Progress in transplantation outcomes depends on continuing research into both donor and recipient factors that may enhance graft and patient survival. A system of licencing for transplantation research, introduced by the Human Tissue Act 2004, which separates it from the transplantation process (then exempt from licencing), has damaged this vital activity by a combination of inflexible interpretation of the 2004 Act and fear of criminal liability on the part of researchers. Now, following the European Union (EU) Directive (2010) on standards (...) of quality and safety of human organs intended for transplantation, new UK Regulations have been drafted, which are intended to implement it. These Regulations impose a compulsory licencing system, similar to that for research, on the whole transplantation process. This goes beyond what is required by the Directive and may even have an inhibitory effect similar to that already seen in research. Initial draft Regulations went further, imposing criminal sanctions for breaches. However, following a public consultation process, the Department of Health (DH) has recently stated that, as a result of the overwhelming view of respondents that the proposed licencing system was unnecessary, all sanctions under the final Regulations are now decriminalised, with the sole exception of operating without a licence. While this does not eliminate the negative effect of licencing, it does suggest an awareness of the DH that excessive regulation unnecessarily harms the transplantation process. An opportunity thus arises for the Human Tissue Authority (the regulatory body for both the new licences and research licences under the 2004 Act) to end the current illogical and harmful separation of transplantation and transplantation research by ensuring that all centres licenced for organ donation, retrieval and transplantation are also fully licenced for related research. Say that some things compose something, if the latter is a whole, fusion, or mereological sum of the former. Then the thesis that composition is identity holds that the composition relation is a kind of identity relation, a plural cousin of singular identity. On this thesis, any things that compose a whole are identical with the whole. This article argues that the thesis is incoherent. To do so, the article formulates the thesis in a plural language, a symbolic language that (...) includes counterparts of plural constructions of natural languages, and shows that it implies that nothing has a proper part. A plurality or plural object is a single object that is also many, and pluralitism is the thesis that there is such an object. This paper argues that pluralitism and closely related theses (e.g., the many-one identity thesis and the composition as identity thesis) violate logic. To do so, it formulates an approach to the logic and semantics of plural constructions that results in plural logic and relates treatments of plural constructions to accounts of natural number. And it gives a (...) critical examination of Frege’s views of numbers and plural constructions, and sketches the view of plural constructions as devices for talking about the many (as such), and an account of natural numbers as properties of a special kind, plural properties. All markets are embedded in ethical relations and moral discourses. This is often forgotten or ignored in alternative agrofood studies, where there has been a frequent assumption that ‘ethics’ can be inserted into markets (Trentmann, 2007), or are only acknowledged in products certified as ‘ethical’ and suchlike (Barnett, Cloke, Clarke, & Malpass, 2005). This paper takes a different approach, choosing to explore how a mainstream commodity, widely associated with the development of capitalist agriculture (Mintz, 1985), is unavoidably embedded in (...) both a set of moral discourses and a web of ethical relations (Goodman, Maye, & Holloway, 2010). Specifically, I offer a critical reading of the moral discourses that circulated between the Caribbean Sugar Protocol signatories and the European Union in the context of the 2006–2009 European Union Sugar Reform. The paper looks at how both Caribbean and European actors negotiated ‘fairness’ and in doing so, reconfigured their historical relationship. I discuss how a relational—or ethical—approach to fairness was evoked in certain instances, disrupting the European Union's (EU) neoliberal rhetoric. Contributing to the literature around ‘moral geographies’ (Jackson & Ward, 2008; Proctor et al., 1999; Smith, 1999) and also to agrofood studies, I conclude by affirming the significance of a relational approach to how the ‘fairness’ of the EU Sugar Reform might be comprehended and to how the ethics of neoliberal market reform can be more generally understood and critiqued. COVID-19 is unique in that it is the first global pandemic occurring amidst a crowded information environment that has facilitated the proliferation of misinformation on social media. Dangerous misleading narratives have the potential to disrupt ‘official’ information sharing at major government announcements. Using an interrupted time-series design, we test the impact of the announcement of the first UK lockdown on short-term trends of misinformation on Twitter. We utilise a novel dataset of all COVID-19-related social media posts on Twitter from the (...) UK 48 hours before and 48 hours after the announcement. We find that while the number of tweets increased immediately post announcement, there was no evidence of an increase in misinformation-related tweets. We found an increase in COVID-19-related bot activity post-announcement. Topic modelling of misinformation tweets revealed four distinct clusters: ‘government and policy’, ‘symptoms’, ‘pushing back against misinformation’ and ‘cures and treatments’. (shrink)

