This paper explores the American bankruptcy system -- especially the Chapter 11 code -- which since 1978 has allowed insolvent companies the opportunity to restructure and reorganise with the benefit of court protection from creditors. Particular attention is focused on asbestos companies, such as Johns--Manville, which have been among the most consistent and controversial filers for bankruptcy under Chapter 11. The history of asbestos and Chapter 11 is explored, against the backdrop of the burgeoning asbestos crisis, caused by increasing mortality (...) and litigation. Some of the business and ethical issues involved are highlighted by examining in detail a recent bankruptcy (Federal Mogul/T&N in 2001) that has implications in both Britain and America. Chapter 11 bankruptcy is evaluated, particularly in the light of the trend towards similar mechanisms of insolvency in the UK, Europe and the rest of the world. It is concluded that, certainly as regards the experience with asbestos, Chapter 11 offers an inefficient and inequitable method of rehabilitating or rescuing failing businesses. (shrink)

Philosophy, Music and Emotion explores two contentious issues in contemporary philosophy: the nature of music´s power to express emotion, and the nature of emotion itself. It shows how closely the two are related and provides a radically new account of what it means to say that music "expresses emotion." Geoffrey Madell maintains that most current accounts of musical expressiveness are fundamentally misguided. He attributes this fact to the influence of a famous argument of the nineteenth-century critic Hanslick, and also (...) to the dominant "cognitivist" approach to the nature of emotion, which sees the essence of emotion to be the entertaining of evaluative judgments and beliefs. This book argues that the cognitivist account of the nature of emotion is false and should be replaced with a conception of emotions as states of feeling. Central to this bold analysis is a new account of two closely connected mental states, desire and pleasure, and their role in human motivation. (shrink)

discounting the future' is one on which philosophers and economists have divergent professional views. There is a lot of talking at cross-purposes across the disciplinary divide here; but there is a fair bit of confusion (I think) within disciplines as well. My aim here is essentially clarificatory. I draw several distinctions that I see as significant: • between inter-temporal and intergenerational questions • between price (discount rate) and quantity (inter-temporal and intergenerational allocations) as the ethically relevant magnitude, and • between (...) price change and preference change as the primary instrument of change. I show that discounting does not violate the principle of inter-temporal and intergenerational neutrality, but I also cast some doubt on whether making adequate allowance for future generations has really been the problem that economists and philosophers seem to have taken it to be. In 2005, Chinese President Hu Jintao instituted a “Harmonious Society” policy marking a new China’s approach toward development. This generated intense excitement among observers of Corporate Social Responsibility (CSR) who perceive an overlap in objectives between CSR and Harmonious Society and believe that Harmonious Society will lead to increased CSR engagement in China. However, there is little exploration of how Harmonious Society will contribute to increasing CSR engagement. This article seeks to explore whether Harmonious Society will meet this promise. It (...) does so by drawing up a list of actions that if taken by the government would increase the level of CSR in China and make Harmonious Society a relevant factor in the development of Chinese CSR. To do so, my article studies comparative literature on CSR development to develop a framework that divides causes of CSR in a country into environmental constraints and discretionary responses. Understanding what drives the development of CSR allows us to understand what measures the Chinese government can take to influence the level of CSR. Using this framework, my article suggests that Harmonious Society is unlikely to promote CSR in China’s growing private sector because policy measures that affect the “constraints” driving CSR are bounded by other political considerations. Presidential addresses offer an opportunity to reflect on the history of our subject and where the history of science stands in our own day. Such reflections are particularly appropriate with the fiftieth anniversary of the founding of the British Society for the History of Science which is marked in 1997. Some may consider that looking back over our past is either an unacceptable luxury or an occasion for the kind of celebration that can all too easily degenerate into hagiography and (...) an excuse to rake over the past in a thoroughly uncritical manner. This address – and I trust the events of 1997 – will try to avoid such excesses and instead contribute to the historiography of our subject. (shrink)

BackgroundRegularity effect can affect performance in prospective memory, but little is known on the cognitive processes linked to this effect. Moreover, its impacts with regard to aging remain unknown. To our knowledge, this study is the first to examine regularity effect in PM in a lifespan perspective, with a sample of young, intermediate, and older adults.Objective and designOur study examined the regularity effect in PM in three groups of participants: 28 young adults, 16 intermediate adults, and 25 older adults. Derrida's earlier work has a good deal to say about the question of metaphor. Very strikingly in view of Derrida's later thematic interest in the question of animality, metaphor is also presented in a piece on Edmond Jabès as an “animality of the letter,” as “the primary and infinite equivocality of the signifier as Life”. “White Mythology” argues for a certain irreducibility of “metaphor in the text of philosophy”. The trajectory of Derrida's thought here is especially difficult to capture, but (...) seems to be circling around the question of being itself and to involve a crucial detour via Heidegger, and more notably his notion of the als‐Struktur. This point of Derrida's thinking must also be thought beyond the reach of any ontology and of any “thinking of being,” to which the early remarks on metaphor might seem to be leading us, but which the thought of dissemination always resists. Considerable evidence has demonstrated that people are not only sensitive to the information contained in concrete imagistic gesture, but furthermore, that they combine this gestural information with the accompanying speech in order to understand the full semantic meaning that a speaker conveys in a message. There is, however, very little experimental evidence concerning how people deal with more abstract metaphoric gestures and whether they extract meaning from these gestures and combine this with the information in the accompanying speech. The two (...) studies reported here investigated this issue by comparing and contrasting the effects of metaphoric gesture-speech matches and mismatches on both semantic communication and social judgment. The studies found that individuals do combine the information contained in metaphoric gestures with that contained in speech and that the meaning of the utterance is demonstrably affected by the presence of a gesture-speech mismatch. The second study found that in messages in which there are gesture-speech mismatches, participants seemed to like the speaker less and were less likely to believe what they said. The implications of these studies for a range of domains, including advertising and politics, are discussed. (shrink)

Contemporary archaeologists commonly acknowledge moral responsibilities to the descendants of the subjects whose remains they disturb. There has been comparatively little reflection within the professional community on whether they have duties to the dead themselves. I argue that doing wrong to the dead is not reducible to harming their successors; that there are ways in which archaeologists can wrong the dead qua the living persons they once were; and that nevertheless this may not have such radical implications for the practice (...) of archaeology as might first be imagined. Because commemorations of historic events say as much about the present as the past, it is important to think carefully about how and why we should remember the Great War in the centenary year of its outbreak. Commemoration must not be allowed to degenerate into mere mass entertainment, thoughtless celebration of martial valour, an occasion for chauvinism, or an advertisement for the merits of war as a means of settling international disputes. More respectable reasons for commemorating the Great War are (...) that it provides opportunities to learn from past mistakes, to reaffirm some common core values, and to pay our respects to those who died in their country’s service. I argue, however, that each of these justifications raises serious problems of interpretation and application, and that careful thought and moral sensitivity are needed if our efforts at commemoration are not to send out the wrong messages. Whether inference is supported by evidence, and whether classification is correct may be questions of law. It has recently emerged that malarial, toxoplasmodial and related parasites contain a vestigial plastid (the organelle in which photosynthesis occurs in plants and algae). The function of the plastid in these obligate intracellular parasites has not been established. It seems likely that modern apicomplexans derive from photosynthetic predecessors, which perhaps formed associations with protists and invertebrates and abandoned autotrophy in favour of parasitism. Recognition of a third genetic compartment in these parasites proffers alternative strategies for combating a host of important (...) human and animal diseases. It also poses some fascinating questions about the evolutionary biology of this important group of pathogens. (shrink)
