This article lies at the intersection of two problems: the one concerning the potential of fictional works to inform us about our social reality and foster our understanding of its various aspects, and the one concerning their potential to engage with philosophical issues. I bring these two together by analyzing the hit television series Law and Order: Special Victims Unit. According to my interpretation, the series is informative about our social world, and it raises philosophical concerns about it. This makes (...) it well-equipped to fulfill the educative function attributed to mass art by Noël Carroll, and to stand out as an example of what he calls popular philosophy. To support this interpretation, I rely on contemporary views regarding the nature of our engagements with fictional narratives. I then explore how philosophical concerns are generated and I elaborate on the role they have in deepening one’s understanding of one’s social circumstances. I further show how the series provides innovative and independent philosophical knowledge by means specific to the medium of generic serialized fiction. The central part of my argument is an analysis of the narrative strategies which enable the informative and philosophical aspects of the series to generate the series’ educative function. (shrink)

My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art's impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art's impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

In this article, I defend the cognitive value of certain generic television series. Unlike media and television scholars, who have been appreciative of the informative capacity of television fiction, philosophers have been less willing to acknowledge the way in which these works contribute to our understanding of our social reality. My aim here is to provide one such account, grounded in aesthetic cognitivism, that is, the view that fiction is a source of knowledge. Focusing on crime and courtroom dramas, I (...) start by offering some examples of the cognitive benefits available in some of these series and I argue that the more beneficial cases establish superior mimetic relations with reality, enhancing their capacity to present ethically challenging issues. I then examine whether the fictional dimension of these works presents an obstacle to their informative potential and I conclude that it does not. A central aspect of my account is the claim that the degree of cognitive benefit depends on the underlying narrative strategy of the series. Specifically, there are clues in any given show, including the treatment of ongoing characters, which signal the extent to which it can be taken as mimetically reliable and thus, cognitively valuable. I complete my account by addressing anti-cognitivists’ arguments which call to doubt the informative aspect of television series and their capacity to address ethical concerns. (shrink)

