In his recent book, Killing in War, Jeff McMahan sets out a number of conditions for a person to be liable to attack, provided the attack is used to avert an objectively unjust threat: (1) The threat, if realized, will wrongfully harm another; (2) the person is responsible for creating the threat; (3) killing the person is necessary to avert the threat, and (4) killing the person is a proportionate response to the threat. The present article focuses on McMahan's second (...) condition, which links liability with responsibility. McMahan's use of the responsibility criterion, the article contends, is too restrictive as an account of liability in general and an account of liability to be killed in particular. In order to defend this claim, the article disambiguates the concept of liability and explores its role in the philosophical analysis of the permission to cause harm to others. (shrink)

At the intersection of literature and history, three “antique romances” initiated a new genre in the mid-twelfth century by transposing into French the great stories of Greek and Latin epic: the fratricidal war of Oedipus's sons in the Roman de Thèbes, the founding of Rome in the Eneas, and the Roman de Troie's Trojan War based on Dares and Dictys. Rejecting Homer's version for these “eyewitness” accounts, Benoît de Sainte-Maure translated the full history of the Trojan War from its beginning (...) in the tale of Jason and the Argonauts to the annihilation of Troy and the victors’ unhappy homecomings. The myth of Trojan descent claimed by many European rulers, including the British and Normans, gives Benoît's translation more than entertainment value for his first public, the Plantagenêt court of Henry II and Eleanor of Aquitaine. Indeed, while repeatedly assuring his readers that this great estoire, story and history, will provide pleasurable enjoyment, Benoît also signals a more serious intent by invoking Solomon and the seven liberal arts: we would be like beasts if not for learning from the past that allows us to distinguish between wisdom and folly. The author/narrator's school training is on full display as he highlights the importance of remembering and the dangers of forgetting. Obliged to share his knowledge, Benoît will put into romanz matter that is at once old and new, lost and refound, so that lay readers without access to his Latin sources can “remember” their past as he shapes it in romance. The success of his enterprise can be gauged by the number of extant manuscripts as well as the romance's subsequent influence on multiple versions of Trojan history, from the Histoire ancienne jusqu’à César to Chaucer's Troilus and Criseyde. But can we pinpoint more specifically what and how Benoît's public might remember? (shrink)

An eye-opener and a head-scratcher, this set of fifty exercices de style offers an oblique and learned introduction to a great classic of ludic literature dating from the twelfth century, the Maqamat of al-Hariri. Each of the fifty tales of the trickster Abu Zayid, some or perhaps all of which contain or are constituted by one or more formal restrictions, is here presented in the form of a pastiche of some familiar or exotic register of writing in English. We can (...) only admire Cooperson for having taught himself to channel Chaucer, Woolf, and Twain, to parrot Singaporean, Nigerian, and Indian English, to compose in dramatic form and in verse, and to riff off Austen as well as a dictionary of law.... What is frustrating to readers is that our translator-imposter does not let us play the game. He explains each exercise and justifies his approach to it in a prefatory note, then adds footnotes, a bibliography, and a glossary of the “dialect” chosen. We are not even allowed to play guess-the-author! The aim of the elaborate and scholarly apparatus attached to these imitative imitations is to give a hint—a necessarily and unapologetically misleading one—of the pleasure and value of the medieval Arabic for its first and later readers.The problem is that pastiche is not only an entertaining exercise. It typically serves a purpose located somewhere between mockery and homage, and sometimes plays both ends against the middle. Cooperson, however, is not mocking Dickens or Gibbon, even less the al-Hariri he clearly admires beyond all others. Consequently, the nonparticipant reader becomes ever more baffled as to what the game is really for. Surely it cannot be intended only to show us how clever and knowledgeable Mr. Cooperson is? Which he certainly is, but not beyond tripping over his own skipping rope. For example, the prisoner's constraint used in the middle of a pastiche of Dickens, when implemented in the way it was defined by its inventor Paul Fournel, excludes the letter z and also cannot accommodate the tilde of señor—and Dickens would have written bade for the past tense of bid. The more you read, the less you smile, the more you quibble as you are drawn into a surely unintended game of spot-the-blooper.It takes genius to write like someone else, which is why the people who get away with