Se analiza la reconstrucción del pensamiento romántico de Karl Heinz Bohrer y de su concepción estética de la subjetividad. Se expone el modo en que esta aparece en la reflexión estética de Friedrich Schlegel y se revisan las críticas de Bohrer a la tendencia de Schlegel a reinstaurar una imagen mítica de las relaciones subjetivas. Se examina la forma en que la segunda generación romántica supera este peligro y, por último, se indaga hasta qué punto la concepción de la subjetividad (...) estética que propone Bohrer resulta adecuada para comprender la producción artística contemporánea, así como algunos de los límites que presenta su lectura del pensamiento de Schlegel. Este artículo se propone indagar hasta qué punto la definición de la negatividad en términos de fuerza, que propone Christoph Menke en el marco de sus reflexiones estéticas, logra superar las coordenadas a partir de las cuales este concepto había sido pensado por la tradición. Mi hipótesis es que Menke se aleja de la inclinación metafísica a identificar la negatividad con el espíritu, pero tiende a reproducir el mismo esquema dualista por medio del cual la interpretación tradicional había establecido la (...) exterioridad de la negatividad. En tal sentido, el modo de proceder de Menke resulta paradójico, porque busca aprehender una negatividad fundamental, pero se sirve para ello de conceptos que ya son un intento de neutralizar el hiato inherente a la normatividad. En el presente artículos analizaremos el modo en que Dieter Henrich interpreta la concepción estética de Hegel. Como veremos, el autor considera que, durante los últimos años de su vida, Hegel revisó su posición contraria al arte moderno y desarrolló una interpretación positiva del mismo. Henrich descubre en las intuiciones de Hegel acerca del humor objetivo un punto de partida adecuado tanto para pensar una visión no soberana de la subjetividad, como para desarrollar una estética de la verdad de carácter (...) afirmativo. No obstante, para hacerlo no solo se aparta de los supuestos de la estética hegeliana sino que, además, proyecta sobre el arte moderno y el arte contemporáneo categorías que serían propias del pensamiento tradicional. Por este motivo, tras revisar las críticas de Henrich a las teorías reflexivas de la conciencia y reconstruir el modo en que entiende la relación entre arte y subjetividad, delinearemos algunas consideraciones relativas a las dificultades que trae aparejada su tendencia a desconocer la autonomía del arte moderno en toda su radicalidad. Según sostendremos, Henrich niega los momentos críticos de la modernidad por medio de la neutralización de sus posibles excesos y a construye una teoría del arte moderno que ya no puede dar cuenta de la ambigüedad constitutiva del mismo. El presente estudio se encuentra orientado a repensar las potencialidades críticas de la experiencia estética. A tales efecto, reconstruye la concepción estética de Christoph Menke, determinando el modo en que esta articula, por una lado, una determinada reconstrucción de la modernidad estética con un posicionamiento actual acerca del hecho estético, y por el otro una defensa radical de la negatividad estética con el resguardo de las instancias sociales de carácter normativo. En este sentido, el planteo de Menke supone tanto una (...) intervención en la tradición filosófica como en el debate actual y puede ser entendido, a su vez, como un intento de mediación entre la filosofía francesa contemporánea y el pensamiento alemán del siglo XX. No obstante, a la hora de posicionarse frente a los debates estéticos contemporáneos, Menke parece dejar de lado algunos de los logros principales de su reconstrucción histórico, mientras que en su intento por tornar compatible normatividad y negatividad estética convierte a la praxis artística en un modelo de praxis social lograda. Tanto desde el punto de vista teórico como desde una perspectiva práctica, el fenómeno de la "estetización" no parece ser portador de buenos augurios. En el ámbito teórico, la estetización ha sido vinculada con la crisis de los discursos orientados en términos de verdad, mientras que en el terreno práctico, ella ha sido asociada a ciertos procesos culturales que conducirían a la debacle de los principios normativos. Dejando de lado la problemática teórica, el presente trabajo se concentra en el debate (...) en torno al fenómeno práctico de la estetización de la política. En primer lugar, nos remontamos a la historia de la condena filosófica de la estetización de la esfera política para ocuparnos luego, en un segundo momento, de algunas posiciones esteticistas y antiesteticistas de finales del siglo XX. Posteriormente, procuramos avanzar en una redescripción de esta problemática que nos permita rescatar un sentido productivo de lo estético para el pensamiento político. Para esto último, nuestro trabajo se apoya en las reflexiones de la actual coeditora de la Neue Zeitschrift für Sozialforschung, Juliane Rebentisch. Tomando como parámetro algunos de los supuestos de sus