Inference to the Best Explanation and Bayesianism have both been proposed as descriptions of the way that people make inferences. This paper argues that one result from cognitive psychology, the "feminist bank teller" experiment, suggests that people use Inference to the Best Explanation rather than Bayesian techniques.

This title was first published in 2000. Philosophers have been greatly concerned with the nature of explanation, but no account has been fully satisfactory within science or plausible in the wider world. The author asserts that this is due to a misplaced focus and that instead of focusing on explanation, philosophers should consider understanding. This work outlines his theory and defends it against some objections. Color charts, or grids of evenly spaced multicolored dots or squares, appear in the work of modern artists and designers. Often the artist/designer distributes the many colors in a way that could be described as “random,” that is, without an obvious pattern. We conduct a statistical analysis of 125 “random-looking” art and design color charts and show that they differ significantly from truly random color charts in the average distance between adjacent colors. We argue that this attribute generalizes results in (...) subjective randomness in a black/white setting and gives further evidence supporting a connection between subjective randomness and what is esthetically pleasing. Clinical ethics consultation has become an important resource, but unlike other health care disciplines, it has no accreditation or accepted curriculum for training programs, no standards for practice, and no way to measure effectiveness. The Clinical Ethics Credentialing Project was launched to pilot‐test approaches to train, credential, privilege, and evaluate consultants.

Purpose: We sought to examine the ethical, legal, and social implications (ELSI) literature research and scholarship types, topics, and contributing community fields of training as a first step to charting the broader ELSI community’s future priorities and goals. Methods: We categorized 642 articles and book chapters meeting inclusion criteria for content in both human genetics or genomics and ethics or ELSI during a 5-year period (2003–2008) according to research and scholarship types, topics, and the area of advanced training of (...) the first-listed author. Research and scholarship type categories were developed and characterized through in-depth review of 95 randomly sampled publications from the larger group. Results: There is a single dominant approach to ELSI, which focuses on ethical and other social issues “downstream” of advances in genomics, the contributors to which predominately have advanced training in medicine or science fields other than social science. A comparatively low percentage of publications primarily offer policy recommendations, and these are much more likely to be written by those with advanced training in law than is the case for the literature as a whole. Social science studies predominately employ qualitative methods and vary significantly with respect to the extent and types of recommendations offered. Two further types of ELSI research and scholarship offer alternative models for so-called “normative” work in this field. Conclusion: Considering topics, training, and types of ELSI research and scholarship from the most recent past allows for a baseline perspective that is sorely needed in charting this field’s future course. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. In my paper, I document a “travel” journey of concept formation and its concrete expression in law, which also constituted a literal travel journey across continents. Through poetic-hermeneutical approaches to language, guided by previously existing concepts stemming from experiences of the Holocaust, communism, and African-American feminist analyses of rape as an attack on a racial/ethnic group, a previously invisible domain of the human condition was charted. Throughout history, sexual atrocities have been committed within the context of wars, but their weaponisation (...) as acts of genocide remained unarticulated. This changed in the 1990s with Serbia-Yugoslavia’s genocidal wars against its neighbours (Editorial comment: The author uses the term Serbia-Yugoslavia to refer to the entity that succeeded the breakup of the Socialist Federal Republic of Yugoslavia after Croatia and Slovenia declared independence on June 25th, 1991. The SFRY up to that point consisted of the six republics Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Serbia (including the so-called autonomous regions of Kosovo and Vojvodina), and Slovenia. Further declarations of independence by Macedonia and Bosnia and Herzegovina on April 27, 1992, left only Serbia and Montenegro who the same day declared themselves to be the Federal Republic of Yugoslavia (FRY). In 2003, the Federal Republic of Yugoslavia was reconstituted as the State Union of Serbia and Montenegro, which existed until Montenegro and Serbia declared their independence (on June 3rd and June 5th, 2006, respectively)). I sketch the genesis of the concept of sexual atrocities as genocide in connection with my personal journey and how it guided legal prosecution of this “new” crime. My own travel-experience began with my association with Asja Armanda, and her discovery of coordinated mass rapes, when she came to the aid of survivors fleeing the Serbian attacks on Croatia, crimes she attempted to bring to international attention to prevent their expansion into Bosnia-Herzegovina and Kosovo. Testimonials reached me in the U.S. as well. I went to Croatia to join Armanda, where we named the crime “sexual atrocities as genocide.” On the basis of this new concept, we filed a lawsuit in New York against Bosnian Serb leader Radovan Karadžić, pioneering this crime’s recognition under international law. I conclude with philosophical questions that Putin’s similar genocidal attack on Ukraine raises today. (shrink)