it for real use a battery of extratextual devices to deceive (think of Guilleragues, Ossian, Chatterton, Kuzma Proutkov, Romain Gary... ). Cooperson is not seeking to deceive (yet how can a pastiche not gesture toward deception?), but he is not actually offering fifty linked stories by fifty different hands either. What he has produced with the help of his distinguished préfacier, two editors, and a bevy of consultants is a curiously unidentifiable literary object, and quite possibly the only one of its kind.Two statements made by the translator in his introduction disturb me. He says he avoided using most twentieth-century literary models and references in order not to run into copyright issues. This is a declaration of submission to the Copyright Monster invented and unleashed by publishers in flagrant disregard of the laws of the UK, the US, and the EU, all of which allow parody and pastiche without permission of the copyright holder. Second, he “takes seriously the argument that privileged users of Standard English have no business imitating... the speech varieties associated with less privileged communities.” In all times other than our own, the privileged did not deign to use “less privileged” forms of speech (unless they were Victor Hugo), but if now they do not even dare, we can still guess what will happen. The less privileged will seek to use more privileged forms of speech, just as Anglo-Saxon serfs aped Norman French until they ended up speaking English. More recently, wealthy corporations have sought to own whole programming languages by extending the reach of copyright law; perhaps “less privileged communities” are now about to use similar weapons to protect their linguistic turf. We must object as noisily as we can to attempts to enclose public goods by corporations, by self-defining communities, or by any other entities. We would all be the poorer if they should ever succeed. (shrink)

Can subjects genuinely possess concepts they do not understand fully? A simple argument can show that, on the assumption that possession conditions are taken to fully individuate concepts, this question must be answered in the negative. In this paper, I examine this negative answer as possibly articulated within Christopher Peacocke’s seminal theory. I then discuss four central lines of attack to the view that possession of concepts requires full understanding. I conclude that theorists should acknowledge the existence of indefinitely many (...) cases of genuine concept possession for partially understood concepts and therefore face the determination challenge, namely, the challenge of fully determining concept individuation from concept possession conditions of partially understood concepts. Although our moral lives would be unrecognisable without them, roles have received little attention from analytic moral philosophers. Roles are central to our lives and to our engagement with one another, and should be analysed in connection with our core notions of ethics such as virtue, reason, and obligation. This volume aims to redress the neglect of role ethics by confronting the tensions between conceptions of impartial morality and role obligations in the history of analytic philosophy and the Confucian tradition. Different perspectives on the ethical significance of roles can be found by looking to debates within professional and applied ethics, by challenging existing accounts of how roles generate reasons, by questioning the hegemony of ethical reasons, and by exploring the relation between expertise and virtue. The essays tackle several core questions related to these debates: What are roles and what is their normative import? To what extent are roles and the ethics of roles central to ethics as opposed to virtue in general, and obligation in general? Are role obligations characteristically incompatible with ordinary morality in professions such as business, law, and medicine? How does practical reason function in relation to roles? Perspectives in Role Ethics is an examination of a largely neglected topic in ethics. The average age of women nursing students in Australia is rising. With this comes the likelihood that more now begin university with family responsibilities, and with their lives structured by the roles of mother and partner. Women with more traditionally gendered ideas of these roles, such as nurturing others and self‐sacrifice, are known to be attracted to nursing as a profession; once at university, however, these students can be vulnerable to gender role stress from the competing demands of study. A (...) qualitative research design, guided by Gadamer's hermeneutic philosophy, explored the gendered behaviours and experiences of 22 women nursing students, all of whom had children and began university in a heterosexual intimate relationship. The findings reveal traditional ideas of gender were almost universal among participants, and these ideas had a significant influence on the nursing degree experience. Participants commonly prioritised family over the university and practiced maternal