En se basant sur l'anthropologie à la fois d'Aristote et de Saint Thomas d'Aquin, Maritain propose une conception de l'homme dans laquelle la morale est étroitement liée aux composantes ontologiques dans l'être humain. Le personnalisme de Maritain met l'accent sur le caractère communautaire de l'humanisme. L'homme s'accomplit au moment où il se donne à soi-même et aux autres. Ces deux dimensions du don sont constitutives pour que l'homme s'épanouisse intégralement et pleinement : le don à l'égard de (...) soi-même (la surexistence en connaissance et en amour) et le don à l'égard des autres (le service du bien commun). During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

Well-being is becoming an increasingly popular issue in economics. The aim of the article is to present the concept of well-being and the methods of its measurement and to examine the statistical significance between the results obtained by specific indicators. The article was written based on the meta-analysis of the books and scientific papers on the subject, as well as well-being and welfare measurement reports. The study shows that there is a very wide range of theories and concepts related to (...) well-being which are sometimes exceptive. The most important conclusion from the study is that the correlation between welfare and well-being represented respectively by GDP and HDI is very strong, while the correlation between welfare and life satisfaction as well as well-being and subjective well-being are negligible. Artykuł jest próbą zaaplikowania wywodzącego się od Martina Heideggera pojęcia „nastroju” do dzisiejszego kontekstu tzw. nowej nietolerancji i pogłębiającejsię agresji wobec szeroko rozumianej Inności. Wskazano powody tego stanu rzeczy orazargumenty, które stosuje się w obronie – rzekomo zagrożonych – praw większości. Głównąagorą sporu na linii większość–mniejszości staje się internet i toczące się w jego obrębiewojny kulturowe.

We discuss the logic of pregroups, introduced by Lambek [34], and its connections with other type logics and formal grammars. The paper contains some new ideas and results: the cut-elimination theorem and a normalization theorem for an extended system of this logic, its P-TIME decidability, its interpretation in L1, and a general construction of (preordered) bilinear algebras and pregroups whose universe is an arbitrary monoid.

Polnische und sowjetische Zwangsarbeiter, die in der nationalsozialistischen Ideologie als „Untermenschen“ galten, waren die am stärksten diskriminierten Nationalitäten unter den ausländischen Beschäftigten in der Kriegswirtschaft des „Dritten Reiches“. Ihre gesamten Lebens- und Arbeitsbedingungen waren der Rassenideologie untergeordnet. Diese Ideologie vertrug sich in hervorragender Weise mit der systematischen Ausbeutung ihrer Arbeitskraft. Das Ergebnis des Zwangsarbeitersystems war ein völlig repressives, sogar unmenschliches System mit miserablen Lebensbedingungen und minderwertiger medizinischer Versorgung. Sowohl die Lebensbedingungen als auch die medizinische Behandlung zeigen wie in einem Brennglas (...) die Hauptziele des NS-Staates und seinen rassistischen und entmenschlichten Charakter. Die im Nordosten Westfalens gelegene Stadt und der Landkreis Bielefeld sind aufgrund ihres gemischt industriellen und landwirtschaftlichen Charakters ein repräsentatives Beispiel für das brutale und repressive System der Zwangsarbeitsindustrie und spiegelt so das gesamte Spektrum der mit der Zwangsarbeit verbundenen Probleme wider. Die Analyse der medizinischen Versorgung im Raum Bielefeld ermöglicht die Unterscheidung zweier Gruppen polnischer Zwangsarbeiter. Die erste Gruppe besteht aus Personen, die in der Industrie beschäftigt sind, während die andere Gruppe eine gemischte Kategorie ist, die Arbeitnehmer aus den Bereichen Landwirtschaft, Dienstleistungssektor und Haushaltshilfe in Privathaushalten umfasst. In der ersten Gruppe war der Status der Arbeitnehmer in der Regel standardisiert. Die meisten von ihnen wurden in den Lagern untergebracht und einer brutalen und systematischen Ausbeutung unterzogen, die darauf ausgerichtet war, die Produktionseffekte zu maximieren und gleichzeitig Personen infolge widriger Arbeits- und Unterbringungsbedingungen und minimaler medizinischer Versorgung zu vernichten. Diese unmenschliche Behandlung war ein Derivat der rassistischen Ideologie. Status, Beschäftigungsbedingungen und medizinische Versorgung in der zweiten Gruppe waren viel uneinheitlicher und stärker von ganz unterschiedlichen Bedingungen abhängig. Wir haben es hier mit einer breiten Palette von Problemen zu tun, oft verbunden mit extrem unterschiedlichen Erfahrungen von Zwangsarbeitern mit dem medizinischen Personal und unterschiedlichen Einstellungen der Arbeitgeber zu den Zwangsarbeitern. Begrenzt wird die Aussagekraft unserer Darstellung durch die oft beschränkte Quellenlage. Insbesondere betrifft das den begrenzten Fundus an schriftlich festgehaltenen Erinnerungen der Zwangsarbeiter. Heute ist es praktisch unmöglich, das Quellenreservoir zu erweitern, da die Zeugen dieser Ereignisse nicht mehr zur Verfügung stehen. (shrink)

