L’articolo esamina la proposta europea di regolamento sull’intelligenza artificiale, AI Act (AIA). In particolare, esamina il modello di analisi e valutazione del rischio dei sistemi di IA. L’articolo identifica tre potenziali problemi di implementazione del regolamento: (1) la predeterminazione dei livelli di rischio, (2) la genericità del giudizio di significatività del rischio e (3) l’indeterminatezza della valutazione sull’impatto dei diritti fondamentali. Il saggio suggeriscealcune soluzioni per affrontare questi tre problemi.

Everyday moral thought uses the concepts of virtue and vice at two different levels. At what I will call a global level it applies these concepts to persons or to stable character traits or dispositions. Thus we may say that a person is brave or has a standing trait of generosity or malice. But we also apply these concepts more locally, to specific acts or mental states such as occurrent desires or feelings. Thus we may say that a particular act (...) was brave or that a desire or pleasure felt at a particular moment was malicious. Even when they concern acts, these last judgements are of virtuousness rather than of moral rightness. They therefore turn essentially on a person’s motives; while he can act rightly from a bad motive, he cannot act virtuously from a bad motive. But they assess the virtue or vice of particular acts and mental states rather than of persons or traits of character. These global and local uses of the virtue-concepts are clearly connected, in that we expect virtuous persons to perform and have, and virtuous traits to issue in, particular virtuous acts, desires, and feelings. A philosophical account of virtue should explain this connection, but there are two different ways of doing so. Each takes one of the two uses to be primary and treats the other as derivative, but they disagree about which is the primary use. A dispositional view takes the global use to be primary and identifies virtuous acts, desires, and feelings in part as ones that issue from virtuous.. (shrink)

Ever since Frege, propositions have played a central role in philosophy of language. Propositions are generally conceived as abstract objects that have truth conditions essentially and fulfill both the role of the meaning of sentences and of the objects or content of propositional attitudes. More recently, the abstract conception of propositions has given rise to serious dissatisfaction among a number of philosophers, who have instead proposed a conception of propositional content based on cognitive acts (Hanks, Moltmann, Soames). This approach is (...) not entirely new, though, but has important precedents in early analytic philosophy and phenomenology. The aim of this volume is bring together some of the most important texts from the relevant historical literature and new contributions from contemporary proponents of act-based conceptions of propositional content. Rescued in 1972 from a storeroom in which rats and seeping water had severely damaged the fifty-year-old manuscript, this text is the earliest major work (1919-1921) of the great Russian philosopher M. M. Bakhtin. Toward a Philosophy of the Act contains the first occurrences of themes that occupied Bakhtin throughout his long career. The topics of authoring, responsibility, self and other, the moral significance of "outsideness," participatory thinking, the implications for the individual subject of having "no-alibi in existence," the difference (...) between the world as experienced in actions and the world as represented in discourse--all are broached here in the heat of discovery. This is the "heart of the heart" of Bakhtin, the center of the dialogue between being and language, the world and mind, "the given" and "the created" that forms the core of Bakhtin's distinctive dialogism. A special feature of this work is Bakhtin's struggle with the philosophy of Immanuel Kant. Put very simply, this text is an attempt to go beyond Kant's formulation of the ethical imperative. Toward a Philosophy of the Act will be important for scholars across the humanities as they grapple with the increasingly vexed relationship between aesthetics and ethics. (shrink)

According to the axiologist the value concepts are basic and the deontic concepts are derivative. This paper addresses two fundamental problems that arise for the axiologist. Firstly, what ought the axiologist o understand by the value of an act? Second, what are the prospects in principle for an axiological representation of moral theories. Can the deontic concepts of any coherent moral theory be represented by an agent-netural axiology: (1) whatever structure those concepts have and (2) whatever the causal structure of (...) the world happens to be. We show that the answer is "almost always". The only substantive constraint is that autonomous moral agents cannot have the power to simultaneously block the options open to other autonomous moral agents. But this seems to be part and parcel of the notion of an autonomous moral agent. (shrink)

Kant considers eudaimonism as his main opponent and he assumes that his ethics is the only viable alternative to eudaimonism. He does not explicitly address theories differing from both eudaimonism and from his own. I argue that whilst Kant and Act-Consequentialists advocate different normative principles, their positions share the important abstract feature that they establish what is to be done from a rational principle and not based on what is in the self-interest of the respective agent, as Kant thinks eudaimonism (...) does. Act-Consequentialism is thus closer to Kant’s ethics than is often assumed. I will demonstrate and vindicate this point with a new interpretation of the Fact of Reason. This reading also establishes that the notion of a Fact of Reason is less contentious than many of Kant’s critics believe. We should not expect that the Fact establishes Kantianism. Instead, the Fact is only supposed to count against a specific competing view of morality, namely, eudaimonism. Act-Consequentialists can accept the Fact as well. (shrink)

