The purpose of the study was to identify problematic aspects of the use of borrowed terms in the regulation of civil law relations. The study included an analysis of the use of borrowings in the Civil Code of Kazakhstan, conducting a survey to determine the attitude of Kazakh lawyers toward the use of borrowings, the results of which were subjected to statistical processing and comparative analysis, and an analysis of the use of borrowings in the civil law (...) of other countries and EU law, and comparing the specifics of such borrowing with the use of borrowings in the law of Kazakhstan. The analysis of the Kazakh-language version of the Civil Code of the Republic of Kazakhstan has shown that the specificity of borrowings in the civil legislation of Kazakhstan is that the Kazakh language was strongly influenced by the Russian language at the time when it was part of the Soviet Union and since then Russian terms have been firmly entrenched in it. A lot of borrowed words and inconsistencies in the terminology of the Kazakh version of the Civil Code are identified, which leads to the conclusion that there is a problem of preserving the linguistic purity and identity of the Kazakh legal language. An examination of the attitude of the selected respondent group to borrowings contained in the Civil Code of Kazakhstan showed that respondents demonstrated a higher level of confidence and acceptance in terms with an established translation while showing less enthusiasm for borrowed legal terms. The study of borrowings in world legislation, including EU law, confirmed that borrowing should be considered as a natural phenomenon for the formation of the legal vocabulary of any language, but the consequences of such borrowing are largely determined by its context. In the present stage of the development of society and the globalisation of international legal cooperation, the main purpose of borrowing should be to simplify legal communication. The terminology of the Kazakh-language version of the Civil Code needs to be revised, and the Kazakh legal language is subject to reform to preserve the linguistic integrity of the Kazakh language. Chinese kindergartens’ over 110 years of adaptation of foreign models is a vivid example of how globalization comes into direct contact with Chinese culture and creates cultural hybridities. Learning Stories as a narrative assessment tool to children’s development from New Zealand, has swept China with the endorsement from the professional organizations and local authorities, especially attracting many followers in Beijing. Based on a two-year participatory action research in Beijing, the article examines Learning Stories as policy borrowing, redesigned as an (...) innovative reflection tool for professional learning community which results from processes of mutual influence between the global and the local. The article highlights the importance of culture and context in considering professional development and the ‘fluid’ and dynamic nature of ‘glocalization’ working towards integration of globalization and localization. The matter under consideration in this article is the problem of borrowed German lexical elements and their life in the borrowing Polish language. The starting point is a short overview of the elements of the lexical field of science and their change of meaning in the Polish language.

Tacitus' use and adaptation of phrases from earlier Latin writers is well known. By this means he adds to his own context something of the atmosphere belonging to the context from which the phrase is borrowed. So, for example, when at Ann. 4. 1 he describes Seianus in language modelled on Sallust's description of Catiline , the reader is immediately made aware that he is to expect Seianus to display the same resolute villainy that Catiline had shown.

Irrational debt decisions at the individual level may harm collective welfare. For this reason, regulators are committed to encourage information-based behaviours in order to enhance likelihood of appropriate indebtedness. We analyse, with a diff-in-diff estimator, the Italian case offered by the Legislative Decree that reformed the consumer credit market adopting European Directive 2008/48/ec, and that reinforced the mandatory information acquisition, jointly asked to lenders and borrowers, before granting/receiving consumer credit. By using micro-data on 60.000 consumer credit borrowers, in total, randomly (...) sampled from the most relevant Italian Credit Bureau, our findings support that, in the medium term, the new consumer credit regulation has improved borrowers’ repayment ability, enhancing the quality of credit distribution. Nevertheless, a simplistic ‘better information-better behaviour’ relationship cannot be assured. This success is likely due to conjunct adaptation of behaviours, with shared responsibilities experienced on both the demand and offer side of the consumer credit marketplace. (shrink)

The entire Upper Silesian dialect is based on the Polish language system, and all elements from German are treated as borrowings. The main aim of the research was to focus on the issue of German loanwords in the field of clothing vocabulary that appear in the Upper Silesian dialect and which are listed in the “Dictionary of Silesian dialect” by Barbara and Adam Podgórski. Different countries worldwide have issues with adapting legal terminology in a multilingual society. Such issues are still prevalent in Kazakhstan, where it is particularly difficult to guarantee the quality of laws written in the state language. This study aims to answer the question of what scientific, methodological, and legal mechanisms can be used to enhance legislative drafting practises in countries with two or more official languages by using Kazakhstan as an example. The Kazakh legal terminology reflects the societal communication requirements (...) for the control of public relations. According to the findings, the current challenges of establishing a legal conceptual framework in Kazakhstan are closely connected to trends in expanding the terminological lexicon. This trend stems from neologisation, optimisation of borrowings of legal terms, and internationalisation of legal discourse. The ways to improve the legislative drafting technique are suggested based on a generalised analysis of texts in the state language of some legislative instruments of the Republic of Kazakhstan. The article offers several recommendations for specialists-translators of legal texts practising in rule-making and lawyers-specialists in legislative drafting and review. (shrink)

Neutral Theory is controversial in ecology. Ecologists and philosophers have diagnosed the source of the controversy as: its false assumption that individuals in different species within the same trophic level are ecologically equivalent, its conflict with Competition Theory and the adaptation of species, its role as a null hypothesis, and as a Lakatosian research programme. In this paper, I show why we should instead understand the conflict at the level of research programs which involve more than theory. The Neutralist (...) and Competitionist research programs borrow and construct theories, models, and experiments for various aims and given their home ecological systems. I present a holistic and pragmatic view of the controversy that foregrounds the interrelation between many kinds of practices and decisions in ecological research. (shrink)

Seed libraries are institutions that support the creation of semi-formal seed systems, but are often intended to address larger issues that are part of the “food movement” in the global north. Over 100 SLs are reported present in California. I describe a functional framework for studying and comparing seed systems, and use that to investigate the social and biological characteristics of California SLs in 2016 and how they are contributing to alternative seed systems based on interviews with 45 SL managers. (...) At a minimum, SLs function as new seed distribution institutions founded and overseen by dedicated, values-driven individuals and groups with goals including education, seed access, local adaptation, biodiversity conservation, community-building, and human health. Annually about 4776 people borrow seeds from, and 238 people return seeds to the SLs in this study, that operate through over 17,000 hours of work/year. These SLs distribute approximately 6456 packets of seed annually, mostly of commercial seeds from small seed companies, but some SLs emphasize local and culturally meaningful seeds. The significance of a 6% seed return rate depends on SL goals and can be investigated once appropriate indicators for those goals are identified and documented. Beyond distribution, the seed system functions accomplished by SLs differ, and all can have consequences for the processes shaping the diversity and adaptation of their crops. The SLs engaged in seed system functions beyond distribution are new forms of socially-motivated community science, poised to develop biological and social innovations reflecting their values and interests. In 1979, Lewontin and I borrowed the archi- tectural term “spandrel” (using the pendentives of San Marco in Venice as an example) to designate the