ABSTRACTNon‐governmental aid programs are an important source of health care for many people in the developing world. Despite the central role non‐governmental organizations play in the delivery of these vital services, for the most part they either lack formal systems of accountability to their recipients altogether, or have only very weak requirements in this regard. This is because most NGOs are both self‐mandating and self‐regulating. What is needed in terms of accountability is some means by which all the relevant stakeholders (...) can have their interests represented and considered. An ideally accountable decision‐making process for NGOs should identify acceptable justifications and rule out unacceptable ones. Thus, the point of this paper is to evaluate three prominent types of justification given for decisions taken at the Dutch headquarters of Médecins sans Frontières. They are: population health justifications, mandate‐based justifications and advocacy‐based justifications. The central question at issue is whether these justifications are sufficiently robust to answer the concerns and objections that various stakeholders may have. I am particularly concerned with the legitimacy these justifications have in the eyes of project beneficiaries. I argue that special responsibilities to certain communities can arise out of long‐term engagement with them, but that this type of priority needs to be constrained such that it does not exclude other potential beneficiaries to an undesirable extent. Finally, I suggest several new institutional mechanisms that would enhance the overall equity of decisions and so would ultimately contribute to the legitimacy of the organization as a whole. This response addresses criticisms in this journal of an Editorial written by Willem Landman and Udo Schuklenk. I demonstrate that the UNESCO Declaration on Bioethics and Human Rights is in crucial aspects deficient, despite attempts in this journal to defend the Declaration against its critics. I focus on individual versus societal interests, research ethics, informed consent and the use of “human dignity” to illustrate the weaknesses of the UNESCO Declaration on Bioethics and Human Rights. This article concludes with (...) reflections on what documents such as the UNESCO Declaration on Bioethics and Human Rights ought to be called to avoid the mislabelling of what essentially are policy documents. Since the early 20th century, bioethics in South Africa has moved through several stages, responding to the same forces and developments as elsewhere, for example in the United Kingdom and United States. In addition, some unique developments in South Africa, for example the death of Steve Biko, the HIV/AIDS pandemic, and a peaceful transition to democracy with increased focus on human rights have given bioethics in South Africa its own dimension. Bioethics in South Africa reflects the general concerns of the (...) field elsewhere, but it also stands at the intersection of the concerns of both developed and developing worlds. Thus, issues such as resource allocation, HIV/AIDS, and medical research take on an urgency and character that reflect South Africa's particular historical, geographical, and social conditions. Wilfrid Sellars has been called "the most profound and systematic epistemological thinker of the twentieth century". He was in many respects ahead of his time, and many of his innovations have become widely acknowledged, for example, his attack on the "myth of the given", his functionalist treatment of intentional states, his proposal that psychological concepts are like theoretical concepts, and his suggestion that attributions of knowledge locate the knower "in the logical space of reasons". However, while many philosophers have begun (...) to acknowledge Sellars's inspiration in their work, their interpretation of his thought has not always been the most accurate. His writings are difficult. Individually, his essays are complex and sometimes rely on doctrines and arguments he put forward elsewhere. Each of his articles is deepened and strengthened by seeing it in its systematic context, but he never wrote a unified exposition of his system, which therefore has to be pieced together from numerous disparate sources. Willem deVries addresses these difficulties specifically and provides a careful reading and remarkable overview of Sellars's systematic philosophy that will become the standard point of reference for all philosophers seeking to understand Sellars's hugely significant body of work. We describe a number of conscientious objection cases in a liberal Western democracy. These cases strongly suggest that the typical conscientious objector does not object to unreasonable, controversial professional services—involving torture, for instance—but to the provision of professional services that are both uncontroversially legal and that patients are entitled to receive. We analyse the conflict between these patients' access rights and the conscientious objection accommodation demanded by monopoly providers of such healthcare services. It is implausible that professionals who voluntarily join (...) a profession should be endowed with a legal claim not to provide services that are within the scope of the profession's practice and that society expects them to provide. The terms “politics” and “political” have become so overdetermined that it is difficult to use them in any effective manner. We argue that this has dangerous political consequences, and that this could be addressed by providing a new, sounder, notion of politics. This paper argues that defining politics in relation to the notion of play can provide a notion both intuitively appealing and able to withstand the problematic overdeterminations. We argue that politics is the set of practices through which the (...) indeterminate of Spielraum is made more determinate. This suggests that politics is always partly a matter of play: it is about instituting values without making any claims about the legitimacy of this instituting act. With reference to Huizinga and Nietzsche’s analyses of play, we define play as the living unity of seriousness and frivolity, and non-play as either seriousness without frivolity or frivolity without seriousness. In order to illustrate this, we comparatively analyse the attitudes of Barack Obama and Donald Trump in the single context of the well-known yearly White House Correspondent’s Dinner. There, we see two opposed attitudes to playfulness. Our analysis allows us to apply our _Spielraum_ model of politics to show that the thrust of Obama’s attitude involves an embrace of the non-foundational nature