In this paper I try to indicate particular elements of Socrates’ philosophy by which educational practice should be guided, as well as certain harmful implications of Sophistic approach to education. In analysis of Socrates’ position, I especially rely on Vlastos’ interpretations, and particularly I refer to Socrates’ thesis that virtue cannot be taught. Among other things, it suggests a non-doctrinal approach to moral-educational practice, which cannot result from Protagoras’ opposite beliefs. Nowadays Sophistic particular- and utilitarian-oriented education occurs especially in the (...) educational (or better: manipulative) transmission of national, business and similar so-called ethics, which are not able for recognizing and overcoming of the existing socio-economic framework, and for which Socrates’ moral-educational philosophy contains critical force, arising primarily out of the emphasis on autonomy. With his thesis on the genius who does not know from where their ideas come from and how they create, Kant left an indelible mark on thought concerning art and artistic creation. He insisted that it represents a unique act by natural gift, and thus specific for the domain of art, and specifically not belonging to the domain of science. Although today we know that such a disposition is wrong, many of Kant’s claims are supported in contemporary theories in cognitive (...) science, but also by the artistic practice. In this paper, I will analyse Kant’s theory of beautiful art and artistic creation in the context of contemporary research on creativity and talent and show how much is Kant’s theory on beautiful art and artistic creation rich explanatory, especially for understanding and thinking the artistic creation, artistic reception and artistic practice. On the twentieth anniversary of the death of one of the most important contemporary political and social philosophers, John B. Rawls (1921–2002), in this paper the authors deal with his understanding of the relationship between civil disobedience and freedom within the framework of a liberal constitutional democracy based on the rule of law. The fundamental starting point of Rawls’s theory, and thus of this work, is that civil disobedience expresses disobedience to the law within the limits of fidelity to the (...) law, although it is at the outer edge thereof. If the freedom of thought expressing disobedience to unjust laws is one of the fundamental freedoms, then civil disobedience can be understood not only as a corrective to liberal constitutional democracy but also as a realistic attempt to “save” it. This is an important topic of contemporary political philosophy, considering the increasingly widespread discourse about the crisis of liberalism in general today, and the impact of that crisis on the institutions of liberal constitutional democracy, among which the state stands out, but in fact law and the legal system as a whole. The responsibility for the COVID-19 pandemic was first ascribed to persons associated with the Huanan Seafood Market. However, many scientists suggest that this pandemic is actually a consequence of human intrusion into nature. This opens up a whole new perspective for an examination of direct and indirect, individual and collective responsibility concerning this particular pandemic, but also zoonotic pandemics as such. In this context, one of the key issues are the consequences of factory-farming of animals, which contributes to circumstances in (...) which zoonotic pandemics emerge. Moreover, it is part of a larger economic system, global capitalism, whose logic implies certain coercion toward its participants to keep it essentially unchanged and therefore to make sure that livestock health remains?the weakest link in our global health chain?. However, even though the precise answer to the issue of moral responsibility for zoonotic pandemics outbreaks in general and the COVID-19 pandemic in particular cannot be given, it is possible to list certain indicators and make a framework helpful in ascribing moral responsibility to certain persons. The paper intends to do so by examining the notion of responsibility and by applying it to the issues mentioned. The results of this analysis show that it is misleading to place moral blame on people involved in actions that directly caused the animal-to-human transmission of a certain virus or on humanity as a whole. In this paper I address Jerome Stolnitz’s famous article “On the cognitive triviality of art,” with the aim of defending aesthetic and literary cognitivism against the charges Stolnitz issues at it therein. My defence of literary cognitivism is grounded in contemporary epistemology, which, I argue, is more embracive of cognitive values of literature traditionally invoked by literary cognitivists. My discussion is structured against Stolnitz’s individual arguments, dedicated in particular to the problem of literary truth. After exploring what such notion might (...) amount to, I move on to address the problems of applicability and triviality of literary truths, and I end by defending literature as a cognitively valuable social practice. Stanislaw Lem, Philosopher of the Future is a revealing and instructive guide to the philosophical fiction of Stanislaw Lem. Throughout the book, Swirski builds a framework of philosophical and scientific concepts within which Lem’s works should be read, in particular its most significant aspect: Lem’s unyielding concern for knowledge supported by his conviction that literature is an epistemologically valuable tool for exploring reality. Swirski offers a rich background to Lem's litrary career and unravels the depths of Lem’s philosophical fiction.