class of forms and spaces that arise as necessary byproducts of another decision in design, and not as adaptations for direct utility in them- selves. This proposal has generated a large literature featur- ing two critiques: (i) the terminological claim that the span- drels of San Marco are not true spandrels at all and (ii) the (...) conceptual claim that they are adaptations and not byprod- ucts. The features of the San Marco pendentives that we explicitly defined as spandrel-properties—their necessary number (four) and shape (roughly triangular)—are inevitable architectural byproducts, whatever the structural attributes of the pendentives themselves. The term spandrel may be extended from its particular architectural use for two- dimensional byproducts to the generality of “spaces left over,” a definition that properly includes the San Marco pendentives. Evolutionary biology needs such an explicit term for features arising as byproducts, rather than adaptations, whatever their subsequent exaptive utility. The concept of biological span- drels—including the examples here given of masculinized genitalia in female hyenas, exaptive use of an umbilicus as a brooding chamber by snails, the shoulder hump of the giant Irish deer, and several key features of human mentality— anchors the critique of overreliance upon adaptive scenarios in evolutionary explanation. Causes of historical origin must always be separated from current utilities; their conf lation has seriously hampered the evolutionary analysis of form in the history of life. (shrink)

Governance theory in political science and international relations has to adapt to the onset of an increasingly digital society. However, until now, technological advancements and the increasing convergence of technologies outpace regulatory efforts and frustrate any efforts to apply ethical and legal frameworks to these domains. This is due to the convergence of multiple, sometimes incompatible governance frameworks that accompany the integration of technologies on different platforms. This theoretical claim will be illustrated by examples such as the integration of technologies (...) on the “human platform” as it is referred to in the case of enhanced soldiers. Hence, successful governance might require new approaches borrowed from a distant relative, namely cybernetics. Insights gained from cybernetics for governance theories might be able to give guidance for a more efficient and adaptive governance approach that is able to deal with increasing complexity caused by technology and governance convergence. While cybernetics itself might be considered a governance approach, it has had surprisingly little reception in the wider field of governance within the area of social and political sciences. This article will develop cybernetic governance as a set of expandable governance principles that are applicable to an increasingly complex digital and smart society. It thereby tries to further galvanise what could be termed cybernetic governance theory as a subject of worthwhile insights from the combination of otherwise largely the disjoined fields of cybernetics and governance. : Xunzi borrows several significant ideas originating in the Zhuangzi and the ''Neiye'' chapter of the Guanzi, adapting them to solve problems in his own theories of mind and self-cultivation. This reworking occurs in three main areas. First, he uses some of the psycho-physical terminology of the ''Neiye'' but alters its cosmological background and thus its implications for selfcultivation. Second, largely for rhetorical effect he adopts the language of shen and shenming from both texts, but uses them to argue for (...) the potency of the Confucian Way rather than some ineffable cosmic Dao. Third, and most significantly, he takes and transforms the terminology of emptiness, unity, and tranquility, using them in new ways within his own Confucian vision to solve important philosophical problems generated by his own positions. Since becoming independent from the Soviet bloc in the early 1990s, the Central Asian countries of Kazakhstan, Kyrgyzstan and Uzbekistan have established strategic priorities focused on the globalization and internationalization of higher education. These have emphasized the modernization of university systems with a focus on research to produce impactful knowledge and enhance global standing in knowledge production. Yet, the espoused strategic priorities have not been supported by policy development associated with research ethics. This article addresses the need for research ethics (...) policy to facilitate internationalized knowledge production and dissemination. Developing research ethics policy is not without its difficulties. In many developing research contexts, commentators have criticized policy internationalisation which involves the direct transfer of research ethics policy from the Global North rather than engaging with and adapting policy to other cultural contexts. In the light of recent scholarly debates over policy borrowing and translation, this mixed methods study considers how and in what ways higher education research ethics policy can or should develop within Central Asia. This provocative work provides a radical reassessment of the emergence and nature of Christian sexual morality, the dominant moral paradigm in Western society since late antiquity. While many scholars, including Michel Foucault, have found the basis of early Christian sexual restrictions in Greek ethics and political philosophy, Kathy L. Gaca demonstrates on compelling new grounds that it is misguided to regard Greek ethics and political theory—with their proposed reforms of eroticism, the family, and civic order—as the foundation of Christian sexual (...) austerity. Rather, in this thoroughly informed and wide-ranging study, Gaca shows that early Christian goals to eradicate fornication were derived from the sexual rules and poetic norms of the Septuagint, or Greek Bible, and that early Christian writers adapted these rules and norms in ways that reveal fascinating insights into the distinctive and largely non-philosophical character of Christian sexual morality. Writing with an authoritative command of both Greek philosophy and early Christian writings, Gaca investigates Plato, the Stoics, the Pythagoreans, Philo of Alexandria, the apostle Paul, and the patristic Christians Clement of Alexandria, Tatian, and Epiphanes, freshly elucidating their ideas on sexual reform with precision, depth, and originality. Early Christian writers, she demonstrates, transformed all that they borrowed from Greek ethics and political philosophy to launch innovative programs against fornication that were inimical to Greek cultural mores, popular and philosophical alike. The Septuagint's mandate to worship the Lord alone among all gods led to a Christian program to revolutionize Gentile sexual practices, only for early Christians to find this virtually impossible to carry out without going to extremes of sexual renunciation. Knowledgeable and wide-ranging, this work of intellectual history and ethics cogently demonstrates why early Christian sexual restrictions took such repressive ascetic forms, and casts sobering light on what Christian sexual morality has meant for religious pluralism in Western culture, especially among women as its bearers. Paper presented at Philippe Garrel, le temps incorporé/Embodied Time Université Paris 8 Nanterre 29 & 30 novembre 2018 This paper proposes a loose typology of space and place in Garrel’s cinema. Its point of departure is the 1969 round table organised by Jacques Rivette which was a supplement to a series of film screenings chosen to illustrate the theme of space in cinema. Among the films chosen was Garrel’s Le lit de la vierge, which, for Rivette, is of interest in (...) the way it exemplifies the cinema of an ‘adventure of place’ rather than an ‘adventure occurring in a place’. The film for Rivette escapes from the “dénoté géographique, topographique”. Although the round table represents a particular juncture it offers a potential line of enquiry regarding the spatialities of Garrel’s subsequent work. Given the crucial role played by memory linked to place, temporality must also be considered. I propose to explore certain examples from Garrel’s body of work through the idea, borrowed from Michael Tawa in his book of this title, of agencies of the frame. Through the possibilities in this conception, a rethinking of the link between character and place/space emerges. Linking the idea of agencies of the frame – which Tawa himself adapts from Simondon – back to Rivette’s early insights, I propose a survey and typology featuring, inter alia, the generic spaces of urban encounter and circulation, specific places of significance to Garrel, types of urban space, screen spaces, abstraction and spatiality and Parisian topographies. We will examine three types of reuse represented in P?li legal literature: unacknowledged borrowings of authoritative opinions and definitions adapted and rearranged ; unacknowledged borrowings of largely unchanged selected text portions being rearranged ; and unconnected extracts of unchanged text portions lined up in the sequence of the source text century CE).

