In lieu of an abstract, here is a brief excerpt of the content:Criminal Law, Pain Relief, and Physician Aid in DyingFaye Girsh, Ed.D., Executive DirectorMadam:The article by Cantor and Thomas on “Pain Relief, Acceleration of Death, and Criminal Law” (KIEJ, June 1996) was a tortured attempt to develop criteria for the humane and compassionate physician who tries to serve the needs of a patient in unremitting pain. There are three areas that merit comment.The authors dealt with pain medications that (...) might have the undesirable side effect of causing death. They did not mention tolerance, which usually occurs in a patient with chronic pain and which would require exceedingly high doses to be effective. They did not mention barbiturates, which are preferable to opiates in causing death and which are used increasingly by compassionate physicians to answer the pleas of their suffering patients, but for which there is no excuse about alleviating pain. Would the criminal law just call the prescription of a lethal dose of barbiturates a reckless act and require conviction? Fortunately, juries, as the authors point out, do not balance these formulas on the head of a pin. When they see the circumstances under which these doctors do help their patients, they choose to nullify the law and would ignore the suggestions made in this article.The authors refer to the “consent” of the patient. They do not mention that these doctors are operating with more than consent; they are administering these medications because suffering patients are begging them to put them out of their pain and the indignities of the dying process. The article discusses the process as though it were the same as consent to elective surgery. These patients—with AIDS, cancer, and hopeless neurological degeneration—are not simply agreeing to a procedure; they are desperately seeking a way out. If the criminal law were to develop criteria for physician aid in dying, certainly one of them should be the active, witnessed, repeated request of such a patient for a certain, quick, painless, gentle death.The third point is that physicians do not face prosecution when administering no treatment to a patient whose life could be saved with treatment but who chooses not to receive it. This has been upheld by the U.S. Supreme Court; no criteria for suffering, alternatives, terminality, justifiability, or unbearability are required. The doctor can stand by while the patient dies what may be a protracted, difficult death, but it is within the law. What matters in this situation is the decision of the patient to refuse treatment, and that is absolute. How ironic that the patient who cannot refuse treatment must, with his or her doctor, jump through all these hoops to achieve a peaceful death.One worries that the physician who must balance the risk of “risky pain relief” against the accusation of recklessness will err in the direction of allowing [End Page 103] the patient to bear the pain rather than help with a dose of analgesics that might be considered beyond the stipulated “risk.”Why don’t we just be honest about it? Allow dying or hopelessly ill patients to make the decision about what they want by passing a carefully defined law allowing euthanasia rather than balancing the risk and trying to determine the “purpose” of the physician’s ministrations. We protect some patients from themselves while allowing others almost complete autonomy to make the choice of ending their lives. Thomas L. Kane, a crusader for antislavery, women's rights, and the downtrodden, rose to prominence in his day as the most ardent and persuasive defender of Mormons' religious liberty. Though not a Mormon, Kane sought to defend the much-reviled group from the "Holy War" waged against them by evangelical America. His courageous personal intervention averted a potentially catastrophic bloody conflict between federal troops and Mormon settlers in the now nearly forgotten Utah War of 1857-58. Drawing on extensive, newly available (...) archives, this book is the first to tell the full story of Kane's extraordinary life. The book illuminates his powerful Philadelphia family, his personal life and eccentricities, his reform achievements, his place in Mormon history, and his career as a Civil War general. With increasing awareness of environmental issues, there has been rising demand for environmental-friendly business practices. Prior research has shown that the implementation of environmental management practices is influenced by existing and potential stakeholder groups in the form of external pressures from legislators, environmental groups, financial institutions and suppliers, as well as internally by employees and owner/manager attitudes and knowledge. However, it has been reported that despite business owner/managers having strong “green” attitudes, the level of implementation of environmental-friendly practices is low. (...) In order to explore the connection between pressures for improved practices and the management actions taken, this article examines how influence from various stakeholders is related to awareness of environmental issues, and how this awareness relates to actions taken within the businesses to reduce the environmental impact of their operations. The results indicate that legislation does result in general environmental awareness, and that organizations are then willing to␣change their business processes and environmental strategies. However, despite their actions they have little awareness of the benefits that might arise from cost reductions from their environmental-friendly practices. Those influenced by their suppliers act to reduce waste, but do not put into place formal environmental management systems, or use environmental messages to market their goods or services. Nevertheless, it can be argued that they have a real commitment to environmental issues, as evidenced by a willingness to voluntarily contribute to environmental organizations. (shrink)