Law and Evil presents an alternative evolutionary picture of man, focusing on the origins and nature of human evil, and demonstrating its useful application in legal-philosophical analyses. Using this representation of human nature, Wojciech Załuski analyses the development of law, which he interprets as moving from evolutionary ethics to genuine ethics, as well as arguing in favour of metaethical realism and ius naturale.

Pentus (1992) proves the equivalence of LCG's and CFG's, and CFG's are equivalent to BCG's by the Gaifman theorem (Bar-Hillel et al., 1960). This paper provides a procedure to extend any LCG to an equivalent BCG by affixing new types to the lexicon; a procedure of that kind was proposed as early, as Cohen (1967), but it was deficient (Buszkowski, 1985). We use a modification of Pentus' proof and a new proof of the Gaifman theorem on the basis of the (...) Lambek calculus. (shrink)

We characterize all finitary consequence relations over S4.3, both syntactically, by exhibiting so-called passive rules that extend the given logic, and semantically, by providing suitable strongly adequate classes of algebras. This is achieved by applying an earlier result stating that a modal logic L extending S4 has projective unification if and only if L contains S4.3. In particular, we show that these consequence relations enjoy the strong finite model property, and are finitely based. In this way, we extend the known (...) results by Bull and Fine, from logics, to consequence relations. We also show that the lattice of consequence relations over S4.3 is countable and distributive and it forms a Heyting algebra. (shrink)

In this work, an intuitionistic propositional logic with a Galois connection is introduced. In addition to the intuitionistic logic axioms and inference rule of modus ponens, the logic contains only two rules of inference mimicking the performance of Galois connections. Both Kripke-style and algebraic semantics are presented for IntGC, and IntGC is proved to be complete with respect to both of these semantics. We show that IntGC has the finite model property and is decidable, but Glivenko's Theorem does not hold. (...) Duality between algebraic and Kripke semantics is presented, and a representation theorem for Heyting algebras with Galois connections is proved. This paper contains a discussion of striking similarities between influential philosophical concepts of the past and the approaches currently employed in selected areas of computer science. In particular, works of the Pythagoreans, Plato, Abelard, Ash’arites, Malebranche and Berkeley are presented and contrasted with such computer science ideas as digital computers, object-oriented programming, the modelling of an object’s actions and causality in virtual environments, and 3D graphics rendering. The intention of this paper is to provoke the computer science community to go (...) off the beaten path in order to find inspiration for the development of new approaches in software engineering. Propertarian justifications of intellectual property postulate the appropriation of various entities, often called patterns, designs, or technologies. These must be immaterial and should not be confused with material structures that embody them. Hence two classes of objects are distinguished. It is convenient to refer to them as types and tokens. The type must involve a condition defining which material structures should be considered its tokens. For an IP regime to be economically meaningful one must necessarily appropriate types in a way (...) which restricts access to wide classes of similar, non-identical material structures. Therefore, type conditions must be general. They must define, with a margin of tolerance, only certain aspects of the structure, leaving others unspecified. Consequently, the relationship between such types and tokens is of many-to-many variety. The recognition of these facts leads to four problems in justifying intellectual property on propertarian grounds. The first problem is to demonstrate possession of the type in the pre-legal situation. The second one is to explain, why boundaries of an appropriated type should be placed in a particular location. The third problem is to avoid claim deadlocks resulting from conflicts of rights generated by separate overlapping types. The fourth problem is to justify why ownership of the type should entail the control over other separate entities—that is tokens. In the propertarian framework grounded in the pre-legal state of nature, satisfactory solutions do not seem to have been proposed for any of these four problems. (shrink)

Electrotherapy is a dynamically developing method of treatment of sinus node dysfunction and atrioventricular conduction disturbances. It is an extremely important method used in the treatment of heart failure. The aim of this paper was to use classification trees for the differentiation between patients implanted with one of the three electrotherapy devices, i.e. SC-VVI/aai, DC-DDD, ICD/crt. The analysed data concerned 2071 patients who underwent implantation or device replacement procedures in the years 2010–2018, hospitalized in a coronary care unit. CART-type classification (...) trees with 5-fold cross-validation were used for the analysis. The decision concerning the choice of a particular electrotherapy device is always made based on the latest guidelines and the patient’s clinical condition. The used classification trees may enable verification of the state of implementation of guidelines in real-life therapeutic decisions. (shrink)