investigaciones, aquí intentaremos demostrar hasta qué punto la estetización de la vida política puede contribuir al desarrollo de una concepción renovada de esta última. Both from a theoretical and from a practical perspective, the phenomenon of "aestheticization" does not seem to anticipate anything particularly good. On a theoretical level, it has been linked to the crisis of discourse-oriented in terms of truth, while in the practical, has been associated with certain cultural processes that lead to the the collapse of the normative principles. Leaving aside the theoretical issues, this paper focuses on the debate on the phenomenon of the aestheticization of the political culture. First, it goes back to the history of philosophical condemnation of the aestheticization of the political sphere. In a second time, he deals with some conceptions of the late twentieth century. Subsequently, the paper seeks to advance a redescription of this problem that allows rescue a productive sense of aesthetics for political thought. For the latter, our article is based on the reflections of Juliane Rebentisch and attempts to show how the aestheticization of political life can help to develop a new concept of the same. (shrink)

El objetivo de este trabajo es demostrar, en primer lugar, que el problema de la verdad no se encuentra completamente ausente en la estética kantiana y que no lo está, en segundo lugar, porque la autonomización de la dimensión estética es pensada a partir de una experiencia de la unidad de la subjetividad. A los fines de demostrar estos dos puntos, procuro reconstruir, en primer lugar, el contexto epistémico de la KU. En un segundo momento, me remito a la delimitación (...) kantiana de la autonomía del juicio del gusto y finalmente reviso aquellos momentos en los cuales Kant va más allá de sus propias pretensiones. Aquí me refiero especialmente a la idea de un acuerdo espontáneo entre las facultades cognoscitivas en la medida en que ella revela la imbricación de la determinación de la autonomía del juicio estético con problemáticas de carácter extraestético que remiten a la posibilidad de una autolegitimación de la modernidad. In the present work, our aim is to emphasize the tensions between the concepts of irony and essay which Lukács uses in The soul and the Forms, and the way in which such concepts were used by Friedrich Schlegel at the end of the 18th. century. With that purpose, we will utilize the categories of "modern episteme" and "episteme of the forms" as they are formulated by Elías Palti. We believe that these categories will allow us to detect certain breaks (...) in the discursive level that remain hidden under the apparent continuity of some topics and make difficult the reading of The soul and the Forms.Nuestro objetivo en el presente trabajo es enfatizar las tensiones que existen entre el uso de los conceptos de ironía y ensayo, que hace Lukács en El Alma y las formas, y el modo en que tales conceptos son empleados por Friedrich Schlegel, a fines del siglo XVIII. A tal efecto nos valdremos de las categorías de episteme moderna y episteme de las formas, tal como son formuladas por Elías Palti. Creemos que es posible, en virtud de ellas, detectar ciertas rupturas a nivel discursivo que permanecen ocultas bajo la aparente continuidad de algunos tópicos y cuyo desconocimiento dificulta la lectura de El alma y las Formas. “Modernity, Aesthetics and Subjectivity. A Historical-conceptual Reconstruction of the Reappropriations of Friedrich Schlegel’s Thought Within the Framework of Contemporary German Philosophy”. In this paper we analyze the interpretation of Friedrich Schlegel’s romantic thought developed by K. H. Bohrer and M. Frank. The aim is to show how, through this historical reference, the aforementioned authors reconstruct a conception of subjectivity that breaks with the modern postulate of an instituting subject and that allows to overcome the poststructuralist thesis of the death of (...) the subject. However, neither this alternative conception of the subject, nor the way in which the aesthetic dimension is characterized by Bohrer and Frank, are free of difficulties. As we will see towards the end of this paper, their anti-idealistic reading of Schlegel’s work is not only strongly unilateral, but unable to realize the specificity of contemporary artistic production. El presente trabajo reconstruye algunos de los momentos principales del debate acerca del concepto de "raza humana" que tuvo lugar hacia finales del siglo xviii entre Kant, Forster y Herder. El objetivo de esta reconstrucción es mostrar, en una primera instancia, que esa polémica se hallaba determinada por la necesidad de adaptar las herramientas histórico-naturales heredadas a la emergencia de una concepción irreversible de la variable temporal. En un segundo momento, es analizada la posición asumida por Kant frente a los (...) problemas epistémicos que generaba la progresiva temporización de los fenómenos naturales. Según se demuestra a partir del presente análisis, la