The ‘right to the truth’ involves disclosing all the pertinent facts to a patient so that an informed decision can be made. However, this concept of a ‘right to the truth’ entails certain ambiguities, especially since it is difficult to apply the concept in medical practice based mainly on current evidence-based data that are probabilistic in nature. Furthermore, in some situations, the doctor is confronted with a moral dilemma, caught between the necessity to inform the patient (principle of autonomy) and (...) the desire to ensure the patient's well-being by minimising suffering (principle of beneficence). To comply with the principle of beneficence as well as the principle of non-maleficence ‘to do no harm’, the doctor may then feel obliged to turn to ‘therapeutic privilege’, using lies or deception to preserve the patient's hope, and psychological and moral integrity, as well as his self-image and dignity. There is no easy answer to such a moral dilemma. This article will propose a process that can fit into reflective practice, allowing the doctor to decide if the use of therapeutic privilege is justified when he is faced with these kinds of conflicting circumstances. We will present the conflict arising in practice in the context of the various theoretical orientations in ethics, and then we will suggest an approach for a ‘practice of truth’. Last, we will situate this reflective method in the broader clinical context of medical practice viewed as a dialogic process. (shrink)

This paper examines Ian Hacking's analysis of the looping effects of psychiatric classifications, focusing on his recent account of interactive and indifferent kinds. After explicating Hacking's distinction between 'interactive kinds' (human kinds) and 'indifferent kinds' (natural kinds), I argue that Hacking cannot claim that there are 'interactive and indifferent kinds,' given the way that he introduces the interactive-indifferent distinction. Hacking is also ambiguous on whether his notion of interactive and indifferent kinds is supposed to offer an account of classifications or (...) objects of classification. I argue that these conceptual difficulties show that Hacking's account of interactive and indifferent kinds cannot be based on - and should be clearly separated from - his distinction between interactive kinds and indifferent kinds. In clarifying Hacking's account, I argue that interactive and indifferent kinds should be regarded as objects of classification (i.e., kinds of people) that can be identified with reference to a law-like biological regularity and are aware of how they are classified. Schizophrenia and depression are discussed as examples. I subsequently offer reasons for resisting Hacking's claim that the objects of classification in the human sciences - as a result of looping effects - are 'moving targets'. (shrink)

At the current level of economic development, the digital transformation of society is an important factor in advancing any social structure. The purpose of the present study was to explore the transformation of a traditional society into a digital one, with a focus on ethical and environmental aspects. The study draws on a variety of information analysis methods to identify strengths, weaknesses, opportunities, and threats of digitalization, including the environmental aspect. Our research revealed that in Russia, the only highly digitalized (...) sectors were information technology and finance. Digitalization is strikingly different in the European countries, where only transport and building industries slowly implemented digital technologies into their business processes. We also examined digitalization levels in 7 Moscow universities. The universities managed to improve their digitalization scores with the help of recommendations developed for online learning, such as selection of quality software, having qualified teaching staff, constant monitoring, and evaluation of knowledge. The findings can be used in economic, social, and environmental spheres since they highlight the ambiguous effects of digitalization using practical examples. (shrink)

