What is human finitude? What is objectivity? What is culture? What is truth? Reading Across the Divide brings together critical essays from the continental and analytic traditions in philosophy. The selection is geared towards a better understanding of philosophical problems by combining the perspectives from both sides of the divide between analytic and continental philosophy. The specific ordering of the texts and the short introductions to them facilitate this better understanding. Although it is true that the introductions, selections of texts, (...) and the ordering of them could be seen to imply a particular philosophical interpretation, the editors are adamant that this is by no means the only possible view. The editors do take a firm stance against what they take to be the infertile political division in philosophy between analytic and continental philosophy. (shrink)

Doug Walton, who died in January 2020, was a prolific author whose work in informal logic and argumentation had a profound influence on Artificial Intelligence, including Artificial Intelligence and Law. He was also very interested in interdisciplinary work, and a frequent and generous collaborator. In this paper seven leading researchers in AI and Law, all past programme chairs of the International Conference on AI and Law who have worked with him, describe his influence on their work.

We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. Using Hofstede's culture theory (1980, 2001 Culture's Consequences: Comparing Values, Behaviours, Institutions, and Organizations Across Nation. Sage, NewYork), the current study incorporates the moral development (e.g. Thorne, 2000; Thorne and Magnan, 2000; Thorne et al., 2003) and multidimensional ethics scale (e.g. Cohen et al., 1993; Cohen et al., 1996b; Cohen et al., 2001; Flory et al., 1992) approaches to compare the ethical reasoning and decisions of Canadian and Mainland Chinese final year undergraduate accounting students. The results indicate that Canadian (...) accounting students' formulation of an intention to act on a particular ethical dilemma (deliberative reasoning) as measured by the moral development approach (Thorne, 2000) was higher than Mainland Chinese accounting students. The current study proposes that the five factors identified by the multidimensional ethics scale (MES), as being relevant to ethical decision making can be placed into the three levels of ethical reasoning identified by Kohlberg's (1958, The Development of Modes of Moral Thinking and Choice in the Years Ten to Sixteen. University of Chicago, Doctoral dissertation) theory of cognitive moral development. Canadian accounting students used post-conventional MES factors (moral equity, contractualism, and utilitarianism) more frequently and made more ethical audit decisions than Chinese accounting students. In this paper, we continue our research on a hybrid narrative-argumentative approach to evidential reasoning in the law by showing the interaction between factual reasoning (providing a proof for ‘what happened’ in a case) and legal reasoning (making a decision based on the proof). First we extend the hybrid theory by making the connection with reasoning towards legal consequences. We then emphasise the role of legal stories (as opposed to the factual stories of the hybrid theory). Legal stories provide a (...) coherent, holistic legal perspective on a case. They steer what needs to be proven but are also selected on the basis of what can be proven. We show how these legal stories can be used to model a shift of the legal perspective on a case, and we discuss how gaps in a legal story can be filled using a factual story (i.e. the process of reasoning with circumstantial evidence). Our model is illustrated by a discussion of the Dutch Wamel murder case. (shrink)

In classical logic, the proposition expressed by a sentence is construed as a set of possible worlds, capturing the informative content of the sentence. However, sentences in natural language are not only used to provide information, but also to request information. Thus, natural language semantics requires a logical framework whose notion of meaning does not only embody informative content, but also inquisitive content. This paper develops the algebraic foundations for such a framework. We argue that propositions, in order to embody (...) both informative and inquisitive content in a satisfactory way, should be defined as non-empty, downward closed sets of possibilities, where each possibility in turn is a set of possible worlds. We define a natural entailment order over such propositions, capturing when one proposition is at least as informative and inquisitive as another, and we show that this entailment order gives rise to a complete Heyting algebra, with meet, join, and relative pseudo-complement operators. Just as in classical logic, these semantic operators are then associated with the logical constants in a first-order language. We explore the logical properties of the resulting system and discuss its significance for natural language semantics. We show that the system essentially coincides with the simplest and most well-understood existing implementation of inquisitive semantics, and that its treatment of disjunction and existentials also concurs with recent work in alternative semantics. Thus, our algebraic considerations do not lead to a wholly new treatment of the logical constants, but rather provide more solid foundations for some of the existing proposals. (shrink)