The trajectory of Merleau-Ponty’s career is often seen as a progressive development: he begins by analyzing scientific consciousness in The Structure of Behavior, complements that account with a phenomenological analysis of behavior as lived in Phenomenology of Perception, and then overcomes the “philosophy of consciousness” to which the earlier texts are committed in the turn toward an ontology of flesh in The Visible and the Invisible. Through close readings of Merleau-Ponty’s engagements with Gestalt psychology in The Structure of Behavior, I (...) argue that the immanent critique of Gestalt theory in that text already anticipates the chiasmic logic of flesh. This challenges the idea of a turn in Merleau-Ponty’s thinking. I begin by outlining the elemental, carnal, and reversible status of flesh. With careful attention to his source materials, I then distinguish Merleau-Ponty’s appropriations of Gestalt theoretical insights from his critical adaptations, defending three claims: (1) The Structure of Behavior borrows insights from Gestalt theorists that are undermined by their own, realistic ontology; (2) it modifies those insights to explicitly acknowledge the elemental status of nature; and (3) those modifications enable Merleau-Ponty to re-interpret Gestalt psychologists’ empirical findings, outlining how consciousness must emerge from nature as both carnal and reversible. The primary aim of this article is to reveal a number of previously unrecorded appearances of classical Latin poetry in the poems of Ausonius, with a brief assessment of their value in understanding his text, and an incorporation of them into the general picture of his acquaintance with his predecessors; a final section will outline some ways in which his adoptions and adaptations are used. Latin poets now fragmented or lost are not included in this study; for the survival of (...) a Lucilius or an Ennius has generally enjoyed more attention and study than the after-life of better-known authors. It is moreover doubtful if such early writers had a context to offer the borrower in Late Antiquity; while poets of the second and third centuries A.D. , who did, are poorly known today. (shrink)

BilesMore than a decade ago, Malcolm Heath provided an influential explanation for charges of plagiarism between comic poets when he posited a growing store of ideas that were recycled as quickly as they were invented. As a result, "Anything put on stage in a comedy would become public property and be absorbed into the repertoire, so that all comic (...) poets contributed to it; and all drew on it, although each would aim to give a new and original twist to the material which he borrowed, so that the repertoire constantly evolved. If this was so, then any poet could lay claim to originality... and any rival could make a counterclaim of plagiarism."1 These remarks have important implications for the study of Old Comedy, not least in exposing the irony of such assertions as that of Antiphanes (Poiēsis, fr. 189 K-A), which overstates generic distinctions between tragedy and comedy on the score of originality. Beyond merely acknowledging comedy's essentially adaptive nature, Heath's position suggests that a certain degree of allusiveness was, as it were, built into the genre. Unfortunately there are few opportunities to test the potential insights that follow from Heath's general proposition since the corpus of comic fragments poses so many questions of plot, context, attribution, and-always important for this kind of study-chronology.There is one sequence of plays, however, that has attracted attention since antiquity as an example of comic poets responding to one another and for which valuable insights can still be gained by building on Heath's thesis. In 423 Cratinus took the prize against Aristophanes' Clouds with Pytine, a play in which Cratinus boldly portrayed himself as the hero while borrowing heavily from Aristophanes' caricature of him in Knights the previous year. While interest in the relationship of these plays has been renewed in recent years, the convergence of issues pertaining to adaptation, intertextuality, and rivalry has not been fully explored. Besides discussing these ideas as they relate to Knights and [End Page 169] Pytine, I shall extend the thread of artistic borrowing at either end, first by positing a stage autobiography of Cratinus that both predates and inspired Knights, and then by tracing elements of intertextuality between Wasps and Pytine. Generally speaking Heath's model proves to be of great value; however, my study makes an important modification by treating competition as a vital aspect of comic poetry.2 The intertextuality of these plays primarily depends on poetic biography, and the notion of competition is central to my understanding of stage biography as comic poets employed it either to assert their own superiority or malign their rivals. After examining the biographical interplay in the rivalry of Cratinus and Aristophanes, I end by applying the intertextual model more generally to Wasps, a play that advertises itself as a competitive response and whose intertextual relationship with Pytine can be viewed as a function of competitive strategy.IThe trail of evidence begins with a scholion on Knights 400. Commenting on the chorus's elusive response to Cleon ("If I don't despise you, may I become a blanket in Cratinus' house!"), the scholiast writes:(= Pytine test. ii K-A)3 [End Page 170]Certain errors about Cratinus' retirement aside,4 the scholiast shows himself to be a reliable witness to the play by his knowledge of the plot and ability to cite the text in the continuation of his commentary (fr. 193). Thus, with the exception of treating the more fully developed caricature of Cratinus as a drunk in the Knights parabasis as the actual source of inspiration for his self-portrayal in Pytine, generations of scholars have followed the scholiast's characterization of Pytine as a redemptive play, however exaggerated this biographical (mis)representation may have been in both plays. Two recent studies have raised objections to the traditional understanding of Knights and Pytine. Troubled by a certain feeling of allusiveness in the jokes about Cratinus in Knights and Acharnians, Keith Sidwell hypothesizes a source for the audience's familiarity with details of Cratinus' life by arguing that his stage "biography " was not an Aristophanic... Species evolve, very slowly, through selection of genes which give rise to phenotypes well adapted to their environments. The cultures, including the languages, of human communities evolve, much faster, maintaining at least a minimum level of adaptedness to the external, non- cultural environment. In the phylogenetic evolution of species, the transmission of information across generations is via copying of molecules, and innovation is by mutation and sexual recombination. In cultural evolution, the transmission of information across generations is by learning, and (...) innovation is by sporadic invention or borrowing from other cultures. This much is the foundational bedrock of evolutionary theory. But things get more complicated; there can be gene-culture co-evolution. Prior to the rise of culture, the physical environment is the only force shaping biological evolution from outside the organism, and cultures themselves are clearly constrained by the evolved biological characteristics of their members. But cultures become part of the external environment, and influence the course of biological evolution. For example, altruistic cultures with developed medical knowledge reduce the cost to the individual of carrying genes disposing to certain pathologies (such as diabetes); and such genes become more widespread in the populations maintaining such cultures. Assortative mating can affect biological evolution, and particular cultures may influence the factors which are sorted for in mating. (For a careful discussion of the effects of cultural evolution on natural selection, see Cavalli-Sforza and Bodmer, 1971:774- 804). This paper examines mechanisms involved in the co-evolution of a biological trait, the critical period for language acquisition, and a property of human cultures, the size of their languages. A gene/culture interaction will be shown that can be described as a kind of symbiosis, but perhaps more aptly as an `arms race'. In this introduction, we will sketch the basic mechanics of the interaction in very broad terms; the rest of the paper will explain and justify the details. General readers will associate him (...) primarily with The Hellenistic Philosophers (edited by A. A. Long and D. N. Sedley, Cambridge University Press, 1987), a work which excerpts the ancient literary texts which it takes as sources, fragmenting them in the interests of philosophical reconstruction; but in this tightly argued new book Sedley reverses the process, taking as his aim the proper understanding of a whole work, De Rerum Natura, and wielding an unparalleled mastery of the fragmentary philosophical literature written during the half-millennium which begins with Plato.Students of Lucretius will recognize the tradition, for Sedley signals his deliberate continuity with the work of Bailey (xi) and states that his main audience is "readers who have themselves come to Lucretius through the study of Latin poetry" (xviii). He develops