The appropriateness of S5 as a logic of knowledge has been attacked at some length in the philosophical literature. Here one particular attack based on the interplay between knowledge and belief is considered: Suppose that knowledge satisfies S5, belief satisfies KD45, and both the entailment property (knowledge implies belief) and positive certainty (if the agent believes something, she believes she knows it) hold. Then it can be shown that belief reduces to knowledge: it is impossible to have false beliefs. While (...) the entailment property has typically been viewed as perhaps the least controversial of these assumptions, an argument is presented that it can plausibly be viewed as the culprit. More precisely, it is shown that this attack fails if we weaken the entailment property so that it applies only to objective (nonmodal) formulas, rather than to arbitrary formulas. Since the standard arguments in favor of the entailment property are typically given only for objective formulas, this observation suggests that care must be taken in applying intuitions that seem reasonable in the case of objective formulas to arbitrary formulas. The first philosophers of the Frankfurt School famously turned to the psychoanalytic theories of Sigmund Freud to supplement their Marxist analyses of ideological subjectification. Since the collapse of their proposed "marriage of Marx and Freud," psychology and social theory have grown apart to the impoverishment of both. Returning to this union, Benjamin Y. Fong reconstructs the psychoanalytic "foundation stone" of critical theory in an effort to once again think together the possibility of psychic and social transformation. Drawing on the work (...) of Hans Loewald and Jacques Lacan, Fong complicates the famous antagonism between Eros and the death drive in reference to a third term: the woefully undertheorized drive to mastery. Rejuvenating Freudian metapsychology through the lens of this pivotal concept, he then provides fresh perspective on Theodor Adorno, Max Horkheimer, and Herbert Marcuse's critiques of psychic life under the influence of modern cultural and technological change. This article isolates ten prepositions, which constitute the undercurrent paradigm of contemporary discourse of health disease and medicine. Discussion of the interrelationship between those prepositions leads to a systematic refutation of this paradigm. An alternative set is being forwarded. The key notions of the existing paradigm are that health is the natural condition of humankind and that disease is a deviance from that nature. Natural things are harmonious and healthy while human made artifacts are coercive interference with natural balance. It (...) is suggested that the current paradigm is influenced by the world of finances and by instrumental reason. The alternative model suggests that human nature cannot be delineated. Humans fashion their own selves and nature by artificial means, medicine among them. The article discusses the implications of the paradigm adapted in various scholarly and popular debates such as the use of sex hormones for contraception, the care of the elderly, holistic medicine and distributive justice in health care. Medicine is not an isolated or a privileged realm. There is no unique entitlement to health care. It is always part of a broader agenda of social values and institutions. A open view of human societies, values and practices as they are situated within concrete material conditions is the platform required for an integrative and creative discourse of health care. In 1960, E. P. Wigner, a joint winner of the 1963 Nobel Prize for Physics, published a paper titled On the Unreasonable Effectiveness of Mathematics in the Natural Sciences [61]. This paper can be construed as an examination and affirmation of Galileo's tenet that “The book of nature is written in the language of mathematics”. To this effect, Wigner presented a large number of examples that demonstrate the effectiveness of mathematics in accurately describing physical phenomena. Wigner viewed these examples as (...) illustrations of what he called the empirical law of epistemology, which asserts that the mathematical formulation of the laws of nature is both appropriate and accurate, and that mathematics is actually the correct language for formulating the laws of nature. At the same time, Wigner pointed out that the reasons for the success of mathematics in the natural sciences are not completely understood; in fact, he went as far as asserting that “… the enormous usefulness of mathematics in the natural sciences is something bordering on the mysterious and there is no rational explanation for it.”. This paper draws on the economics of ethical compliance model to examine the association between ethical reasoning, perceived risk of detection, perceived levels of penalties and Chinese auditors'' ethical behavior in an audit conflict situation. Using 53 Chinese auditors from Shenzen as subjects, and a survey questionnaire, this study found that there is a significant negative association between ethical reasoning and the likelihood of unethical behavior and that this negative association is weaker for auditors who perceive higher risks of detection.

