I knew that this was a book a long time in the making, and one that bore the mark of many years of teaching the philosophy discussed in the work. As a publisher, you come to learn that those who have taught courses on what they’re writing about tend to do a better job than those who haven’t, especially when it comes to books, like this one, intended for a wider audience.

Florence Ashley has argued that requiring patients with gender dysphoria to undergo an assessment and referral from a mental health professional before undergoing hormone replacement therapy (HRT) is unethical and may represent an unconscious hostility towards transgender people. We respond, first, by showing that Ashley has conflated the self-reporting of symptoms with self-diagnosis, and that this is not consistent with the standard model of informed consent to medical treatment. Second, we note that the model of informed consent involved in cosmetic (...) surgery resembles the model Ashley defends, and that psychological assessment and referral is recognised as an important aspect of such a model. Third, we suggest that the increased prevalence of psychiatric morbidity in the transgender population arguably supports the requirement of assessment and referral from a mental health professional prior to undergoing HRT. Many of the reforms being required or recommended to ensure that for-profit companies achieve greater transparency and more effective governance are similarly being promoted for adoption by nonprofit health care organizations. The demands are coming from a variety of sources - government officials, donors, business partners, companies that provide directors and officers (D&O) liability insurance, the media, and directors themselves. Florence Ashley has responded to our response to ‘Gatekeeping hormone replacement therapy for transgender patients is dehumanising.’ Ashley criticises some of our objections to their view that patients seeking hormone replacement therapy (HRT) for gender dysphoria should not have to undergo a prior psychological assessment. Here we clarify our objections, most importantly that concerning the parity between cosmetic surgery and the sort of intervention Ashley has in mind. Firstly, we show Ashley’s criticism of our comparison is insubstantial. We then examine (...) their comments regarding the analogy between abortion and HRT, and the language of informed consent. We also scrutinize the data upon which Ashley relies to defend the claim that informed consent without assessment always yields positive outcomes, finding this conclusion to be overstated. Finally, even if Ashley’s arguments were vindicated, the claim that the gatekeeping of HRT is motivated by hostility towards transgender people remains unsupported. (shrink)

