El objetivo de este artículo es comentar las prácticas que lleva a cabo el equipo docente de la asignatura Epistemología y Metodología de la Investigación en Ciencias Jurídicas (FCEJS-UNSL) –cuya actividad inició en 2012– respecto de la enseñanza del derecho desde una perspectiva compleja. Concebir lo jurídico desde tal enfoque implica considerar la diversidad de las realidades actuales. Asimismo, si se asume que los entornos son múltiples, heterogéneos, no es posible estudiarlos desde un único campo de conocimiento. Adoptar tales miradas (...) epistemológicas necesita de una actitud pedagógica que se adapte al cambio. Por ende, este texto evidenciará las formas en que una asignatura de grado afronta desafíos cotidianos para plantear estrategias que pongan en cuestión el sentido jurídico dominante y, a partir de ello, trascender el positivismo. Por otra parte, a toda la humanidad sorprendió la situación suscitada a partir de la pandemia por COVID-19, que mostró la importancia de asumir una didáctica dinámica. Por ello, también se dará cuenta de las adaptaciones realizadas por el equipo docente para atender a ese nuevo contexto. (shrink)

This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. The traditional point of view on analyticity implies that truth in virtue only of meaning entails a priori acceptability and vice versa. The argument for this claim is based on the idea that meaning as it concerns truth and meaning as it concerns competence are one and the same thing. In this paper I argue that the extensions of these notions do not coincide. I hold that truth in virtue of meaning— truth for semantic reasons—doesn't imply a priori acceptability, and (...) that a priori reflection based only on knowledge of meaning—in the sense of competence—doesn't necessitate true conclusions.The main consequence of this view concerns conceptual analysis, as it presupposes we have a privileged—incorrigible in the face of empirical evidence—access to non-trivial truths about the world on the basis of mere a priori reflection founded on meaning. If, as I argue, such access is not incorrigible the project of conceptual analysis loses its special epistemological status. (shrink)

Through fourteen original essays, the book seeks to understand the viability of the notion of sovereignty in a globalized world, thus taking into account the inclusion of a language of rights, limitation and legitimacy. It examines sovereignty using a normative approach.

Veremos como no Fedro de Platão há inicialmente dois tipos de desejos, um deles seria o desejo epithymía e o outro seria o desejo hímeros, sendo o último um desejo nobre, retratado exclusivamente na palinódia de Sócrates. Faremos um estudo do campo semântico associado a cada um desses desejos dentro das três recitações iniciais do diálogo, discernindo a natureza de cada um deles, sua potencialidade, direção e desdobramentos. O diálogo evidencia a enunciação controlada desses desejos na trama conceitual platônica, quando (...) Fedro chama a atenção de Sócrates para esse aspecto notável do uso das palavras (tois onómasin, Phdr. 234c7) na recitação de Lísias, assim como Sócrates no fim da palinódia reafirma o vocabulário (tois onómasin, Phdr. 257a5) poético a que foi submetido. Nesse trajeto surge uma leitura fisiológica, discernindo a estática, os movimentos, as direções dos desejos e amizades descritas, assim como suas qualidades e quantidades. (shrink)

This expansión is permittedby two sentence and modal rules.The logical relations of the square allow us to formulate several theorems in order to show a glimpse of the Medieval Logic complexity.

In Jurismania, Paul Campos asserts that our legal system is beginning to exhibit symptoms of serious mental illness. Trials and appeals that stretch out for years and cost millions, 100 page appellate court opinions, 1,000 page statutes before which even lawyers tremble with fear, and a public that grows more litigious every day all testify to a judicial overkill that borders on obsessive-compulsive disorder. Campos locates the source of such madness, paradoxically, in our worship of reason and the (...) resulting belief that all problems are amenable to legal solutions. In insightful discussions of a wide range of cases, from NCAA regulations of student-athletes to the Simpson trial, from our most intractable social disputes over abortion and physician-assisted suicide to the war on drugs and the increasingly fastidious attempts to regulate behavior in public spaces, Campos shows that the mania for more law exacerbates the very problems it seeks to remedy. Neste artigo é apresentada uma crítica ao programa de pesquisa em ciência cognitiva que se dedica ao estudo da religião, a chamada ciência cognitiva da religião (CCR). Argumentamos que essa disciplina negligencia o papel das emoções e estados afetivos em sua tentativa de explicar por que crenças religiosas são aderentes, isto é, memoráveis, evocativas e de fácil disseminação. A explicação oferecida pela CCR é estruturada, em larga medida, em cima da Hipótese da Contraintuitividade Mínima, que relaciona a aderência de crenças (...) religiosas ao grau de contraintuitividade dos conceitos que figuram em seu conteúdo. Embora essa hipótese explique satisfatoriamente a aderência de algumas crenças religiosas, há uma variedade de crenças religiosas – as chamadas crenças místicas – cuja aderência não parece poder ser explicada sem o envolvimento estados afetivos. Time has a highly unstable place between the objective and the subjective. On the one side, there are very well known philosophical arguments trying to show that time has only a subjective reality, even that it is merely a subjective epiphenomenon. On the other side, we are compelled to take points of view as non dispensable elements of reality, at least of a reality capable of containing beings like us. And points of view offer a world of temporal entities existing (...) in an objective way. Moreover, points of view themselves appear to be temporal entities among other temporal entities. We analyse both aspects of time. Our main focus will be McTaggart’s arguments against the reality of a fluent time, what he called temporal series of kind A. We will distinguish three very different arguments in McTaggart works. We analyse them in detail. And we reject their conclusive character. Our final target is to maintain that there is a room for fluent time in what is internal to points of view but external to the subjects adopting those points of view. (shrink)