Contemporary debates within analytic philosophy regarding the relation between literature and philosophy focus on the capacity of some literary works to engage with philosophical problems. While some philosophers see literature as a welcome contribution to philosophy, or as an alternative to pursuing philosophical questions, some are more sceptical with respect to its capacity to tackle philosophical concerns. As a contribution to this debate, in this paper I look at similarities and dissimilarities between the two practices, with the aim of mitigating (...) some views which see them as too diverse to allow for literary treatment of philosophical issues. As points of contact, I focus on the shared thematic concerns of the two practices, i.e. on the fact that literature and philosophy both deal with issues that humans generally care for. I argue that both practices, despite the stylistic, linguistic and methodological differences in their approach, manage to fulfil ‘the recognition requirement’, namely, recognize and engage with those issues, situations and context of human predicament in the world which are in need of intellectual refinement. I then move on to dismiss arguments which purport to discredit literary treatments of philosophy on the basis of literature’s alleged subjectivity and emotional dimension, which are contrasted with philosophical objectivity and rationality. I end by emphasizing the impact of academic constraints on professional philosophy, in order to suggest that pursuing philosophical concerns is not an invention of the practice, but a natural inclination of reflective, inquisitive human mind. Big philosophical questions—about the mind, the idea of the good, justice, beauty, knowledge—have been the prime interest of philosophers ever since Plato first raised them in his dialogues. However, regardless of how hard philosophers have been trying to find answers to them, it seems that all they have ever managed to do was to find reasons for disagreements, and, on the whole, to have failed to reach a consensus on pretty much anything. Some philosophers now claim that there hasn’t been (...) much progress in philosophy, especially when compared to the sciences. I take up this verdict and try to refute it, first by offering an alternative view on what counts as progress, and then by analyzing big philosophical questions and their relevance for our intellectual and practical pursuits. I argue that, due to the distinctive nature of philosophical curiosity, coming up with answers to the big philosophical questions is an ideal that can hardly be met, but that philosophy nevertheless delivers various benefits, intellectual and practical, which the proponents of the No-Progress View tend to ignore. In this paper we want to explore different epistemological benefits that we gain by dealing with some artworks, and our focus is on narrative arts. We claim that there is a sense in which narrative arts can be similar to testimony, in that they provide information which can be epistemologically valuable for cognitive agents such as we are. We identify at least two broad categories of these epistemological benefits, the first one includes ‘facts stating’ and in that sense is parallel (...) to the paradigmatic case of testimony in which what the testifier says can be a source of knowledge as mere acquisition of facts for his audience . This, however, is not the most peculiar and distinctive kind of epistemological benefits we can gain from art. The other one has to do with raising awareness, of deepening our understanding about some issues either by a specific, powerful and involving way of providing us facts , or by presenting us the stance, the attitude, the opinion of the artist that can be enlightening, or challenging for us. In this paper, I address the question of engaged philosophy with an emphasis on aesthetics and the philosophy of art. Referring to some specific problems discussed in these areas – in particular climate change, ecological crisis and immoral art – I demonstrate that philosophy can be engaged in two ways: (i) in its aspiration to question social reality, culture, human experience and the strategies for making sense of and finding value in that experience; (ii) in the aspiration to contribute to (...) the well-being of individuals and society through its contribution to understanding that reality and experience. First, I point to the connection between the philosophical questions and the fundamental intellectual aspirations of human beings as social and cultural beings, but also as autonomous knowers and valuers. Second, I respond to two objections that can be directed against engaged philosophy: (i) one that points to a lack of consensus among philosophical responses (the problem of disagreement), and (ii) one that highlights the irrelevance of philosophical debates to our social practice. The paper deals with the critical questioning of the relation between legitimate imposed legal obligations and the rights to refuse these obligations based on the right of the freedom of conscience, i.e. conscientious objection. The critical perspective that is applied to conduct the questioning is a legal profession because, in Croatian legal culture, there is no articulated answer to the question of how to reconcile these two obligations within the legal profession. The paper draws on the comprehension of John Rawls’s (...) theory of conscientious objection since it is a systematic analysis of justice that shall submit subjective understanding of the good to the principle of right. In practice, the focus is on the grounds for acknowledging conscientious objection among lawyers as well on the obstacles to exercising this right. (shrink)

Pendant plus de quinze ans, Léon N. Tolstoï a travaillé sur son seul traité esthétique intitulé Qu'est-ce que l’art? dans lequel il écrit que l'art n'est ni l'apparition d'une mystérieuse idée ou de la beauté divine, ni le produit de l'énergie de l'homme ou de l'expression de ses émotions, mais un moyen de communication entre hommes, nécessaire à la vie et à l'aspiration vers la bonté de tout humain. Pour lui, l'art est une forme de création communicative qui unit les (...) hommes dans des émotions identiques parmi lesquelles se distingue particulièrement l'importance du Bien. C’est précisément dans le transfert des émotions à l'aide du langage symbolique que repose la principale caractéristique de l'art. L'objectif de ce travail est la lecture des approches de Tolstoï envers l'esthétique et l'art, dispersées dans ses différentes œuvres, afin d'arriver à la vision de l'art en tant que forme particulière d’ « à la recherche de » mais aussi du reflet du Bien. Ce travail est rédigé dans l'idée qu'une recherche plus exhaustive des pensées esthétiques de Tolstoï peut modestement contribuer à la « réhumanisation de l'art ». (shrink)

