Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Fazendo circular e acreditando na força que a palavra tem de desconstruir as ficções psíquicas e políticas que organizam nosso pacto social. Essa é a aposta que anima a (...) pesquisa cujos primeiros resultados estão neste livro. Partimos da hipótese de que o racismo é uma construção histórico-libidinal e que pode ser desfeita. Dentre os códigos fascistas que organizam o desejo, o racismo se destaca (dentre o machismo, a homofobia, por exemplo) por tentar situar a alteridade num determinado grupo de pessoas de forma a controlá-la, subjugá-la. Esse desejo de distinção provém, em grande medida, da angústia produzida pela presença da alteridade dentro do próprio sujeito. Há algo em um livro como o de Carolina que é preciso ser destacado: trata-se de uma resposta singular a um pacto social perverso, organizado pelo racismo. É preciso pensar nos efeitos afetivos que tal resposta, endereçada como um "diário de uma favelada", produz em cada um(a) de seus (suas) leitores(as). (shrink)

This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, judicial decisions, (...) official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart's jurisprudence. Indeed, the book's analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. The comparative conceptual analysis of the bio-power and bio-politics in the mentality of the modern technological civilization is a main method of the research. The methodological and philosophical analogy of biological and social engineering allows combining them in the nature and social implications (...) as part of a High Hume technologies class. As result of the transformation of somatic foundations of the human being and his behavior, stereotypes in the object of control and management the technogenic risk reached the existential level. In this article, I reconsider bio-essentialism in the study of kinship, centering on David Schneider’s influential critique that concluded that kinship was “a non-subject” (1972:51). Schneider’s critique is often taken to have shown the limitations of and problems with past views of kinship based on biology, genealogy, and reproduction, a critique that subsequently led those reworking kinship as relatedness in the new kinship studies to view their enterprise as divorced from such bio-essentialist studies. Beginning with an alternative narrative connecting kinship (...) past and present and concluding by introducing a novel way of thinking about kinship, I have three constituent aims in this research article: (1) to reconceptualize the relationship between kinship past and kinship present; (2) to reevaluate Schneider’s critique of bio-essentialism and what this implies for the contemporary study of kinship; and (3) subsequently to redirect theoretical discussion of what kinship is. This concluding discussion introduces a general view, the homeostatic property cluster (HPC) view of kinds, into anthropology, providing a theoretical framework that facilitates realization of the often-touted desideratum of the integration of biological and social features of kinship. Bio-ontologies are digital frameworks for handling biological and biomedical data. They consist of theoretical entities and relations with explicitly defined logical structures and precise definitions, whose purpose is to provide a shared language for representing information to be distributed and integrated across diverse scientific contexts. It is tempting to view bio-ontologies as clear and formal expressions of a scientific community’s ontological commitments about their domain of inquiry, and to view their integration as tantamount to the metaphysical unification of science that (...) some philosophers have envisaged. However, I argue that the local, practical, social and technological factors that influence their design prevent us from straightforwardly reading metaphysical conclusions from them. I discuss these complications and suggest how they can be overcome, revealing more general lessons for the development of a well-founded scientific metaphysics. (shrink)

Examining a variety of bio-objects in contexts beyond the laboratory, Bio-Objects: Life in the 21st Century explores new ways of thinking about how novel bio-objects enter contemporary life, analysing the manner in which the boundaries between human and animal, organic and non-organic, and being 'alive' and the suspension of living, are questioned, destabilised and in some cases re-established.

En este artículo trataremos de reflexionar, con la ayuda del filósofo español Ortega y Gasset, sobre la posibilidad de una bio-ecología que problematice algunos de los enfoques y premisas habitualmente asumidos en ecología. Tras mostrar que la filosofía orteguiana es una filosofía radicalmente ecológica —y una pionera en este aspecto—, mostraremos cómo las categorías de la razón vital armonizan perfectamente con algunos de los más recientes desarrollos biológicos que nos exigen pensar en conexión más estrecha a organismos y entornos.