I argue against the tendency in the philosophy of science literature to link abduction to the inference to the best explanation (IBE), and in particular, to claim that Peireean abduction is a conceptual predecessor to IBE. This is not to discount either abduction or IBE. Rather the purpose of this paper is to clarify the relation between Peireean abduction and IBE in accounting for ampliative inference in science. This paper aims at a proper classification—not justification—of types of scientific reasoning. In (...) particular, I claim that Peireean abduction is an in-depth account of the process of generating explanatory hypotheses, while IBE, at least in Peter Lipton's thorough treatment, is a more encompassing account of the processes both of generating and of evaluating scientific hypotheses. There is then a two-fold problem with the claim that abduction is IBE. On the one hand, it conflates abduction and induction, which are two distinct forms of logical inference, with two distinct aims, as shown by Charles S. Peirce; on the other hand it lacks a clear sense of the full scope of IBE as an account of scientific inference. (shrink)

En este trabajo se analizan las reflexiones de Ernst Jünger sobre la idea de progreso para, después, ofrecer una hipótesis acerca de las bases metafísicas de este concepto. Para ello, se presenta una lectura de los textos fundamentales de Jünger en torno a esta cuestión, publicados durante la época de entreguerras, en los que el progreso aparece vinculado al desarrollo de la técnica y del nihilismo. Después, se propone una genealogía de la idea de progreso para descubrir sus cimientos filosóficos (...) desde una perspectiva crítica. Por último, se presenta la propuesta de superación del mundo configurado en torno al progreso planteada por Jünger. (shrink)

El objetivo de este artículo es analizar el uso del término cáncer desde una perspectiva social y su representación en la prensa española a comienzos del siglo xx, en los periódicos La Vanguardia y ABC. A partir de la hemeroteca digital de ambos medios se seleccionaron todas y cada una de las veces que se pudo identificar el término «cáncer» y su aplicación metafórica desde una perspectiva de problemática social, procediéndose a la descripción de los rasgos significativos y al análisis (...) del discurso. Encontramos un uso de la palabra cáncer como metáfora social a lo largo del periodo estudiado, siendo común extender la metáfora del cuerpo enfermo a situaciones de orden político o social. El cáncer es una enfermedad con un gran impacto en nuestra sociedad, cuya utilización metafórica es descriptiva y expresa el deseo del cambio, pero su empleo puede comportar la estigmatización de los enfermos afectados por esta patología. Palabras clave: cáncer, metáfora, sociedad, prensa, España.The objective of this article is to analyze the use of the term cancer from a social perspective and its representation in the Spanish press at the beginning of the 20th Century, in the newspapers La Vanguardia and ABC. From the digital mass media library, each and every one of the times that the term «cancer» and its metaphorical application could be identified from a perspective of the social problem was selected, proceeding to the description of the essential features and the discourse analysis. A use of the word cancer as a social metaphor was found throughout the studied period, being common to extend the metaphor of the sick body in situations of political or social order. Cancer is a disease with a great impact on our society, metaphorical use is descriptive and expresses the desire for change, but its use may involve the stigmatization of patients affected by this pathology. Spinoza’s Theological-Political Treatise (TTP) contains two main arguments for toleration, one theological, the other political. In light of the latter, the capacity for judging is embedded in each individual’s power and cannot be overcome or dismissed. The individual, not the state, is the subject par excellence of judgment concerning the true and the good. In the Political Treatise (TP), however, multiplicity takes centre stage. The multitude, a concept that Spinoza had seldom used until then, appears to emphasise that the more (...) powerful individuals become with others, the more likely they are to avoid error in judgment. Does this contrast mean that the TP’s argument from multiplicity undermines the TTP’s political argument for toleration? In this paper, I demonstrate that the strain under which the political argument for toleration seems to be due to the TP’s emphasis on the epistemic competencies of the many is only apparent. To achieve this, I show that Spinoza, under Machiavelli’s influence, endorses a particular form of epistemic democracy, which in turn requires both multiplicity and diversity. The upshot is that we find a third argument for toleration in the TP embedded in the argument from epistemic democracy. (shrink)