introducción de principios regulativos y el giro kantiano hacia el ámbito de la subjetividad se hallaban orientados a respaldar la vigencia de la comprensión clásica de las formas orgánicas naturales, de modo a garantizar el carácter sistemático del orden natural en un contexto en el cual las transformaciones histórico-naturales ya no resultaban concebibles bajo el modelo clásico de la reversibilidad temporal. This work reconstructs some key moments of the debate on the concept of "human race" that took place in the late eighteenth century among Kant, Forster and Herder. It aims to show, first, that this controversy was defined by the need to adapt the natural-historical tools inherited from the emergence of a conception of irreversible temporality. Secondly, it analyses Kant´s position regarding the epistemic problems generated by the progressive temporization of natural phenomena. Based on this analysis, it is shown that the introduction of regulative principles and the Kantian turn toward subjectivity tended to support the validity of the classic understanding of natural-organic forms, and thus, to guarantee the systematic character of natural order in a context in which historical and natural transformations could no longer be conceived under the classic model of temporal reversibility. En primer lugar, se ocupa del trabajo de Albrecht Wellmer, representante de la “segunda generación de la Teoría Crítica”; en segundo lugar, se refiere al abordaje del actual profesor de estética en Berlín, Georg W. Bertram; y, en última instancia, indaga los aportes de Juliane Rebentisch, coeditora de la nueva versión de la Zeitschrift für Sozialforschung. Si bien los planteos de estos autores presentan matices diversos, (...) todos ellos son, de uno u otro modo, herederos de un incisivo proceso de reconsideración crítica de la teoría estética de Theodor W. Adorno que viene desarrollándose desde los años setenta. La intención del artículo es reconstruir la modalidad de crítica planteada por estos tres autores y explorar a partir de ello algunas líneas de desarrollo para un estética postadorniana. Hacia fines del siglo XIX y principio del XX se desarrolla en la Argentina un importante debate en torno al derecho penal, en el que muchos intelectuales, formados bajo la influencia del biologicismo darwiniano, intervienen para cuestionar el Código Penal, vigente desde 1887. En nuestro trabajo analizamos los desarrollos de José Ingenieros sobre el tema, profundizando el estudio de los conceptos que propone y atendiendo a la transformación radical que éstos implican en lo que hace a la comprensión del derecho, (...) de la delincuencia y de su tratamiento. A lo largo del trabajo reconocemos en las formulaciones de Ingenieros una renovación del campo conceptual en el tratamiento del delito, de acuerdo con un nuevo esquema de estudio e investigación de la delincuencia, una nueva clasificación de los sujetos criminales y nuevo sentido para la institución jurídica. A partir de allí analizamos sus consecuencias en términos de un nuevo mapa disciplinar para el tratamiento de la delincuencia, en el que la psicología pasaría a ocupar un rol protagónico, poniendo de manifiesto sus potencialidades para la intervención normalizadora del campo social. In the end of 19th Century and the beginning of the 20th it develops in Argentine an important discussion around penal law, in which many intellectuals, under the influence of Darwinian biologicism, query the Penal Code, current since 1887. In our article we analyze Jose Ingenieros' explanations about this topic, studying the concepts that he proposes and attending to the radical transformation that they imply for the understanding of law, of crime and of its treatment. In this paper we recognize in Ingenieros' formulations a renovation of the conceptual field in the treatment of crime, according with a new outline of the study and investigation of crime, a new criminal's classification and a new sense for the legal institution. We also analyze its consequences in terms of a new disciplinary map for crime's treatment, in which psychology assumes a central place, showing its potentialities for the normalizing intervention in the social field. Sus construcciones teóricas fueron elaboradas a la luz de las consecuencias políticas de la Revolución, pero también a partir de la lectura de una serie de teóricos políticos franceses que, de manera contemporánea, pensaban el proceso revolucionario francés. Situar a estos autores en el contexto de los debates intelectuales del momento es un modo (...) de ampliar la lectura y de descubrir las principales particularidades de un pensamiento que se define ante las nuevas condiciones de la política moderna.Echeverría, Alberdi and Bilbao may be considered to be three of the finest 19th Century's interpreters of the Latin American Revolution of the Independence. Their theories were developed in light of the political consequences of the Revolution, but also based on an assessment of a series of French political