La biopolítica ha devenido, sin duda, una de las categorías centrales para la reflexión política contemporánea. Dada su importancia, resulta imperioso avanzar sobre algunas operaciones teóricas que no logran dar cuenta de su especificidad, en tanto que administración de la vida como forma de dominación. Al respecto, y con la intención de rehabilitar la conceptualización de la política, nos interesa demostrar cómo la aparente dicotomía entre zoé y bíos que pretende discutir Agamben no encuentra respaldo en los textos que él (...) mismo utiliza (fundamentalmente, Aristóteles y Foucault), ni tampoco en la cristalización de tales categorías en prácticas sociopolíticas (por ejemplo, la disciplina moderna con sus raíces en el monasterio cristiano). Precisamente, la identificación de la zoé ya como forma de vida es lo que nos permite comprender el interés biopolítico por gestionar la vida biológica. Así, solamente habiendo clarificado estas categorías, podrá rehabilitarse un pensamiento político sobre la política. (shrink)

A prominent objection to non-cognitive moral bio-enhancements is that they would compromise the recipient’s ‘freedom to fall’. I begin by discussing some ambiguities in this objection, before outlining an Aristotelian reading of it. I suggest that this reading may help to forestall Persson and Savulescu’s ‘God-Machine’ criticism; however, I suggest that the objection still faces the problem of explaining why the value of moral conformity is insufficient to outweigh the value of the freedom to fall itself. I also question whether (...) the objection is compatible with Neil Levy’s parity principle. Accordingly, I go on to consider an alternative relational freedom-based objection to NCMBEs that aims to explain the fundamental moral importance of the freedom that NCMBEs would violate. I argue that although this strategy might allow the critic of NCMBEs to bypass a powerful criticism of Harris’ objection, it also weakens the freedom-based objection’s compatibility with the parity principle. Within the philosophy of biology, recently promising steps have been made towards a biologically grounded concept of agency. Agency is described as bio-agency: the intrinsically normative adaptive behaviour of human and non-human organisms, arising from their biological autonomy. My paper assesses the bio-agency approach by examining criticism recently directed by its proponents against the project of embodied robotics. Defenders of the bio-agency approach have claimed that embodied robots do not, and for fundamental reasons cannot, qualify as artificial agents because they (...) do not fully realise biological autonomy. More particularly, it has been claimed that embodied robots fail to be agents because agency essentially requires metabolism. I shall argue that this criticism, while being valuable in bringing to the fore important differences between bio-agents and existing embodied robots, nevertheless is too strong. It relies on inferences from agency-as-we-know-it to agency-as-it-could-be which are justified neither empirically nor conceptually. (shrink)