Foundational issues in statistical mechanics and the more general question of how probability is to be understood in the context of physical theories are both areas that have been neglected by philosophers of physics. This book fills an important gap in the literature by providing a most systematic study of how to interpret probabilistic assertions in the context of statistical mechanics. The book explores both subjectivist and objectivist accounts of probability, and takes full measure of work in the foundations of (...) probability theory, in statistical mechanics, and in mathematical theory. What is an inference rule? This question does not have a unique answer. One usually finds two distinct standard answers in the literature; validity inference $(\sigma \vdash_\mathrm{v} \varphi$ if for every substitution $\tau$, the validity of $\tau \lbrack\sigma\rbrack$ entails the validity of $\tau\lbrack\varphi\rbrack)$, and truth inference $(\sigma \vdash_\mathrm{t} \varphi$ if for every substitution $\tau$, the truth of $\tau\lbrack\sigma\rbrack$ entails the truth of $\tau\lbrack\varphi\rbrack)$. In this paper we introduce a general semantic framework that allows us to investigate the notion of inference (...) more carefully. Validity inference and truth inference are in some sense the extremal points in our framework. We investigate the relationship between various types of inference in our general framework, and consider the complexity of deciding if an inference rule is sound, in the context of a number of logics of interest: classical propositional logic, a nonstandard propositional logic, various propositional modal logics, and first-order logic. There have been two major lines of research aimed at capturing resource-bounded players in game theory. The first, initiated by Rubinstein (), charges an agent for doing costly computation; the second, initiated by Neyman (), does not charge for computation, but limits the computation that agents can do, typically by modeling agents as finite automata. We review recent work on applying both approaches in the context of decision theory. For the first approach, we take the objects of choice in a (...) decision problem to be Turing machines, and charge players for the “complexity” of the Turing machine chosen (e.g., its running time). This approach can be used to explain well-known phenomena like first-impression-matters biases (i.e., people tend to put more weight on evidence they hear early on) and belief polarization (two people with different prior beliefs, hearing the same evidence, can end up with diametrically opposed conclusions) as the outcomes of quite rational decisions. For the second approach, we model people as finite automata, and provide a simple algorithm that, on a problem that captures a number of settings of interest, provably performs optimally as the number of states in the automaton increases. Our reactions to actual crime-disbelief about the act committed, anger at the hurt caused, a desire to get even, and fear for ourselves and our children-arrive in an indecipherable rush of emotion. We perceive strong, intuitive, and sometimes oppositional reactions at once. So it is little wonder that no single traditional moral justification for punishment is satisfactory. Traditional theories, both retributive and utilitarian, are grounded in a priori truths that ignore the convergence of the theoretical, the practical and the emotional (...) that gives rise to the need to punish. In their stead, we should embrace an advertently pragmatic theoretical approach, which recognize the primary need to protect ourselves against danger, but looks as well to providing reformation wherever possible. Such an approach does not ignore the traditional rationales. To eschew retribution entirely is to deny a deeply-rooted moral intuition and forego efforts to tame it. To jettison utility is to condemn the victim and community to perpetual fear; just to the extent that retributive impulses, by any name, undermine necessary forward-looking concerns about our future's safety, they poorly serve our needs, which include service to the victim, the community and the offender. Societies are composed of groups that interact. Symbiotic groups are those in which agents complement each other in resources that they have in excess. Symbiotic groups are useful especially when the resources in an environment are distributed unevenly, because they enable agents to trade resources easily. However, for trading to happen successfully, agents in symbiotic groups need to cooperate, i.e., they should be willing to donate resources when appropriate. Similarly, if some agents in a symbiotic group are defectors, they should (...) be identified by others and eliminated from the group for the well-being of the remaining agents. Accordingly, we first study Edmonds’ tag-based model of symbiotic groups to understand the lifespan of symbiotic groups (e.g., why some groups live shorter than others). Then, we enhance Edmonds’ model by adding the capability of reciprocal interactions to agents, thus achieving a hybrid model. We capture reciprocity in three different models and study their effects on the elimination of defectors in symbiotic groups. Our experimental results show that the groups that are built with the proposed hybrid model can eliminate more defectors and earlier than tag-based models. Further, the hybrid approach can generate symbiotic groups more effectively and efficiently. (shrink)