Given how thoroughly the history of quantum physics has been excavated, it might be wondered what these two hefty volumes by a physicist (Duncan) and a historian (Janssen) bring to the table. Aside from their inclusion of a wide range of recent work in this area, including some notable publications by themselves, the answer is twofold: first, as they state explicitly in the preface to the first volume, derivations of the key results are presented ‘at a level that a reader (...) with a command of physics and mathematics comparable to that of an undergraduate in physics should be able to follow without having to take out pencil and paper’ (vol. 1, p. vi). In response to those who might raise Whiggish eyebrows, I shall simply play the ‘you-try-reading-Pascual-Jordan's-groundbreaking-work-in-the-original’ card. As the authors suggest, by using modern notation and streamlining derivations whilst also, they maintain, remaining conceptually faithful to the original sources (ibid.), the book is rendered suitable for classroom use, albeit at the higher undergraduate or graduate levels. In this work we give a complete answer as to the possible implications between some natural properties of Lebesgue measure and the Baire property. For this we prove general preservation theorems for forcing notions. Thus we answer a decade-old problem of J. Baumgartner and answer the last three open questions of the Kunen-Miller chart about measure and category. Explicitly, in \S1: (i) We prove that if we add a Laver real, then the old reals have outer measure one. This paper seeks to chart a concept of historical experience that French Romantic writers first developed to describe their own relationship to historical time: the notion of the “transitional period.” At first, the term related strictly to the evolving periodic conception of history, one that required breaks, spaces, or zones of indeterminacy to bracket off periods imagined as organic wholes. These transitions, necessary devices in the new grammar of history, also began to attract interest on their own, conceived either as (...) chaotic but creative times of transformation, or, more often, as slack periods of decadence that possessed no proper style but exhibited hybrid traits. Their real interest, however, lies in their reflexive application to the nineteenth century itself, by writers and historians such as Alfred de Musset, Chateaubriand, Michelet, and Renan, who in their effort to define their own period envisioned the “transitional period” as a passage between more coherent and stable historical formations. This prospective self-definition of the “age of history” from a future standpoint is very revealing; it shows not just the tension between its organic way of apprehending the past and its own self-perception, but it also opens a window on a new and paradoxical experience of time, one in which change is ceaseless and an end in itself. The paper also presents a critique of the way the term “modernity” has functioned, from Baudelaire’s initial use to the present, to occlude the experience of transition that the Romantics highlighted. By imposing on the nineteenth-century sense of the transitory a heroic period designation, the term “modernity” denies precisely the reality it describes, and sublimates a widespread temporal malaise into its contrary. The paper concludes that the peculiarly “modern” mania for naming one’s period is a function of transitional time, and that the concept coined by the Romantics still governs our contemporary experience. Migrations driven by ethnic, religious, and other forms of social conflict have been common in the past quarter-century, and have in Africa led many to seek refuge and to expect hospitality abroad. This leads to a concern for pluralist ethics, for many receiving refuge abroad expect that they will be able to live by their thoughts and beliefs, creating enclaves of cultural difference. But difference exists in all communities: cultural homogeneity does not exist except in the conservative imagination. Nevertheless, a (...) sameness – the sameness of the value of every person – remains within this plurality. The sameness is conceived in distinct ways in the Natural Law tradition that yields liberalism, in the Golden Rule, in Kant's categorical imperative, and in the Luo culture of Eastern Africa. The Luo precept Luoro remb dhano is compared with these other ethical cosmopolitan wellsprings in this essay. (shrink)

Hurley is right to reject the dichotomy between intentional agents and mere stimulus/response habit machines, and she is also right in thinking that it is important to map the space of systems for the adaptive control of behaviour. So there is much in this paper with which I agree. My disagreement concerns folk psychology. Hurley thinks that control space can be charted by asking whether and to what extent animals are intentional agents. In contrast, I doubt that the concepts of (...) folk psychology, especially folk psychology construed as an interpretative practice, are the right mapping tools. If the main function of folk psychology is to make sense of one another, coordinate joint action, or make decisions about moral and legal responsibility, then there is no point in applying folk psychological notions to nonhuman minds. These interpretative functions simply do not arise for our interaction with nonhuman minds, and if folk psychology serves largely as a social tool serving them, there is no need to apply it to nonhumans, nor is there a reasonable expectation that we can usefully do so. If folk psychology does not even carve our sensing and control mechanisms at the joints, if it is not a good theory of human cognitive architecture, then it is not likely to be wellsuited for describing those of nonhuman agents. The global pandemic needs to mark a turning point for the peoples of Aotearoa New Zealand. How can we make sure that our culturally diverse nation charts an equitable and sustainable path through and beyond this new world? In a less affluent future, how can we ensure that all New Zealanders have fair access to opportunities? One challenge is to preserve the sense of common purpose so critical to protecting each other in the face of Covid-19. How can we centre (...) what we have learnt about resilience within Māori and wider Pacific communities in our reforms? How can public understanding of Covid-19 science create a platform for the future social valuing of expertise? How can we ensure that the impact of Covid-19 in New Zealand results in a more sustainable, and inclusive workforce–for instance by expanding our perceptions of the value of our workers through promoting digital inclusion? To meet these challenges, we must reimagine our existing traditions of thought, breathing new life into perennial concepts and debates. Our paper indicates some of the ways that Philosophy is central to this collective reimagining, highlighting solutions to be found across our rich philosophical traditions. (shrink)

