During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

Well-being is becoming an increasingly popular issue in economics. The aim of the article is to present the concept of well-being and the methods of its measurement and to examine the statistical significance between the results obtained by specific indicators. The article was written based on the meta-analysis of the books and scientific papers on the subject, as well as well-being and welfare measurement reports. The study shows that there is a very wide range of theories and concepts related to (...) well-being which are sometimes exceptive. The most important conclusion from the study is that the correlation between welfare and well-being represented respectively by GDP and HDI is very strong, while the correlation between welfare and life satisfaction as well as well-being and subjective well-being are negligible. This book carefully examines the most recent wave of the emergence and case law of activist constitutional courts: those that were set up after the fall of communism in Central and Eastern Europe. Artykuł jest próbą zaaplikowania wywodzącego się od Martina Heideggera pojęcia „nastroju” do dzisiejszego kontekstu tzw. nowej nietolerancji i pogłębiającejsię agresji wobec szeroko rozumianej Inności. Wskazano powody tego stanu rzeczy orazargumenty, które stosuje się w obronie – rzekomo zagrożonych – praw większości. Głównąagorą sporu na linii większość–mniejszości staje się internet i toczące się w jego obrębiewojny kulturowe.

We discuss the logic of pregroups, introduced by Lambek [34], and its connections with other type logics and formal grammars. The paper contains some new ideas and results: the cut-elimination theorem and a normalization theorem for an extended system of this logic, its P-TIME decidability, its interpretation in L1, and a general construction of (preordered) bilinear algebras and pregroups whose universe is an arbitrary monoid.

Polnische und sowjetische Zwangsarbeiter, die in der nationalsozialistischen Ideologie als „Untermenschen“ galten, waren die am stärksten diskriminierten Nationalitäten unter den ausländischen Beschäftigten in der Kriegswirtschaft des „Dritten Reiches“. Ihre gesamten Lebens- und Arbeitsbedingungen waren der Rassenideologie untergeordnet. Diese Ideologie vertrug sich in hervorragender Weise mit der systematischen Ausbeutung ihrer Arbeitskraft. Das Ergebnis des Zwangsarbeitersystems war ein völlig repressives, sogar unmenschliches System mit miserablen Lebensbedingungen und minderwertiger medizinischer Versorgung. Sowohl die Lebensbedingungen als auch die medizinische Behandlung zeigen wie in einem Brennglas (...) die Hauptziele des NS-Staates und seinen rassistischen und entmenschlichten Charakter. Die im Nordosten Westfalens gelegene Stadt und der Landkreis Bielefeld sind aufgrund ihres gemischt industriellen und landwirtschaftlichen Charakters ein repräsentatives Beispiel für das brutale und repressive System der Zwangsarbeitsindustrie und spiegelt so das gesamte Spektrum der mit der Zwangsarbeit verbundenen Probleme wider. Die Analyse der medizinischen Versorgung im Raum Bielefeld ermöglicht die Unterscheidung zweier Gruppen polnischer Zwangsarbeiter. Die erste Gruppe besteht aus Personen, die in der Industrie beschäftigt sind, während die andere Gruppe eine gemischte Kategorie ist, die Arbeitnehmer aus den Bereichen Landwirtschaft, Dienstleistungssektor und Haushaltshilfe in Privathaushalten umfasst. In der ersten Gruppe war der Status der Arbeitnehmer in der Regel standardisiert. Die meisten von ihnen wurden in den Lagern untergebracht und einer brutalen und systematischen Ausbeutung unterzogen, die darauf ausgerichtet war, die Produktionseffekte zu maximieren und gleichzeitig Personen infolge widriger Arbeits- und Unterbringungsbedingungen und minimaler medizinischer Versorgung zu vernichten. Diese unmenschliche Behandlung war ein Derivat der rassistischen Ideologie. Status, Beschäftigungsbedingungen und medizinische Versorgung in der zweiten Gruppe waren viel uneinheitlicher und stärker von ganz unterschiedlichen Bedingungen abhängig. Wir haben es hier mit einer breiten Palette von Problemen zu tun, oft verbunden mit extrem unterschiedlichen Erfahrungen von Zwangsarbeitern mit dem medizinischen Personal und unterschiedlichen Einstellungen der Arbeitgeber zu den Zwangsarbeitern. Begrenzt wird die Aussagekraft unserer Darstellung durch die oft beschränkte Quellenlage. Insbesondere betrifft das den begrenzten Fundus an schriftlich festgehaltenen Erinnerungen der Zwangsarbeiter. Heute ist es praktisch unmöglich, das Quellenreservoir zu erweitern, da die Zeugen dieser Ereignisse nicht mehr zur Verfügung stehen. (shrink)