The question of the basis of human equality has recently gained increasing attention. However, much of the literature has focused on whether persons—understood as fully competent adults—have equal moral status, while relatively less attention has been devoted to the analysis of what grounds the equal moral status of those human beings who are not fully competent adults. This paper contributes to this debate by addressing the question of the equality of moral status between adults and children. Specifically, this paper has (...) three aims. First, it provides a conceptual map of this complex issue. Second, it argues that the challenges that have been raised against standard accounts of persons’ equal moral status are even more forceful when applied to the question of adults and children’s moral equality. Finally, it examines what a commitment to adults and children’s moral _inequality_ entails and what it does not, thereby showing that the justificatory role of the principle of moral equality is not as far-reaching as commonly assumed. In his recent book, Humanity without Dignity: Moral Equality, Respect, and Human Rights, Andrea Sangiovanni argues that the principle of moral equality should be grounded in the wrongness of treating others as inferiors insofar as this constitutes an act of social cruelty. In this short piece, I will raise two concerns about the rejection of social cruelty as the basis of moral equality: first, Sangiovanni’s account seems to give rise to disturbing implications as to how those beings that have basic (...) moral status relate to each other. This paper presents a theory of reasoning with evidence in order to determine the facts in a criminal case. The focus is on the process of proof, in which the facts of the case are determined, rather than on related legal issues, such as the admissibility of evidence. In the literature, two approaches to reasoning with evidence can be distinguished, one argument-based and one story-based. In an argument-based approach to reasoning with evidence, the reasons for and against the occurrence of (...) an event, e.g., based on witness testimony, are central. In a story-based approach, evidence is evaluated and interpreted from the perspective of the factual stories as they may have occurred in a case, e.g., as they are defended by the prosecution. In this paper, we argue that both arguments and narratives are relevant and useful in the reasoning with and interpretation of evidence. Therefore, a hybrid approach is proposed and formally developed, doing justice to both the argument-based and the narrative-based perspective. By the formalization of the theory and the associated graphical representations, our proposal is the basis for the design of software developed as a tool to make sense of the evidence in complex cases. The Essays on the Active Powers of Man was Thomas Reid's last major work. It was conceived as part of one large work, intended as a final synoptic statement of his philosophy. The first and larger part was published three years earlier as Essays on the Intellectual Powers of Man. These two works are united by Reid's basic philosophy of common sense, which sets out native principles by which the mind operates in both its intellectual and active aspects. The (...) Active Powers shows how these principles are involved in volition, action, and the ability to judge morally. Reid gives an original twist to a libertarian and realist tradition that was prominently represented in eighteenth-century British thought by such thinkers as Samuel Clarke and Richard Price. Based on autoethnographic observations and phenomenological descriptions of everyday life, this article develops a theory about the connection between challenging housing experiences and the lockdown situation during the COVID-19 pandemic in Germany. A special focus is placed on living in community, i.e. living permanently together with other people. The reorganisation of spatial routines and the bundling of these in the flat led to the development of new methods of everyday life in terms of work, leisure and social behaviour. In Storybrooke, the city in which Once Upon a Time takes place, live many characters of fantastic stories. A plethora of princesses resides in this town, and their history, like their representation, undergoes important variations. Moving away from the role of “damsel in distress” often found in fairy tales and their adaptations, Emma, Snow White or Little Red Riding Hood, gain independence and freedom. However, clichés are tough and heroines often get involved in stereotypical love stories, where motherhood seems to (...) be the only possible destiny. Hardly anyone denies that (nearly) all human beings have equal moral status and therefore should be considered and treated as equals. Yet, if humans possess the property that confers moral status upon them to an unequal degree, how come they should be considered and treated as equals? It has been argued that this is because the variations in the degree to which the status‐conferring property is held above a relevant threshold are contingencies that do not generate differences in degrees of (...) moral status. Call this the contingency argument for the basis of moral equality. In this paper, I reject the contingency argument. Instead, I develop an attitude‐based account of the basis of moral equality: according to this account, the basis of moral equality lies in a fitting, basic, and independent moral attitude which is owed to human beings qua moral status‐holders, and provides a coherent and plausible explanation for why the variations above the threshold for moral status do not matter. This paper develops a novel theory of the meaning of moral equality. This theory has two original and significant implications: first, it shows—contra what is commonly held in the literature—that adults and children are not always each other’s equals; rather, the former are sometimes inferior and sometimes superior to the latter, depending on the interest at stake. The principle of moral equality is one of the cornerstones of any liberal theory of justice. It is usually assumed that persons’ equal moral status should be grounded in the equal possession of a status-conferring property. Call this the property-first approach to the basis of moral equality. This approach, however, faces some well-known difficulties: in particular, it is difficult to see how the possession of a scalar property can account for persons’ equal moral status. A plausible way of circumventing such (...) difficulties is to explore another avenue for the justification of persons’ equal moral status: moral equality should be grounded in the wrongness of treating others as inferiors. Call this the relation-first approach to the basis of moral equality. This paper aims at providing some reasons as to why this approach should be rejected and clarifying why the property-first approach still represents the most promising way of justifying our commitment to moral equality. Two objections will be pressed against the relation-first approach: first, grounding moral equality in the wrongness of treating others as inferiors gives rise to some disturbing normative implications; second, relation-first accounts cannot vindicate the idea that a range of beings has equal fundamental rights. This, however, is precisely what an account of moral equality is meant to justify. The paper, then, concludes that the relation-first approach fails to provide a plausible answer to the question of the basis of moral equality. Instead, the program's contribution lay in catalyzing “a sense of mission” in the collaboration between psychologists Daniel Kahneman and Amos Tversky, economist Richard Thaler, and their associates. Partly this reflected the common strategy of American foundations to pick an individual or small group of scientists and stick with them until scientific success had been achieved. (...) Bex analyzes the case with an informal version of his hybrid theory, which combines scenario construction and argumentation. Arguments based on evidence can be used to reason about alternative scenarios. Bex claims that his hybrid theory provides the best of both worlds by combining cognitively feasible story‐based reasoning with more detailed rational argumentation. However, like the argument‐based approach, the hybrid theory does not provide a systematic account of uncertainty.