This volume presents a sketch of the Meaning-Text linguistic approach, richly illustrated by examples borrowed mainly, but not exclusively, from English. Chapter 1 expounds the basic idea that underlies this approach—that a natural language must be described as a correspondence between linguistic meanings and linguistic texts—and explains the organization of the book. Chapter 2 introduces the notion of linguistic functional model, the three postulates of the Meaning-Text approach (a language is a particular meaning-text correspondence, a language must be described by (...) a functional model and linguistic utterances must be treated at the level of the sentence and that of the word) and the perspective “from meaning to text” for linguistic descriptions. Chapter 3 contains a characterization of a particular Meaning-Text model: formal linguistic representations on the semantic, the syntactic and the morphological levels and the modules of a linguistic model that link these representations. Chapter 4 covers two central problems of the Meaning-Text approach: semantic decomposition and restricted lexical cooccurrence (≈ lexical functions); particular attention is paid to the correlation between semantic components in the definition of a lexical unit and the values of its lexical functions. Chapter 5 discusses five select issues: 1) the orientation of a linguistic description must be from meaning to text (using as data Spanish semivowels and Russian binominative constructions); 2) a system of notions and terms for linguistics (linguistic sign and the operation of linguistic union; notion of word; case, voice, and ergative construction); 3) formal description of meaning (strict semantic decomposition, standardization of semantemes, the adequacy of decomposition, the maximal block principle); 4) the Explanatory Combinatorial Dictionary (with a sample of complete lexical entries for Russian vocables); 5) dependencies in language, in particular—syntactic dependencies (the criteria for establishing a set of surface-syntactic relations for a language are formulated). Three appendices follow: a phonetic table, an inventory of surface-syntactic relations for English and an overview of all possible combinations of the three types of dependency (semantic, syntactic, and morphological). The possible future EU membership of Turkey has become one of the most hotly debated topics both in the EU and within Turkey itself. Underlying this debate are competing principles of international ethics.

From the political point of view, European Union (EU) integration implies some kind of unity in the community constituted by EU citizens. Unity is difficult to attain if the diversity of citizens (and their nations) is to be respected. A thick bond that melts members' diversity into a 'European pot' is therefore out of the question. On the other hand, giving up unity altogether makes political integration impossible. Through a meta-theoretical analysis of normative positions, this paper proposes a composed notion (...) of European identity that links without binding. It contains four facets – cultural, political, social, external – with nuances, expressed in three binaries, that cut across all of them – history-project, ethos-achievement, commonness-uncommonness. I will submit that a workable European identity (and the related concepts of unity, polity and citizenship) can be better conceived as analogical – a mid way between blending unity and irreconcilable diversity. In this article, I argue that Hannah Arendt’s well-known but controversial distinction between labour, work, and action provides, perhaps unexpectedly, a conceptual grounding for transforming politics and policy-making at the EU level. Beyond the analysis and critique of modernity, Arendt brings the conceptual resources needed for the EU to move beyond the modern trap it fell into thirty years ago. At that time, the European Commission shifted its purpose away from enhancing interdependence among Member States with a common market towards (...) achieving an internal market in the name of boosting growth and creating jobs. Arendt provides the conceptual tools to transform the conceptualisation of relations and of agents that fuels the growing dissatisfaction among many Europeans with EU policy-making. This argument is made through stretching and re-articulating Arendt’s labour-work-action distinction and taking seriously both the biological and plural dimensions of the human condition, besides its rational one. By applying this shift in an EU context, EU policies could change their priorities and better address the needs and expectations of plural political agents and of European citizens. (shrink)

This paper focuses on the integration of generic software such as enterprise resource planning into organisational life. These applications have gained prominence as the IT systems of choice in many organisations. The perspective that dominates the literature studying these applications reflects a rationality based on alignment of the software and organisational processes and fails to consider the ethical issues that arise when a new work system is being constructed, such as the possibilities for end‐user participation. Drawing on the strand of (...) research that studies implementations of new technologies as social relations, this paper considers the experiences of end user groups as they engage in adaptation of the software and embed technology in contexts of local use. Design and use activities are complex and multifaceted and the embedding of software for local use represents an overlap between them. This paper explores whether the shift towards large scale generic software allows for a blurring of a boundary between what are construed as design activities and use activities in applications for office work. It is significant to the construction of this boundary that office work is gendered female in the U.K. where clerical and secretarial work is usually done by and considered to be suited to women. The paper draws on a case study of the introduction and integration of a generic software application for supporting the administration of student records at a UK university to explore the social relations of end‐user participation in the implementation of these software packages. The paper presents an analysis of the implementation activity, IToffice worker relations, and the different constructions of skills and knowledge understood to be required as the workers attempted to deal with this software application. This thesis problematises the bases of soft power, that is, causal mechanisms connecting the agent (A) and the subject (B) of a power relationship. As the literature review reveals, their underspecification by neoliberal IR scholars, the leading proponents of the soft power concept, has caused a great deal of scholarly confusion over such questions as how to clearly differentiate between hard and soft power, how attraction (soft power’s primary mechanism) works and what roles structural and relational forces play in hard/soft (...) power. In an effort to ascertain the bases, I address this issue not from the viewpoint of A’s policies or resources, like do IR neoliberal scholars, but in terms of B’s psychological perception of A. Employing social psychological accounts, I argue that attraction can be produced in three distinct ways, namely 1) through B’s identification with A (“emotional” attraction), 2) via B’s appreciation of A’s competence/knowledge in a particular field (“rational” attraction) and 3) by means of the activation of B’s internalised values which contextually prescribe B to act in A’s favour (“social” attraction). Importantly, depending upon the way attraction is produced, it is peculiar in a number of characteristics, the main of which are power scope, weight and durability. Insights from social psychology also show that unlike soft power, hard power requires not only B’s relevant perception of the A-B relationship (as coercive or rewarding), but also A’s capability to actualise a threat of punishment and/or a promise of reward. I argue this difference can be fairly treated as definitional rather than empirical, which implies that coercion and reward necessarily have both relational and structural dimensions, whereas for attraction, a structural one alone suffices, while a relational one may or may not be present. Having explicated the soft power bases, I illustrate each of them using three “most likely” case studies, namely Serbia’s policies towards Russia (emotional attraction), Kazakhstan’s approach to relations with the EU (rational attraction) and Germany’s policies vis-à-vis Israel (social attraction). This paper examines the recent UK House of Commons Health Committee report on the Influence of the Pharmaceutical Industry in relation to its findings and recommendations concerning access to medicines, and in particular the continuance of cost effectiveness or reference pricing. This mechanism of bargaining down the price of drugs on social justice grounds recently has been targeted by the US Department of Commerce as an unjustifiable non-tariff barrier to trade that should be eliminated in all OECD countries. Concerns have (...) been raised that certain provisions in the AUSFTA may have been designed to achieve this end, in defiance of norms of democratic legitimacy, moral responsibility and the international right to health. With focus on the development and use of artificial intelligence (AI) systems in the digital health context, we consider the following questions: How does the European Union (EU) seek to facilitate the development and uptake of trustworthy AI systems through the AI Act? What does trustworthiness and trust mean in the AI Act, and how are they linked to some of the ongoing discussions of these terms in bioethics, law, and philosophy? What are the normative components of trustworthiness? And how (...) do the requirements of the AI Act relate to these components? We first explain how the EU seeks to create an epistemic environment of trust through the AI Act to facilitate the development and uptake of trustworthy AI systems. The legislation establishes a governance regime that operates as a socio-epistemological infrastructure of trust which enables a performative framing of trust and trustworthiness. The degree of success that performative acts of trust and trustworthiness have achieved in realising the legislative goals may then be assessed in terms of statutorily defined proxies of trustworthiness. We show that to be trustworthy, these performative acts should be consistent with the ethical principles endorsed by the legislation; these principles are also manifested in at least four key features of the governance regime. However, specified proxies of trustworthiness are not expected to be adequate for applications of AI systems within a regulatory sandbox or in real-world testing. We explain why different proxies of trustworthiness for these applications may be regarded as ‘special’ trust domains and why the nature of trust should be understood as participatory. (shrink)

