Legal and political controversies persist about the performance of Kelsenian-type constitutional courts in democratic systems. One of the reasons is that the design of these institutions cannot easily accommodate simultaneous but conflicting demands for the strong protection of democracy and human rights, judicial independence and constitutional restraint. Challenging the dominant approach to the design of contemporary constitutional courts, this article proposes a new way to balance these three values through reforms to the structure of Kelsenian institutions. The proposal seeks to (...) institutionalize constitutional restraint, embedding it into courts’ internal functioning rules while, concurrently, emancipating constitutional judges from political control through a reform of appointment procedures. It is argued that the combined effects of these two reforms will produce constitutional courts that are more independent and able to protect the core elements of a democratic political community while, at the same time, increasing constitutional deference to the democratically elected legislator. The Cynic moral and sociopolitical imprint on Stoic philosophy has frequently been overlooked in recent academic studies. However, the Cynic influence is palpable throughout the history of Stoicism. In this article, I recognise seven Cynic-Stoic conceptual continuities concerning the idea of virtue, or aretē, and five continuities concerning the morally ideal society. This article is mainly descriptive, as it serves a modest but theoretically vital purpose: to explain the interrelation(s) among these 12 Cynic–Stoic continuities, which will elucidate the strong (...) cohesion of each (moral/political) philosophical system. Ergo, I show how these 12 continuities strongly and simultaneously imply a Cynic-Stoic continuity in terms of the conceptions or appraisals of culture-tradition, epistemology, sexuality, money, law, religion and cosmopolitanism. The main objective of this study is to identify the socioemotional competencies of adolescents in secondary education who are currently in the first grade of secondary school (school year 2022-2023), which contribute to a better interaction with their peers and environment, in addition to preventing possible risk behaviors. It will be approached from a quantitative approach, with a descriptive scope. The sample consists of 19 students from a private institution, located in the municipality of Guadalupe, Zac. A questionnaire called (...) emociogram was applied through the Habilmind platform, to identify the main characteristics regarding the emotional scale, which in turn is composed of five subscales such as: empathy, assertiveness, interpersonal emotional regulation, teamwork and conflict resolution. The results show us some areas of opportunity that should be emphasized in order to improve the results and thus improve the socioemotional competencies of adolescents. (shrink)

What did John Dewey mean by the experience? Researchers of John Dewey’s work often attempt to decipher the American thinker’s thesis, statements and postulates. However, specific approaches have probably become inexact when interpreting many of his concepts, even thinking that they are superficial idealism. Detailed state-of-the-art review during the past decade, in terms of the idea of experience in Dewey, makes it possible to think that this concept –although not precisely defined as that of a dictionary– can be analyzed more (...) accurately. The last is the debate and reflection that will be open to the academic community in this paper; to clarify and, subsequently, define the concept, two fundamental and inherent aspects are presented in this document: first, the pragmatist line that addresses an epistemological framework of the idea; second, two Deweyan elements will be enlightened, these are the living organism and nature, which, as the axis of an empirical influence, are analyzed from the Vermont philosopher’s perspective. This concept also addresses three essential perspectives: biological, psychological and social, bearing in mind that, according to Dewey, real experiences occur if “meaning” comes after. The aim of this work is to question the neoliberal governance standing from Michel Foucault’s philosophy. The starting point is that Foucaultian reflection is able to trigger a characterization of neoliberal rationality which can show the connection between freedom, individual and government. Likewise, the hypothesis of this writing holds that Foucault’s notion of ontology of actuality allows to criticize in a quite radical way the identities that the neoliberal logic imposes. The present work aims to study the knot formed between ontology, normativity and subjetivation in order to tackle the problem of materiality of domination relations. Along these lines, a materialist aproach will explore the movements, relationships and multiple implications among these dimensions. This method seeks to dismantle the tendency of philosophical idealism that appeals to the suture, blocking and closure of the plurality of events through some normative principle of a, let´s say, a priori trascendental or empirical character. This article presents the relationship between the notions of equality and freedom assumed by Castoriadis as necessary conditions for social autonomy project. The chiasmatic figure that Castoriadis establishes between equality and freedom will be approached with the aim of clarifying whether both notions should be addressed jointly or, on the contrary, they can be considered separately for an autonomy project as well. Once exposed the difficulties