philosophers that, at the same time, were thinking the French revolutionary process. Placing these authors in the context of the theoretical discussions of their time is a way to extend the understanding and to identify the singularities of a view defined on the horizon of the new conditions of the modern politics. En ellas se resguardaron variadas obras filosóficas y humanísticas que fueron fundamentales en la promoción y el desarrollo de la cultura escrita y la educación. Al revisar algunos aspectos centrales del comercio, el control librario y la colección de obras afines en las primeras bibliotecas privadas y religiosas, (...) se pretende reconstruir, al menos en sus rasgos característicos, el devenir de la filosofía en el Nuevo Mundo. The transmission of philosophy to the Americas can be traced through the examination of the commercial networks that provided the first colonial libraries with books. These vast collections contained various philosophical and humanistic works that were a key factor in the promotion and the development of written culture and education. Reviewing some aspects on trading, book inventory and the collection of related works in the first private and religious libraries, the main goal is to reconstruct, at least in its characteristic features, the development of philosophy in the New World. The university reform can be considered as the favorable scenario for the explanation of some supposed of the university philosophy. The definitions that were operated at the beginning of the century may have been the basis on which the discourse of university reformism was constructed. In one way or another, both elements are linked. In the article we approach the question from the reading and review of the editorial, philosophical and university proposal of the Revista de Filosofí­a. Cultura, ciencia, educación (...) and Valoraciones. These are two publications that are presented as expressions of university reformism, while trying to delimit the philosophical field. (shrink)

The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)

In this paper, we examine the scientific, legal, and ethical foundations for inclusion of transgender women athletes in competitive sport, drawing on IOC principles and relevant Court of Arbitration for Sport decisions. We argue that the inclusion of trans athletes in competition commensurate with their legal gender is the most consistent position with these principles of fair and equitable sport. Biological restrictions, such as endogenous testosterone limits, are not consistent with IOC and CAS principles. We explore the implications for recognizing (...) that endogenous testosterone values are a ‘natural physical trait’ and that excluding legally recognized women for high endogenous testosterone values constitutes discrimination on the basis of a natural physical trait. We suggest that the justificatory burden for such prima facie discrimination is unlikely to be met. Thus, in place of a limit on endogenous testosterone for women, we argue that ‘legally recognized gender’ is most fully in line with IOC and CAS principles. (shrink)

Deep brain stimulation (DBS) is a developing technology. New generations of DBS technology are already in the pipeline, yet this particular fact has been largely ignored among ethicists interested in DBS. Focusing only on ethical concerns raised by the current DBS technology is, albeit necessary, not sufficient. Since current bioethical concerns raised by a specific technology could be quite different from the concerns it will raise a couple of years ahead, an ethical analysis should be sensitive to such alterations, or (...) it could end up with results that soon become dated. The goal of this analysis is to address these changing bioethical concerns, to think ahead on upcoming and future DBS concerns both in terms of a changing technology and changing moral attitudes. By employing the distinction between inherent and noninherent bioethical concerns we identify and make explicit the particular limits and potentials for change within each category, respectively, including how present and upcoming bioethical concerns regarding DBS emerge and become obsolete. Many of the currently identified ethical problems with DBS, such as stimulation-induced mania, are a result of suboptimal technology. These challenges could be addressed by technical advances, while for instance perceptions of an altered body image caused by the mere awareness of having an implant may not. Other concerns will not emerge until the technology has become sophisticated enough for new uses to be realized, such as concerns on DBS for enhancement purposes. As a part of the present analysis, concerns regarding authenticity are used as an example. (shrink)