Leader behavioral integrity (BI) is central to perceived credibility and thus to leaders’ effectiveness at fostering ethical and other climates. Our research broadens the theoretical foundation for BI research by integrating the cognitive–attributional role of trust in the formation and maintenance of leader BI perceptions. Guided by recent research on trust primacy and prior theories of fairness used to examine ethical behavior, we examine how perceptions of leader BI can be either diminished or maintained through trust velocity following a psychological (...) contract breach. Using a field and an experimental study, we explore the manner in which followers perceive leader’s actions when conflicting interests lead to unfulfilled promises. We found that trust velocity mediates the relationship between a psychological contract breach and leader BI (study 1), and that informational justice moderates this relationship (study 2), suggesting that leaders can attenuate the impact of broken promises on ascribed BI. Our findings offer a pathway for leaders operating in dynamic contexts to preserve BI and also help address concerns that have been raised about the behavioral integrity construct regarding its conceptual overlap with related constructs such as trust, psychological contracts, and informational justice. Professors Ackerman and Alstott contrast their proposal for stakeholding with Philippe Van Parijs’s proposal for a universal basic income. InThe Stakeholder Society, Ackerman and Alstott proposed that the federal government give all U.S. citizens an $80,000 grant as they reach adulthood. The program’s revenue cost is to be funded by an annual wealth tax of 2 percent and a “payback” requirement at death. All editions and translations of Homer'sIliadpresent the epic as a series of twenty-four segments always marked off in the same places. In this respect theIliadconforms to, and seems even to originate, a practice in which narratives of any considerable length are almost always presented in marked segments, usually calledchapters.Similarly, dramas, except very short ones, usually run as a series ofactswhose dimensions are determined in the composition. Acts may be marked by curtains, intermissions or briefer pauses, or other variations in the (...) performance: in ancient Greek drama the segmentation is unmistakeably marked by the placement of choral lyrics. It is not exactly clear why the chapter and the act should be so indispensable, but authors and audiences alike know intuitively that they are. Yet many scholars since antiquity have believed that theIliadand theOdysseyoriginally lacked marked segmentation, and that the now-familiar presentation was imposed upon them later by someone other than their composer. Cloth, £50.00This is a competent, clearly written, and authoritative exploration of its topic, in some respects a labor of love, for the author is both a pastor and a student of theology. Sell comprehensively examines the proliferation of dissenting academies and nonconformist colleges of England and (...) Wales, with some excursions into the Scottish scene, from the Toleration Act of 1689 through the early twentieth century. For the 230 years of this study, a great variety of schools, many of which had only a brief moment of existence, and most of which were barely funded, offered training for the ministers of over a dozen protestant denominations in Britain. Often one man provided instruction in subjects as diverse as mathematics, science, and literature—as well as religious fields.Sell does not focus on ministerial training or even theology, but the way in which the nonconforming religious élite expounded on and was taught philosophy. Thus, one sees how a diverse group that surely had sectarian needs in mind was also interested in grasping how thinkers outside its belief system approached basic problems of human existence. Over time Descartes and other continental rationalists, Locke and the Cambridge Platonists, Kant and Hegel, and the nineteenth-century British idealists were taught by the dissenting professoriate. In summarizing its interpretation, Sell presents a history of modern Anglo-European philosophy as it was refracted in the minds of (some) English-speaking Protestants. Their emphases are not unexpected: empiricism is somewhat devalued, and rationalistic and a priori modes of thinking perhaps inflated. The ethical implications of epistemology and metaphysics are most carefully explicated, and what is taken to be most strategic for [End Page 211] Reformed theology is underscored. Overall, if one is tempted to generalize (as Sell himself does not), the positions reached are credible and not out of line with the philosophical cutting edge of each era.For the most part the dissenters were not themselves creative philosophers of the first rank, but Sell rightly puts forward (206) a short list of thinkers at these schools who have genuine claims to merit, and my own very short list would include Richard Price, James Martineau, and Robert Mackintosh.The author uses diverse strategies to give readers a sense of the effort of these mostly forgotten men. To some extent the book is a biographical compendium, with brief sections on individual or paired thinkers. But Sell also offers coverage by denomination, and he adds a series of discussions by topics—on an assortment of recurring dilemmas in moral philosophy and on apologetics. A final and most useful feature of the book is a trio of indices, in addition to the very full notes and a complete bibliography, mainly of the writings of the many authors cited. Two of the indices are standard, but helpful, lists of persons and topics; the third one is a compendium of all the academies Sell treats, as well as their denominational affiliation, and the duration of their existences.Philosophy, Dissent, and Nonconformity has the defects of its virtues. It is encyclopedic in nature, available for reference but unlikely to be read as a synthetic book, except by devotees of a certain kind of historical philosophical theology. The author also presumes his readers are unlikely to tackle the volume unless they have a prior attraction. That is, the book is written without much contextual explication, and attention to the needs of the non-specialist certainly would have made the volume of wider interest. There are two traditional ways to read Kant's claim that every event necessarily has a cause: the weaker every-event some-cause and the stronger same-cause same-effect causal principles. The focus of the debate about whether and where he subscribes to the SCP has been in the Analogies in the Critique of Pure Reason and in the Metaphysical Foundations of Natural Science. By analysing the arguments and conclusions of both the Analogies and the Postulates as well as the two Latin principles non (...) datur casus and non datur fatum that summarise their results, I will argue for the novel thesis that the SCP is actually demonstrated in the Postulates of the First Critique. Self-managing teams have been predicted to break down organizational hierarchies and sex-segregated functional divisions. Based on participant observation and interviews with 39 men and women in service-oriented self-managing teams, the authors found that the metaphor of family emerged in interviews as a popular way to describe teams' interaction and social relations. The ways that team members used the family metaphor revealed that women were often perceived in familial roles that the authors argue encourage emotional labor. Although relational tasks may not (...) directly reproduce traditional gender power relations in teams, women can face difficulties taking on more instrumental team tasks. The authors propose that the persistence of family metaphors sustains the organizational gender categorization that self-managing teams as work-based, cross-functional groups were supposed to help eliminate. To the extent that this is the case, it suggests the importance of exploring the gendered organizational cultures that exist alongside structural arrangements. (shrink)