that appear in the representation that establishes a correspondence between both terms, attention (...) class='Hi'>will be directed to the need of the figure of law as a legal element to guarantee the privileges that are granted to the members of the community in the Autonomy project that is equal participation. To conclude, the article will be directed to a silence in the work of Castoriadis; who can be considered a subject in the autonomy project, that is, who should participate in the formation of the new institutions. The aim of this paper is to propose a self-representational theory of phenomenal consciousness from Sartre. For it I will clarify and show the closeness of two ideas. The first of these is the so-called self-representational theory of consciousness, which holds that a mental state is conscious if and only if it represents itself in the right way. The second of these are the descriptions of consciousness from Sartre, which say that all consciousness is self-consciousness of itself, or more (...) precisely: every positional consciousness of an object is at the same time a non-positional consciousness of itself. The 2016 Royal Society of Chemistry’s report Future of the Chemical Sciences presents four different scenarios for the future of chemistry: chemistry saves the world; push-button chemistry; a world without chemists; and free market chemistry. In this paper we ethically assess them. If chemistry is to solve many of the greatest challenges facing the contemporary world, prioritization of research topics will need to be done explicitly on the basis of moral values, ​​such as solidarity and equity, but also environmental (...) justice, which will have to be central in determining a research agenda for chemistry. The decentralization of chemistry will also present ethical challenges to the research standards established by the scientific community. Ethical education in chemistry may help counteract these risks. We also argue that if chemistry and its subdisciplines are to fulfil their goal of generating knowledge and helping us solve the great challenges of the contemporary world, then it is ethically imperative that scientists from different disciplines be more open to interdisciplinary work. Finally, if the future of chemistry is in free market forms, then it is necessary that we pay more attention to the possible risks that this model has. We call attention to two: first, it is likely that problems that affect the lowest income countries or the most disadvantaged sectors of society, who do not have the means to pay for some of the goods and services, will not be addressed; second, the free market tends to foster unsustainable forms of development. Within the results, 56.5 % of respondents understood the concept of LTE, and 90 % applied it actively. BackgroundUpper limb impairment is common after stroke, and many will not regain full upper limb function. Different technologies based on surface electromyography (sEMG) have been used in stroke rehabilitation, but there is no collated evidence on the different sEMG-driven interventions and their effect on upper limb function in people with stroke.AimSynthesize existing evidence and perform a meta-analysis on the effect of different types of sEMG-driven interventions on upper limb function in people with stroke.MethodsPubMed, SCOPUS, and PEDro databases were systematically (...) searched for eligible randomized clinical trials that utilize sEMG-driven interventions to improve upper limb function assessed by Fugl-Meyer Assessment (FMA-UE) in stroke. The PEDro scale was used to evaluate the methodological quality and the risk of bias of the included studies. In addition, a meta-analysis utilizing a random effect model was performed for studies comparing sEMG interventions to non-sEMG interventions and for studies comparing different sEMG interventions protocols.ResultsTwenty-four studies comprising 808 participants were included in this review. The methodological quality was good to fair. The meta-analysis showed no differences in the total effect, assessed by total FMA-UE score, comparing sEMG interventions to non-sEMG interventions (14 studies, 509 participants, SMD 0.14, P 0.37, 95% CI –0.18 to 0.46, I255%). Similarly, no difference in the overall effect was found for the meta-analysis comparing different types of sEMG interventions (7 studies, 213 participants, SMD 0.42, P 0.23, 95% CI –0.34 to 1.18, I273%). Twenty out of the twenty-four studies, including participants with varying impairment levels at all stages of stroke recovery, reported statistically significant improvements in upper limb function at post-sEMG intervention compared to baseline.ConclusionThis review and meta-analysis could not discern the effect of sEMG in comparison to a non-sEMG intervention or the most effective type of sEMG intervention for improving upper limb function in stroke populations. Current evidence suggests that sEMG is a promising tool to further improve functional recovery, but randomized clinical trials with larger sample sizes are needed to verify whether the effect on upper extremity function of a specific sEMG intervention is superior compared to other non-sEMG or other type of sEMG interventions. The combined effect of coercion (public and private pressure), self-interest (competitive advantage) and conviction (intrinsically motivated or genuine) explain why environmental issues have become a key priority for companies. While research has explored coercion and competitive advantage, the role of conviction has received little attention. This paper aims to address this gap. Conviction, which has been correlated