a sustained argument for the propositions (1) that Lucretius used only Epicurus' On Nature as a source; (2) that he did so in a spirit of "fundamentalist" reverence for the founder of his school; (3) that Lucretius' principal literary model was Empedocles; and (4) that in the poem there exist clear signs of two plans of composition and that our DRN represents an incomplete revision of an earlier plan. This will be for many the most important conclusion of Sedley's work, but Latinists and ancient philosophers alike will also learn much from his analysis of Lucretius' method of translation and adaptation from his Greek prose source and from his reconstruction of Epicurus' own intellectual environment.Chapter 1 builds a case for the view that Lucretius' proem was modeled on the now fragmentary On Nature of Empedocles (and, more specifically, on the proem of that work). Sedley argues (1-2), from a careful rereading of Cicero Ad Quintum Fratrem 2.9.4, that Cicero meant to offer a direct comparison of Lucretius and the Empedoclea of Sallustius, and that a contemporary reader would have recognized the Empedoclean character of DRN. He then tackles several problems in Empedoclean scholarship, taking account of the newly discovered papyrus fragments of Empedocles and arguing, for example, that Purifications was a separate poem offering only ritual advice and that a good deal of what used to be assigned to the "religious" poem, especially B115 DK, belongs in On Nature. Moreover, Lucretius lived during a philosophical revival centered in Italy, marked by a particular strength in the very school he adhered to. Yet he ignored all of this and looked only to Epicurus. The scientific study of living organisms is permeated by machine and design metaphors. Genes are thought of as the ‘‘blueprint’’ of an organism, organisms are ‘‘reverse engineered’’ to discover their functionality, and living cells are compared to biochemical factories, complete with assembly lines, transport systems, messenger circuits, etc. Although the notion of design is indispensable to think about adaptations, and engineering analogies have considerable heuristic value (e.g., optimality assumptions), we argue they are limited in several important respects. In particular, the (...) analogy with human-made machines falters when we move down to the level of molecular biology and genetics. Living organisms are far more messy and less transparent than human-made machines. Notoriously, evolution is an opportunistic tinkerer, blindly stumbling on ‘‘designs’’ that no sensible engineer would come up with. Despite impressive technological innovation, the prospect of artificially designing new life forms from scratch has proven more difficult than the superficial analogy with ‘‘programming’’ the right ‘‘software’’ would suggest. The idea of applying straightforward engineering approaches to living systems and their genomes— isolating functional components, designing new parts from scratch, recombining and assembling them into novel life forms—pushes the analogy with human artifacts beyond its limits. In the absence of a one-to-one correspondence between genotype and phenotype, there is no straightforward way to implement novel biological functions and design new life forms. Both the developmental complexity of gene expression and the multifarious interactions of genes and environments are serious obstacles for ‘‘engineering’’ a particular phenotype. The problem of reverse-engineering a desired phenotype to its genetic ‘‘instructions’’ is probably intractable for any but the most simple phenotypes. Recent developments in the field of bio-engineering and synthetic biology reflect these limitations. Instead of genetically engineering a desired trait from scratch, as the machine/engineering metaphor promises, researchers are making greater strides by co-opting natural selection to ‘‘search’’ for a suitable genotype, or by borrowing and recombining genetic material from extant life forms. This monograph deals with the interrelationship between chemistry and physics, and especially the role played by quantum chemistry as a theory in between these two disciplines. The author uses structuralist approach to explore the overlap between the two sciences, looking at their theoretical and ontological borrowings as well as their continuity. -/- The starting point of this book is that there is at least a form of unity between chemistry and physics, where the reduction relation is conceived as a (...) special case of this unity. However, matters are never concluded so simply within philosophy of chemistry, as significant problems exist around a number of core chemical ideas. Specifically, one cannot take the obvious success of quantum theories as outright support for a reductive relationship. Instead, in the context of a suitably adapted Nagelian framework for reduction, modern chemistry's relationship to physics is constitutive. The results provided by quantum chemistry, in particular, have significant consequences for chemical ontology. Summary This article examines the complex nature of post-war Italian political thought, stressing the importance of Italy's unusual institutional and historical political arrangements, but also the vibrancy of its political ideologies in this period. In the past it has often been argued that the dysfunctional nature of post-war Italian democracy with its rapidly changing governments, and widespread corruption—which nonetheless coexisted with the one party, the Christian Democrats, being constantly in power—led to the atrophying of political theory in general, and political (...) ideologies in particular. But this picture is strongly disputed here—on the contrary it is argued that Christian Democratic, Left and liberal political ideologies were all complex and interesting. Thus if Christian democracy should ultimately be seen as an ‘ideology of transition’ which existed to help Catholicism adapt to the parameters of modern mass democracy, and which lacked a thinker of the calibre of Jacques Maritain, it nevertheless contained within it important debates on the role of the state, between such interesting thinkers as Giuseppe Dossetti and Alcide De Gasperi. And if anything, political thinking on the Left in the post-war period was even more complex, with visceral debates within the (large) Communist Party (PCI) over whether to work within the law—between such thinkers as Palmiro Togliatti and the Il Manifesto group. Equally on the more revolutionary Left, there were important debates about how quickly capitalism could be made to collapse through revolutionary action between thinkers such as Raniero Panzieri and his more radical disciples, Mario Tronti and Antonio Negri, while later, due to the general failure of these revolutionary efforts, post-modern thinkers such as Gianni Vattimo sought to abandon grand metaphysical narratives, whilst retaining a commitment to Left of centre political commitments. Finally, although not part of a widespread mass movement, the liberal thought of Norberto Bobbio was also highly interesting and sophisticated—borrowing from Hobbes and Kelsen, he sought to advocate a modest form of liberal democracy which allowed for civilised forms of conflict, and the protection of minorities, and which rejected the contention of Marxists that civil rights could not be distinguished from economic ones. Overall, if normative aspirations in post-war Italian politics were often frustrated in practice, this was certainly not due to any lack of theoretical vibrancy. (shrink)

The book situates the works and reception of the French scholar Pierre de la Ramée (Petrus Ramus) in a variety of European cultural and educational contexts, from Britain and France to Eastern Europe, from Germany to the Iberian peninsula, and from Scandinavia to the Netherlands. Pierre de la Ramée or Petrus Ramus (1515-1572) has long been a controversial figure in educational reform and innovation, from the moment of his first public academic statements in the 1530s, to his reception among scholars (...) in the twentieth and twenty-first centuries. What is beyond dispute, however, is the vast reach of his influence throughout Europe. Ramus's ideas were disseminated through copious editions and translations of his own textbooks, and in wave after wave of adaptations and re-imaginings of his ideas that swept across the continent. This volume embarks on a European tour of Ramism, using a wide range of previously unpublished or untranslated archival evidence from throughout the continent to examine the dissemination of Ramus's works and his intellectual influence in geographic and in disciplinary terms. The ten chapters explore the spread of Ramism from his home country of France to Protestant strongholds in Germany, Holland, and Britain, and in the Catholic context of the Iberian peninsula. The book also examines Ramism in the less familiar territories (to most Anglophone readers) of Scandinavia and Hungary, and considers the preceding and contemporary Dutch and German educational reform movements from which Ramus borrowed to forge his own distinctive intellectual method. Developmental plasticity may be an adaptation by natural selection simultaneously favored (or sometimes in conflict) at multiple levels of biological organization (e.g., cells, individuals, groups, etc.). To understand the interrelationships