We characterize all finitary consequence relations over S4.3, both syntactically, by exhibiting so-called passive rules that extend the given logic, and semantically, by providing suitable strongly adequate classes of algebras. This is achieved by applying an earlier result stating that a modal logic L extending S4 has projective unification if and only if L contains S4.3. In particular, we show that these consequence relations enjoy the strong finite model property, and are finitely based. In this way, we extend the known (...) results by Bull and Fine, from logics, to consequence relations. We also show that the lattice of consequence relations over S4.3 is countable and distributive and it forms a Heyting algebra. (shrink)

Law and Evil presents an alternative evolutionary picture of man, focusing on the origins and nature of human evil, and demonstrating its useful application in legal-philosophical analyses. Using this representation of human nature, Wojciech Załuski analyses the development of law, which he interprets as moving from evolutionary ethics to genuine ethics, as well as arguing in favour of metaethical realism and ius naturale.

In this work, an intuitionistic propositional logic with a Galois connection is introduced. In addition to the intuitionistic logic axioms and inference rule of modus ponens, the logic contains only two rules of inference mimicking the performance of Galois connections. Both Kripke-style and algebraic semantics are presented for IntGC, and IntGC is proved to be complete with respect to both of these semantics. We show that IntGC has the finite model property and is decidable, but Glivenko's Theorem does not hold. (...) Duality between algebraic and Kripke semantics is presented, and a representation theorem for Heyting algebras with Galois connections is proved. This paper contains a discussion of striking similarities between influential philosophical concepts of the past and the approaches currently employed in selected areas of computer science. In particular, works of the Pythagoreans, Plato, Abelard, Ash’arites, Malebranche and Berkeley are presented and contrasted with such computer science ideas as digital computers, object-oriented programming, the modelling of an object’s actions and causality in virtual environments, and 3D graphics rendering. The intention of this paper is to provoke the computer science community to go (...) off the beaten path in order to find inspiration for the development of new approaches in software engineering. Propertarian justifications of intellectual property postulate the appropriation of various entities, often called patterns, designs, or technologies. These must be immaterial and should not be confused with material structures that embody them. Hence two classes of objects are distinguished. It is convenient to refer to them as types and tokens. The type must involve a condition defining which material structures should be considered its tokens. For an IP regime to be economically meaningful one must necessarily appropriate types in a way (...) which restricts access to wide classes of similar, non-identical material structures. Therefore, type conditions must be general. They must define, with a margin of tolerance, only certain aspects of the structure, leaving others unspecified. Consequently, the relationship between such types and tokens is of many-to-many variety. The recognition of these facts leads to four problems in justifying intellectual property on propertarian grounds. The first problem is to demonstrate possession of the type in the pre-legal situation. The second one is to explain, why boundaries of an appropriated type should be placed in a particular location. The third problem is to avoid claim deadlocks resulting from conflicts of rights generated by separate overlapping types. The fourth problem is to justify why ownership of the type should entail the control over other separate entities—that is tokens. In the propertarian framework grounded in the pre-legal state of nature, satisfactory solutions do not seem to have been proposed for any of these four problems. (shrink)

The presentation of the formal conception of noemata is the main aim of the article. In the first section, three informal approaches to noemata are discussed. The goal of this chapter is specifying main controversies and their sources concerned with different ways of the understanding of noemata. In the second section, basic assumptions determining the proposed way of understanding noemata are presented. The third section is devoted to the formal set-theoretic construction needed for the formal comprehension of noemata. In the (...) fourth section, definitions of noemata and their various kinds, as well as definitions of other phenomenological notions are formulated. Electrotherapy is a dynamically developing method of treatment of sinus node dysfunction and atrioventricular conduction disturbances. It is an extremely important method used in the treatment of heart failure. The aim of this paper was to use classification trees for the differentiation between patients implanted with one of the three electrotherapy devices, i.e. SC-VVI/aai, DC-DDD, ICD/crt. The analysed data concerned 2071 patients who underwent implantation or device replacement procedures in the years 2010–2018, hospitalized in a coronary care unit. CART-type classification (...) trees with 5-fold cross-validation were used for the analysis. The decision concerning the choice of a particular electrotherapy device is always made based on the latest guidelines and the patient’s clinical condition. The used classification trees may enable verification of the state of implementation of guidelines in real-life therapeutic decisions. (shrink)