of politics as play, whereas Trump’s attitude is politicidal: it is animated by a refusal to acknowledge its own lack of foundation, leading to an oscillation between over-seriousness and over-frivolity. We argue that, in certain circumstances, doctors might beprofessionallyjustified to provide abortions even in those jurisdictions where abortion is illegal. That it is at least professionally permissible does not mean that they have an all-things-considered ethical justification or obligation to provide illegal abortions or that professional obligations or professional permissibility trump legal obligations. It rather means that professional organisations should respect and indeed protect doctors’ positive claims of conscience to provide abortions if they plausibly track what is in the best (...) medical interests of their patients. It is the responsibility of state authorities to enforce the law, but it is the responsibility of professional organisations to uphold the highest standards of medical ethics, even when they conflict with the law. Whatever the legal sanctions in place, healthcare professionals should not be sanctioned by the professional bodies for providing abortions according to professional standards, even if illegally. Indeed, professional organisation should lobby to offer protection to such professionals. Our arguments have practical implications for what healthcare professionals and healthcare professional organisations may or should do in those jurisdictions that legally prohibit abortion, such as some US States after the reversal ofRoe v Wade. This paper examines two strategies aimed at demonstrating that moral obligations to improve global health exist. The ‘humanitarian model’ stresses that all human beings, regardless of affluence or global location, are fundamentally the same in terms of moral status. This model argues that affluent global citizens’ moral obligations to assist less fortunate ones follow from the desirability of reducing disease and suffering in the world. The ‘political model’ stresses that the lives of the world's rich and poor are inextricably linked (...) because of harmful state-to-state actions and because of the currently existing transnational institutions. These institutions’ design at once secures the high standard of living of the affluent and reinforces the continued foreseeable—and avoidable—deprivation of many of the global poor; and these give rise to compensatory health-related moral obligations beyond borders. This paper argues that political reasoning is unsuitable for the crucial task of determining priority in the receipt of health aid. We conclude that in the context of global health ethics, political reasoning must be supplemented with, if not replaced by, humanitarian reasoning. (shrink)

Universities are occupied by management, a regime obsessed with ‘accountability’ through measurement, increased competition, efficiency, ‘excellence’, and misconceived economic salvation. Given the occupation’s absurd side-effects, we ask ourselves how management has succeeded in taking over our precious universities. An alternative vision for the academic future consists of a public university, more akin to a socially engaged knowledge commons than to a corporation. We suggest some provocative measures to bring about such a university. However, as management seems impervious to cogent arguments, (...) such changes can only happen if academics take action. This article provides an analysis of moral emotions from an attributional point of view, guided by the metaphors of man as a naïve scientist (Heider, 1958) and as a moral judge (Weiner, 2006). The theoretical analysis focuses on three concepts: (a) The distinction between the actor and the observer, (b) the functional quality of moral emotions, and (c) the perceived controllability of the causes of events. Moral emotions are identified (admiration, anger, awe, contempt, disgust, elevation, embarrassment, envy, gratitude, guilt, indignation, (...) jealousy, pity, pride, rage, regret, remorse, resentment, respect, schadenfreude, scorn, shame, and sympathy). A classification of these moral emotions is suggested and the empirical evidence briefly summarized. In discussing our results, we identify unresolved issues awaiting further analyses and research. BackgroundSexual boundary violations in healthcare are harmful and exploitative sexual transgressions in the professional–client relationship. Persons with mental health issues or intellectual disabilities, especially those living in residential settings, are especially vulnerable to SBV because they often receive long-term intimate care. Promoting good sexual health and preventing SBV in these care contexts is a moral and practical challenge for healthcare organizations.MethodsWe carried out a qualitative interview study with 16 Dutch policy advisors, regulators, healthcare professionals and other relevant experts to explore (...) their perspectives on preventing SBV in mental health and disability care organizations. We used inductive thematic analysis to interpret our data.ResultsWe found three main themes on how healthcare organizations can prevent SBV in mental health and disability care: setting rules and regulations, engaging in dialogue about sexuality, and addressing systemic and organizational dimensions.ConclusionOur findings suggest that preventing SBV in mental health and disability care organizations necessitates setting suitable rules and regulations and facilitating dialogue about positive aspects of sexuality and intimacy, as well as about boundaries, and inappropriate behaviors or feelings. Combining both further requires organizational policies and practices that promote transparency and reflection, and focus on creating a safe environment. Our findings will help prevent SBV and promote sexual health in mental health and disability care organizations. (shrink)