New Haven and London: Yale University Press, 1998. xv 1 212 pp. Cloth, $30; paper, $15. Yale's Hermes series offers this contribution by James Romm on Herodotus, a subject dear to the heart of the series' founding editor, the late John Herington. This series addresses itself, in the words of the editor, to the "nonspecialist (...) adult" or "uninstructed beginning student" (ix). Though an introductory "Hermes book" need not have a thesis to prove, Romm does start with an agendum. He sets out to show, he says, that the best way to appreciate Herodotus is not to worry about the historian's accuracy. Ideally, the reader should use a translation without footnotes and should "otherwise ignore modern fact- oriented treatments of the archaic period" (7). Romm intentionally avoids calling Herodotus a historian (8) in these pages. He concentrates on the first four books of the Histories, which he says readers find puzzling and often skip, moving on to the "more familiar ground of The Persian Wars" (10).But wait: Romm writes for the "uninstructed," for whom the Persian Wars will be presumably just as obscure as early Lydian history. How many Persian wars were there? Who won? Why do we care? Romm gives no early help to the reader who picks up Herodotus for the first time. Instead his first chapter, "Myth and History," begins with an unenlightening quotation from M. Ondaatje's English Patient and then makes the dubious statement (page 1) that "quite possibly" Croesus on his pyre could not have expected to be famous thousands of years later (because of Herodotus' Histories). In fact, Croesus went to great lengths in his lavish dedications at Delphi to make sure he would be remembered, and the Myson vase and Bacchylides 3 attest to the Lydian monarch's public relations success. A prominent Athenian family even apparently named a son after Croesus (CEG 27). Romm's focus on the first four books seems, in fact, to stem more from his own love of geography and ethnography in the early books--as attested in his useful The Edges of the Earth in Ancient Thought (Princeton 1992)--than from concern for the puzzled reader.The second chapter, "From Homer to Herodotus," presents more introductory material. Between Homer and Herodotus, it appears, there is not much that readers of the latter need take into account. One might have expected more substantial treatment (here and later) of Hesiod, the early poets, the Presocratics, and the Sophists. Hippocrates does not even make the index; Aesop gets three pages (15-17). Indeed it seems symptomatic of the shortcomings of this book that Romm avoids, overlooks, or ignores some of the commonplaces of Herodotean criticism. His earlier book, for example, touched on the theme [End Page 309] of the Noble Savage, but it never appears here. Romm's focus on his author and on the text is admirable, but he disserves the beginning reader by presenting Herodotus as a writer with little or no intellectual or literary history.In his next chapter Romm appears to ignore his earlier antihistorical statements by giving "a quick survey of archaic Greek and Near Eastern history" (32). It is here that we first learn of the great battles of 480 and 479 B.C.--but no mention as yet of Marathon. He appears to be providing, albeit sketchily, precisely the historical footnotes he earlier said were to be avoided. We hear, for example, that Cambyses' attack on Egypt was not a "personal vendetta" but "more likely part of a carefully planned program of imperial expansion" (42-43). He may be right, of course, but Herodotus' focus on unpredictable personal motivations instead of rational political ones deserves respect even in our modernist and democratic age. Herodotus would have had no trouble writing the histories of Lyndon Johnson or Richard Nixon.Chapter 4, "The Man and His Work," presents, with curious omissions, standard handbook information about Herodotus' life and his book. Television content that contains non-stereotypical representations of ethnic minorities and models positive intercultural interactions may potentially aid in reducing the prejudices of its viewers. However, the exact effect has yet to be demonstrated. Furthermore, the cognitive mechanisms behind such an effect remain unclear. This article tests hypotheses derived from social identity theory and social learning theory that attribute this effect to the identification patterns with ingroup and outgroup characters in television drama. In an experiment, participants either watched episodes of a (...) multicultural drama or a regular soap series. Results showed that viewers of multicultural drama had lower perceptions of ethnic threat. Moreover, this effect was mediated by identification with characters, namely, increased identification with outgroup and lowered identification with ingroup characters resulting in lower ethnic threat. The results suggest that short term viewing effects are best explained with social identity theory. The implications for long term effects and the possible role of social learning are analyzed in the discussion. (shrink)