gatekeeping (prevention of male partner involvement in domestic work). These traditionally gendered behaviours, coupled with experiences of gender role stress, had a detrimental impact on participants' capacity to study and their personal wellbeing. The importance of these findings to the burgeoning nursing workforce shortage nursing is considered in terms of student retention and the supply of graduates into the profession. The implications to the nursing profession are also explored against the evidence that nursing students with traditional gender beliefs are less likely to develop as autonomous, critical thinking nurses compared to their gender‐egalitarian peers. The introduction of gender theory via critical pedagogy in the undergraduate nursing degree curriculum is recommended to enlighten and empower women nursing students and promote the competence, agility, and sustainability of the nursing profession. Este trabalho é um breve estudo sobre a análise literária de textos cristãos elaborada por Erich Auerbach. O objetivo é destacar como, a partir do sermão 256 de Santo Agostinho e da Bíblia, Auerbach ilumina a articulação do sublime cristão com o sermo humilis , ou seja, incorpora a linguagem ordinária e temas prosaicos cotidianos para transmitir a mensagem religiosa. Do ponto de vista teórico-conceitual, faremos uma breve exposição sobre teoria da literatura, mais especificamente, sobre mimesis e literatura, como forma (...) de pensar a abordagem de textos cristãos. Segundo Auerbach, o texto cristão, num mundo bastante conturbado, incorporou a vida e a linguagem simples das pessoas para, então, configurar uma nova forma do sublime. Concluímos que o texto cristão, visando a uma formulação religiosa (normativa), para isso trouxe para seu interior aquilo que definimos como dinâmica histórica, para trabalhá-la numa proposta de sentido. This paper explores the thinking of some Salamancan theologians regarding the notion of pure nature. In particular, I address Suárez’s thinking on this subject and locate it within the context of the debate over whether human beings have a desire for the beatific vision. Insofar as a number of Thomists and Suárez think that there is no natural desire for a supernatural end, human beings are, by nature, left only with a desire for natural beatitude. The theoretical possibility of a (...) human nature created without any order to a supernatural end and also falling outside the economy of grace becomes a subject of speculation that serves to illuminate something about created nature itself. The writings of John Paul II are rich in meanings and analogies that enrich our understanding of human person and God. According to the tradition, what is specific to human person is reason, which means the ability to assume responsibility. Nevertheless, such responsibility is paradoxical, because it is only realized in relationship with events that depend on circumstances - which are manifested especially in relationships with others, specifically through love. Now, it is properly the paradox of such personal responsibility that (...) can give an analogical understanding of the mystery of God, one and triune. (shrink)

O presente artigo é uma discussão sobre a noção heideggeriana de Überwindung. Seu objetivo é duplo: por um lado, [1] mostrar a perspectiva que tal termo deve ser compreendido; por outro, [2] aprofundar esta perspectiva à luz de comentários ao aforismo I do texto Überwindung der Metaphysik. Para tanto, duas questões são postas: em que perspectiva e que questões estão implícitas quando Heidegger propõe o projeto da Überwindung der Metaphysik?; e por que uma Überwindung contém em si tantos problemas? De (...) modo a discutir e comentar tais questões, o artigo percorre dois caminhos: [1] faz-se uma análise da própria indicação heideggeriana da perspectiva de compreensão da Überwindung der Metaphysik, qual seja, revisitar, a partir de um olhar determinado, a construção da noção de história do ser. Esta, por sua vez, tem sua gênese antes mesmo da própria Kehre. Mais especificadamente, na reinterpretação que o próprio Heidegger faz de seu texto Vom Wesen der Wahrheit. A partir desta reconsideração feita por Heidegger e inserida em seu próprio texto, é possível detectar quatro teses fulcrais que traçam essencialmente a metafísica e que justificam a sua superação. São elas: [a] o fato de o ser, originariamente, se velar e provocar, historialmente, o seu esquecimento; [b] a relação entre a verdade do ser e a história, que se desenvolve como história do ser; [c] a ideia de que pertence ao ser um caráter originário de retração de si mesmo e que essa retração é um destino que pertence à história do pensamento metafísico e se configura na própria essência da metafísica; [d] afirmar que a certeza da manifestação da essência coincide com o seu fim. [2] Adentra-se, mediante uma aproximação pari passu, no aforismo I do texto Überwindung der Metaphysik, com intuito de comentar a problematicidade do termo Überwindung quando usado para repensar a metafísica à luz da perspectiva da história do ser.
