Cet article s’attache à comprendre si les cyrénaïques étaient susceptibles d’être attaqués moyennant l’objection d’inactivité et, si oui, comment ils auraient pu essayer d’y répondre et quel type de vision morale ils auraient pu essayer de défendre. En traitant de ces questions, j’évaluerai la légitimité de l’interprétation du scepticisme cyrénaïque offerte par Jules Vuillemin. Je confirmerai ainsi la plausibilité de son interprétation et développerai en même temps l’exploration de la nature et de la portée de la philosophie cyrénaïque.

This work deals with the exponential fragment of Girard's linear logic without the contraction rule, a logical system which has a natural relation with the direct logic . A new sequent calculus for this logic is presented in order to remove the weakening rule and recover its behavior via a special treatment of the propositional constants, so that the process of cut-elimination can be performed using only “local” reductions. Hence a typed calculus, which admits only local rewriting rules, can be (...) introduced in a natural manner. Its main properties — normalizability and confluence — has been investigated; moreover this calculus has been proved to satisfy a Curry-Howard isomorphism with respect to the logical system in question. This book explores how the design, construction, and use of robotics technology may affect today's legal systems and, more particularly, matters of responsibility and agency in criminal law, contractual obligations, and torts. By distinguishing between the behaviour of robots as tools of human interaction, and robots as proper agents in the legal arena, jurists will have to address a new generation of "hard cases." General disagreement may concern immunity in criminal law (e.g., the employment of robot soldiers in battle), personal (...) accountability for certain robots in contracts (e.g., robo-traders), much as clauses of strict liability and negligence-based responsibility in extra-contractual obligations (e.g., service robots in tort law). The Cyrenaic school of philosophy (named after its founder Aristippus’ native city of Cyrene in North Africa) flourished in the fifth and fourth centuries BCE. Ugo Zilioli’s book provides the first book-length introduction to the school in English. The book begins by introducing the main figures of the Cyrenaic school beginning with Aristippus and by setting them into their historical context. Once the reader is familiar with those figures and with the genealogy of the school, the book offers an overview (...) of ancient and modern interpretations of the Cyrenaics, to provide readers with alternative accounts of the doctrines they endorsed and of the role they played in the context of ancient thought. Finally, the book offers a reconstruction of Cyrenaic philosophy and shows how the ethical side of their speculation connected with the epistemology and ontology they endorsed and that, as a result, the Cyrenaics were able to offer a quite sophisticated philosophy. Indeed, Zilioli demonstrates that they represented, in ancient philosophy, an important and original metaphysical position and alternative to the kind of realism endorsed by Plato and Aristotle. The paper examines today’s debate on the new responsibilities of Internet service providers in connection with legal problems concerning jurisdiction, data processing, people’s privacy and education. The focus is foremost on the default rules and safe harbour clauses for ISPs liability, set up by the US and European legal systems. This framework is deepened in light of the different functions of the services provided on the Internet so as to highlight multiple levels of control over information and, correspondingly, different types (...) of liability. The new responsibilities of ISPs concern the original “end-to-end” architecture of the medium and policies on design rather than responsibility for user content and individual messages. (shrink)

The study empirically investigates the relationship between corporate governance and the triple bottom line sustainability performance through the lens of agency theory and stakeholder theory. We claim, in fact, that no single theory fully accounts for all the hypothesised relationships. We measure sustainability performance through manual content analysis on sustainability reports of the US-based companies. The study extends the existing literature by investigating the impact of selected corporate governance mechanisms on each dimension of sustainability performance, as defined by the GRI (...) framework. Our approach allows to identify which governance mechanisms foster triple bottom line performance, also revealing that some mechanisms fit only specific dimension of sustainability. The fact-based findings provide support for a new beginning in the theorising process in which the theories must try not only to provide rationale for the impact of corporate governance on sustainability, but also to explain which dimension of sustainability might be more affected. The most important implication for practitioners is the support for sustainability practices, which may be gained through implementation of particular corporate governance mechanisms. The findings contribute also to the improvement of the ongoing standard setting process, in particular as it concerns the in-depth revision of the economic dimension of sustainability carried out under the new GRI framework. Often perceived by its contradictors as the main fragility of its system, analogy constitutes however a driving element of the development of Schopenhauerian metaphysics, and makes it possible to avoid the pitfall of theoretical egoism in which any idealistic philosophy can sink. We will try to show, in accordance with the indications of paragraph 19 of The World as Will and Representation, how Schopenhauer understands the totality of the phenomena "by analogy with our body" and establishes the structure of his (...) masterpiece from this analogical dynamic that puts in motion the primitive intuition of his thought. This paper starts with an examination of the terms use d to designate the