It was extended to mixed characteristic together with the author. Hensel minimality aims to mimic o-minimality in both strong consequences and wide applicability. In this paper, we continue the study of Hensel minimality, in particular focusing on [math]-h-minimality and [math]-h-minimality, for [math] a positive integer. This short paper describes a perspective on questions which does not view wh-words as existential quantifiers or as expressions introducing a quantificational domain, but rather as indeterminate referential expressions (Dotlačil and Roelofsen 2019). The proposal is programmatic in nature, and several aspects of it remain to be worked out in greater detail. I argue, however, that it has several potential benefits, including a principled account of weak and strong question interpretations, a uniform analysis of single-wh and multiple-wh questions, and an (...) account of the typologically widespread similarity between interrogative and indefinite pronouns which, unlike previous approaches, can explain the observation that if a language contains interrogative and indefinite pronouns which are similar in form but non-identical (e.g., where and somewhere), the indefinite pronouns are always morphologically more complex than the interrogative pronouns, and never the other way around (Haspelmath 1997). The tentative proposal is that an interrogative pronoun involves complete indeterminacy in the sense that it does not only leave open what its referential value is but also whether it has a referential value at all. For instance, where is completely indeterminate, permitting lack of a referential value. The ‘some’ in somewhere eliminates this possibility and thereby exerts existential force. (shrink)

This paper provides a complete characterization of epistemic models in which distributed knowledge complies with the principle of full communication (van der Hoek et al., 1999; Gerbrandy, 1999). It also introduces an extended notion of bisimulation and corresponding model comparison games that match the expressive power of distributed knowledge operators.

The purpose of this article is not to affirm or deny particular philosophical positions, but to explore the limits of intelligibility about what post-mortem harm means, especially in the light of improper post-mortem procedures at Bristol and Alder Hey hospitals in the late 1990s. The parental claims of post-mortem harm to dead children at Alder Hey Hospital are reviewed from five different philosophical perspectives, eventually settling on a crucial difference of perspective about how we understand harm to the dead. On (...) the one hand there is the broadly 'analytical' tradition1 of thinking that predicates the notion of harm on the basis of an existing subject. Since the dead are non-existent persons, it makes little sense to view the dead as being harmed. On the other hand, there is a phenomenological perspective, where the dead, in respect to the experience of grief, are existentially absent. This forms the basis that it is possible to harm grieving parent's experiences of how their dead are treated. The article ends with a short examination of what harming the dead implies for traditional bioethical concerns, namely, obtaining informed consent from significant others when planning medical research on the newly dead. This article critically examines how solidarity has been enacted in the first 2 months of the COVID-19 pandemic, mainly, but not exclusively, from a United Kingdom perspective.1 Solidaristic strategies are framed in two ways: aspirations to overcome COVID-19 ; and those that are illusory, incompatible, contradictory, and disrupting of solidaristic ideals. Solidarity can also be understood more widely from a biocentric perspective. In the context of COVID-19 a lack of biocentric solidarity points to a probable cause of the pandemic; where (...) COVID-19, harmless in bats, jumped species as a consequence of closer contact with humans. Solidarity, therefore, is not only expressed in a fight against a viral “enemy” but is also a reminder of human activity that has upset balances within ecosystems. (shrink)

