Legal theory usually distinguishes only two kinds of legal realism: the American and the Scandinavian. Another school of this theoretical perspective is German legal realism, which refers to scholars like Ihering, Weber, and Schelsky. According to German legal realism, the author outlines what legal theory can do to persuade modern jurisprudence to face the social reality of law, conceived as institutionalized normative communication. In a recent article published in this journal, Kris McDaniel proposes a variant of Peter van Inwagen’s argument against the principle of sufficient reason that makes crucial use of plural grounding. In this response paper I object to McDaniel’s argument. I argue that there is no notion of plural grounding available that is both irreflexive in the sense required for the argument to go through and general enough to formulate the principle of sufficient reason as proposed by McDaniel.

This study examines the public's and physicians' willingness to support deception of insurance companies in order to obtain necessary healthcare services and how this support varies based on perceptions of physicians' time pressures. Based on surveys of 700 prospective jurors and 1617 physicians, the public was more than twice as likely as physicians to sanction deception (26% versus 11%) and half as likely to believe that physicians have adequate time to appeal coverage decisions (22% versus 59%). The odds of public (...) support for deception compared to that of physicians rose from 2.48 to 4.64 after controlling for differences in time perception. These findings highlight the ethical challenge facing physicians and patients in balancing patient advocacy with honesty in the setting of limited societal resources. (shrink)

Advances in science and technology have added to our insights into the vulnerabilities of human agency as well as to the methods of exploiting them. This has raised the stakes for efforts to clarify the concept and ethics of manipulation. Among these efforts, Robert Noggle’s influencer-centered account of manipulation has been most significant. He defines manipulative acts as those whereby an agent intentionally influences a recipient’s attitudes so that they do not conform as closely as they otherwise would to the (...) pertinent norms and ideals endorsed by the influencer. This provides a relatively simple and in many ways clear definition of manipulation. It sidesteps thorny debates about autonomy, freedom, or practical rationality. It also promises to reveal a conceptual parallel between manipulating and lying, and thus to explain why manipulation is pro tanto wrong. In one respect, however, the account remains ambiguous: It remains unclear whether, and to what extent, it requires that influencers’ beliefs about what is ideal for their recipients to be grounded in some effort on the part of the influencer to identify with or take on the role of her recipient. This paper explains this ambiguity. It argues that influencer-centrism cannot remain indifferent to the validity of an agent’s beliefs about the ideal state of the recipient and provide an identification requirement that would render the whole account plausible and sufficiently determinate. Conceptual research is interdisciplinary in two regards. On the one hand, various disciplines have developed various approaches to conceptual research. These range from conceptual analysis and conceptual history in philosophy, Begriffsgeschichte in historical and literary studies to term-related semantics in linguistics and conceptual research in psychoanalysis. On the other hand, concepts play a key role in any cooperation within interdisciplinary research projects. If they remain undiscussed and unmediated between the participating disciplines, they tend to impede productive cooperation. This contribution provides (...) an overview of different forms of conceptual research and introduces the approach of Experimental Conceptual Research as a technique of conceptual reflection, which unifies approaches of various disciplines by going back to an investigation of those criteria that become effective in the practice of concept formation and usage. As a criterial investigation, it starts at the level of conceptualizing phenomena within the course of research. In this way, premature fixations of conceptually filtered perceptions can be avoided, allowing the discovery of distinguishing features in phenomena to pave the way for forms of interdisciplinary cooperation that are deeply anchored in material content. I focus on the relationship between the coalition of ideas including constructivism and enactivism on the one side, and ontology in general on the other. Based on a certain logico-phenomenological attitude that dominated Polish philosophy in the 20th century I argue that ontology as such is not burdened with realistic or representationalist presumptions. Die Einsicht in die einzelnen Formen der Positivität ermöglicht es, sich einen Begriff von der Sprachlichkeit des Selbstbewusstseins zu machen.

Corruption continues to be a considerable challenge for internationally active companies. In this article, we examine personal and socioenvironmental antecedents of corrupt behavior in organizations. In particular, we aim to illuminate the links between Machiavellianism, on-the-job experience with corrupt behavior at work, neutralization, and the attitude of business professionals toward corruption. The empirical analysis is based on the responses of 169 professionals. At first, a positive relationship between both Machiavellianism and on-the-job experience and the acceptance of corruption appears in the (...) model. However, an in-depth mediation analysis shows that neutralization is the keystone linking both Machiavellianism and on-the-job experience to the likelihood to condone corruption. The paper defines dialogic rationality and shows a rational path and understanding from the individual point of view. A separate discipline or discourse should coordinate the urgent need of deeper emotional transformation (metanoia) and explore the appearance of inner spiritual connectedness. This will establish the importance of every unique creature in the universe. Consequently in postmodernism, epistemology can no longer be accomplished by a “clear” cognitive theory, separated from ontological and anthropological elements. Cognition can no longer progress to an unchangeable, (...) non-falsifiable knowledge, because of changes within the object’s inner ontological level. Thus an observer can only interpret the phenomena but can never say “the last word”. Human cognition is based on time-coordinates when an observer tries to make a projection before the future has come. Yet existing now, it also contains the step back to the past as a shore of memory, experience, and knowledge. In this view history is considered to be non-linear—it is a complicated forward process, still continuously going back to the origin of human correlations with nature. A dialogic approach does not reject the importance of self-organizing processes, but tries to compose a sphere of acknowledgeable co-existence with the other to save the whole specter of human physical and mental, existential and creational features. Facing rational or mystical, but still radical, transformation, we get a sense of self-existence and can actively work and challenge ourselves to realize this in every-day life and in communication with the other. This paper argues that institutions are higher-level autonomous systems enacted by patterns of participatory sense-making. Therefore, unlike in the standard equilibrium theory, institutions are not themselves thought of as behavioural patterns. Instead, they are problem domains that these patterns have brought forth. Moreover, these are not merely any patterns, but only those devoted to maintaining a specific strategy of problem solving, called the strategy of ‘letting be’. The latter refers to, following Hanne de Jaegher, a balance between underdetermination and overdetermination (...) of individual behaviour by a collective. Such an understanding of institutions becomes an option once a hybrid ‘equilibrium + rules’ theory of institutions, such as the one proposed by Frank Hindriks, is supplemented with insights from enactivism. In this light, drawing a connection between these two areas is the additional, meta-theoretical goal of this paper. This connection is beneficial, I argue, in particular since it allows for a satisfactory, in-depth account of the normative character of institutions as well as their local character. (shrink)