Background: The advent of AIDS brought about a group of patients unwilling to accept crucial aspects of the methodological standards for clinical research investigating Phase 1 drugs, surgeries or devices. Their arguments against placebo controls in trials, which depended-at the time-on the terminal status of patient volunteers led to a renewed discussion of the ethics of denying patients with catastrophic illnesses access to last-chance experimental drugs, surgeries or devices. Sources of data: Existing ethics and health policy literature on the topic (...) of access to experimental drugs. Areas of agreement: The positions of those arguing for or against free access to experimental drugs for terminally ill patients are irreconcilable. Areas of controversy: At stake are questions about the kinds of personal sacrifices society can reasonably expect patients in clinical trials to make to ensure statistically predictive results. These would benefit by necessity a much larger number of current and future patients-the conflict is about individual versus public interests. It is also about the question of whether or not the state can legitimately prevent patients with terminal illnesses from unfettered access to experimental drugs, surgeries or devices in order to motivate them to participate in clinical trials. We review the ethical arguments for and against the provision of access to Phase 1 agents for terminally ill patients. Growing points: Finding a compromise between providing free or no access to Phase 1 drugs for terminally ill patients. Areas timely for developing research: We ought to investigate means to increase access to experimental drugs for terminally ill patients without sacrificing necessary clinical trials' sounds scientific methods. Adolescence is a crucial developmental window because it involves elaboration of the self‐concept, the laying down of lifelong autobiographical memories, and the development of emotional resilience during a time of substantial risk for mood problems. Autobiographical memory retrieval plays an important role in depression both in adults (Citationvan Vreeswijk & de Wilde, 2004) and adolescents (Kuyken, Howell, & Dalgleish, 2005; CitationPark, Goodyer, & Teasdale, 2002). This study examined facets of autobiographical memory associated with memory retrieval in never‐depressed and currently depressed (...) adolescents: personal importance, imagery, recency, source monitoring, and field‐observer perspective. Compared with never‐depressed adolescents, adolescents with depression were significantly more likely to retrieve memories from an observer perspective and more recent time period, preferentially rehearsed negative memories and rated their memories as more personally important. Depressed adolescents who reported a history of trauma retrieved more vivid autobiographical memories than depressed adolescents not reporting such a history, had rehearsed them more frequently, and reported more confidence in their veracity. Many contemporary atheists find support in what they take to be the methodology and findings of science. In response to this, it is often suggested that these atheists are wrong‐headed, and that religion and science are completely compatible. It is often claimed by critics that the widespread acceptance of philosophical naturalism by scientifically informed people results from a simple mistake. Evolutionary theory is best regarded as a sort of atheistic religion. This myth crops up frequently, as does the idea that (...) evolutionary theory is inherently antireligious. The essentials of contemporary evolutionary theory are robust—they have so much empirical support that they are almost certainly true. Negotiating proves a precarious ability. The development of the arts of compromise and negotiating is not self-evident. Confrontation, flight and direct physical attack prove much more tempting in human history. How did these skills develop? The typical power and dependency network that evolved in western Europe in particular, is a significant factor. Different patterns of emotion management emerged in interaction with changing power balances. These patterns bred the skills of negotiating and compromise.

Dietzgen's philosophy is monistic in nature. This study is focused on the question in what way Dietzgen treats the relation between unity and diversity as an epistemological and ontological issue. How does Dietzgen formulate the unity of all that exists, and what is the place and the role of the process of gaining knowledge in this formulation? These questions serve as stepping stones to the central question: What is the position of Dieagen's thinking with regard to the philosophy of Feuerbach, (...) and that of Marx and Engels? This is an important question in the light of the history of the labour movement. In the early years of this century, Dietzgen's work became a subject of discussion. Some said that Dietzgen had nothing to add to Feuerbach's philosophy; others regarded him as the perfect Marxist philosopher. This discussion has not ended. The present study seeks to clarify the positions in this discussion by means of an analysis of Dietzgen's philosophy itself. This raises the additional questions of it's relation to Kant's epistemological theory, to scientific and Darwinist-oriented materialism, and to Dietzgen's ethical ideas and criticism of religion. The problem of simultaneous measurement of incompatible observables in quantum mechanics is studied on the one hand from the viewpoint of an axiomatic treatment of quantum mechanics and on the other hand starting from a theory of measurement. It is argued that it is precisely such a theory of measurement that should provide a meaning to the axiomatically introduced concepts, especially to the concept of observable. Defining an observable as a class of measurement procedures yielding a certain prescribed result for (...) the probability distribution of the set of values of some quantity (to be described by the set of eigenvalues of some Hermitian operator), this notion is extended to joint probability distributions of incompatible observables. It is shown that such an extension is possible on the basis of a theory of measurement, under the proviso that in simultaneously measuring such observables there is a disturbance of the measurement results of the one observable, caused by the presence of the measuring instrument of the other observable. This has as a consequence that the joint probability distribution cannot obey the marginal distribution laws usually imposed. This result is of great importance in exposing quantum mechanics as an axiomatized theory, since overlooking it seems to prohibit an axiomatic description of simultaneous measurement of incompatible observables by quantum mechanics. The German end-of-life vehicle take-back system is described and analyzed in terms of its impact on the environment and the car companies involved. It is concluded that although this system is often cited as an example of a successful take-back scheme, it is not one that maximizes the value recovered from end-of-life vehicles. As a result, corporations do not achieve the potential benefits that can be realized from an alternate value chain based on recovering value from end-of-life products. Neither is (...) society benefiting from the potential reduction in pollution and from making its way of life more sustainable.
