A case of Moral Luck occurs whenever we normatively assess agents for things that depend on factors beyond their control. The paper takes a comparative approach and examines how morality and law deal with such cases. The comparative perspective allows us to explain the problem of Moral Luck as a tension inherent in normative orders: While normative orders are based on a strong connection between responsibility and voluntariness, this idealist assumption is at least partly at odds with their functional requirements (...) as social orders. The paper examines how law and morality converge and differ in resolving this tension in cases of Moral Luck. Finally, the paper concludes with a brief discussion of some more general features of the normative orders of morality and the law that follow from this "bottom-up" analysis of Moral Luck. (shrink)

The focus on translational research in clinical trials has the potential to generate clinically relevant genetic data that could have importance to patients. This raises challenging questions about communicating relevant genetic research results to individual patients. An exploratory pharmacogenetic analysis was conducted in the international ovarian cancer phase III trial, AGO-OVAR 16, which found that patients with clinically important germ-line BRCA1/2 mutations had improved progression-free survival prognosis. Mechanisms to communicate BRCA results were evaluated, because these findings may be beneficial to (...) patients and their families. Communicating individual BRCA results was not anticipated during clinical trial design. Consequently, options were not available for patients to indicate their preference for receiving their individual results when they signed pharmacogenetic informed consent. Differences in local requirements, clinical practice, and opinion regarding the ethical aspects of how to convey genetic results to patients are all potential barriers to returning individual BRCA results to patients. Communicating the aggregate BRCA result from this study provided clinical investigators with a mechanism to disseminate the overall study finding to patients while taking individual circumstances, local guidelines and clinical practice into account. This study illustrates the importance of increasing the clarity and scope of informed consent and the need for patient engagement to ensure clinical trial participants can indicate their preference regarding receipt of potentially important individual pharmacogenetic results. This is a book that contrary to common practice, shows the commonalities of ancient and modern theories of freedom, law, and rational actions. Studying the works of the ancients is necessary to understanding those that follow. Thomas Chaimowicz challenges current trends in research on antiquity in his examination of Montesquieu's and Burk's path of inquiry. He focuses on ideas of balance and freedom. Montesquieu and Burke believe that freedom and balance are closely connected, for without balance within a state (...) there can be no freedom. When Montesquieu speaks of republics, he means those of antiquity as they were understood in the eighteenth century. In this view, freedom can develop only within the framework of established tradition. Edmund Burke's greatest service to political thought may lie in making use of this idea when he fought against the abstractions of the French Revolutionaries. Antiquity as the Source of Modernity examines Montesquieu's "Roman mind," meaning not an attitude influenced by the ancients, but one primarily influenced by Roman heritage. It speaks to the antithesis of monarchy and despotism in Montesquieu's thought and the influence of Tacitus and Pliny the Younger on him. The separation of powers and its relation to the concept of the mixed constitution as well as Montesquieu's smaller masterpiece Considerations on the Causes of the Grandeur and Decadence of the Romans are examined in detail. Finally, the discussion leads seamlessly to Burke, who, as a critical admirer of Montesquieu, partly incorporated his interpretation of the English constitution into his own thinking threatened by teachings of the French Revolution and its British adherents. The central idea of Antiquity as the Source of Modernity is timeless. It is that the ancient past can lead to a clearer understanding of what follows. This perspective represents a reversal of the conventional procedures for conducting this kind of research, but it is a reversal that Chaimowicz embraces in order to add a new dimension to the study and impetration of both Montesquieu and Burke. Thomas Chaimowicz was a distinguished visiting professor at the International Academy of Philosophy in the Principality of Liechtenstein and honorary professor of Roman Lay at the University of Salzburg. Late in a career of more than sixty years, Thomas Burch, an internationally known social demographer, undertook a wide-ranging methodological critique of demography. This open access volume contains a selection of resulting papers, some previously unpublished, some published but not readily accessible [from past meetings of The International Union for the Scientific Study of Population and its research committees, or from other small conferences and seminars]. Rejecting the idea that demography is simply a branch of applied statistics, his work (...) views it as an autonomous and complete scientific discipline. When viewed from the perspective of modern philosophy of science, specifically the semantic or model-based school, demography is a balanced discipline, with a rich body of techniques and data, but also with more and better theories than generally recognized. As demonstrated in this book, some demographic techniques can also be seen as theoretical models, and some substantive/behavioral models, commonly rejected as theory because of inconsistent observations, are