For as long as humans have pondered philosophical issues, they have contemplated the good life. Yet most suggestions about how to live a good life rest on assumptions about what the good life actually is. Thomas Carson here confronts that question from a fresh perspective. Surveying the history of philosophy, he addresses first-order questions about what is good and bad as well as metaethical questions concerning value judgments. Carson considers a number of established viewpoints concerning the good life. He (...) offers a new critique of Mill's and Sidgwick's classic arguments for the hedonistic theory of value, employing thought experiments that invite us to clarify our preferences by choosing between different kinds of lives. He also assesses the desire- or preference-satisfaction theory of value in detail and takes a fresh look at both Nietzsche's Übermensch ideal and Aristotle's theory of the good life. In exploring foundational questions, Carson observes that many established theories rest on undefended assumptions about the truth of moral realism. Arguing against this stand, he defends the view that good means desirable and presents a divine-preference version of the desire-satisfaction theory. In this he contends that, if there exists a kind and omniscient God who created the universe, then what is good or bad is determined by His preferences; if such a God does not exist, what is good or bad depends on what we as rational humans desire. Value and the Good Life is the only book that defends a divine-preference theory of value as opposed to a divine-command theory of right and wrong. It offers a masterfully constructed argument to an age-old question and will stimulate all who seek to know what the good life truly is. (shrink)

Thomas L. Shaffer argues that the morals of modern American lawyers and doctors have been corrupted by misguided professionalism and weak philosophy.

Klink rejects the use of ecological models in environmental decision making because their predictions cannot be tested by rigorous scientific methods. I argue that models that cannot be tested according to the rigorous standards of the physical sciences can still be considered “scientific”; they are useful (and, in practice, used) for assessing the impacts of human actions on the environment and choosing between alternative courses of action. It is, however, important to be aware of the uncertainties and to make corrections (...) as new data and insights become available. The interplay between (1) model‐based decisions and action and (2) their consequences and subsequent corrections can be regarded as a dialogue between humans and nature (or God) in the sense proposed by Klink. Klink also claims that future actions should be informed by the larger vision of theology and should not be based on science. I suggest that science has an indispensible role. The larger vision is needed to respond to the fundamental religious question: How should I live—and why? But this question cannot be answered without first addressing the fundamental scientific question: How does the world work? I suggest that responses to the first question can be formulated as visions of a future state of existence that we feel compelled to strive to realize, and that science is necessary to provide “maps of reality” needed to realize visions. I also suggest that Christian traditions can probably provide adequate visions; the crucial need is for improving our “maps of reality.”. (shrink)

Marr's levels of analysis—computational, algorithmic, and implementation—have served cognitive science well over the last 30 years. But the recent increase in the popularity of the computational level raises a new challenge: How do we begin to relate models at different levels of analysis? We propose that it is possible to define levels of analysis that lie between the computational and the algorithmic, providing a way to build a bridge between computational- and algorithmic-level models. The key idea is to push the (...) notion of rationality, often used in defining computational-level models, deeper toward the algorithmic level. We offer a simple recipe for reverse-engineering the mind's cognitive strategies by deriving optimal algorithms for a series of increasingly more realistic abstract computational architectures, which we call “resource-rational analysis.”. There is a consensus that post-war British analytic philosophy was politically neutral. This view has been affirmed by the post-war analysts themselves, and by their critics. This paper argues that this consensus-view is false. Many central analytic philosophers claimed that their empirical philosophy had liberal outcomes, either through cultivating liberal habits of mind, or by revealing truths about the world that supported liberal conclusions. These beliefs were not subject to significant scrutiny or attempts at justification, but they do help us (...) to explain the otherwise puzzling disinclination to engage with questions of political philosophy on the part of these politically active individuals. For Emmanuel Levinas the foundation of the moral “ought” is an important question. He is skeptical, however, about using human reason or any sort of metaphysics to ground ethics. Instead he resorts to the human face as to what motivates a person to act ethically toward another person. Levinas argues that it is the nature of the human face to oblige anyone to act in an ethical way. In short, the human face commands one to be ethical. I will argue (...) that the metaphysics of being according to W. Norris Clarke and Jacques Maritain provide a corrective to Levinas’s metaphysical skepticism. Using Clarke’s metaphysics of person as the fullest expression of what it means to be, I maintain that what shines forth in the human face is the very depths of the human person. What grounds the ethical “ought” is the person. The human face is only the surface through which a deeper reality resonates. In this way, I argue for a metaphysical foundation for ethics. (shrink)

This essay examines the contemporary masculinity of straight, white men in the business classes of the United States as a category of identity. I argue that this form of masculine identity is currently in crisis, and, through a reading of the 1995 film Toy Story, develop an argument about the value of ‘downsizing’ masculinity in an era of diminished work expectations.