Background: Ethical competence in nursing practice helps clinical nurses to think critically, analyse issues, make ethical decisions, solve ethical problems and behave ethically in their daily work. Thus, ethical competence contributes to the promotion of high-quality care. However, studies on ethical competence in Malawi are scanty. Objectives: The aim of this study was to explore ethical competence among clinical nurses in selected hospitals in Malawi. Methodology: A cross-sectional survey was conducted in four selected hospitals in Malawi with a sample of (...) 271 clinical nurses. Data were collected using self-administered questionnaires, which included a Moral Competence Scale for Home Care Nurses. Descriptive statistics and logistic regression were computed for the dataset using STATA version 12.0. Ethical consideration: The study protocol complied with all ethical requirements and was approved by the College of Medicine Research Ethics Committee under the University of Malawi. Results: The clinical nurses in Malawi are ethically competent. However, there is a significantly high number (p 0.05). Three determinants of high ethical competence level (strong will, judgement skills and recognition of discrepancy of intention) were identified through a reduced model after stepwise logistic regression analysis. Furthermore, results show that indicators of ethical competence include caring, confidentiality and observance of nurses dressing code. The study has also confirmed that the Moral Competence Scale for Home Care Nurses is a reliable tool to assess ethical competence in low-resource settings. Conclusion: The majority of nurses who completed the survey had low ethical competence. However, clinical nurses with high ethical competence level are required to competently manage complex ethical challenges in health facilities. Strategies for enhancing ethical competence such as continuing ethics education, establishment of ethics committees and provision of supportive supervision are recommended to enable nurses in Malawi attain a high level of ethical competence. It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

This paper aims to investigate whether and in what respects the conceptions of the body and of agency that Judith Butler develops in Bodies That Matter are useful contributions to feminist theory. The discussion focuses on the clarification and critical assessment of the arguments Butler presents to refute the charges of linguistic monism and determinism.

We contribute to feminist and gender scholarship on cultural notions of motherhood by analyzing the importance of motherhood among mothers and non-mothers. Using a national probability sample of U.S. women ages 25-45, we find a continuous distribution of scores measuring perceptions of the importance of motherhood among both groups. Employing OLS multiple regression, we examine why some women place more importance on motherhood, focusing on interests that could compete with valuing motherhood, and controlling for characteristics associated with becoming a mother. Contrary to cultural schemas that view mother and worker identities as competing, we find that education level is not associated with the importance of motherhood for either group and that valuing work success is positively associated with valuing motherhood among mothers. Consistent with feminist explanations for delayed fertility, valuing leisure is negatively associated with valuing motherhood for non-mothers. (shrink)

We study probabilistic logic under the viewpoint of the coherence principle of de Finetti. In detail, we explore how probabilistic reasoning under coherence is related to model- theoretic probabilistic reasoning and to default reasoning in System . In particular, we show that the notions of g-coherence and of g-coherent entailment can be expressed by combining notions in model-theoretic probabilistic logic with concepts from default reasoning. Moreover, we show that probabilistic reasoning under coherence is a generalization of default reasoning in System (...) . That is, we provide a new probabilistic semantics for System , which neither uses infinitesimal probabilities nor atomic bound (or big-stepped) probabilities. These results also provide new algorithms for probabilistic reasoning under coherence and for default reasoning in System , and they give new insight into default reasoning with conditional objects. At the outset of an ethnographic inquiry, we navigated national and international resources to search for theoretical and practical guidance on obtaining parents and children’s informed consent/assent. While much theoretical guidance debating ethical issues to children’s participation in research was found, a paucity of published papers offering practical guidance on assent processes and/or visual representations of child assent forms and information sheets was discovered. The purpose of this article is to describe our experiences, both theoretically and practically, of negotiating the (...) process of obtaining informed consent and assent with parents and children for a non-therapeutic qualitative research study. We hope this article instigates a platform for others to explicate their experience and contributes to the construction of a coherent body of knowledge which will