between developmental plasticity and adaptive evolution I borrow heavily from West-Eberhard (2003) and Frank (1995; 1997). Theocritus' twenty-second idyll is cast in the form of a hymn to the Dioscuri, who are addressed in the proem as saviours of men, horses, and ships. This opening section of the idyll is modelled loosely on the short thirty-third Homeric hymn, and like that hymn contains an expanded account of the twins' rescue of ships about to be lost in a storm. As is hardly surprising, Theocritus in reworking the Homeric hymn draws on other literary antecedents as well, and (...) like other Alexandrian poets makes prominent use of diction borrowed and adapted from the Homeric epics. At the same time, the proem also shares several points of contact, largely overlooked or disputed by previous scholarship, with the poetry of Theocritus' own contemporaries. In the present paper, I shall suggest that in the storm scene of the proem references to Aratus' Phaenomena and Apollonius Rhodius' Argonautica occur in a carefully arranged pattern with potentially significant implications for our understanding of the proem and the idyll as a whole. As historian Henning Schmidgen notes, the scientific study of the nervous system would have been “unthinkable” without the industrialization of communication in the 1830s. Historians have investigated extensively the way nerve physiologists have borrowed concepts and tools from the field of communications, particularly regarding the nineteenth-century work of figures like Helmholtz and in the American Cold War Era. The following focuses specifically on the interwar research of the Cambridge physiologist Edgar Douglas Adrian, and on the technology that led to his (...) Nobel-Prize-winning research, the thermionic vacuum tube. Many countries used the vacuum tube during the war for the purpose of amplifying and intercepting coded messages. These events provided a context for Adrian's evolving understanding of the nerve fiber in the 1920s. In particular, they provide the background for Adrian's transition around 1926 to describing the nerve impulse in terms of “information,” “messages,” “signals,” or even “codes,” and for translating the basic principles of the nerve, such as the all-or-none principle and adaptation, into such an “informational” context. The following also places Adrian's research in the broader context of the changing relationship between science and technology, and between physics and physiology, in the first few decades of the twentieth century. European rhetoric) and took as their territory conversation and letter writing (more domestic rhetorical forms). 2 But some "poached" on men's territory. In this essay, I examine the tactics that Maria Edgeworth, Eliza Farrar, and Frances Willard used to appropriate and respond to a tradition of rhetoric that by fiat excluded women from rhetorical education, public speaking, and persuasive writing. In order to analyze their poaching on men's territory, I borrow from Michel de Certeau's theory of everyday practices of consumption.In The Practice of Everyday Life (1984), de Certeau suggests that we should study the ways that culture is constituted not only by dominant ideology, but also by "the dominated element in society (a status that does not mean that they are either passive or docile)" (xi-xii). Culture, for de Certeau, is not simply consumed; rather, in everyday life, it is invented "by poaching in countless ways on the property of others" (xii). One must study not just consumers, but also how they consume, what they do and make with the cultural artifacts and constructs offered to them, how they manipulate ideology. For the weak, those lacking political power, de Certeau, like recent feminists, 3 claims sophistic rhetoric, since the Sophists privileged the art of making "the weak position seem the stronger" (xx). How do "users reappropriate the space organized by techniques of sociocultural production?" asks de Certeau (xvii). For the weak, as for the Sophist, "[a] tactic insinuates itself into the other's place, fragmentarily, without taking it over in its entirety, without being able to keep it at a distance" (xix). With these issues in play, de Certeau studies everyday practices--shopping, cooking, moving about, and, most important for our purposes, reading. [End Page 243]Although seemingly passive, reading, de Certeau points out, is an "activity" of "silent production" (xxi). The reader does not absorb what he or she reads, but, instead, reinvents it--misunderstands it, adapts it to his or her own interests and concerns, remembers pieces of it, but pieces mutated. "This mutation makes the text habitable" (xxi), argues de Certeau. Thus, the dominant in culture may offer a set of rules, but it is only a basis for improvisation for the multitude of others in society. Consumption is not the imposition of an ideology on a society; a group does not absorb what it consumes. Instead, the group makes what it consumes its own. "'Assimilating' does not mean 'becoming similar to,'" according to de Certeau; rather, it means "'making something similar'" (166). A reader is not, then, a passive consumer. The introduction deals with the various means, such as morphological or lexical markings, word order, position and the like, that can help the reader distinguish allusion in an act (...) of repetition, and there follow several detailed examples of practice built on theory. But the main body of the book consists of a “grammar” of repetition.The first major segment is devoted to gemination, the repetition of identical forms within the same sense unit. This in turn is divided between a cataloguing of simple gemination, either in nominal form or of verbs and adverbs, and of expanded gemination, where one of the elements repeated is qualified with further detail. Four chapters are devoted to the next rubric, polyptoton and its elaborations, the repetitions of different forms within a simple clause. Then follow detailed discussions of the same phenomena but located across units, entitled “parallelism” where, as in the case of gemination, the forms are the same; and “modification,” akin to polyptoton in that the forms are different. Empathy is a topic of continuous debate in the nursing literature. Many argue that empathy is indispensable to effective nursing practice. Yet others argue that nurses should rather rely on sympathy, compassion, or consolation. However, a more troubling disagreement underlies these debates: There’s no consensus on how to define empathy. This lack of consensus is the primary obstacle to a constructive debate over the role and import of empathy in nursing practice. The solution to this problem seems obvious: Nurses need (...) to reach a consensus on the meaning and definition of empathy. But this is easier said than done. Concept analyses, for instance, reveal a profound ambiguity and heterogeneity of the concept of empathy across the nursing literature. Since the term “empathy” is used to refer to a range of perceptual, cognitive, emotional, and behavioral phenomena, the presence of a conceptual ambiguity and heterogeneity is hardly surprising. Our proposal is simple. To move forward, we need to return to the basics. We should develop the concept from the ground up. That is, we should begin by identifying and describing the most fundamental form of empathic experience. Once we identify the most fundamental form of empathy, we will be able to distinguish among the more derivative experiences and behaviors that are addressed by the same name and, ideally, determine the place of these phenomena in the field of nursing. The aim of this article is, consequently, to lay the groundwork for a more coherent concept of empathy and thereby for a more fruitful debate over the role of empathy in nursing. In Part 1, we outline the history of the concept of empathy within nursing, explain why nurses are sometimes warry of adapting concepts from other disciplines, and argue that nurses should distinguish between adapting concepts from applied disciplines and from more theoretical disciplines. In Part 2, we show that the distinction between emotional and cognitive empathy—borrowed from theoretical psychology—has been a major factor in nurses’ negative attitudes toward emotional empathy. We argue, however, that both concepts fail to capture the most fundamental form of empathy. In Part 3, we draw on and present some of the seminal studies of empathy that can be found in the work of phenomenological philosophers including Max Scheler, Edmund Husserl, and Edith Stein. Martin Reading Smith's Theory ofMoral Sentiments one cannot help but note that, in spite ofthe obvious similarities between Smith and Hume and the equally obvious borrowings and adaptions Smith makesofportions of Hume's theory, the two differ substantially on the role of utility in morality. The difference is, in fact, practically diametrical opposition. Hume believed that utility was the (...) "foundation of the chief part of morals." Smith, on the other hand, believed that, while utility may contribute an additional beauty to virtue, it is never the source oftheir virtue and rarely the source of moral approbation. Given their agreement in so many other respects, why the difference regarding utility? To answer this question I shall examine both Smith's specific criticisms ofHume