The European Union Emissions Trading System (EU ETS) is in dire straits. Prone to design problems and suffering from the effects of the economic crises the scheme is criticised for its poor achievements. In this paper we will analyse some of the features of this situation from an ethical perspective. The major part is dedicated to the complications within each phase of the EU ETS and to the recent developments it has undergone. We will briefly discuss the remedies suggested by (...) prominent commentators. Furthermore, any policy tool to tackle climate change should be evaluated in view of the profound equity issues that are inherent to the climate problem. We will evaluate the EU ETS according to two justice-based criteria, related to effectiveness and the distribution of the duties involved in climate change, respectively. We will conclude that the EU ETS, in its current form, clearly lacks fairness on both criteria. However, the biggest problem is the unwillingness of EU leaders to mend, what could be, a commendable climate policy tool. To that extent, we argue, those leaders are acting unjustly. (shrink)

Num primeiro momento, analisa-se de que forma Merleau-Ponty, em contraste com as filosofias empirista e racionalista, reformula a noção da subjetividade, num plano fenomenológico e ontológico. O Eu se define não mais por uma sorte de pensamento, ou por uma causalidade de leis físicas e (...) químicas, mas pelo entrelaçamento na carnalidade do mundo. Em seguida, investiga-se a noção de projeção em Freud, a fim de evidenciar como tal conceito ocupa a função de “proteção” para o Eu. A projeção limita o “lugar” necessário para que o Eu possa se desenvolver, conforme mecanismo de defesa. Por fim, sustenta-se que a noção de Eu merleau-pontyano e a projeção freudiana convergem, na medida em que ambas só podem ser pensadas como experiências dentro de um mundo de relações que ocorrem por uma dimensão inconsciente, aproximando-se, assim, com a proposta de Pereira Jr..: This article takes as its starting point a text by Alfredo Pereira Jr. which discusses Merleau-Ponty’s notion of the sentient Self and the concept of “projection” in Freudian psychoanalysis. First we analyze how Merleau-Ponty, in contrast to empiricist and rationalist philosophies, reformulates the notion of subjectivity on a phenomenological and ontological plane. The Self is no longer defined by a kind of thought or by the causality of physical and chemical laws, but by its entanglement in the carnality of the world. Second, the notion of projection in Freud is investigated in order to show how this concept occupies the function of “protection” for the Self. Projection limits the necessary “place” for the Self to develop. Finally, it is argued that Freud’s concept of projection and Merleau-Ponty’s notion of the Self converge, since both can only be thought of as experiences within a world of relations that occur in an unconscious dimension; it is in this sense that our proposal is similar to that of Pereira Jr. (shrink)

