having been virtuous, being attracted to what merits attraction, leaving the world a better place, connecting to organic unity, or transcending oneself by connecting to what is extensive. He argues that no extant principle satisfactorily accounts for the three-fold significance of morality, enquiry, and creativity, and that the most promising theory is a fresh one according to which meaning in life is a matter of intelligence contoured toward fundamental conditions of human existence.