Methane emissions from sheep and cattle production have gained increasing profile in the context of climate change. Policy and scientific research communities have suggested a number of technological approaches to mitigate these emissions. This paper uses the concept of co-production as an analytical framework to understand farmers’ evaluation of a 'good animal’. It examines how technology and sheep and beef cattle are co-produced in the context of concerns about the climate change impact of methane. Drawing on 42 semi-structured interviews, this (...) paper demonstrates that methane emissions are viewed as a natural and integral part of sheep and beef cattle by farmers, rather than as a pollutant. Sheep and beef cattle farmers in the UK are found to be an extremely heterogeneous group that need to be understood in their specific social, environmental and consumer contexts. Some are more amenable to appropriating methane reducing measures than others, but largely because animals are already co-constructed from the natural and the technical for reasons of increased production efficiency. Benjamin Zolf, in his recent paper ‘No conscientious objection without normative justification: Against conscientious objection in medicine’, attempts to establish that in order to rule out arbitrary conscientious objections, a reasonability constraint is necessary. This, he contends, requires normative justification, and the subjective beliefs that ground conscientious objections cannot easily be judged by normative criteria. Zolf shows that the alternative of using extrinsic criteria, such as requiring that unjustified harm must not be caused, are likewise grounded on normative criteria. He (...) concludes that conscientious objection is therefore untenable. Here, I present an alternative account, based on the value we are willing to place on conscientious objection as an expression of freedom of conscience and religion. Using an extrinsic criterion such as harm, we can make a judgement of what degree of harm should be tolerated as the cost of permitting conscientious objection. A normative criterion for judging individual claims is therefore not required. (shrink)

Räsänen has attempted to make a moral case for permitting some people to change their legal age: if someone considers that their chronological age does not correspond to their emotional age or biological age, and they face age-based discrimination as a result, they may change the legal record of their age. This response considers some of the problems with Räsänen’s paper, including its reliance on equivocation. This article examines parallels between the increasing mental burnout and environmental overshoot in the organisational context. The article argues that there is a particular philosophy of management that connects these two phenomena of overshoot and burnout, namely productivism. As there are boundaries in all ecological processes and systems, the productivist aim of having ever more output and growth is deemed absurd. It is proposed that productivity as a management philosophy not only leads to mental ill-health in organisations but also to (...) overshoot in the environment. The article concludes that productivism, which denies the limits in utilisation of humans and other natural resources, fits poorly with circular economy and sustainability. Hence, ecological management should be complemented with a more holistic and processual view of organizations, as well as have an aim of peaceful coexistence between all earthbound objects. This signifies acknowledging and caring for human and non-human needs both now and in future by applying the idea of moderation to production of goods and services. (shrink)

La doctrine de droit international privé a tendance à organiser le rapport entre le droit de l’Union européenne et les réglementations nationales de droit international privé par le biais des principes de hiérarchie normative et d’attribution de compétence, de sorte que l’on s’interroge principalement sur le contenu et les limites de la nécessaire adaptation du droit national à la construction européenne. Le droit international privé est ainsi soumis à l’épreuve du droit européen. À l’inverse, à partir d’une conception alternative du (...) rapport entre les deux, comme un conflit entre visions du droit différentes, nous proposons de soumettre le droit de l’Union européenne, en particulier l’application des libertés de circulation par la Cour de justice de l’Union européenne, aux outils analytiques de droit international privé. En particulier, les notions de droit applicable, lois de police et exception d’ordre public vont nous permettre de mieux comprendre l’originalité et particularité de la « cosmologie juridique » qui anime cette jurisprudence. En un segundo apartado, trataremos la obra Ravel, Ravel, Unravel (2013) en la que debatimos las manipulaciones del tiempo (...) y el espacio. Abstract“Clinical ethics consultants” have been practicing in the United States for about 50 years. Most of the earliest consultants—the “pioneers”—were “outsiders” when they first appeared at patients' bedsides and in the clinic. However, if they were outsiders initially, they acclimated to the clinical setting and became “insiders” very quickly. Moreover, there was some tension between traditional academics and those doing applied ethics about whether there was sufficient “critical distance” for appropriate reflection about the complex medical ethics dilemmas of the day (...) if one were involved in the decision making. Again, the pioneers deflected concerns by identifying and instituting safeguards to assure professional objectivity in clinical ethics consultation services. One might suggest that in moving inside and establishing normative practices, the pioneer clinical ethics consultants anticipated adoption of their routines and professionalization of the field. Philosophers writing on the subject of human action have found it tempting to introduce their subject by raising Wittgenstein's question, 'What is left over if you subtract the fact that my arm goes up from the fact that I raise my arm?' The presumption is that something of particular interest is involved in an action of raising an arm that is not present in a mere bodily movement, and the philosopher's task is to specify just what this is. Unfortunately, such (...) an approach does not take us very far, since a person could properly be said to raise his (or her) arm while asleep or hypnotized even though he (or she) would not be performing an action in the sense of 'action' with which philosophers are particularly concerned. To avoid this kind of difficulty I shall approach the subject of human action is a more academic way: I shall expound some important rival theories of human action, and introduce the relevant issues by commenting critically on those theories. One of the issues I eventually introduce is a metaphysical one. A theory of action makes sense, I contend, only on the assumption that there are such 'things' as actions (or events). After considering some key arguments bearing on the issue I conclude that, as matters currently stand in philosophy, a metaphysically noncommittal attitude toward actions and events seems justified. This study investigates financial correlates of corporate philanthropy in Fortune 1000 companies using structural equation modeling. The results suggest that cash flow (one of the most discretionary types of organizational slack) has a significant impact on a firm’s cash donations to charitable causes, but monetary donations do not affect firm financial performance. These findings support the accepted view of corporate philanthropy as a discretionary social responsibility and the traditional thinking about firm giving in the business and society literature—that doing well (...) enables doing good. Contrary to some contemporary thinking, the findings imply no significant effect on profits from corporate generosity. (shrink)