The Gouldian argument for evolutionary contingency found in Wonderful Life can be dissected into three premises: palaeontological, macro-evolutionary, and developmental. Discussions of evolutionary contingency have revolved primarily around the developmental. However, a shift in methodological practice and new palaeontological evidence subsequent to the book’s publication appears to threaten the palaeontological premise that asserts high Cambrian disparity, or, roughly, that morphological differences between the Cambrian species were high. This presents a prima facie problem: Did the Cambrian consist of enough anatomical variety (...) to fuel a different outcome upon a replay of the tape of life? I investigate the role that disparity plays in the Gouldian argument for evolutionary contingency and conclude that the reduced disparity view does not undermine the argument, per se. As for the macro-evolutionary premise, Gould never offers any explicit justification for the idea that species sorting was indiscriminate or ‘lottery-like’ (though he certainly gestures at it). Putting aside the exegetical, I consider certain empirical avenues for underwriting the macro-evolutionary premise and argue that the most plausible route is to appeal to the special status of mass extinctions, a move that is not entirely unfamiliar to macro-evolutionists. That is, mass extinctions can be good sources of contingency due to their being ‘chancy’ in at least three respects. In sum, I update the palaeontological and macro-evolutionary premises as to reconstrue the Gouldian argument for evolutionary contingency in its strongest form. (shrink)

This essay revisits the significance of Kaufmann's Toledot ha-emunah ha-yisre'elit in Jewish intellectual history, as its reception has hitherto been somewhat reductive. His work is generally viewed as an anti-Christian polemic with a Zionist agenda that sought to glorify the formative period of his people. A closer look at his intellectual background, as well as his theoretical framework, leads us to a different understanding of his work in general and of its alleged nationalistic features in particular. BY EXPLORING THE ONGOING CONTROVERSY WHETHER TEACHER-LED recitation of the Pledge of Allegiance in public schools is constitutional, this paper demonstrates how and why Christians have much to gain from reverting the pledge to its pre-1954 text. I expose critical weaknesses in recent strategies to retain the contested words "under God" in the pledge employed by litigants, amici curiae, several Supreme Court justices, and other interested parties. I additionally interrogate the prominent place the American flag holds in public life and (...) question whether such preoccupation rises to the level of fetishism or even idolatry. Finally, I conclude that pacifists and others who are critical of America's expanding military empire have good reason to reject the Pledge of Allegiance entirely, whether or not the nation is described as being "under God.". The puzzle emerges from the phenomenon that Ruth Chang calls “parity”. The solution I advance construes prioritarianism as an essentially comparative view.

Open peer commentary on the article “Enaction as a Lived Experience: Towards a Radical Neurophenomenology” by Claire Petitmengin. Upshot: Why has the neurophenomenological approach not been adopted as a common and even obligatory tool in the study of consciousness? I suggest that the problem with the neurophenomenological approach is its effectiveness on the one hand and its almost impossible demands from the scientist on the other: One cannot accept the neurophenomenological approach without rejecting not only the paradigm of cognitive science, (...) but the scientific paradigm as a whole. The objective in this article is to apply a Daoist model of an ethic derived from the _Laozi_ on writings of the Huang Lao tradition to offer a unique Daoist cosmically derived ethic _in its own terms_. Having our point of departure in the _Laozi_ we refer to its paradoxical language as a _living riddle_ that is inherent in the tradition, and as such it suggests a "model of modeling." We find this model in _Laozi_ 25, according to which self-so (...) (_ziran_ 自然) serves as foundation for an ethic that is neither dichotomizing nor resting on human moral conventions, but serves rather as a guiding philosophy of living. On this basis we explore the question of an ethic in the Huang Lao tradition. (shrink)

This study examines whether truth-telling in the form of honest reporting is associated with cognitive moral development. Conventional agency theory assumes that people are self-interested and willing to tell a lie to increase their personal payoffs, while recent empirical evidence shows that some people give up monetary rewards to tell the truth. The social psychology literature suggests that cognitive moral development influences individuals’ ethical decisions. We carried out an experiment whereby participants submitted managerial reports in which truth-telling decreased their monetary (...) payoff. Despite the fact that their decisions were not subject to monitoring, auditing, or reputation effects, some participants reported honestly or partially honestly. We find the relationship between honest reporting and cognitive moral development to be both positive and linear. Compared with those at lower stages of cognitive moral development, participants at higher stages of cognitive moral development were more likely to submit an honest report and give up potential monetary gains from lying. We further examine the economic impact of honest reporting on the firm’s profit. With the assumption of self-interest and profit maximization, Antle and Eppen suggest that a contract with a hurdle-rate feature reduces managers’ information rent. We find that in comparison with the expected outcome of a hurdle contract, the firm can yield higher profits with a trust contract by hiring managers with a P-score higher than 16.67. (shrink)