This paper attempts to explain what a protest is by using the resources of speech-act theory. First, we distinguish the object, redress, and means of a protest. This provided a way to think of atomic acts of protest as having dual communicative aspects, viz., a negative evaluation of the object and a connected prescription of redress. Second, we use Austin’s notion of a felicity condition to further characterize the dual communicative aspects of protest. This allows us to distinguish protest from (...) some other speech acts which also involve a negative evaluation of some object and a connected prescription of redress. Finally, we turn to Kukla and Lance’s idea of a normative functionalist analysis of speech acts to advance the view that protests are a complex speech act constituted by dual input normative statuses and dual output normative statuses. This article offers a reconstruction of Brentano’s notion of act content that identifies the content of a mental act with a combination of marks (Merkmale) or a single such mark. The author will first clarify the role act content plays in Brentano’s philosophy of psychology and then go on to locate the proposed notion of content in the historical context of Brentano’s work as well as in his writings at the time of Psychologie. This paper develops an account of consciousness in action. Both consciousness and action are related to knowledge. A voluntary action is defined as a volition, or something intentionally effected by means of such volitions. Volitions are conscious mental acts whose proper function is to make their content true. A mental act is the exercise of a power of mind and a conscious mental act is identical with knowledge of its own phenomenal character. It is commonly thought that on Kant’s view of action, ‘everyone always acts on maxims.’ Call this the ‘descriptive reading.’ This reading faces two important problems: first, the idea that people always act on maxims offends against common sense: it clashes with our ordinary ideas about human agency. Second, there are various passages in which Kant says that it is ‘rare’ and ‘admirable’ to firmly adhere to a set of basic principles that we adopt for ourselves. This article offers an (...) alternative: the ‘normative reading.’ On this reading, it is a normative ideal to adopt and act on maxims: it is one of the things Kant thinks we would do if our reason were fully in control of our decision-making. The Mental Capacity Act received Royal Assent on 7 April 2005, and it will be implemented in 2007. The Act defines when someone lacks capacity and it supports people with limited decision-making ability to make as many decisions as possible for themselves. The Act lays down rules for substitute decision making. Someone taking decisions on behalf of the person lacking capacity must act in the best interests of the person concerned and choose the options least restrictive of his or her (...) rights and freedoms. Decision making will be allowed without any formal procedure unless specific provisions apply, such as a written advance decision, lasting powers of attorney or a decision by the court of protection. Choice is one of the central elements in the experience of free will, but it has not received a good account from either compatibilists or libertarians. This paper develops an account of choice based around three features: (i) choice is an action; (ii) choice is not determined by one's prior beliefs and desires; (iii) once the question of what to do has arisen, choice is typically both necessary and sufficient for moving to action. These features might appear to support a (...) libertarian account, but they do not. Instead it is argued that all three features can be accommodated within a compatibilist account, where choice is needed because of agents' inabilities to arrive at judgements about what is best. Choice differs though from random picking: in choosing, agents frequently (though not always) deploy abilities that enable them to make good choices. In such cases, judgements about what is best will frequently follow the choice. Finally choice is distinguished from agency, and, on the basis of the distinction, the claim that choice is an action is made good. (shrink)

This essay examines recent work on abilities to act. Different kinds of ability are distinguished, and a recently proposed conditional analysis of ability ascriptions is evaluated. It is considered whether abilities are causal powers. Finally, several compatibility questions concerning abilities, as well as the relation between free will and abilities of various kinds, are examined.

The notion of cognitive act is of importance for an epistemology that is apt for constructive type theory, and for epistemology in general. Instead of taking knowledge attributions as the primary use of the verb 'to know' that needs to be given an account of, and understanding a first-person knowledge claim as a special case of knowledge attribution, the account of knowledge that is given here understands first-person knowledge claims as the primary use of the verb 'to know'. This means (...) that a cognitive act is an act that counts as cognitive from a first-person point of view. The method of linguistic phenomenology is used to explain or elucidate our epistemic notions. One of the advantages of the theory is that an answer can be given to some of the problems in modern epistemology, such as the Gettier problem. (shrink)

In this article, we build on the stakeholder-politics literature to investigate how corporate scandals transform political contexts and give impetus to the contentious movements of fringe stakeholders against multinational corporations (MNCs). Based on Adut’s scandal theory, we flesh out three scandal-related processes that directly affect political-opportunity structures (POSs) and the generation of social movements against MNCs: convergence of contention toward a single target, publicization of deviant practices, and contagion to other organizations. These processes reduce the obstacles to collective actions by (...) fringe stakeholders by pushing corporate elites to be more sensitive to their claims, by decreasing MNCs’ capability to repress contentious movements, by forcing the targeted MNCs to formalize a policy to monitor and eradicate the controversial practices, and by helping fringe stakeholders find internal and external allies to support their claims. This conceptual model of scandals as catalysts of contentious actions contributes to a better understanding of stakeholder politics by unveiling the role of the political context in the coordination of fringe stakeholders.
