When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

How can cradling, handling, or rubbing a text be said, ethically, to have made something happen? What, as readers or interpreters, may come off in our hands in as we maculate or mark the books we read? For Adam Zachary Newton, reading is anembodied practice wherein "ethics" becomes a matter of tact in the doubled sense of touch and regard. With the image of the book lying in the hands of its readers as insistent refrain, To Make the Hands (...) Impure cuts a provocative cross-disciplinary swath through classical Jewish texts, modern Jewish philosophy, film and performance, literature, translation, and the material text. Newton explores the ethics of reading through a range of texts, from the Talmud and Midrash to Conrad's Nostromo and Pascal's Le Mémorial, from works by Henry Darger and Martin Scorsese to the National September 11 Memorial and a synagogue in Havana, Cuba. In separate chapters, he conducts masterly treatments of Emmanuel Levinas, Mikhail Bakhtin, and Stanley Cavell by emphasizing their performances as readers a trebled orientation to Talmud, novel, and theater/film. To Make the Hands Impure stages the encounter of literary experience and scriptural traditions he difficult and the holy through an ambitious, singular, and innovative approach marked in equal measure by erudition and imaginative daring. Martin Bunzl’s book was published in Routledge’s Philosophical Issues in Science series. It concerns the twin issues of objectivity and realism in the writing of history.

I define ecosabotage and relate this definition to several well-known analyses of civil disobedience. I show that ecosabotage cannot be reduced to a form of civil disobedience unless the definition of civil disobedience is expanded. I suggest that ecosabotage and civil disobedience are special cases of the more general concept of conscientious wrongdoing. Although ecosabotage cannot be considered a form of civil disobedience on the basis of the standard analysis of this concept, the civil disobedience literature can provide important insights (...) into the justification of ecosabotage. First, traditional appeals to a higher law in justifying ecosabotage are no more successful than they are in justifying civil disobedience. Second, utilitarian justifications of ecosabotage are promising. At present there is no apriori reason tosuppose that some acts of ecosabotage could not be justified on utilitarian grounds, although such ecosaboteurs as Dave Foreman have not provided a full justification of its use in concrete cases. Social attitudes toward usury (here defined using the archaic meaning as the taking of interest on loans) have changed dramatically over the centuries. From antiquity until the Protestant Reformation, usury was regarded as an inherently evil activity. Today, with few exceptions, usury is met with moral indifference. Modern objections to usury are limited to protest against "excessive" interest rates rather than interest per se. With this change in focus, the very meaning of the term "usury" has also changed. Many early (...) pronouncements against the taking of interest emphasized the plight of the poor, but ironically, the poor actually pay the highest rates of interest in the modern American economy. Despite the universality of usury, some socio-economic subcultures still manage to avoid the taking or giving of interest. Orthodox branches of both Judaism and Islam have maintained bans on usury throughout the centuries and up to the present time. This is especially interesting in the case of Judaism, given the popular cultural image of the Jew as usurer. Jewish free loan systems may actually offer a model for modern loan programs that can be designed to aid poor borrowers, who are frequently shut out of mainstream financial services. (shrink)

Daniel Taylor and Dawn Goodwin present a case study of the Morecambe Bay Inquiry (MBI), which examined the high rate of maternal and neonatal deaths over a period of 9 years (2004–2013), within the small maternity unit of Furness General Hospital (FGH), one of the three hospitals comprising Morecambe Bay Hospitals Trust.1 They examine this through a conceptual lens, and provide a solution involving changes in medical education. This commentary explores both these elements. First, they use the lens of ‘Normalisation (...) of Deviance’ (NoD) to explain organisational failure. However, other available lenses such as ‘Sociology of Disasters’, ‘Organisational Silence’ and ‘Comfort-seeking Behaviour’ may point to different problems and solutions. More justification for their choice of the lens of NoD would have been useful. Similarly, more justification for their focus on a cluster of five ‘serious untoward incidents’ (SUIs) occurring in 2008 would also have been useful. They suggest that before 2008, the perinatal mortality rate was low, patient satisfaction was high and recent level 2 accreditation of maternity services by the Clinical Negligence Scheme for Trusts all suggested standards of care within the obstetric department were adequate. This stream of positive signals is likely to have contributed towards a genuine belief of safe operation within the maternity unit by staff and board members. However, as they acknowledge, the first problem can be seen in 2004. According to the MBI,2 there were SUIs in the years before and after 2008, but this …. (shrink)