Modern contraceptives—especially long-acting, reversible contraceptives, or LARCs—are typically seen as a boon for humanity and for women, the majority of their users, in particular. But the disparity between the number and types of female and male LARCs is problematic for at least two reasons: first, because it forces women to assume most of the financial and health-related responsibilities of contraception, and second, because men’s reproductive autonomy is diminished by it. In order to understand how to change our current contraceptive arrangement, (...) Diversos estudios vienen encontrando asimetrías de género en el ámbito del conocimiento y la ciencia. Esta investigación se propone comprobar si existen brechas de género en la autoría de libros en las editoriales científicas de mayor prestigio en el ámbito de la Comunicación en España. A partir de un análisis bibliométrico sobre las colecciones de libros de las 14 primeras editoriales españolas según el ranking Scholarly Publication Index (Q1) se han contabilizado las autorías principales de hombres y mujeres. Se comprueba (...) que, de media, las mujeres son autoras principales en menos de un 24% de los libros y primera firma en menos de un 18% de los títulos a la venta. Se constata también que la situación no evoluciona hacia una progresiva paridad en los últimos años. El estudio pone su foco de análisis en algunas de las ramificaciones del androcentrismo del sistema científico, como son el estatus del sujeto varón emisor en la producción de sentido, la cuestión del poder cultural androcéntrico y la asociación prestigio-masculinidad en la producción editorial. La investigación abre el debate sobre los criterios de calidad editorial sostenidos sobre un déficit democrático como es la falla en el principio de igualdad. Se señala la especial relevancia de esta circunstancia en el ámbito de la comunicación y los medios, por su rol prioritario en la eliminación de las discriminaciones de género. (shrink)

Nine introductory theses about dystopia Resumen: Este artículo proporciona una introducción actualizada a la distopía y una exégesis del apogeo ilimitado que esta vive. Y lo hace planteando nueve tesis. El supuesto de partida es que el término “distopía” no designa solamente una forma literaria. Sus premisas, metodologías y actitudes elementales son visibles en el pensamiento social contemporáneo y otras muchas expresiones culturales. En las dos primeras tesis diferencio el género distópico de otros géneros afines y sondeo las coincidencias temáticas (...) que atesoran sus expresiones literarias y filosóficas. A lo largo de las tres tesis posteriores, señalo las causas sociales e ideológicas que subyacen a su hegemonía actual. Finalmente, dedico las cuatro últimas tesis a calibrar las implicaciones políticas de la distopía y a determinar las relaciones que guarda con la utopía.: This article provides an up-to-date introduction to dystopia and an exege- sis of its huge heyday, in nine theses. The starting point is that the term “dystopia” does not designate only a literary form. Its basic premises, methodologies and attitudes are visible in contemporary social thought and many other cultural expres- sions. In the first two theses, I distinguish the dystopian genre from other related genres and probe the thematic coincidences among their literary and philosophical expressions. Throughout the three subsequent theses, I point out the social and ideological causes that underlie its current hegemony. Finally, I devote the last four theses to calibrating the political implications of dystopia and to determining its relationship with utopia. Epistemic impairment has been the decisive yardstick when excluding infants from political agency. One of the suggestions to bypass the epistemic requirement of political agency and to encourage the inclusion of infants in representative democracies is to resort to proxies or surrogates who share or advocate interests which may be coincidental with their interests. However, this solution is far from desirable, given that it privileges the political agency of parents, guardians and trustees over other adult citizens. This article offers an (...) alternative to this conceptual frame of reference by making a case for the political agency of infants. Firstly, it maintains that political agency can be understood in terms of the several facets involved in political representation. Secondly, it claims that the all-affected principle can be reformulated as an ‘infant-affected-interests principle’ in light of which infants are members of the class of the represented. Thirdly, it explores the ways through which this political agency can occur without having to resort to alternative conceptions of representation. The conclusion ascertains that infant enfranchisement is highly undesirable and that there are more viable forms to promote infant political agency, such as virtual representation, infant-beneficial principles of political action and ombudspersons for infants. The paper looks into a participatory art project developed in two women’s refuges, one in Portugal and the other in England. Addressing liminality after surviving violence, the project constructs a portrait of survivors, utilising feminist pragmatist aesthetics to transfer representational agency to participants. Against a background where women who have experienced domestic violence have often been portrayed in simplistic representations of damaged beauty, the study sought to gain a deeper understanding by holding visual art workshops with participants (Portugal, England) and (...) analysing data from verbal testimonies (England). The paper contributes to a discussion of the practical issues negotiated when establishing a representational power balance between researchers and research participants. It does this by providing a critical discussion of three ethical problems emerging in relation to the project. The first concerns the dominant representation of survivors, the second the need for participants’ anonymity and the third the challenges of inequality in qualitative research. (shrink)