Both the defenders and critics of judicial review assume tacitly that there is a special moral capacity needed for a correct articulation of constitutional (explicit or implied) rights, and they only disagree about who is likely to possess this moral capacity to a higher degree. In this working paper I challenge this unstated assumption. It is not the case that the reasoning oriented towards rights articulation is more moral than many non-rights-oriented authoritative public decisions in the society. Further, I suggest (...) that rights-related reasoning cannot be shown to be differently moral in a way which would support the idea that this relevant difference may justify why some political agents (such as judges) may be more suited to performing this particular type of moral reasoning than others (such as legislators). The best argument for such a distinction refers to the opportunity for and habit of conducting "moral thought experiments" which is what, as part of their professional duties, judges normally do, and which they can therefore instinctively do also when they engage in a "concrete" judicial review of a statute. But there is no good moral reason to believe that "moral thought experiments" triggered by specific fact-situations should be privileged as a method of moral reasoning, compared to an unashamedly abstract, principle-based moral reasoning. If anything, a good case may be made (referring to the need to openly acknowledge moral conflict, secure impartiality, equality and legitimacy) for deliberately abstracting from specific cases and focusing on the abstract and general level, only modifying it later, if one is compelled to such modifications by considering evidence from specific instances. Not even one half (the bottom-up half) of the Rawlsian famous "reflective equilibrium" apparatus can be of help in this regard. (shrink)

Action logic of Pratt [21] can be presented as Full Lambek Calculus FL [14, 17] enriched with Kleene star *; it is equivalent to the equational theory of residuated Kleene algebras (lattices). Some results on axiom systems, complexity and models of this logic were obtained in [4, 3, 18]. Here we prove a stronger form of *-elimination for the logic of *-continuous action lattices and the –completeness of the equational theories of action lattices of subsets of a finite monoid and (...) action lattices of binary relations on a finite universe. Are there things that we must never do, no matter how untypical the circumstances and “unorthodox” our deontic ideas might be? In this essay I try to make evident that acts I call “pure sadist acts” satisfy this description. I discuss several examples of such acts and alert to their being not always easy to distinguish from certain others. Norms prohibiting such acts I call “true”, and I suggest that other, less suggestive, norms might also be (derivatively) true, if the (...) pertinent acts stand in certain relations with the former ones. I incorporate some ideas from Hume, as well as from elementary model theory, to make mine clearer. (shrink)

The main aim of this paper is to challenge the validity of the distinction between legal justice and social justice. It is argued that what we usually call legal justice is either an application of the more fundamental notion of social justice to legal rules and decisions or is not a matter of justice at all. In other words, the only correct uses of the notion of legal justice are derivative from the notion of social justice and, hence, the alleged (...) conflicts between criteria of social and legal justice result from the confusion about the proper relationship between these two concepts. Two views about the social justice/legal justice dichotomy are of particular importance and will provide the focus for the argument: this dichotomy is sometimes identified with a classical distinction between distributive and commutative justice and sometimes with the distinction between substantive and procedural justice. The Limits of Cognition and the Shape of Being Based on the Thought of Karl Jaspers The article points out the elements of Karl Jaspers’ epistemological conception that cross out the possibility of a comprehensive account of being. The key issue here is the limits of cognition, which take the form of object cognition. The theme of limits points to the inadequacies of human thinking in the context of quantifiable and absolutist representations of reality. The impossibility of adequately grasping the (...) totality of reality will be illustrated here by means of the criticism Jaspers levelled at absolutising metaphysics. In connection with the description of the structure of cognition proposed by Jaspers, the article points out the conceptual proximity of the issue of worldview and metaphysics in the light of the thought of the cited author. Anscombe znalazła w Etyce nikomachejskiej Arystotelesa pewną niekonsekwencję: Arystoteles zdaje się twierdzić, że cokolwiek wynika z namysłu, jest wyborem, i że słaby wolą może się skutecznie namyślać, ale i że — z drugiej strony — on nie wybiera. Anscombe znajduje rozwiązanie tej sprzeczności: Arystoteles powinien był, jej zdaniem, zaznaczyć, że by z namysłu wynikał wybór, to, ze względu na co się namyślamy, musiałby sam być przedmiotem uprzedniego wyboru. Badam to rozwiązanie i znajduję jego słabe strony, jak niebezpieczeństwo nieskończonego regresu, (...) trudność prześledzenia genealogii wyborów i nieosiągalność pierwotnego celu. Pomimo to próbuję je ulepszyć, poddając pod dyskusję, czy tego rodzaju pierwotne wybory, jakich wymaga rozwiązanie Anscombe, nie są jednak czasem naprawdę podejmowane i czy ich cele nie są rozkładalne na takie, które można realistycznie mieć nadzieję osiągnąć. In this article the author argues that the 'Liar' Paradox sentence: "This sentence is false" is neither true nor false because it does not express any proposition or "Satz" in the sense of Bernard Bolzano. The difficulty left open is that by a similar line of reasoning also the sentence "This sentence is true" would not express any proposition, yet it is sometimes taken to be true (on the strength of a theorem by Loewe).

The author argues that it is possible to develop a metaphysical interpretation of Aquinas's doctrine of natural law that still deserves serious philosophical consideration today; examines Aquinas's theoretical reflections on the metaphysical and epistemological aspects of human natural goodness, applying them to moral contexts as found in the Secunda secundae.