Languages are transmitted from person to person and generation to generation via a process of iterated learning: people learn a language from other people who once learned that language themselves. We analyze the consequences of iterated learning for learning algorithms based on the principles of Bayesian inference, assuming that learners compute a posterior distribution over languages by combining a prior (representing their inductive biases) with the evidence provided by linguistic data. We show that when learners sample languages from this posterior (...) distribution, iterated learning converges to a distribution over languages that is determined entirely by the prior. Under these conditions, iterated learning is a form of Gibbs sampling, a widely-used Markov chain Monte Carlo algorithm. The consequences of iterated learning are more complicated when learners choose the language with maximum posterior probability, being affected by both the prior of the learners and the amount of information transmitted between generations. We show that in this case, iterated learning corresponds to another statistical inference algorithm, a variant of the expectation-maximization (EM) algorithm. These results clarify the role of iterated learning in explanations of linguistic universals and provide a formal connection between constraints on language acquisition and the languages that come to be spoken, suggesting that information transmitted via iterated learning will ultimately come to mirror the minds of the learners. Normative nonrealism denies, first, that some things are good or bad independently of facts about the attitudes of moral agents and, second, that attitude-independent moral facts determine what is rational. This implies that facts about what is rational are logically prior to what is moral. Nonrealism commonly assumes (a) that moral realism is false or unjustifiable, (b) that there is a conceptual connection between morality and rationality and (c) that the particular theory of rationality is the correct account of rationality. (...) Facing the threat of relativism when abandoning (c) it is argued that (c) is at least dubious. Semantic considerations concerning the meaning of "rationality" are sketched and the full-information approach of decision making, intemalism and extemalism are discussed in the light of "Why care?"-questions with the resuh that these questions do serious damage to nonrealist approaches to rationality and reason-based morality. Political societies frequently regard philosophers as potential threats to morality and religion, and those who speak for politics often demand a defense of philosophy. This book will address philosophy as a mode of existence put into question.

The recent accounting scandals at Enron, WorldCom, and other corporations have helped to fuel a massive loss of confidence in the integrity of American business and have contributed to a very sharp decline in the U.S. stock market. Inasmuch as these events have brought ethical questions about business to the forefront in the media and public consciousness as never before, they are of signal importance for the field of business ethics. I offer some observations and conjectures about the bearing of (...) the recent scandals on the literature on business ethics. I defend the following contentions: 1. Recent events reveal serious weaknesses of the stakeholder theory about the social responsibilities of business which lacks prohibitions against fraud and deception. This is a glaring deficiency of standard versions of the stakeholder theory, but it is easily remedied by adding explicit prohibitions against fraud and deception. In addition, recent events highlight the stakeholder theory's very naive and unrealistic hopes and expectations for business executives as moral arbiters and agents of social improvement. 2. Recent events do not constitute an objection to the shareholder theory about the social responsibilities of business, however, these events make evident the implausibility of strong versions of the invisible hand theory. 3. Schemes of payment and reward often create perverse incentives for individuals to engage in unethical conduct. 4. Both the shareholder theory and the stakeholder theory need to add a constraint that requires executives to respect the professional obligations of employees. (shrink)

In 1992, I sent Milton Friedman a draft of my 1993 paper “Friedman's Theory of Corporate Social Responsibility.” He and I corresponded at length. My 1993 paper argues that Friedman's published formulations of his theory are not equivalent and that they prescribe different courses of action in many possible cases. In our correspondence, Friedman conceded that his two formulations of his theory are inconsistent and, at my suggestion, he endorsed a modified version of the view he presented in Capitalism and (...) Freedom as the preferred version of his theory. This modified theory is an important formulation of his position. In one of his letters to me, Friedman writes: “I agree that corporate executives might have duties to the general public which sometimes outweigh their duties to the shareholders.” I argue that this creates major problems for his theory. I also answer Friedman's published response to one of my criticisms. (shrink)