I discuss two puzzling and neglected passages in the Critique of Practical Reason, namely, V:92 and V:163. In these passages Kant claims that practical philosophers should follow the paradigm of the chemist and conduct experiments on common human reason. I explain Kant’s conception of the chemical experiment, provide a detailed interpretation of the two passages in question, and conclude by applying the structure of the chemical experiment to the Analytic of the Critique of Practical Reason. Chemical experiments as a model (...) of ethics should be understood as a method of confirming that a philosophical theory systematizes and defends ideas that ordinary rational agents are already committed to. What does it take for an individual to be personally responsible for behaviors that lead to increased risk of disease? We examine three approaches to responsibility that cover the most important aspects of the discussion of responsibility and spell out what it takes, according to each of them, to be responsible for behaviors leading to increased risk of disease. We show that only what we call the causal approach can adequately accommodate widely shared intuitions to the effect that certain causal (...) influences—such as genetic make-up or certain social circumstances—diminish, or undermine personal responsibility. However, accepting the causal approach most likely makes personal responsibility impossible. We therefore need either to reject these widely shared intuitions about what counts as responsibility-softening or undermining or to accept that personal responsibility for behaviors leading to increased risk of disease rests on premises so shaky that personal responsibility is probably impossible. When making a moral judgment, people largely care about two factors: Who did it (causal responsibility), and did they intend to (intention)? Since Piaget's seminal studies, we have known that as children mature, they gradually place greater emphasis on intention, and less on mere bad outcomes, when making moral judgments. Today, we know that this developmental shift has several signature properties. Recently, it has been shown that when adults make moral judgments under cognitive load, they exhibit a pattern similar to (...) young children; that is, their judgments become notably more outcome based. Here, we show that all of the same signature properties that accompany the outcome‐to‐intent shift in childhood characterize the “intent‐to‐outcome” shift obtained under cognitive load in adults. These findings hold important implications for current theories of moral judgment. (shrink)

Agent-based models (ABMs) are one of the main sources of evidence for decisions regarding mitigation and suppression measures against the spread of SARS-CoV-2. These models have not been previously included in the hierarchy of evidence put forth by the evidence-based medicine movement, which prioritizes those research methods that deliver results less susceptible to the risk of confounding. We point out the need to assess the quality of evidence delivered by ABMs and ask the question of what is the risk that (...) assumptions entertained in ABMs do not include all the key factors and make model predictions susceptible to the problem of confounding. Luck egalitarians need to address the question of cost-responsibility: If an individual is responsible for being worse off than others, then what benefits, if any, is that individual uniquely cost-responsible for? By applying luck egalitarianism to justice in health I discuss different answers to this question inspired by two different interpretations of luck egalitarianism, namely ‘standard luck egalitarianism’ and ‘all luck egalitarianism’, respectively. Even though I argue that the latter is more plausible than the former, I ultimately suggest and defend (...) a third interpretation of luck egalitarianism, which I label ‘universal luck egalitarianism’. Finally, I adjust my findings to a (all things considered) more plausible currency, namely welfare. (shrink)