Greenland has a special relationship with the European Union due to its link with the Kingdom of Denmark - Greenland’s mother country. As a result, Greenland shares some parts of the EU’s internal market via association agreements. Greenland, has become a meeting place of American, European and Asian interests in the Arctic. It is therefore essential that the EU doesn’t lose the North and keeps strengthening its relationship with Greenland. The notion of a “third food regime” implies simultaneous processes of further global concentration and integration and at the same time resistance through new emerging producer–consumer relations. This paper examines these processes by looking at Austria over the last 30 years. While direct producer–consumer cooperatives established at an early point, today forms of community supported agriculture are rare. This paper explains this by identifying a shift of the entire food system from “food from nowhere” to “food from here.” The (...) account follows the early emergence of alternative food networks through the political appeal to consumer patriotism in connection with Austria joining the EU, to a sustained positioning of retail chains with regional and national food products. The paper argues that this satisfies the needs of a large proportion of consumers and discourages the emergence of new food initiatives. The paper follows the development of different approaches and their transformations until today. Thus a picture evolves of changing, and partly progressing consumer–producer relations in response to wider societal and political transformation processes. The results explain why the movement towards CSA is currently weak in Austria, but demonstrate at the same time how alternative food networks may contribute to a transformation of the food system. The paper aims to investigate the relationship between knowledge production and coloniality, guided by the question of alterity in the epistemological context of modern subjectivity. Seeking to understand how the relationship between subjectivity and identity (or sameness) occurs, consequently, between objectivity and alterity (or otherness) in modernity, we will seek to critically answer questions essential to philosophical practice in contemporaneity: a) what does the counterpart of the “I” consist of in this philosophy more consecrated among us and for whom the (...) canon is, as such, the ultimate legacy of the legitimate and the true? b) Which can be the possibilities of these “others” coming to relate in a dialogical and positive way to this canonical philosophy? c) Which consequences can be drawn from these responses from the point of view of the constitution of an integrated multiplicity of global and pluriversal knowledges, from which all living beings on planet Earth, and the planet itself, could truly benefit? The European elections on June 9th, 2024, coincided with another early parliamentary election in Bulgaria. As in the previous election campaigns, domestic political problems and sharp party opposition overshadowed the EU- related issues. Although proper political debates on these issues were absent, strong populist anti-EU narratives were used by various parties and politicians, including established ones. The research shows anti-EU narratives in all three categories of populist messages: anti-elitism, people-centrism, and exclusion. Four parties (“Revival”, “Greatness”, BSP and ITN) form a (...) “discursive coalition” claiming to understand and express the concerns and desires of “the people”. They present the EU as a foreign elitist power, claim that the sovereignty should be restored to the Bulgarian people, and exclude the liberal values and liberal elites (parties, media) from “the people”. A particular anti-EU narrative is formed about the war in Ukraine. These narratives are characterised by a high propensity to use proven disinformation. (shrink)

The Nursing and Midwifery Council, the United Kingdom regulator of nursing and midwifery has recently revised its professional code of practice. This article begins by arguing that a professional code must be capable of sustaining close reading and of action guidance. Using four exemplar clauses, it is argued that the new revised code does not meet this purpose. First, I show that in setting out requirements for consent and documentation, the meaning of the relevant clause has changed significantly during the (...) editing process so that a literal reading of the final document bears little relation to established professional practice. Second, I argue that the clause concerning the nature of professional relationships has also been altered during the editing process so that it is inconsistent with other professional groups and established accounts of the professional nurse–patient relationship. Third, I argue that the clause concerning disclosure of confidential information, which survived revision and editing with its meaning intact, is nevertheless factually incorrect and inconsistent with UK law and authoritative guidance. Finally, fourth, I argue that use of the word ‘inappropriate’ is inappropriate as it amounts to meaningless circularity, discussed in relation to a clause on expressing personal beliefs. Taken together, these examples demonstrate that the Code is seriously flawed and does not fulfil its purpose. One way that simple prescriptive clauses in the Code can be usefully understood is through the provision of detailed guidance. I argue that the Nursing and Midwifery Council has changed its position on its view of the value of guidance and has significantly reduced the amount of written guidance and advice it provides. The article concludes by arguing that in order to meet its action directing function, further clarifying revision and the provision of detailed guidance is required. (shrink)

The number of surplus frozen human embryos in storage in the United Kingdom (UK) is at its highest level since records began in 1991 and the formation of the UK Human Fertilisation and Embryology Authority (HFEA). This study features a quantitative analysis of data from 1991 to 2019 provided by the HFEA as well as a commentary on observed trends within this data. We also discuss trends relating to the final destiny of surplus embryos. Data analysis show that at least (...) 130,000 stored embryos have been discarded in the UK since 1991, while another 500,000 embryos are currently being stored in a frozen state, of which a significant proportion is likely to be discarded in the future. However, this creates a moral dilemma since UK legislation relating to human embryos is based on the 1984 Warnock Report which recognizes that they have a special moral status. (shrink)

Should CSR be approached only on a voluntary basis or should it be complemented with a compulsory regulatory framework? What type of government intervention is more effective in fostering CSR among companies? This paper is an attempt to answer these questions, reviewing the debate between proponents of the voluntary case and the obligatory case for CSR, and critically analysing current international government-led initiatives to foster CSR among companies, and national government-led initiatives in the EU area. Finally, the paper focuses on (...) the Spanish case, as an example of the failure of an exclusively voluntary approach. Despite the rapid uprise of CSR, Spain is still far behind late in CSR promotion strategies. Most action has been undertaken by companies themselves with no common guidelines, governmental support, or independent verification. The lack of a regulatory framework for CSR or ethical investment issues and the virtual absence of other indirect incentives, explains the misbalance between private, public and Third Sector initiatives. Based on the Spanish context which is quite similar to other non-OECD countries, the authors call for a more proactive government position in CSR related issues. The conclusions of the paper detail the features of this regulatory framework and other policies to promote CSR in Spain as well as in other OECD countries. (shrink)

Mutual perceptions of ethical behaviour among managers in nine EU-countries were quantatively measured and related to perceptions concerning "ease of cooperation". A strong positive correlation obtains: the more ethical a country is perceived to be, the higher it is valued as an international business partner. Germany, however, is a typical exception to this rule: German managers are perceived as the most ethical, but are considered relatively difficult to cooperate with.