According to what Jonathan Bennett calls the Kant–Frege view of existence, Frege gave solid logical foundations to Kant’s claim that existence is not a real predicate. In this article I will challenge Bennett’s claim by arguing that although Kant and Frege agree on what existence is not, they agree neither on what it is nor on the importance and justification of existential propositions. I identify three main differences: first, whereas for Frege existence is a property of a concept, for Kant (...) it is a relational property pertaining between the concept and intuition of an object. Second, whereas for Frege truth about individuals presupposes their existence, for Kant truth is in many cases independent of the existence of objects. Third, whereas Frege binds logic to existence and removes modalities from logic, for Kant existence is a modal category that is emphatically removed from the domain of logic and set in the core of metaphysics. Due to these differences in Kant’s and Frege’s theories of existence, Frege cannot be seen as giving logical clarity to Kant’s view. (shrink)

The Darwinian concept of natural selection was conceived within a set of Newtonian background assumptions about systems dynamics. Mendelian genetics at first did not sit well with the gradualist assumptions of the Darwinian theory. Eventually, however, Mendelism and Darwinism were fused by reformulating natural selection in statistical terms. This reflected a shift to a more probabilistic set of background assumptions based upon Boltzmannian systems dynamics. Recent developments in molecular genetics and paleontology have put pressure on Darwinism once again. Current work (...) on self-organizing systems may provide a stimulus not only for increased problem solving within the Darwinian tradition, especially with respect to origins of life, developmental genetics, phylogenetic pattern, and energy-flow ecology, but for deeper understanding of the very phenomenon of natural selection itself. Since self-organizational phenomena depend deeply on stochastic processes, self-organizational systems dynamics advance the probability revolution. In our view, natural selection is an emergent phenomenon of physical and chemical selection. These developments suggest that natural selection may be grounded in physical law more deeply than is allowed by advocates of the autonomy of biology, while still making it possible to deny, with autonomists, that evolutionary explanations can be modeled in terms of a deductive relationship between laws and cases. We explore the relationship between, chance, self-organization, and selection as sources of order in biological systems in order to make these points. (shrink)

The author discusses the contributions of grounded theory and grounded action to the development of a new, and evolutionary, theoretical framework for understanding diversity as a complex phenomenon. She discusses the work of Thomas and Gregory as pioneers in expanding the conceptualization of diversity, arguing that this new understanding increases the potential for creative action in systems.

Theories of autonomy divide into two conflicting categories: theories that emphasize freedom to choose among alternatives, and theories that focus on personal authenticity. This conflict can be resolved by recognizing the basic function of natural authenticity, and its deep roots in human and animal behavior. Authenticity functions to keep options open that might be too hastily abandoned. Thus forms a natural symbiotic union with autonomy as alternatives. Human authenticity is a special adaptation, but it is not different in kind from (...) the authenticity of many other species. My naturalistic account of authenticity avoids traditional problems concerning willing addicts and happy slaves and reaffirms the traditional link between authenticity and autonomous choices among alternatives.