PREFACEProf. Göran Sundholm of Leiden University inspired the group of Logic at Lille and Valparaíso to start a fundamental review of the dialogical conception of logic by linking it to constructive type logic. One of Sundholm's insights was that inference can be seen as involving an implicit interlocutor. This led to several investigations aimed at exploring the consequences of joining winning strategies to the proof-theoretical conception of meaning. The leading idea is, roughly, that while introduction rules lay down the conditions (...) under which a winning strategy for the Proponent may be built, the elimination rules lay down those elements of the Opponent's assertions that the Proponent has the right to use for building winning strategy. It is the pragmatic and ethical features of obligations and rights that naturally lead to the dialogical interpretation of natural deduction.During the Visiting Professorship of Prof. Sundholm at Lille in (2012) the group of Lille started delving into the ways of implementing Per Martin-Löf's Constructive Type Theory with the dialogical perspective. In particular, Aarne Ranta's (1988) paper, the first publication on the subject, was read and discussed during Sundholm’s seminar. The discussions strongly suggested that the game-theoretical conception of quantifiers as deploying interdependent moves provide a natural link between CTT and dialogical logic. This idea triggered several publications by the group of Lille in collaboration with Nicolas Clerbout and Juan Redmond at the University of Valparaíso, including the publication of the book (2015) by Clerbout / Rahman that provides a systematic development of this way of linking CTT and the dialogical conception of logic. However the Clerbout / Rahman book was written from the CTT perspective on dialogical logic, rather than the other way round. The present book should provide the perspective from the other side of the dialogue between the Dialogical Framework and Constructive Type Theory. The main idea of our present study is that Sundholm's (1997) notion of epistemic assumption is closely linked to the Copy-Cat Rule or Socratic Rule that distinguishes the dialogical framework from other game-theoretical approaches. One way to read the present book is as a further development of Sundholm’s extension of Austin's (1946, p. 171) remark on acts of assertion to inference. Indeed, Sundholm (2013, p. 17) gave the following forceful formulation: When I say therefore, I give others my authority for asserting the conclusion, given theirs for asserting the premisses.Per Martin-Löf, in recent lectures, have utilized the dialogical perspective on epistemic assumptions to get out of a certain circle that threatens the explanation of the notions of inference and demonstration. A demonstration may be explained as a chain of (immediate) inferences starting from no premisses. That an inference J1... Jn—————Jis valid means that the conclusion J can be made evident on the assumption that J1, …, Jn are known. The notion of epistemic assumption thus enters in the explanation of valid inference. We cannot, however, in this explanation understand 'known' in the sense of demonstrated, for then we are explaining the notion of inference in terms of demonstration, whereas demonstration has been explained in terms of inference. Martin-Löf suggests that we here understand 'known' in the sense of asserted, so that epistemic assumptions are judgements others have made, judgements for which others have taken the responsibility; that the inference is valid then means that, given that others have taken responsbility for the premisses, I can take responsibility for the conclusion:The circularity problem is this: if you define a demonstration to be a chain of immediate inferences, then you are defining demonstration in terms of inference. Now we are considering an immediate inference and we are trying to give a proper explanation of that; but, if that begins by saying: Assume that J1, …, Jn have been demonstrated – then you are clearly in trouble, because you are about to explain demonstration in terms of the notion of immediate inference, hence when you are giving an account of the notion of immediate inference, the notion of demonstration is not yet at your disposal. So, to say: Assume that J1, …, Jn have already been demonstrated, makes you accusable of trying to explain things in a circle. The solution to this circularity problem, it seems to me now, comes naturally out of this dialogical analysis. […]The solution is that the premisses here should not be assumed to be known in the qualified sense, that is, to be demonstrated, but we should simply assume that they have been asserted, which is to say that others have taken responsibility for them, and then the question for me is whether I can take responsibility for the conclusion. So, the assumption is merely that they have been asserted, not that they have been demonstrated. That seems to me to be the appropriate definition of epistemic assumption in Sundholm's sense. One of the main tenets of the present study is that the further move of relating the Socratic Rule rule with judgemental equality provides both a simpler and more direct way to implement the constructive type theoretical approach within the dialogical framework. Such a reconsideration of the Socratic Rule, roughly speaking, amounts to the following. 1.A move from P that brings-forward a play-object in order to defend an elementary proposition A can be challenged by O. 2.The answer to such a challenge, involves P bringing forward a definitional equality that expresses the fact that the play-object chosen by P copies the one O has chosen while positing A. For short, the equality expresses at the object-languaje level that the defence of P relies on the authority given to O to be able to produce the play-objects she brings forward. More generally, according to this view, a definitional equality established by P and brought forward while defending the proposition A, expresses the equality between a play-object (introduced by O) and the instruction for building a play-object deployed by O while affirming A. So it can be read as a computation rule that indicates how to compute O's instructions. Let us recall that from the strategic point of view, O's moves correspond to elimination rules of demonstrations. Thus, the dialogical rules that prescribe how to introduce a definitional equality – correspond – at the strategic level – to the definitional equality rules for CTT as applied to the selector-functions involved in the elimination rules. So, what we are doing here is extending the dialogical interpretation of Sundholm's epistemic assumption to the rules that set up the definitional equality of a type.The present work is structured in the following way:•In the Introduction we state the main tenets that guide our book•Chapter II contains a brief overview of Constructive Type Theory penned by Ansten Klev with exercises and their solutions. •Chapter III offers a novel presentation of the dialogical conception of logic. In fact, the first two sections of the chapter provide an overview of standard dialogical logic – including solved exercises, slightly adapted to the content of the present volume. This Introduction to the Special Issue on “Responsible Research and Innovation” outlines features of the philosophical debate about the concepts involved and summarizes the papers assembled in this issue. The topic of RRI is widely discussed in science studies and has made its way into science policy. This SI is intended to make the contributions of philosophers of science more visible. The philosophically relevant parts of the field concern, among others, the processes of public participation in science and their impact (...) on the knowledge produced, the notion of justified public trust in science, and the idea of research pursued for the common good. Such topics bring social procedures together with epistemic and ethical considerations and thus raise philosophical challenges. RRI is subject to the tension between committing research to creating knowledge in harmony with public expectations, on the one hand, while not complying with public wishful thinking, on the other. RRI embodies a friction between serving people’s aspirations and correcting people’s expectations. This special issue is intended to explore the narrow pathway left between these conflicting demands. In this book, Mike W. Martin interprets Schweitzer's 'reverence for life' as an umbrella virtue, drawing together the specific virtues--authenticity, love, compassion, gratitude, justice and peace loving--in individual chapters. Martin's treatment of his subject is sympathetic yet critical, and for the first time clearly places Schweitzer's environmental ethics within the wider framework of his ethical theory.