now seen as valuable theoretical models, for example demographic transition theory. This book shows how demography can build a strong theoretical edifice on its broad and deep empirical foundation by adoption of the model-based approach to science. But the full-fruits of this approach will require demographers to make greater use of computer modeling [both macro- and micro-simulation], in the statement and manipulation of theoretical ideas, as well as for numerical computation. The Life of Wisdom in Rousseau's "Reveries of the Solitary Walker" is the first complete exegesis and interpretation of Rousseau's final and culminating work, showing its full philosophic and moral teaching. The Reveries has been celebrated as a work of literature that is an acknowledged acme of French prose writing. Thomas L. Pangle argues that this aesthetic appreciation necessitates an in-depth interpretation of the writing's complex and multileveled intended teaching about the normatively best way of life—and how essential this (...) is for a work that was initially bewildering. Rousseau stands out among modern political philosophers in that he restored, to political philosophy, what Socrates and his students (from Plato and Xenophon through Aristotle and the Stoics and Cicero) had made central—and that the previous modern, Enlightenment philosophers had eclipsed: the study of the life and soul of the exemplary, independent sage, as possessor of "human wisdom." Rousseau made this again the supreme theme and source of norms for political philosophy and for humanity's moral as well as civic existence. In his analysis of The Reveries, Pangle uncovers Rousseau's most profound exploration and articulation of his own life, personality, soul, and thought as "the man of nature enlightened by reason." He describes, in Rousseau's final work, the fullest embodiment of the experiential wisdom from which flows and to which points Rousseau's political and moral philosophy, his theology, and his musical and literary art. PurposeAlthough there is much public talk about privacy, it seems that there is no definite answer; rather, ambiguous concepts of what privacy is and what indeed privacy in peril is. The overall aim of this paper is to clarify how privacy is defined in the academic literature, what the different concepts of privacy have in common, what distinguish them from one another, and what advantages and disadvantages such definitions have in order to clarify if there is a gap in the (...) existing literature.Design/methodology/approachThis contribution constructs theoretically founded typologies in order to systemize the existing literature of privacy studies and to analyse examples of privacy (threats). Therefore, it mainly is a theoretical approach combined with illustrative examples.FindingsThis paper contains a systematic discussion of the state of the art of privacy studies by establishing a typology of existing privacy definitions and discussing commonalties and differences. In this paper, it is argued that the existing literature is insufficient for studying privacy. Therefore, a critical contribution to privacy studies is needed.Originality/valueA critical contribution to privacy studies avoids pitfalls of the existing literature and strives for the development of theoretical and empirical research methods in order to focus on privacy in the context of domination, asymmetrical power relations, resource control, social struggles, and exploitation. Not only our conscious expectations, wishes and intentions are directed towards the future, but also pre- or unconscious tendencies, hunches and anticipations. Using a term coined by Ernst Bloch, they can be summarized as the not-yet-conscious. This not-yet-consciousness usually unfolds spontaneously and without a plan; it is not expected or striven for, but rather emerges in consciousness in such a way that the subject is surprised by itself, so to speak. This gives rise to phenomena such as the conspicuous, the (...) accidental, the new and the improvised, which are particularly important for understanding creative and therapeutic processes. The aim of this article is to develop a general phenomenological framework for understanding not-yet-conscious dynamics and their unfolding in different contexts. To this end, the structure of the not-yet-conscious is examined in the light of protention, in which the phenomenon is fundamentally located. (shrink)

In _My Father's House_, the political philosopher Thomas Dumm explores a series of stark and melancholy paintings by the American artist Will Barnet. Responding to the physical and mental decline of his sister Eva, who lived alone in the family home in Beverly, Massachusetts, Barnet began work in 1990 on what became a series of nine paintings depicting Eva and other family members, as they once were and as they figured in the artist's memory. Rendered in Barnet's signature quiet, (...) abstract style, the paintings, each featured in full color, present the ordinary and extraordinary aspects of a twentieth-century American family. Dumm first became acquainted with Barnet and his paintings in 2008. Given his scholarly focus on the lives of ordinary people, he was immediately attracted to the artist's work. When they met, Dumm and Barnet began a friendship and dialogue that lasted until the painter's death in 2012, at the age of 101. This book reflects the many discussions the two had concerning the series of paintings, Barnet's family, his early life in Beverly, and his eighty-year career as a prominent New York artist. Reading the almost gothic paintings in conversation with the writers and thinkers key to both his and Barnet's thinking—Emerson, Spinoza, Dickinson, Benjamin, Cavell, Nietzsche, Melville—Dumm's haunting meditations evoke broader reflections on family, mortality, the uncanny, and the loss that comes with remembrance.