Empirical moral psychology is sometimes dismissed as normatively insignificant because it plays no decisive role in settling ethical disputes. But that conclusion, even if it is valid for normative ethics, does not extend to bioethics. First, in contrast to normative ethics, bioethics can legitimately proceed from a presupposed moral framework. Within that framework, moral psychology can be shown to play four significant roles: it can improve bioethicists’ understanding of the decision situation, the origin and legitimacy of their moral concepts, efficient (...) options for implementing decisions, and how to change and improve some parts of their moral framework. Second, metaethical considerations suggest that moral psychology may lead to the radical revision of entire moral frameworks and thus prompt the radical revision of entire moral frameworks in bioethics. However, I show that bioethics must either relinquish these radical implications of moral psychology and accept that there are limits to progress in bioethics based on moral psychology or establish an epistemic framework that guides radical revision. This essay responds to Badiou's charge that Deleuze fails to set forth a philosophy that is “beyond Gategorical oppositions.” It is argued that this criticism of Deleuze is founded upon a misreading of the Deleuzean distinction between the virtual and the actual, a reading that carries forward Badiou's misreading of Spinoza and, hence, of Deleuze's Spinozism. With this corrected, we show how the virtual‐actual distinction operates within the experimental philosophy, or pragmatics, that Deleuze, and later Deleuze and Guattari, sets forth. (...) It is this pragmatics that is precisely the philosophy of difference that is beyond categorical oppositions. Through a comparison of Deleuzean pragmatics with the work of Hume and Peirce, we are able to respond to Badiou's further criticism that Deleuze's philosophy fails to understand the conditions for creativity in thought and culture. This criticism is itself resolved once one corrects for Badiou's misreading of Deleuze's virtual‐actual distinction. (shrink)

The effort to understand speech perception on the basis of relationships between acoustic parameters of speech sounds is to be recommended. Neural specializations (combination-sensitivity) for echolocation, communication, and sound localization probably constitute the common mechanisms of vertebrate auditory processing and may be essential for speech production as well as perception. There is, however, no need for meaningful maps.

This book examines alternative philosophical conceptions of legal interpretation as a way of making sense of international human rights as they bear on government and multinational business activities. Today the dominant philosophies of law pertaining to rights interpretation are positivism, realism, and law-as-integrity.

Even with the rich inventory of GVV cases available, faculty may want to develop their own teaching materials. One option is to add GVV questions onto current teaching notes for existing cases to bring in an ethical dimension or to flesh out the complexity of a decision. Another option is to write your own case entirely. This article discusses the benefits of both paths, and shares best practices for doing so.

It is generally accepted that appropriate documentation of activities and recommendations of ethics consultants in patients’ medical records is critical. Despite this acceptance, the bioethics literature is largely devoid of guidance on key elements of an ethics chart note, the degree of specificity that it should contain, and its stylistic tenor. We aim to provide guidance for a variety of persons engaged in clinical ethics consultation: new and seasoned ethics committee members who are new to ethics consultation, students and trainees (...) in clinical ethics, and those who have significant experience with ethics consultation so that they can reflect on their practice. Toward the goal of promoting quality charting practices in ethics consultations, we propose recommendations on a broad array of questions concerning clinical ethics consultation chart notes, including whether and when to write a chart note, and practical considerations for the tenor, purpose, and content of a chart note. Our broader aim is to promote discussion about good charting practices in clinical ethics, with the hope of contributing to clear standards of excellence in clinical ethics consultation. (shrink)

The article presents a new theory for the subdivision of human thought into four domains that are experientially and operationally discrete and are elaborated by activity in four anatomically definable areas of the dorsolateral prefrontal cortex. I propose that these areas constitute the Social, Material, Temporal anddivisions of the mind and that their sequential maturation accounts for the cognitive stages of childhood. The Social Mind ) is responsible for our emotional intelligence. The Temporal Mind enables us to contemplate the future (...) in terms of a sequence of manageable sub-goals. The Material Mind is responsible for our practicality. The Abstract Mind enables us to comprehend possibility and generate hypotheses. Because recent neurogenetical studies show the powerful influence of genes in controlling the size of the areas of Brodmann, I suggest further that variation in the size of these areas provides an explanation for the genetic basis of personality and many of the so-called cultural differences apparent between long-isolated human populations.