regarding the role ofutility in morals and his more general objections to any theory that makes an appeal to utility a foundation ofmoral approval. I shall show that, while Smith does raise anumber ofgenuine difficulties for Hume's theory, he does not succeed in his most serious criticism, that is, that Hume's theory does not adequately capture the essentially social nature ofmorality. Hume's View ofthe Role ofUtility AccordingtoHume, the sentimentofmoral approbation arisesfrom the perception ofqualities ofcharacter or mind which are either useful or agreeable to ourselves or others. Examples of qualities agreeable to ourselves include cheerfulness, confidence, self-respect, and taste. Examples of qualities agreeable to others include manners, wit, eloquence, andmodesty. But themajorityofourmoral sentiments arise from the perception of the usefulness of qualities, that is, "from reflexions on their tendency to the happiness of mankind, and of particularpersons."2 Utility or usefulness is nothing but a tendency to a certain end. But, Hume claims, "itis acontradictioninterms, thatany thingpleases as means to an end, where the end itself no wise affects us" (E 219). Thus, ifwe approve ofthose qualities thathave a tendency to promote the happiness or well-being of either the possessor or others, it must be eitherbecause we value theirhappinessin itselforbecause we value it as a means to our own interests. Philosophers in eighteenth-century Britain had a keen interest in human nature, and made great strides in developing more scientific conceptions of human nature by borrowing and adapting the methods from natural history and natural philosophy. Human nature was analyzed at the level of the individual: how to cultivate a moral sense, or a more refined taste with respect to beauty. Even more attention was paid to the members of a society, and to the stages of development, especially in relation to (...) laws, government, and other social institutions. Entering a new economic age of prosperity, British thinkers focused on social progress in manners and conversational skills, as well as in the arts and sciences. This chapter examines these developments and the work of some of the most important proponents of the science of human nature. It concludes with some reflection on the legacies of the eighteenth-century views in Britain, Europe, and America. (shrink)

Compensation for research related injuries is a subject that is increasingly gaining traction in developing countries which are burgeoning destinations of multi center research. However, the existence of disparate compensation rules violates the ethical principle of fairness. The current paper presents a comparison of the policies of Brazil, Russia, India, China and South Africa. A systematic search of good clinical practice guidelines was conducted employing search strategies modeled in line with the recommendations of ADPTE Collaboration. The search focused on three (...) main areas namely bibliographic data bases, clinical practice guidelines data bases and a restricted internet search. A manual search of references cited in relevant guideline documents was also conducted. The search terms, Medical Subject Headings and key words were developed for a PubMed platform and then adapted for all other data bases. The search terms were kept constant for each country with the only difference being the country name. The documents so obtained were subjected to systematic content analysis. The study revealed that there is vast panoply of regulations which exist on a continuum. On one extreme is India with comprehensive regulations that are codified into law, and on the other end there is China which does not have specific laws regulating research related injuries. There are a number of differences and similarities such as mandatory insurance requirements, existence of no fault compensation, compensable injuries and the role of research ethics committees. It is imperative to enact legislations that protect participants without stifling the research enterprise. There is need for consistency and ideally harmonization of such regulations at a global level. A model policy on compensation for research related injuries should borrow from the best aspects of the different country policies and should be informed by the cardinal ethics principles of autonomy, justice and beneficence. Although the piano is an instrument with more than three hundred years of history, it has not been in China for a long time. Therefore, in the process of learning to play the piano in China, many Western piano works are often played, but rarely come into contact with Chinese-style piano works. With the development of time, thanks to the relentless search for outstanding Chinese composers, more and more piano works based on ethnic culture and Chinese style appear. Some of (...) these works are based on the music of national minorities, some are adaptations of Chinese folk songs, and some are borrowed from folk music. "Spring Dance" is a typical work reflecting the culture of the Uighurs living in Xinjiang. The work is melodic, rhythmic, expresses the beautiful nature of Xinjiang, the warm and energetic character of the Uighur people.This article analyzes the "Chinese style" of the "Spring Dance" in the hope that it will serve as a basis for studying piano works with Chinese national flavor. The "Chinese style" in rhythms is not only an imitation of the rhythms of traditional folk instruments, but also an imitation of the peculiarities of the language of Chinese national minorities. Thanks to the study of the "Chinese style" in this work, the author understood more deeply the unique charm of Chinese piano works which will also serve as a guide for the subsequent study of such piano works. A former student and collaborator of Jacques Derrida, Catherine Malabou has generated worldwide acclaim for her progressive rethinking of postmodern, Derridean critique. Building on her notion of plasticity, a term she originally borrowed from Hegel's _Phenomenology of Spirit_ and adapted to a reading of Hegel's own work, Malabou transforms our understanding of the political and the religious, revealing the malleable nature of these concepts and their openness to positive reinvention. In French to describe something as plastic is to recognize both (...) its flexibility and its explosiveness-its capacity not only to receive and give form but to annihilate it as well. After defining plasticity in terms of its active embodiments, Malabou applies the notion to the work of Hegel, Heidegger, Levinas, Levi-Strauss, Freud, and Derrida, recasting their writing as a process of change between dialectic and deconstruction. Malabou contrasts plasticity against the graphic element of Derrida's work and the notion of trace in Derrida and Levinas, arguing that plasticity refers to sculptural forms that accommodate or express a trace. She then expands this analysis to the realms of politics and religion, claiming, against Derrida, that "the event" of justice and democracy is not fixed but susceptible to human action. (shrink)

A common feature of contemporary policymaking is the sharing and adaptation of policies from other countries. As neo-liberal globalisation continues to impact on the development of policy, such practices are increasingly commonplace. This article considers the current phenomenon of ‘policy borrowing’ with reference to the use of data from the Programme for International Student Assessment (PISA) and the 2010 Schools White Paper The Importance of Teaching. Reformed Scholastic John Owen's appropriation and adaptation of Thomas Aquinas’ development of the classical ‘disposition’ (Latin: habitus) concept offers practical insight into seventeenth century faculty psychology. This article argues that Owen not only borrows deliberately from Aquinas, he also attempts to simplify and even improve upon Aquinas’ more complicated theological, philosophical, and psychological insights in this important area. While he deals with dispositions of the mind, will, and affections in a way that is broadly similar to Aquinas’ ontological understanding, (...) Owen's most significant contribution to seventeenth century faculty psychology and its theological use is a sustained and consistent emphasis on the necessity of virtuous affections in the pursuit of communion with God. Examining this concept also provides greater context for how the Reformed Scholastics were able to interact with their medieval counterparts. In this we see the Reformed Scholastics’ continuity with the Christian tradition and their depth of understanding regarding human nature. (shrink)