The paper attempts to point out Paulo Freire’s thoughts that could be fruitful in the context of bioethical consideration of the human relationship toward nature, i.e., non-human living beings, especially with regard to the development of bioethical sensibility, in particular present in children. Given that certain childhood traits, compatible with the idea of bioethical sensibility, form the core of Freire’s philosophy of education, this is an area in which the bioethicisation of Freire’s thought can be particularly fruitful. In addition, the (...) paper presents his views associated with moral regard toward non-human living beings, as well as those that are somewhat contradictory to due regard toward living beings, given that the latter views provide impoverished insights into the richness of the non-human living beings’ self-realisation. Prior to these considerations, the notion of bioethicisation of philosophy is further clarified, especially regarding the closely related (programmatic) notion of Europeanisation of bioethics. Both of these terms are used in the context of integrative bioethics. The last chapter explains the potential contribution of Freire’s dialogical method to the development of a pluri-perspective methodology of integrative bioethics. (shrink)

In his numerous philosophical writings Cicero mostly adapted contemporary Greek sources, but occasionally he took up certain positions of his own. His propensity to scepticism in epistemology and dogmatism in ethics and political philosophy appears to be a further development of the model set forth by Carneades. Though Cicero was influenced by both Antiochus of Ascalon and Philo of Larissa—both of them claimed the heritage of the Platonic Academy—he owed a life-long allegiance to the Academic tradition of Carneades. Very often (...) we are faced with a poor state of his own argument. But it seems to me very likely that in main questions his position was consistent throughout his life, and I consider his own philosophy as the beginning of the rising Middle Platonism. (shrink)

Laypersons serve at critical junctures in the legal process. This article provides an overview of research about layperson roles and draws attention to the research methodologies used in studying them. It also discusses the jury system because, in addition to the fact that this institution has attracted the greatest quantity of empirical research on lay participation in legal processes, the studies have also involved the greatest range of methodological approaches, thus allowing exploration of their various strengths and weaknesses. Research on (...) mixed tribunals, lay magistrates, justices of the peace and other forms of lay participation are also discussed in the article. There are literally hundreds of empirical studies bearing on jury competence and behavior. More systematic research surveying the extent of layperson roles in different cultures and countries is needed and studies of how laypersons actually perform in these roles is crucial. (shrink)

Autor podrazumijeva činjenicu da su Crkva i kršćanstvo nastali, razvijali se i širili u ozračju grčko-rimske ili helenističke kulture u koju su, navješćujući vjeru u Krista, Otkupitelja i Spasitelja, unijeli određene sastojke tadašnje židovske kulture, omogućujući tako razvoj europske culture. U misionarskom djelovanju, posebno nakon otkrića Amerike, Crkva susreće i prihvaća i druge kulture. U novom vijeku Crkva sve više postaje svjesna važnosti tih kultura, da bi počevši s II. vatikanskim saborom počela govoriti o pluralizmu kultura, o važnosti autohtonih kultura (...) trećeg svijeta, tražeći načine kako ih plodonosno povezati s navještajem Evanđelja. Autor iznosi kako Crkva u dokumentima II. Vatikanskog Sabora, posebno u pastoralnoj konstituciji Gaudium et spes, naširoko govori o kulturi , prihvaćajući također činjenicu pluralizma kulturâ. U spomenutoj saborskoj konstituciji susrećemo definiciju kulture u br. 53. Govoreći o poslije-saborskom govoru Crkve o kulturi, autor analizira različite papinske dokumente i govore poslije II. vatikanskog sabora, dokumente različitih vatikanskih ureda, kao i one biskupa iz Latinske Amerike. Autor posebno analizira crkveni govor o problematici kulture i inkulturacije u navještaju vjere, želeći pokazati kako je Crkva u svojem djelovanju nakon Sabora susretala i prihvaćala nove izazove, posebno antropološki pristup kulturi i inkulturaciji, koji su je poticali da još jasnije progovori o kulturi, o pluralizmu kultura, i o inkulturaciji vjere na kraju dvadesetog stoljeća.The author comprehends the fact that the Church and Christianity emerged , developed and spread in the atmosphere of the Greek-Roman or Hellenistic culture in wich they brought, by proclamation the faith in Jesus Christ, the Redeemer and Savior, the certain ingredients of Jewish cultur, making in such way possible the developement of European culture. In missionary work, especially after the discovery of America, the Church meets and accepts the other cultures. In the modern world Church more and more becomes conscious of these cultures. Beginning with the Second Vatican Council the Church speaks of a plurality of cultures and the importance of authentic cultures of the third world in order to find the ways how to fertile connect cultures with the proclamation of Gospel. The author brings out that the Church in the documents of Second Vatican Council, particularly in the Pastoral Constitution Gaudium et spes, widely speaks of culture accepting the fact of a plurality of cultures. The same pastoral constitution brings the definition of the word ‘culture’ in the number 53. Based on the topic of culture after the Second Vatican Council the author analyzes the different papal document and speeches, the document of various Vatican offices, as well as documents of bishops from Latin America. The author particularly analyzes the Church’s speech founded on the problem of culture and inculturation in the proclamation of faith, in order to show how Church, in its work after the Second Vatican Council, met and accepted new challenges, especially anthropological admission to culture and inculturation, that gave an impulse to the Church to speak more clearly of culture, of a plurality of cultures and of inculturation of faith at the end of 20th century. In the paper authors present, examine, and test elements of the vital idea of the philosophical morphology as a method and a technique of philosophical investigation. The paper consists of some applications mostly concerning the method applied by L. Wittgenstein in PI and related later works, and of a series of examples concerning daily phenomena. In the first part the philosophical morphology is explicated as a method, and in the second and in the third part basic “commandments” of morphological technique (...) are described and examined, namely the first one – which says that one should “look-at exhaustively”, and the second one – which says that one should “see-as and describe synoptically”. In these parts some objections and replies to crucial morphological ideas are provided and accompanied with examples. (shrink)