In this paper, we analyse the recent rapid growth of ‘binge’ drinking in the UK. This means the rapid consumption of large amounts of alcohol, especially by young people, leading to serious anti-social and criminal behaviour in urban centres. British soccer fans have often exhibited this kind of behaviour abroad, but it has become widespread amongst young people within Britain itself. Vomiting, collapsing in the street, shouting and chanting loudly, intimidating passers-by and fighting are now regular night-time features of many (...) British towns and cities. A particularly disturbing aspect is the huge rise in drunken and anti-social behaviour amongst young females. Increasingly, policy makers in the West are concerned about how not just to regulate but to alter social behaviour. Smoking and obesity are obvious examples, and in the UK ‘binge’ drinking has become a focus of acute policy concern. We show how a simple agent based model approach, combined with a limited amount of easily acquired information, can provide useful insights for policy makers in the context of behavioural regulation. We show that the hypothesis that the rise in binge drinking is a fashion-related phenomenon, with imitative behaviour spreading across social networks, is sufficient to account for the empirically observed patterns of binge drinking behaviour. The results show that a small world network, rather than a scale-free or random one, offers the best description of the data. (shrink)

Our study analyses the nature, quality and extent of human resource disclosures of UK Financial Times Stock Exchange 100 firms by relying on a novel disclosure index measuring the depth and breadth of disclosures. Contextually, we focus on the 5-year period following the then Labour government’s attempts to encourage firms to formally report on their human resource management practices and to foster deeper employer–employee engagement. First, we evaluate the degree to which companies report comprehensively on a number of HRD items (...) that we classify as “procedural” or “sustainable.” Second, we hypothesise that a company’s employee relation ideology is positively associated with HRD. Our results indicate that: whilst there has been an increase in the breadth of HRD in terms of procedural and sustainable items being disclosed, the evolution towards a more comprehensive and in-depth form of HRD remains rather limited; and there is a positive association between a company’s employee relation ideology and the level of HRD. Theoretically, we conceive of HRD both as a reflection of an organisation’s orientation towards a key stakeholder and a legitimacy seeking exercise at a time of changing societal conditions. We contribute to the scant literature on the extent and determinants of HRD since prior research tends to subsume employee-related disclosures within the broader concept of social, ethical or intellectual capital disclosures. In this paper, we propose a methodology to maximize the benefits of interdisciplinary cooperation in AI research groups. Firstly, we build the case for the importance of interdisciplinarity in research groups as the best means to tackle the social implications brought about by AI systems, against the backdrop of the EU Commission proposal for an Artificial Intelligence Act. As we are an interdisciplinary group, we address the multi-faceted implications of the mass-scale diffusion of AI-driven technologies. The result of our exercise (...) lead us to postulate the necessity of a behavioural theory that standardizes the interaction process of interdisciplinary groups. In light of this, we conduct a review of the existing approaches to interdisciplinary research on AI appliances, leading to the development of methodologies like ethics-by-design and value-sensitive design, evaluating their strengths and weaknesses. We then put forth an iterative process theory hinging on a narrative approach consisting of four phases: definition of the hypothesis space, building-up of a common lexicon, scenario-building, interdisciplinary self-assessment. Finally, we identify the most relevant fields of application for such a methodology and discuss possible case studies. (shrink)