Judging a person as morally responsible involves believing that certain responses (such as punishment, reward, or expressions of blame or praise) can be justifiably directed at the person. This paper develops an account of the evolution of moral responsibility judgment that adopts Michael Tomasello’s two-step theory of the evolution of morality and borrows also from Christopher Boehm’s work. The main hypothesis defended is that moral responsibility judgment originally evolved as an adaptation that enabled groups of cooperative individuals to hold (...) free riders responsible more safely by acting in a coordinated way. We should now be able to come to some general conclusions about the main lines of Cuvier's development as a naturalist after his departure from Normandy. We have seen that Cuvier arrived in Paris aware of the importance of physiology in classification, yet without a fully worked out idea of how such an approach could organize a whole natural order. He was freshly receptive to the ideas of the new physiology developed by Xavier Bichat.Cuvier arrived in a Paris also torn (...) by many overlapping debates on the nature of classification, and in particular that between the natural and artificial systems. The very validity of the enterprise of classification was questioned in many quarters. Cuvier's achievement on his entry into the Parisian world of science was not simply to establish himself as a highly competent anatomist: far more important, he also began to use ideas from many different specialties to change completely the notion of what was involved in natural history.124 At the same time that he himself swung away from the guiding image of the field naturalist as the ideal of the specialty, he took ideas from the new physiology to answer questions about the order of the animal world, and from comparative anatomy to resurrect extinct creation — and to come to conclusions from that creation about the history of the forms of life and the manner of their succession. He showed himself able to alter the relationships between natural history and many other fields of study in a way that implied, rightly or wrongly, his own complete mastery over such a movement. Partly he was able to do this because the ideas he borrowed were not themselves logically articulated and thus could be easily adapted and refocused for many different specific purposes. The value of the heuristic possibilities inherent in the idea of life, for example, far outweighed its inability to generate full systems of classification. Cuvier also consistently refused to consider in science matters relating to the first causes of events. Freed from the consideration of first-order phenomena, he was able to use second-order explanations across a far wider field of applicability. Personal doubts about the validity of a theology that had used science in order to bolster its own claims were combined here with the strong influence of the Kantian critique of the limits of human reason.125Cuvier's characteristic mode of procedure was that of intellectual appropriation and a bold capacity for altering the relationships between different fields of knowledge, rather than, with the exception of taxonomy, the technique of expanding their subject matter. His claims to originality came, first, from this reappropriation and reorientation and, second, from the sheer scope of his work, which aimed at nothing less than the cataloging and classification of all animate objects.126 They rested also on his acute use of his assertion of a certain relationship with the past of his subject. Very often he would present this history in such a way as to obscure his own intellectual genealogy, and often too he would give differing accounts of the priority of use of an idea in order to distract attention from the questionable exactitude of his own claims to originality. Cuvier came to Paris at precisely the time when society and institutions were most profitably malleable for a newcomer; it was also a time when many scientific disciplines had reached a stage advanced in terms of their factual content, yet relatively inadequate in conceptual organization. They were ripe for takeover by large-scale organizing ideas such as the animal economy and the subordination of characteristics. Paleontology is a particularly good example of a specialty in this particular form of underdevelopment in 1795.Cuvier paid a high price for his initial success. His electic applications of large-scale organizing ideas tended to mean that little of his own work had complete coherence at all levels. Ideas, as we have seen, that proved capable of providing a complete reform of the larger groups of the animal kingdom were incapable of producing its detailed working-out in the taxonomy of smaller groups, which had to be supplied from observed analogical correlations. Further, his physiological approach to classification involved the breakdown of strict correspondence between organs and functions, which left the way open for workers such as Geoffroy St. Hilaire gradually to tilt the balance away from the study of the correlations of hierarchies of functions, and toward morphology as the basis of the order of nature. Cuvier's brilliant appropriations from physiology from the beginning, therefore, contained the seeds of conflict with Geoffroy.Cuvier's eclectic approach made it very nearly impossible for him to present a clear idea of the ways in which the life sciences could be said to be lawful. In spite of his efforts to assimilate them to the position of the physical sciences in this respect, he was forced in the end to accord only an ambiguous status as “laws” to observational correlations. From this area of failure came much of the attempt to give his own two laws — the correlation of parts and the subordination of characteristics — predictive qualities, particularly in relation to paleontological research.It is not surprising that Cuvier's title as the “legislator” of natural history should represent more a claim than a reality. How, then, was he able to emerge as the leading French naturalist of his day? First of all must be adduced the sheer scale of his undertakings. Then comes his expertise as a practical anatomist, and the range of different topics toward which he turned his interest. His collaborators cannot be given credit for his output nor, as we have seen, for slavish adherence to his ideas. Cuvier was able to successfully claim to have dominated the underdeveloped specialties, such as paleontology, and turned them into a major heuristic input into both geology and comparative anatomy; but in other fields, such as physiology, he appropriated concepts and encouraged research but made little impact on the field himself. His attempts in 1812 to head off, or neutralize and absorb the growth of morphological studies landed him in a dangerously rigid position, which despite his encouragement of the new physiological research under the Restoration made further elaboration of his own conceptual underpinnings almost impossible.Cuvier's authority in the scientific world would in any case have been great because of his substantive achievement in taxonomy, but the rest of his work had enough ambiguities and dislocations for it to need the support of his political and social power. Cuvier's detractors seized on a vital fragment of the truth when they accused him of finding the political dimension all-important: it obscured the disjunctions in his theories and at the same time gave him the authority to make new claims for the status of the observational sciences - and for their relations of power with their surrounding specialties. Cuvier's science both thrived on and was halted by the power games of intellectual appropriation, manipulation of the past to confirm the present, and continual claims for hegemony. (shrink)

Resumo: A questão que move este trabalho é a seguinte: é possível justificar e fomentar o diálogo inter-religioso, através das abordagens pluralistas atuais? Pretende-se empreender uma análise de duas teorias pluralistas, mostrando suas vantagens e limites, para justificar e fomentar o diálogo inter-religioso. Num primeiro momento, será feita uma breve introdução e contextualização dos problemas filosóficos gerados pela diversidade religiosa. Feito isso, serão apresentadas e discutidas duas teorias pluralistas atuais. Será focalizada primeiramente a teoria pluralista de John Hick, o qual (...) possui uma proposta de justificação do pluralismo religioso que tem como ponto central a distinção, emprestada de Kant, entre a realidade fenomênica e a realidade numênica ou entre fenômeno e coisa em si. É daí que seu pluralismo pode ser chamado de pluralismo transcendental. Serão abordados e discutidos os principais conceitos, alcances e limites dessa teoria. Após isso, o mesmo se fará com a teoria de Victoria Harrison, conhecida como pluralismo internalista, que parte de uma adaptação do realismo interno de Putnam ao âmbito da diversidade religiosa. Por fim, esboçar-se-á uma avaliação comparativa das duas teorias, analisando-se as possibilidades e limites dessas teorias, no que se refere ao diálogo inter-religioso.: Is it possible to justify and promote inter-religious dialogue through current pluralistic approaches? This paper analyses two pluralist theories, showing their advantages and limits in justifying and promoting interreligious dialogue. First I make a brief introduction and contextualization of the philosophical problems generated by religious diversity. Next I present and discuss two current pluralistic theories. The first is the pluralistic theory of John Hick, which in justifying religious pluralism has as its central point the distinction, borrowed from Kant, between phenomenal and noumenal reality; Hick’s theory can be called transcendental pluralism. The second is Victoria Harrison’s theory, known as internalist pluralism. This theory is an adaptation of Putnam’s internal realism to the problems of religious diversity. Finally, I make a comparative evaluation of the two theories, analyzing their possibilities and limitations with regard to interreligious dialogue. (shrink)