clearly delineate important elements that must be considered when negotiating children’s agreement to participate in research. The presence of stigmatizing language in the electronic health record (EHR) has been used to measure implicit biases that underlie health inequities. The purpose of this study was to identify the presence of stigmatizing language in the clinical notes of pregnant people during the birth admission. We conducted a qualitative analysis on N = 1117 birth admission EHR notes from two urban hospitals in 2017. We identified stigmatizing language categories, such as Disapproval (39.3%), Questioning patient credibility (37.7%), Difficult patient (21.3%), (...) Stereotyping (1.6%), and Unilateral decisions (1.6%) in 61 notes (5.4%). We also defined a new stigmatizing language category indicating Power/privilege. This was present in 37 notes (3.3%) and signaled approval of social status, upholding a hierarchy of bias. The stigmatizing language was most frequently identified in birth admission triage notes (16%) and least frequently in social work initial assessments (13.7%). We found that clinicians from various disciplines recorded stigmatizing language in the medical records of birthing people. This language was used to question birthing people's credibility and convey disapproval of decision‐making abilities for themselves or their newborns. We reported a Power/privilege language bias in the inconsistent documentation of traits considered favorable for patient outcomes (e.g., employment status). Future work on stigmatizing language may inform tailored interventions to improve perinatal outcomes for all birthing people and their families. (shrink)

In this article three viewpoints on the relation of body and language are discussed: the poststructuralist viewpoint of Judith Butler, the phenomenological viewpoint of Maurice Merleau-Ponty and the postmodernist viewpoint of Jean-François Lyotard. The reason juxtaposing for these three accounts is twofold. First, the topic requires a combination of post-structuralist and phenomenological insights, and second, the accounts are supplementary. Butler's account raises questions that can be answered with the help of Merleau-Ponty's work. Lyotard's anthropology of the inhuman offers a perspective (...) of finitude that is missing in the other two. In this paper we consider the problem of how to measure the strength of statistical evidence from the perspective of evidence amalgamation operations. We begin with a fundamental measurement amalgamation principle : for any measurement, the inputs and outputs of an amalgamation procedure must be on the same scale, and this scale must have a meaningful interpretation vis a vis the object of measurement. Using the p value as a candidate evidence measure, we examine various commonly used approaches to amalgamation (...) of evidence across similar studies, including standard forms of meta-analysis. We show that none of these methods satisfies MAP. Thus an underlying measurement problem remains. We argue that a successful approach to evidence amalgamation necessitates a solution to the problem of evidence measurement, and we suggest some lines of reasoning that might guide further work towards this end. The case of Charlie Gard sparked an ongoing public and academic debate whether in court decisions about medical treatment for children in England & Wales the best interests test should be replaced by a harm threshold. However, the literature has scantly considered (1) what the impact of such a replacement would be on future litigation and (2) how a harm threshold should be introduced: for triage or as standard for decision-making. This article directly addresses these gaps, by first analysing reported (...) cases in England & Wales about medical treatment in the context of a S31 order, thus using a harm threshold for triage and second comparing court decisions about medical treatment for children in England & Wales based on the best interest test with Dutch and German case law using a harm threshold. The investigation found that whilst no substantial increase of parental discretion can be expected an introduction of a harm threshold for triage would change litigation. In particular, cases in which harm is limited, currently only heard when there are concerns about parental decision-making, may be denied a court hearing as might cases in which the child has lost their capacity to suffer. Applying a harm threshold for triage in decisions about withholding or withdrawing life-sustaining treatment might lead to a continuation of medical treatment that could be considered futile. In this essay I compare Nussbaum's and Arendt's approach to narrativity. The point of the comparison is to find out which approach is more adequate for practical philosophy: the approach influenced by cognitive theory or the one influenced by hermeneutic phenomenology. I conclude that Nussbaum's approach is flawed by methodological solipsism, which is due to her application of cognitive theory.