Leta 1740 se je oče Žiga Škerpin (Sigismundus Skerpin, 1689‒1755) kot predstavnik hrvaške in kranjske province frančiškanskega reda udeležil generalnega kapitlja frančiškanskega reda v Kastilji. Med potjo iz Ljubljane v Valladolid in nazaj, ki je trajala od 24. januarja do 10. septembra, je svoje doživljaje zapisoval. Po vrnitvi je nato dokončal rokopis Diarium oder Kurze beschreibung der Raiß, ki ga hranijo v frančiškanskem samostanu v Kamniku. Besedilo je nemško, le neka­teri odlomki so v latinščini. Škerpin je potoval po Kranjski, Koroški (...) in Tirolski, vzdolž meje med Svetim rimskim cesarstvom in Švicarsko konfederacijo, nato pa po Alzaciji in Burgundiji proti jugu, saj je želel videti čim več Francije. V Franciji se je zadržal tudi na poti domov: iz Valladolida je potoval skozi jugozahodno Francijo ter se za nekaj dni ustavil v Parizu in Versaillesu. Po habsburških dednih deželah je potovanje potekalo brez težav: Škerpin je prenočeval v frančiškanskih in drugih samostanih, prijazno pa so ga sprejele tudi posvetne oblasti. Ko je potoval ob Bodenskem jezeru in Renu, se je pogosto znašel v politično in versko drugačnem okolju, na primer na protestantskih območjih Švicarske konfederacije (npr. v Baslu). Na največje težave je naletel v Franciji, deloma tudi zato, ker ni znal francosko. Redno se je pritoževal nad Francozi in njihovim pomanjkanjem spoštovanja do duhovščine, splošno negostoljubnostjo in visokimi cenami. Kljub temu pa sta ga navdušili urejenost francoskih cerkvenih, državnih in mestnih ustanov, zlasti samostanov, univerz in bolnišnic, ter veličina arhitekturnih in inženirskih dosežkov, kot so ceste, mostovi, utrdbe, vodne črpalke in kanali. V Španiji, kjer je opazil veliko spoštovanje do duhovnikov, zlasti do frančiškanov, se je počutil bolj sprejetega. (shrink)
