Si la place accordée à la démocratie et aux libertés est résiduelle chez Carré de Malberg, elle ressort bien plus clairement chez Kelsen. Les deux auteurs restent néanmoins fortement imprégnés, dans la logique positiviste, par l’idée d’ordre (articulant unité et puissance) qui structure encore, en filigrane, nos systèmes juridiques contemporains.