The problem of wasteful clinical trials has been debated relentlessly in the medical community. To a significant extent, it is attributed to redundant trials – studies that are carried out to address questions, which can be answered satisfactorily on the basis of existing knowledge and accessible evidence from prior research. This article presents the first evaluation of the potential of the EU Clinical Trials Regulation 536/2014, which entered into force in 2014 but is expected to become applicable at the end (...) of 2021, to prevent such trials. Having reviewed provisions related to the trial authorisation, we propose how certain regulatory requirements for the assessment of trial applications can and should be interpreted and applied by national research ethics committees and other relevant authorities in order to avoid redundant trials and, most importantly, preclude the unnecessary recruitment of trial participants and their unjustified exposure to health risks. Background As part of its response to the 2014 Ebola outbreak in west Africa, the United Kingdom government established an Ebola treatment unit in Sierra Leone, staffed by military personnel. Little is known about the ethical challenges experienced by military medical staff on humanitarian deployment. We designed a qualitative study to explore this further with those who worked in the treatment unit. Method Semi-structured, face-to-face and telephone interviews were conducted with 20 UK military personnel deployed between October 2014 and April (...) 2015 in one of three roles in the Ebola treatment unit: clinician; nursing and nursing assistant; and other medical support work, including infection control and laboratory and mortuary services. Results Many participants reported feeling ethically motivated to volunteer for deployment, but for some personal interests were also a consideration. A small minority had negative feelings towards the deployment, others felt that this deployment like any other was part of military service. Almost all had initial concerns about personal safety but were reassured by their pre-deployment 'drills and skills', and personal protective equipment. Risk perceptions were related to perceptions about military service. Efforts to minimise infection risk were perceived to have made good patient care more difficult. Significantly, some thought the humanitarian nature of the mission justified tolerating greater risks to staff. Trust in the military institution and colleagues was expressed; many participants referred to the ethical obligation within the chain of command to protect those under their command. Participants expected resources to be overwhelmed and ‘empty beds’ presented a significant and pervasive ethical challenge. Most thought more patients could and should have been treated. Points of reference for participants’ ethical values were: previous deployment experience; previous UK/National Health Service experience; professional ethics; and, distinctly military values. Conclusion We report the first systematic exploration of the ethical challenges face by a Western medical military in the international response to the first major Ebola outbreak. We offer unique insights into the military healthcare workers’ experiences of humanitarian deployment. Many participants expressed motivations that gave them common purpose with civilian volunteers. Questionamos se esses alunos, no cotidiano do labor magisterial, nos momentos constituintes do agir ético em diálogo com a estética da profissão, vivem a realidade viva do ato da docência de sujeitos, pelo primado da individualidade e da alteridade no plano do reencontro, no (...) mundo real, do ato particular da experiência vivida com o mundo social da profissão. Os fundamentos da teoria dialógica de Bakhtin e seu Círculo respaldam a discussão proposta.ABSTRACT In this paper we discuss culture in the public space of schools based on essays by pre-service student teachers in a Portuguese Language and Literature Teaching Credential Program. In these essays, the pre-service student teachers form representations of self-other relations while practicing their student teaching in supervised internships. We questioned whether these pre-service student teachers, in the practice of their field experience, in decisive moments of ethical practice in dialogue with the aesthetics of the profession, experience themselves as actual teaching subjects, through the primacy of individuality/otherness in the encounter between the physical world of life experience, and the professional world of social experience. Resumo Este artigo examina as considerações de Nietzsche acerca das fontes sociais e históricas do eu como um contra-argumento à concepção liberal de indivíduo. Defendo que Nietzsche oferece não apenas uma crítica contundente à concepção associal e previamente individuada de pessoa, à qual se conecta a noção liberal de liberdade, como ainda um contra-conceito alternativo de pessoa e de soberania. Seus argumentos visam mostrar, em sua dimensão crítica, que o indivíduo ou pessoa é inseparável de seus objetivos ou valores, que (...) são socialmente constituídos, e que nossa capacidade como indivíduos, especialmente para a agência soberana, é o produto de uma longa história e pré-história social. Em sua dimensão construtiva, encontramos em Nietzsche a contra alegação de que a manutenção e o cultivo de nossas capacidades são dependentes de relações de um antagonismo ponderado entre nós mesmos enquanto indivíduos, ou antes: como dividua. Esses argumentos serão desenvolvidos no que se segue em consonância com quatro principais linhas de pensamento: sobre as origens sociais e o caráter da consciência ; sobre a história e a constituição social de nossa capacidade como indivíduos soberanos [sovereign] ; sobre as origens sociais do fenômeno moral ; e sobre a destruição fisiológica do sujeito moral substancial, seguida da reconstrução