with institutional and individual drivers, offers more stable results and a potential multiplier effect as good examples are disseminated by imitation throughout an industry. (...) While the role of imitation has drawn increasing attention of business management studies, it has received scant attention in research on sustainability. This is the second gap this paper aims to address, contributing to the literature on sustainability in two ways: firstly, we will further explore the role of conviction in environmental sustainability; secondly, employing a compartmental model of epidemic propagation, used for other social phenomena, we model the role genuine examples by leaders can play within an industry and the dissemination of good behavior by imitation. Defining genuine conviction as the voluntary mitigation of the externalities of a firm's operations beyond that required by law or the market, substantiated in the responsible behavior of its leaders, our model discovers patterns that policymakers could use to create a “sustainability epidemic”. We suggest mathematical models of epidemics can be applied to sustainability, offering a fresh perspective on the phenomenon of imitation, allowing us to discover how some cultural and social habits can be used. This paper examines the influence of internal barriers on the relationship between the organizational capability of stakeholder integration and proactive environmental strategies. We adopt a moderate hierarchical regression model to test the hypotheses using data from a sample of 73 managers in the business education industry. The paper contributes to stakeholder theory by showing that stakeholder integration positively influences the development of proactive environmental strategies when managers perceive internal barriers to the development of such strategies. In Older Adults (OAs), Electroencephalogram (EEG) slowing in frontal lobes and a diminished muscle atonia during Rapid Eye Movement sleep (REM) have each been effective tracers of Mild Cognitive Impairment (MCI), but this relationship remains to be explored by non-linear analysis. Likewise, data provided by EEG, EMG (Electromyogram) and EOG (Electrooculogram)—the three required sleep indicators—during the transition from REM to Non-REM (NREM) sleep have not been related jointly to MCI. Therefore, the main aim of the study was to explore, with (...) results for Detrended Fluctuation Analysis (DFA) and multichannel DFA (mDFA), the Color of Noise (CN) at the NREM to REM transition in OAs with MCI vs. subjects with good performances. The comparisons for the transition from NREM to REM were made for each group at each cerebral area, taking bilateral derivations to evaluate interhemispheric coupling and anteroposterior and posterior networks. In addition, stationarity analysis was carried out to explore if the three markers distinguished between the groups. Neuropsi and the Mini-Mental State Examination (MMSE) were administered, as well as other geriatric tests. One night polysomnography was applied to 6 OAs with MCI (68.1 ± 3) and to 7 subjects without it (CTRL) (64.5 ± 9), and pre-REM and REM epochs were analyzed for each subject. Lower scores for attention, memory and executive funcions and a greater index of arousals during sleep were found for the MCI group. Results confirmed that EOGs constituted significant markers of MCI, increasing the CN for the MCI group in REM sleep. The CN of the EEG from the pre-REM to REM was higher for the MCI group vs. the opposite for the CTRL group at frontotemporal areas. Frontopolar interhemispheric scaling values also followed this trend as well as right anteroposterior networks. EMG Hurst values for both groups were lower than those for EEG and EOG. Stationarity analyses showed differences between stages in frontal areas and right and left EOGs for both groups. These results may demonstrate the breakdown of fractality of areas especially involved in executive functioning and the way weak stationarity analyses may help to distinguish between sleep stages in OAs. Bayesian confirmation theory is our best formal framework for describing inductive reasoning. The problem of old evidence is a particularly difficult one for confirmation theory, because it suggests that this framework fails to account for central and important cases of inductive reasoning and scientific inference. I show that we can appeal to the fragmentation of doxastic states to solve this problem for confirmation theory. This fragmentation solution is independently well-motivated because of the success of fragmentation in solving other problems. I (...) also argue that the fragmentation solution is preferable to other solutions to the problem of old evidence. These other solutions are already committed to something like fragmentation, but suffer from difficulties due to their additional commitments. If these arguments are successful, Bayesian confirmation theory is saved from the problem of old evidence, and the argument for fragmentation is bolstered by its ability to solve yet another problem. Psychiatry uncomfortably spans biological and psychosocial perspectives on mental illness, an idea central to Engel's biopsychosocial paradigm. This paradigm was extremely ambitious, proposing new foundations for clinical practice as well as a non-reductive metaphysics for mental illness. Perhaps given this scope, the approach has failed to engender a clearly identifiable research programme. And yet the view remains influential. We reassess the relevance of the biopsychosocial paradigm for psychiatry, distinguishing a number of ways in which it could be (re)conceived.