Synthetic biology, materials chemistry and soft robotics are fast becoming leading disciplines within the field of practices which look to nature for inspiration and opportunities. In this article I discuss how these molecular-scale practices fit within the existing trends of bio-informed design defined at the macro level, that is, bionics, biomimetics and more specifically biomimicry. Based on the metaphysical views underlying bio-informed design practices, I argue that none of them currently fit the biomimicry model, as they are not consistently concerned (...) with environmental sustainability. While biomimetic chemistry loosely belongs to the field of biomimetics, and soft robotics to the field of bionics, both practices have a profound impact on their respective fields, as they question the places of nature and engineers. This paper provides an overview of the origins, vicissitudes, and abandonment of ‘metapsychology’, the psycho-biological scientific core of the Freudian opus, and introduces the authors’ key revisions. Although couched in the language of metaphor and analogy from 19th century physics, the conceptual foundations of Freud’s theories contained the seeds of a bio-semiotic theory of mind and of human nature in the natural world. Today, new artistic practices incorporate scientific techniques linked to medical research that modify the body’s biological performance in vivo, transforming it into a singular laboratory object. In this way, some artists are making works of their bodies by subjecting them to various biotechnological procedures, often invasive. Augmented, the biological body of these performance artists becomes a site for experimentation. DIY (Do It Yourself) enthusiasts or accompanied by biologists and doctors, are these ‘bio-artists’ evidence of the changes brought about by a (...) new mechanisation of the human body, the complexity of which we are only just beginning to understand? Could there be, in the name of art, reasons that justify the creation of utopian bodies that are not eschatological, and that could make us believe in the worst or the best of all worlds? Based on performances by Stelarc, Yann Marussich, Marion Laval-Jeantet and the Quimera Rosa duo, our aim is to analyse what is at stake in this new fabrication of the body outside its biological limits. In this paper I argue that a Bio-Social conception of “race” is a socially salient conception within the United States. This conception is “socially salient” in the sense that is demonstrative of public understanding and public use of the race concept within context of the United States and its member institutions. The Aristotle-Kant tradition requires that autonomous activity must originate within the self and points toward a new type of causation (different from natural efficient causation) associated with teleology. Notoriously, it has so far proven impossible to uncover a workable model of causation satisfying these requirements without an increasingly unsatisfying appeal to extra-physical elements tailor-made for the purpose. In this paper we first provide the essential reason why the standard linear model of efficient causation cannot support the required model of agency: (...) its causal thread model of efficient causation cannot support the core requirement that an action is determined by, and thus an expression of, the agent’s nature. We then provide a model that corrects these deficiencies, constructed naturalistically from within contemporary biology, and argue that it provides an appropriate foundation for all the features of genuine agency. Further, we provide general characterisations of freedom and reason suitable to this bio-context (but that also capture the core classical conceptions) and show how this model reconciles them. Intended both as an introduction to the thought of the Italian philosopher Roberto Esposito and as a mapping of current biopolitical practice, this essay traces the contributions and the limits of recent Italian contributions to the discussion of biopolitics. The essay offers a summary of Esposito's insight into the relation of community and immunity and compares his thinking to other philosophers who take immunity as their object of study . Campbell goes on to read Esposito's privileging of bios in (...) the light of Giorgio Agamben's emphasis on zōē, while making reference as well to Antonio Negri and Michael Hardt's understanding of biopower. He concludes by arguing that the stakes of Esposito's analysis for an affirmative biopolitics concern fundamentally the nature of community and its opening to all life forms as bios. (shrink)

This essay builds on the literatures on ‘biocapitalism’ and ‘informationalism’ (or ‘informational capitalism’) to develop the concept of ‘bio-informational capitalism’ in order to articulate an emergent form of capitalism that is self-renewing in the sense that it can change and renew the material basis for life and capital as well as program itself. Bio-informational capitalism applies and develops aspects of the new biology to informatics to create new organic forms of computing and self-reproducing memory that in turn has become the (...) basis of bioinformatics. The paper begins with a review of the successes of the ‘new biology’, focusing on Craig Venter’s digitizing of biology and, as he remarks, the creation of new life from the digital universe. The paper then provides a brief account of bioinformatics before brokering and discussing the term ‘bioinformational capitalism’. (shrink)