fisiológica.This essay examines Nietzsche's thought on the social and historical sources of the self as a counter-argument against the liberal concept of the individual. Nietzsche, it is argued, offers a powerful critique of the asocial, antecedently individuated concept of personhood, to which the liberal notion of freedom is attached, but also an alternative counter-concept of personhood and sovereignty. On the critical side are arguments to the effect that the individual or person is inseparable from its ends or values, which in turn are socially constituted, and that our capacities as individuals, especially for sovereign agency, are the product of a long social history and pre-history. On the positive side is the constructive counter-claim that the maintenance and cultivation of our capacities for productive, autonomous agency is dependent on relations of measured antagonism both between and within us as individuals, or rather: as dividua. These arguments are reconstructed along four main lines of thought: on the social origins and character of consciousness ; on the history and social constitution of our capacities as sovereign individuals ; on the social origins of moral phenomena, understood as internalisations of communal norms ; and Nietzsche's physiological destruction of the substantial moral subject, coupled with the physiological reconstruction of the subject as dividuum. Children’s unpleasant experiences with misuse of their personal information online is among the rapidly increasing online ‘risks’. Among these, four were chosen for this study: dealing with their own hacked accounts, dealing with others’ fake accounts, dealing with fake accounts impersonating them and sending rude messages on their behalf with the intent of damaging their reputation, and dealing with receiving rude messages from hacked accounts of friends were reported as most bothersome in EU Kids Online III. These four subtypes of (...) problematic situations related to privacy were strategically chosen to illustrate children’s coping responses to situations that are related but increasingly complex, distinctions related to whether situations involved peers or strangers, whether children were direct victims of hacked accounts, or recipients of unwelcomed or rude messages sent from fake profiles and/or hacked accounts. Furthermore, the four situations were chosen to develop a more inclusive coping typology for EU Kids Online data, which can span across different types of risks. This article relies heavily on theoretical work put forward by research on coping with general and specific stressors but integrates approaches to children’s dealing with online issues relevant for online safety measures. This article examines how women’s and gender-equality issues form part of social movement organizations’ ideological framing and discusses how this tendency is mirrored in discourses at European and nation-state levels. Focusing on one of Western Europe’s few non-EU member countries, the article compares how two Norwegian social movement organizations draw on gender issues in their argumentation. The analysis is empirically based on written material produced by the organizations and takes recourse in a feminist methodological approach rooted in the tradition of (...) discourse analysis. The analysis suggests that gender-related issues discussed by the organizations are coloured by an implicit North–South hierarchy which frames some areas, nations and cultures as more gender-equal and women-friendly than others. By drawing on notions conceptualized by Nira Yuval-Davis, it is argued that social movement organizations’ tendency to frame women’s issues and gender-equality in a way that implicitly marks and maintains symbolic boundaries between North and South is coloured by a ‘politics of belonging’ at the macro-level. The final discussion suggests some of the ways in which it may be problematic to see Nordic gender-equality traditions and current EU initiatives as universal solutions that fit all women living in Europe. This paper aims at analyzing and presenting the findings of an inquiry carried out in the spring of 2006 in Bucharest. The inquiry itself originally set out to investigate the effect of different gender and religious beliefs and practice with respect to couple formation and related issues, with particular reference to varying corresponding attitudes towards relationships between the men and women. The inquiry was conducted on a sample of inhabitants of Bucharest, the capital city, and one of the most significant (...) urban areas of Romania on the verge of EU accession. Statistically, significant differences were observed with respect to couple formation, depth of religious beliefs, and the corresponding degree of religious practice, in addition to the stated reasons for marriage in the first place, and hence, to the prospective partner’s attributes and selection criteria, both subjective (emotional) and objective (practical and pragmatic). In this paper I would like to present a brief description of the issues in English-Polish translation in the field of antitrust. Ever since Poland became a part of the broadening European integration, the Polish antitrust laws have been strongly “Europeanised”. Many new linguistic elements exist in both the Polish language of antitrust law and Polish legal language. Whatever the cause, the result is a decrease in the quality of the language. The issues of concern are divided into two groups. (...) The first relates to producing Polish versions of EU legal documents concerning antitrust. The second is related to translating English language of antitrust for the purposes of drafting national documents concerning antitrust, both legal documents and documents that are not legally binding. I will then turn to areas where a change is needed and propose measures that might be helpful in the current circumstances. (shrink)