İsrā’iliyyat which is the narration material passed on to Islam from other religions and cultures, primarily Judaism and Christianity has been one of the topics discussed especially within the frame of tafsir discipline throughout the fourteen centuries of Islamic history. While these narrations were used as one of the sources of information without being subjected to a normative evaluation in the early day tafsirs, they have been started to be criticized emphasizing mainly on the weakness of their imputation in the (...) classical tafsirs. When it was reached to the modern era, with the effect of movements of thoughts such as Western originated positivism, rationalism, and historical criticism, and orientalist allegations. İsrā’iliyyat has been criticized rather content-wise, reviewed as unreal, imaginary, mythological story-type narrations mixed with superstitions. As a result of these criticisms, both a distance has been kept from İsrā’iliyyat and also alternatives to it have been pursued. Although in the modern-day tafsirs, it has been consulted to the Bible as the strongest alternative to İsrā’iliyyat, this situation has made way for many debates, and it has dwelled on other alternatives than that. These points mentioned are valid for Tunisian scholar Tāhir İbn ʿĀshūr’s (1879-1973) tafsir named al-Tahrīr wa’t-Tanwīr, too. An important feature of this tafsir is that although it has been looked kindly upon İsrā’ili narrations within the frame of certain criteria, it has been criticized in general. The writer has developed alternatives to İsrā’ili narrations without complimenting them as much as possible. Among these alternatives, while he prioritized the Bible narrations, he didn’t settle for this and he headed for other alternatives, too. In this study, it has been emphasized on methods of text-centered commentary, socio-psychologic commentary, and foresight-based commentary, which İbn ʿĀshūr used as an alternative to İsrā’iliyyat from time to time. It has been seen that the writer developed stronger and farther-from-a-debate-ground methods compared to İsrā’iliyyat and used these methods successfully in this way. It has come to the conclusion that in the case of these methods being used in Qura’ân parables accurately, they can be an important alternative to İsrā’iliyyat. (shrink)

In folk songs, which can be described as melodies reflecting the feelings and thoughts of the people, it is possible to find all kinds of events experienced by the person or society, all kinds of emotions that can be felt, in other words, the joy, sadness, life and beliefs of individuals and/or society, in short, all elements of life. Folk songs are one of the most important sources in which society's perception of religion, religious life, and how religion is theoretically (...) or practically embodied in daily life can be determined. With this study, it is aimed to determine the reflections of the subject of “religion (Islam)” in the folk songs of Âşık Veysel, (the existence of the subject of religion, how it takes place theoretically and practically), and to classify and evaluate the materials found. Before moving on to the main topic in the study, brief and concise information was given about Âşık Veysel and his folk songs/poems. In the main part of the study, the religious elements contained in the lyrics of Âşık Veysel's compositions/adaptations and lyrics in a total of thirty-seven pieces of broken air style procedural (rhythmic) works belonging to him were examined in the form of substances. The works belonging to him that he sang as poems without melody, the works that were in a unmetered folk song style (uzun hava, rhythmless) and free rhythm, and the works whose lyrics belonged to other bards/poets and were performed by Âşık Veysel were not subjected to examination. This limitation of the scope of the study is due to the fact that Veysel's folk songs are more widespread, visible and listened to, as well as the fact that the analysis of all his works exceeds the volume of the article. Based on the saying “what is inside the cube seeps out of it”, a number of results have been achieved as a result of studying the religious elements found in the lyrics of the songs composed and sung by Âşık Veysel in the metered folk song style(kırık hava, rhythmic) style. Many religious and mystical topics such as Allah, prophets, holy books, worldly life, the hereafter, heaven, hell, death, mourning, fate, spiritual/luminous beings, sacrifice, prayer, curse, martyrdom, veteran, sects, loyalty and dhikr have been directly or indirectly included in folk songs, which are usually seen to be sung/written in an admonitory style. Prayer, zakat, fasting, hajj, etc. practical issues have not been included at all. (shrink)