G.E.M. Anscombe znalazła w Etyce nikomachejskiej Arystotelesa pewną niekonsekwencję: Arystoteles zdaje się twierdzić, że cokolwiek wynika z namysłu, jest wyborem, i że słaby wolą może się skutecznie namyślać, ale i że — z drugiej strony — on nie wybiera. Anscombe znajduje rozwiązanie tej sprzeczności: Arystoteles powinien był, jej zdaniem, zaznaczyć, że by z namysłu wynikał wybór, to, ze względu na co się namyślamy, musiałby sam być przedmiotem uprzedniego wyboru. Badam to rozwiązanie i znajduję jego słabe strony, jak niebezpieczeństwo nieskończonego regresu, (...) trudność prześledzenia genealogii wyborów i nieosiągalność pierwotnego celu. Pomimo to próbuję je ulepszyć, poddając pod dyskusję, czy tego rodzaju pierwotne wybory, jakich wymaga rozwiązanie Anscombe, nie są jednak czasem naprawdę podejmowane i czy ich cele nie są rozkładalne na takie, które można realistycznie mieć nadzieję osiągnąć. Ludwik Fleck says that a thought-collective develops a thought-style which shapes the ways of perceiving the world and thinking of the world by its members. So how could it happen that at the end of 1900 Max Planck, whose thinking was determined by classical mechanics, managed to think that energy is quantized - the idea that contradicted the principles of Newton's mechanics? My answer is that Planck did not intend to think it.

According to Descartes ideas are the immediate objects of human mind. In "Meditationes de prima philosophia" there are three groups of ideas: "innatae", "adventitiae", "factae". However, in "Notae in Programma" Descartes says, that all human ideas must be innate. The ideas potentially exist in human mind. Descartes asserts human ideas are some kind of disposition to respond to sensory stimuli in particular way – by perceiving. The senses deliver occasions to actualizing our innate ideas. However, Descartes does not explain the (...) way of actualizing of innate dispositions (ideas). This problem has not been resolved by now. (shrink)

The paper presents a new argument supporting the ontological standpoint according to which there are no mathematical facts in any set theoretic model (world) constructed on the grounds of second order arithmetical theories founded upon set theory. Slingshot arguments directed against facts, situations and other propositional entities are usually blocked by rejecting one of the main inference rules used in various versions of this argument. Authors distinguish two types of main inference rules used in these variants: (i) for non-propositional expressions: (...) iota-conversion rules (ι-conv), iota-substitution rules (ι-subs), lambda-conversion principle (λ-conv); and (ii) for propositional expressions: the principle of substitutivity for logical equivalents (PSLE). Even if strategies for defending facts by the rejection of one of the mentioned rules are accepted, it may be shown that the acceptance of the requirement that mathematical facts (situations or truth-makers) differing with regard to their constituents are different facts, leads to the contradiction in meta-theories of set theoretic models for first order arithmetical theories. In the paper, a new type of slingshot argument is presented, which may be called hyper-slingshot . The difference between meta-theoretical hyper-slingshots and conventional slingshots consists in the fact that the former are formulated in the semantic meta-language of mathematical theories without the use of the iota-operator or the name-forming lambda-operator, whereas the latter require for their expression at least one of these non-standard term-operators. Furthermore, in hyper-slingshots PSLE is not used, whereas in conventional slingshots, PSLE plays a crucial inferential role. Hyper-slingshots implement simpler language tools in comparison with those used in conventional slingshots. (shrink)

The Limits of Cognition and the Shape of Being Based on the Thought of Karl Jaspers The article points out the elements of Karl Jaspers’ epistemological conception that cross out the possibility of a comprehensive account of being. The key issue here is the limits of cognition, which take the form of object cognition. The theme of limits points to the inadequacies of human thinking in the context of quantifiable and absolutist representations of reality. The impossibility of adequately grasping the (...) totality of reality will be illustrated here by means of the criticism Jaspers levelled at absolutising metaphysics. In connection with the description of the structure of cognition proposed by Jaspers, the article points out the conceptual proximity of the issue of worldview and metaphysics in the light of the thought of the cited author. In this article the author argues that the 'Liar' Paradox sentence: "This sentence is false" is neither true nor false because it does not express any proposition or "Satz" in the sense of Bernard Bolzano. The difficulty left open is that by a similar line of reasoning also the sentence "This sentence is true" would not express any proposition, yet it is sometimes taken to be true (on the strength of a theorem by Loewe).