The aim of this article is to shed light on women’s experience of informal trade on one of the EU external borders: Belarus–Lithuania. The article suggests looking at the informal economy beyond the notion of precarity and to pay attention to how women themselves understand their involvement in trading practices. The author argues that, although economic necessity is an important motivation for women to start trading activities, this experience rewards them not only financially but also through non-economic aspects such as (...) self-respect, solidarity and socializing. Theoretically, the article brings together the discussion of the gendered nature of informal work with the feminist theory of agency. It shows that women’s experience of informal cross-border trade is agentive. Trade provides women with a sense of pride, self-confidence and respect and enables them to recognize their self-sufficiency. However, it is also argued that agency is not synonymous with autonomy and individualism. Theoretically and empirically, the article stresses a relational understanding of agency. On the one hand, women acknowledge their financial achievements as the capability to take proper care of their children, especially in situations when the second breadwinner is absent. On the other hand, they also value their trading experience as a space of socializing with other women. The success of cross-border trade depends on the sense of solidarity and collective action to resist the system represented by customs and border control. (shrink)

The Lisbon Treaty’s ratification is complete. This article makes two related claims, one ethical, the other empirical. First, the EU should now be developed with the aim of making it a (more) just institution; and second, the amendments to the Treaties now introduced provide the constitutional inspiration so that the EU can so develop. In particular, there is a prospect for appropriate standards of justice to be applied in part through a revised philosophy of EU law. The article argues that (...) a human rights based approach to values, although not without its difficulties, provides the least divisive and most effective means of achieving this revision. Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at international level (...) due to absence of a single authoritative body to provide guidance on interpretation and application of the 1951 Refugee Convention. Considering that the judgments of the EU Court are part of the EU law, the Member States should develop their national asylum law with due regard being taken to those judgments. By the beginning of 2012, the Court has issued eight judgments on the interpretation of various problematic issues of EU asylum law. This Article analyses the jurisprudence of the EU Court in asylum cases, related to the granting of refugee status and subsidiary protection. It also provides a critical evaluation of those judgments. The main objective of the Article is to familiarise the relevant Lithuanian institutions and lawyers with the first judgments of the EU Court in asylum cases and encourage discussions concerning the application of rules established by the Court in the Lithuanian context. Due to limited size, this Article presents the analysis of two EU Court judgments adopted on interpretation of the 2004 Qualification Directive: Elgafaji v. The Netherlands (2009) dealing with granting of subsidiary protection, and Abdulla and others v. Bundesrepublik Deutschland (2010), dealing with cessation of refugee status. The value of those judgments first of all lies in the guidance they provided to the Member States on such concepts as: protection in a situation of an armed conflict, agents of protection, effectiveness of protection; as well as determination of a relationship between refugee status and subsidiary protection, relationship of the Qualification Directive with the European Convention on Human Rights and Fundamental Freedoms (ECHR), also cessation of protection. Elgafaji decision, while quite liberal with regard to persons seeking international protection, is not so liberally applied in the Member States’ practice and does not in itself guarantee positive outcome of the application of a concrete individual fleeing from an armed conflict, or a liberal approach to granting subsidiary protection in the Member States. Based on Elgafaji judgment it is clear that: Art. 15(b) of the Qualification Directive correspond to Art. 3 ECHR, while Art. 15(c) provides additional protection and in that it expands the Member States’ obligations beyond the ECHR to provide protection to persons fleeing in situations of armed conflict. While not every person arriving from an armed conflict situation would automatically fall under the granting of subsidiary protection, in certain exceptional situations indiscriminate violence may amount to individual threat without invoking personal circumstances. The EU Court departed from the individualisation requirement applied by the European Court of Human Rights in Art. 3 cases and did not also rely on international humanitarian law, by introducing a “sliding scale” formula for establishing an individual threat in armed conflict situation instead. This formula addressed the alleged internal discrepancy between “individual threat” and “indiscriminate violence”. The Abdulla decision brought in the human rights and law enforcement perspectives to the interpretation of cessation clauses, however it represents a rather superficial approach in the context of the analysed concepts (e.g. towards effectiveness of protection provided by the multinational armed forces) and is likely to be incompatible with the latest legislative trends in the EU asylum instruments (e.g. determination of refugee status and subsidiary protection by means of a single procedure) and the recent jurisprudence under the ECHR (e.g. failure to ensure a minimum standard of living may violate the ECHR). Design: Qualitative interview study. Participants: Fifty-nine patients with a family history of cancer who attend a regional cancer genetics clinic in the UK were interviewed about their current and previous research experiences. Findings: Interviewees gave a range of explanations for research participation. These were categorised as social—research participation benefits the wider society by progressing science and improving treatment for everyone; familial—research participation may improve healthcare and benefit current or future generations of the participant’s family; and personal—research participation provides therapeutic or (...) non-therapeutic benefits for oneself. Conclusions: We discuss the distinction drawn between motives for research participation focused upon self and others, and observe that personal, social and familial motives can be seen as interdependent. For example, research participation that is undertaken to benefit others, particularly relatives, may also offer a number of personal benefits for self, such as enabling participants to feel that they have discharged their social or familial obligations. We argue for the need to move away from simple, static, individualised notions of research participation to a more complex, dynamic and inherently social account. (shrink)

Should CSR be approached only on a voluntary basis or should it be complemented with a compulsory regulatory framework? What type of government intervention is more effective in fostering CSR among companies? This paper is an attempt to answer these questions, reviewing the debate between proponents of the voluntary case and the obligatory case for CSR, and critically analysing current international government-led initiatives to foster CSR among companies, and national government-led initiatives in the EU area. Finally, the paper focuses on (...) the Spanish case, as an example of the failure of an exclusively voluntary approach. Despite the rapid uprise of CSR, Spain is still far behind late in CSR promotion strategies. Most action has been undertaken by companies themselves with no common guidelines, governmental support, or independent verification. The lack of a regulatory framework for CSR or ethical investment issues and the virtual absence of other indirect incentives, explains the misbalance between private, public and Third Sector initiatives. Based on the Spanish context which is quite similar to other non-OECD countries, the authors call for a more proactive government position in CSR related issues. The conclusions of the paper detail the features of this regulatory framework and other policies to promote CSR in Spain as well as in other OECD countries. (shrink)

The EU AI Act is the first step toward a comprehensive legal framework for AI. It introduces provisions for AI systems based on their risk levels in relation to fundamental rights. Providers of AI systems must conduct Conformity Assessments before market placement. Recent amendments added Fundamental Rights Impact Assessments for high-risk AI system users, focusing on compliance with EU and national laws, fundamental rights, and potential impacts on EU values. According to the International Relations theory known as Realism, interstate interactions, whether ancient or modern, are motivated by the pursuit of hegemony of individual states, which act as monolithic groups in articulating their foreign policy decisions. The application of Realism to the study of Spartan foreign policy in the third century BC shows the validity of this theory in explaining certain aspects of ancient interstate interactions, as illustrated by the two alliances discussed in this article. The first, earlier alliance, (...) between King of Macedonia Antigonos Gonatas and Sparta and some Peloponnesian cities, was made in response to the threat posed by King Pyrrhus of Epirus who was set on conquering them. The later alliance, between Sparta and other states, was made to stop the ambitions of King Antigonos Gonatas who controlled many cities of the Peloponnese and sought to conquer the whole of Greece. In forging such alliances, according to the Realist view, the states acted as large monolithic groups, yet a broader assessment of the available evidence shows the presence of smaller, subtler networks of individuals, which were paramount in articulating important foreign policy decisions. The comparison of Spartan decision making with the activation in 2009 of the EU’s Solidarity Clause, included in Article 222 of The Treaty on the Functioning of the European Union (TFEU), indicates that the activation of this clause too required the consensus of several European governing bodies. By bringing to light the critical role played by smaller networks of power in foreign policy decision making in the ancient and the current-day EU alliances, this article exposes both the merits and the limits of the Realist international relations theory.