En este trabajo se explora una conexión entre el contextualismo y el fiabilismo. El propósito es desarrollar las líneas centrales de un acercamiento contextualista para resolver la crítica internista de que las nociones fiabilistas de justificación y de conocimiento no son adecuadas porque no recogen las intuiciones correspondientes a que un sujeto que está justificado o que sabe es racional y epistemológicamente responsable. Se argumenta que esta crítica y el escepticismo pirrónico comparten un presupuesto común, a saber, la cláusula internista, (...) por lo que, si es posible limitar el alcance de esta cláusula a través del contextualismo distinguiendo dos contextos diferentes, entonces también es posible hacer uso de esta distinción para dar respuesta a la crítica internista al fiabilismo. In this paper, we explore a connection between reliabilism and contextualism. our purpose is to draw up a contextualist approach to solve the critique that the reliabilist notions of justification and knowledge are not satisfactory because there is no room for the intuitions that a subject who is justified or knows is rational and epistemologically responsible. We will argue that this critique and the Pyrrohnian skepticism share the same assumption, viz., the internalist clause. Thus, if it is possible to limit the scope of this clause using contextualism, making a distinction between two different contexts, then it is also possible to use this distinction to offer an answer to the internalist critique to reliabilism. According to Petersen, ‘the individualization argument against NMEF [nonmedical egg freezing]’ states: ‘it is morally wrong to let individuals use technology X [NMEF] – in order to try to handle a problem that is social in nature – if the use of X [NMEF] will somehow work against a social solution to a social problem P [gender inequality in the labor market]’. While there may be individuals making individualisation argument against NMEF, I do not read the scholars he discusses—Karey Harwood,1 (...) 2 Lynn Morgan, Janelle Taylor3 and Angel Petrapanagos4—as making this argument. These scholars agree with the premise of the individualisation argument that NMEF ‘is an individualistic and morally problematic solution to the social problems that women face’, but this does not mean that they agree with the conclusion ‘women should not use NMEF’. In fact, several admit that NMEF can be a good choice for some women; Petropanagos, for example, states ‘individual women may benefit from egg freezing to satisfy their reproductive desires’.4 In this commentary, I argue that Petersen incorrectly reduces these scholars’ positions to the individualisation argument by neglecting three pertinent factors: their feminist orientation, their multifaceted critiques of NMEF and how the rapidly advancing field of reproductive medicine informs their ethical analysis. Este artigo examina quais teorias da causalidade explicam a ocorrência de sentimentos em animais e homens, segundo Descartes. Esse exame é feito à luz do debate entre as teorias ocasionalista e interacionista, bem como da posição de Descartes nesse debate. Nesse contexto, são discutidas algumas objeções a essas teorias, buscando determinar em quais pontos Descartes poderia ser considerado um adepto de uma ou da outra. A hipótese defendida é a de que ele adota certos aspectos da teoria interacionista para explicar (...) a causalidade entre corpos, que caracteriza a ocorrência de sentimentos em animais. Por outro lado, ressalta-se o uso de duas linguagens em sua explicação da causalidade entre corpos humanos e mentes, que caracteriza os sentimentos humanos. Esse uso é explicado pelo fato de que, no caso desses sentimentos, ele adota uma posição que concilia ocasionalismo e interacionismo. (shrink)

This essay provides an account of the lived personal experience of immigration at three levels: general aims; relations to place and to other persons; and feelings and sensibility. The account is structured by Charles Peirce's phenomenological categories, but the emphasis is on describing the experience. For the experiential descriptions, the essay also relies on the work of Latin Americans such as Octavio Paz and Mario Benedetti and Anglo Americans such as Henry Thoreau, John McDermott, Jane Addams, and Lara Trout.