All can agree that the achievement of Moses Maimonides (d. 1204) set the standard for subsequent works of "Jewish philosophy". But just what were the contours of philosophical-scientific inquiry that Maimonides replaced? A fairly large array of diverse texts have been studied, but no comprehensive picture has yet emerged. The newly discovered Hebrew dialogue published here has points of contact of various depth with most of the major works of pre-Maimonidean thought. It shares as well influences from without, especially from (...) the Islamic kalam. The concept of obedience is included as a basic concept in the Holy Quran. In addition to the command to obey Allah, obey Muhammad was also stated and ordered. Obeying the Messenger was considered obedience to Allah and it was explained that absolute obedience belonged only to Allah. Obedience to the Messenger of Allah, Muhammad, is also in the category of absolute obedience in accordance with the command of Allah. In addition, "obeying the ulu’l-amr" is also commanded in the Quran, (...) but this is introduced as limited obedience. "Ulu’l-amr", which we translate as "those with authority/command", are Muslim knowledgeable people, scholars and administrators who are in administrative positions both familiarly and socially. The main subjects of obedience are the principles of faith. In Islam, obligations of servitude such as prayer (salah), almsgiving (zakat), fasting (sawm) and pilgrimage (hajj) are appearing of obedience. However, these obligations are primarily based on the principles of obedience such as Islamic tawhid, prophethood and belief in the afterlife. Even after belief in Islamic tawhid (monotheism) and therefore other aspects of faith are established in people obedience to the principles of faith continues by means of preserving faith. At this point, the importance of obligatory duties and good deeds is clear. The most obvious example of obedience in the principles of faith was seen in the Meccan period of the Prophet Muhammad. In this period, even though there were deeds such as tahārah (purity), salāt (prayer), and sadaqah (almsgiving); belief in one God, in the existence of a day of reckoning in which he will repay good deeds and evil deeds, and in the nubuwwah (prophethood) of the Prophet Muhammad, who communicated all these; constituted the primary agenda of obedience in Mecca at that time. Because shirk (polytheism) was dominant in Mecca. This study examines the literal meanings of obedience, obedience in the Qur'an and Hadith, and the nature of obedience in general terms. Later, some events that took place in the Meccan Period of Islam were interpreted within the framework of "obedience to Allah and His Messenger Muhammad". This section constitutes the main subject of this research. This article tries to see how the Messenger of Allah and the Companions responded to the divine command of obedience in Mecca. It is thought that this article will be a horizon for the idea of “obedience to Allah and His Messenger” in the 21st century. (shrink)

Business and Marketing ethics have come to the forefront in recent years. While consumers have been surveyed regarding their perceptions of ethical business and marketing practices, research has been minimal with regard to their ethical beliefs and ideologies. In addition, no study has examined the ethical beliefs of Austrian consumers even though Austria maintains a unique status of political neutrality, nonalignment, stability, economic prosperity and geographical proximity to the East- and West-European countries. This research investigates the relationship between Machiavellianism, ethical (...) ideology and ethical beliefs of Austrian consumers. The results indicate that Austrian consumers are mostly situationists who, while rejecting moral rules, judge the ethics of a behavior by the consequences and outcomes of the situation. (shrink)

Maintaining plural values is important when there is no conclusive principle by which the relative priority of normative positions can be determined. Value-articulating institutions predicated upon such principles have a low pluralistic potential. In response to the failures of stated-preference approaches to economic valuation, new perspectives have been developed to capture plural values. Three broad approaches are identified. The first, functional diversifi-cation, seeks to encompass the multiple qualities of the object of valuation, whereas positional modification enforces a particular mode of (...) thinking on the subject. Both entail a prior judgement of values and benefit from a reduction in the range of values. Eventually, therefore, both approaches collapse pluralism to a problem that can be tackled. The third approach, structural reconstruction, has greater pluralistic potential, recognising that the more diverse and uncertain the object of valuation, the more compelling it is. (shrink)