The influence of Heinrich Hertz's The Principles of Mechanics on Ludwig Wittgenstein's Tractatus Logico‐Philosophicus has been studied for decades, but it has never become a mainstream topic in the Wittgensteinian literature. This paper focusses on Tractarian notions of objects, elementary facts and elementary sentences and discusses their similarities with Hertz's concepts of mass, its constituents and their mechanistic images. As the paper demonstrates, the Hertzian context provides some fruitful interpretational leads concerning several controversial ideas endorsed by early Wittgenstein, namely propositional (...) analysis, logical independence of elementary facts, logical independence of elementary sentences, and modalities. In a world filled with “ambient violence”, public protest is a vital signal of shared discontent. The essential compulsion at the heart of protest, however, is conventionally not recognised for what it is: solidarity with those suffering injustices. Amid authorities’ often-fierce efforts to curtail gatherings of people whose experiences of injustice propel them into the streets, a sharp rise in public protests has been perceived since the early 2000s. Thousands of column inches dedicated to reporting on protests are rivalled in (...) volume only by the reams of academic theories produced around causes. Despite this overabundance of discourses, it often remains unclear what protest, at heart, constitutes. That is, what are we talking about when we talk about protest, and why does this question matter? In this paper I consider the constituent parts of protest formation in the abstract, including grievances, gestures, and tactics, among other. Developing these constituent parts reveals protest to be, first and foremost, a manifestation of a nonhegemonic ethical commitment to justice, requiring courage and coordination, and whose outcome is always contingent, that is, an act of love. I also reflect on the nature of protest as a direct political action that sits on a continuum that ranges from opposition politics to civil war. This continuum offers a graded view ranking expressions of discontent by severity of outcome. (shrink)

ZusammenfassungVor dem Hintergrund der medialen Debatte um die beiden Therwiler Schüler, die sich mit Verweis auf religiöse Gründe weigerten, ihrer Lehrerin die Hand zu reichen, strebten Politikerinnen und Politiker im Kanton Basel-Landschaft an, die dortige Verfassung zu ändern. Dabei wurde auf rechtliche und erinnerungskulturelle Diskurse aus dem Kulturkampf des 19. Jahrhunderts – und auf solche, die dazu Bezug nehmen – verwiesen. Diese Verweise werden in einem (partiellen) Close Reading des Kommentars zur geplanten (letztlich aber nicht realisierten) Änderung der basellandschaftlichen Kantonalverfassung (...) erörtert und in den konfligierenden Narrativen des liberalen und des konservativen Lagers verortet. Dabei wird der Kommentar als Dokument gelesen, in welchem spezifische Geschichtsbilder, politische Identitäten und das Recht als sozial konstruierte Entitäten verwoben werden – und in welchem spezifische Konstruktionen und Reifikationen von Identität und Alterität angelegt sind.