This chapter explores how what is dismissed as “trans activism” is often public philosophy. It considers how so‐called “public philosophy” on trans issues often does a substantially worse job of living up to the name. The chapter discusses how the dichotomy between “trans activism” and “public philosophy” provides a pretext for marginalizing trans voices. To draw on Black feminist philosophical thought, lived experience is a criterion for knowledge of the needs of marginalized people. Like other marginalized communities, trans communities have (...) encountered many areas in which hermeneutical liberation is needed. Public philosophy as trans activism is often systemically and systematically ignored or willfully misinterpreted as being biased and motivated by self‐interest, whereas anti‐trans (public) philosophy is seen as asking the important questions. Abstract:Brain–computer interfaces (BCIs) can enable communication for persons in severe paralysis including locked-in syndrome (LIS); that is, being unable to move or speak while aware. In cases of complete loss of muscle control, termed “complete locked-in syndrome,” a BCI may be the only viable solution to restore communication. However, a widespread ignorance regarding quality of life in LIS, current BCIs, and their potential as an assistive technology for persons in LIS, needlessly causes a harmful situation for this cohort. In addition (...) to their medical condition, these persons also face social barriers often perceived as more impairing than their physical condition. Through social exclusion, stigmatization, and frequently being underestimated in their abilities, these persons are being locked out in addition to being locked-in. In this article, we (1) show how persons in LIS are being locked out, including how key issues addressed in the existing literature on ethics, LIS, and BCIs for communication, such as autonomy, quality of life, and advance directives, may reinforce these confinements; (2) show how these practices violate the United Nations Convention on the Rights of Persons with Disabilities, and suggest that we have a moral responsibility to prevent and stop this exclusion; and (3) discuss the role of BCIs for communication as one means to this end and suggest that a novel approach to BCI research is necessary to acknowledge the moral responsibility toward the end users and avoid violating the human rights of persons in LIS. The introduction of new medical treatments based on invasive technologies has often been surrounded by both hopes and fears. Hope, since a new intervention can create new opportunities either in terms of providing a cure for the disease or impairment at hand; or as alleviation of symptoms. Fear, since an invasive treatment involving implanting a medical device can result in unknown complications such as hardware failure and undesirable medical consequences. However, hopes and fears may also arise due to the cultural (...) embeddedness of technology, where a therapy due to ethical, social, political and religious concerns could be perceived as either a blessing or a threat. While Deep Brain Stimulation (DBS) for treatment resistant depression (TRD) is still in its cradle, it is important to be proactive and try to scrutinize both surfacing hopes and fears. Patients will not benefit if a promising treatment is banned or avoided due to unfounded fears, nor will they benefit if DBS is used without scrutinizing the arguments which call for caution. Hence blind optimism is equally troublesome. We suggest that specificity, both in terms of a detailed account of relevant scientific concerns as well as ethical considerations, could be a way to analyse expressed concerns regarding DBS for TRD. This approach is particularly fruitful when applied to hopes and fears evoked by DBS for TRD, since it can reveal if our comprehension of DBS for TRD suffer from various biases which may remain unnoticed at first glance. Background: Nurses are expected to provide comprehensive, holistic and ethically accepted care according to their code of ethics and practice. However, in Malawi, this is not always the case. This article analyses moral competence concept using the Walker and Avant's strategy of concept analysis. Objective: The aim of this article is to analyse moral competence concept in relation to nursing practice and determine defining attributes, antecedents and consequences of moral competence in nursing practice. Method: Analysis of moral competence concept was (...) done using Walker and Avant's strategy of concept analysis. Results: Deductive analysis was used to find the defining attributes of moral competence, which were kindness, compassion, caring, critical thinking, ethical decision making ability, problem solving, responsibility, discipline, accountability, communication, solidarity, honesty, and respect for human values, dignity and rights. The identified antecedents were personal, cultural and religious values; nursing ethics training, environment and guidance. The consequences of moral competence are team work spirit, effective communication, improved performance and positive attitudes in providing nursing care. Conclusion: Moral competence can therefore be used as a tool to improve care in nursing practice to meet patients' problems and needs and consequently increase public's satisfaction in Malawi.