In doing so, Edwards is (...) not interested in undermining psychiatric expertise, but exploring some of the practical consequences that flow from it, such as involuntary psychiatric treatment.My concern about psychiatric treatment in general and involuntary psychiatric treatment in particular, is three-fold, the third concern adding to the arguments already rehearsed by Edwards and others. The first concern is about the value neutrality of mental illness. Any dysfunctional conception of mental illness is not value neutral according to Fulford; dysfunction is, straightaway, a normative concept and is heavily influenced by a patient's desires and values. The second concern is about competing and conflicting values that arise in a person's psychiatric treatment. Again, there exists a legitimate variation in people's evaluative judgments about mental health conditions, for which a degree of democratic compromise might be required in negotiating conflicting values in a person's psychiatric treatment (Fulford and Colombo 2004). Without wishing to examine any of the philosophical foundations or counter-arguments to these claims in this short discussion paper, my third concern is about how to ethically negotiate between conflicting values in a person's psychiatric treatment. In other words, what might democratic compromise consist in? How might democratic compromise be implemented in terms of an ethically relevant principle?Any democratic enterprise, by definition, favors or is characterized by social equality and is egalitarian in nature (New Oxford English Dictionary 1999, 490). To be able to negotiate in the spirit of democratic compromise between competing and conflicting values in the process of psychiatric treatment, a principle of equal consideration of interests is vital.The essence of the principle of equal consideration of interests is that we give equal weight in our [End Page 101] moral deliberation to the like interests of all those affected by our actions (Singer 1979, 19). In other words, an interest is an interest whoever's interest that may be. So, for example, if the principle is about relieving pain, then the moral principle is about relieving the undesirability of pain as such, and not the undesirability of A's pain, which might be different from the undesirability of B's pain. Naturally, one may be able to distinguish that A's pain is greater than B's pain, in which case, under the equal consideration of interests principle, A's pain should be given greater weighting than B's pain in any conflict of interests. In short, in the evaluation of like interests, major interests outweigh minor interests.The significance of the principle of equal consideration of interests in decisions about mental health treatment in general, and about involuntary psychiatric detention and treatment more specifically, is that it should be possible (in theory at least) to able to democratically arbitrate on the basis of utility, whose interests take precedence when legitimate conflicts arise. The great practical advantage to the principle of equal consideration of interests is that it weighs' interests impartially—like well-balanced weighing scales; they favor where the interest is stronger or where several interests combine to outweigh a smaller number of similar interests. Most important, in the case of psychiatric treatment, it is a principle that takes no account of whose interests they are, avoiding any discriminatory stigma that may arise because of having made certain assumptions about being mentally ill. From the point of view of the equal consideration of interests, who the bearer is and how they are classified is, in itself, incidental to what the actual bearer's interests are and how they compete and conflict with others who have like interests. This article examines Noël Carroll’s theory of solidarity from a critical race theoretical perspective. Using recent work in philosophy of film, philosophy of emotion, and critical philosophy of race, it argues his theory pays insufficient attention to both the role disgust plays in generating solidarity and the role race plays in generating disgust. Numerous and significant examples are cited to support these claims. The article also suggests implicit bias and embodied affect figure into character allegiance more seriously than Carroll’s theory (...) indicates. These weaknesses arguably affect related theories in both philosophy of film and cognitive film theory, such as those advanced by A. W. Eaton, Margrethe Bruun Vaage, Murray Smith, and Carl Plantinga. The result is a call for revision of Carroll’s and these other thinkers’ theories, as well as a call for deeper investigation into disgust, race, and their importance in generating character allegiance. Abstract:This article seeks to contribute to a better understanding of the relationship between Catholic and Protestant theories of mission by examining the influence of the Jesuit José de Acosta on the De conversione Indorum et gentilium (1669), one of the first comprehensive handbooks of Protestant missiology, written by Johannes Hoornbeeck. It is demonstrated that Acosta's Thomist emphasis on the willing acceptance of a new faith made his ideas particularly attractive to Hoornbeeck and are the reason why the latter preferred Jesuit (...) sources to Franciscan thinkers and writings, since these were more Scotist in their outlook.