Foucault coined the term biopolitics when thinking about political philosophy, this concept designates a double path: a) anatomo-politics (regulation of bodies) and b) biopolitics of the population (massification of behaviors). Among these notions, the police emerges: a device that is an apparatus of discipline and a state apparatus and characterizes modern political rationality as a “political technology of doctors” between the 17th and 18th centuries (Classical Era). This work, therefore, focuses on investigating the notion of police in Foucault’s writings from (...) the prism of a genealogy of the police as a bio-police and questioning whether this idea is born as 1) a device of repression, as one thinks, or 2) advocates a technique of improving state sovereignty and strengthening the state within the state. Christopher Boorse’s bio-statistical theory of health and disease argues that the central discipline on which theoretical medicine relies is physiology. His theory has been much discussed but little has been said about its focus on physiology or, conversely, about the role that other biomedical disciplines may play in establishing a theoretical concept of health. Since at least the 1950s, epidemiology has gained in strength and legitimacy as an independent medical science that contributes to our knowledge of health and disease. Indeed, (...) it not only provides important information about disease distribution and aetiology, but the risk-factor approach it employs seems to challenge BST’s binary conception of health and disease. The objective of the article is to show, firstly, how important information deriving from descriptive and analytical epidemiology forms part of our contemporary medical concepts of health and disease, and secondly, that these elements are not taken into account by BST in a satisfactory way. The article’s central contention, therefore, is that if the project of defining the theoretical concept of health is to be maintained, more importance should be accorded to the contribution made by epidemiology—alongside physiology—in defining health. Roberto Esposito is one of the most prolific and important exponents of contemporary Italian political theory.

Questions concerning moral problems caused by the lifesciences and concerning the adequate methods and instruments to solve these are timely and urgent; especially in the face of intense debates on the acceptability of research on human embryonic stem cells and preimplantation diagnostics, to name only two applications developed from research in the life-sciences. Unfortunately, the constant and accusing demand that life-scientists must behave morally does not give us a clue on how ethics may help in establishing guidelines for moral behaviour. (...) In this heated situation the foundation of ethics-committees seems to be the motto of the day. But instead of functioning as necessary and fruitful scientific advisory boards, these committees run the risk of being misused as a fashionable (and soon forgotten) weapon in the battle for political opinion-leadership. In the following article, the view is defended that ethics is a scientific enterprise and has an important role to play in political decision making on lifesciences issues. Since the 1960s the bio/technosciences have occupied a central place in philosophical thinking. The paper sets out three theoretical configurations embodying major challenges for today’s gender studies in philosophy, since they raise an obstacle, each in its own way, to the discussion on implications of the bio/technosciences in the political field and the area of gender theory: firstly naturalism in the field of the philosophy of science; secondly the paradigm of applied ethics; and thirdly the discourse of philosophical anthropology that (...) has been reactivated in philosophical debates about the bio/technosciences. Abstract Hannah Arendt frequently referred to herself as a phenomenologist in that she wished to reveal how action, in the Greek sense of praxis, engenders a public space of appearances or of phenomenality. The life of the Greek city?state, of the polis, was made possible through this activity, this bios politikos. However, beginning with Plato and continuing right down to Hegel and Heidegger, there has been a sustained attempt to cover up and conceal the specific phenomenality of the (...) class='Hi'>bios politikos in favour of the bios theoretikos, involving the substitution of poiesis and theoria for the life of praxis. At the roots of this concealment of the active life is a misunderstanding of the true nature of the theoretical and its highest form, namely, thinking. (shrink)

The purpose of this study is to present how ancient and modern thinkers describe politics and to discuss reasons for differences seen in these definitions. In the ancient period, the identification of human being as a political entity by nature caused politics to be seen as the most supreme of all human activities. For the ancient thinkers, politics is conceptualized as a pluralist area in which the common issues are discussed by equals and also which excludes inequality. Ancient thinker Aristotle (...) says that the purpose of politics is “good life”. However, modern political thought which began with Machiavelli identified politics with the concepts of force, power and violence. Politics is defined by Machiavelli and his successors as the legitimate organization of physical violence, the distribution of power, value and resources by authority. While in the Ancient Greece violence is excluded from the public-political sphere, It has become one of the central concepts defining the political society in the modern world. While the human being was defined as a political entity (zoon politikon) in the ancient period, it is usually seen as an economic entity (homo economicus) in the modern period. For the ancients good life means a life that is dedicated to politics; nevertheless, it has been often associated with econo- mic activity by the moderns. This study argues that the main difference between the political definitions of ancients and moderns stem from differences between their perspectives about the aim of human and human life. (shrink)