This paper examines ethical violations committed by Certified Public Accountants in Puerto Rico in the 2002–2010 period and the related disciplinary actions taken by the local regulatory bodies. The institutional settings for the accounting profession in PR are different from those of the United States. Ethical complaints are investigated by the PR Society of CPAs and evaluated based on the Code of Professional Conduct of the American Institute of Certified Public Accountants, although most CPAs in PR are not affiliated with (...) the AICPA. Our study is based on data provided by the PR Society of CPAs that is not publicly available. We examine the association between the occurrence of the ethical violations and certain variables such as gender, type of practice performed by the CPA, and whether the CPA participates in a peer review program. Results of a multiple correspondence analysis suggest that not being a member of the AICPA, practicing as a sole practitioner, and not participating in a peer review program seem to be more associated with the occurrences of ethical violations by CPAs. We compare our findings with prior research on ethical infractions committed by CPAs in the United States and find some differences attributable to the institutional settings in PR. Overall, our results suggest the importance of codes of conduct in the accounting profession and compliance with such ethical guidelines by practicing accountants. (shrink)

Verbs in the passive voice have been described as linguistic features which can exert ideological effects because they typically omit the agent, or ‘doer’ of an action. These missing agents are said to be potentially ‘mystified’ to readers. But to what extent are these agents actually mystified to readers, and can we predict when mystification is likely to occur? A text-based analytical framework for inference prediction focusing on agency mystification was applied to two corpora of US newspaper editorials. Eighty-four percent (...) of passive verbs were predicted not to mystify agency for casual readers. To test this method of inference prediction, a reader response study was carried out in which readers were asked to identify agents that had been deleted from texts via the addition of agentless passives. By a standard of 50% accuracy, 74% of passives were found to be non-mystifying. These results suggest that agents missing from texts are likely to be inferred correctly by readers in a majority of cases and that mystification may be predictable from text analysis. (shrink)

This study aims to test the theoretical model of career adaptability of refugees to investigate the dynamics of successful resettlement. The theoretical model is grounded on career construction and social network theory. We employ quantitative and qualitative methodologies to test the model in a sample of Venezuelans living and working in Colombia. The quantitative results provide partial support for Campion’s model. However, we test an alternative model and find that career adaptability has a direct relationship with subjective resettlement. In addition, (...) cultural identification plays a buffering role on the harmful effects of discrimination on subjective resettlement. Qualitative results from eight in-depth interviews shed light on the process of refugee resettlement, thus revealing the role of social networks. Our study contributes to previous research on refugees by testing, adapting, and expanding a novel model of work resettlement and focusing on a group of refugees transitioning from one emerging country to another emerging country. One of the most distinctive features of the tradition of philosophy on this continent has been the insistence that lived experience is the ultimate source of knowledge, and, more (...) importantly, amelioration of individual and collective community experience is the ultimate criterion for validation of knowledge relations. Dr. Ira Harkavy and the Netter Center at which he works represent a version of that ideal made institutionally manifest.In his 2022 Coss Lecture, Harkavy offers a vision for how the ideal of knowledge generation grounded in community experience and serving community priorities could be institutionalized in major US research universities. Furthermore, he makes the case that this transformation of research universities would revitalize our collective commitment to democratic citizenship and governance. It is an appealing vision, earnestly offered. In what follows, I celebrate the merits of this vision but raise concerns that it does not adequately consider questions about the ontology of experience. I review some of those questions and offer suggestions about what an updated ontology of experience, one that could revitalize democracy in the manner Harkavy says is needed, would look like.Experiential Basis for My ResponseA short personal introduction will provide context for (and perhaps lend credibility to) my response comments. I am a Professor of Education at the University of Oregon with affiliate appointments in the Department of Philosophy and in the Department of Ethnic Studies. My area of theoretical specialization is the development of new qualitative methodologies for research on educational equity. The latter involves working out the implications of different epistemologies and ontologies for educational inquiry and practice. Specifically, I have spent most of my career looking at the way teachers’ classroom experiences can be a valid source of general knowledge about educational practice and policy (Rosiek and Atkinson; Rosiek and Gleason).Both branches of my scholarship exist in a dialectic with my community activism around educational equity issues. My largest project to date was a ten-year study of the racial resegregation of a public school district, looking at how students and teachers navigated its aftermath (Rosiek and Kinslow). My most recent project involved two years of working with teachers all over the world to identify the ways they addressed equity challenges during the pandemic and to identify the institutional conditions that helped or hindered such work (DeRosia et al.). In a less academic context, I have worked with local educational activist organizations in my home community to support the needs of immigrant families and students, to create safer spaces for LGBTQIA students, and to get more equity-minded school board members elected.I share all of this just to clarify that I am familiar with the challenge of putting university expertise in the service of community improvement and, more specifically, promoting equity in educational institutions. I am familiar with approaching research in a manner that respects practitioners and non-academic community members as sources of knowledge, not just objects of knowledge.Praise for the Work at the Netter CenterFrom the vantage point that experience provides me, I want to offer energetic praise for the work that Harkavy and the Netter Center have been doing these last three decades. We should all recognize the difficulty of integrating the university’s knowledge-producing role with local education and service work (Brewer; Harkavy et al.). It is even more difficult to do so when aspiring to the ideal of collaborative knowledge production with the community in a manner that genuinely commits to epistemic egalitarianism. Service learning can be trivialized and can become the exploitative enlistment of unpaid labor in the service of an agenda exogenous to both the participants and the community (Santiago-Ortiz; Stoecker).