Qaṣeeda-i Burdah written by Egyptian sufi poet Busīrī (d. 695/1296) as an eulogy for Beloved Messenger Moḥammed has received great attention in the Islamic world. This work has been recited both in cultural/social ceremonies such as weddings, holidays and funerals. On the other hand, it was also annotated, translated, and takhmīs, tesdīs, tesbī‘ and taşṭīr were written to it by the pen of scholars and litterateurs in literary circles. These activities, which have been carried out over and over again, has (...) been going on from the 15th century to the present day. Not only the reputed people, but also unknown ones or ones whose names were later forgotten have tried to translate it to their own language. The subject of the study is one of this type of poetic translations of the eulogy. Like its translator, date of this poetic translation is also unknown. This work was written in the remel baḥr type of ‘arūż in 162 verses using the spelling of the classical period. Although a significant portion of the rhyme words was adapted from the source text, it has a more understandable style than its counterpart. In terms of poetry, it is above the average. The translator decorated the meaning that he borrowed from the original text with his own poetic ability and tried to express it in a unique manner. For this aim, it is more literary, lyrical and successful than most other translations of Qaṣeeda-i Burdah. In the present study, text of the mentioned work was given with transcription along with mentioning of some of its features. Summary: Qaṣeeda-i Burdah written by Egyptian sufi poet Buṣīrī (d. 695/1296) has an important place in the Islamic world. Named by the poet himself as al-Kavākib-al-durriya fī madḥi khayr-al-bariyya, this work is also known as al-Qaṣeedat-al-mīmiyya since its rhyme letter is Arabic mim, as Qaṣeeda-i Bur’ah since it caused Buṣīrī to recover from a disease, as Qaṣeeda-i Burdah due to the rumor that this event took place while he was wearing a coat by the hands of Beloved Messenger Moḥammed. In order to prevent confusion with the eulogy of Ka‘b b. Zuhayr (d. 24/645) with the same name, it is known in cultural circles as Qaṣeeda-i Bur’ah. However, in literature, it is commonly referred as Qaṣeeda-i Burdah. The work was written in simple baḥr style of ‘arūż, and consists of 161 couplets. It has ten sections in terms of its content: longing for the beloved, complaining about the soul, eulogy for Beloved Messenger Moḥammed, his birth, miracles, dignity of the Holy Qur’ān, miracle of mi‘rāc, importance of jihad, sorrow, hope, prayer and request. The eulogy, which has an effective style, has gained great acclaim in the Islamic geography and has been read for various purposes for centuries. Some people recite it in wedding ceremonies, while some others use it in funerals. The sick people recite it with the hope of healing, while calligraphers wrote it for practice.Owing its fame more to its story rather than its value of art, the eulogy was translated into Eastern languages such as Persian, Malay, Pashto, Punjabi, Turkish and Urdu, as well as into Western languages such as German, French, Greek, English, Spanish, Italian and Latin. In addition, many annotations, footnotes, takhmīs, tesdīs, tesbī‘, taşṭīr and replies were written to it. For example, the poem annotated in Arabic by Ebū Shāme al-Maqdisī (d. 665/1266), Khalid b. ‘Abdullah al-Ezherī (d. 905/1499), Ibrahim b. Moḥammed al-Bacurī (d. 1277/1860), ‘Omer b. Aḥmed al-Ḥarpuṭī (d. 1299/1882) was translated into Persian by the men of letters such as Molla Ḥafıẓ Sharaf (d. after 810/1407), ‘Iṣāmuddin b. ‘Arabshah al-Isfarayinī (d. 945/1538), ‘Ali b. Ḥasan Zavareī (d. 968/1560). The work was annotated by Le‘alī Aḥmed b. Muṣṭafa (d. 971/1563), Sayyid Ḥasan b. ‘Abdurraḥman (d. 1071/1661), Naẓifī Ismail Aqḥiṣarī (d. after 1205/1790), Shaykh-al-Islam Makkī Meḥmed (d. 1212/1797), Moḥammed b. Fayżullah (d. 1231/1816), Moḥammed b. Aḥmed (d. 1318/1900), Anqara Governor ‘Abidin Pasha (d. 1324/1906) in Turkish language. Takhmīs was written to the work by poets such as Ṭashkoprizade Kemaleddin (d. 1030/1621) Khocazāde Asad (d. 1034/1625), Sayyid Moḥammed Sharifī (d. 1040/1631), Shaykh-al-Islam Yahya (d. 1053/1644), Suleyman Naḥifī (d. 1151/1738), ‘Abdullah Ṣalaḥī (d. 1197/1783), Shaykh-al-Islam Makkī Meḥmed, Mollacıqzāde Raif (d. 1238/1823), Muṣṭafa Maqṣud (d. 1258/1843), Yemliḥazāde Muṣṭafa (d. 1294/1878), Meḥmed Said Pasha (d. 1308/1892), Moḥammed Favzī (d. 1318/1900) while Ismail Mufid (d. 1217/1803) wrote tesdīs and Niyazī-i Mıṣrī (d. 1105/1694) wrote tesbī‘ to it.The work was translated into Turkish language by poets such as ‘Abdurraḥim Qaraḥiṣarī (d. after 888/1483), Kemal Pashazāde (d. 940/1534), Ahmed-i Rıḍvan (d. before 945/1538) Le‘alī Aḥmed b. Muṣṭafa, Shamsaddin Sivasī (d. 1006/1597), Kemalatī Meḥmed (d. before 1015/1606), Esasī (d. before 1041/1631), Sayyid Ḥusayin (d. after 1050/1641), Mehmed Ṭalib (d. 1089/1679), Sukutī Meḥmed (d. 1103/1691), ‘Abdulhay Jalvatī (d. 1117/1705), Sulayman Naḥifī, ‘Abdullah Ḥulvanī (d. 1159/1746), Aḥmed ‘Arifī (d. after 1195/1781), ‘Abdullah Ṣalaḥī, Ismail Mufid, Sivaslı Aḥmed Suzī (d. 1246/1830), Evranyali ‘Abdurraḥim (d. 1282/1865), Meḥmed Said Pasha, Qonyalı Fakhreddin (d. 1365/1950), Sazai Qaraqoç (d. 1933), Ilhan Armutchuoghlu (d. 1937), Maḥmut Qaya (d. 1945), but there are also translations whose translators are unknown. The present study deals with such a translation of the work. To our best knowledge, the translation that has not been paid much attention by scholars to date and was mentioned only by Ṣadıq Yazar. Even he articulated only a few sentences about the translation based on a deficient copy of the work. Both in the library records and in its copies, there was no information about the translator and the translation date of the work. The translation, which beginns directly without a section such as an introduction at the opening, was written in 162 verses with the spelling of the classical period. It has a remel baḥr style of ‘arūż structure with fā‘ilātun fā‘ilātun fā‘ilātun fā‘ilun rhythm. Although it has some ‘arūż mistakes, it can be said that it is successful in terms of rhythm. Using the source text rhyme of mīm letter, the translator directly adapted some rhyme words from the Arabic text, while converting some others to appropriate Turkish words. Although he used some of them only once, he used some others several times. This finding implies that the translator may have had difficulties in finding words for the rhyme. It is noteworthy that he used some of those words in different meanings, and he employed 99 different rhymes in 162 couplets. The translator used the original text for purposes other than the rhyme words. He used some words directly without translating them or only removed the ḥarf-i ta‘rif. He transformed some words to others with the same stem or to their counterparts in Persian. While converting some of the phrases to forms suitable for the structure of the Turkish language using various practices, he used the old Anatolian Turkish as well as living Turkish. Like Buṣīrī’s eulogy, the poem, which consists of 10 parts in terms of contents, is suitable for the contents of the source text, but it is not a literal translation. The translator, who cared about literary rhetoric, largely preserved or even contributed to the harmony elements of the text. He reinterpreted the meaning of Buṣīrī’s work using his poetry skills, and produced a successful translation in terms of poetry with minimal rhyme flaws. Considering other translations of Qaṣeeda-i Burdah, the translation has similarities with that by Uskudarlı ‘Abdulhay Jalvatī in terms of rhyme letter, with that by Sayyid Husayin Amasī in terms of rhyme, and with that by Ismail Mufid Afandi in terms of direct adaptation of some words in original text, while it has common characteristics with the translation by Naḥifī in terms of both rhyme letter and direct adaptation of most rhyme words from the original text. On the other hand, the translation has similarities with the translations by Kemal Pashazāde, Ahmed-i Rıḍvan, Esasī Afandi, ‘Abdullah Ṣalaḥī and Na‘imī in terms of rhyme letter, rhyme and adaptation of most rhyme words from the original text. However, it is simpler compared to the translation by Kemal Pashazāde, more loyal to the content of original text compared to the translation by Ahmed-i Rıḍvan and more robust in terms of rhyme compared to the translation by Na‘imī. The authors argue that in the 1993 Duma elections it was the Communist Party of the Russian Federation, led by Gennady Zyuganov, that incorporated rhetorical values and audience adaptation into its campaign strategy. Finding its discursive ground limited by history, the CPRF gradually shifted its rhetorical posture and argumentative strategies, redefining itself in the process. This evolution allowed the CPRF to employ the ideographs of ’democracy‘, ‘will of the people‘, ’citizen‘, and other key terms of Western-style democracy, while retaining, (...) albeit in transformed meaning, traditional communist ideographs such as ’justice‘ and ’spirituality‘. In addition, the CPRF was able to borrow selectively from the history of the USSR between 1917 and 1989, thereby imbuing their political appeals with historical force and cultural memory. (shrink)