face in different languages, in particular in Italian, comparing these with the definitions provided by some authoritative dictionaries as well as with their etymology. This exploration yields some remarkable results: firstly, it appears that the face is indeed a term that has a material meaning, but at the same time it is a social object; secondly, the importance of the communicative function emerges, which makes the face (...) similar to the mask and in some ways to the arbitrariness of language. All this suggests that the philosophical status of the face is that of ‘transcendence’ which is a condition of that state of freedom that we attribute to ourselves and that can be defined as ‘human exception’. Studies on the 1616 and 1633 actions brought against Galilei by the Index and the Inquisition generally presumed that part of the documentation was still to be unveiled. This assumption was frequently accompanied by the hypothesis that some available documents were forgeries, merely composed to justify the 1633 condemnation. New documents from the Archive of the Roman Inquisition, including a censure of Saggiatore, official acts concerning the public dissemination of the verdict, and applications for permission to read Galilei¹s works, show (...) that the 1984 edition of his trial was not exhaustive. It is argued, however, that these documents were not concealed intentionally by the Holy Office and their not being found so far has been mainly due to the poor organisation of the Archive. Una presa di posizione, questa, che, già sviluppata in altri precedenti lavori, viene qui riproposta relativamente a H. Gouhier, lo studioso che più di ogni altro, con ricchezza di documenti e sottigliezza di analisi interpretative, ha sostenuto la tesi del “malinteso” e ha individuato nella dottrina della terza nozione primitiva la spiegazione autenticamente cartesiana del rapporto sussistente tra anima e corpo. Una interpretazione di cui nel presentge studio si mostra tutta la debolezza, soprattutto se la si considera alla luce dell’altra dottrina, anch’essa cartesiana, ma di gran lunga più articolata, che fa del rapporto tra anima e corpo un nesso da spiegarsi in analogia al rapporto che nel linguaggio intercorre tra il segno e il suo significato. The Μικρομεγάλη Ἰλιάς, the first work written by John Tzetzes, consists of 1.676 hexameters and numerous scholia. It narrates the events of the Trojan war from the conception of Paris to the fall of the city. This paper analyses the poem and its structure. In his later Exegesis to the Iliad, Tzetzes states that the Μικρομεγάλη Ἰλιάς allows to “learn thoroughly, in every detail” the history of the war. Following this evidence, the macro- and the microstructure of the poem are (...) analysed in order to understand how Tzetzes structured his literary work and to what end. In my research published last year, i.e. Homo homini deus. Per un'introduzione al pensiero giuridico di Francis Bacon, I have analytically presented the Aphorismi de Jure gentium maiore sive de fontibus justiciae et iuris and I have closely studied the relationship between the legal and political philosophy of the Lord Chancellor and the civil science of Thomas Hobbes1. In the present essay I will try to summarize some of the main reasons why I think that manuscript of Chatsworth House, discovered (...) to be Bacon's only in 1980, is so important. It clarifies, with its twenty aphorisms, some crucial principles of Bacon's civil philosophy that would probably remain otherwise shadowed. So, here I will take as an excellent example that concept of sovereignty which is presented in the Aphorismi. His famous silences - for which the Lord Chancellor has been often considered the worthy, English heir of Machiavelli: 'We're much beholden...'2, - will be better understood at the light of this 'new' text. However, there is not only this sort of silence that Baconian scholars have to face and to understand, also a historiographical tradition has been consolidated in the twentieth century that has almost forgotten Bacon's civil philosophy. Those Bacon's legal and political texts that have been still considered and analyzed by philosophical critique, have been generally misunderstood. So, in order to avoid as far as possible such a fate for the Aphorismi de Jure gentium maiore either, it is necessary to consider that historical context which, as we shall see, depends very much on separating Bacon as a political thinker from his younger contemporary, Thomas Hobbes. The paper examines the realignment of the legal sources in an information society, by considering first of all the differences with the previous system of sources, dubbed as the “Westphalian model”. The current system is tripartite, rather than bipartite, for the sources of transnational law should be added to the traditional dichotomy between national and international law. In addition, the system is dualistic, rather than monistic, because the tools of legal constructivism, such as codes or statutes, have to be complemented (...) with the rules of customary law and contracts. In light of the canonical version of the law as a set of commands enforced through the threat of physical sanctions, however, two further novelties must be stressed, namely the soft law-tools of governance as a source of the system and the aim to embed normative constraints into technology, in order to enforce the law through the use of filtering systems, self-enforcing technologies, etc. This latter approach impacts on functions and requirements of the system, by transferring the normative side of the law from the traditional “ought to” of legal commands to what actually is on the basis of automatic techniques, thus affecting the very notion of source. The overall aim of the paper is to show that rearrangements of the legal sources are intertwined with redistributions of power and hence, a normative standpoint is needed, so as to determine whether scholars can obtain the solution that best justifies the integrity of the law before its hard cases, or the answer is a reasonable compromise between many conflicting interests.
